This month however, the industry<br />

experienced their first live event since the<br />

start of Lockdown. PROFCon 21 held at<br />

Brooklands Museum was a great success with<br />

presentations to an invited audience. It was an<br />

enjoyable day, and a reminder that however<br />

good modern methods are, a Zoom call is<br />

no substitute to meeting in face to face. You<br />

can read all about the event in Derek’s pages,<br />

starting on page 10.<br />

A<br />

key role for any recovery operator holding a police<br />

contract will be the movement of a vehicle, whether it’s a<br />

car, motorcycle, van or perhaps a commercial vehicle that<br />

has been involved in crime. That recovery operator will have the<br />

responsibility of moving the vehicle without contaminating the<br />

evidence and maintaining a clear evidence trail, with continuity<br />

within the operator’s process.<br />

The IVR’s VR19 module enables a recovery technician to<br />

recover a vehicle on behalf of the Police (or managing agent),<br />

without contaminating or damaging vital evidence. Evidence that<br />

may be required to secure a prosecution.<br />

This highlights some of the diverse work that recovery<br />

technicians are required to turn their hand to. There can be a<br />

lot riding on the way these vehicles are recovered and stored. It<br />

cannot stay where it is, it needs to be moved and stored, but in<br />

so doing vital evidence can be affected by bringing contamination<br />

into the scene, by moving evidence or by destroying evidence<br />

such as on-board computer data.<br />

Forensics is so finely detailed that it is surprising that a vehicle<br />

can be moved but still be used in evidence. So, a recovery<br />

technician needs to show absolute professionalism, whilst<br />

continuing to look out for his/her own health and safety in these<br />

situations. The recovery technician and the operator are part of<br />

the chain of continuity, one weak link can bring a case crashing<br />

down.<br />

These are the reasons that the National Highways Sector<br />

Scheme 17/17B (NHSS17/17B) includes IVR VR19 as the module to<br />

attend to ensure that the recovery technician is acutely aware<br />

of what can and cannot be touched during recovery and how to<br />

handle the recovery process without any contamination.<br />

Aside from which the NHSS17/17B was not only developed for<br />

Highways England, but for other Government agencies such as<br />

the Police. NHSS17/17B is ready-prepared and off the shelf for<br />

police to write into their recovery contracts.<br />

The VR19 module was written in association with a number of<br />

police forces, it has been recently updated and refreshed again<br />

with police CSI specialists ensuring it is up to date to current<br />

standards. The module will continue to be reviewed as required.<br />

As always, the Institute likes to ensure that theory is brought to<br />

life through practical engagement and practice, therefore the<br />

module also has a practical element to it.<br />

The course does not instruct how to be a forensic scientist<br />

or a CSI, or demand that you already be one, that is simply not<br />

necessary, but it does give a forensics appreciation of how to<br />

recover a vehicle without disturbing vital evidence. This VR19<br />

course is also intended for any VRO’s staff who may come into<br />

contact with vehicles requiring evidence preservation back at<br />

their base or SOCO facility, where the VRO<br />

may be expected to store these vehicles. Only VR19 certified<br />

recovery personnel should attend a police job where the vehicle<br />

is required for evidence.<br />

This VR19 module, has been delivered to a number of police<br />

forces and forensic officers, gaining their full support, emotively<br />

described by the Police as “SPOT ON!” it is also worth noting that<br />

this course has been externally accredited by LANTRA and can<br />

only be delivered by a qualified, IVR approved instructor.<br />

The All Industry Display Team<br />

One of the main highlights of every Tow Show is the amazing recovery<br />

demonstrations staged by the All Industry Display Team, sponsored by Boniface<br />

Engineering.<br />

Taking place daily in the Boniface Arena, this impressive display is somehow<br />

produced bigger and better every year. To those in the audience who take their seats<br />

to enjoy this part of the event the display is ultra-slick, extremely impressive and very<br />

well organised.<br />

This comes as a result of a huge amount of resource and coordination, with<br />

planning that starts in earnest a long time before the actual show takes place in<br />

Telford. Michael Boniface kindly tells us what to expect at this years show.<br />

Preparations are well under way to<br />

provide interesting and informative<br />

demonstrations in the Boniface<br />

Arena at the Tow Show in September,<br />

including some ideas carried forward from<br />

2020 when the show was cancelled.<br />

The team will be led by Nick<br />

Ovenden whose objective is to put<br />

on demonstrations that show the<br />

audience techniques that may expand<br />

their knowledge and possibly influence<br />

the approach taken to situations that<br />

recovery operators face in their day to<br />

day business. The team comprises of<br />

individuals from a wide cross-section of<br />

the industry, from hands-on operators<br />

to office managers, all who generously<br />

provide their time to support Boniface<br />

in putting on the display, sometimes<br />

devoting a week to the cause and some<br />

even taking annual holiday to attend.<br />

We are fortunate once again to have<br />

the assistance of John Coupland who<br />

will take the microphone to fill in some<br />

of the gaps in commentary when Nick<br />

may be focusing on a particular recovery<br />

scenario.<br />

The vehicles on display range from<br />

large Century Rotators to small Isuzu<br />

pickups, the big stuff rolling, lifting and<br />

towing a range of casualties, the Isuzu<br />

showcasing the products of Boniface’s<br />

associated company in France, Jige<br />

International. Expect to see Recoverer<br />

Tridents with Sidewinders deploying four<br />

winches through four fairleads to control<br />

roll a tanker, look at the latest multitool<br />

attachment designed by Boniface,<br />

a product that is low, offset and can be<br />

combined with other lifting devices, and<br />

there will also be the latest innovations<br />

from BA Products from the US, a company<br />

that has been developing light weight fibre<br />

chains and aluminium lifting devices.<br />

One demonstration not to be missed<br />

this year will be supported by Highways<br />

England who along with the IVR will<br />

recover an electric car, possibly accident<br />

damaged. As the number of these<br />

vehicles increases on the roads business<br />

owners and operators will benefit from<br />

seeing what should be avoided and how<br />

to recover safely.<br />

A GREAT SUCCESS FOR<br />

PROFCon 21<br />

It’s not very often Paul gives me the subject matter to write<br />

about, but I guess after attending such a successful industry<br />

conference in PROFCon 21, and by dating it and stating it’s<br />

the inaugural PROF conference, most certainly means we<br />

can look forward to a second event next year.<br />

With attendance numbers set low to avoid any Covid<br />

complications, it was decided by Richard to make the<br />

event, by personal invitation only and not to have the event<br />

drag on to a full day, but to have a full packed half day, with 4 good<br />

speakers, plus a final spot delivered by me, followed by, yes, a free<br />

lunch.<br />

The event was well publicised in <strong>Professional</strong> <strong>Recovery</strong> magazine,<br />

advertising the fact that the days main sponsor was Highways<br />

England (HE), so to get the proceedings underway Highways England<br />

acting CEO, Nick Harris addressed the room opening the event,<br />

expressing how pleased Highways England were, both to be the main<br />

sponsor but also to be involved in the proceedings. Colin Stevenson<br />

provided a relationship update and more so the relationship with<br />

PROF and the independent recovery industry had flourished over<br />

the past couple of years.<br />

Nick also expressed how pleased he was that the day also marked<br />

another true milestone in the relationship Highways England now<br />

has with the independent recovery industry, further cementing<br />

the relationship and the signing of 2 further strategic partnership<br />

agreements, one with the independent work providers and the other<br />

with our industry colleagues National Tyre Distributors Association<br />

(NTDA).<br />

The day’s events were set, and the rostrum was passed back<br />

to Richard, who with his innovative style and enthusiasm held the<br />

audience in an eerie silence, expressing the professionalism of<br />

the independent recovery industry. Richard played a short video<br />

endorsing the fact that the recovery industry is not the household<br />

names recognised in yellow and orange liveries but emphasised to<br />

some of the audience, for whom it was their first recovery industry<br />

event, that it was the independent network operating on a national<br />

basis that was the true fourth emergency service.<br />

Part of the video flicked through the independent operators<br />

in action, showing the huge investment and the full diversity the<br />

independent operator has at its disposal. Specialist equipment the<br />

household names do not have but highlighting how the independent<br />

network are relied upon. The video showed operators from the<br />

far south of the country and stretched to operators as far north<br />

as the England/Scotland border, this all-inclusive and UK unified<br />

approach was also demonstrated by the attendance of the PROF<br />

regional forum members. These are the PROF members who make<br />

representation at the Highways England Regional meetings. The<br />

following statements were received in the days following:<br />

by all involved and well received by important influential<br />

attendees to the industry. This is a turning point, and we<br />

are proud to be part of the PROF forum representing the<br />

The final part of Richard’s presentation included a message from<br />

Grant Shapps, Transport Minister, endorsing how essential the<br />

recovery industry is to the UK economy and that it is the true<br />

Fourth Emergency Service. Not leaving it there Richard questioned,<br />

how with all that investment and expertise is it possible for the<br />

independent work providers to lose work to the public sector, those<br />

household names? He emphasised it was time to close that gap and<br />

for that work to be retained by the independent sector.<br />

“I believe that a united Independent Vehicle <strong>Recovery</strong><br />

Network coming together to share best practices and thought<br />

processes can only be a positive step for the industry. Through<br />

continuing to develop our working partnerships with each other,<br />

I feel it will greatly benefit the industry as a whole and I look<br />

forward to seeing PROFCon develop into a permanent feature in<br />

the annual events calendar”<br />

vast industry knowledge and as an IVR ITSSAR Cat 4 Tutor and Vice<br />

Chairman of the Institute of Vehicle <strong>Recovery</strong>, Mark Hartell gave a<br />

very informative overview of the Institute, the role it plays improving<br />

and maintaining the industry’s high standards as well as the vital<br />

role it plays as the administrators to the National Highways Sector<br />

Scheme (NHSS17/17B) National Training Scheme. For some of the<br />

audience this was the first introduction to the fantastic and vital role<br />

the IVR plays.<br />

However, the main element of Mark’s presentation was regarding<br />

EV and Hybrid vehicles and to dispel the false conversations around<br />

thermal event within the battery and high voltage systems. This<br />

section of his presentation was evidence based, with the Toyota<br />

Prius now over 20 years old there have been no reported fatalities<br />

or serious injuries from the HSE, possibly because the IVR VR27<br />

module has steered away from the need to have anything to do with<br />

the high voltage systems.<br />

Mark expressed the need for pragmatic EV and Hybrid training,<br />

he explained that there was more to consider than electrocution,<br />

thermal event and toxic fumes. The real issues for a VRO were<br />

around vehicle weights, locking wheels, smart keys and just as<br />

importantly, when to rely on the emergency services. He highlighted<br />

the expectation that a recovery operator putting on his specialist<br />

rubber boots, rubber gloves, etc. in all conditions, day, night, rain<br />

or snow, at the side of the road, to carry out a manual disconnect<br />

function was not pragmatic. He went on to explain that most<br />

manufactures have hidden the plug and for good reason.<br />

England has been doing to improve the relationship it has with the<br />

independent recovery industry and just how seriously it takes the<br />

safety and wellbeing of our roadside staff. Accepting the fact that<br />

todays very good relationship has not always been the case and that<br />

there was a time when the independent network was somewhat<br />

undervalued, he went on to describe just how distant a memory that<br />

was and that today we are hugely respected and are considered in<br />

all of Highways England operational decision making.<br />

Clear examples of this are within our partnership agreement and<br />

the involvement that PROF and the other signatories to the strategic<br />

partnership agreement have. With the 7 regional areas now with<br />

dedicated contact numbers and the regional meetings that are now<br />

regularly on the agenda, the executive group again made up of the<br />

independent stakeholders (these meetings are chaired by the acting<br />

CEO, Nick Harris, something we would never have seen before), the<br />

introduction of dedicated signs and signals specific to the recovery<br />

industry (this incidentally we have been asking for, for years) so a<br />

clear indication of how this relationship is working for everyone,<br />

thank you to the HE team, Nick Harris, Peter Alan, Wayne Carey and<br />

Colin Stevenson.<br />

If you have never heard of the next speaker before, then you<br />

are missing out. Stefan Hey, CEO NTDA, a well-orchestrated<br />

presentation and real-life roadside experiences of the tyre industry,<br />

so likened to the devastating experiences our industry faces, tragic<br />

fatalities of tyre technicians carrying out their duties. Stefan shared<br />

pictures of tyre vans so damaged they’re not recognisable.<br />

They also take standards and training as serious as the Institute<br />

of Vehicle <strong>Recovery</strong> and the recovery industry does, their training<br />

qualification is ‘REACT Licence’ Roadside Emergency Action<br />

Concerning Technicians, in the same vein as the NHSS17/17B Skills<br />

identity card, the IVR RQM card, the NTDA are doing their level<br />

best to ensure all roadside tyre technicians are qualified and hold a<br />

REACT licence.<br />

Stefan expressed how pleased he was and thanked Richard and<br />

PROF for the opportunity to present at PROFCon but also for his<br />

help in building the relationship with Highways England and the<br />

NTDA. Stefan talked about the signing of the tyre industries strategic<br />

partnership agreement, which was signed at the conference,<br />

something Stefan took great pride in being involved in.<br />

NTDA Chief Executive Stefan Hay said: “PROFCon21 was a<br />

seminal event for the recovery industry and both the NTDA<br />

National Chairman and I were both extremely pleased, and<br />

proud, to be involved. PROF and its Chairman Richard Goddard,<br />

have been instrumental in bringing not only the recovery<br />

industry together, but also in creating an alliance with the NTDA<br />

and its members who work on commercial tyre incidents on<br />

the strategic road network, culminating in the new strategic<br />

partnership we have signed with Highways England. There can<br />

be no doubt, therefore, that the recovery industry is, indeed,<br />

coming of age!”<br />

The final presentation was left for me, ‘The Future of the <strong>Recovery</strong><br />

Industry’, perhaps not about the future but more the present,<br />

without going into too much detail I highlighted the issues the<br />

independent industry faces today.<br />

Using London as an example (sorry for that), I highlighted the<br />

issues clean air zones (CAZ’s), low traffic neighbourhoods (LTN’s) and<br />

the ULEZ extension - that is now just around the corner, are having<br />

on the recovery industry. Demonstrating that to date £15 million<br />

has been spent in London on LTN’s, a tip of the iceberg as there’s<br />

been £250 million set aside for LTN’s across the rest of the country.<br />

Knowing the problems this has caused in London we can only<br />

imagine the widespread problem the rest of the country now faces,<br />

as apart from operational issues this has a knock-on effect of your<br />

operation costs and truck residual values.<br />

This was another point I raised, and Mark Hartell brought to<br />

the surface in his presentation, with the growth of EV and Hybrid<br />

vehicles, the independent operator faces another issue, the 3.5t<br />

transporter will become virtually redundant, as it will be lacking in<br />

payload capacity.<br />

However, by far the biggest and most important issue facing the<br />

recovery industry is the staffing problem. The RHA survey showed<br />

the haulage industry is at least 100,000 drivers short. Without<br />

our own survey data we can easily estimate the recovery industry<br />

represents 10% of that figure, yes, it’s at least 10,000 drivers short<br />

and let’s not forget a recovery driver holds a very different skill-set<br />

to general haulage.<br />

The recovery industry is now suffering from the distinct lack of<br />

youth investment from the garage sector, as this is arguably where<br />

our skilled workforce originates from. In my presentation I suggested<br />

now is the time that the recovery industry should create its own<br />

FastTrack system to encourage drivers to the recovery sector.<br />

However, my presentation had a strong focus on our own sector<br />

developing youth training and apprenticeship opportunities.<br />

Lastly, a presentation from me would be lost without highlighting<br />

the need for self-regulation, after all it is part of the strategic<br />

partnership agreement with, Highways England and it would go a<br />

long way to resolving a whole raft of industry issues. Now I’m sure<br />

some of you readers will be saying I bet that Firminger promotes ‘R’<br />

Licence or ROLS, well absolutely not, in fact I suggested they are<br />

removed and for now discarded, left for another day, if ever.<br />

What the recovery industry should do is make PAS 43 and<br />

NHSS17/17B mandatory. Adopt PAS 43, even though we know it<br />

has a few holes in it and use it as the operational tool to manage<br />

your business by and then use the established, tried and tested<br />

NHSS17/17B, and the already approved UKAS auditors as the<br />

statutory instrument to ensure compliance.<br />

names, each and every one should already be working to that as a<br />

Following that bombshell Richard returned to close the<br />

event, thanking everyone for taking the time from their busy<br />

diaries, extending a special thanks to Mick Burke and Terry Hunt,<br />

representing the Metropolitan Police and National Police Chief<br />

Council (NPCC) and Ian Greenman representing United Kingdom<br />

Rescue Organisation.<br />

I am yet to mention a very special guest, Nikki King OBE, as we all<br />

know she has always been one of our industries biggest supporters.<br />

Although Nikki is meant to be retired and putting her feet up, I<br />

can assure you, that is never the case she interrupted a very busy<br />

schedule to attend the morning session and I leave you with some<br />

very special words.<br />

“I came out of retirement last week to attend the PROFCon<br />

at Brooklands. For many years I tried to persuade the<br />

Industry that if they would only work together, they would<br />

be a major force in government. The lack of a united body<br />

to represent the roadside recovery and repair industry has<br />

made it impossible for government to talk to the industry as a<br />

whole and this situation has been manipulated by the service<br />

providers to their advantage for many years.<br />

It was therefore wonderful to see last week that, at last, the<br />

whole industry was showing a united force. To see Highways<br />

England, the other emergency services, tyre specialists and the<br />

independent recovery industry all working together to improve<br />

working relationships and safety issues was a very emotional<br />

moment for me and I felt privileged to be asked to attend.<br />

A huge thank you must go to the new head of the Highways<br />

England, Nick Harris for his willingness to accept new thinking<br />

and his very positive attitude to shaping the way forward.<br />

Above all, the Industry must owe a massive debt of gratitude<br />

to Richard Goddard who has worked tirelessly to achieve such<br />

a major landmark for recovery operators throughout the UK.<br />

His speech on Thursday reflected all the gravitas this industry<br />

deserves, and I am so proud to call him a friend.”<br />

Well we did it - Independent day. The inaugural PROFCon 21 took place on July 29th and from<br />

the many quotes and the amazing feedback I received on the day PROFCon 21 was a success.<br />

Don’t take my word for it; many of you<br />

don’t anyway, see for yourselves on<br />

the PROF website, and many of the<br />

other social media platforms. Not Facebook<br />

though, or should I call it, Two Facedbook,<br />

your little tinkers you are!<br />

Anyway, back to reality, it was great to<br />

just have an industry event again, although<br />

COVID restrictions restricted capacity, the<br />

quality and diversity of the stakeholders<br />

who attended made it a worthwhile event.<br />

The signing of two significant partnership<br />

agreements made the inaugural PROFCon a<br />

historic independent industry event.<br />

I am very proud that PROF played<br />

a leading role in orchestrating these<br />

partnerships, as I believe they will play<br />

a positive role in further unifying the<br />

independent recovery industry to meet the<br />

major industry challenges ahead.<br />

The independent recovery industry<br />

partnership agreements are a vital building<br />

block in uniting an industry that for too long<br />

has been divided and thus has been largely<br />

undervalued and mostly ignored.<br />

It takes two to agree to a partnership<br />

and on that basis I thank Highways<br />

England for embracing such a positive and<br />

constructive approach to the recovery<br />

industry. Highways England have not only<br />

met us halfway, but have been consistently<br />

proactive in building the very positive<br />

relationship and agreements we now have<br />

in place.<br />

Both Wayne Carey and Colin Stevenson<br />

from Highways England in particular have<br />

both been a constant source of positive<br />

proactive support and communication.<br />

Without their daily commitment the<br />

achievements of the last 22 months would<br />

not have been possible. So thank you guys<br />

and I should also mention that without the<br />

back up and personal support afforded<br />

to them from the very top of Highways<br />

England again nothing could have been<br />

possible.<br />

I also want to thank Peter Allen and<br />

Acting CEO, Nick Harris for their personal<br />

input and support. It was really great to see<br />

the personal positive interactions between<br />

all of them and the industry stakeholders<br />

that were present. People who had never<br />

met before have connected and can now<br />

work together in improving standards,<br />

safety and hopefully the economics of an<br />

industry that has come of age.<br />

That positive message gives us a real<br />

voice at government level but also a real<br />

working relationship with other important<br />

essential and emergency services. In terms<br />

of economics, as an industry we must<br />

work together to make ourselves and our<br />

independent industry stakeholders and<br />

work providers much more competitive,<br />

and start by recognising what the real<br />

economic problems are and confront<br />

them. If lock down hasn’t taught you that<br />

the real competition is not each other It’s<br />

the ferociously competitive brand that<br />

masquerades as the rescue and recovery<br />

industry whilst it is sucking the life blood<br />

out of it.<br />

The independent work providers cannot<br />

continue to sustain losing corporate<br />

clients to what is in effect both of our<br />

competition. When they lose a client to<br />

that cocker spaniel and then regurgitate<br />

that same work back into the independent<br />

network but roughly around 20% less than<br />

the previous independent provider without<br />

the opportunity to fix rather recover, than<br />

we are the architects of our own economic<br />

demise.<br />

We are the real recovery industry,<br />

and in many cases we are the only ones<br />

capable of recovering the 20%. Or more<br />

of the vehicles they can’t fix and then can’t<br />

or won’t recover. During lockdowns the<br />

independent work providers have kept us<br />

alive with work and economic supplements<br />

that were vital to our survival. Meanwhile<br />

that cocker spaniel withdrew over 90% of<br />

its work and left us to sink or swim. Those<br />

of us who managed to swim thanks to the<br />

independents should now be supporting<br />

those work providers with maximum<br />

support and input.<br />

The fragility of the support network that<br />

still exists and the limited recovery fleets<br />

and recovery resources now available to<br />

certain breakdown clubs, have left them<br />

vulnerable as demand is exceeding supply.<br />

If the UK suffers a harsh winter, which is<br />

very feasible, that fragility will manifest<br />

itself to members being left for hours at the<br />

roadside and on motorways because the<br />

mix of work and the demand for precious<br />

resources will far out way supply.<br />

I’ve seen many reports already from<br />

VRO’s up and down the country, some<br />

in Scotland, stating that they are now<br />

attending members of one organisation that<br />

have been left for so long on motorways<br />

they have become statutory removals.<br />

During the recent Transport Select<br />

Committee hearings, Edmund King was<br />

questioned regarding what percentage<br />

of AA resources rather than AA subcontractors<br />

were used on Smart<br />

Motorways. Mr King stated that it depended<br />

on what day of the week it was, or whether<br />

there was a resource close by, which<br />

actually seemed to frustrate the Chair of<br />

the committee, but in my opinion was a<br />

stark indictment of the actual contempt<br />

we are held in by an organisation that still<br />

refers in evidence to the recovery industry<br />

as ‘garages’.<br />

PROFCon was not an industry conference<br />

just for the sake of a conference; it’s a<br />

first step for the independent industry to<br />

collectively take stock of its self. Talk to<br />

itself with a real sense of purpose of how<br />

we can initiate the small and some radical<br />

changes we need to work on together.<br />

Realise some work providers are in some<br />

cases your competitors.<br />

Recruitment/ULEZ/climate change,<br />

generational changes, training, and of<br />

course the most important challenge of<br />

safety at the roadside.<br />

The willingness of Highways England<br />

to now work with us in genuine strategic<br />

partnerships, the consistent economic<br />

support of our independent work<br />

providers aligned with their willingness to<br />

work together with us will make us more<br />

effective and harder to ignore at any levels.<br />

The new positive interactions with<br />

both the NPCC and UKRO will add new<br />

constructive dimensions to many of the<br />

discussions ahead and of course, no<br />

PROF event would be complete without<br />

representatives from our colleagues<br />

from the NTDA. Who themselves signed<br />

a partnership agreement with Highways<br />

England, which gave me great pleasure as I<br />

initiated it.<br />

It was lovely to see my friend Nikki King<br />

at an industry event. A longtime industrious<br />

supporter of the recovery industry, who<br />

founded RISC, and gave me a co-write<br />

credit on founding our great industry<br />

charity. Nikki herself has battled numerous<br />

heath issues but there isn’t much that<br />

could keep her away from PROFCon. If they<br />

sent Nikki King to Afghanistan the Taliban<br />

would have to think twice. Together we<br />

will be working with the IVR and Highways<br />

England to bring the recovery industry into<br />

schools colleges and to the Skills for Life<br />

Trusts she so passionately supports.<br />

It was great to finally meet Lance Williams<br />

and I was delighted that he openly admitted<br />

Profcon21<br />

to enjoying the day and that he had been<br />

inspired by the conference. High praise<br />

indeed and great to hear.<br />

I’ve seen and heard many observations<br />

that PROF is just me, blah blah blah.<br />

Dictator blah ! Maybe I am a dictator who<br />

knows. What I do know is without the<br />

unstinting support from, people like Andy<br />

Lambert who not only is passionately<br />

committed to RISC, his commitment to<br />

PROF and basically the recovery industry is<br />

unstinting.<br />

Without him I’m not sure there would<br />

have been a PROFCon. Derek Firminger<br />

who might tell you stuff you don’t want<br />

to hear, but who works tirelessly behind<br />

the scenes and sometimes behind enemy<br />

lines helping to raise real awareness and<br />

standards is a massive help to me, as is Mac<br />

Hobbs unless it’s buying a round of drinks.<br />

Paul Gregory’s Tow Show experiences and<br />

organisational skills were also a big help,<br />

and I can’t wait for next month’s Tow Show.<br />

I make no secret of my passionate<br />

support of the IVR. They are the heartbeat<br />

of this industry. They independently<br />

maintain and administrate the standards<br />

this industry relies upon. Every<br />

collaboration with the IVR is balanced and<br />

an education in doing the job safely and<br />

correctly and I thank them for the input<br />

that went into PROFCon. There is still a lot<br />

to be learnt from the IVR and we can now<br />

look forward to them interacting with the<br />

NTDA, initiating new methods and standards<br />

and helping us to maintain standards whilst<br />

learning new techniques.<br />

Finally, creating the PROF regional forum<br />

has given me a great deal of satisfaction.<br />

Some of the industries most respected<br />

VRO’s make up the regional forum, and<br />

it was brilliant that Billy Calvert from<br />

CF Engineering and Sean Manchett of<br />

Manchetts Garages made the long journey<br />

down to Brooklands to attend PROFCon -<br />

thank you.<br />

Mac Hobbs of HRS missed his heart<br />

appointment at the stonemasons to attend<br />

and help out and Ray Coleman of Lanterns<br />

<strong>Recovery</strong> Services, made time to attend<br />

himself. He is back at the treasury now,<br />

discussing granting a loan agreement to the<br />

Highways England signs a further two unifying<br />

agreements with the recovery industry<br />

Highways England has signed two further unifying agreements with the recovery industry, with<br />

the National Tyre Distributors Association (NTDA) and independent recovery industry work<br />

providers Green Flag, Allianz Partners, LV=Britannia Rescue, GEM Motoring Assist and Call Assist<br />

These agreements were signed by Highways England’s<br />

Acting CEO Nick Harris at this year’s PROFCon 21 event at<br />

Brooklands Motor Museum in Surrey on 29th July 2021. They<br />

see Highways England making a commitment to both NTDA and the<br />

Independent <strong>Recovery</strong> Industry Work Providers to work together<br />

to improve communications and achieve best practice across the<br />

industry, whilst encouraging vehicle recovery operators (VRO’s) and<br />

commercial tyre technicians to always work safely on the network.<br />

The new agreements, which were initiated by the <strong>Professional</strong><br />

<strong>Recovery</strong> Operators Federation, follow a ground-breaking<br />

industry first last March 2020, which saw Highways England sign<br />

an initial agreement to unite with strategic stakeholders within the<br />

independent recovery industry.<br />

Nick Harris, acting Chief Executive, Highways England says: ‘‘In<br />

March 2020, Highways England signed a strategic partnership<br />

agreement to unite with the independent recovery industry. Since<br />

signing the agreement, we have taken positive steps to update<br />

recovery protocols on motorways and to improve our day-to-day<br />

operational communications between vehicle recovery operators<br />

and Highways England. I am pleased to be signing two additional<br />

strategic partnership agreements with the independent recovery<br />

work providers and the NTDA. These agreements, which have<br />

been made possible by the help and support of PROF, further<br />

demonstrates Highways England’s commitment to work more<br />

closely with the recovery industry.”<br />

With a range of independent bodies operating within the industry<br />

and Highways England responsible for the network they operate<br />

on, it became clear that further operational and strategic guidance<br />

would benefit all parties, which is how the initial agreement was<br />

born.<br />

Since signing the original agreement just over a year ago, great<br />

progress has been made in working more closely with the recovery<br />

industry.<br />

This work includes:<br />

• The formation of a new Highways England <strong>Recovery</strong> Industry<br />

Executive Committee chaired by Nick Harris<br />

• The creation of seven new operations led regional recovery<br />

groups, to improve day-to-day operational communication<br />

between VROs and Highways England.<br />

• Producing a new joint working protocol guidance document<br />

covering the recovery of large vehicles on the network<br />

• Launching a new direct ‘<strong>Recovery</strong> In’ phone numbers to enable<br />

improved two-way communication between VROs and Highways<br />

England traffic officers.<br />

• Creating four new recovery focussed signs to help support the<br />

safety of VROs working on our network and provide motorists<br />

with information and awareness of a VROs presence and recovery<br />

activity.<br />

Stefan Hay, Chief Executive of the NTDA said: “We are delighted<br />

proving to be highly productive, for the Association. The level of<br />

access the NTDA and its members now have at both operational<br />

and executive level within Highways England is unprecedented<br />

safer roadside working for those REACT trained commercial tyre<br />

technicians deployed across the strategic road network.”<br />

Neil Worth, Chief Executive of GEM Motoring Assist said: “As an<br />

organisation we have spent the past 90 years working to achieve<br />

safer roads for everyone, be they our members, recovery operators<br />

or the wider community. Highways England’s input into our Blue<br />

Light Aware resource has been invaluable and this agreement will<br />

allow us to strengthen and develop our partnership work for the<br />

benefit of GEM members and all road users.”<br />

Ben Johnson, Director of Networks at Call Assist said: “Call Assist<br />

is passionate about working with Highways England and likeminded<br />

work providers, as we all share best practices to ensure we<br />

continue providing a first-class assistance service.”<br />

Highways England recognises recovery operators as an essential<br />

service and the importance in the role they play helping to clear<br />

incidents and keep traffic moving.<br />

The principal purpose of the agreements is to guide the working<br />

partnerships in line with national agreements and guidance from<br />

within the vehicle recovery industry.<br />

The agreements have given the opportunity for all involved to<br />

identify areas of joint working and respective areas of interest. It<br />

sets out a commitment to work together towards issue resolution<br />

and closer partner working in the future.<br />

or motorways it will mean they can expect to receive a more<br />

consistent recovery service, with improved communications<br />

between Highways England traffic officers and recovery operators.<br />

return to Boniface<br />

Since its inception back in 1959,<br />

Boleyn <strong>Recovery</strong> has traded with the<br />

vehicle recovery and maintenance<br />

industries, steadily growing to become the<br />

successful business it is today. Supporting<br />

London’s blue light services since the<br />

1970’s through to today Boleyn have<br />

continually ensured their fleet of vehicles<br />

another new vehicle Boleyn <strong>Recovery</strong><br />

again approached Boniface Engineering<br />

onto a DAF XF chassis.<br />

The INTERSTATER MK6 with Maxi-Reach<br />

Lowline K Boom has a maximum lift<br />

capacity of 33t when retracted at 2.04<br />

meters and an impressive maximum lift<br />

capacity of 9T when fully extended at<br />

4.34 metres. The rear hydraulic stabiliser<br />

legs provide a solid footprint when<br />

operating the equipment and with the flip<br />

over spades deployed, provide excellent<br />

anchorage for the twin 15,000kg winches<br />

during heavy winching operations. The<br />

newly designed ram height allows for<br />

the underlift to have an even higher<br />

range of movement resulting in it being<br />

perfectly horizontal when using the Safe<br />

Bar equipment to tow casualty vehicles.<br />

In addition to the standard forks and<br />

pedestals Boleyn <strong>Recovery</strong> decided to<br />

have this latest vehicle fitted with the Safe<br />

Bar lifting set allowing them to maximise<br />

the equipment’s capabilities as required.<br />

The 12 function remote handset<br />

mounted in the cab provides the driver<br />

the ability when using the rear camera to<br />

lower the underlift from within the cab<br />

reducing the time he needs to spend on<br />

the roadside. Other options included by<br />

Boleyn were a six drawer toolbox mounted<br />

in the locker, LED Beacon, LED strobes,<br />

LED worklights, LED underlift worklights<br />

and LED scene lights mounted on the flyer<br />

and the body to provide an illuminated<br />

work area for the operator. The body of<br />

the truck was painted white to match the<br />

cab and whilst this is a change from the<br />

recognisable blue when fitted with the<br />

new Boleyn reflective livery it really looks<br />

the part and will most definitely will stand<br />

out from the crowd.<br />

For over 30 years Manchester Breakdown Services have been<br />

providing breakdown and recovery assistance for both car and<br />

commercial vehicles. Due to their expertise and outstanding<br />

AVRO’s Response to the Government<br />

Consultation on Removal, Storage<br />

and Disposal Vehicle Charges<br />

Please find below an excerpt from AVRO’s submitted<br />

response to the statutory fee consultation.<br />

CURRENT PRACTICE:<br />

It is generally the case that any authority<br />

(normally a Police Force or Highways<br />

England) operating a vehicle removal<br />

scheme within England and Wales will,<br />

together with their management agent,<br />

take part of the proceeds from the<br />

statutory fees, through management fees,<br />

to generate revenue for themselves. We<br />

believe that this practice is absolutely<br />

contrary to the position of successive<br />

Governments as laid out in paragraph<br />

7.5 of the explanatory memorandum<br />

preceding the existing 2008 legislation<br />

(see below). We believe that this practice<br />

is unethical and against the spirit of the<br />

law. This behaviour adds considerably to<br />

the level of financial distress within the<br />

recovery industry to the point where we<br />

are now seeing gaps appearing in the<br />

nationwide vehicle recovery operator<br />

network as operators struggle to sustain<br />

their business as a direct result of<br />

the reduced revenue combined with<br />

additional demands required of them to<br />

support the crucial service they provide.<br />

In fact, in some instances the vehicle<br />

recovery operator only receives 37%<br />

of the statutory removal fee, with the<br />

remaining 63% taken as a management<br />

fee by ‘middlemen’ managing agents<br />

and subsequently the Police or Highways<br />

England. This is totally unacceptable given<br />

that both the Police and Highways England<br />

are already taxpayer funded entities.<br />

It must be noted that simply increasing<br />

the current statutory fees for removal,<br />

storage, and disposal - as is proposed<br />

within the consultation document - is<br />

NOT the sole solution to this problem.<br />

Without specific action by Government<br />

on this point and regardless of the level<br />

of any statutory fee, it (the increase) will<br />

continue to be eroded away from the<br />

vehicle recovery operator to be expunged<br />

by the ‘middlemen’ managing agents<br />

whom, it seems, have free will to impose<br />

any amount of management fee and<br />

additional service level requirement they<br />

choose.<br />

This is compounded by the fact that in<br />

2008, when the most recent legislation<br />

and current level of statutory fees were<br />

introduced, average management fees<br />

charged by Police forces and ‘middlemen’<br />

management companies to the vehicle<br />

recovery operator were circa £0 to £12.00<br />

plus VAT per vehicle. Even though there<br />

has been no increase in the statutory<br />

fees, management fees on Police schemes<br />

range from between £40.00 to £75.00<br />

plus VAT per vehicle – a substantial<br />

increase which has been forced upon the<br />

vehicle recovery operator. An increase<br />

from £12.00 to £40.00, for example,<br />

represents a percentage increase of 333%<br />

- this is an unjust increase for the Police<br />

and their middlemen.<br />

On Highways England schemes, the<br />

‘middlemen’ managing agents take even<br />

higher fees which decreases the revenue<br />

for the vehicle recovery operator. In<br />

one scenario for heavy recovery on<br />

the Highways England vehicle removal<br />

scheme, the ‘middleman’ managing agent<br />

(FMG) receives a cut of £1446.00 from the<br />

£6000.00 statutory removal fee, thereby<br />

leaving only £4554.00 for the vehicle<br />

recovery operator – this is totally unjust.<br />

Simply put, it is beyond doubt that<br />

the Police and Highways England, and<br />

their ‘middlemen’ managing agents are<br />

using the statutory charges as a means of<br />

generating revenue in stark contrast to<br />

the government’s position, at the expense<br />

of the core recovery industry that is on<br />

the front line providing the expertise and<br />

infrastructure to deliver and support the<br />

removal and recovery service.<br />

An excerpt of the Government’s position is<br />

below for clarity:<br />

‘EXPLANATORY MEMORANDUM TO THE<br />

REMOVAL, STORAGE AND DISPOSAL<br />

OF VEHICLES (PRESCRIBED SUMS AND<br />

CHARGES) REGULATIONS 2008’.<br />

“7.5 Ministers take the view that the<br />

charges should not be punitive or an<br />

income generator for the police, but<br />

should be set at such a level as to make<br />

removal operations viable.<br />

7.6 The new higher charges are necessary<br />

because otherwise it is likely to become<br />

uneconomic for contractors to continue<br />

these operations. This is especially so if<br />

there were any increase in the numbers<br />

who insisted that they would pay only the<br />

statutory charges, whatever the actual<br />

cost incurred.<br />

7.7 If contractors decided to stop work for<br />

the police, this would have a detrimental<br />

effect on the police’s ability to enforce the<br />

law, remove obstructions and potential<br />

dangers, prevent theft of the vehicles,<br />

their being used for crime or becoming<br />

a focus for crime or environmental<br />

degradation or being driven in a<br />

dangerous condition.<br />

AVRO strongly impresses upon those<br />

responsible for giving due consideration<br />

to this crucial matter a summary of the<br />

following points:-<br />

All charges collected from the<br />

statutory removal, storage and disposal<br />

of vehicles must be ringfenced and<br />

retained in totality by the core vehicle<br />

recovery operator with no part<br />

paid over to any internal or external<br />

‘middlemen’ styled managing agents<br />

or indeed Police forces, Highways<br />

England, or other authority. Neither<br />

the Police, Highways England or others<br />

should be allowed to take any part of<br />

the statutory fee.<br />

The use and subsequent cost of using<br />

‘middlemen’ managing agents by Police<br />

forces, Highways England, or others,<br />

whether internal or external, should be<br />

borne by the reliant authority as part of<br />

their taxpayer funded finance – it must<br />

not be financed by the vehicle recovery<br />

operator.<br />

There should be no ‘bundling’ of extra/<br />

additional services for Police Forces,<br />

Highways England, or others at the<br />

expense of vehicle recovery operators<br />

such as free or below market value<br />

roadside recovery services for Police<br />

own vehicles, vehicles recovered<br />

under PACE legislation and services<br />

such as free storage, free forensic and<br />

mechanical examination facilities etc.<br />

Consideration must be given to the<br />

proposed EHAFV levy of 25% over and<br />

above what is proposed in Appendix<br />

One.<br />

Statutory Fees must be reviewed<br />

every three years in their entirety with<br />

consideration given to an annual rate<br />

increase. Each three yearly review must<br />

be comprehensive and consider the<br />

onset of different vehicle technologies<br />

and industry and market pressures.<br />

A mechanism must be introduced<br />

within statutory fees which will, in<br />

exceptional circumstances, permit the<br />

reasonable, justified, and authorised<br />

(by the authority) additional charges,<br />

over and above the statutory fee to<br />

ensure that vehicle recovery operators<br />

are recompensed sufficiently for<br />

exceptional recovery scenarios. Such<br />

incidents are usually abnormally<br />

large vehicles in size and/or weight,<br />

specialised in construction as well<br />

as size and scale and require the<br />

deployment of a specialist vehicle (or<br />

vehicles), equipment and resources<br />

that are not standard within the vehicle<br />

recovery industry such as mobile<br />

cranes, specialist lifting equipment,<br />

water rescue, diving services and<br />

others.<br />

Automotive industry charity, Ben, has launched its own league<br />

as part of the popular Fantasy Premier League game for the<br />

2021-22 season, which kicks off this week.<br />

Ben is inviting everyone in the industry to join its Fantasy<br />

to Exeter Chiefs Rugby Club manager. We also transported two<br />

horse drawn vintage vehicles using a King tilt low loader + 18 ton<br />

beaver tail to load them up. One vehicle was so heavy that six<br />

people couldn’t load the vehicle up and had to be winched on.<br />

My journey begins with some ‘hands-on’ and I should say ‘hands-off’ experience<br />

within the sector. Having registered to participate in an IVR course, I arrived to<br />

find not only one trainer but two. How lucky was I, double the teaching power and<br />

double the experience from within the industry!<br />

The course required plenty of equipment and most certainly<br />

did not disappoint, it was held at a busy recovery company<br />

who are accredited to NHSS 17/17B. From the very start<br />

security was apparent, with a sizeable secure compound, (I used<br />

google maps to locate the address) blanked off gates to obscure<br />

any view of the compound and its contents, a number of sealed<br />

SOCO bays where forensic investigation work was apparently<br />

carried out, a strict code of ‘do not touch’ and CCTV throughout.<br />

I felt privileged by such an opportunity and thoroughly enjoyed<br />

the experience. I came away with an understanding of why snatch<br />

blocks need to be correctly sized with winch cables, information<br />

about purpose and use of specialised equipment, ratio’s and<br />

the fact vehicle technicians need to have a high speed and<br />

accurate processing system to carry out calculations (usually an<br />

exceptional mathematical brain) in order to achieve a successful<br />

outcome. For the occasions which were not quite so successful<br />

there were examples of damaged equipment and discussions of<br />

how it ended up looking like it did. I could not stop myself from<br />

being distracted by the thought of “how much does it all cost?”<br />

and “how do you equate all of these costs to achieve a profit?”<br />

The scheme applies to recovery operators who provide<br />

contracted vehicle removal and recovery operations and is<br />

an ISO9001 Quality Management Scheme. There is an advisory<br />

the free recovery offered on<br />

motorway contraflow systems.<br />

NHSS 17B relates to the<br />

inspection and system<br />

requirements for providing<br />

public sector contracted<br />

vehicle recovery and removal<br />

operations and services<br />

(including storage) particularly<br />

in relation to the Strategic<br />

Road Network and for Police<br />

contracts in England. It is<br />

intended for use on the English<br />

Strategic Road Network and if<br />

deemed appropriate on roads<br />

operated by other highway<br />

authorities. It is also intended<br />

for use by police forces as a<br />

contract document for use in<br />

connection with the removal,<br />

recovery and where necessary<br />

storage of vehicles in respect<br />

of operational policing activity.<br />

It may therefore relate to any<br />

type of highway. It will be used<br />

to define the inspection and<br />

system requirements for recovery to be procured by Highways<br />

England as part of the National Vehicle <strong>Recovery</strong> Project and may<br />

be a requirement specified in other Highways England, highway<br />

authorities and police contracts. This is most definitely not a free<br />

service and associated statutory fees can easily render the Police<br />

contractor with a scene from Lizard Lick (those who have viewed<br />

the show will be able to visualise exactly what I mean) especially<br />

when disgruntled vehicle owners are required to part with large<br />

sums of money to regain possession of their vehicle and/or<br />

property.<br />

Itinerary<br />

The scheme requires a process for storage of personal<br />

belongings whereby staff are required to collate and log each<br />

item onto the computer system ELVIS, produce an itinerary,<br />

bag, tag and secure store (behind two locked doors) all whilst<br />

maintaining the integrity of such items. There is an element of risk<br />

for; lost, damaged or false item claims.<br />

The recovery operator will also need to be connected to the<br />

APEX system which requires technicians to be able to use PDA<br />

hand held devices. An appropriate support and training network<br />

should be available to assist staff with any technical difficulties<br />

they may encounter.<br />

NHSS17/17B certification requires an annual audit which is<br />

carried out by FMG which covers PAS43/ISO9001/NHSS17/17B.<br />

The auditor will carry out a physical check of; equipment and<br />

vehicles, loler certification, documented records of vehicle safety<br />

inspections and monthly equipment checks. The Auditor will also<br />

check; Hi Vis clothing meets the Class 3 standard, technicians<br />

training records, mandatory ID cards and DBS checks.<br />

As my journey in this sector draws to a close, I cannot leave<br />

without sharing a further personal experience. Within the same<br />

week of my IVR course, it seems the local NHSS17/17B provider<br />

was put to the challenge when a daytime drunk driver failed<br />

to stop and shunted the rear of my car. Luckily not too much<br />

damage on either vehicle thankfully. However, I doubt the<br />

offending driver would have had an opportunity of driving home<br />

that day, due to an observant passing Police officer who stopped<br />

to assist!<br />

In conclusion, it would appear a vast array of knowledge,<br />

variety of vehicles, endless amount of equipment, reliable<br />

resources, financial backing, 24/7 accessible facilities and a<br />

detailed paper trail are what it takes to successfully provide<br />

in this sector. FMG recently published an article looking for<br />

Vehicle <strong>Recovery</strong> companies in four separate Police force areas<br />

This is a very versatile little butane gas torch from Laser Tools<br />
