Strong leadership<br />

needed at CPVV<br />

Last month the Victorian Regulator’s CEO, Aaron de Rozario, finished his time with Commercial<br />

Passenger Vehicles Victoria (CPVV) and moved into a position with the National Transport<br />

Commission. Six years ago Mr de Rozario took over the helm from the acting CEO James<br />

Holyman, and at that time said that he “was looking forward to meeting Victorian stakeholders<br />

and working with the industry to ensure a sustainable future”.<br />

But, how did that work out? It was surprisingly not so good for Victorian stakeholders!<br />

Under Mr de Rozario’s reign, the Victorian taxi and hire car industry was deregulated, licences<br />

were revoked with minimal value paid as compensation, Uber was permitted to operate illegally<br />

for three years without repercussions, more forms and procedures were introduced, more onus<br />

was placed on the Booking Service Providers thereby causing less work for CPVV personnel,<br />

touting was made legal, maximum age of vehicles for taxis and hire cars was abolished and<br />

there were no fare increases.<br />

So what did Mr de Rozario do in his six-year tenure at CPVV? He destroyed the Victorian taxi<br />

and hire car industry!<br />

Three of CPVV’s top personnel, Aaron de Rozario (CPVV CEO), Al Martin (CPVV Executive<br />

Director) and Megan Burke-O’Neil (Chairman of CPVV Commissioners) have all left CPVV.<br />

Currently, Tammy O’Connor is CPVV’s acting CEO. Let’s hope that she has good oversight of<br />

everything that is happening in the industry and within the CPVV, otherwise this mess will only<br />

get prodigious.<br />

updates<br />

ONLINE FOR BOOKED<br />

HIRE SERVICE LICENCES<br />

Department of Transport and Main Roads (TMR) has<br />

launched a new online service for Booked Hire Service<br />

Licence holders. The Apply for/Amend Booked Hire<br />

Service Licence online service has been upgraded to<br />

allow holders with current or approved Booked Hire<br />

Service Licences to:<br />

• Update the vehicle registration details<br />

• View, print, email and download a copy of<br />

Booked Hire Service Licence/s<br />

• Surrender a Licence<br />

• Update the contact person details<br />

You need to change your vehicle registration details<br />

on your Booked Hire Service Licence if:<br />

• You’ve sold your vehicle<br />

• You’ve obtained personalised plates<br />

• You’ve bought a vehicle<br />

• You’ve changed your number plates<br />

• Your vehicle is written off<br />

All you will need to use the service:<br />

• Booked Hire Service Licence number<br />

• New vehicle details<br />

If you are not the registered operator of the vehicle,<br />

complete Form F5190 to obtain consent from the<br />

registered operator to attach the vehicle to your<br />

licence.<br />

If the CTP insurance class needs to be upgraded,<br />

contact your insurer and attach a copy of your CTP<br />

change of class letter.<br />

​If you attach Form 5190 or CTP change of insurance<br />

class letter to your vehicle amendment request, your<br />

request will be assessed by the department.<br />

You must not start using the new vehicle for your<br />

Booked Hire Service Licence until you have been<br />

notified by email whether your vehicle registration<br />

amendment has been approved or refused, or you<br />

may be liable to a fine or sanction.<br />

Remember:<br />

• Applications can take up to twenty (20) business<br />

days to process.<br />

• If your application is approved, you will receive<br />

an email from TMR with your Booked Hire Service<br />

Licence.<br />

• If your application is refused, you will receive<br />

notification from TMR.<br />

• Other drivers may use the vehicle listed on your<br />

Booked Hire Service Licence to provide ridebooking<br />

services, however they must have a<br />

current Driver Authorisation and carry a copy of<br />

the Booked Hire Service Licence for the vehicle.<br />

Department of Transport and Main Roads (TMR) has<br />

a team of dedicated transport inspectors focused on<br />

the personalised and passenger transport industry.<br />

These inspectors intercept and inspect personalised<br />

transport vehicles during the week and on weekends<br />

in peak periods.<br />

The most common instances of non-compliance<br />

identified are:<br />

1. Defect notices for non-compliant tyres<br />

2. Defect notices for lights not working<br />

3. Defect notices for oil leaks<br />

4. Penalty Infringement Notices (PINs) for not<br />

displaying ride-booking signage<br />

5. PIN for parking in the incorrect zone (bus, taxi) or<br />

on a solid yellow line<br />

6. PIN for driving defective vehicle<br />

Drivers and operators can avoid the above matters by<br />

being aware of their obligations, undertaking regular<br />

vehicle maintenance, and ensuring their vehicle is in<br />

a safe condition to be used. A pre-start process will<br />

assist with this along with checks during a shift.<br />

2 years<br />

The Regional Seniors Travel Card, is a $250 prepaid Visa card designed to ease the burden of travel costs for<br />

eligible seniors in rural, regional and remote areas and can be used for pre-booked NSW Trainlink Regional<br />

trains and coaches, fuel and Taxis.<br />

From 2022, 300,000+ seniors in Regional NSW, who have reached the Age Pension age and are receiving any<br />

one of the following are eligible to receive the Regional Seniors Travel Card:<br />

• the Age Pension through Services<br />

Australia or the Department of Veterans’<br />

Affairs;<br />

• a Disability Support Pension or a Carer<br />

Payment from Services Australia;<br />

• a Service Pension issued by the<br />

Department of Veterans’ Affairs;<br />

• a Disability Pension through the<br />

Department of Veterans’ Affairs under the<br />

Veterans’ Entitlements Act 1986;<br />

• a War Widow(er)’s Pension issued by the<br />

Department of Veterans’ Affairs.<br />

People who hold a Commonwealth Seniors<br />

Health Card issued by Services Australia<br />

or the Department of Veterans’ Affairs are<br />

also eligible and the regional boundaries for<br />

applicants will remain the same in 2022.<br />

Seniors across NSW have benefited from the<br />

initial two-year travel card trial, with 337,500<br />

cards issued in 2020 and more than 330,000<br />

cards issued to regional seniors in <strong>2021</strong> so far.<br />

the pandemic<br />

AN EXTRA LAYER OF PROTECTION<br />

The NSW Government is being<br />

urged to provide an additional<br />

layer of defence against the risk<br />

of COVID-19 at Sydney Airport<br />

with London Taxis, tailor made to<br />

provide enhanced protection to<br />

drivers and passengers.<br />

The NSW Taxi Council had<br />

proposed to the NSW Government<br />

last year to utilise these purposebuilt<br />

Taxis for transporting<br />

vulnerable and high-risk<br />

passengers. Unfortunately, the<br />

NSW Government did not progress<br />

with the proposal to use London<br />

Taxis at the time.<br />

Amidst the recent lockdown in<br />

Sydney, there are a number of<br />

these Taxis sitting dormant at<br />

Sydney Airport ready to be utilised<br />

with COVID-safe measures like<br />

sanitisation, mandatory masks,<br />

distancing in practice, along with<br />

the extra physical barrier of a<br />

safety screen.<br />

My name is Bruce Maguire, and I am the Lead Policy Advisor with Vision Australia. In that role I develop<br />

the organisation’s public positions on issues that affect the blind and low vision community, and I also<br />

write submissions to government and industry inquiries. As I am blind, I use Taxis quite a bit, and I think<br />

that taxi drivers can play a really important part in helping to make us feel more independent and included<br />

in the community. I have two adult children and became a grandfather last year.<br />

you grew up? — A: A doctor – I still want to be one when I grow up.<br />

TAA Meetings<br />

with relevant industry stakeholders<br />

Transport Alliance Australia (TAA) is prepared to organise and participate in<br />

meetings with relevant stakeholders such as the Victorian regulator, Commercial<br />

Passenger Vehicles Victoria (CPVV), so it can deliver further industry insight and<br />

knowledge to its members, and members have the vehicle to express their views as<br />

well.<br />

It is important for all TAA members to be consistently aware<br />

of the issues the industry faces, proposed solutions and<br />

updates on the progress of those solutions. The goal is to<br />

create positive change in the industry.<br />

Transport Alliance Australia – looking after<br />

the interests of those in the Australian<br />

commercial passenger transport sector.<br />

Our latest meeting with Wedding<br />

Car Association (WCA), VicRoads,<br />

Commercial Passenger Vehicles<br />

Victoria (CPVV) and Department<br />

of Transport (DoT), on Thursday<br />

24th of June, was an insightful<br />

and productive one. We were<br />

able to retrieve more answers<br />

surrounding illegal operators,<br />

H-plates and club permit<br />

vehicles, and come up with viable<br />

suggestions for solutions to these<br />

issues.<br />

Rob Brewer, WCA President,<br />

initiated the meeting with<br />

a statement expressing his<br />

exhaustion by the lack of action<br />

from regulators to stop illegals,<br />

which goes against the common<br />

goal of ensuring public safety.<br />

One of his major concerns is club<br />

plated cars misusing their plates<br />

for commercial gain and doing<br />

weddings. He asserted that if<br />

those in charge of the industry<br />

were really concerned about<br />

public safety, they wouldn’t allow<br />

the risk of illegals on the road –<br />

operators that have no duty of<br />

care, pay less in registration and<br />

TAC and profit from illegal activity<br />

let alone not pay taxes and stamp<br />

duty.<br />

Currently there are 90,000 H-plate<br />

club permit vehicles in Victoria,<br />

but not all of them are being used<br />

illegally.<br />

CONCERNS RAISED<br />

• Club plated cars are<br />

advertised on social media,<br />

booking agents, magazines,<br />

the Easy Weddings website<br />

and VIC Tourism websites<br />

stating they are available for<br />

weddings and promotional<br />

work.<br />

• Many illegals show up on<br />

Facebook and Instagram, yet<br />

VicRoads hasn’t had many<br />

offences reported about<br />

this, which supports the idea<br />

that the public isn’t aware of<br />

illegal versus legal operators.<br />

WHAT’S BEEN DONE<br />

• VicRoads has designed<br />

and implemented a new<br />

procedure in January <strong>2021</strong><br />

to investigate reports of club<br />

permit vehicles being used<br />

as wedding vehicles. CPVV’s<br />

website was updated to<br />

outline this to commercial<br />

passenger vehicle<br />

participants.<br />

• In 2020, the current Road<br />

Safety (Vehicles) Regulations<br />

were amended to make<br />

it clear that club permit<br />

vehicles were not to be used<br />

for commercial purposes.<br />

Specifically, the amendments<br />

state that this misuse is<br />

a breach of the general<br />

conditions of commercial<br />

passenger vehicles.<br />

• It was also confirmed<br />

that clubs can indeed be<br />

cancelled; those with club<br />

permits using their vehicles<br />

commercially must be<br />

reported to CPVV. Their<br />

vehicle club permit would<br />

be cancelled along with the<br />

club, if it ended up being<br />

involved in the scheme. The<br />

investigation would then be<br />

passed onto Victoria Police<br />

and State Revenue Office.<br />

MOVING FORWARD<br />

CPVV advised that its compliance<br />

team has expanded from 12 to<br />

50, and they are apparently being<br />

trained in all things CPVV.<br />

Greg Maloney from CPVV<br />

emphasised that CPVV is removing<br />

illegal vehicles from its system –<br />

some of which have popped up<br />

again but CPVV is continuing to<br />

enforce them.<br />

VicRoads has requested any<br />

evidence with regards to club<br />

permit vehicle owners operating<br />

illegally be forwarded to them via<br />

the VicRoads website.<br />

VicRoads takes these concerns<br />

with the utmost seriousness and<br />

investigations are in process.<br />

Since VicRoads can’t fine H-plates<br />

for flouting the laws, it would<br />

inform Victoria Police, which in<br />

turn would action the fining.<br />

SOLUTION SUGGESTIONS<br />

It was agreed that public<br />

awareness on the issue of<br />

illegals needs to be increased,<br />

as customers don’t know the<br />

difference between illegal<br />

operators and legal operators.<br />

President, is confident that with<br />

an effective advertising campaign<br />

across the hire car industry to<br />

highlight illegal operators, whilst<br />

the enforcement of illegals<br />

continues, a majority of them can<br />

be eliminated.<br />

WCA, TAA and VicRoads will<br />

strategise an advertising<br />

campaign to educate the<br />

public, and organise a social<br />

media campaign to encourage<br />

Wheelchairs<br />

during<br />

transport<br />

In the past five months there have been two separate<br />

incidents involving a passenger in a wheelchair<br />

sustaining fatal injuries during a trip in a wheelchair<br />

accessible vehicle (WAV).<br />

Wheelchairs must be appropriately restrained when<br />

passengers are seated in them. Failure to do so may<br />

result in the wheelchair moving or falling whilst in<br />

transit, unseating the passenger which can result in<br />

serious or fatal injuries.<br />

Drivers of WAVs are cautioned that legal action<br />

could be taken against them if they are found to<br />

breach their obligations when carrying passengers<br />

with mobility aids. In addition, CPVV may suspend or<br />

cancel the driver accreditation held by any driver who<br />

has failed to fully and properly restrain a passenger<br />

in a wheelchair, or has attempted to transport a<br />

wheelchair or scooter and its passenger in any manner<br />

which is not consistent with the above requirements.<br />

Contributing factors to WAV related incidents could<br />

include:<br />

• Failing to ensure that the passenger’s wheelchair<br />

is of a type that is suitable to be appropriately<br />

restrained within the WAV.<br />

• Failing to have the wheelchair positioned with<br />

the occupant facing the front of the vehicle and<br />

the wheelchair located between the front and<br />

rear restraint attachment points on the floor of<br />

the vehicle.<br />

• Failing to secure the wheelchair with brakes –<br />

this could see the chair roll and build enough<br />

momentum to stress the tie down straps.<br />

• Failure of tie down equipment to hold the<br />

wheelchair in place – this may be because it is<br />

damaged, not attached correctly, or faulty.<br />

It saddens me deeply to write again regarding the devastation our industry is experiencing because of this<br />

pandemic.<br />

These past two lockdowns in Victoria have differed from previous restrictions and that is because this time,<br />

the commercial passenger vehicle sector has been financially supported.<br />

We are very pleased that after initial discussions with Treasurer Tim Pallas, Minister Ben Carroll and<br />

Parliamentary Secretary to the Premier<br />

MP Steve Dimopoulos, we could ensure<br />

the Victorian taxi and hire car industry was<br />

eligible for the Business Support Package.<br />

We desperately needed it.<br />

Businesses who received the $5000 grant<br />

as part of the Business Costs Assistance<br />

Program in the last lockdown will now<br />

automatically be eligible for an additional<br />

$4800 of support for the 12-day lockdown #5.<br />

While I have been pleased with the<br />

support provided by the government to<br />

our industry, I am concerned that a lack<br />

of regulation has meant that this support<br />

has not been distributed fairly. Taxi drivers<br />

and rideshare drivers have been put in<br />

the same category and because of this,<br />

the CPVV does not have the capacity to<br />

differentiate between those who work two<br />

days a month or those who work full-time.<br />

registration process, which allows drivers<br />

who have registered to stay in the system<br />

actively driving or not. It is the<br />

responsibility of the driver to<br />

deregister when they stop driving,<br />

however, this is rarely done.<br />

Part-time rideshare drivers who<br />

have other forms of income<br />

have also been made eligible for<br />

support grants. In my view, this<br />

undermines the effort to ensure<br />

that support goes where it is<br />

needed most. This is simply unfair.<br />

This is why I believe that<br />

commercial passenger vehicle<br />

licences should be granted on an<br />

annual basis. This will ensure that<br />

we have the correct information<br />

required to direct support where it<br />

is needed and deserved.<br />

Overall, I am pleased to see the<br />

government recognising the<br />

struggles of our industry and<br />

taking action to support those<br />

who have previously fallen<br />

through the cracks. This is a<br />

significant step forward.<br />

ADVISORY PANEL<br />

Next week, I will be returning to my position on<br />

the Commercial Passenger Vehicle (CPV) Advisory<br />

Panel. We will be meeting on a regular basis. I will<br />

be bringing a range of issues for the government<br />

to consider, including the revocation of licences,<br />

regulations, data collection, electric vehicles and the<br />

Multi-Purpose Taxi Program.<br />

This panel will focus on frank and constructive<br />

discussion on how we can assist the industry in<br />

recovery out of this pandemic. We will be advising the<br />

government on how to regulate the industry and on<br />

strategies for growth moving forward.<br />

I believe this panel will be critical for the future of the<br />

commercial passenger vehicle industry and we will be<br />

working our hardest to ensure your voice is heard.<br />

as a travel option?<br />

It is likely to be around 10-15 years before these Flying<br />

Cars are really a potential travel option for the general<br />

public. You can expect to see some sooner, potentially<br />

in around 5 years, but this will be in much smaller<br />

numbers.<br />

Q. What are the challenges and what are the<br />

Q. When will Australia likely see Flying Cars<br />

as a travel option?<br />

There are dozens of Flying Car variants in development<br />

around the world, however only a small number are in<br />

full-scale flight testing. Those in full-scale prototype<br />

flight testing include Lilium (Germany), Cora (USA),<br />

and SkyDrive (Japan). Currently, there are no Flying Car<br />

vehicles in public use, however Japan has stated that<br />

it would like to see these vehicles flying in just a few<br />

years’ time.<br />

Q. Do you see Flying Cars impacting the<br />

commercial passenger industry (taxis, hire<br />

cars, rideshare)? And if so, in what way?<br />

Early adopters of this technology, based on investment<br />

thus far, are likely to include rideshare companies,<br />

for example Uber has invested in multiple Flying Car<br />

developments, including partnering with Hyundai on<br />

development of a vehicle for ridesharing purposes.<br />

Hence, it is expected to impact the commercial<br />

passenger industry in the future, with people having<br />

the option to book personal transportation via a Flying<br />

Car if they prefer for their journey.<br />

The other potential early adopter is emergency<br />

services, particularly with air ambulance services<br />

taking an interest, as these vehicles are being designed<br />

to be more versatile than traditional aircraft and<br />

helicopters, potentially improving service capabilities.<br />

An example of this is CareFlight in NSW, which has<br />

partnered with AMSL Aero (Australia) on development<br />

of their vehicle, the Vertiia.<br />

9,500 licensed taxis GONE<br />

across England<br />

since COVID-19 broke, according to DfT<br />

ENGLAND – The number of<br />

licensed taxi vehicles across<br />

England has dropped by a<br />

staggering 9,500 in the first twelve<br />

months since the Coronavirus<br />

pandemic first broke according to<br />

latest data released.<br />

The Department for Transport<br />

(DfT) has released annual statistics<br />

covering the taxi and private hire<br />

industry across England.<br />

Within the stats it shows a sharp<br />

decrease in the number of licensed<br />

cabs in the 12 months starting<br />

from 31 March 2020.<br />

In March 2020 the number of<br />

licensed taxis stood at 67,800, but<br />

has now dropped by 14% to just<br />

58,300 vehicles in the 12 month<br />

period.<br />

In London alone 59% of the 9,500<br />

lost taxis were attributed to the<br />

capital.<br />

Within those stats, and<br />

worryingly for those with mobility<br />

requirements, the number of<br />

licensed Wheelchair Accessible<br />

Vehicle (WAV) taxis dropped by<br />

19% from 38,900 to 31,700 in just<br />

one year.<br />

The licensed taxi industry wasn’t<br />

the only sector hit hard. There was<br />

a similar decrease experienced in<br />

the private hire industry too.<br />

In March 2020 298,600 Private Hire<br />

Vehicles (PHV) were licensed with<br />

local licensing authorities across<br />

England. Fast forward a year and<br />

that figure has spiralled by 47,500<br />

to 251,100. That figure represents a<br />

drop of 16% across England.<br />

Just 4,700 of the 251,100 PHV are<br />

WAVs.<br />

In June, the Chairman of the<br />

Licensed Private Hire Car<br />

Association (LPHCA) warned that<br />

a ‘catastrophic shortage of drivers’<br />

risks the sustainability of the taxi<br />

and private hire industry.<br />

Steve Wright, Chairman of the<br />

LPHCA, warned of the potential<br />

problems last summer when he<br />

contacted the Secretary of State<br />

for Transport, Grant Shapps.<br />

Steve Wright said in the latest<br />

issue of Private Hire News: “Sadly,<br />

our prediction of the possibility<br />

of a catastrophic shortage of<br />

drivers is becoming a reality and<br />

the LPHCA will continue to make<br />

ministers aware of the difficulties”.<br />

“Last <strong>July</strong> we wrote to Rt. Hon.<br />

Grant Shapps MP Secretary of<br />

State for Transport to draw his<br />

attention to potential serious<br />

problems and the risks to the<br />

sustainability of the taxi and<br />

Uber drivers launch class<br />

action against rideshare<br />

company<br />

Legal fight hopes to override previous ruling that drivers are not<br />

employees<br />

NEW ZEALAND – Uber drivers<br />

are taking the global rideshare<br />

company to court, in the hopes<br />

of being legally determined as<br />

employees instead of contractors.<br />

It is the latest in a string of cases<br />

taken against the company and<br />

other rideshare apps, and the<br />

second such case in New Zealand.<br />

Two unions, First Union and E Tu,<br />

will take the class action to the<br />

Employment Court on behalf of<br />

more than 20 drivers. They hope<br />

to override a legal precedent set in<br />

the court last year, which ruled a<br />

driver was not an employee.<br />

An Uber driver’s rate is set by<br />

Uber, but First Union’s Anita<br />

Rosentreter said the judge in<br />

last year’s decision concluded<br />

that the driver had control over<br />

their wages because they could,<br />

in theory, be paid less, or could<br />

improve the profitability of<br />

their business through adopting<br />

cheaper business costs – such as a<br />

phone plan.<br />

“I find it unfathomable that<br />

someone thinks that is a<br />

compelling argument,” said<br />

Rosentreter.<br />

The Employment Relations Act<br />

2000 requires that the intention<br />

of the parties, and how an<br />

employment relationship acts<br />

in practice, must be considered.<br />

Merely stating in a contract that<br />

a person is a contractor does not<br />

mean it will automatically pass the<br />

legal test.<br />

Rosentreter said Uber ultimately<br />

has control over how its business<br />

is carried out and how much<br />

drivers are paid for each ride.<br />

She said the drivers are out there<br />

representing Uber’s brand, not<br />

their own, meaning they should<br />

be deemed as employees, despite<br />

signing on as independent<br />

contractors.<br />

“The court has to look at the<br />

reality of the way drivers are<br />

working and the relationship<br />

they have with the company and<br />

decide if that looks more like an<br />

employment relationship than the<br />

relationship of a contractor or a<br />

client,” Rosentreter said.<br />

The legal challenge is part of a<br />

two-pronged attempt to seek<br />

better conditions and security for<br />

Uber and food-delivery drivers.<br />

The unions delivered a report<br />

titled Gig Work in Aotearoa to the<br />

minister for workplace relations<br />

and safety, Michael Wood, at<br />

Parliament earlier this month,<br />

outlining legal grey areas for gigworkers<br />

in employment law, their<br />

lack of employment security, and<br />

worrying trends in their rates of<br />

pay.<br />

As self-employed contractors,<br />

the drivers are being deprived<br />

of their minimum employment<br />

entitlements, including the<br />

minimum wage, holiday pay,<br />

sick leave and legal recourse for<br />

unjustified dismissals, the report<br />

said.<br />

53% of the respondents said they<br />

earned less than the minimum<br />

hourly wage after expenses.<br />

“We have an opportunity in<br />

Aotearoa to get ahead of the<br />

worst excesses of the gig economy<br />

and learn from ample overseas<br />

evidence that employment<br />

laws need to be fit for purpose,<br />

not prone to exploitation by<br />

companies like Uber,” Rosentreter<br />

said.<br />
