No matter what your sport of choice is, whether it is sailing, fencing, cricket or<br />

croquet, they all have a saying that is pretty much the same. That same saying<br />

applies to football as well, and as finals of all codes are approaching (or finished for<br />

some teams) across the country, I am taking heed of the coach’s advice to “lift my<br />

eyes” and respond to what I see.<br />

Our industry has been through an immensely harrowing time over the past year<br />

and a half. Whilst many members have been shut or suffering drastic reductions<br />

in visitations as there are no tourists, there are also plenty that are looking to “play<br />

what is in front of them” by turning the direction of their business or taking the<br />

opportunity to refresh their offerings.<br />

Over the past month our <strong>QHA</strong> team have concentrated on two key areas to assist<br />

members. Firstly, to get out and visit as many members as possible and connect<br />

them with support from Government, our industry partners and / or the <strong>QHA</strong> expert<br />

services. I think we have covered more kilometres this couple of months than all of<br />

last year combined. Secondly, we have tried to look ahead to see what the industry<br />

will face in the years to come in order to be prepared and to minimise the impact.<br />

It feels both strange and re-assuring to be back discussing liquor, tourism and<br />

gaming issues on behalf of members again. Looking for better deals from energy<br />

and insurance suppliers is back on the agenda, as is compiling a list of regulations<br />

that have hindered the industry for far too long and seeking to get them changed.<br />

This is just the beginning of the tasks and we will be happy to discuss them in<br />

detail with members as we head up to Cairns for our Regional Board Meeting,<br />

to Kingaroy for our “Pubs Pots and Profits” training, to the Gold Coast for our<br />

Accommodation GM meetings and everywhere in between. We won’t get out of<br />

this mess by constantly looking over our shoulder and worrying about COVID. Our<br />

eyes are keenly focused forward and we at the <strong>QHA</strong> are committed to forging a<br />

bright future with you, the members.<br />

In memory of<br />

Alf Zeller<br />

It is with great sadness that we pay tribute to Alf Zeller,<br />

a <strong>QHA</strong> leader of many years’ service.<br />

In the same year Australian Prime Minister Harold Holt<br />

walked off into the surf never to return, Alf Zeller walked<br />

into a pub in Toowoomba and started what was to<br />

become a life-long career.<br />

The year was 1960 and it was the beginning of a 10-<br />

year stint working in the hotel industry that saw Alf<br />

work as barman, yardman and administrator for the<br />

Canberra Hotel and Portadown Hotel in Toowoomba<br />

and the Kedron Park Hotel in Brisbane.<br />

Hotels had captured Alf’s attention and in September<br />

1970 Alf and his wife Margaret signed the lease on the<br />

King George Hotel in Roma and took on the challenges<br />

of managing a country pub.<br />

Over the next 48 years this dynamic duo owned,<br />

leased, or managed numerous hotels and motels<br />

through Queensland. Most recently they had built<br />

their empire around Townsville where Alf was once the<br />

president of Home Hill Race Club.<br />

Alf was a long-standing and loyal member of the<br />

Queensland Hotels Association, clocking up 37 years<br />

of service.<br />

He is a life member (since 2000) was Trustee for the<br />

State Board and has served in numerous positions<br />

including 10 years as a State Board member, almost<br />

20 years at the <strong>QHA</strong> Northern Zone Representative,<br />

and as President of the <strong>QHA</strong> – Townsville District – for<br />

about 20 years.<br />

The list of hotels the Zeller family has been involved<br />

in, either Alf and Margaret as a team, or via Alf Zeller<br />

Family Trust in conjunction with their son Garry Zeller<br />

is extensive and includes: Lake Eacham Hotel, 2014<br />

– January 2019; Central Hotel, Normanton, April 2007<br />

– 2014; Redbrick Hotel, Brisbane, January 2011 –<br />

May 2012; Railway Hotel, Ravenswood, April 2010<br />

– September 2010; Yongala Lodge Motel, Townsville.<br />

March 2005 – <strong>October</strong> 2008; Malpass Hotel, Home<br />

Hill, November 1986 – <strong>October</strong> 2004; Stuart Hotel,<br />

Townsville, November 1985 – March 1989; Malpass<br />

Hotel, Home Hill, July 1982 – September 1985;<br />

Midtown Hotel, Townsville, January 1981 – July<br />

1982; Canecutter Hotel, Innisfail, September 1976<br />

– December 1980; Empire Hotel, Roma, September<br />

1973 – September 1976: King George Hotel, Roma,<br />

September 1970 - September 1973.<br />

Alf, aged 80, passed away on 17 August 20<strong>21</strong>. His<br />

friends and family celebrated his life at a service at St<br />

Joseph The Worker Catholic Church in Wulguru on<br />

Wednesday, August 25. He was the beloved husband<br />

of Margaret and much-loved father and father-in-law<br />

of David and Sorelle, Glenn and Carolyn, Garry and<br />

Nicole, and Theresa, loving Pop of Jacquelyn, Jasmine,<br />

Ryan, Dylan, Cooper, James, Hayden, Holly and Abbey.<br />

Great-Pop of Harvey.<br />

Alf was a publican through and through. His service to<br />

the industry he loved and the people he worked with<br />

along the way was always generous. On behalf of his<br />

friends in the <strong>QHA</strong><br />

GAMBLING GRANTS TOP ONE BILLION<br />

The Gambling Community Benefit<br />

Fund (GCBF) recently passed a great<br />

milestone. The Round 108 of Funding<br />

passed the extraordinary One Billion<br />

Dollar funding mark.<br />

There has been over 62,000<br />

not-for-profit community groups that<br />

have been awarded funds across all<br />

parts of Queensland. We estimate the<br />

Hotel sector has contributed about<br />

60% of the total amount as in line with<br />

gaming tax figures. The taxes come<br />

from Pokies, TAB and KENO of which<br />

our industry is the largest contributor.<br />

More good news is that for Round<br />

One in February 2022 the upper limit<br />

of funds will increase from $35,000<br />

to a maximum of $100,000, this is<br />

a very substantial funding increase<br />

for this one-off round. I would like to<br />

encourage all Publicans to approach<br />

different not-for-profit organisations<br />

in their communities to make<br />

applications for this particular round.<br />

The funds can be used to undertake<br />

significant improvements to their<br />

organisations property and in a wide<br />

range of other capacities. If you need<br />

any more information about the fund<br />

and how to apply please make initial<br />

contact with the <strong>QHA</strong> membership<br />

Services Officer.<br />

Some of the types of organisations<br />

that the Fund has assisted over the<br />

many years are, Men’s Sheds, local<br />

sports club teams, Show Societies,<br />

Women’s shelters, Country Women’s<br />

Association and Lions Clubs etc.<br />

We tend to look favourably towards<br />

communities in remote locations<br />

as well as the disadvantaged. We<br />

also prioritise areas that have been<br />

disadvantaged by disasters including,<br />

floods, fires, droughts etc.<br />

I have represented the Queensland<br />

Hotel Association on this fund for the<br />

last 7 years and I have found it to be<br />

very satisfying knowing that we can<br />

make such a difference to a lot of<br />

struggling community groups which<br />

in remote locations tend to be the<br />

backbone of the community and which<br />

a lot of people rely on. So I say to all<br />

Hoteliers put this out in your community<br />

so that the benefits are shared among<br />

those in need. As well as helping out<br />

you could expect support from those<br />

whom you help. The people who<br />

run the fund through OLGR are very<br />

helpful in submitting an application for<br />

consideration. It is part of the money<br />

that we have contributed to the fund<br />

via Gaming tax, so the benefit in<br />

your area could be very well received<br />

and your help appreciated by these<br />

organisations.<br />

Keep your taps flowing and hopefully<br />

the disaster that we are experiencing<br />

will be over soon.<br />

LOVE OF CRICKET BRINGS INDUSTRY STALWARTS TOGETHER<br />

Golf days, barefoot bowling, fishing trips, functions. The<br />

options for socialising are endless, however finding an<br />

event that enables groups bigger than four people to<br />

interact at one time can be difficult.<br />

For Geoff Crossman and the team at Campari, the<br />

solution to that particular problem came in the form of<br />

the annual Campari Cup – a cricket match with a rotating<br />

roster of Queensland publicans and <strong>QHA</strong>’s very own<br />

Bernie Hogan, who take to the pitch to bat, bowl, and<br />

share industry news and ideas.<br />

This year’s cup took place on July 28 at Souths<br />

headquarters in Fairfield in honour of Lorraine Ford, the<br />

wife of long time Queensland hospitality stalwart Andrew<br />

Ford, who, sadly, lost her battle with brain cancer recently.<br />

Geoff said he had originally started the event when he<br />

was working at Carlton United Breweries may years<br />

ago. It had been a hit, but it dropped off when he moved<br />

across to a new role at Campari.<br />

The former players had chased him to resurrect the fun,<br />

Campari were willing, CUB said no worries, and so it<br />

made a comeback with a new sponsor behind it.<br />

“Basically, what it is, is a thought to bring together<br />

some key strategic stakeholders of our industry here in<br />

Queensland in a way that hasn’t really been done before<br />

that connects everyone at the one time - not like a golf<br />

day where you’re in groups of four – or at a corporate box<br />

where there’s 10 of you,” Geoff said.<br />

“There’s the serious, competitive side of people, we then<br />

have a presentation at one of the venues – a few cold<br />

drinks and some food and network around the issues at<br />

the same time.”<br />

“It’s a 35-over match – Souths provide us with an umpire<br />

and the scorers – it’s all legitimate. Everyone’s got to bowl<br />

a minimum of two overs – you retire at 30 and can come<br />

back in later if you’re needed.<br />

“I do up One Day strip uniforms and Deery (Richard<br />

Deery) does a barbecue for us at lunch time because<br />

we’re near the Story Bridge (Hotel).<br />

“The Southern Stars play the Northern Kings – basically<br />

divided by the river.<br />

“It’s an 11-a-side – but over the years there’s normally<br />

about 30 – you can never quite get the time right – we’ve<br />

always managed to have that nucleus – they always get<br />

the first crack at it.<br />

“While the capability of a few of them might not be to a<br />

standard – it’s the one thing in the year that they all make<br />

time for. They’re as passionate about it the next year<br />

that it goes around. It’s almost like they are the ones that<br />

remind me when’s it on.<br />

“We’ve been doing it now at Campari since 2012 – but I<br />

actually started it off about five years prior to that when I<br />

was at CUB.”<br />

Geoff said the while the Southern Stars (captained by<br />

Richard Deery) had traditionally been the dominant side,<br />

there was a rumour the Northern Kings (captained by<br />

Nick Gregorski) had put in some last-minute practice this<br />

year and come closer to a win.<br />

He said it wouldn’t be a proper grudge match without a<br />

prize or trophy to play for – in this case it’s a <strong>21</strong>-year-old<br />

bottle of Appleton Rum.<br />

Geoff said Campari had recently joined the <strong>QHA</strong> and<br />

is looking foward to working with the <strong>QHA</strong> and their<br />

members for years to come.<br />

Campari is now in its 11th year as a standalone business<br />

unit in Australia.<br />

Campari Managing Director Simon Durrant said the<br />

acquisition of Wild Turkey in 2010 had coincided with the<br />

arrival of Campari Australia.<br />

“In Australia, Campari is currently recognised and<br />

respected as a leading provider or spirits products,<br />

bring continual innovation in terms of execution and<br />

experiences to the on-premise.<br />

“The company prides itself on helping to cement a<br />

cocktail culture into the Australian vernacular and<br />

showcasing everything on-premise has to offer. Negroni,<br />

Old Fashioned, and of course Aperol Spritz, are now<br />

established favourites.<br />

“In 20<strong>21</strong>, Campari Australia will be increasing its efforts to<br />

capture new occasions, having already kicked off the year<br />

with the launch of Aperol Ready to Serve.<br />

“Customers can also expect new offerings aimed at new<br />

and lapsed bourbon drinkers, helping them to re-discover<br />

bourbon.”<br />

RACE DAY 20<strong>21</strong><br />

More than 170 hoteliers and partners joined together in<br />

Rockhampton for the annual <strong>QHA</strong> & Tabcorp Race Day on<br />

Tuesday 31st August. This is the first time the event has<br />

been moved out of the South East corner and it was a great<br />

success at bringing many regional hoteliers to the event.<br />

Guests were greeted by fresh oysters and prawns with<br />

thanks to PFD Food Services, and beverages were enjoyed<br />

with thanks to our Beverage Partners – Lion, CUB, Diageo,<br />

Coca-Cola Amatil, Treasury Wine Estates, Brown-Forman,<br />

Accolade, Pernod-Ricard, Yalumba and Sirromet.<br />

Kicking off with the Tabcorp Forum, the team from The<br />

Strand Hotel Yeppoon won 3-months free Sky channel<br />

for their venue, whilst Jimmy Lucas from the Central Hotel<br />

Burpengary took out the Streakers Competition. Nick<br />

Preston from PFD Food Services showcased his excellent<br />

tipping abilities to take home the crown with the Racing<br />

Royalty prize.<br />

After the event, everyone was treated<br />

to a delicious dinner feast, very<br />

generously provided by Rob Carr<br />

and the team from the Red Lion<br />

Hotel.<br />

A TOUCH OF LATIN AMERICA<br />

IN DOWNTOWN BRISBANE<br />

As this edition of <strong>QHA</strong> Review hits your desk, the team<br />

at Fortitude Valley’s newest club should be celebrating at<br />

least a week of trading in their long-awaited venue.<br />

Opening night of Hallmark Group’s Latin-American-style<br />

social club, Hey Chica!, was scheduled for September 17<br />

with the promise of being an exciting new addition to the<br />

hustle and bustle that is Brunswick Street in the Valley.<br />

Hallmark Group Director Scott Hempel said the venue is<br />

aiming to create a new experience for its visitors.<br />

“Hey Chica! is all about the passion and atmosphere of a<br />

Latin American street party – a destination where guests<br />

can embrace the diverse and colourful energy found in<br />

the back streets of Havana,” Mr Hempel said.<br />

“Characterised by a kaleidoscope of colour, unique décor<br />

<strong>QHA</strong>’s Employment Relations<br />

Conference was held on 9<br />

September 20<strong>21</strong> at LOFT in West<br />

End, Brisbane.<br />

With the 2020 conference<br />

cancelled due to COVID-19, the<br />

<strong>QHA</strong> was very glad the conference was able to go ahead after being forced<br />

to re-schedule from the original date of 5 August.<br />

This year we were joined by several attendees from other AHA branches;<br />

AHA ACT and Hospitality NT. Due to border restrictions, it was an<br />

opportunity to test our Zoom capabilities. Utilising this conferencing<br />

technology we have been able to contact with more members than ever<br />

before. It has been an excellent learning tool that we have added in our<br />

Training Department and now Employment Relations too.<br />

Jackson Inglis from Sparke Helmore Lawyers spoke about current issues<br />

and legal considerations in relation to mandatory vaccination.<br />

Cletus Brown, Director of the Compliance Branch of the Fair Work<br />

Ombudsman was interviewed by the <strong>QHA</strong>’s Wesley Davey about<br />

compliance in the hospitality industry and what employers should expect if<br />

contacted by the Fair Work Ombudsman.<br />

Yvette Mclaughlin (also from Sparke Helmore Lawyers) spoke about<br />

responding to Psychological Injury Workers’ Compensation claims.<br />

Dr Angus Forbes from Phoenix Occupational Medicine provided some<br />

helpful advice about looking after employee’s and dealing with the physical<br />

and mental health impacts of COVID-19.<br />

Intrust Super’s Georgia Gowen spoke about wellness and tips for how<br />

superannuation can contribute to wellness and financial security.<br />

The <strong>QHA</strong>’s Joanna Minchinton and Andrew Stirling from Tanda discussed<br />

casual conversion obligations and assessing what is a regular pattern of<br />

work.<br />

The <strong>QHA</strong>’s Lyndsay Balch and Tana Thorpe got attendees thinking and<br />

talking during their interactive session on the practical aspects of managing<br />

employee underperformance and misconduct.<br />

Commissioner Paula Spencer of the Fair Work Commission enlightened<br />

attendees with some advice on appearing before the Fair Work<br />

Commission. Commissioner Spencer also provided attendees with a<br />

detailed summary of interesting decisions relevant to the industry.<br />

To cap off a great program Wesley Davey facilitated a panel discussion with<br />

industry representatives that discussed challenges arising from COVID-19.<br />

When it comes to drinking wine it’s ultimately what’s in<br />

the bottle that really counts – but there’s no denying the<br />

packaging on the outside plays its part when to comes to<br />

finding new buyers.<br />

In South Australia this month the art of the wine label is<br />

being celebrated in style with an exhibition, Message on<br />

a Bottle, being held at The Hawke Centre’s Kerry Packer<br />

Civic Gallery.<br />

The exhibition has been pulled together by a team from<br />

the University of South Australia’s design school to<br />

showcase 70 years of wine labels.<br />

Exhibition co-convenor David Blaiklock, who is also<br />

the program director of UniSA’s Bachelor of Illustration<br />

and Animation, said Message on a Bottle highlights the<br />

important roles and contributions of wine label design in<br />

building South Australia’s wine industry and its brands,<br />

including the associated economies such as tourism and<br />

manufacturing.<br />

“The design of memorable and successful wine labels<br />

has seen South Australian designers and design studios<br />

gain international prominence and recognition over the<br />

past 70 years,” David said.<br />

“Wine label design now has a significant influence on<br />

purchasing decisions and a big impact on the economic,<br />

social, and cultural capital of South Australia.<br />

“OF COURSE, WINE LABELS SIGNAL WINE STYLES,<br />

REGIONS, QUALITY, AND BRANDS, BUT BEYOND<br />

THESE ESSENTIALS, WINE LABEL DESIGNS HAVE THE<br />

Playing host to many visitors in its time, this Royal hotel has received celebrity<br />

guests as well as presidential guests since it was built and opened in 1969 as the<br />

Park Royal Hotel. At the time and particularly through the 1970s, Brisbane’s music<br />

scene was abuzz with visiting international musicians who performed at the famed<br />

music venue, Festival Hall. From Queen, the Bee Gees, Bob Marley and Barry<br />

White to The Police, Bob Dylan, Johnny Cash and Led Zeppelin, Festival Hall was<br />

the place to perform, and it was located just three blocks from Park Royal which<br />

was the accommodation of choice among performers.<br />

“The hotel was built in 1969, it was the Park Royal then, and it was built because<br />

there was a lack of good international hotels at the time,” Royal on the Park,<br />

Director of Sales and Marketing, Tanya Stearn said.

“The hotel has certainly gone through some changes,<br />

originally when it was built and the location was<br />

decided, it was because of its location or its proximity<br />

to the Festival Hall, so a lot of celebrities have stayed<br />

at the hotel in the past and it was the hotel of choice.<br />

“In November 2000 its name changed to Royal on the<br />

Park, and it’s now an independent hotel synonymous<br />

with overlooking the City Botanic Gardens. That<br />

makes the hotel 52 years old, and during that time, it<br />

survived two floods and a fire.”<br />

Flood and fire aren’t the only moments of history<br />

that can be attributed to the hotel. The hotel’s onebedroom<br />

Junior suite was purpose built in the lead<br />

up to the 2014 G20 Summit, (held in Brisbane) for<br />

Brazil’s first female president, Dilma Rousseff who was<br />

later impeached and removed from office. The hotel<br />

also hosted South Korea’s first female president Park<br />

Geun-hye who was also later impeached and removed<br />

in 2017.<br />

Since its most recent renovation in 2014, the 153-<br />

room hotel now offers nine suites including four deluxe<br />

suites with spa baths, three executive suites on the top<br />

level which are all one-bedroom suites.<br />

“We have a really good selection of room types, from<br />

deluxe rooms with a city or park view, premium rooms<br />

on the higher floors with city or park views, and our<br />

collection of suites,” Tanya added.<br />

Positioned opposite the City Botanic Gardens, Royal<br />

on the Park is often home to romance and adulation as<br />

it offers a prime inner-city wedding destination, where<br />

newlyweds can take advantage of the gardens and<br />

river setting across the road, and quality hospitality at<br />

the Royal.<br />

It is also a popular destination for high school formals<br />

thanks to its grand entry which presents an instagramworthy<br />

photo opportunity for the young ones.<br />

“We’ve become quite a diverse business here,<br />

school formals are popular mainly because we have<br />

a beautiful sense of arrival for the students with that<br />

porte cochere and the flags out the front. We do have<br />

weddings at the hotel and the beauty of having a<br />

wedding here is that you can have your ceremony over<br />

at the Botanic Gardens and reception here,” Tanya<br />

explained.<br />

“We also host a lot of dinners and events, and some<br />

of those events that we work with each year are<br />

the Queensland’s Young Achievers Awards and the<br />

Queensland Community Achievers Awards.”<br />

Being an inner-city hotel with a significant amount<br />

of competition nearby, Royal on the Park ensures<br />

it maintains a strong focus on a superior level of<br />

customer service.

“It is a big challenge, more inventory obviously means<br />

more competition. We do have loyal guests who come<br />

back to us time and time again because they like the<br />

feel and the service offered by our hotel.<br />

“It’s unusual that somebody would like both styles,<br />

someone who might like ultra modern may not choose<br />

us and that’s ok, and vice versa, someone who may<br />

choose us, may not want ultra-modern, so we still<br />

have our loyal base of guests, our wonderful royal<br />

rewards members and they get very well looked after,”<br />

Tanya explained.<br />

“We’re a small team and an independent hotel so we<br />

can’t leverage off a corporate office or other sister<br />

hotels, and while we’re a small team we don’t roster a<br />

lean staff,” Tanya said.<br />

“We have a warm, welcoming feeling as soon as<br />

you walk into the hotel and our whole team’s focus<br />

is service and to make sure that our guests feel like<br />

they’re at home.<br />

“We ensure that we have staff on to look after<br />

breakfast and dinner services in the restaurant and we<br />

also have porters on to assist with the front office with<br />

check ins and checkouts. We’re very mindful of that,<br />

and we don’t skimp and save on guests.”<br />

The hotel’s restaurant, The Walnut Restaurant and<br />

Lounge Bar, serves up delectable dishes such as<br />

Lobster and Chive Risotto and Confit de Canard<br />

(duck) on its main menu and serves monthly specials<br />

while keeping a focus on sourcing local produce and<br />

beverages as much as possible.<br />

“Our Walnut Restaurant and Lounge is quite well<br />

known. Back in the day it was very well known for<br />

those long lunches and at one time there was a lot of<br />

media who used to come in for them.

“It is open for breakfast, lunch and dinner, we can host<br />

small groups and we do offer high tea there as well.<br />

“We’re very supportive of sourcing local produce<br />

and we do that with our bar as well with our wine,<br />

and some of our spirits. We try to work with locals<br />

sourcing produce within 100km, we’re also very<br />

mindful of our food waste in that it’s not being sent to<br />

general waste and we use Scouts Recycling for our<br />

recyclable waste,” Tanya said.<br />

Although Royal on the Park cannot claim to have<br />

hosted a member of the British Royal monarchy,<br />

hosting rock royalty is just as outstanding, if not better.<br />

When the time came for JDA Hotels to upgrade<br />

its venue at Mermaid Beach it turned to Rohrig<br />

Construction and architect Paul Kelly Design to<br />

help develop a refurbishment that would bring<br />

value for years to come. The result is a stunning<br />

new look tavern that has proven to be a hit with<br />

locals and visitors alike, providing a new hub for<br />

hospitality on the Gold Coast.<br />

Collaboration for style and value<br />

John Feros, owner of JDA Hotels, said the vision for the<br />

Mermaid Beach Tavern would be 100% inclusive and<br />

offer something for everyone.<br />

He said the venue needed the right casual sophistication<br />

to make it equally attractive for locals to come as a<br />

family, on a first date, for a ladies’ long lunch or for the<br />

boys to come in for a punt.<br />

“We wanted a pub that would pride itself in doing the<br />

simple things right: great pub food, extensive beverage<br />

offering, good entertainment and fantastic customer<br />

service,” Mr Feros said.<br />

Architect Paul Kelly, of Paul Kelly Design, was tasked<br />

with meeting the brief.<br />

“The fundamental idea was to bring new life to the past,<br />

with our concept being a reinterpretation of a jewellery<br />

box (it’s what’s inside that’s the most desirable),” Mr Kelly<br />

said.<br />

Rohrig Construction, working on a design and construct<br />

basis, collaborated with the client and architect to help<br />

evolve the design and ensure value in the build and for<br />

future operations.<br />

Rohrig Construction Manager Matt Tucker said JDA<br />

Hotels engaged Rohrig early to help with initial cost<br />

planning.<br />

He said while the project was being DA approved,<br />

Rohrig was able to work alongside the client and Paul<br />

Kelly to explore multiple design options.<br />

A fresh and practical design<br />

“We had a lot of experience with other JDA Hotels<br />

projects which, combined with close collaboration with<br />

all involved, meant we could find the best approaches<br />

to achieve lasting value and to realise the client’s and<br />

architect’s vision,” Mr Tucker said.<br />

The redevelopment of the tavern included a new sports<br />

bar, gaming room, kitchen, lounge, bistro, public bar,<br />

courtyard areas and beer garden. The new kids’ room

makes sure it’s still a loved place for families with<br />

youngsters too.<br />

Mr Kelly said the new building elements were designed<br />

to ensure there was a strong connection with the<br />

outside environment, with natural sunlight and natural air<br />

flow. The extensive height, natural light, monolithic brick<br />

finish and abundant planting create a unique space.<br />

The design also included the introduction of a large,<br />

centralised bar and an enlarged kitchen.<br />

Rohrig’s specialist food and beverage design team<br />

developed the bar and kitchen areas to bring the design<br />

ideas to life effectively and to ensure everything would<br />

function with optimum efficiency for staff and patrons.<br />

Looking to the future<br />

The revitalised Mermaid Beach Tavern with its distinctive<br />

aluminium-battened exterior and Queensland indooroutdoor<br />

feel is now set to embrace many more decades<br />

at the heart of Gold Coast life.<br />

Owner John Feros is delighted with the results and<br />

said it perfectly encapsulates their business motto ‘the<br />

premium pub experience’.<br />

“We feel the project has been a successful union of<br />

great design and expert construction,” Mr Feros said.<br />

“We could not be happier with the end product and look<br />

forward to sharing it with the thriving Mermaid Beach<br />

community.”

ARE YOU READY FOR THE NEW ‘STAPLING‘ RULES?<br />

Last month I talked about Intrust Super’s merger with<br />

Hostplus on 26 November 20<strong>21</strong>. The transition is<br />

continuing, and we will be rolling out information kits<br />

and sessions to <strong>QHA</strong> members all the way up to the<br />

merger date.<br />

No matter which super fund you choose as a default,<br />

there are some upcoming rule changes that you and<br />

your human resources team will have to follow next<br />

month.<br />

The new ‘Your Future, Your Super’ rules will see<br />

super fund accounts ‘stapled’ to individuals from 1<br />

November. The intention is to avoid the creation of<br />

multiple accounts when people change jobs.<br />

Under the new rules, businesses will need to find the<br />

details of the current super fund of every new staff<br />

member and pay their contributions into the existing<br />

account.<br />

The Australian Taxation Office (ATO) will be creating<br />

a portal to assist businesses with finding their<br />

employees’ super accounts. Payroll officers will need<br />

to access this portal to set up a new employee with<br />

their super contributions. The ATO have stated that<br />

if businesses don’t meet their choice of super fund<br />

obligations, additional penalties may apply.<br />

Get ready<br />

To make sure you’re ready to request an employee’s<br />

stapled super fund details, check and update the<br />

access levels of your authorised representatives in<br />

ATO online services. This will also protect your staff’s<br />

personal information.<br />

How to find a new employee’s exiting super<br />

account<br />

To see if a new employee has an existing account you<br />

will need to:<br />

1. Log into the ATO online services portal.<br />

2. Enter your employee’s details, including their:<br />

• TFN<br />

• full name – including ‘other given name’ if<br />

known<br />

• date of birth<br />

• address (residential or postal), if TFN not given<br />

3. Receive the response on-screen in online<br />

services. The ATO will notify your employee of the<br />

stapled super fund request and the fund details<br />

they have provided.<br />

The ATO assistant commissioner Larissa Evans said<br />

checking the ATO portal for an employee’s old account<br />

would take “minutes” and that bulk requests will be<br />

available if you need to request stapled super fund<br />

details for over 100 new employees at once.<br />

I’d like to acknowledge and thank all of you for<br />

the tremendous effort you have put in to keep<br />

Queenslanders safe over recent months.<br />

We’ve seen licensed venues across the state step up<br />

to the plate time and time again to help protect our<br />

communities, as the COVID-19 health crisis continues<br />

to present unprecedented challenges for the industry.<br />

While lockdowns, checking in patrons and staff,<br />

wearing masks and other restrictions are key to<br />

stopping the spread of COVID-19 in our community,<br />

we know our hospitality operators have been doing<br />

it tough.<br />

That’s why we have bolstered our financial support for<br />

the hospitality industry through a range of grants and<br />

fee relief.<br />

This includes waiving or refunding liquor licensing fees<br />

for the 20<strong>21</strong>-2022 period for existing operators and<br />

injecting more than $<strong>21</strong> million back into Queensland’s<br />

licensed venues.<br />

We’re also continuing to waive application fees<br />

associated with changes to trading hours or licensed<br />

areas until 30 June 2022, so be sure to keep this in<br />

mind as we head into the summer months and<br />

in Queensland or interstate can also access cash<br />

payments through the 20<strong>21</strong> COVID-19 Business<br />

Support Grant program.<br />

We’ve joined forces with the Commonwealth<br />

Government to offer payments of between<br />

$10,000 and $30,000 depending on your business’s<br />

payroll size.<br />

Applications are currently open for these grants and<br />

all eligible businesses who apply will receive funding. If<br />

you haven’t already done so, I encourage you to check<br />

your eligibility and apply before 16 November 20<strong>21</strong>.<br />

We’ve also increased support for businesses directly<br />

affected by a positive COVID-19 case through the<br />

COVID-19 cleaning rebate which covers up to 80<br />

per cent of professional cleaning costs, capped at<br />

$10,000 per separate event, when a business is a<br />

confirmed exposure site.<br />

These fee waivers, grants and rebates are in addition<br />

to a range of the other support available to licensed<br />

venues across Queensland including mentoring<br />

programs, financial counselling and small business<br />

support packages.<br />

As we approach the end of another challenging year,<br />

some of you who own, manage and work at our pubs<br />

and hotels may be feeling the psychological effects<br />

of the pandemic. Now, more than ever, your mental<br />

health and wellbeing should be a priority.<br />

Mental Health Awareness Week (9 to 17 <strong>October</strong>) is a<br />

great opportunity to check in with your colleagues and<br />

staff, and I would like to remind you that along with<br />

our financial assistance, mental health support is also<br />

SPOTLIGHT ON RESPONSIBLE GAMBLING<br />

The world around us is changing rapidly with<br />

community expectations, industry innovation and<br />

development, and technological advances constantly<br />

altering the shape of Queensland’s liquor and gaming<br />

industry.<br />

To keep pace with these changes, the Office of Liquor<br />

and Gaming Regulation (OLGR) is taking a closer look<br />

at how it operates in this evolving landscape.<br />

Through a new regulatory strategy project, OLGR will<br />

establish how it will align its work to the evolving needs<br />

of the industry and the Queensland community across<br />

six key areas. These are:<br />

• delivering public value<br />

• discharging our statutory functions<br />

• being a trusted regulator<br />

• being contemporary<br />

• enhancing our risk-based approach<br />

• contributing to Queensland’s economic recovery.<br />

By the end of 20<strong>21</strong>, the project aims to produce a<br />

five-year regulatory strategy for OLGR, outlining best<br />

practice for a modern regulator in the liquor and<br />

gaming space.<br />

OLGR began the project with a review into how we<br />

operate today, including how we work with liquor and<br />

gaming licensees across the state.<br />

We also undertook extensive research into what it<br />

means to be a modern regulator both in Australia<br />

and overseas. This included environmental scans and<br />

reviewing academic research about modern regulators.<br />

Drawing on data and insights from this research,<br />

and recognising the significant impact our work can<br />

have on licensees, OLGR consulted more than 110<br />

different businesses across Queensland including<br />

hotels and pubs.<br />

We also received feedback from industry associations,<br />

community groups, consultants, law firms and other<br />

regulators across the state and nation, hoping to find<br />

out how you thought OLGR was currently operating<br />

in terms of modern regulatory practices and how you<br />

thought it can best work with industry moving forward.<br />

It was eye-opening to learn about the challenges<br />

you’re experiencing and the opportunities you see for<br />

a more collaborative and coordinated effort between<br />

OLGR and industry over the next five years.<br />

That feedback will be essential to providing a full<br />

picture of where OLGR is now, where it needs to be<br />

and how it should get there, as we shift our focus<br />

to drafting the regulatory strategy this <strong>October</strong>. We<br />

will again call on industry for feedback on the draft<br />

strategy before it is finalised.<br />

While the development of a regulatory strategy is just<br />

the first step of a much broader cultural change, it will<br />

put OLGR in a good position to support the industry to<br />

continue to deliver safe liquor and gaming experiences<br />

to Queenslanders now and into the future.<br />

Keep an eye out for more updates on this exciting<br />

project towards the end of the year.<br />

On the subject of creating safer environments, I’d<br />

like to highlight that <strong>October</strong> is Safe Work Month.<br />

It’s a great opportunity to commit to building and<br />

maintaining safe and healthy spaces for your staff,<br />

colleagues, and patrons.<br />

On top of your usual responsibilities to maintain<br />

physical and mental health and safety, hotels and pubs<br />

also play a key role in keeping Queenslanders COVID<br />

Safe.<br />

Importantly, you need to continue to follow the Chief<br />

Health Officer’s public health directions and stay up to<br />

date with requirements to make sure your venues and<br />

patrons are COVID Safe.<br />

Here’s a few things you can do day-to-day to help<br />

protect your staff and patrons from COVID-19:<br />

• use the Check in Qld app to collect contact details<br />

from staff and patrons, including patrons and<br />

delivery personnel collecting takeaway<br />

• encourage staff and patrons to observe physical<br />

distancing<br />

• use the up-to-date COVID Safe Checklist<br />

• regularly clean and disinfect your venues<br />

• ensure handwashing facilities or sanitisers are<br />

available for patrons and staff<br />

• notify patrons through prominent signage that they<br />

should not enter your venue if they’re showing any<br />

COVID-19 symptoms.<br />

NO MASK, NO ENTRY?<br />

With government health directions coming and going,<br />

many of our pub and hotel clients have asked us<br />

whether they can refuse entry to someone for not<br />

wearing a mask. The short answer is, it depends.<br />

Unfortunately, this is still a grey area with strong<br />

arguments for and against. In this article, we talk<br />

through where you can (and can’t) deny entry to nonmask<br />

wearing patrons.<br />

Masks protect an individual’s ‘right to life’<br />

Under the Human Rights Act 2019, public entities<br />

(such as Queensland Health) are obliged to take<br />

positive steps to protect rights, including the right to<br />

life.<br />

Mandating mask wearing is an example of complying<br />

with this obligation. Under the Public Health Act 2005,<br />

Queensland Health have the power to issue health<br />

directions that must be complied with by the public in<br />

affected local government areas.<br />

Under the current direction, patrons are required to<br />

wear a mask inside unless eating or drinking. And<br />

pubs are required to enforce this direction, or face<br />

hefty fines.<br />

However, you cannot enforce this on everyone…<br />

It is important to note that the direction to wear a mask<br />

does not apply to a person who has a physical or<br />

mental health illness or condition, or disability, which<br />

makes wearing a face mask unsuitable.<br />

There is no requirement under the public health<br />

directions for those claiming a medical exemption to<br />

provide proof such a condition exists (i.e. produce a<br />

medical certificate).<br />

Further, under the Disability Discrimination Act 1992,<br />

it is unlawful to discriminate against another person<br />

on the ground of the person’s disability. This includes<br />

refusing access to any premises that the public (or a<br />

section of the public) is entitled or allowed to enter or<br />

use (i.e. a pub).<br />

Therefore, declining a patron entry to your venue for<br />

not wearing a mask, may be considered unlawful<br />

discrimination, as their disability renders them exempt<br />

from the original direction to wear a mask.<br />

But wait, there is another ‘however’.<br />

However, under Anti-Discrimination legislation, a<br />

person may do an act (i.e. refuse someone entry to<br />

a venue for not wearing a mask) if it is ‘reasonably<br />

necessary’ to protect public health or protect the<br />

health and safety of people at a place of work.<br />

Arguably, it is reasonably necessary to require patrons<br />

to wear masks to protect staff and other patrons<br />

against the risk of COVID-19.<br />

It can also be argued that allowing anyone to claim<br />

a medical exemption without providing proof (which<br />

they are currently not required to do), will open the<br />

floodgates for other patrons to claim unsubstantiated<br />

medical exemptions, potentially endangering your<br />

patrons and staff.<br />

Other considerations<br />

Depending on the situation, it may be worth<br />

considering other laws that may provide you the right<br />

to refuse a patron from your venue. For example, the<br />

Liquor Act provides that a licensee has an obligation<br />

to provide a safe environment in and around their<br />

premises. It also does not limit the rights a licensee<br />

might have under another law to prevent entry to a<br />

premises – such as the right of a property owner or<br />

tenant to exclusive possession and quiet enjoyment of<br />

their premises.<br />

Conclusion<br />

This has certainly been a challenging time for the<br />

hospitality industry, and these grey areas can produce<br />

very difficult situations for staff, owners and managers.<br />

Your decision to refuse entry to a patron on the basis<br />

of them not wearing a mask will depend heavily on<br />

the circumstances at hand. Should you find yourself in<br />

“Our extension and refurbishment of the Calamvale<br />

hotel’s Gaming Lounge entrance, Garden Terrace<br />

Bar and lounge and TAB area was completed in 20<br />

weeks, which resulted in major upgrades to the hotel’s<br />

functionality and style,” Ashley Cooper Construction<br />

Managing Director, Luke Ashley-Cooper said.<br />

“One major feature of the build was an impressive<br />

structural steel element which formed the base of<br />

the new entry and extension. This created a visually<br />

striking feature during the day, and came alive at night<br />

transforming the entrance into a spectacular light<br />

feature.”<br />

Luke said he and his team worked closely with the<br />

project architect and key consultants to focus heavily<br />

on increasing street appeal for the hotel to ensure the<br />

architectural design elements came together to create<br />

an inviting space for patrons to enjoy.<br />

The McGuire Hotel Group-owned hotel had engaged<br />

Ashley Cooper Construction for the renovation and<br />

Matt McGuire said the project was handled in a<br />

seamless manner from start to finish.<br />

“Originally we put [the job] to tender, Ashley Cooper<br />

won the tender and it was smooth sailing from<br />

then on, they did a great job and it was a seamless<br />

process,” Matt said.<br />

When choosing a contractor he added that the time<br />

frame for the renovation was a contributing factor and<br />

Ashley Cooper delivered on its promise to complete<br />

the job in 20 weeks. During that timeframe the hotel<br />

was able to continue to operate with limited trading<br />

running both the restaurant and the gaming room.<br />

“What impressed me the most was all the staff, from<br />

Luke to the foreman Damian who did a great job, he<br />

was really polite, respectful, and they were happy to<br />

cater to our needs or anything that popped up along<br />

the way. It was absolutely fantastic, and the patrons<br />

love it.<br />

“The outdoor beer garden is full of greenery, is airy and<br />

open and no one else in the area has anything like it, ”<br />

Matt added.<br />

“Understanding the client’s needs is our priority, and<br />

understanding that each venue works differently is<br />

extremely important to the operations of our business,”<br />

Luke said.<br />

In an industry such as hospitality, it’s imperative that<br />

a business can continue to operate in some capacity<br />

during a renovation, and it’s in recognising this crucial<br />

element that has made Ashley Cooper Construction an<br />

attractive option to the hospitality sector.<br />

“It’s getting back to that understanding of the business<br />

you’re working in, to understand how they operate,<br />

and how we can work around their business to make<br />

sure that they can still function while we’re there,” Luke<br />

explained.<br />

“For example if we’re working on a project that<br />

requires a function room within a venue, we want to<br />

make sure nobody can hear or see what we’re doing<br />

inside.”<br />

Ensuring minimal disruptions throughout the project’s<br />

duration is always a priority, and having started the<br />

business in 2013, Luke and his team of experienced<br />

and tightly-knit professionals, work tirelessly to offer<br />

a high-quality craftsmanship for their clients, and pay<br />

attention to the finer details.<br />

“We’re not pretentious, there is no BS; we’re there to<br />

do a job and to do it properly, so to do that efficiently it<br />

all comes down to prior preparation and planning, and<br />

we have the staff to do that.<br />

“We have 25+ employees, we have project managers,<br />

contract administrator, site supervisors, carpenters and<br />

finance department.<br />

“We mainly work within the hospitality and education<br />

sectors. I was a carpenter and somehow I’d always<br />

end up working around the hospitality sector myself,”<br />

Luke explained.<br />

“I started my building company in 2013 and just<br />

learned the ropes until I landed my first significant<br />

building job in the industry which was in 2017, and<br />

The Department of Tourism, Innovation and Sport<br />

unveiled the latest package to support our industry<br />

– the Tourism and Hospitality Sector COVID-19<br />

Lockdown Support Package.<br />

This package is the culmination of a range of industry<br />

briefings and advocacy by the <strong>QHA</strong> and other<br />

parties. It provides a range of fee and payroll tax relief<br />

measures together with immediate support for tourism<br />

and hospitality businesses impacted by the recent<br />

lockdowns in South East Queensland and in other<br />

states. The $47.75 million package includes:<br />

Payroll tax deferral: eligible tourism and hospitality<br />

businesses that lodge payroll tax returns monthly can<br />

apply to defer paying their payroll tax liability due in<br />

August 20<strong>21</strong> for 6 months. If they have already paid<br />

the liability due in August, they can apply to defer their<br />

next month’s payroll tax liability.<br />

12-month state land rent deferral: rent deferral is<br />

available for eligible tourism operators on state land for<br />

the period 1 July 20<strong>21</strong> to 30 June 2022.<br />

Fee waiver/refunds for commercial tourism daily<br />

passenger fees: tourism businesses that operate in<br />

a national park, conservation park, recreation area or<br />

state forest, including whale watching operations, may<br />

have fees waived or refunded between 1 July 20<strong>21</strong><br />

and 30 June 2022.<br />

Liquor licensing fees waived for 20<strong>21</strong>–22: tourism<br />

and hospitality businesses can have their licensing fees<br />

for 20<strong>21</strong>–22 waived or refunded if they were licensed<br />

under the Liquor Act or Wine Industry Acts as at 30<br />

June 20<strong>21</strong>.<br />

20<strong>21</strong> COVID-19 Business Support Grants<br />

expanded: large tourism and hospitality businesses<br />

statewide are now included in the 20<strong>21</strong> COVID-19<br />

Business Support Grants of up to $30,000.<br />

Cleaning rebate for small, medium and not-forprofit<br />

businesses: will be able to apply for a rebate<br />

of up to 80% of the cost of professional cleaning (up<br />

to $10,000 ex GST) if your business is a confirmed<br />

COVID-19 exposure site.<br />

Counselling: Businesses can also contact one of the<br />

Queensland Government-funded Tourism Business<br />

Financial Counsellors or COVID-19 Small Business<br />

Counsellors who can assist with identifying potential<br />

sources of funding and business support.<br />

New support to bring Business Events to<br />

Queensland: Applications are open for a second<br />

round of the National Business Events Program. The<br />

program will target national associations and corporate<br />

events bringing more than 350 delegates with the<br />

criteria being 50 per cent of whom must come from<br />

outside the Local Government Area where the event is<br />

being hosted, and stay a minimum of two days. Funds<br />

must be spent in Queensland.<br />

In other news, Penny Lion has stepped down from<br />

her role at Tourism Australia, where she has led the<br />

organisation’s business events division for almost 11<br />

years. She leaves behind her the legacy of starting the<br />

Bid Fund Program and There’s nothing like Australia<br />

for business events’ campaign. Tourism Australia aims<br />

to continue her vision of integrating business events<br />

more across the whole organisation.<br />

Tourism Australia has added new and updated<br />

resources to its corporate site. The assets include a<br />

new Working with Media guide, updated information<br />

for the tourism industry on COVID Safe industry<br />

resources, information on Australian Government relief<br />

assistance, support and resources, disaster recovery<br />

information and Federal Government support for<br />

tourism businesses.<br />

New Zealand has outlined a three-pronged plan to<br />

reopen to the world. Key elements include vaccinating<br />

as many New Zealanders as possible, with all eligible<br />

ages able to book an appointment by 1 September<br />

and a six-week gap between doses. A self-isolation<br />

pilot program will be tested this year in conjunction<br />

with the set-up of new testing and vaccine verification<br />

systems at border entry points.<br />

Construction will soon begin on the Queensland<br />

quarantine hub, which will be located at the Damascus<br />

Barracks in Pinkenba, metres from Brisbane Airport<br />

and will offer a purpose-built solution to quarantine<br />

for returning travellers. Queensland Premier Anastacia<br />

Palaszczuk has signed an MOU allowing the Australian<br />

Government to proceed with construction of the<br />

Commonwealth facility.<br />

The Queensland Government is also pushing ahead<br />

with its own regional dedicated COVID-19 quarantine<br />

facility on vacant land owned by Wagner Corporation,<br />

just outside Toowoomba. They have signed a oneyear<br />

lease with the option of extending for 2-3 years.<br />

Construction has commenced with 500 beds to be<br />

available by the end of the year and a total capacity<br />

of 1000 by March next year. The design is being<br />

modelled on the Howard Springs quarantine facility in<br />

the Northern Territory.

So it was that fresh from celebrating the 70th birthday<br />

of Margaret, the couple loaded up their trusty Isuzu<br />

and fold out camper trailer and hit the road north,<br />

kicking off in style with a couple of days at the Spicers<br />

Retreat at Pokolbin in the Hunter Valley.<br />

Country kids at heart, having grown up together in<br />

the regional New South Wales town of Wellington<br />

more than a few moons ago, they set a path to Coffs<br />

Harbour to catch up with family, then pointed the truck<br />

inland to see what Central Queensland had to offer an<br />

active grey nomad.<br />

Aside from the tourist sites and national parks, as an<br />

upside of having a son who writes for <strong>QHA</strong> Review,<br />

they were also tasked with grabbing as many photos<br />

of local pubs as they could along the way so we could<br />

share them with you, our readers. I reckon someone<br />

owes me a beer for that excuse!<br />

And so it was that our intrepid duo crossed the border<br />

into Queensland on May 23 (20<strong>21</strong>) and stayed north<br />

of the dreaded line of COVID demarcation until the<br />

first week of September. All in all, a 100 day road trip<br />

across our great State.<br />

An overnight stop at Cranky Rock near Warialda on<br />

the NSW side of the border was all it took before<br />

crossing the border and heading north- west for the<br />

sites of Charleville, Cunnamulla, Charlotte Plains<br />

and St George on the way to a week-long stay at<br />

Takarakka to walk the Carnarvon Gorge with friends.<br />

With daytime temperatures hitting 24 but the nights<br />

still cool Richard said the trip was pretty comfortable,<br />

although he did wonder if any Queensland politicians<br />

had driven the Leichhardt Highway in recent times –<br />

“it’s downright dangerous!”.<br />

Highlights here included the Red Lizard Camping<br />

Ground, six kilometres from the centre of Charleville,<br />

and the town itself, with Hotel Corones coming in for a<br />

special mention.<br />

At Cunnamulla the Anzac Memorial was worth a look,<br />

while clear skies meant watching the lunar eclipse was<br />

as simple as putting your head outside of the tent.<br />

The Cunnamulla pubs were great and the old<br />

telephone exchange made for an interesting drop in.<br />

Charlotte Plains Station was the place to be when<br />

it came to camping, with its outdoor baths (wearing<br />

swimsuits) generating plenty of laughs.

YOUR BUSINESS AND MINIMISE CLAIM RISK<br />

Procedural fairness means acting fairly in the process of<br />

making a decision. It is critical that employers act fairly<br />

during processes that may lead to a decision regarding<br />

an employee’s employment. This includes processes<br />

such as:<br />

• Managing performance or taking disciplinary action<br />

(e.g. issuing a warning);<br />

• Conducting investigations;<br />

• Determining an employee’s physical or psychological<br />

capacity to perform the inherent requirement of their<br />

role; and<br />

• Terminating employment.<br />

Following a process that is procedurally fair provides<br />

employers with the best possible opportunity to defend<br />

the process they followed and the decision they made.<br />

This is particularly important if an employee lodges a<br />

claim with an external tribunal or court such as Unfair<br />

Dismissal, General Protections or Discrimination claims.<br />

This article explains the importance of procedural<br />

fairness in defending these external claims, and provides<br />

general procedural fairness guidelines for employers to<br />

follow.<br />

Importance in defending Unfair Dismissal claims<br />

If an employee lodges an Unfair Dismissal claim with<br />

the Fair Work Commission (‘FWC’), the FWC will<br />

consider whether the termination was harsh, unjust and<br />

unreasonable. Section 387 of the Fair Work Act 2009<br />

(“FW Act”) outlines the criteria for the FWC to consider<br />

when determining whether the termination was harsh,<br />

unjust and unreasonable. The criteria lists that the<br />

employer must have a valid reason for the dismissal<br />

linked to capacity or conduct. The criteria also lists<br />

procedural requirements that the FWC must consider in<br />

determining whether the dismissal was harsh, unjust or<br />

unreasonable such as:<br />

• Whether the employer unreasonably refused to allow<br />

the employee to have a support person present at<br />

any discussion relating to the termination;<br />

• If the termination is for unsatisfactory performance,<br />

whether the employee was warned about the<br />

unsatisfactory performance before the termination;<br />

and<br />

• Whether the employee was given an opportunity<br />

to respond to the employer’s concerns before a<br />

decision to terminate was made.<br />

(This is not an exhaustive list of the criteria).<br />

Following these procedural considerations, and making<br />

the decision to terminate as a result of a fair process,<br />

reduces the risk of the FWC finding that the termination<br />

was unfair. Where a termination is found to be unfair, the<br />

FWC may order that the employer pay compensation to<br />

the now former employee or reinstate employment.<br />

Please note that an employee is not eligible to make an<br />

Unfair Dismissal claim with the FWC if their employment<br />

ends during their Minimum Employment Period (“MEP”).<br />

Section 383 of the FW Act defines the MEP as six<br />

months of employment, or 12 months for small business<br />

employers (a business with fewer than 15 employees).<br />

Importance in defending General Protections and<br />

Discrimination claims<br />

Claims such as General Protections or Discrimination<br />

are still possible for employees unable to make an<br />

Unfair Dismissal claim. Employees may lodge General<br />

Protection or Discrimination claims in regards to any<br />

adverse action taken by their employer (e.g. warnings or<br />

other decisions regarding employment), and not just for<br />

termination of employment like Unfair Dismissal claims.<br />

Unlike an Unfair Dismissal claim, procedural fairness<br />

may not determine whether a General Protection or<br />

Discrimination claim is successful. Procedural fairness<br />

can however assist an employer in demonstrating that<br />

the reason for the actions taken by the employer (e.g.<br />

terminating employment due to performance, conduct,<br />

capacity, or operational reasons) was the actual reason,<br />

and not for an unlawful or discriminatory reason. Where<br />

an employer is found to have terminated or taken<br />

adverse action against an employee for an unlawful or<br />

discriminatory reason, the employer may be ordered to<br />

pay compensation to the employee.<br />

website. Members are encouraged to obtain a copy<br />

to understand the different external claims that an<br />

General Procedural Fairness Guidelines<br />

The <strong>QHA</strong>’s Employment Relations (‘ER’) team has<br />

developed a new Fact Sheet on the topic of procedural<br />

fairness which is available on request. The Fact Sheet<br />

provides specific guidelines on providing procedural<br />

fairness in each of the following processes:<br />

• Performance management and/or disciplinary action;<br />

• Conducting investigations;<br />

• Determining an employee’s capacity; and<br />

• Termination of employment.<br />

Outlined below are recommended general guidelines for<br />

employers to follow during any process that may lead to<br />

a decision regarding employment:<br />

1. Deal with matters promptly and efficiently;<br />

2. Ensure that the process and steps taken align with<br />

internal policies and procedures (e.g. Performance<br />

Management policy, Discipline and Termination policy<br />

or Grievance policy);<br />

3. Provide notice of any meeting you want to hold with<br />

the employee, preferably 24 hours in advance, and in<br />

writing wherever possible. The notice should inform<br />

the employee of the following:<br />

a. The purpose of the meeting and what will be<br />

discussed;<br />

b. The time and location of the meeting;<br />

c. Whom from the employer will be present; and<br />

d. That the employee may bring a support person<br />

to the meeting.<br />

Note: an employee’s request to have a support<br />

person cannot be unreasonably refused for<br />

a meeting that may result in termination of<br />

employment;<br />

4. Meet with the employee and clearly present all<br />

relevant matters or facts being relied upon or<br />

considered to the employee. Depending on the<br />

matter, this may include previous warnings, and<br />

evidence such as CCTV footage, statements,<br />

medical evidence, policies, or other relevant<br />

information;<br />

5. Provide the employee with the opportunity to<br />

respond either verbally and/or in writing to the<br />

matters that are raised in the meeting;<br />

6. Take a reasonable amount of time to consider<br />

the employee’s responses before deciding on an<br />

outcome. For complex matters that may result in<br />

termination, it may be suitable to take a longer break<br />

to consider the employee’s responses, and inform<br />

the employee of the decision in a separate meeting;<br />

7. Ensure matters are dealt with thoroughly before<br />

deciding the outcome. For example, after meeting<br />

with an employee, the employer may need to gather<br />

further information or evidence before deciding the<br />

outcome;<br />

8. Ensure that matters are dealt with professionally and<br />

confidentially. All parties involved should be informed<br />

of the requirement to maintain confidentiality, and<br />

their commitment to that requirement obtained and<br />

recorded.<br />

NOTE: While an employee needs to be informed<br />

of any decision regarding their employment, an<br />

employee is not entitled to be informed of a decision<br />

regarding another employee.<br />

9. Ensure that matters are dealt with without bias or<br />

a pre-determined outcome. In situation where the<br />

decision maker may have potential bias, you may<br />

need to seek external assistance to carry out a fair<br />

process; and<br />

10. Record and document each step and ensure<br />

that meetings are recorded or documented in an<br />

appropriate manner.<br />

to follow, however each situation turns on the<br />

circumstances of the case. Employers are encouraged<br />

to read the <strong>QHA</strong>’s new Fact Sheet on procedural fairness<br />

which provides additional specific guidelines to assist<br />

Particularly in tough economic times when businesses<br />

and families are impacted by ‘lockdowns’, trading<br />

restrictions and closed borders, there are increased<br />

pressures on our hospitality sector and our staff who<br />

are indeed frontline workers.<br />

Mental health<br />

Psychological health and safety is about protecting<br />

the psychological health of workers, in the same way<br />

that we protect their physical health. An awareness<br />

of our own mental health including in the workplace<br />

environment is extremely important when you<br />

consider that:<br />

• One third of adult life is spent at work.<br />

• Work-related stress is estimated to affect around<br />

32% of all Australians.<br />

• 1 in 5 Aussies experience a mental health condition<br />

in any year.<br />

• 1 in 2 of us will experience a mental health<br />

condition in our lifetime.<br />

• But 5 in 5 workers should be protected from<br />

injury or illness and supported by their workplace.<br />

During your career, it is highly likely you will work<br />

alongside, or manage someone with a mental<br />

health condition. Whether you know it or not.<br />

• Mental disorder claims cost more and last longer<br />

than physical claims.<br />

• Across the country, $543 million is paid in<br />

workers’ compensation every year for mental<br />

health conditions.<br />

• And in workplaces that are perceived to be<br />

mentally unhealthy, workers are 3 times more<br />

likely to take time off.<br />

• Not to mention…low morale, under performance,<br />

absenteeism, reduced productivity, poor image<br />

and turnover.<br />

The time to build mentally healthy workplaces is now,<br />

because now more than ever we are seeing:<br />

• Rising screen time, sedentary behaviour and<br />

chronic illness.<br />

• Major advances in automation, digitisation and<br />

artificial intelligence.<br />

• The blurring of boundaries between work<br />

and home.<br />

• Rising performance and productivity expectations.<br />

• The creation of a ‘gig’ and entrepreneurial<br />

economy – the disruptors.<br />

• And more digital connection but less human<br />

contact are all expected to lead to increased stress<br />

and mental health challenges.<br />

So what can be done?<br />

It makes good business sense to create a mentally<br />

healthy workplace. For every $1 spent on mentally<br />

healthy workplaces up to $2.30 is returned<br />

from reduced presenteeism, absenteeism and<br />

compensation.<br />

A mentally healthy workplace promotes positive<br />

workplace practices that enhance mental health by:<br />

1. Preventing harm through effective risk<br />

management practices<br />

2. Intervening early to signs of stress and<br />

distress, and<br />

3. Supporting workers recovering from physical and<br />

mental health conditions.

There is a training company called RSA ONLINE<br />

NOW (or other state based variants of a similar name)<br />

who deliver an online course described as an “RSA.”<br />

Unbeknownst to many customers, usually young<br />

people who are entering the industry, this RSA training<br />

course is not in fact the accredited unit of competency<br />

that’s the mandatory qualification required to work in<br />

Queensland’s hotel and hospitality sector.<br />

How do they get away with this? They fudge it by<br />

calling the training product a “Responsible Sale<br />

of Alcohol” and describe the RSA course as “an<br />

introduction to the Hospitality Industry where service of<br />

alcohol is required.” They include some content from<br />

the genuine accredited RSA course and provide a<br />

Statement of Attendance or Certificate of Completion<br />

upon graduation, which is not the correct qualification<br />

but who would know that?<br />

Customers who don’t know much about hospitality<br />

training products are fooled into believing that this is<br />

the accredited Responsible Service of Alcohol course<br />

as described in the Liquor Act.<br />

This is what to look for on any website offering online<br />

RSA training:<br />

• The accredited course is actually called Provide<br />

Responsible Service of Alcohol<br />

• It is a unit of competency coded SITHFAB002<br />

• This training can only be delivered by a Registered<br />

Training Organisation (RTO) e.g. approved by the<br />

regulator – <strong>QHA</strong> is an RTO serial no. 30826<br />

• RTOs are training providers listed by the regulator<br />

on training.gov.au<br />

• Course content is based upon four elements:<br />

» Element 1 – Sell or serve alcohol responsibly<br />

» Element 2 – Assist customers to drink within<br />

appropriate limits<br />

» Element 3 – Assess alcohol affected customers<br />

and identify those to whom sale or service must<br />

be refused<br />

» Element 4 – Refuse to provide alcohol<br />

• A Statement of Attainment is issued upon<br />

successful completion.<br />

• The Statement of Attainment will include the<br />

following:<br />

» The words ‘Statement of Attainment’<br />

» It will display a certificate number, date of issue<br />

and RTO number<br />

» A Nationally Recognised Training logo (upside<br />

down pyramid)<br />

» Signed by an authorised officer (Chief Executive<br />

etc)<br />

All of the above should be displayed, found or<br />

described on the training provider’s website. In the<br />

RSA ONLINE NOW instance, none of the above<br />

information is provided.<br />

HOW DO THEY GET AWAY WITH THIS? THEY<br />

FUDGE IT BY CALLING THE TRAINING PRODUCT<br />

A “RESPONSIBLE SALE OF ALCOHOL”<br />

I understand that there have been complaints to the<br />

vocational training regulator (ASQA) in the past about<br />

this but they and/or some of the variants are still<br />

operating. Just one to mention to any young, potential<br />

hospitality employee who intends to obtain an RSA so<br />

they don’t get ripped off.<br />

On another note, original RSA Statements of<br />

Attainment dating back to 2011/2012 are still valid if<br />

they are described as a Statement of Attainment and<br />

contain the Nationally Recognised Training logo, even<br />

though the code may have been superseded.

appeal to my tastebuds.<br />

This is an enjoyable<br />

rendition that features<br />

dark roasted malts,<br />

American hops Ekuanot<br />

and Simcoe and a velvety<br />

body that delivers roasted<br />

coffee and cacao flavours<br />

with hints of blood<br />

orange, pine and aniseed.<br />

This brew combines malt<br />

and coffee notes with the<br />

easy drinking nature of a<br />

lager. Not too heavy, not<br />

too light, it’s just right for<br />

the change of season.<br />

couple I was singing the<br />

Bee Gees at the top of my<br />

voice (especially the high<br />

notes) - night fever, night<br />

fever, we know how to do<br />

it. Gimme that night fever,<br />

night fever.<br />

Absolutely magic. Your<br />

mouth is immediately<br />

awash with grapefruit yet<br />

it is not overpoweringly<br />

bitter, rather smooth and<br />

silky delivering a soft<br />

mouthfeel. Your tongue<br />

will feel like velvet, your<br />

mouth a little numb and<br />

your mind completely at<br />

ease. Relax and continue<br />

slurping.<br />

The tropical punch aroma<br />

is followed by hits of pine<br />

and passionfruit that<br />

finishes with some resin<br />

bitterness that will wet<br />

the whistle. Solid. Thirst<br />

quenching. Thumbs up<br />

And I am finally converted<br />

to sour. Yes, some<br />

have been enjoyable<br />

enough but I would<br />

never reach for one over<br />

a Japanese style lager<br />

or a brilliantly bitter IPA.<br />

Well, this was incredible<br />

and could be my leftfield<br />

thirst quencher on<br />

a hot summer’s day. I<br />

particularly loved the<br />

addition of coconut.<br />

A GREAT CATCH AT WEST END<br />

If you travel enough you soon realise that most<br />

cities in the world have a pattern to them. There’s a<br />

business district, a museum district, an entertainment<br />

district and a bohemian space where wanderers from<br />

all over the world gather and share their food, their fun<br />

and their talents.<br />

In Brisbane, that bohemian space is captured in the<br />

folds of the Brisbane River at West End – a place of<br />

unique shops, galleries and a vast array of tastes,<br />

flavours and cultures with a history of welcoming all<br />

comers.<br />

It’s that “positive, welcome and nostalgic feeling”<br />

that drove the creation of Catchment Brewing Co<br />

and continues to be the focus behind the craft beer<br />

creations it produces.<br />

For Allana and Chris Robinson, and Katie and Nick<br />

Jorss, the one thing they felt was missing from the<br />

suburb, way back in the early 2010s, was its own<br />

brewery.<br />

They found an art deco building at 150 Boundary<br />

St, first built by Greek businessman Alexander Fites<br />

in 1937 to house two shops, each with a flat above<br />

accessed from the shop below. The building was<br />

the third on the site after fire in 1889 destroyed<br />

the original 1887 building and the second was<br />

demolished to be replaced by the shell of what’s there<br />

now. The Robinson and Jorss families renovated the<br />

current building to suit their dreams of a brewery,<br />

bar and restaurant and opened their doors in 2015 –<br />

making use of the full block and its laneways to add<br />

laneway bar areas and a large seating area.<br />

In the six years since launch the brewery has<br />

continued to develop a following for its interesting<br />

range of beers, quirky wine list and tasty food. It’s<br />

also grown from its family base to have around 25<br />

shareholders and a CEO, Matt Newberry, charged<br />

with helping it to grow.<br />

Matt said the brewery had gone from strength to<br />

strength and was now looking at expanding.<br />

“We’re now at full capacity in the brewery currently,”<br />

he said.<br />

“We’re in the process of purchasing more brewing<br />

capacity to enable us to expand our business<br />

significantly.”<br />

Venue purchases and the potential addition of another<br />

brewery are on the cards with the Catchment Team<br />

keen to see their beers on tap far and wide.<br />

“Our aim is to replicate the Catchment story which<br />

is centered squarely around the local community.<br />

We intend to replicate that style of community driven<br />

hospitality making specific brews that resonate with<br />

the locals.<br />

On the beer front, the team put their 5HL Spark<br />

Engineering brewery to good use producing a core<br />

range of award-winning beers – led by their most<br />

popular brew, Whynot Lager.<br />

Whynot Lager’s name is based on the question most<br />

asked of prospective land buyers at West End at<br />

settlement more than 130 years ago – Why Not?<br />

There’s a street of the same name, Whynot St, and<br />

now there’s a 4.5% classic lager with a crisp lager<br />

malt flavour and a hint of lingering hop bitterness too.<br />

Other core beers from the brewery include:<br />

Pale Select, a 4.8% pale ale with flavours of stone<br />

fruit, tropical fruit and light spice. This beer was<br />

made as a tribute to the signature beer of the original<br />

West End Brewery which was founded in 1890 at<br />

Montague Rd and Merivale St. That brewery no longer<br />

exists.<br />

Vulture IPA, a 5.8% west coast style IPA with<br />

American hops described as bringing the aromas and<br />

flavours of tropical fruit, grape, mango, berry, and hop<br />

resin – with the hop bitterness balanced by a “bready,<br />

caramel malt sweetness”.<br />

Hoogley Session Ale, a 3.2%, described as a “light,<br />

spritzy session beer” full of flavours like passionfruit<br />

and citrus with some light herbal and resinous notes.<br />

Juno – Yuzu Summer Ale, a 4.2% beer brewed in<br />

collaboration with local Pan-Asian restaurant Chop<br />

Chop Changs which has been fermented with<br />

Japanese yuzu juice. The lemony citrus of the yuzu<br />

mixes with “subtle bread with light bitterness to round<br />

the end product”.<br />

Cow Tipper Milk Stout, a 5.6% classic stout offering<br />

big flavours of chocolate, coffee and vanilla.<br />

Each Catchment Brewing Co. can features art in<br />

the form of a colourful and stylish map logo which<br />

was created by overlaying colours onto the different<br />

pockets of activity within the boundaries of the suburb<br />

of West End itself.<br />

As well as being sold on site, the beers can be<br />

bought from more than 60 retailers in the Brisbane<br />

area (listed on the catchment website) or ordered<br />

online. Kegs are available for venues keen to add it to<br />

their taps too.<br />

On the venue side of things, Catchment Brewing Co<br />

offers three different function spaces, the Boundary<br />

Bar, Brewery Lane and Hidden Windows, and also<br />

sells Brewery Tours with the Head Brewer as an<br />

option for visitors. It is able to cater to functions of up<br />

to 300 people.<br />

The Catchment team describe their little piece of<br />

hospitality paradise as being a brewery, bar and<br />

venue space created for people to enjoy the energy,<br />

variety and flavour of the region, “while also enjoying<br />

some locally brewed beer that showcases differences,<br />

while harnessing the similarities of the people who live<br />

Even though the restrictions of the pandemic are still<br />

lingering over us, it is positive to see so many venues<br />

right across the state holding events and developing<br />

on-premise promotions to entice locals and visitors to<br />

your venues for these annual features.<br />

<strong>QHA</strong> & Tabcorp Race Day – Rockhampton<br />

A fantastic day was had by all attendees (close to 170)<br />

at the <strong>QHA</strong> & Tabcorp Race Day in Rockhampton<br />

in late August. Thank you to all of the hoteliers and<br />

industry partners who attended to socialise and<br />

network at the event. We had hoteliers from far and<br />

wide including Cairns, Charleville, Brisbane, Gundiah<br />

and Koumala just to name a few. A special thank you<br />

to Robert Carr and the team at the Red Lion Hotel for<br />

hosting the after-party as well. The event was such a<br />

success, thanks to the participation of all involved, that<br />

we will have to make the Regional Race Days a feature<br />

on the annual calendar.<br />

Minors on premise<br />

Many pubs across the state are reporting a surge of<br />

minors trying to get on to the premises with groups of<br />

friends. This can be attributed to the fact that this is<br />

the first year in Queensland that half of the graduating<br />

grade from high school are already eighteen years of<br />

age, while the other half are still seventeen years old.<br />

These seventeen year old’s are now more inclined to<br />

try and enter a licensed premises to join their friends<br />

who are of legal age, where in previous years there has<br />

only been a minority of students in high school who<br />

were eighteen. Add to this the prevalence, accessibility<br />

and competence of fake ID’s, it is becoming<br />

increasingly difficult to ensure these non-exempt<br />

minors do not enter the premises to consume alcohol<br />

with their friends. It is a timely reminder for your staff<br />

to remain vigilant with end of school year celebrations<br />

approaching.<br />

<strong>QHA</strong>/TAB Race Day in Rockhampton<br />

Live Music Australia Grants Program<br />

The Live Music Australia Program has been developed<br />

to bring more live music to Australian communities<br />

and will fund applications that support quality original<br />

Australian live music that is professionally staged, with<br />

a focus on small to medium venues. The Australian<br />

Government has provided a total of $20 million over<br />

four years for the Live Music Australia program. There<br />

will be $2.5 million funding available in each round.<br />

It has been great to see many QLD venues access<br />

the funding in the early rounds. Your venue could be<br />

eligible to access these grants ranging from $5,000<br />

Canowindra’s organic winegrower, Pig in the House,<br />

has released their new gold-medal winning 2019 Pig in<br />

the House Shiraz.<br />

The 2019 Pig in the House Shiraz was awarded a Gold<br />

Medal at the recent 2020 Royal Adelaide Wine Show.<br />

“We were really pleased with this result,” commented<br />

Pig in the House Winemaker Anthony D’Onise.<br />

“Our Pig in the House Shiraz is a consistent goldmedal<br />

wine, with each vintage from the 2016 having<br />

been awarded a gold medal.<br />

“We have really focused on our shiraz winemaking over<br />

the last few years; highlighting modernity and vibrancy<br />

in the style. As the results from Adelaide suggest, the<br />

Canowindra region lends itself to this style, with its dry<br />

summers and cool nights during the growing season.<br />

“We are truly pleased that the South Australian judges<br />

were able to identify our wine amongst 150 wines from<br />

all across Australia as being a benchmark aromatic,<br />

medium-bodied shiraz.<br />

“We are not overly surprised that the region’s shiraz are<br />

performing well. The expertise in the region, along with<br />

the vines are maturing. On average our shiraz vines are<br />

nearing 30 years old and have been grown organically<br />

for half that.<br />

“We are more confident as every season passes. The<br />

recent results demonstrate this, and we look forward<br />

to what the future brings. We find that as the vines<br />

evolve, so does the style.”<br />
