THE WAY BURGERS WERE MEANT TO BE MADE
OUR main focus - by making sure our goal, maintaining the competitive
fast-casual dining by serving high quality, never frozen patty at a great
‘value’ will always stay true and make Wayback Burgers Malaysia
unique from our competitors.
Wayback Burgers is uncomplicated and honest. It reflects its customers : hardworking people who want
simple uncomplicated things: A great burger, fries or chips, and a delicious hand-dipped milkshake. The
comfortable, welcoming environment makes the shorts wait for made-to-order meals that much easier.
The hallmark of a good burger is that is nice and juicy when you bite into it, and you just can’t get that
juiciness if only use lean ground beef, which will cook up dry and tough. Burgers are usually cooked at
fairly high temperature to get a nice crust and/or char on the outside, but to keep the inside moist, you
need fats. Our imported (Halal) Chilled Chuck Tender 100% grain-fed from Australia, is cut to cube,
ground and blended to a ratio of 80 percent lean and 20 percent fat (±5%). No added salt, sugar, spice;
nothing just freshly hand-patted ground beef, flattened the old-style and cooked to order.
A “must try” Cheeeesy Burger - inverted grill bun with 4 slices of cheese, will sure tantalize your taste
buds. When come to our sides, our fries are made from 100% USA potatoes; skin-on with no add on
salt. While the onion rings are hand battered and serve on it owns or on a burger. Wayback Burgers is
indeed one of its kinds by serving only freshest ingredients possible. If you are craving for burger that
are freshly made to order, with never-frozen beef patties that are grilled to perfection, then look no
further as this is the way to go.
We are also welcoming anyone that are interested to become our franchisee or to learn more about our
products or franchise system. Feel free to reach us at info@waybackdelights.com or visit our restaurant
in Melawati Mall at Level 3-16B or Wisma Lim Foo Yong at Ground Floor.

Global Franchises Ranking
The Top 100 Global Franchises ranking gives you a glimpse at
how some of the most successful franchises across the world
have fared throughout the past year. This ranking is especially
focused on franchises that have gone international and
operate in more than one country.
The ranking formula uses sales instead of total revenue, with
percentage unit growth also noted as a factor. This makes it
easier to identify new up and coming franchises as they will
usually start with smaller systems and fewer outlets than their
more experienced contemporaries.
Below is a list of the Top 100 Global Franchises as well as a brief
summary of some of the more interesting franchises within.
The Top 10
#1
McDonald’s has once again reached the number one rank
in the 2019 Top Franchises list. This international franchise
has been a top contender since the very first listing, and even
during its down periods McDonalds has never dropped below
the top 3.
Though it’s far from the oldest franchise, the success of
McDonald’s has certainly had some significant effects on the
industry. As the pinnacle of the fast food franchising sector,
the McDonalds network has flourished based on three main
characteristics: Consistency, Innovation, and Resiliency.
Burger King moved up to second place last year due to their
recent expansion projects in South America. Chief Executive
Officer of BK Brazil SA Iuri Miranda recently announced that
there are now well over 900 Burger King restaurants open in
Brazil, with a new site opened every three to four days.
As food delivery services become ever more popular, Pizza Hut
has moved up to the number three spot by quite literally taking
the show to the road. In October 2018, they partnered with
Toyota to debut the Tundra Pie Pro – a new zero-emission vehicle
that contains a working pizza kitchen in the truck bed.
This revolutionary
design has resulted in
a mobile kitchen that
can create pies in less
than 10 minutes. Pizza
Hut has claimed that
the development of the
Tundra Pie Pro allows
them to bypass the
normal restraints of a
typical delivery radius
and deliver freshly
made meals to their
customer’s door.
Using their extensive portfolio of 30 brands, Marriott
International signed management and franchise agreements for
over 800 properties last year. The hotel franchise has benefited
from the rise in international travel, with a record number of
room signings reported in locations throughout the world. In
places like Europe, the Middle East, Africa, and the Asia-Pacific
region, they’re seeing more travellers than ever before.
Another massive fast food franchise, KFC have been taking steps
to improve their employee quality by integrating cutting edge
technology into their training process. Their Chicken Mastery
Certification training now includes a VR (virtual reality) game
called “The Hard Way”.
This escape room style simulation involves completing a number
of mini games based on the 5 steps of the franchise’s signature
chicken-frying process
under the watchful eye
of an animated Colonel
Sanders. The Hard Way
VR is used to supplement
the franchise’s regular
hands-on training
process and ensure that
their employees can
complete their training
quickly and efficiently.
The famous donut making franchise has decided to remake itself over
the New Year. They plan to change their name by formally dropping the
word “Donuts” from their branding and just go by “Dunkin”.
According to Tony Weisman, the Chief Marketing Officer for the
franchise’s U.S operations, this move is meant to simplify and modernize
their brand name while still paying homage to their heritage.
The ubiquitous 7-Eleven franchise is by far the largest franchise network
by number of units. As they enter 2019, this franchise aims to enhance
their brands customer experience via modern technology. Aside from
digital payment options, 7-Eleven are also looking into smartphone apps,
social media customer service bots, bill payment services, and more.
#8
#10
Subway had a rather shaky start in 2019, with
plenty of changes occuring in the upper levels of
their franchise. Not only are they searching for a
new CEO, but James Walker, their vice president
of North American operations, stepped down in
January while chief marketing officer Joe Tripoldi
retired at the end of 2018.
Dominos moves up to the top 10 list based
on the recent revamp of their business model
to become more technologically and digitally
focused. This move has paid off tremendously,
with around 65% of their orders now coming in
through digital sales.
This pizza franchise have bold ambitions,
including an expansion plan that aims to add
10,000 new outlets by 2025. At least 2,000
locations are planned in the US alone, with the
remainder spread out across the world.
Rising into the top 10 list, Baskin-Robbins is
rolling out a new store concept later this year.
The ice cream franchise hopes that this concept
will “help guests create joyful moments with
family and friends while enjoying great-tasting
ice cream and amazing flavor variety”.
start in Philadelphia. Their founder and CEO Charley Shin actually
opened his first restaurant near the Ohio State University campus. With
their emphasis on delicious, good quality food, Charleys Philly Steaks
quickly became a big hit. Now they currently own nearly 600 locations in
17 countries, with Charleys outlets in retail shopping centers, airports,
and strip centers worldwide.
The world’s fastest growing functional training network, F45’s franchise
grew from 545 to 900 outlets last year – a whopping 65.1% growth rate.
This expansion has been based on a simple concept: F45’s studios
offer their members a variety of 45 minute high intensity circuit training
workouts, with a different workout for every day of the week. Each workout
is designed from a database of over 3,000 different exercises, meaning
that no two workouts are ever the same.
Interview
Redesigning
Islamic
Preschool
Globally
Zaliza Alias, founder of
GENIUS AULAD
When GENIUS AULAD was established 20
years ago, it unveiled a fresh take on what
Islamic early childhood education could
be. Appealing to discerning parents who
want education to go hand in hand with
wholesome spiritual values and creative
learning, the concept took on like wildfire.
Today, there are 71 GENIUS AULAD outlets
nationwide and in Indonesia, and the
numbers are growing. We speak to Zaliza
Alias, GENIUS AULAD’s dynamic founder
about her passion and vision for the
preschool, and how she plans to take it to
greater heights.
■ Can you share a little about yourself and
what inspired you to start GENIUS AULAD as a
business and also your decision to embark on a
franchising model?
20 years ago, wholesome early childhood education is something
that is almost unheard of. In those days, there was more emphasis
on how-tos and technicalities. Children were graded based on
quantity i.e., how many words they memorised or pages they read,
rather than quality and the intrinsic value that they gained from
the activity. You can’t measure that by the number of pages!
I also saw a need for preschools to be seen as a professional
industry and for preschool teachers to be seen as professionals
in their own right. After all, they play an important role in developing
young minds. I believe that it is important to be the change we
want to see around us rather than to wait and see, and so I decided
to take up the challenge to bridge the gap to provide quality early
childhood education based on a character-building framework
and Islamic values.
We expanded into our first branch five years into the business in
2005 and ventured into franchising in 2008. We decided to grow
organically rather than expand aggressively because in this industry,
it is vital to have the right people and a well-equipped system on
the onset. While it is important to grow the business, we need
franchisees who will never lose sight of our mission and passion
in educating the children.
■ Can you describe briefly about GENIUS
AULAD Learning System - the GENIUS AULAD
Preschool, GENIUS AULAD Beyond Preschool
and GENIUS AULAD Play-school and how they
are different from other early childhood
education programmes?
GENIUS AULAD Learning System is built to cater to children as soon
as they are independent enough to be in a group setting. As such,
we created a learning system that addresses the needs of children
in different stages of development. Our playschool is designed for
children between the ages of 2 ½ to 3 years old, while preschool
caters to children from the ages of 4 to 6 years old. With the
increasing demand from working parents to place their child in
full-day childcare centres, we have developed the GENIUS AULAD
Beyond Preschool programme to fulfil this full-day educare need
while providing a more relaxed learning environment for the child.
As seasoned early childhood education practitioners, we acknowledge
that literacy plays a big role in a child’s development. And through
our 20 years of extensive experience and research, GENIUS AULAD
has developed a unique method in developing a child’s literacy skills
Interview
■ Can you share more about the iLOVE Lesson
Plans and how it functions?
In the two decades that we have been in this business, we have
seen the shift of parental expectations towards their children. 10
years ago, parents want their children to be able to read as early
as 3 years old, but now the demand has shifted to a balance of
character-building that goes hand-in-hand with academic excellence.
Hence, GENIUS AULAD iLOVE (Islamic, Literacy, Original Arts,
Value and Excitement) lesson plan is based on the love and care
character-building and practical life skills, which is an important
part of development for toddlers. Activities may range from the
excitement of play pretend to various ways of expressing their
feelings. The lesson plans are compact and include fun play,
songs, reading and games. Our energetic teachers make sure the
students’ different needs are fulfilled and that they experience a
happy learning environment.
■ In your opinion, what are the advantages of
home-grown pre-school programmes compared
to foreign ones?
Every country has its own unique culture that impacts education
needs. However, the basic need to build literacy skills is the same.
The differentiating factor is the methods used to facilitate this
learning need.
A home-grown preschool caters to the needs of the local children.
The environment plays a major role in the development of children.
Children learn best through various methods like playing, drawing
storytelling and more, rather than just through books alone.
At GENIUS AULAD, we tailor our learning programmes to suit our
international markets. For example, at our Indonesian centre, the
content of the programme is tweaked to resonate with the culture
of the local children there in order to make learning more effective.
GENIUS AULAD Learning System includes various parental
involvement so there are various values being shared to enrich
the school’s learning environment and culture.
■ How has the reception been towards these
tailored programmes?
We believe that every child develops at their own pace. At GENIUS
AULAD, each student will have a one-to-one reading session with
their teachers on a daily basis. Over the years, parents have testified
that it has helped their children in developing their reading skills.
This one-to-one session also involves communications and
interactions which make reading meaningful and wholesome for
the children.
■ How does one become a GENIUS AULAD
franchisee and what are the benefits and
support a franchisee can expect to receive?
The first step on becoming a GENIUS AULAD franchisee is easy:
just log on to our website and submit your application. You will then
be invited to attend our Franchise Briefing.
GENIUS AULAD is very careful in providing the highest level of
education quality consistently throughout the years. As such, we
are very selective in choosing our franchisees as we would like to
ensure that they are not only looking to venture into a business but
most importantly, they need to have what it takes to be an educator.
This is because only those who are passionate in education would
understand what it takes to operate our school and to ensure that
all of the students are getting the same level of education quality,
no matter which GENIUS AULAD centres they are enrolled in.
Every GENIUS AULAD centre will need to adhere to the standard
GENIUS AULAD centre kit, where every centre will have the
standardised interior design, safety features, educational materials,
lesson plans and events line-up. We will also train the teachers
twice a year on how to provide care and education to the children.
This will not only ensure that the same level of education quality
can be met but most importantly, new franchisees who are looking
to open up a GENIUS AULAD learning centre will not need to go
through the stress of starting the business from scratch. Additionally,
we will guide and help the franchisee every step of the way on their
journey with GENIUS AULAD.
■ What are the traits that a franchisee should
possess to succeed in this business?
Our main goal in this business is to play a partnership role with
parents in their parenting journey. So, I would say the most important
trait to become a member of GENIUS AULAD is passion.
GENIUS AULAD bridges the gap to provide quality early childhood
education based on a character-building framework and Islamic values.
A good franchisee will always put the children first. Only with passion
can a good franchisee work towards providing a high quality of
education. This is an important part to thrive in the education sector
as we need to build trust and rapport with our parents. We treat
our franchisees as part of our family, and we respect each other’s
professional guidelines and boundaries, so we enjoy a warm and
pleasant working environment.
12 Franchise Asia • 2019 Vol 36
Interview
GENIUS AULAD facilitates our children’s learning by understanding how they learn, their abilities,
needs and interests.
■ As you celebrate your 20th anniversary this
year, can you share some of the milestones and
achievements in your GENIUS AULAD journey?
To date, we have nurtured more than 75,000 children. We have
been constantly growing for the past 20 years at a minimum rate
of 15%. We hold the record of zero-closure of franchise centres,
with franchisees being with us for more than 10 years and growing
more centres. For the past several years, we have received numerous
awards for Best Preschool at the national level.
character-building on top of basic literacy
skills. Through GENIUS AULAD, my aim has
always been to make consistent
improvement in the happiness of learning.
For our relentless passion, GENIUS AULAD
has also been entrusted as the Education
Consultant for various children’s talent TV
programmes and animations, such as the
recent phenomenal animation Omar & Hana
on ASTRO channels in Malaysia as well as
several international TV channels.
■ Being in the industry for
two decades, what are your
observations of the changes
in educating the children of
today and how can GENIUS
AULAD continue to play a
significant role in the nation?
I would say that the children of today are
more empowered and have no qualms in
exercising their right to choose as opposed to kids of yesteryears
who would ask for guidance to, say, colour a drawing in a certain
way. As such, the education system should evolve around this
change. As educators, we facilitate our children’s learning by
understanding how they learn, their abilities, needs and interests.
This has always been the very foundation of GENIUS AULAD and
as we expand and grow, we will definitely make an impact in the
nation and region.
In 2018, we grew beyond our borders with the opening of our first
international outlet in Indonesia. Currently, we plan to expand
overseas and are looking for partners, joint ventures or Master
Franchisees to collaborate with us.
■ Where do you see opportunities in terms of
locations, demographics, etc., that GENIUS
AULAD can expand to?
Within Malaysia, we are expanding steadily to meet the demands
of our local market both within the city centre and the outskirts of
the city centre. At the same time, we have also noticed that the
need for Islamic education is increasing within the ASEAN countries,
and as such, we are looking to meet this demand.
■ What motivates you to keep pressing on in
growing your business to greater heights?
No two days are the same, so you don’t get bored in this business!
When it comes to early childhood education, there’s always
something new to learn and explore. I’m still very much hands-on
and involved in clowning and puppeteering activities with the
children. It’s amazing how things appear when we see them through
their eyes. It keeps my perspective fresh.
When we first started the business, early childhood Islamic education
was not at the forefront of the industry. So in that sense, we were
the pioneer in that field. What I had and still have is an unwavering
belief and passion to develop quality and reputable Islamic
preschools that incorporate aspects of creative learning and
Interview
Left to right - Dr Lim and Dr Aung Than welcome you to their restaurant
Leading A Burger Revolution
What happened when two medical doctors decided to team up and take their first plunge into
the world of franchise? They became the first franchisees of the most exciting fast-casual burger
franchise concept to hit our shores: Wayback Burgers.
Franchise Asia speaks to Dr. Lim Liat Woi and Dr. Aung Than (Drs) about their experience being
first-timers in the franchisee world, and Christine Lee (Christine), General Manager of Wayback
Delights about the brand and its franchising programme.
■ Can you share how Wayback Burgers came
into being and how the brand has grown since
its inception?
Christine: Wayback Burgers (then known as Jake’s Hamburgers)
first opened in Newark, Delaware, in 1991. The burgers were so
delicious that it wasn’t long before some more Jake’s Hamburgers
opened up.
Eventually, to avoid confusion with another smaller restaurant chain,
the name ‘Jake’ was dropped. The Wayback Burgers franchise now
has 155 domestic restaurants in 30 states with several additional
restaurants around the world. All in all, there are more than 500
development deals in place. So, Wayback Burgers may or may not
be a household name (it depends whose house you live in) today,
but it will be…and very soon!
■ When did Wayback Burgers come
to Malaysia?
Christine: Wayback Burgers opened its doors in Malaysia in July
2017 in Taman Melawati, Kuala Lumpur. Retaining the same
freshness and tasty burgers people have long enjoyed in America
with some new meals to complement the local tastes, Wayback
Burgers Malaysia has garnered a significant number of regulars
that just can’t resist their scrumptious menu.
Wayback Delights is the locally owned company which holds the
Master Franchise License of Wayback Burgers in Peninsular
Malaysia. This company is owned by a group of friends who likes
to eat burgers. They also have more than 20 years of experience
in retail and marketing.
14 Franchise Asia • 2019 Vol 36
Interview
■ What would you say are the key factors that
potential franchisees look for in an F&B
franchise business?
Christine: When people look at a restaurant, they tend to focus on
the business model, menu and food. They also put a high emphasis
on how the company is run, what it takes to keep the business
going smoothly and the management methods that can help the
company achieve long-lasting success.
This was why we only started to sell the franchise license after 7
months into operation. Although we have the product standard
operating procedures (SOP) from the USA, we are serving food to
Malaysians and thus, the expectations and requirements are
different in their own way. We also need to evaluate our suppliers
to make sure that there are no hiccups on the supply side of things.
The first franchise license was bought by two certified medical
doctors, Dr. Lim Liat Woi and Dr. Aung Than. They opened their
first franchise restaurant on 26th August 2018 at Wisma Lim Foo
Yong, Jalan Raja Chulan, serving the busy CBD at the heart of
Kuala Lumpur.
■ What made you venture into F&B franchising?
Drs: Being medical doctors, we wanted to diversify by stepping into
the “real business” world. Having owned two private clinics, we
decided that it is best to start a F&B business as we could pass it
down to our children or spouses as they do not need to be certified
nor even have the knowledge about cooking in order to run the
business, as opposed to owning a clinic. When it comes to early
retirements, doctors may face a hindrance as our job requires us
to attend to our patients every time we are needed. By owning a
business that is time flexible, we have the option to retire early and
still be generating an income.
■ Why did you choose Wayback Burgers as
your foray into F&B franchising?
Drs: Wayback Burgers is famous for their fast-casual service,
providing only the freshest ingredients on their menu. The variety
of quality products combined with excellent service are what makes
Wayback Burgers stand out from other F&B companies. Their
popular handmade groundbeef
patties using only Chuck
Tenders imported from
Australia and the hand-dipped
milkshakes are the signatures
of the company.
We chose Wayback Burgers because we
are impressed with the brand’s variety
of quality products and excellent service
In addition, Wayback Burgers’
menu is crafted for everyone.
They have a specific menu that
caters to guests that are vegan
and vegetarian. The Craft-
Your-Own section further
complements the menu,
enabling guests to have their
own burgers to be precisely
and specifically ‘built’’ only
for their tastebuds. As an
initiative to attract local hungry
customers, Wayback Burgers
Malaysia is certifed Halal by
Jakim and has localised their
selection of food on the menu.
The addition of Cili Padi in the
sauce selection and the
choice of using chicken for
their frankfurters is to better
suit Malaysia’s local tastes
from the different backgrounds
of religions and races. The
competitively priced menu
coupled with amazing
products enable everyone to
have a wonderful meal time
at Wayback Burgers.
The outlet at Wisma Lim Foo Yong
Wayback Burgers are freshly made
and never frozen
To us, it’s all about the product, the service and the investment.
The total investment is relatively low for a fast-casual restaurant
compared to other American brands. Most importantly, we do not
need to import any spices or sauces from America. All the spices
are available locally.
■ How has your experience been in opening a
Wayback Burgers restaurant?
Drs: There is not much involvement required from us in order to
open a Wayback Burger restaurant as the master franchisee will
send an operation personnel to assist us from the very beginning
until the very end. From real estate selection (location sourcing) to
leasing negotiations, especially in rental negotiations, it will all be
handled by the master franchisee. In fact, our current outlet is
secured entirely by the master franchisee. We didn’t even meet the
landlord until the day we are needed to pay the deposit and sign
the leasing agreement.
The master franchisee will take charge of basically everything that
is needed for the new restaurant, including renovation supervision,
initial stock ordering, equipment, furniture and restaurant set-up.
They even sent us weekly renovation updates. For items that will
be supplied to the restaurant (except beef products), they will be
sourced from local suppliers and will not be imported from the
United States. Furthermore, marketing materials, as well as thorough
training for future employees will be provided and planned well
before the restaurant’s opening. Also, ongoing support that include
weekly visits, sales analysis, local restaurant marketing, and
assistance in ordering will be done by the master franchisee.
Interview
■ Can you share more about the support you
receive as a Wayback Burgers franchisee?
Drs: The support given by the master franchisee cover a few aspects
before the opening of a restaurant. In terms of training, we were
required to hire staff who would need to attend training at the
Melawati Mall outlet for at least two weeks. They encouraged us
as the owners to attend the training, too. They were also on standby
for two weeks at our restaurant during the initial opening.
I remember during those two weeks, the operation person from the
master franchisee was stationed at our restaurant for 12 hours,
from opening till closing time. This is to ensure the efficiency and
the smoothness of operation. For the first month of business, we
did not need to concern ourselves with the keys of running the
operations as this was taken care of by the master franchisee before
the handing it over to the manager in charge. The master franchisee
also assists us in manpower sourcing and interviews, HR-related
issues, such as salary package advice, manpower scheduling, as
well as cost management including Profit & Loss reports and the
filling system for the restaurant.
■ Why do you think it is good to be associated
with an American brand?
Christine: American brands have a long history in Malaysia and
they have been the number one choice for many of us. In the F&B
world, American restaurants have been in the country for decades
and have created a significant impact in many peoples’ childhoods.
Hence, we took this opportunity to be one of the brands that can
leave a memory in many Malaysians’ lives, though with a distinct
difference compared to the rest, notably with our signature
handmade ground-beef patties and hand-dipped milkshakes.
The launch of Wayback Burgers in Malaysia will indeed create an
impact, especially with its fast-casual style restaurant that is quite
revolutionary in this country. Americans always have a craving for
something fresh and new in their menu, which is similar to the taste
buds of many Malaysians. That is why only the best and most
excellent choice of ingredients make it into our menu, and will
indeed change the way Malaysians consume burgers.
■ What can a potential employee expect when
they join your team?
Christine: We consider it our utmost responsibility to ensure that
the Wayback Burgers’ team members are well taken care of. Their
welfare is regularly being monitored to ensure that they are
constantly in excellent condition whilst at work. The employees are
given staff meals once per day which consist of selected items from
the menu. In addition, the team members are given briefings
regarding the sales targets they are expected to achieve, when they
are to be met, and incentives would be given to well-deserving staff.
■ Food delivery services are all the rage now.
What are your plans to collaborate with these
service providers?
Christine: Our restaurant has partnered with a number of popular
food delivery services, namely, Foodpanda, honestbee and in the
near future, GrabFood. These collaborations will fully satisfy the
needs of our customers to have their favourite Wayback Burgers
orders delivered right
to their doorsteps. We
also have a vision of
launching our very own
delivery channel for
the convenience of our
customers, an initiative
that has been done by
many competing
brands, which we, too,
want to be a part of.
Special
Franchising In China:
What You Really Need To Know
With over a billion people and counting, China is one of the biggest potential
franchise markets in the world. Their fast-growing middle class are always
looking for more stores, restaurants, and services in order to cater to their needs.
In January 2019, China’s Ministry of Commerce (MOFCOM) officially listed
4,368 franchisors, though unofficial statistics imply that China already has
more than 4,500 franchises and chains with around 400,000 outlets. Some
of the key sectors and services in the franchise market include food and
beverage, retail, car rental, catering, education, beauty, health and fitness,
and hospitality.
Recent trends
Despite the recent slowdown in the global economy, China still
remains one of the fastest-growing consumer markets in the
world. International investors can find plenty of opportunities in
the Chinese market.
The growing Chinese middle and upper-middle class brings with
it higher incomes, a younger generation of consumers, and new
technology and services that not only boost China’s consumption
but also create a more heterogeneous consumer market.
Many Chinese citizens are taking advantage of their newfound
wealth by trading up and purchasing higher-quality products and
services, especially in fields like food, travel, and entertainment.
Millennial Chinese have shown a tendency of being trendconscious,
with an ever changing preference for characteristic or
customized products. Many international franchises operating in
China are benefiting as Chinese consumers actively seek out the
quality, attractiveness, and convenience often associated with
Western brands.
As more and more Chinese gain affordable internet access, the
demand for integrated digital shopping experiences likewise
continues to grow. Online food delivery services, e-commerce
grocery sales, and other high tech services have increased
considerably as a result of increasing digitalization.
Special
Franchising in China
International franchisors looking to enter the Chinese market
typically adopt the master franchising model, though area
development franchising has also become popular in recent
years. In some cases, the franchisor formed a joint venture
vehicle with a local franchisee to become master franchisees or
area developers.
A good example of how useful franchising can be is to look at
the history of KFC and McDonald’s in China. Both companies
were in China by the 1990s. Initially, neither company franchised
their outlets. However, in 1992, KFC began granting franchises
in lower-tier cities, allowing them to expand faster compared to
McDonald’s who only adopted franchising after 2004. Currently,
KFC have around 6,000 outlets in mainland China – more than
twice the number of McDonald’s outlets.
Franchising Laws
When it comes to the franchisor-franchisee relationship, it’s
important to keep the relevant laws in mind. In general, all
contracts in China need to conform to the general principles
set out in the Contract Law of the PRC. More specific laws and
regulations linked to franchising are listed below:
● The Commercial Franchise Administration Regulation
( 商 业 特 许 经 营 管 理 条 例 , 2007)
● The Commercial Franchise Registration Administrative
Measures ( 商 业 特 许 经 营 备 案 管 理 办 法 , 2011)
● The Commercial Franchise Information Disclosure
Administrative Measures
( 商 业 特 许 经 营 信 息 披 露 管 理 办 法 , 2012)
● The Administrative Measures for Foreign Investment in
Commercial Fields ( 外 商 投 资 商 业 领 域 管 理 办 法 , 2004)
Other laws that may affect franchisors include: the Labor
Contract Law ( 劳 动 合 同 法 ), the Anti-unfair Competition Law
( 反 不 正 当 竞 争 法 ), the Anti-monopoly Law ( 中 华 人 民 共 和 国 反 垄
断 法 ), the Trademark Law ( 商 标 法 ), and the Copyright Law
( 著 作 权 法 ).
What do you need to know before
starting a franchise in China?
Enterprises
Only enterprises can engage in business as franchisors. You
should have a mature business model as well as the ability to
provide any franchisees with various benefits including longterm
business guidance, technical support, and any relevant
business training.
The “2+1” Requirement
Before signing a franchise agreement, the franchisor needs
to remember the “2+1” requirement (Article 7, Franchises
Regulation). This means that the franchisor must have at least
2 directly-owned stores and have operated the business to be
offered for franchise for at least 1 year. Note that the directlyowned
stores can be run by an affiliate and can be based
anywhere in the world.
Failure to meet this “2+1” requirement can result in fines of
between RMB100,000 and RMB500,000 (Article 24,
Franchises Regulation). The commercial administrative
department will also request the franchisor to rectify the breach
and confiscate all income acquired by the franchisor under the
illegal franchise scheme.
15-Day Deadline
Make sure to submit the relevant documents and proof of
compliance with the 2-1 requirement in time. The franchisor
needs to file their records with the relevant commercial
authorities within 15 days of signing the first franchising contract
in China.
Special
The Pros and Cons of Franchising
in China
Pros
Expanding consumer class
As China’s middle and upper class groups grow, the younger
generation is growing up with more income than ever before.
Many young Chinese like the opportunity to show off their wealth
by buying big ticket branded items such as trendy drinks, fashion
accessories, and more.
Cons
Intellectual Property Protection
Many earlier foreign brands chose to enter China as companyowned
stores or JVs instead of franchises due to weak
intellectual property enforcement as well as uneven legal
framework. Due to the lack of adequately enforced intellectual
property laws, there have been many cases of local companies
stealing someone else’s name and logo to open their own fake,
unapproved outlets.
Local Management
Many franchisers report difficulties when it comes to finding
qualified local managers who understand how to run a business.
Training costs are high, but good employees have been known
to quit shortly after receiving training in order to take a higher
paying job somewhere else.
Adapting to new markets
Franchisers who wish to succeed in China must learn to adapt to
the needs and tastes of Chinese consumers. The sheer size of
the country means that there can be many differences between
two different regions, so a company that can function well in
one region may struggle to expand to other parts of China. In
addition, foreign companies should be careful when translating
their brand or product names in Chinese as the language
differences may cause unintentional issues to develop.
West is Best
Many Chinese associate expensive foreign brands with quality,
convenience, and good customer service. This is especially true
in the retail and food sectors where Western franchises are often
viewed as more trendy compared to local brands.
Open to Franchising
First-tier cities often have developed infrastructure, business
friendly governments, and internationally standard services
and amenities. However, while they’re relatively “easy” for
newcomers to enter, labor and real estate prices have risen over
the last few years. Second-tier cities, on the other hand, benefit
from relatively lower as well as local governments that tend to
encourage the creation of new businesses.
In Conclusion…
Despite the challenges of the China market, the opportunities
are too great to ignore. The Chinese government has spent many
years improving the country’s infrastructure and raising the
standard of living.
Western products in particular are seen as desirable, especially
if they already have a strong brand presence. Combined with a
young consumer base who are willing and able to spend more
than the previous generations, franchising in China is looking
more profitable than ever before.
Why Encouraging Innovation
in Franchising
Makes Good Business Sense
By Troy Franklin
COO, World Franchise Associates – Southeast Asia
Carl Sagan, an American astronomer, cosmologist, astrophysicist,
astrobiologist, and author, best known for his work as a science
popularizer and communicator was definitely correct when he
said, “We live in a society exquisitely dependent on science
and technology, in which hardly anyone knows anything about
science and technology”.
Big Data
As I begin this article, I am going to use Mr. Sagan’s quote as
my disclaimer by admitting that I am one of those people who
“knows hardly anything about science and technology”.
Steve Jobs, the co-founder of Apple, is a legend when it comes
to technology and innovation, so it is no surprise that he said
that “Innovation distinguishes between a leader and a follower”
but what is perhaps a bit surprising is that government leaders
around the world are also starting to understand and embrace
the power of innovation and technology. For example, India’s
Prime Minister Narendra Modi noted that “The pace at which
people are taking to digital technology defies our stereotypes of
age, education, language and income.”
IR 4.0
Innovation & Technology are becoming prevalent in many
aspects of our day to day lives including 1) Education;
2) Communication; 3) Government; 4) Military; 5) Medical
Science; 6) Transportation; 7) Religion & 8) Business and terms
like Big Data, IR4.0 and Disruption are being used more and
more in boardrooms, business meetings, seminars etc.
Disruption
While Innovation has been a buzzword since the 1st Industrial
Revolution, the term Disruption has started to become more
common during the present day 4th Industrial Revolution or
IR4.0. In researching Disruption versus Innovation, I learned
that Disruptors are always innovators, but not all innovators are
disruptors. I also learned that Innovation and Disruption are
similar in that they are both creators and builders. Disruption
veers completely away from a given course by literally shifting
how we think, act, and conduct business and also how we
learn and manage our day-to-day lives. Describing disruption,
Harvard Business School professor and disruption guru Clayton
Christensen says that “a disruption displaces an existing market,
industry, or technology and produces something new and more
efficient and worthwhile. It is at once destructive and creative.”
How Times Have Changed
One only needs to look at the well known trademarks/logos in
this picture to reinforce how times have changed as most of
these companies were not in business or were merely start-ups
at the end of the previous century. Several of these companies
could be described as both innovators and disruptors:
The Amazon Effect
One company that has been recognized as a major disruptor of
organized retail is Amazon which now has a phenomenon known
as the Amazon Effect attached to its name. The Amazon effect
is the ongoing evolution and disruption of the retail market,
both online and in physical outlets, resulting from increased
e-commerce. The name is an acknowledgement of Amazon’s
early and continuing domination in online sales, which has
driven much of the disruption.
The major manifestation of the Amazon effect is the ongoing
consumer shift to shopping online. Another manifestation of
the Amazon effect is the way physical retailers and malls are
attempting to make in-person shopping a more compelling
experience for consumers. Hybrid e-commerce models, like click
and collect, have also arisen to streamline the purchasing and
payment processes. Click and collect allows customers to select
and pay for an item online and pick it up in-store.
Beacon-based technology is another transformation of the
retail environment. Beacons located throughout stores can
communicate with customers’ mobile devices to help them
locate products and services and deliver proximity marketing
messages, among other possibilities. Proximity marketing
might target a customer standing in front of a product display
with discount or upgrade offers. The same technology can also
enable contactless and automatic payment so the user can just
select their items and walk out of the store with them.
Another giant in the technology sector which built its foundation
on online shopping and trading is the Ali Baba Group founded
by Jack Ma. One of the world’s richest men, Mr. Ma was quoted
as saying “Trust the young people; trust this generation’s
innovation. They’re making things, changing innovation every
day. And all the consumers are the same: they want new things,
they want cheap things, they want good things, they want unique
things. If we can create these kind of things for consumers, they
will come.”
How Technology Benefits Franchises
Technology can help franchises use their capital and human
resources more effectively. Technology provides franchises
greater efficiency and versatility and is often a logical evolution
for the systems, tools and processes a franchise has had in
place for years. In many cases franchises may need to make
investments and adaptations to maximize the benefits of
technology, but in today’s world the transition is often quick and
pain-free and the benefits can be realized reasonably quickly.
Some specific areas where technology can help franchises are
as follows:
• Productivity
• Financial Management
• Marketing
• Training & Development
• Customer Service & Engagement
• Mobile Workplace
• Telecommuting
Cloud Technology
Another term initially popularized by Amazon is cloud computing.
The use of Cloud Computing Technology or Cloud Technology
makes computer system resources, especially storage and
computing power, available on demand without direct active
management by the individual user. The term is generally used
to describe data centres available to many users over the
Internet. Cloud Technology and in particular enterprise clouds
are emerging as a solution of choice across all sector of the
franchise industry including F&B, Retail and Services. Specific
applications and benefits of Cloud Technology for franchise
businesses includes:
• Consolidating Platforms for Systems, Tools & Processes
• Implementing Real-Time Inventory Management
• Implementing Real-Time Labour Management
• Establishing a unified gift card function
• Integrating Customer Data, Gift Card, Reward & Loyalty Programs
• Click and Collect Programs
• Improving Information Integrity
• Enhancing Customer Experience
26 Franchise Asia • 2019 Vol 36
Franchise Viewpoint
Other key technological advancements that are having a positive
impact on franchises include:
• Gift Card, Rewards & Loyalty Programs
• 3rd Party Delivery Services
• Beacon / Proximity Marketing
• Self-Service Ordering Technology
• Digital Merchandizing Solutions
• Product & Equipment Technology
StarBanks?? – Looking specifically at Rewards & Loyalty programs it
is very interesting to note that Starbucks is holding more consumer
cash than many established international financial institutions:
not using the internet so the upside for these markets over the
next decade is phenomenal. Notably these same 3 countries
are listed as among the top countries in terms of being digitally
active in adopting FinTech services.
Emerging Markets Leading
Technology Advancements
While the uninformed might believe that technology is being
driven by developed countries and leading global economies
the fact is that emerging markets are at the forefront of global
technology growth.
Many emerging market tech companies are the most innovative
and fastest growing in the world, driven by young, increasingly
affluent and tech-savvy populations. The MSCI Emerging Market
Index now has the largest technology weighting of any global
index, with its share rising from 13% at the end of 2010 to
28% by the end of January 2018. Here are some reasons why
emerging markets are leading the tech revolution:
• Huge Appetite for Technology
• The Power of the Mobile Phone
• Taking the Lead in FinTech
• Governments are Committed
• Technological Leapfrogging
• Emerging Market Technology Titans
Access to the internet including rapidly growing access to smart
phones is one of key drivers behind this trend. For example,
China, India and Brazil identified as 3 of the top 5 internet users,
with the sales of smartphones in emerging markets over the past
decade far ahead of smartphone sales in developed markets.
Interestingly, China, India and Brazil are also listed as the
countries with the smallest percentage of their urban population
FinTech Adoption Rates
I will wrap up with a quote from William Pollard, an American
physicist who started his career as a professor of physics
in 1936 at University of Tennessee who said “Learning and
innovation go hand in hand. The arrogance of success is to think
that what you did yesterday will be sufficient for tomorrow”.
While Mr. Pollards quote is almost 70 years old, it is more
relevant now than ever and I believe it is fair to say that to remain
competitive and relevant across any sector of the franchise
industry brands are going to need to Catch Up & Keep Up or they
should probably Give Up.
KYROS KEBAB
Almost 19 years ago, we bit something. Well, actually, we ate
something “out of this world”. This astonishingly, intrinsically
delicious Mediterranean delicacy, called the kebab inspired us
love with this incredibly succulent meal. So yummy we can’t think
of anything else but kebab! We noticed that kebab was only available at very
limited places. So we thought we could spread the joy of this exquisite meal to
all Malaysians which led to the development of the most delicious made-to-order
DPM aims to boost trade between Malaysia and Brunei
According to Deputy Prime Minister Datuk Seri Dr Wan Azizah Wan Ismail, Malaysia
and Brunei need to take full advantage of existing bilateral and multilateral engagement
initiatives to boost trade between the two countries.
Brunei was Malaysia’s seventh largest trading partner in the ASEAN region during 2018,
with total trade between the two countries rising by 45.9 per cent in the last three years.
“Bruneian businessmen are encouraged to strengthen their networking with Malaysian
companies and to identify potential areas for collaboration.” she said.
“Potential products and services which could be further expanded upon include
halal, furniture, medical, consumables, renewable energy, urban farming, oil and gas,
franchising, early child education, healthcare and medical tourism, as well as Information and Communications Technology,” she said
at a roundtable meeting during her two day working visit to Brunei Darussalam last month.
As part of her visit, the Deputy Prime Minister invited Bruneian companies to
take part in several upcoming Malaysian trade events this year such as the
biennial Langkawi International Maritime and Aerospace Exhibition (Lima) in
March, and the 16th Malaysia International Halal Showcase (Mihas).
“As Muslims account for around 40 per cent of the Asean population, the
business community in Brunei, Malaysia, Indonesia, southern Thailand and
southern Philippines should take advantage of these opportunities to develop
stronger halal supply chains and linkages in these markets,” she added.
Wan Azizah encouraged Malaysian and Bruneian companies to seize the
opportunities that have arisen as a result of economic growth in the region,
revealing that the Malaysian government is in the process of actively reviewing
and evaluating the country’s economic policies as part of ‘new Malaysia’.
“Regionally, our Prime Minister Tun Dr Mahathir Mohamad has called on Asean to boost intra-regional trade by up to 30 per cent from
the current 20 per cent. This is to further provide more opportunities to small and medium-sized enterprises to capitalise in growing
investments in the area,” she added.
Wan Azizah called on Bruneian businessmen to expand their collaboration with Malaysian companies and undertake various projects
together in order to explore the opportunities in trade and investment within both nations.
The Manhattan Fish Market and MarryBrown enters Japanese
market ahead of the 2020 Tokyo Olympic Games
The Malaysian Franchise Association (MFA) have recently announced that two local franchises have succeeded
in entering the Japan market.
According to association chairman Datuk Razali Hassan, The Manhattan Fish Market and MarryBrown
franchises began operations in the third quarter of 2018. Together with the Ministry of Domestic Trade and
Consumer Affairs (KPDNHEP), MFA is actively working to promote Malaysian franchises across the world.
“We now have 66 local franchises that
have penetrated the markets of 65
countries... we target the number of
franchises to reach 80 this year,”
he said.
To aid in this goal, MFA is also
organizing the 2019 Franchise
International Malaysia (FIM) exhibition
and conference this April 5 to 7.
“To date, 12 countries have confirmed
their participation at FIM2019,” he
said. “Over 100 local and international
franchises will be involved.”
FIM2019 is expected to bring in sales of RM500 million, with attending investors from several countries such as Saudi Arabia, China,
Taiwan, and Japan to help local franchise brands expand internationally.
Tealive Expands to China
Loo announced that Tealive will also make available food products such as the
famous ‘Seremban Lucky King’ buns to support its expansion.
“So what we are trying to feature and promote is not only Malaysian ingredients
but also the Malaysian culture,” he added.
Apart from China, Loo mentioned that Tealive is preparing for its first ventures
into other countries such as India and the United Kingdom.
Local bubble tea brand Tealive is turning eastwards with plans to open
at least 10 corporate stores in China this year. Tealive owner Loob
Holding has announced that they aim to set up no less than 500 Tealive
outlets in China within 3 years to get a foothold in the world’s largest
tea consumer market.
“In China, where investments are high, we would like to keep it as an
asset light model, where we will franchise most of our stores,” Loob
Holding Sdn Bhd chief executive officer Bryan Loo said.
“So, before we franchise outlets, we will first set up corporate stores
to test and prove the model works,” he told journalists after the official
launch of Tealive’s first store in Shanghai. Opened in November
2018, Tealive’s Shanghai outlet has received overwhelming positive
responses, with high demand for Malaysian flavors such as durian,
cempedak, gula melaka, and Bentong ginger.
Kedai Ayamas Eatery plans to have 100 new outlets by 2023
Kedai Ayamas eatery operator Kara Holdings is aiming to establish no
less than 100 new outlets within the next four years through its new
franchising program. Their move into franchising is already starting to
bear fruit with 9 franchises opened thus far and 20 more planned within
this year.
“As Johor Corp’s wholly owned subsidiary, we complement the KFC
business in terms of maximising the use and distribution of poultry
products at the farm,” said Kara’s executive director Abd Rahman Md
Dawi. “The poultry-relating business has always been a high-demand
market for the food and beverage sector in Malaysia.
“Last year, we registered a revenue of RM35 million [$8.6 million]”, he
added. “With the additional franchise business, hopefully, it will amplify
our revenue this year, coupled with Kara’s technological adoption of food
delivery services such as Foodpanda and Grab-Food.”
According to Dawi, the company is open to franchisee acquisition
of Kara’s 40 corporate outlets. Six of the nine new franchises were
acquired from the firm.
“There are certain criteria that will be considered for us to sell our own
shops, but we encourage the newcomers to open a new shop,” he said.
Kara’s franchising program costs between RM100,000 and RM400,000 ($24,600–98,450), and includes management and
operational training sessions.
Filipino Fast Food Franchise Jollibee to open 100 outlets in Malaysia
Jollibee Foods Corporation opened its first Malaysian branch in Center Point
Sabah in December 2018. Now this Filipino fast food franchise aims to
expand further – with plans to open over 100 new outlets in Malaysia within
the next decade.
Jollibee’s Center Point Sabah branch opened to great applause, receiving an
“overwhelming response”, with long queues from day one due to the state’s
sizeable Filipino community.
“We believe that we can appeal to the diversity as we have seen in other
countries where Jollibee has been successful, such as Vietnam, Brunei, Hong
Kong and Singapore,” said president and head of JFC International Business
Dennis Flores.
“We know that Kota Kinabalu
is a melting pot of many ethnic
cultures,” he said, adding that
he wanted Jollibee to add to the
diversity of the city’s food scene.
Known as the world’s largest and
fastest growing Asian restaurant
company, Jollibee has produced
a number of hit products such as
the Yumburger, Chicken Joy, Jolly
Spaghetti, and more.
