NOTE<br />

Welcome to the <strong>2021</strong> Spring Edition of the Silent Review,<br />

your cabin crew magazine.<br />

In this edition we honour a remarkable person, Arthur Mansour. Many of us know<br />

Arthur from flying and more so from his position in the EP department. Arthur has<br />

many skills and this article outlines how much more there is to that smiling face he<br />

so often parades.<br />

As we phase out of lockdown into “return to flying," it is important we understand<br />

the legislation related to contracting Covid in the workplace. We welcome Michael<br />

Hyland, the FAAA associated legal expert, on all matters Workers Compensation and<br />

in particular contracting Covid at work. Michael talks in detail about what transpired<br />

when flying was being wound back in March 2020 as the pandemic was declared.<br />

Learn what we can expect in relation to this going forward.<br />

Our very own councillor, Benjamin Parker writes about Enterprise Bargaining<br />

Agreements (EBAs) and explains a little more about them in detail. Ben’s article<br />

covers a broad scope of industrial law items, which is important to understand as<br />

this relates to our job as cabin crew.<br />

There is a great article on our extremely well respected ex-CSM Sam Barripp who<br />

took VR and moved into a new world of customer service and hospitality.<br />

Plus, the FAAA business directory along with other discounted offers throughout<br />

the magazine.<br />

As we get ready to return to flying I recognise that it’s a very stressful time.<br />

It will take a bit of time and effort to get back into the swing of<br />

what flying will be post Covid.<br />

The FAAA are never here to increase your stress or anxiety in your workplace. Yet, we have an obligation<br />

to ensure everyone understands the climate and the industrial issues that are attached to the return to flying<br />

and also YOUR EBA negotiations.<br />

We need to highlight every issue and every possibility from the company’s claim and ensure that all crew<br />

are informed and educated on this critical vote.<br />

Whilst some may say there is not a lot in this qantas long haul eba to be concerned about, the critical<br />

impact on the company’s proposed changes will impact the conditions of cabin crew forever. Once any<br />

conditions are lost, they cannot be regained.<br />

All in all, cabin crew are aviation’s first responders and we are simply asking that our airlines respect the<br />

important role we play in the Buisness and reward us accordingly.<br />

COVID-19 AND WORKERS<br />

To date forty-eight members of the Flight Attendant’s Association of Australia<br />

have submitted workers compensation claims for Covid-19 infection. The majority<br />

of the members who were employed by Qantas were Sydney based. Qantas<br />

accepted liability for the claims. Thereafter the members were paid weekly<br />

compensation for certified periods of total or partial incapacity for work and injury<br />

treatment expenses were paid on their behalf.<br />

Most of the relevant members were infected with<br />

Covid-19 during the first wave of the virus. Early<br />

symptoms of the disease differed on a case to case basis.<br />

Commonly reported symptoms included but were not<br />

limited to a loss of taste and smell, rapidly increasing<br />

levels of fatigue and myalgia, shortness of breath, chest<br />

pain, persistent headaches and flu-like symptoms.<br />

The inherent Covid-19 high risk contagion environment<br />

of the cabin of a commercial aircraft crystallised for the<br />

cabin crew of QF28 operating from Santiago to Sydney<br />

on 27 March 2020. Of the fourteen crew, eight were<br />

infected with Covid-19.<br />

The vagaries of Covid-19 were chillingly illustrated by<br />

its impact on two of the infected QF28 crew, referred to<br />

hereafter as FA1 and FA2.<br />

FA1 began suffering from respiratory symptoms, including<br />

a cough and fever, during the flight from Santiago to<br />

Sydney. Following arrival into Sydney, FA1 undertook<br />

a Covid test which was reported as positive. On NSW<br />

Health Department directions FA1 self-isolated at home.<br />

His respiratory symptoms gradually improved over a<br />

10-12 day period.<br />

However, in mid-April 2020 FA1’S condition rapidly<br />

deteriorated and he developed acute urinary retention<br />

requiring home attendance by paramedics for insertion<br />

of a catheter. Within 24 hours FA1 developed disturbing<br />

neurological symptoms including increasingly poor<br />

balance and difficulty walking. An ambulance was again<br />

called and FA1 was conveyed to a public hospital.<br />

Emergency Department investigations, including an<br />

MRI scan, established that FA1 was suffering from<br />

post-infectious transverse myelitis, an inflammation of<br />

the spinal cord. As a result of the diagnosis, FA1 was<br />

hospitalised for 11 days. Following his discharge,<br />

FA1 was required to use a walking stick for 5-6 weeks.<br />

Although it is now 18 months since FA1 was Covid 19<br />

infected, he continues to suffer balance problems and his<br />

long term prognosis remains uncertain.<br />

FA2 began to suffer symptoms of fatigue and body aches<br />

on 2 April 2020. The severity and range of symptoms<br />

suffered dramatically escalated within a 24-hour period.<br />

On 5 April 2020, test results established that FA1 was<br />

Covid- 19 infected. On NSW Department of Health<br />

directions, FA2 was required to isolate at her residence<br />

with her husband and two children.<br />

In the early stages of her isolation FA2 began suffering<br />

from high levels of stress and anxiety due to the Covid-19<br />

infection risk she posed to her children and husband. The<br />

basis for FA2’s stress and anxiety was the life-threatening<br />

risk to her children and husband if they contracted<br />

Covid-19. Both children were asthmatics and FA2’s<br />

husband also suffered from an underlying health condition.<br />

FA2’s fears were realised when both of her children and<br />

her husband were diagnosed with Covid-19 in or around<br />

mid-April <strong>2021</strong>. The diagnoses exacerbated FA1’s stress<br />

and anxiety.<br />

During her period of infection, FA2 undertook multiple<br />

covid tests. The results of the third test undertaken on<br />

8 May 2020 were reported as negative.<br />

Before being Covid infected, FA2 had no prior medical<br />

history of suffering from blurred vision or sensitivity to<br />

light. However, in or around early June 2020, FA1 began<br />

suffering both.<br />

On consulting with an ophthalmologist, FA2 was<br />

diagnosed as suffering from central serious retinopathy<br />

(“CSR”) in her right eye. CSR is a disease which if<br />

left untreated can cause visual impairment. FA2’s<br />

ophthalmologists opined that although it was early days in<br />

terms of understanding the effects of Covid-19 he was not<br />

aware of any causal relationship between Covid-19 and<br />

the development of CSR.<br />

In or around four months after her CSR diagnosis, FA2 was<br />

diagnosed by her ophthalmologist as also suffering from<br />

left eye nummular keratitis, an inflammation of the cornea.<br />

In respect to causation, FA2’s ophthalmologist opined that<br />

the left eye condition may have been a long-term effect of<br />

Covid-19.<br />

Although liability had been accepted for FA2’s earlier<br />

Covid-19 workers compensation claim, Qantas denied<br />

funding liability for FA2’s CSR and nummular keratitis<br />

treatment expenses which totalled just over $1,000.<br />

FA2 successfully challenged Qantas’ treatment expenses<br />

funding determination in the NSW Personal Injury<br />

Commission. Expert medical evidence relied on by FA2<br />

included an independent medical examination report<br />

provided by an ophthalmic surgeon. In his report the<br />

surgeon expressed the opinion that FA2’s “symptoms<br />

of blurring and glare sensitivity were initially due to the<br />

effects of the CSR and then nummular keratitis and<br />

these were caused or exacerbated by the effects of the<br />

Covid-19 infection.”<br />

Although it is now 18 months since FA2 was Covid-19<br />

infected, she continues to suffer problems with breathlessness<br />

and her long-term prognosis also remains uncertain.<br />

The long-term persistence of some Covid 19-symptoms<br />

which continue to be suffered by FA1 and FA2 raises the<br />

question as to whether either or both are suffering from<br />

a post Covid-19 condition, which is being increasingly<br />

referred to in the media as long Covid.<br />

Noting that the pandemic is yet to reach its second<br />

anniversary date, medical research into long Covid is still<br />

evolving. However, early research results provide cause<br />

for significant concern that sufferers of long Covid face the<br />

potential risk of permanent damage to one or more organs,<br />

including but not limited to the respiratory system, heart<br />

and liver.<br />

So, what is long Covid?<br />

In early October <strong>2021</strong>, the World Health Organisation<br />

provided the following clinical case definition of post<br />

Covid-19 condition.<br />

Post Covid-19 condition occurs in individuals with a<br />

history of probable or confirmed SARS CoV-2 infection,<br />

usually three months from the onset of Covid-19 with<br />

symptoms and that last for at least two months and<br />

cannot be explained by an alternative diagnosis. Common<br />

symptoms include fatigue, shortness of breath, cognitive<br />

dysfunction but also others and generally have an impact<br />

on everyday functioning. Symptoms may be new onset<br />

following initial recovery from an acute Covid-19 episode<br />

or persist from the initial illness. Symptoms may also<br />

fluctuate or relapse over time.<br />

Subject to the provisions of workers compensation<br />

legislation at the Commonwealth level and in each State<br />

and Territory, the entitlements of a long Covid- 19 infected<br />

worker may extend to claiming permanent impairment<br />

lump sum compensation.<br />

For the extreme scenario, the Covid- 19 infection of a<br />

worker being fatal, do the deceased worker’s dependents<br />

or in the absence of dependents, the deceased worker’s<br />

Estate have any compensation entitlements against the<br />

deceased workers employer?<br />

For a New South Wales widow, this question was<br />

answered in the affirmative by the NSW Personal Injury<br />

Commission on 10 August <strong>2021</strong> in the matter of Sayde<br />

Sara v. G & S Sara Pty Limited.<br />

Sayde Sara (“the applicant”) was the widow of Georges<br />

Sara (“the worker”). The respondent employer was part<br />

of a group of companies that provided dental technician<br />

products and services both in Australia and in the United<br />

States. The worker was both a director and an employee<br />

of the respondent.<br />

The worker travelled to New York for business purposes<br />

on 15 July 2020. On around 18 or 19 July 2020 he began<br />

suffering from symptoms of CovId-19 but did not consult<br />

with a doctor. On 23 July 2020 the worker was admitted<br />

into hospital in New York and diagnosed with Covid-19<br />

on the same date. During his extended period of hospital<br />

admission, the worker suffered several heart attacks and<br />

strokes. The worker died on 21 November 2020 due to<br />

respiratory complications from Covid-19.<br />

The applicant claimed a death lump sum benefit, funeral<br />

and associated expenses and treatment expenses.<br />

In denying liability for the applicant’s claim, the respondent<br />

employer’s insurer contended that the worker contracted<br />

Covid 19 in a social setting outside of the course of his<br />

employment and/or the work performed by the worker<br />

was for a US company and hence was not covered by the<br />

New South Wales Workers Compensation Act.<br />

The issue to be determined by the Personal Injury<br />

Commission was whether the worker was in the course of<br />

his employment with the respondent when he contracted<br />

Covid-19.<br />

The Commission held that the worker probably<br />

contracted Covid-19 during the course of his travel to<br />

the United States. As such, the Commission determined<br />

that the worker contracted the virus in the course of his<br />

employment. Orders entered for the applicant included an<br />

order for payment of a death lump sum benefit in the sum<br />

of $834,200.<br />

The Commonwealth and all State and Territory workers<br />

compensation statutes include provisions for death benefit<br />

lump sum claims, funeral and associated expenses and<br />

claims for weekly compensation where a deceased worker<br />

had a financially dependant spouse and/or financially<br />

dependant children.<br />

With the significant number of deaths resulting from<br />

the <strong>2021</strong> Delta outbreak in NSW, Victoria and the ACT,<br />

it is anticipated that more death benefits claims will be<br />

pursued by families and/or the Estates of worker’s who<br />

suffered fatal Covid-19 infections.<br />

With the gradual increase in domestic operations and<br />

Qantas’s recent announcement of recommencement<br />

of international flights from 1 November <strong>2021</strong>, it is also<br />

anticipated that there is potential for a “spike” in the<br />

submission of workers compensation claims by members<br />

who become infected with Covid-19 arising from or<br />

during the course of their employment.<br />

New South Wales based members of the Association<br />

who suffer Covid-19 infection in the future will have the<br />

benefit of 2020 amendments made to the NSW Workers<br />

Compensation Act 1987. The amendments introduced a<br />

presumption that workers in prescribed employment who<br />

contract Covid-19 are automatically presumed to have<br />

contracted it in the course of their employment, unless<br />

the contrary is established.<br />

The Workers Compensation Amendment (Consequential<br />

Covid-19 Matters) Regulation 2020 (NSW) commenced<br />

on 24 July 2020. The Regulation sets out the medical tests<br />

and results for prescribed workers, how the presumption<br />

applies and types of prescribed employment. Prescribed<br />

employment includes employment in passenger<br />

transport services.<br />

Under the Regulation eligible workers are presumed to<br />

be incapable of work until 21 days from the date of<br />

illness, or if the worker still has Covid-19 at this date,<br />

until the end date of the worker’s incapacity, as recorded<br />

on a Certificate of Capacity provided to the worker by<br />

a treating doctor.<br />

To date Melbourne and Brisbane based members and<br />

members employed by Virgin (whose entitlements<br />

fall under the Commonwealth workers compensation<br />

regime) do not have the prescribed employment statutory<br />

status held by NSW members for Covid-19 workers<br />

compensation claims.<br />

In the event that liability is denied for any Covid-19<br />

workers compensation claim submitted by a Melbourne<br />

or Brisbane based member or by a member employed<br />

by Virgin, then it is recommended that the Association is<br />

immediately contacted to enable advice to be provided.<br />

By the outpouring of reactions and messages on Facebook, Arthur is one of the<br />

most well-known and well-loved Qantas Group family members in recent memory.<br />

His impact on crew is clear for all to see (just visit qfcrew for a visual aid).<br />

During this interview, I learned that Arthur has a fearfully<br />

good memory for dates, names (and procedures) and<br />

could talk underwater… but most palpable is that he has<br />

a genuine and enduring love for the job, people and life.<br />

And it turns out that he has lived a few – and they keep<br />

weaving into each other to make the picture that we now<br />

see. Locations, hobbies, interests, skills…<br />

intended) into the man,<br />

the mentor that is…<br />

You can picture Arthur as a<br />

high school maths teacher<br />

– he taught from 1985-1988<br />

at James Cook High in<br />

Kogarah, Sydney. By chance,<br />

he was tutoring a family<br />

friend whose sister had just<br />

applied to Qantas and he<br />

thought it sounded great.<br />

Arthur had no real experience in a ‘job application<br />

process’ due to being interviewed as a matter of course<br />

upon graduating as a teacher. He posted his Qantas<br />

application away and despite underpaying the mail<br />

charge, his package made it into safe recruitment<br />

hands. Arthur then was asked by the post office for the<br />

outstanding cost (of 80c). What a sliding doors moment<br />

and how different EPs would have been if the underpaid<br />

package bounced and he didn’t make the application due<br />

date. A further string to his bow was that Arthur qualified<br />

as an Arabic speaker due to his Lebanese background.<br />

Arthur, without too much formal interview experience at<br />

all attended the Qantas panel interview. Another hopeful<br />

candidate had what seemed like pre-rerecorded answers,<br />

and sounded robotic<br />

whereas Arthur was pretty<br />

relaxed and genuine. A<br />

final question was ‘anything<br />

to ask us?’. The candidates<br />

had been asked ‘what<br />

has been your greatest<br />

challenge?’ so Arthur<br />

decided to throw this one<br />

back to the recruiters.<br />

He received his letter of<br />

selection, and was told his<br />

start date was September.<br />

In true aviation style, it was<br />

rolled forward to July 18th<br />

‘and the rest was history!’.<br />

Arthur started his flying<br />

with London trips. He received 75% rounded up<br />

standdown (not standdown as we know it these days, but<br />

it used to mean ‘rest after a pattern’). Hence, he got 6/7<br />

days off after trips and taught PE back casually at his old<br />

employer. Some of the boys didn’t even realise he had<br />

left teaching, let alone just flown to Heathrow. The role<br />

seemed too good to be true: ‘be nice to passengers then<br />

get all this spending money… is that even work??’.<br />

He has also loaned his skills to the Crew Revue since 1996<br />

and since 2002 has being doing the dubbing. No, this man<br />

never stops weaving his passions and skills.<br />

Eighteen months in, Arthur became a CSS. His experience<br />

taught him this: ‘remain calm and do what you have to do,<br />

STAR technique. Take a fraction of a second and don’t<br />

have a knee jerk reaction. Don’t learn rote and get unstuck,<br />

it’s a thought process as opposed to memory recall.’<br />

One day in 1990 when Arthur was signing on, he was<br />

asked by chance to pose for a photo. Unknowingly, he<br />

therefore became the literal poster boy for Qantas cabin<br />

crew – and he found out when his students ended up<br />

spotting him on their careers fair pamphlet. This was just<br />

the beginning of his time in front of the camera.<br />

In 1995, Qantas advertised for EPs instructors. Arthur’s<br />

teacher background made it a great fit and wove in two<br />

lives again. Arthur’s first video was in 1996 – he had to<br />

carry out briefing a passenger with disabilities. The footage<br />

still exists…<br />

Doug Hadley and Arthur digitised all initials resources<br />

from slides on carousel machines and scripts. (Slide<br />

projectors were located in those narrow little rooms in<br />

SYD behind the training rooms with the wooden shelving<br />

where we now store our bags.) Arthur always tried to<br />

avoid Death by PowerPoint – and was meticulous about<br />

consistent formatting. He spent hours in the AV editing<br />

Batcave – curtains closed, publishing meticulous graphics.<br />

They even invented new graphics pixel by pixel for us<br />

when pictures weren’t available! Doug and Arthur rotated<br />

rosters as they were not allowed to be missing from<br />

EPs. Arthur still programs the trainer for evidence based<br />

scenarios, as recently as July this year.<br />

In 1989, Arthur was in Fiji and stumbled upon a PRODIVE,<br />

part owned by a Qantas ‘chief’. He then worked his way<br />

up to become a diving instructor. A great piece of advice<br />

which in my opinion is as helpful underwater as other<br />

skills like applying symmetrical winged eyeliner or working<br />

the galley on a Jumbo was: ‘plan your dive and dive your<br />

plan’. Arthur even wove his EPs contacts into his diving life<br />

by using the Jetbase pool for diving certification.<br />

Arthur is now teaching at St Johns as a First Aid trainer.<br />

He also as mentioned assisted at Qudos Bank Arena Mass<br />

Vax Hub where his logistics and training expertise saw<br />

him reunited with crew.<br />

Q: Top Three Study Tips? (Narrator: There were not<br />

just three.)<br />

‘Flick through the manual, just read what you have<br />

forgotten, not the whole thing.’<br />

‘Use the walkarounds and the videos.’<br />

‘Stop, look and think.’<br />

‘Stay up with procedures, read through everything<br />

including the CSOs. Don’t cut corners, consistency<br />

is important.’<br />

‘Take ownership and responsibility – it’s your job. Police<br />

and firies and ambos are safety professionals who train,<br />

we should too.’<br />

Arthur has also had a videography business on the side.<br />

His father was in tech and he loved photography – Arthur’s<br />

first camera was a Pentax Super A at age sixteen. He then<br />

scored a Canon XL1 in 2000. Arthur was often approached<br />

to film the big events that his family put on. He is currently<br />

digitising VHS tapes for friends (and in the 2020 pandemic,<br />

Q: Does watching ‘Aircraft Investigations’ count as study?<br />

‘It’s sensationalised but it denotes the role as not just<br />

‘chicken or beef’. Human Factors was introduced in<br />

1995. The raft drill was performed with cabin crew being<br />

pre-allocated roles (you had the navy rescuer, a raft<br />

commander, some passengers eg couples). Turning on<br />

the rain and using the hose made it more real. ‘Aircraft<br />

Investigations’ highlights the fact that it was important<br />

that the cabin crew spoke out; they are the pilots’ eyes<br />

and ears. We are all one team, the whole package.’<br />

Q: Any memorable hiccups during EPs:<br />

‘People have actually come to EPs exams and during the<br />

day gone home’. ‘Once a hostie doing the computer exam<br />

pulled me over and said ‘what about the helicopter’. The<br />

answer was ‘pull the sea anchor in to prevent damage’ [to<br />

the rescue ship] but she was fixated on the presence of a<br />

helicopter. I had to say to her ‘turn around and look at me –<br />

read the question out loud – there IS NO helicopter!’. Arthur<br />

still remembers this mind blip due to helicopter… obsession.<br />

Q: Speaking of obsessions… the rite of passage that is<br />

the Mascot Hong Ha bakery. Arthur has a hot tip for<br />

eating the crusty bread rolls: ‘you gotta crush them with<br />

your hand, but it depends where you’re eating them’.<br />

Q: What do you wish passengers knew about you?<br />

‘I hope they trust me, their safety is our paramount thing…<br />

to look after them and not just through hospitality. I’m<br />

not a servant but I am offering a service.’ [The cheekier/<br />

personal content I have redacted for our innocent ears.]<br />

Q: How many times have you watched the Pristine<br />

Manual Handling aka Davey’s Jam Donut video?<br />

‘I don’t always take that component of the course but…<br />

heaps – and I still use it in St Johns when teaching CPR.<br />

Lean directly over the patient, turn don’t twist when<br />

you give the breaths.’<br />

Q: What’s the biggest sacrifice you made as crew?<br />

‘Missing out I guess. Being at EPs hence on the ground,<br />

according to a comparison of group certificates meant<br />

‘losing’ up to $5000/10000 a year in allowances. But<br />

working in EPs for 26 years pretty much means I could<br />

take the good with the bad, and working on the ground is<br />

good for your body. Later, the skill allowance was upped.<br />

The job is mentally stimulating. When family and friends<br />

plan events in the future, they can say ‘you’ll be here’<br />

versus you saying ‘will I be around?’.<br />

Q: What are the changes you’ve noted over your time?<br />

It was just different before. ‘Once, the CSM was on the PA,<br />

pointing out local beauties that we were flying over. Kerry<br />

Packer said if he doesn’t shut up I’ll shove that phone up<br />

his ass’.<br />

‘People were not fixated with screens, it was more social<br />

– less engrossed in screens. But you need to go with the<br />

times. Change is here, it’s going to happen. What you can’t<br />

change, you work with. If you’ve got a better way let’s do<br />

it. The ‘better way’ does not always work. It’s not rocket<br />

science, it only makes sense.’<br />

Q: Have you had any memorable<br />

onboard emergencies?<br />

‘Despite having 33 years of service in<br />

July <strong>2021</strong>, I have had a non-eventful<br />

flying career. To me it’s just doing my<br />

job, have situational awareness.’<br />

Arthur has never used restraints<br />

but has offloaded a woman ex LAX<br />

swearing. She was in her late 30s,<br />

gave the option: behave and get you<br />

home. Seats are meant to withstand<br />

6Gs of force – she kicked and broke<br />

the seat. The passenger was escorted<br />

off the aircraft in a ‘restraint manner’.<br />

Actually, ‘years ago in the EPs trainer,<br />

we used to teach crew to run over the<br />

top of the seats, used to fill the cabin<br />

with smoke and drag out a colleague<br />

by the collar.<br />

We had surprise hijackings with balaclavas and fake guns.<br />

We used to light fires at the end of SYD airport runway.’<br />

Q: Proudest moment/s as a Qantas teacher?<br />

Getting the 2000 Excel Award for Outstanding<br />

Contribution, after pulling some EPs twelve hour days<br />

working 6am to 6pm.<br />

He also received the Annual Safety Award for 2006, due<br />

to his work with an incapacitated pilot on a 767 flight<br />

AKL to SYD. It was the end of a ‘rice bowl’ tour. The FO<br />

was in the foetal position. He had been cleared after<br />

contracting malaria but then began hallucinating. (Earlier in<br />

the flight, a cardiologist had his computer up and he and<br />

Arthur got talking – surprise surprise). Arthur got help from<br />

the doctor, then the crew stripped the pilot of his uniform<br />

accolades and put him in the cabin for landing. They made<br />

a PANPAN call (one below a MAYDAY) landing into SYD<br />

to get priority. For the Safety Award, Qantas invited Arthur<br />

to stay at the Four Points Sheraton then to a black tie event<br />

at Acer Arena – now called Qudos Bank Arena where he<br />

is leading stood down crew at the huge vax hub.<br />

with the big bucket items versus smaller items for a<br />

re-briefing. EPs is real, with real people. Not doing ‘check<br />

safe’ in the widow will be the thing that kills you; you<br />

can’t recover from it. Remember what is life threatening<br />

and what isn’t. I am passionate about the flow of actions.<br />

Remember what is punitive versus what is training. Major<br />

fail versus a minor fail… where do you draw the line?<br />

The philosophy of training often came from higher up’.<br />

Q: What actually happened in the Lower Lobe?<br />

Kkkkrrrrrrrrrrrrrrkkkkkkkkk [the phone call cut out a<br />

little here].<br />

Closing words are from Arthur, whose dedication and<br />

passion is obvious.<br />

Q: What is your training philosophy?<br />

‘Helping crew – it’s the best part of the job no dramas,<br />

people still message me and I want them to do a good job<br />

and not get stressed. The idea was that when you left the<br />

EPs day, you would be better at your job, confident and<br />

believing in yourself. Confidence will save lives. When we<br />

were observed by CASA, I was keen to push compliance<br />

‘I was so blessed: look at my life.<br />

Teaching EPs then you get a few<br />

trips here and there, who would<br />

want a better lifestyle. My last 33<br />

years have been fantastic.’<br />

EBA BASICS<br />

As we are well and truly in the early stages of negotiations for our next enterprise<br />

agreement, this is a great time to share some information sourced directly from the<br />

law. The Fair Work Act 2009 contains many of the rights workers in Australia have,<br />

but this large, complex, and confusing piece of legislation is often under attack by the<br />

government and employer lobby groups. So it’s important to have a basic understanding<br />

of some elements. Let’s talk about the basics of an enterprise agreement.<br />

What does the law say an enterprise agreement is?<br />

The Fair Work Act 2009 (Cth) states that an enterprise<br />

agreement – made at the enterprise level (enterprise means<br />

a business, activity, project or undertaking) – can have<br />

terms and conditions for employees that are in addition<br />

to the national employment standards. An enterprise<br />

agreement can last between 1-4 years.<br />

So, who can make enterprise agreements?<br />

Employers and employees may make enterprise<br />

agreements. Our current agreement (EBA 10) covers two<br />

employing entities, so it is known as a multi-enterprise<br />

agreement. This is allowed to be made with the employees<br />

who are employed at the time the agreement is made and<br />

whoever else will be covered by it. However, an enterprise<br />

agreement cannot be made with just a single employee.<br />

If you are a member of an employee organisation (i.e your<br />

FAAA) – they will make the agreement with your employer<br />

on your behalf. If the enterprise is genuinely new and does<br />

not yet have any employees, the employer is to bargain<br />

with the union – this is known as a greenfields agreement.<br />

How does an enterprise agreement begin?<br />

An employer is to notify each employee of representational<br />

rights. Each employee has the right to have a representative<br />

negotiate, or, bargain for them (hello FAAA!). However,<br />

you have the right to appoint yourself. So, what can be<br />

included in an agreement?<br />

• Matters pertaining to the relationship between an<br />

employer and its employees, and between an employer<br />

and an employee organisation who will be covered by<br />

the agreement;<br />

• Deductions from<br />

wages for any<br />

purpose authorised<br />

by the employee<br />

(This may be salary<br />

sacrifice, as an<br />

example)<br />

• How the agreement<br />

will operate.<br />

So, who does the<br />

bargaining?<br />

An employer is one bargaining representative for the<br />

agreement. This, in my opinion, is crucial to remember –<br />

the employers have a direct say in which conditions they<br />

wish to provide for their employees.<br />

If there is an employee, who will be covered by the<br />

agreement, that is a member of an employee organisation<br />

(aka a union), then the union will bargain (or, negotiate) on<br />

behalf of that employee, forming two parties of<br />

an agreement.<br />

This begins – generally – the longest part of the entire<br />

process – the actual bargaining. This is currently where we<br />

are now at for EBA 11.<br />

How does the enterprise agreement then become<br />

approved?<br />

Before an employer requests that employees approve<br />

a proposed enterprise agreement by voting for the<br />

agreement, the employees must be given a copy of<br />

the written agreement in whole, including any material<br />

incorporated by reference in the agreement. The employer<br />

must tell the employees the time and place where the vote<br />

will occur, and the method that the vote will take place –<br />

either by ballot or an electronic method. The time between<br />

receiving the proposed agreement and the start of the<br />

voting process is 7 days. The employer must not knowingly,<br />

or recklessly, make a false or misleading representation<br />

in any document that the employees are given a copy<br />

of, and they must take all reasonable steps to ensure the<br />

employees have the opportunity to have the terms of the<br />

agreement and their effects, explained to them.<br />

you have the right to<br />

have it explained to<br />

you by your employer.<br />

If the employees that<br />

will be covered by the<br />

agreement have been asked to approve it, the employees<br />

have voted and a majority of the employees approve it,<br />

then the agreement is made. A bargaining representative<br />

(either employer or union) must apply to the Fair Work<br />

Commission for approval of the agreement within 14 days.<br />

If the employees vote no and reject the agreement, then<br />

the agreement is not made.<br />

When does the Fair Work Commission HAVE to<br />

approve an EA?<br />

The Fair Work Commission must be satisfied that:<br />

• The employees have genuinely agreed to the agreement<br />

• The employers have genuinely agreed to the agreement<br />

• The agreement doesn't include any unlawful terms<br />

• The agreement has terms on an expiry date (which<br />

must not be more than 4 years) and has a term on<br />

settling disputes<br />

• The agreement doesn't contravene the NES (Remember<br />

from the last post? The 11 minimum employment<br />

standards in Australia), and,<br />

EBA passes this test at the time of the application<br />

for approval of the agreement, however there are limited<br />

instances where the FWC can approve an agreement<br />

when it doesn’t pass the BOOT.<br />

What is the modern award?<br />

The modern award, together with the<br />

NES – provide a fair<br />

and relevant minimum safety net of terms and conditions,<br />

relevant to specific jobs. If we did not have our EBA, we<br />

would be covered under the Aircraft Cabin Crew Award<br />

2020.<br />

As an example of the minimum safety net, the Aircraft<br />

Cabin Crew Award 2020 provides for 5 weeks of annual<br />

leave, whereas our EBA provides for 6; modern award<br />

crew must replace their uniforms at their own cost apart<br />

from fair wear and tear, whilst Qantas pays for ours;<br />

and modern award crew are only entitled to 8 days off<br />

per 28 day period, whereas we are entitled to 9 in 28 days.<br />

Very importantly, if Qantas threatens to terminate our<br />

EBA and return to the modern award, the maximum length<br />

of a single sector duty is 18 hours (unplanned to 20) –<br />

which rules out Sunrise flights.<br />

Can an EBA be changed or even cancelled once it is<br />

in place?<br />

Yes. If both parties of the agreement decide to change it,<br />

they can jointly apply to make a variation to the agreement.<br />

However, the change must be approved by the FWC. An<br />

employer can request employees to approve a proposed<br />

variation, done by voting. The FWC may vary an enterprise<br />

agreement to remove an ambiguity or uncertainty on<br />

application by just one applicant – a single employee,<br />

even. And the Australian Human Rights Commission can<br />

apply to vary an enterprise agreement, too.<br />

What is the BOOT?<br />

The Better Off Overall Test (BOOT) is a satisfaction by<br />

the Fair Work Commission (FWC) that each employee<br />

would be better off by working under the conditions of<br />

the proposed EBA, instead of the relevant modern award<br />

applied to them. The commission must be satisfied that the<br />

We always wanted to try our hand at owning a cafe, however never thought<br />

seriously about it, as Sam had a fulfilling and ‘safe’ career at Qantas.<br />

Enter “COVID” in March 2020, and things changed dramatically. Overnight, the<br />

aviation industry and Sam’s 30+ year career as an International OBM was over.<br />

As the saying goes, “one door closes and another one<br />

opens”, we decided to put the cafe idea into practise.<br />

Sam and Linda come to The Chocolaterie Cafe with a<br />

combined 60 years in service excellence (Linda also<br />

enjoying a 28 year career with Qantas). Having travelled<br />

extensively around Australia and the world, their<br />

experiences have highlighted the importance of customer<br />

interaction that makes beneficial and lasting impressions.<br />

We are dedicated to making a positive difference to all<br />

who walk through our door and our community at large.<br />
