THE RIGHT TO TRY<br />

Before the “Right to Try” law became federal law in May, 2018, 40<br />

states had already enacted their own Right to Try laws, which allow<br />

certain patients to bypass the FDA and gain access to drugs that have<br />

already completed phase 1 clinical trials. These laws allow patients with<br />

life-threatening illnesses to have access to experimental treatments after<br />

the drugs are tested for the first time on a small sample of healthy people<br />

who do not have the targeted conditions in order to calculate proper<br />

dosages and other significant side effects. While the law gives patients<br />

and their physicians the right to ask for a developmental drug, manufacturers<br />

are not required to provide it.<br />
