Proactivity in COVID-19 

containment efforts encouraged 

It seems as though almost overnight the novel coronavirus 

COVID-19 has changed the world. Spread containment efforts have 

led to restrictions in travel, public events and social gatherings of all 

kinds. It has created closures of restaurants, schools, sports events 

and theatre productions and, as the spread extends, restrictions 

deepen and become more defined and entrenched. But there is good 

to be seen in every difficult situation and, although this virus knows 

no boundaries or borders, it has most certainly brought the world 

together in a unified approach to meeting this challenge head-on. 

At the core of the issue is public safety. While we may be inconvenienced 

by changes to routine and everything we rely on in our daily 

lives, the steps we take now will ultimately define the extent of the 

spread and the impact to the health of people in Canada and around 

the world. With this in mind, the Canada Safety Council fully supports 

the direction being provided by federal government and public 

health officials as well as the measures being taken by Canadian 

industries, organizations and individuals in preventing the spread of 

the virus, which has been declared a pandemic by the World Health 

Organization

The CSC has also taken steps to limit spread in restricting access 

to the office, in relying on virtual meetings and in enabling remote 

work arrangements that ensure continuation of services from the

more specifically each other,” said Gareth Jones, president and CEO

Silver City Days cancelled 

Federal and provincial government 

health officials strongly recommend 

social distancing and the cancellation of 

large events to help prevent the spread of 

COVID-19. Therefore, the City of Trail 

and the Silver City Days Planning Committee 

have decided to cancel Silver City 

Days, scheduled for May 6 -10, 2020. 

“We understand the cancellation of 

Silver City Days is very disappointing,” 

said Councillor Colleen Jones, chair of 

the Silver City Days Planning Committee. 

“Silver City Days is a huge event that 

draws thousands of people into various 

Trail venues. Considering the importance 

of COVID-19 prevention and the 

health and safety of our community, our 

only choice was to cease planning immediately 

and to cancel this year’s event.” 

The committee is now contacting 

the sponsors, volunteers, community 

groups, local organizations and vendors, 

who previously committed their donations 

and services, to inform them of the 

cancellation. “There are so many moving 

parts to this event,” said Jones. “We are 

very sympathetic to those who rely on 

events such as Silver City Days for fundraising 

and revenue, but everyone thus 

far has been very understanding considering 

the extraordinary circumstance.” 

Riverfront Food Fair vendors will 

receive their deposits back and the 

city will work directly with Shooting 

Star Amusements and the booked 

entertainers to resolve any contractual 

obligations. 

“Lastly, I would like to express our 

gratitude to those sponsors, volunteers 

and organizations who continue to 

dedicate their time and resources to the 

success of Silver City Days,” said Jones. 

“This event continues to thrive because 

of your support. We look forward to 

working with all of you again next year.”

RDKB closures in response 

to COVID-19 

The Regional District of Kootenay 

Boundary has announced that the Beaver 

Valley Arena and the Greater Trail Community 

Centre in Trail that also houses 

Selkirk College, Charles Bailey Theatre, the 

Trail Gymnastics Club and VISAC Gallery 

are closed to the public until further notice. 

“We have closed these facilities and our 

front-counter service in direct response to 

the latest information from our lead agencies 

in this pandemic – the BC Centre for 

Disease Control (BCCDC) and Interior 

Health Authority,” said Mark Andison, 

chief administrative officer. “We know this 

will impact residents who rely on our recreation 

facilities for exercise and social interaction 

which are all part of staying healthy. 

We have closed these facilities to address 

the ongoing risks of close social contact 

that can lead to residents contracting this 

virus and spreading it to others. We do also 

want to reassure everyone that all RDKB 

staff are continuing to provide the services 

we usually provide, just in a slightly different 

way.” 

The RDKB will suspend face-to-face 

counter services at offices in Trail and 

Grand Forks as well as public access to 

RDKB fire stations. Our fire services need 

to ensure they maintain the capacity to 

deliver fire rescue service throughout this 

pandemic. We will continue to provide 

all essential services including water and 

sewer treatment, fire rescue and emergency 

response. 

Staff will continue to work both remotely 

and in their offices during regular business 

hours to provide all services such as 

building and plumbing inspection, land 

use planning and other services and will 

respond to public inquiries and requests 

by phone and email. Residents can call 

the RDKB in advance to drop off building 

plans or other items or ask any questions at

Landfills in the region are still open. The 

RDKB reminds residents that they must 

not throw wet wipes or other synthetic 

cleaning cloths used for disinfection into 

compost buckets or flush wipes down the 

toilet – these products must go into garbage 

destined for the landfill. Residents can

hours of operation and other Environmental 

Services topics.

“As a regional government we need to 

balance both our level of risk and a critical 

need to do everything we can to prevent 

further transmission of this virus to 

allow our healthcare system to meet the

our advanced emergency planning is 

designed to allow us to continue our daily 

business and serve the region. The well 

being of all our staff, directors and residents 

is paramount.” 

Despite facility closures, the RDKB 

encourages residents to take advantage of 

the good weather to pursue other forms 

of outdoor recreation, exercise and social 

interaction that allow each of us to maintain 

a healthy social distance of one metre 

or more to meet the guidelines of the 

BCCDC and Interior Health. RDKB assets 

include a large network of trails and several 

parks, all of which will remain open to public 

use. 

The RDKB has now activated its Emergency 

Operations Centre to Level 2, with 

multiple staff dedicated to responding to 

COVID-19 events and will reassess all closures 

and responses to the COVID-19 situation 

daily.

public updates in the media, on social

“Our main concern right now is maintaining 

the health of our community,” said Mayor Lisa 

Pasin. “We understand the closure of city hall 

and the closure of our other city facilities earlier 

in the week make things difficult 

for some people, but these precautions 

are necessary to prevent the spread of

At the beginning of last week, the city 

announced the closure of its recreation 

facilities and the Trail Riverfront Centre 

and also made the decision to cancel 

Silver City Days, scheduled for May 6 

– 10, 2020. Also this week, the provincial 

government announced classes for 

kindergarten to Grade 12 in the public 

school system are suspended until the 

fall and many non-essential services 

and businesses decided to temporarily 

close their doors. 

“It’s all about prevention and measures 

need to be taken seriously,” said 

Pasin. “The city’s closures align with the 

province’s strong suggestion to practice 

social distancing to help prevent spread 

of the virus. Let’s work together on this 

to flatten the curve and let’s be courteous 

and kind to one another during this 

unexpected circumstance.”

RDCK announces closures 

All community complexes and recreation 

facilities and programs operated by 

the Regional District of Central Kootenay 

(RDCK) have been suspended as of Monday 

March 16, as part of the RDCK’s response to 

the novel coronavirus/COVID-19. The closures 

will be in place until further notice, for 

at least four weeks. 

All programs scheduled to run at these 

facilities have been cancelled, including 

drop-in classes, preregistered programs 

and rentals. Staff will be working to process 

refunds and credits. Time-based memberships 

will be put on hold immediately. Customers 

do not need to take any action at this 

time. 

All arena ice operations will be closed for 

the season and all organized sporting activities 

are cancelled until further notice.

Celgrow into their soil.

Resort closure 

After careful consideration of 

growing concerns regarding the 

COVID-19 pandemic, management 

and ownership of Ainsworth Hot 

Springs Resort announce the closure 

of the resort until at least until 

the end of April. 

Pools closed to the public on 

Tuesday, March 17, the hotel and 

restaurant closed on Sunday, March 

22. All guests with hotel bookings 

will be contacted directly. 

This is voluntary decision that we 

consider necessary to safeguard the 

health and safety of our staff, guests, 

their loved ones and the community

Can You Get Your Spouse's Gambling Losses Back? 

Suppose that after a 20-year long marriage 

that’s been floundering for some 

years, you end up separating. One thing 

the court has to decide is how to divide 

up your family property and family debt 

after your separation. 

In court, you find out that for the last 

several years of your relationship, your 

spouse has been syphoning money out of 

your family company and gone on a gambling 

spree. You knew she liked playing 

the slots at the casino occasionally, but 

you had no idea she used money from 

the company or how much money was 

involved. In the end, more than $660,000 

of what was effectively family property 

has gone down the drain, for good. 

How will the court approach such a 

situation? 

The basic rule under our current Family 

Law Act is that all family property and 

all family debt acquired by either spouse 

during the course of their relationship 

are to be shared equally between them 

after separation. That applies to family 

property and family debt incurred from 

the date you started to live together or 

got married (whichever is earlier). It also 

applies to common-law couples legally 

treated as spouses. 

If an equal division would be “significantly 

unfair,” the court can allocate 

such property and debt differently. This 

is a high threshold to overcome, however, 

and the court will always look at 

the unique situation involved to decide 

what’s appropriate. 

For example, if both of you liked to gamble, 

and you both racked up gambling 

debts and losses in the normal course of 

your relationship, the court is unlikely 

to treat these debts and losses differently 

than other family debt or property; upon 

separation, you’d each likely be responsible 

for sharing such debts or property 

losses equally. 

The situation may well be different 

though if it turns out that, without the 

other’s knowledge and consent, one of 

you squanders a substantial amount of 

family property by an uncontrolled gambling 

habit. 

Let’s go back to our earlier example. In 

a recent case, the BC Supreme Court 

concluded that the wife had wrongfully 

used up over $660,000 of a family company’s 

money for her gambling. Had that 

money stayed in the company, she would 

have been entitled to one half of it. So 

the court awarded her husband one half 

of the misappropriated funds, i.e., over 

$330,000 in compensation, plus almost 

$40,000 in forensic accounting costs. 

It’s important to point out that this 2019 

case was decided under our province’s 

earlier family law statute, which allowed 

re-apportionment (i.e. unequal division) 

of family assets if an equal division 

would be (simply) unfair. That’s a lower 

threshold than the “significantly unfair” 

hurdle you have to overcome under our 

current Family Law Act if you want to get 

a greater-than-equal share. But on similar 

facts the outcome could well be the 

same for a case decided under today’s 

family law rules.

Walk for Alzheimer’s 

announcement 

The Alzheimer Society of B.C. is enormously 

proud of its IG Wealth Management 

Walk for Alzheimer’s, which has 

been an instrumental fundraiser to support 

people affected by dementia. 

While the IG Wealth Management Walk 

for Alzheimer’s is moving away from inperson 

events due to COVID-19, the 

Alzheimer Society of B.C. wants to assure 

participants and supporters that the event 

has not been cancelled. There are exciting 

plans in development on how we can bring 

communities and individuals together 

virtually on Sunday, May 3. More will be 

shared in the coming weeks about how you 

can get involved. 

“Our first priority is the safety of our 

participants, staff, volunteers and their 

family and friends,” says Cathryn France, 

the Alzheimer Society of BC’s director of 

resource development. “The IG Wealth 

Management Walk for Alzheimer’s is our 

biggest fundraising event of the year and 

the funds raised allow us to provide critical 

programs and services. We are committed 

to coming together and having this event 

go ahead in a different way, perhaps virtually. 

Please stay tuned for more information, 

but keep May 3 free in your calendar.” 

This decision was informed by the latest 

recommendations from the Public Health 

Agency of Canada and the BC Centre for 

Disease Control. More information about 

the IG Wealth Management Walk for 

Alzheimer’s and how you can attend will 

be available within the coming weeks. Even 

though it will look different, the event will 

undoubtedly remain a chance to honour 

and celebrate people affected by dementia.

FortisBC set to support BC 

during COVID-19 outbreak 

As businesses and government take additional 

steps to contain the spread of the 

novel coronavirus COVID-19, FortisBC 

has taken several steps to protect the health 

and safety of our customers and employees 

while maintaining service levels and 

responding quickly to any emergency or 

outage situations. 

First and foremost, we are working to 

keep our employees healthy. We’ve asked 

all employees to self-isolate if they feel any 

symptoms associated with COVID-19 and, 

if those symptoms worsen, to seek medical 

attention. To increase social distancing 

at our offices, we’re organizing ways for 

employees to work from home when possible 

to decrease the number of people at 

our office facilities. We’ve also asked our 

employees to cancel any in-person meetings 

with vendors for the time being and 

limit the number of people in any face-toface 

meetings. 

To assist in containment, we have also 

cancelled any non-essential work related 

travel for our staff and, for any staff travelling 

for personal or work reasons, will be 

asking them to self-isolate for two weeks 

upon their return to ensure they have not 

contracted the virus. We’ve also closed our 

offices to public visits for the time being 

and meeting with more vendors and contractors 

via teleconference rather than in 

person.

BC’s Provincial Health Officer promulgated 

an order under the Public Health Act entitled 

“Mass Gatherings re: COVID-19”. The 

order provides that every municipality and 

regional district is prohibited from permitting 

the gathering of people in excess of 50 

people at a place of which the local government 

is the owner, occupier or operator, 

or for which it is otherwise responsible. The 

Order expires on May 30, 2020 and is subject 

to revision, cancellation or extension 

by the Provincial Health Officer. 

The order applies to community centres, 

recreation facilities, meeting facilities, theatres, 

and other places owned, occupied or 

operated by the local governments, including 

concessions or licenced areas. It also 

applies to any events held or occasioned 

by local governments, such as parades, 

festivals, concerts or demonstrations.
