North Dakota Public Notices 

Mr. Montplaisir briefly discussed fi- 

nancing options available to the board af- 

ter approval last month of Resolution 

#2009-12 which designated a recovery 

zone in Cass County. The county may fi- 

nance both projects with taxable bonds 

through this federal bond program, which 

will reimburse the county for 45% of the 

interest paid. This program runs through 

the end of 2010. He said the county is 

not able to build without some type of fi- 

nancing and no more than five mills will 

be needed for both projects. As the 

county’s valuation increases, the five mills 

will decrease over time. The county levy 

has been at 61 mills for the last three 

years and has been between 60 and 66 

mills since the Home Rule Charter was 

passed. He said operational costs were 

used to determine the lease value of $15 

per square foot for the law enforcement 

center, and noted that the county is look- 

ing at cost recovery, not to make a profit. 

Mr. Vanyo said the board knows 

county space needs are real, security is- 

sues exist and unique financing options 

are available through the federal govern- 

ment. He cannot think of a better time to 

build as it will save taxpayers money in 

the long run. He said costs for these 

buildings will continue to increase if a de- 

cision is not made. 

Mr. Pawluk believes government build- 

ings should be built with future needs in 

mind. However, because of the price in- 

volved he supports taking the issue to a 

vote of the people. He asked about an 

Attorney General (AG) opinion and ques- 

tioned whether the county is able to move 

forward without a vote. 

Mr. Burdick said the AG opinion from 

2003 was issued during the demolition of 

the jail. He said normally a public vote 

would be needed for this kind of expendi- 

ture; however, Cass County has a Home 

Rule Charter which allows the county to 

pass an ordinance and supersede the 

voting requirement. Mr. Pawluk said he 

supports both projects, but still would like 

to put the issue to a vote of the public. 

Mr. Wagner said if the county wishes 

to put the issue to a vote, the next elec- 

tion is almost a year from now, and the 

county will lose the financing opportunity 

available through the federal government. 

He said the Home Rule Charter was ap- 

proved by county voters, which allows the 

commission authority to move forward 

with these kinds of projects. 

MOTION, passed 

Mr. Wagner moved and Mr. Vanyo 

seconded to approve the first reading of 

Ordinance #2009-1, Cass County Build- 

ing Levies, direct that appropriate notice 

be published in the official county news- 

paper, and schedule the second reading 

of the ordinance for September 8, 2009. 

Discussion: Mrs. Sorum also supports a 

vote of the public on this issue and has a 

hard time supporting a mill levy increase 

considering county employees are not re- 

ceiving a cost of living adjustment (COLA) 

next year. Mr. Pawluk said long-term 

flood protection is more of a priority to him 

and noted the county will need to look at 

funding costs to support flood protection 

in the future. On roll call vote, the motion 

carried with Mr. Wagner, Mr. Vanyo and 

Mr. Bennett voting “Yes”; Mr. Pawluk and 

Mrs. Sorum voting “No”. 

8. LAW ENFORCEMENT CENTER 

CONTRACT, Approved with T.L. Stroh

Mrs. Johnson said the board should 

consider approving a building contract 

with T.L. Stroh Architects, Ltd. at a rate of 

7.25% with a deduction in the amount of 

$10,000 for services provided during the 

planning process.

9. RECOVERY ZONE ALLOCATION 

COMMITTEE, Appointed 

Mr. Montplaisir said the board ap- 

proved Resolution #2009-12, Designating 

a Recovery Zone, last month. The reso- 

lution calls for appointment of an alloca- 

tion committee to consist of the Cass 

County State’s Attorney, Cass County Au- 

ditor, President of the Greater Fargo 

Moorhead Economic Development Cor- 

poration and two commissioners. 

Mr. Wagner volunteered to serve on 

the committee. Mr. Vanyo asked if the 

commission chair is willing to be part of 

the committee and Mrs. Sorum agreed. 


Mr. Vanyo moved and Mr. Pawluk sec- 

onded to appoint Commissioner Scott 

Wagner and Commission Chair Robyn 

Sorum to the allocation committee re- 

ferred to in Resolution #2009-12, Desig- 

nating a Recovery Zone. Motion carried. 

10. VETERAN’S SERVICE OFFICER, 

Position to be re-advertised 

Mrs. Sorum asked how the board wish- 

es to proceed with the Veteran’s Service 

Officer position. Currently, Mike Vandro- 

vec is serving as the acting director until 

the commission hires a replacement. Mr. 

Vandrovec was present and said staff is 

using overtime hours approved by the 

commission last month, and believes the 

office is providing the best service pos- 

sible to veterans. 

Mr. Bennett prefers the position to be 

re-advertised as soon as possible. Mr. 

Pawluk asked if the board may appoint 

Mr. Vandrovec as the Veteran’s Service 

Officer. Mrs. Johnson said since Cass 

County Government is an Equal Opportu- 

nity Employer, the position needs to be 

posted. She said Mr. Vandrovec will re- 

main the acting director until the commis- 

sion takes further action. If the board 

wishes to re-advertise, Mrs. Johnson be- 

lieves the advertisement could be ready 

for publication in the newspaper this up- 

coming weekend. 

Mr. Wagner asked about the relation- 

ship between the county office and the 

State Department of Veteran’s Affairs. 

Mr. Vandrovec said their office has been 

working with the state office during this in- 

terim period when assistance is needed. 


Mr. Pawluk moved and Mr. Bennett 

seconded to re-advertise for the Veteran’s 

Service Officer position; eliminate the re- 

quirement for a college degree from the 

job qualifications; and include a prefer- 

ence for prior experience in veteran’s ser- 

vice duties in the job qualifications. On 

roll call vote, the motion carried unani- 

mously.

Mrs. Johnson said the Courthouse 

roofing project will begin this week to re- 

move old shingles and install new shin- 

gles to the center section of the building. 

Mrs. Johnson said the Youth Commis- 

sion picnic will be held Wednesday, Au- 

gust 5th beginning at 5:30 PM. She will 

provide a tour of the Courthouse to the 

parents of the youth participants. 

Mrs. Johnson said a joint luncheon 

meeting of the Cass and Clay County 

Board of Commissioners will be held 

Monday, September 21, 2009, beginning 

at 11:30 AM at the Ramada Plaza Suites.

Mr. Wagner said the committee met 

last month and unanimously approved a 

recommendation for the commission to 

move forward with the proposed Court- 

house West Addition and Cass County 

Law Enforcement Center. He said the 

committee used key criteria when consid- 

ering its recommendation to the commis- 

sion as follows: a justifiable need for both 

structures; the current construction cli- 

mate; historic financing opportunities; and 

the county’s history of fiscal responsibility. 

Mr. Wagner said the county has been 

studying space needs for many years. In 

the late 1990’s, the commission began 

the planning process for a new jail and 

hired Kimme & Associates as part of the 

process. The jail project included plans 

for future expansions as well as re-loca- 

tion of the Sheriff’s Office to the jail site. 

In 2001, the commission began the plan- 

ning process for a Courthouse West Addi- 

tion to accommodate the growing space 

needs of the county. District Court is also 

housed in the Courthouse and has faced 

the same situation. In 2008, the county 

once again hired Mr. Kimme to conduct a 

space needs study, and a final report was 

presented to the board this past June. 

The consultant outlined four main reasons 

why a west addition is needed: a neces- 

sity for additional office and meeting 

space; housing for permanent and secure 

mechanical, electrical, and technological 

infrastructure; secure inmate holding; and 

secure transportation of inmates to court. 

Mr. Wagner said the two projects com- 

plement each other and if the law en- 

forcement center was built first, the vacat- 

ed Sheriff’s space may be used for other 

functions that would result as a west addi- 

tion progressed. Consultants have in- 

formed the building committee the con- 

struction climate is favorable and with 

special one-time federal reimbursements 

of 45% in interest costs, the county would 

save the taxpayers approximately $1.4 

million. He briefly discussed the county 

mill levy rate of 61 mills, which has held 

steady the last three years and is the sec- 

ond lowest since voters approved the 

Home Rule Charter fifteen years ago. Fi- 

nancing options were discussed at the 

last meeting, and five mills would pay for 

both projects, which would keep the mill 

levy well within the 75 mill cap. There- 

fore, based on all the information provid- 

ed, the building committee recommends 

the board move forward with both building 

projects. 

Law Enforcement Center 

Architect Terry Stroh, T.L. Stroh Archi- 

tects, Ltd., was present. He said several 

months ago, the county hired his firm to 

complete a study on a law enforcement 

center. The building committee approved 

forwarding two options, and if necessary, 

use the lesser alternative based on bid 

prices. The alternatives include Option 6, 

which is a full build-out two-story building 

with a parking garage on the lower level; 

the second floor would be shelled; and 

storage for election equipment in the 

basement; or Option 4, which is a one- 

story building with a parking garage on 

the lower level; structural components in 

place to add a second floor in the future; 

and storage for election equipment in the 

basement. 

Mr. Stroh said the project includes 

roughly 6,000 square feet for the North 

Dakota Highway Patrol, who would lease 

the space from the county. He noted 

roughly 50,000 square feet for the build- 

ing includes a large auditorium, hallways, 

corridors, restrooms, and other spaces 

the Sheriff’s Office currently does not 

have at the Courthouse. The proposed 

project also includes 6,400 square feet in 

basement storage for election equipment. 

The 7,000 square feet the Sheriff current- 

ly occupies at the Courthouse does not 

include hallways, corridors, restrooms, 

etc. Mr. Stroh discussed the project time- 

line and said with the favorable construc- 

tion climate, the county would be able to 

bid and receive full advantage of prices 

available today. He said if the contract 

with his firm is approved today, founda- 

tion work could begin as early as Septem- 

ber. Sheriff Laney discussed the benefits of 

a law enforcement center, which include 

numerous advantages for their depart- 

ment to be housed in one location, and 

the opportunity to be part of a cooperative 

effort with the Highway Patrol. Another 

benefit to re-locating their office to the jail 

site is county patrol units would have di- 

rect access to the interstate systems. 

Sheriff Laney said in emergency events 

like a flood, adequate space would be 

available for the Tactical Operations Cen- 

ter (TOC). Captain Dave Kleppe and 

Captain Eldon Mehrer were present from 

the Highway Patrol. 

Mr. Bennett asked about space which 

may be shared between the Sheriff’s Of- 

fice and Highway Patrol. Sheriff Laney 

said plans include a joint locker room, 

joint training area and joint evidence 

room. 

Captain Kleppe said the North Dakota 

Highway Patrol is interested in a partner- 

ship with the county and believes it is im- 

portant to work together to help facilitate a 

closer relationship between both organ- 

izations. 

Commissioners discussed the lease of 

space. Mr. Wagner said on-going opera- 

tional costs will be offset by the lease rev- 

enue received. Mr. Pawluk asked about 

payment on shared space. Mrs. Johnson 

said the Sheriff’s Office and Highway Pa- 

trol will work together to determine a per- 

centage on cost-shared space. 

Courthouse West Addition 

Architect Rick Hoganson, Foss Archi- 

tecture & Interiors, was present. He said 

Consultant Dennis Kimme was hired last 

year to conduct a survey on county space 

needs. The current observation of the 

consultant was similar to the recommen- 

dation provided in 2001. After the study, 

three alternatives were presented to the 

building committee, which were narrowed 

down to two for the commission to consid- 

er. The committee approved forwarding 

two options, and if necessary, use the 

lesser alternative based on bid prices. 

Option A is a full build-out including a 

basement garage; court holding; mainte- 

nance; commission and administrative of- 

fices; information technology; electrical 

and mechanical space; jury courtrooms; 

and skyway. Option B includes a base- 

ment garage; electrical and mechanical 

space; court holding; maintenance; infor- 

mation technology; and skyway. Mr. Ho- 

ganson said information technology and 

mechanical equipment issues are consid- 

ered high priority and are addressed in 

both options. 

Mr. Hoganson discussed the project 

timeline. He said construction on the law 

enforcement center will begin first. Con- 

struction on the west addition could begin 

in June 2010 with an anticipated comple- 

tion date of December 2011. 

East Central Judicial District Judge 

Douglas Herman was present and said 

the county is charged with providing ade- 

quate space for the courts. He discussed 

security concerns with movement of pris- 

oners and the public through the same 

space. He said the state supports the full 

build out option for a west addition which 

will be serviceable to citizens for decades 

to come. 

Mr. Wagner said the county made re- 

quests for financial assistance from the 

state in the last two legislative sessions, 

but was unsuccessful. He also discussed 

his concerns that jurors, victims and de- 

fendants are within contact of each other 

and wants to ensure the safety of every- 

one who uses the county facilities. The 

opportunity to address this issue is avail- 

able with the proposed west addition. 

Sergeant Michele Harmon, supervisor 

of court transport, was present. Court 

transport officers provide security at 

county buildings. She gave several ex- 

amples of courthouse violence which 

have occurred locally and nationally, and 

said the general public knows their staff 

transports inmates using the side door to 

the Courthouse, which is a security risk. 

Also, inmates are escorted through hall- 

ways and elevators used by the public. 

She stressed the need for secure inmate 

transport and inmate holding and asked 

the board to support moving forward on 

the west addition. 

Gwen Hase is a criminal justice advo- 

cate for the Rape & Abuse Crisis Center. 

She said jurors, victims and defendants 

cross paths in hallways and this creates 

numerous issues for everyone involved, 

including intimidation of victims. On more 

than one occasion, she has walked peo- 

ple to their vehicles after court hearings 

and trials. 

State’s Attorney Birch Burdick said pe- 

riodically their office sends out surveys for 

comments. He said concerns expressed 

from jurors include issues of propriety, i.e. 

jurors felt it was improper for all parties 

related to the trial process to be outside 

rooms where jury deliberations are taking 

place.

VICES 

Minot State University (MSU) has been 

accepted by the NCAA to official candida- 

cy status for a move to Division II Athlet- 

ics. As part of that process MSU needs to 

review its existing athletic facilities, i.e. 

Dome and Football Stadium, to enhance 

and improve those athletic and public are- 

as. The firm selected for this process 

shall have staff, who are “LEED” certified 

and shall have as part of the team consul- 

tants experienced in planning and design 

of University level facilities especially 

NCAA facilities. Planning and analysis 

work will also include cooperative work 

with existing projects under construction 

or under design that are interrelated with 

the dome and stadium (Swain Hall, Well- 

ness Center, and the planned Phase II 

Health and Wellness Center). Work to in- 

clude planning and analyses to enhance 

and expand the existing facilities as they 

interrelate to support current and future 

athletic programs. 

The planning and construction work 

shall be done in accordance with North 

Dakota State University System and State 

of North Dakota Guidelines. The archi- 

tect/engineer shall prepare complete 

planning documents, complete plans, 

specifications, and cost estimates for the 

above work as directed, along with the 

necessary construction documents to put 

the project out for bids. During construc- 

tion, the architect/engineer shall review 

shop drawings and make periodic trips to 

the construction site to observe that the 

construction is performed in accordance 

with the plans and specifications. The ar- 

chitect/engineer shall also prepare final 

inspection reports to insure the contrac- 

tors have completed the project satisfac- 

torily.

Century Code, it is the duty of landowners 

or operators with land adjoining regularly 

traveled county and township highways to 

mow weeds and grasses on the said road 

right of way. The cutting shall be per- 

formed by the owner or operator between 

August 30 and October 1, 2009. The 

minimum cut width shall be 12 feet from 

the edge of the roadway. The maximum 

height of the remaining stubble shall be 

six inches. If landowners fail to cut the

pervisors may cause the weeds and

The State of North Dakota will conduct 

a public hearing at 10:00 am (CST) on 

Thursday, September 17, 2009. The lo- 

cation of the meeting will be at the Lake 

Agassiz Regional Council, Main Floor

ND. The purpose of this meeting is to re- 

ceive input on housing and non-housing 

community development needs, for the 

development of the state’s 2010-2014 

Consolidated Plan, and the 2010 Action 

Plan. 

The Consolidated Plan, required by the 

Federal Department of Housing and Ur- 

ban Development (HUD), describes the 

state’s demographic characteristics; 

housing inventory, housing needs primari- 

ly for persons of low and moderate in- 

come, the homeless, and special needs 

persons; and the state’s housing and non- 

housing priority needs. The Plan also in- 

cludes five year goals for housing and 

non-housing needs, a description of 

available resources, and a description of 

how certain resources will be delivered. 

The emphasis of the Plan is to benefit low 

and moderate income persons. 

In addition, the Plan contains the Ac- 

tion Plan for the year 2010 that serves as 

the state’s grant application for the Com- 

munity Development Block Grant 

(CDBG), HOME, and Emergency Shelter 

Grants, (ESG) programs. The Action 

Plan contains the program descriptions 

that describe how these programs will be 

delivered in the year 2010. 

The public is encouraged to attend the 

public hearing to learn about the Plan and 

to provide ideas for its development. At a 

later date, the public will be invited to ob- 

tain a copy of the draft Plan and to pro- 

vide written comments.

construction activities include clearing, 

grading, and excavating that result in land 

disturbance of equal to or greater than 

one acre. Construction activity also in- 

cludes the disturbance of less than one 

acre of total land area that is part of a 

larger common plan of development or 

sale, if the larger common plan will ulti- 

mately disturb equal to or greater than 

one acre. 

The permit requires the implementation 

of a pollution prevention plan to reduce 

erosion and sediment impacts to surface 

waters. The permit includes discharge 

conditions based on prohibitions, best 

management practices, water quality 

standards, and other considerations appli- 

cable to the activities. 

Tentative Determinations 

Proposed effluent limitations and other 

permit conditions have been made by the 

Department. They assure that State Wa- 

ter Quality Standards and applicable pro- 

visions of the FWPCAA will be protected.

The Owner may waive any infor- 

malities or minor defects or reject any and 

all Bids. Should there be reason why the 

contract cannot be awarded within the 

specified period, the time may be extend- 

ed by mutual agreement between the 

Owner and the Bidder. Should the bids 

exceed the estimate, deductive alternates 

will be accepted if possible in the order in 

which they are listed, to the extent neces- 

sary to stay within the funds available, 

with a reasonable reserve for construction 

contingencies. 

Bidders must satisfy themselves of the 

accuracy of the estimated quantities in 

the Bid Schedule by examination of the 

site and a review of the drawings and 

specifications including Addenda. After 

Bids have been submitted, the Bidder 

shall not assert that there was a misun- 

derstanding concerning the quantities of 

Work or of the nature of the Work to be 

done. 

The Contract Documents contain the 

provisions required for the construction of 

the project. Information obtained from an 

officer, agent, or employee of the Owner 

or any other person shall not affect the 

risks or obligations assumed by the Con- 

tractor or relieve him from fulfilling any of 

the conditions of the contract. 

When the Agreement is executed the 

bonds of the remaining unsuccessful Bid- 

ders will be returned. The Bid Bond of 

the successful Bidder will be retained until 

the payment Bond and Performance 

Bond have been executed and approved, 

after which it will be returned. Attorneys- 

in-fact who sign Bid Bonds or Payment 

Bonds and Performance Bonds must file 

with each Bond a certified and effective 

dated copy of their Power of Attorney. 

The party to whom the contract is 

awarded will be required to execute the 

Agreement and obtain the Performance 

Bond and Payment Bond within ten (10) 

calendar days from the date when the No- 

tice of Award is delivered to the Bidder. 

The Notice of Award shall be accompa- 

nied by the necessary Agreement and 

Bond forms. In case of failure of the Bid- 

der to execute the Agreement, the Owner 

may at his option consider the Bidder in 

default, in which case the Bid Bond ac- 

companying the proposal shall become 

the property of the Owner. 

The Owner may make such investiga- 

tions as he deems necessary to deter- 

mine the ability of the Bidder to perform 

the Work, and the Bidder shall furnish to 

the Owner all such information and data 

for this purpose as the Owner may re- 

quest. The Owner reserves the right to 

reject any Bid if the evidence submitted 

by, or investigation of, such Bidder fails to 

satisfy the Owner that such Bidder is 

properly qualified to carry out the obliga- 

tions of the Agreement and to complete 

the Work contemplated therein. 

All applicable laws, ordinances, and 

the rules and regulations of all authorities 

having jurisdiction over construction of the 

project shall apply to the contract through- 

out. The failure or omission of any Bidder 

to do any of the foregoing shall in no way 

relieve any Bidder from any obligation in 

respect to his Bid.
