Proactivity in COVID-19<br />

containment efforts encouraged<br />

It seems as though almost overnight the novel coronavirus<br />

COVID-19 has changed the world. Spread containment efforts have<br />

led to restrictions in travel, public events and social gatherings of all<br />

kinds. It has created closures of restaurants, schools, sports events<br />

and theatre productions and, as the spread extends, restrictions<br />

deepen and become more defined and entrenched. But there is good<br />

to be seen in every difficult situation and, although this virus knows<br />

no boundaries or borders, it has most certainly brought the world<br />

together in a unified approach to meeting this challenge head-on.<br />

At the core of the issue is public safety. While we may be inconvenienced<br />

by changes to routine and everything we rely on in our daily<br />

lives, the steps we take now will ultimately define the extent of the<br />

spread and the impact to the health of people in Canada and around<br />

the world. With this in mind, the Canada Safety Council fully supports<br />

the direction being provided by federal government and public<br />

health officials as well as the measures being taken by Canadian<br />

industries, organizations and individuals in preventing the spread of<br />

the virus, which has been declared a pandemic by the World Health<br />

Organization<br />

The CSC has also taken steps to limit spread in restricting access<br />

to the office, in relying on virtual meetings and in enabling remote<br />

work arrangements that ensure continuation of services from the<br />

the health and safety of the communities we work and live in and<br />

Silver City Days cancelled<br />

Federal and provincial government<br />

health officials strongly recommend<br />

social distancing and the cancellation of<br />

large events to help prevent the spread of<br />

COVID-19. Therefore, the City of <strong>Trail</strong><br />

and the Silver City Days Planning Committee<br />

have decided to cancel Silver City<br />

Days, scheduled for May 6 -10, 2020.<br />

“We understand the cancellation of<br />

Silver City Days is very disappointing,”<br />

said Councillor Colleen Jones, chair of<br />

the Silver City Days Planning Committee.<br />

“Silver City Days is a huge event that<br />

draws thousands of people into various<br />

<strong>Trail</strong> venues. Considering the importance<br />

of COVID-19 prevention and the<br />

health and safety of our community, our<br />

only choice was to cease planning immediately<br />

and to cancel this year’s event.”<br />

The committee is now contacting<br />

the sponsors, volunteers, community<br />

groups, local organizations and vendors,<br />

who previously committed their donations<br />

and services, to inform them of the<br />

cancellation. “There are so many moving<br />

parts to this event,” said Jones. “We are<br />

very sympathetic to those who rely on<br />

events such as Silver City Days for fundraising<br />

and revenue, but everyone thus<br />

far has been very understanding considering<br />

the extraordinary circumstance.”<br />

Riverfront Food Fair vendors will<br />

receive their deposits back and the<br />

city will work directly with Shooting<br />

Star Amusements and the booked<br />

entertainers to resolve any contractual<br />

obligations.<br />

“Lastly, I would like to express our<br />

gratitude to those sponsors, volunteers<br />

and organizations who continue to<br />

dedicate their time and resources to the<br />

success of Silver City Days,” said Jones.<br />

RDKB closures in response<br />

to COVID-19<br />

The Regional District of Kootenay<br />

Boundary has announced that the <strong>Beaver</strong><br />

<strong>Valley</strong> Arena and the Greater <strong>Trail</strong> Community<br />

Centre in <strong>Trail</strong> that also houses<br />

Selkirk College, Charles Bailey Theatre, the<br />

<strong>Trail</strong> Gymnastics Club and VISAC Gallery<br />

are closed to the public until further notice.<br />

“We have closed these facilities and our<br />

front-counter service in direct response to<br />

the latest information from our lead agencies<br />

in this pandemic <strong>–</strong> the BC Centre for<br />

Disease Control (BCCDC) and Interior<br />

Health Authority,” said Mark Andison,<br />

chief administrative officer. “We know this<br />

will impact residents who rely on our recreation<br />

facilities for exercise and social interaction<br />

which are all part of staying healthy.<br />

We have closed these facilities to address<br />

the ongoing risks of close social contact<br />

that can lead to residents contracting this<br />

virus and spreading it to others. We do also<br />

want to reassure everyone that all RDKB<br />

staff are continuing to provide the services<br />

we usually provide, just in a slightly different<br />

way.”<br />

The RDKB will suspend face-to-face<br />

counter services at offices in <strong>Trail</strong> and<br />

Grand Forks as well as public access to<br />

RDKB fire stations. Our fire services need<br />

to ensure they maintain the capacity to<br />

deliver fire rescue service throughout this<br />

pandemic. We will continue to provide<br />

all essential services including water and<br />

sewer treatment, fire rescue and emergency<br />

response.<br />

Staff will continue to work both remotely<br />

and in their offices during regular business<br />

hours to provide all services such as<br />

building and plumbing inspection, land<br />

use planning and other services and will<br />

respond to public inquiries and requests<br />

by phone and email. Residents can call<br />

the RDKB in advance to drop off building<br />

plans or other items or ask any questions at<br />

Landfills in the region are still open. The<br />

RDKB reminds residents that they must<br />

not throw wet wipes or other synthetic<br />

cleaning cloths used for disinfection into<br />

compost buckets or flush wipes down the<br />

toilet <strong>–</strong> these products must go into garbage<br />

destined for the landfill. Residents can<br />

“As a regional government we need to<br />

balance both our level of risk and a critical<br />

need to do everything we can to prevent<br />

further transmission of this virus to<br />

allow our healthcare system to meet the<br />

needs of anyone who is unwell or injured,”<br />

said Diane Langman, chair of the board<br />

of directors. “Like all levels of government,<br />

our advanced emergency planning is<br />

designed to allow us to continue our daily<br />

business and serve the region. The well<br />

being of all our staff, directors and residents<br />

is paramount.”<br />

Despite facility closures, the RDKB<br />

encourages residents to take advantage of<br />

the good weather to pursue other forms<br />

of outdoor recreation, exercise and social<br />

interaction that allow each of us to maintain<br />

a healthy social distance of one metre<br />

or more to meet the guidelines of the<br />

BCCDC and Interior Health. RDKB assets<br />

include a large network of trails and several<br />

parks, all of which will remain open to public<br />

use.<br />

The RDKB has now activated its Emergency<br />

Operations Centre to Level 2, with<br />

multiple staff dedicated to responding to<br />

COVID-19 events and will reassess all closures<br />

and responses to the COVID-19 situation<br />

daily.<br />

public updates in the media, on social<br />

media and on our emergency website at<br />

“Our main concern right now is maintaining<br />

the health of our community,” said Mayor Lisa<br />

Pasin. “We understand the closure of city hall<br />

and the closure of our other city facilities earlier<br />

in the week make things difficult<br />

for some people, but these precautions<br />

are necessary to prevent the spread of<br />

COVID-19.”<br />

At the beginning of last week, the city<br />

announced the closure of its recreation<br />

facilities and the <strong>Trail</strong> Riverfront Centre<br />

and also made the decision to cancel<br />

Silver City Days, scheduled for May 6<br />

<strong>–</strong> 10, 2020. Also this week, the provincial<br />

government announced classes for<br />

kindergarten to Grade 12 in the public<br />

school system are suspended until the<br />

fall and many non-essential services<br />

and businesses decided to temporarily<br />

close their doors.<br />

“It’s all about prevention and measures<br />

need to be taken seriously,” said<br />

Pasin. “The city’s closures align with the<br />

province’s strong suggestion to practice<br />

social distancing to help prevent spread<br />

of the virus. Let’s work together on this<br />

to flatten the curve and let’s be courteous<br />

RDCK announces closures<br />

All community complexes and recreation<br />

facilities and programs operated by<br />

the Regional District of Central Kootenay<br />

(RDCK) have been suspended as of Monday<br />

<strong>March</strong> 16, as part of the RDCK’s response to<br />

the novel coronavirus/COVID-19. The closures<br />

will be in place until further notice, for<br />

at least four weeks.<br />

All programs scheduled to run at these<br />

facilities have been cancelled, including<br />

drop-in classes, preregistered programs<br />

and rentals. Staff will be working to process<br />

refunds and credits. Time-based memberships<br />

will be put on hold immediately. Customers<br />

do not need to take any action at this<br />

time.<br />

All arena ice operations will be closed for<br />

the season and all organized sporting activities<br />

are cancelled until further notice.<br />

Can You Get Your Spouse's Gambling Losses Back?<br />

Suppose that after a 20-year long marriage<br />

that’s been floundering for some<br />

years, you end up separating. One thing<br />

the court has to decide is how to divide<br />

up your family property and family debt<br />

after your separation.<br />

In court, you find out that for the last<br />

several years of your relationship, your<br />

spouse has been syphoning money out of<br />

your family company and gone on a gambling<br />

spree. You knew she liked playing<br />

the slots at the casino occasionally, but<br />

you had no idea she used money from<br />

the company or how much money was<br />

involved. In the end, more than $660,000<br />

of what was effectively family property<br />

has gone down the drain, for good.<br />

How will the court approach such a<br />

situation?<br />

The basic rule under our current Family<br />

Law Act is that all family property and<br />

all family debt acquired by either spouse<br />

during the course of their relationship<br />

are to be shared equally between them<br />

after separation. That applies to family<br />

property and family debt incurred from<br />

the date you started to live together or<br />

got married (whichever is earlier). It also<br />

applies to common-law couples legally<br />

treated as spouses.<br />

If an equal division would be “significantly<br />

unfair,” the court can allocate<br />

such property and debt differently. This<br />

is a high threshold to overcome, however,<br />

and the court will always look at<br />

the unique situation involved to decide<br />

what’s appropriate.<br />

For example, if both of you liked to gamble,<br />

and you both racked up gambling<br />

debts and losses in the normal course of<br />

your relationship, the court is unlikely<br />

to treat these debts and losses differently<br />

than other family debt or property; upon<br />

separation, you’d each likely be responsible<br />

for sharing such debts or property<br />

losses equally.<br />

The situation may well be different<br />

though if it turns out that, without the<br />

other’s knowledge and consent, one of<br />

you squanders a substantial amount of<br />

family property by an uncontrolled gambling<br />

habit.<br />

Let’s go back to our earlier example. In<br />

a recent case, the BC Supreme Court<br />

concluded that the wife had wrongfully<br />

used up over $660,000 of a family company’s<br />

money for her gambling. Had that<br />

money stayed in the company, she would<br />

have been entitled to one half of it. So<br />

the court awarded her husband one half<br />

of the misappropriated funds, i.e., over<br />

$330,000 in compensation, plus almost<br />

$40,000 in forensic accounting costs.<br />

It’s important to point out that this 2019<br />

case was decided under our province’s<br />

earlier family law statute, which allowed<br />

re-apportionment (i.e. unequal division)<br />

of family assets if an equal division<br />

would be (simply) unfair. That’s a lower<br />

threshold than the “significantly unfair”<br />

hurdle you have to overcome under our<br />

current Family Law Act if you want to get<br />

a greater-than-equal share. But on similar<br />

facts the outcome could well be the<br />

same for a case decided under today’s<br />

family law rules.<br />

Walk for Alzheimer’s<br />

announcement<br />

The Alzheimer Society of B.C. is enormously<br />

proud of its IG Wealth Management<br />

Walk for Alzheimer’s, which has<br />

been an instrumental fundraiser to support<br />

people affected by dementia.<br />

While the IG Wealth Management Walk<br />

for Alzheimer’s is moving away from inperson<br />

events due to COVID-19, the<br />

Alzheimer Society of B.C. wants to assure<br />

participants and supporters that the event<br />

has not been cancelled. There are exciting<br />

plans in development on how we can bring<br />

communities and individuals together<br />

virtually on Sunday, May 3. More will be<br />

shared in the coming weeks about how you<br />

can get involved.<br />

“Our first priority is the safety of our<br />

participants, staff, volunteers and their<br />

family and friends,” says Cathryn France,<br />

the Alzheimer Society of BC’s director of<br />

resource development. “The IG Wealth<br />

Management Walk for Alzheimer’s is our<br />

biggest fundraising event of the year and<br />

the funds raised allow us to provide critical<br />

programs and services. We are committed<br />

to coming together and having this event<br />

go ahead in a different way, perhaps virtually.<br />

FortisBC set to support BC<br />

during COVID-19 outbreak<br />

As businesses and government take additional<br />

steps to contain the spread of the<br />

novel coronavirus COVID-19, FortisBC<br />

has taken several steps to protect the health<br />

and safety of our customers and employees<br />

while maintaining service levels and<br />

responding quickly to any emergency or<br />

outage situations.<br />

First and foremost, we are working to<br />

keep our employees healthy. We’ve asked<br />

all employees to self-isolate if they feel any<br />

symptoms associated with COVID-19 and,<br />

if those symptoms worsen, to seek medical<br />

attention. To increase social distancing<br />

at our offices, we’re organizing ways for<br />

employees to work from home when possible<br />

to decrease the number of people at<br />

our office facilities. We’ve also asked our<br />

employees to cancel any in-person meetings<br />

with vendors for the time being and<br />

limit the number of people in any face-toface<br />

meetings.<br />

To assist in containment, we have also<br />

cancelled any non-essential work related<br />

travel for our staff and, for any staff travelling<br />

for personal or work reasons, will be<br />

asking them to self-isolate for two weeks<br />

upon their return to ensure they have not<br />

contracted the virus. We’ve also closed our<br />

offices to public visits for the time being<br />

and meeting with more vendors and contractors<br />

via teleconference rather than in<br />

has so much potential, he just needs the right family to give him<br />

BC’s Provincial Health Officer promulgated<br />

an order under the Public Health Act entitled<br />

“Mass Gatherings re: COVID-19”. The<br />

order provides that every municipality and<br />

regional district is prohibited from permitting<br />

the gathering of people in excess of 50<br />

people at a place of which the local government<br />

is the owner, occupier or operator,<br />

or for which it is otherwise responsible. The<br />

Order expires on May 30, 2020 and is subject<br />

to revision, cancellation or extension<br />

by the Provincial Health Officer.<br />

The order applies to community centres,<br />

recreation facilities, meeting facilities, theatres,<br />

and other places owned, occupied or<br />

operated by the local governments, including<br />

concessions or licenced areas. It also<br />

applies to any events held or occasioned<br />

by local governments, such as parades,<br />

festivals, concerts or demonstrations.<br />

For the benefit of all, many organizations and businesses have cancelled or postponed their events. Thank you for your understanding.<br />
