Stamp Duty is to be Replaced by Property Tax In NSW<br />

as Part of a Major Property Tax Reform<br />

In last week’s State Budget the NSW Treasurer, Dominic Perrottet,<br />

announced that the Government is embarking on a public<br />

consultation process in relation to the reform of property taxes in<br />

NSW –replacing stamp duty with a small annual property tax on an<br />

opt-in basis. NSW stamp duty on property purchases dates back to<br />

1865 and is considered to be outdated and inefficient, as its high costs<br />

have a negative impact on buyers looking to enter the market. For<br />

example, the median cost of buying a new home in Sydney is slightly<br />

more than $1.1 million, therefore attracting approximately $40,000 in<br />

Stamp duty. A prohibitive expense for many first-time buyers. While<br />

first home buyers may be eligible for a full or partial exemption on<br />

transfer duty, the home value must be $800,000 or less. Well below<br />

the median price of a home in Sydney. Additionally, the majority of transactions take place between<br />

existing home buyers, which wouldn’t qualify for any type of duty exemption.<br />

This form of tax is also highly volatile in periods of stagnant transaction activity. As a way to stimulate<br />

activity the State Government tends to cut stamp duty, resulting in a large revenue drop for the<br />

government coffers and subsequent negative budgetary impacts. Conversely, when property sales are<br />

booming, money flows in to its coffers and they spend like drunken sailors. This change will provide the<br />

government a much more reliable and efficient stream of income in the long-term.<br />

It is proposed that buyers will be given an option to either pay the current stamp duty or opt for a longterm<br />

annual property tax, to prevent double taxation. This will undoubtedly present a short-to-medium<br />

term problem for the government, as the more people choose to pay annual property tax, revenue will<br />

drop in the intervening period. The proceeding decades will likely witness Sydney property stock where<br />

half of properties pay property tax and the other half upfront stamp duty. These issues are likely to<br />

surface when the government embarks on a consultation process.<br />

House prices may rise a little higher in the first years of the new system, because buyers can afford a bit<br />

more. However, in the long-term the average price of housing would likely fall as more retirees consider<br />

downsizing, thus unlocking large properties and increasing supply. Additionally, young couples that may<br />

have purchased an apartment for their first home, would likely be encouraged to sell their first apartment<br />

to buy a larger home, as their family grows. To cover the revenue shortfall, the state government is<br />

encouraging Victoria and Queensland to join in these reforms in order to make a case to the federal<br />

Government for assistance in funding the scheme in the intervening years.<br />

Fernando takes special care to look after properties under management<br />

management in New York City and Los Angeles, respectively. He’s currently<br />

Alicia has completed her degree in Interior Architecture and is currently<br />
