PASADENA AMENDING CHAP-<br />
TER 5.45 (SEXUALLY ORIENTED<br />
BUSINESSES) OF THE PASADENA<br />
MUNICIPAL CODE<br />
The People of the City of Pasadena<br />
ordain as follows:<br />
SECTION 1. This ordinance, due<br />
to its length and corresponding<br />
cost of publication will be published<br />
by title and summary as<br />
permitted by Section 508 of the<br />
Pasadena City Charter. The approved<br />
summary of this ordinance<br />
is as follows:<br />
“SUMMARY<br />
Ordinance No. 7340 will amend<br />
Chapter 5.45 (Sexually Oriented<br />
Businesses) of the Pasadena Municipal<br />
Code to update the City’s<br />
regulations for sexually oriented<br />
businesses and their employees<br />
to prevent the negative secondary<br />
effects associated with such enterprises.<br />
The ordinance amends<br />
defi nitions and licensing procedures<br />
to update the regulations<br />
and conform with court decisions<br />
in recent years since the regulations<br />
were originally adopted.<br />
Ordinance No. 7340 is necessary<br />
for the immediate preservation<br />
of the public peace, health, and<br />
safety, and shall take effect upon<br />
publication.”<br />
SECTION 2. The City Clerk shall<br />
certify the adoption of this ordinance<br />
and shall cause this ordinance<br />
to be published by t”tle and<br />

Zoning Code Amendment<br />
Relating to Regulation<br />
of Sexually Oriented<br />
Businesses<br />
SUBJECT: On March 4, 2019, City<br />
Council adopted an amendment to<br />
Title 5, Chapter 5.45 of the Pasadena<br />
Municipal Code (PMC) to<br />
update business license and regulations<br />
relating to sexually oriented<br />
businesses. Prior to this, the sexually<br />
oriented business provisions<br />
in the PMC had not been updated<br />
since 2006. Changes in the law<br />
that apply to such businesses, and<br />
in the sexually oriented business<br />
industry itself, require an update<br />
and modernization of the PMC<br />
sections that govern these uses.<br />
Amendments are being proposed<br />
to the sexually oriented business<br />
provisions in Title 17 (Zoning<br />
Code) to bring the Zoning Code<br />
into consistency with the recently<br />
adopted Title 5 amendments.<br />
PROJECT LOCATION: All properties<br />
within the City of Pasadena.<br />
ENVIRONMENTAL DETERMI-<br />
NATION: The City Council will<br />
consider whether adoption of the<br />
proposed Zoning Code Amendment<br />
is exempt from the California<br />
Environmental Quality Act (CEQA)<br />
under Section 15061(b)(3), the<br />
“general ruleî that CEQA applies<br />
only to projects which have the<br />
potential for causing a signifi cant<br />
effect on the environment, and<br />
that where it can be seen with<br />
certainty that there is no possibility<br />
that the activity in question<br />
may have a signifi cant effect on<br />
the environment, the activity is<br />
not subject to CEQA. Since the<br />
proposed activity would not expand<br />
the locations in which these<br />
land uses may locate beyond what<br />
is currently allowed, there is no<br />
possibility that the amendments<br />
will have a signifi cant effect on the<br />
environment.<br />
Planning Commission Recommendation:<br />
On February 27,<br />
2019, the Planning Commission<br />
reviewed the proposed Zoning<br />
Code Amendment and recommended<br />
that the City Council fi nd<br />
that the Zoning Code Text Amendment<br />
is exempt from the California<br />
Environmental Quality Act (CEQA)<br />
pursuant to the CEQA Guidelines<br />
Section 15061(b)(3) and adopt the<br />
proposed amendment.<br />
