Terms & Conditions Of Employment Relationships
Leave is governed by the Basic Conditions of
Employment Act which sets out the types of leave.
Namely annual leave, sick leave, maternity leave and
family responsibility leave, which we have briefly
summarised below. It is always a good idea to have
a leave policy in place to avoid any misunderstanding
or confusion.
ANNUAL LEAVE
Annual leave applies when an employee
works more than 24 hours a month for
an employer and is calculated from the
commencement date of employment. Leave is
accumulated as follows: 1 day for every 17 days
worked, or 1 hour for every 17 hours worked.
Leave can only be taken when the employer
agrees to such leave and may be refused with
just cause. Employers, due to operational
requirements such as shutdowns and/or busy periods, may
require leave to be taken at specific times during the year. When
an employee is on leave they must receive full remuneration for
such days. On the termination of the employment relationship,
any outstanding leave owed to the employee must be paid out
to them.
SICK LEAVE
Sick leave is calculated from the
commencement date of employment and
over a 3-year cycle. During the first 6 months,
an employee may only take 1 day’s paid sick
leave for every 26 days worked. The employee
is entitled to the equivalent of six weeks off
work. For example, employees that work a
5-day week will be granted 30 days sick leave
per cycle and employees that work a 6-day
week will be granted 36 days sick leave per cycle. Sick leave is
paid leave, however, the employer is entitled to request proof of
illness, if the employee is absent for longer than 2 consecutive
days or if there is a pattern of illness (the employee is often sick
on a Friday). If a medical certificate is not submitted the employer
is not obliged to pay for the sick leave.
MATERNITY / PATERNITY LEAVE
A female employee is entitled to 4
months unpaid maternity leave, which
can commence four weeks before
the expected date of birth or on the
written recommendation of a doctor/
midwife. Employees may not return
to work within 6 weeks of having the
baby unless supported by a written
recommendation of a doctor/midwife.
The employee needs to notify her employer of her intended
leave dates. Some companies subsidise maternity leave,
however, this is not an obligation. The employee may make a
claim from the Department of Labour and Unemployment Fund
for her maternity leave. A male employee is entitled to 10-days
unpaid paternity leave. Employees will need to provide a birth
certificate as proof of birth. Again, similarly to female employees,
the employee may make a claim from the Department of Labour
and Unemployment Fund for his paternity leave.
FAMILY RESPONSIBILITY LEAVE
Employees employed for over 4
months, working more than 4 days
a week, will be entitled to 3 days
paid family responsibility leave, per
leave cycle. The employee is only
entitled leave under the following
circumstances (1) The birth of an
employee’s child (2) Illness of an
employee’s child (3) In the event of
the death of the employee’s: (a) Spouse (b) Partner (c) Parent
(d) Adoptive parent (e) Grandfather/grandmother (f ) Child
(g) Adopted child (h) Brother/sister. As with sick/paternity
leave the employee will need to provide proof (eg. a medical/
death certificate).
