WHEN THE call went out for
volunteers to run the Peace
Train that Yusuf Islam gifted to
Christchurch after the mosque
attacks, Andrew Wilson knew
he had to put his hand up.
One of his workmates was at
the mosque when the attacks
occurred and witnessed the
shootings.
“He rang me as he was due
back to work on a project with
me, saying there had been an
event,’’ Wilson recalls.
“It rocked me to the core – my
peace-loving friend had been
through such an ordeal. It took a
long time for him to recover. He
lost his best friend and flatmate.’’
Wilson did all that he could
to support his workmate in the
months that followed.
When he heard the city
council was looking for
volunteers to help run the Peace
Train, the 55-year-old saw
another way to show his support
so he volunteered to train the
train drivers.
“I have been involved
with trains since my earliest
memories. I have been known,
accused even, of being obsessed
with them. It’s not too far from
the truth.’’
He collects model trains,
has a huge garden railway in
his backyard, and is railway
manager at Steam Scene
McLeans Island. He is also
involved with the Little River
Railway Station Trust and a
member of miniature railway at
Halswell.
As a grandfather, Wilson says
he loves putting a smile on kids’
faces and sharing his passion for
trains with others. His years of
experience with trains means
that he knows exactly what it
takes to be a good train driver.
disposition and a willingness to
Wilson is part of a team of 40
volunteers who will be helping
to run the Peace Train.
Co-ordinating the volunteers
is Brendon Eason. His wife,
Elizabeth, has also volunteered
to be a driver and conductor.
“My wife and I saw the article
about the council seeking
volunteers and thought it was
awesome. What a wonderful
idea to promote unity and
peace through families in
Christchurch. This is what we
believe in and what we support,’’
said Eason.
“We want to bring smiles to
faces and joy to people’s hearts.
Even on our training run we had
a group of older people taking
photos and their faces told the
story – they were smiling and
laughing and they all wanted a
ride.’’
Eason said the Peace Train is
an amazing gift and he cannot
wait to take people for a ride
on it.
Yusuf Islam (previously
known as Cat Stevens)
gifted the miniature
train to Christchurch
attacks on the condition
it would run in a central
rides would be free for
No vehicle
access to
Ōtākaro
Avon River
Corridor for
whitebaiters
WHITEBAITERS will no longer
be allowed to drive vehicles
through the Ōtākaro Avon River
Corridor Regeneration Area to
access the river when the season
starts on September 1.
City council head of parks Andrew
Rutledge said whitebaiters
can still access the river, but will
need to walk from public roads to
their spots.
“The OARC is becoming increasingly
popular with recreational
users, and allowing vehicles to
operate inside the regeneration area
where people aren’t expecting them
creates health and safety
issues for everyone,” said Rutledge.
“While the vast majority of
whitebaiters have used the regeneration
area responsibly, last year
we received several complaints
of vehicles speeding in the area,
which increased the risks to dogwalkers,
cyclists and pedestrians.”
He said the regeneration area
needed to be a safe public space
for all users.
“As such, whitebaiters will always
be welcome to fish the river
during the season, but they’ll now
need to park on the road and walk
200m-300m to access their spot.”
Rutledge said whitebaiters can
still use their vehicles to access
the river where public roads run
along the river’s banks, such as
along Avonside Drive to Kerrs
Reach and Retreat Rd.
The previous landowners, Toitū
Te Whenua/Land Information
New Zealand, used to lease keys
to whitebaiters so they could use
their vehicles to access the river.
This would no longer happen,
Rutledge said.
The Department of
Conservation has also shortened
the 2022 whitebait season to
eight weeks, from September 1 to
October 30.
‘I don’t remember a lot about the
• By Susan Sandys
“IT WAS quite emotional really,”
said Kevin Burney of the day he
was able to return home.
“I didn’t think I was ever going
to; it didn’t look like the mending
process was moving fast.”
The 60-year-old suffered burns
to 70 per cent of his body, when
a metal drum he was using a
grinder on in his Darfield driveway
exploded in flames on April
2. He was rushed to Christchurch
in a critical condition, and airlifted
to Middlemore Hospital in
Auckland.
The first four weeks were in
intensive care, where doctors
said they had not seen burns as
severe since those they treated
from the deadly White Island
eruption. They did not know
whether Kevin would survive
as he battled for his life. One of
his lungs collapsed, he suffered
an infection, his heart stopped
during surgery.
Kevin’s family were overjoyed
when he made enough progress
to be taken out of intensive care,
moving to the hospital’s specialist
burns unit on April 30.
Kevin said he did not remember
anything from his time in
intensive care, apart form “very
vague memories of voices in the
background”.
Once in the burns unit, where
he spent eight weeks, he began to
focus on taking one day at a time.
“I didn’t think I was going
to die, the nurses and doctors
were very encouraging and very
supportive. But you didn’t want
to think too far ahead, because I
knew I was going to be there for
four months or something, you
don’t want to pin your hopes.”
Sometimes those hopes would
get dashed – it could feel like one
step forward and two steps back.
Skin graft surgeries would get
postponed as doctors deemed
he wasn’t quite ready, or other
patients took priority.
EXPLOSION: Kevin Burney remembers little of the
accident that happened while he was grinding this metal
drum. Now that he’s recovering, being able to sit up and
do Sudoku puzzles is something he enjoys.
PHOTOS: SUSAN SANDYS
Kevin is not sure exactly how
many skin graft surgeries he
had, he just knows it’s more
than five. The surgeries were
nine-hour marathons involving
three surgeons, where skin was
taken from unburned areas of
his tummy and buttocks, to be
grafted onto the burned areas of
his torso, arms, hands, and the
front and back of his thighs.
One time one of the hospital
staff “casually” asked if he had
a history of any heart trouble,
which he hadn’t, and told him
his heart had stopped during
surgery. They added reassuringly:
“Don’t worry about it though, we
have everyone there to help.”
Kevin said the healing process
after each skin graft was painful
to start with, but what he remembers
most is a “nasty itch” as it
healed. A radio was his constant
companion, going softly in the
background all day and all night.
day, just the drum going boom’
It was always tuned into the
Magic station, playing classic
hits of decades gone by, some of
which would motivate him to
move his hands and “boogie”
along to.
“Night times were so long,
because you had been napping
all day, you would find yourself
at one, two, three o’clock in
the morning just watching the
clock.”
One of his first goals had
been to talk again, especially to
wife Amanda, who was by his
side each day. A breathing tube
initially made speech impossible,
and when this was removed,
at first he could only talk in a
whisper.
“I was really desperate to tell
her I love her, because she was
telling me she loved me the
whole way through.”
Amanda remembers the moment
this was finally achieved.
“He did manage to say it,
I couldn’t understand him. I
thought about it – ‘Did you say
you love me very much?’ He nodded
his head,” Amanda said.
As he neared the end of his
stay at Middlemore, doctors took
him into surgery and removed
the last of an array of tubes, including
catheter and rectal tube.
“All of a sudden, at that point,
I felt free. I could get up and go
to the toilet, and move around,”
FAMILY: Amanda Burney and son Marcus are happy to
have husband and dad Kevin home at last.
Kevin said.
On June 28, he was transferred
back to Christchurch, and was
able to finally return home mid-
July.
Today he remembers little of
the accident itself. In trying to
mark the drum into three sections
for garden plant frames,
he accidentally cut through it.
The drum had been used to
store a cleaning chemical called
isopropyl at his workplace, and it
appears sparks from the grinder
ignited fumes.
“I don’t remember a lot about
the day, just the drum going
‘boom,’ seeing a flash of light.”
He also recalls trying to get
his shorts and T-shirt off as they
melted and stuck to his skin.
All the drama that followed
– of Amanda, son Marcus and
neighbours rushing to the scene,
using a garden hose to cool his
burns as he stood dazed and
naked on the decking along side
the driveway, talking to his rescuers
– are blissfully absent from
his memory.
He said he does not recall feeling
any pain, something common
with victims of deep burns
as nerve endings are destroyed.
He said he felt “pretty stupid”
about the accident itself, believing
in retrospect that he should
have known better than to use
a grinder on the drum, while its
lid was on.
Today Kevin wears a compression
suit and compression gloves,
as his burns and skin grafts continue
to heal. A physiotherapist
visits three times a week, focusing
on getting movement back, a
district nurse visits twice a week
to reapply dressings, while Kevin
visits hospital specialists once a
week.
Kevin and Amanda are planning
to fly to Perth in November,
with Marcus and daughter Ange,
to see their other son Eden and
meet their two grandchildren.
Kevin said while he had been
excited about the trip when it
But now that excitement had
returned, as doctors expected
his skin would be undergoing
significant healing in the next
three months.
Kevin is also looking forward
City councillors put on spot over
• By Chris Barclay
A CITY councillor has urged
colleagues not to rebel against
the Government’s housing
crisis solution – even if they
sympathise with a residents’
association campaign railing
against unfettered development.
The 16-member city council
and mayor Lianne Dalziel have
been lobbied to vote against
initiating government legislation
which effectively enables up to
three three-storey townhouses to
be built on sections throughout
Christchurch without resource
consent.
Councillors are set to consider
rubber stamping the measures
at a meeting on September 8,
but they were emailed an open
letter last week from a group of
16 residents’ associations asking
them to at least stall the process.
The Star approached the 16
city councillors on
their views regarding
housing intensification,
10 provided a response.
Those who did not
respond were mayoral
hopeful Phil Mauger,
Deputy Mayor Andrew
Turner, Celeste
Donovan, Anne
Galloway, Melanie
Coker and Catherine Chu.
Dalziel, who is not seeking
McLellan
RISING: The Seaview Townhouses being built on the ‘Old School’ site in New Brighton.
a fourth term in October,
expressed her concerns at a
select committee last November
before the legislation was
passed, and agreed with
the residents’ associations
sentiment.
“I’ll be responding to
them with advice we are
receiving about the legal
ramifications of what they
are proposing,” she said.
Any resistance
appears futile, with the
Government able to enforce
the new measures, a point
emphasised by Jake McLellan.
He warned fellow city
councillors not to jeopardise the
opportunity to tailor the
legislation by giving the
Government cause to
apply default settings.
“The Government
has set up a framework
that comes into effect
whether we like it or
not,” he said.
“What we have
the power to do
is to basically apply it to
Christchurch. Yes, the law is
Aaron
Keown
the law but you’re able to say:
‘Here are some special character
areas we think should be
worthy of having a special
dispensation’.
“It wouldn’t be a good
idea not to vote for it given
it is actually softening the
Government’s plan.”
Aaron Keown queried
why some councillors
could be opposed to
the policy. “You’ve got
a number who are hard
core in favour of walking, biking
and public transport and yet
they’re not into intensification.
Just a wee word for the wise, one
doesn’t work without the other,”
he said.
“Intensification is certainly
better for the environment,
businesses, people’s time
management and for
affordability of housing.
It’s just got to be done with
neighbourhoods, not to
neighbourhoods.”
Other councillors contacted by
The Star would not reveal how
they would vote.
Sara Templeton said urban
intensification was essential for
all New Zealand cities to address
housing affordability,
climate
change, and to
protect productive
soils.
“The reality is
we are obliged
to implement
the Government
direction on this
and if we don’t
Sara
Templeton
approve the current proposal,
then default settings may apply,”
she said.
“This could mean
intensification everywhere across
the city without the qualifying
matters, such as natural hazards
or character areas that we have
identified, being able to be
excluded.”
The remainder of the
councillors who replied to
The Star had issues with the
Government’s remedy.
“I’d favour planning regulations
being further relaxed in the CBD
to incentivise higher density
development there, however,
residents have
chosen to live
in suburban
areas, specifically
because they do
not want a high
density style of
living. This is
centralisation
gone mad,” said
James Gough.
Sam MacDonald agreed: “This
will destroy suburbs and it’s
counter-intuitive to our goal of
increasing density and the population
of the CBD.”
Yani Johanson
was “deeply
concerned”
about loss of
sunlight, privacy,
and amenity,
such as trees and
greenery, and did
not agree with
Christchurch being
subject to the
same measures as Auckland and
Wellington.
“Christchurch already has
plenty of land zoned for housing,
and plenty of capacity for higher
density due to land use planning
he
said.
“Housing
affordability
dictates we can’t
deny the need
for housing
the key concern
is how it is
implemented,”
Tim
Scandrett
said Tim Scandrett who was still
pondering which way to vote next
month.
Mike Davidson did not think
the Government’s one-size-fits-all
approach was
appropriate.
“A more
bespoke
solution
developed with
council would
have created a
better outcome
for the city,” he
said.
“Infill housing needs to be
focused in areas that have
good public transport and
walkable amenities. Increasing
housing density also needs to be
accompanied with better tree
protection, increased tree canopy
and green spaces.”
Pauline Cotter said the
legislation was appropriate
around
shopping
centres with
good transport
connections
and the CBD,
but should
not be applied
“carte blanche”
across the city,
especially when
Pauline
Cotter
the council is trying to attract
people to live inside the CBD.
“I’m actually worried about the
housing market being flooded
and being left with lots of vacant
tiny units where once there were
trees and gardens.”
Jimmy Chen echoed widely
held fears.
“Residents who live on
small parcels of land need
special consideration to
prevent intensification which
will destroy their amenity, access
to light, sunlight and gardens,”
he said.
A REDCLIFFS man has failed
in his latest bid to make the
Crown pay for damage to his
land during the earthquakes
and fix the cliff wall that still
threatens his property.
In a judgement given by
Justice Kós this week, Kós said
Steven Young had owned the
land since 1979 and spent about
35 years developing it.
When the February 22, 2011,
quake struck, more than 30,000
tonnes of rock and debris fell
from the cliffs behind him,
deeming three of five dwellings
uninhabitable.
Though the neighbouring
cliff-top properties were
acquired by the Crown soon
after they were red-zoned,
Young rejected all offers to buy
his land, even though it was
red-zoned for the continued
cliff instability. In 2017, Young
Antarctic artefacts on their way home
TWO HISTORIC Antarctic
artefacts are on their way home
after more than 60 years and a
trip around the globe.
The box of cocoa tins and a
Shell motor spirits box is an
unlikely pairing, but one of
Antarctic significance.
The items, which were
both crucial supplies on the
expeditions during the heroic
age of Antarctic exploration, are
now in the hands of Antarctic
Heritage Trust in Christchurch,
thanks to former United
States naval captain Dave
Baker.
“With the Antarctic Treaty
now in place and the excellent
work of the trust caring for
these expedition bases, I was
comfortable in returning the
items knowing that they will
be preserved for posterity,” said
Baker.
Trust conservation collections
manager Lizzie Meek said
it is always an exciting day
when items are returned to the
organisation.
“We know there are still some
artefacts out there that were
collected from Antarctica during
some of the early 1940s-60s
missions . . . We always welcome
their return, and have a careful
process for ensuring they are
conserved and then located back
to the expedition bases,” she said.
The trust cares for five
expedition bases in Antarctica,
including those of famous
explorers Sir Ernest Shackleton
and Captain Robert Falcon Scott.
It was when trapped outside in
a storm in Antarctica during his
voluntary service in 1956
that Baker’s story crossed paths
with those of Shackleton and
Scott.
Baker had volunteered to
become a member of a rescue
team (naval parachutists, 30 dogs
and three dog handlers) to be
stationed at McMurdo Base from
December 1955-7.
“Our team made a trip across
the sea ice from McMurdo to
Cape Evans. It was intended to
be an overnight trip, returning to
the navy’s base at Hut Point the
following day,” said Baker.
However, the wind picked
up, forcing the team to hunker
down in their tents. On day
three, Baker and his teammates
decided to investigate the
interior of Scott’s Hut ‘partly out
of curiosity and because they
might have to shelter there if the
storm continued much longer’.
They pried open a window to
catch a glimpse into a moment
frozen in time.
“Below and in front of me was
a long table. It appeared to have
been recently used, as there were
cups, some with frozen cocoa
in them. Someone unfamiliar
with the hut’s history might have
assumed that the occupants
had stepped out to return any
minute,” he said.
The moment Baker refers to
was the rescue of Shackleton’s
Ross Sea Party in 1917, who
boarded their ship the Aurora,
leaving everything as it was
found almost 40 years later.
Baker and his rescue team,
deeming the hut a ‘sacred space’,
left the scene as they found it.
However, while looking for food
stores outside the hut, Baker
found the case of Fry’s cocoa and
a wooden box, labelled ‘Shell
Motor Spirits & Scott’s Antarctic
Expedition 1910’.
Baker was inspired to return
the artefacts to the Antarctic
Heritage Trust.
“They belong to Captain Scott,
Sir Ernest Shackleton and polar
history, so they needed to go
home,” he said.
Over the last 60 years he has
used them as exhibits in lectures,
speaking to tens of thousands
of people, sharing his Antarctic
experience with people.
The artefacts will travel
back to Scott’s Antarctic hut
at Cape Evans with the Trust’s
conservation team who return
this season for their annual
monitoring and maintenance
programme.
Sex worker killer faces deportation
• By Kurt Bayer
A “COLD-BLOODED killer” who
violently strangled a sex worker to death
will be deported back to South Africa on
his release from prison.
Jule Patrick Burns, now aged 47,
continues to deny murdering Susan ‘Suzie’
Sutherland more than 17 years after her
brutal slaying, it can be revealed.
Burns was jailed for life with a
minimum non-parole period of 17 years
in what was, at the time, one of New
Zealand’s longest sentences.
He picked up 36-year-old Sutherland
for sex from the city’s red-light district of
Manchester St in April 2005, drove her
to a vacant inner-city section in the dark,
and strangled her in an attack described
by an expert as among the most violent he
had seen.
Now, the NZ Herald has revealed the
South African-born immigrant appeared
before the Parole Board for the first time
earlier this year.
However, even though the board noted
that Burns will be deported to South
Africa upon his release from jail, his first
bid for release was declined.
The Parole Board said, in a May
judgement obtained by the Herald,
that although it did not have detailed
information about the “extremely violent
strangulation”, they noted that Burns has,
and still does, deny the offending.
When Burns first came to prison, there
were “a number of aggressive incidents”
behind bars, but had generally got more
positive reports, the board heard.
They were told that Burns can appear
“entitled” and that he thought he had been
treated unfairly.
He has filed a number of unsuccessful
challenges to his conviction.
Burns, assessed as low risk of
reoffending, wants to be released to family
in South Africa, the board heard.
But a planned “whānau hui” was
unable to be fully completed because of
“connections problems”.
“We think it vital that does take place,
so that at least his family in South Africa
where, ultimately, he is likely to be
released to, will be aware of his offending
and the facts that gave rise to a conviction
for murder,” the Parole Board decision
says.
“In the meantime, from our perspective,
although a low risk he remains an undue
risk given his conviction for murder and
our inability to fully understand the
circumstances of the killing, what drove it,
and what the background issues were and
therefore fully understand his risk and
what rehabilitation might be required to
address that risk.”
Burns will come back before the Parole
Board in December.
When Burns was sentenced at the
Christchurch High Court in April 2006,
Justice John Hansen was convinced
Sutherland’s killing justified the extended
minimum non-parole period, which
can be imposed for murders with a high
degree of brutality, cruelty, callousness
or depravity, or where the victim is
considered vulnerable.
The sentence was praised by the
Prostitutes Collective as a strong deterrent
to anyone with a desire to hurt a sex
worker.
The judge said he could not ignore
the evidence of experienced forensic
pathologist Dr Martin Sage, who said
the violence used was at the top end of
the scale.
“It spoke volumes of the force and
strength you used,” Justice Hansen told
Burns.
The evidence of people who overheard
the attack from their beds was “graphic as
to Ms Sutherland’s last moments”, while
Crown prosecutor Phil Shamy said it was
apt to describe Burns as a “cold-blooded
killer”.
“This woman was little in stature and
didn’t stand a chance against this man
who was standing over her. She was
particularly vulnerable, as all prostitutes
who work on the street are to this type of
offending,” Shamy said.
Christchurch pimp Kane Wayman, who
died after an alleged assault at a Mongols
MC gang pad last New Year’s Day, which
is subject to an ongoing murder trial at
the Christchurch High Court, was a key
witness during Burns’ trial.
Wayman, the court heard, had been
acting as a minder for another sex
worker on Manchester St that night
and saw Sutherland get into a white
Honda Prelude – the same car that Burns
owned.
Rapist, murderer fails to get off prison charges
• By Tina Grumball
A CONVICTED murderer and
rapist has failed in his second
appeal to get his charges for
breaking prison rules reviewed.
Richard Lyall Genge was
imprisoned for a minimum
non-parole period of 15 years
after the fatal attack of 22-yearold
Anne Maree Ellens in 1994.
Genge and two others raped
her before beating her to death
at Christchurch East School.
Since he was jailed for Ellens’
murder, Genge has frequently
taken the justice system to court
over perceived grievances.
The most recent appeal relates
to two disciplinary charges for
breaches of prison rules, one of
which was for sparring and the
other for refusing to go back to
his cell. Visiting justices found
the charges proven, and Genge’s
first appeal was dismissed by
Justice Gendall last year.
Genge then appealed
this judgement in front of
Justice Courtney, Justice
Collins, and Court of Appeal
president Justice Cooper.
In the decision given by
Courtney this month, she stated
the sparring charge related to
an incident in April, 2017, a year
after Genge had signed a form
acknowledging the existence
of a zero-tolerance for violence
rule.
Corrections officers at
Christchurch Men’s Prison
observed Genge throwing
punches at another prisoner
who was wearing jandals on
each hand and moving his head
as if to avoid blows.
Genge was charged with
misconduct for failing to comply
with the zero-tolerance policy.
Though Genge argued
they were engaged in pads’
training – exercising, not
sparring – Courtney said they
were satisfied the definition of
sparring included making the
motions of boxing as well as
boxing itself.
Any ambiguity about the
sparring rule or unfairness
in charging Genge was also
rejected.
The cell decision relates to an
incident in July, 2019, when the
upper level of the centre unit at
Invercargill Prison lost power
and prisoners refused to go back
to their cells when they were
told to lockdown for the night.
Many of the inmates did
slowly return to their cells as
more staff arrived and warnings
were given, but Genge took the
long way back, stopping along
the way, and waiting outside of
his cell until an officer directly
told him to enter.
He was charged with failing to
obey an order.
Genge argued he had been
blocked by other prisoners, but
CCTV footage showed he was
not blocked and could have
taken a shorter route, Courtney
said.
The justices also rejected
claims Genge had not been
personally asked to return, he
had been unfairly charged, and
the lack of power was in breach
of United Nations minimum
standard for the treatment of
prisoners.
Both appeals for a judicial
review of Gendall’s 2021
decision were also dismissed.
CONVICTED: Richard Lyall
Genge was jailed for life after
the fatal attack on Anne
Judge quits controversial Dubai job
• By Kurt Bayer
A RETIRED Christchurch judge
appointed to a Dubai role quietly
resigned just weeks into the job
after mounting pressure from
human rights campaigners.
Sir William Young, a former
Supreme Court judge who
led the Royal Commission
of Inquiry into the March
15, 2019, Christchurch terror
attack, stepped down less than
a fortnight after joining Dubai’s
international financial court.
Two Irish judges virtually
sworn in alongside Young on July
27 to the Dubai International
Financial Centre (DIFC) Courts
– the republic’s former chief
justice, Frank Clarke and former
High Court president Peter Kelly
– resigned after pressure from a
leading politician who said their
appointments were part of a
“deliberate strategy by . . . [the]
regime to use respected former
judges as a way to legitimise it”.
Amnesty International claims
the United Arab Emirates
Government continues to
commit serious human rights
violations, including its courts
passing death sentences. Young,
70, who retired from the bench
of the Supreme Court earlier this
year after 25 years as a judge, had
been listed on the DIFC’s website
as one of its judges, alongside
high-profile figures from
England and Wales, Scotland,
Australia, Malaysia and the
UAE.
But his photograph and details
have vanished from the site.
After inquiries from the
Herald, Young confirmed he has
stepped down. He said he was
first approached to consider the
position late last year.
Young said he was pleased
to accept the appointment,
believing that the DIFC
Courts played a valuable role
in providing “independent,
impartial and efficient resolution
of commercial disputes for those
who seek redress through them”.
“They are credited with
providing a stable legal
environment, and predictable
outcomes, in which business can
be done. Impartial and efficient
adjudication of commercial
disputes is in the public interest
wherever it occurs,” Young said.
However, criticism over the
appointments of the Irish judges
and the “concerns that underlie
that criticism” made Young
rethink his decision, he said.
“Underlying the criticisms are
issues of perception: How sitting
as a judge on the DIFC Courts
may be seen by others. As an
acting judge in New Zealand, I
concluded that I could not brush
aside the possibility of such
adverse perceptions and any
controversy they may lead to,”
he said.
“I therefore decided to resign
from the DIFC Courts and did
so by email to the chief justice of
the DFIC Courts on August 9.”
The resignation was received
with “polite regret”, he said.
New Zealand’s chief justice
approved Young holding office
as a judge of the DIFC Courts
pursuant to section 142(2) Senior
Courts Act 2016.
Section 142(2) of the Senior
Courts Act provides that if a
judge is to hold any other office,
it must be with the approval of
the chief justice who must be
satisfied that holding such office
is consistent with the judge’s
judicial office in New Zealand.
The chief justice’s assessment
was that the appointment was
consistent with judicial office.
Human rights activist and
retired Irish barrister Bill
Shipsey, who has been outspoken
in criticising judges for signing
up to the Dubai jobs, praised
Young for making a “courageous
decision” to step down.
Shipsey wrote in the Irish
Times earlier this month, asking
“what were they thinking” given
what he calls Dubai’s “appalling
human rights record and the
conduct of their appointer, the
ruler of Dubai, Mohammed Al
Maktoum”.
Within four days of his
column, both Irish judges had
resigned.
When he stepped down, Kelly
said in a statement: “I have
decided to resign from the Court
of Appeal of the DIFC since, as a
private citizen, I do not want this
controversy to disrupt my future
time in retirement.”
The DIFC is yet to make any
public comments around the
resignations.
The appointment of highprofile
respected judges has been
branded “judge washing”, which
has been likened to “sports
washing” – a term popularised
by Amnesty International to
describe the use of sports by
oppressive governments to
legitimise their regimes and
distract from their human rights
abuses. It includes the LIV Golf
tour – an upstart league backed
by the Saudi Government to
compete with the established
PGA Tour by attracting top
players with prize purses worth
tens of millions.
The NZ Herald understands
the Dubai court has been
reluctant to share the oath that
the judges are required to take.
And it’s not known how much
the judges are being paid.
Young, who graduated
from Canterbury University
in 1974 and later gained a
doctorate from Cambridge
University, was appointed a
Queen’s Counsel in 1991. He
was made a High Court judge in
1997 before the Court of Appeal
before becoming a judge of the
Supreme Court in 2010.
Bromley woman wins
battle with city council
• By Jean Edwards
A BROMLEY woman has won a
battle with the city council over
the cost of two air purifiers she
bought to cope with the stench
from the burnt-out wastewater
treatment plant nearby.
Vickie Walker
said she was
doing a “little
happy dance on
the inside” after
the city council
Vickie
Walker
backed down
and agreed to
reimburse her
$695 ahead of
a Disputes Tribunal hearing
scheduled for tomorrow.
Walker owns two air purifiers
bought since the rotten stench
emerged earlier this year to
help her manage headaches and
nausea caused by months of
exposure to sulphurous gases.
The units also helped Walker
control the smell while sick at
home with Covid-19 and in
isolation from her husband, who
has a lung disease.
Walker said the city council
was not legally obliged to foot
the bill but staff had shown
some heart and apologised.
“It would look pretty
inhumane to say no to me with
everything that’s happened.
I think they’ve used a wee bit
of humanity and ignored the
legality, which is nice,” she said.
“I really needed the air
purifiers because I had the smell
of s*** in my house and I just
couldn’t stand it.”
Walker said the city council
initially refused her claim
on the grounds it would set a
precedent, but had since taken
her unique circumstances into
account.
That included acknowledging
an accumulation of odour issues
from both the wastewater and
nearby composting plant, her
home’s proximity to them, the
effect of the stench on shop
fabrics stored at home and
evidence of her expenditure,
Walker said.
She said she was still using
the air purifiers to manage the
smell and hoped her win would
encourage others with a strong
case to make a claim.
“It’s up to people now to
make a stand, if they feel strong
enough, they should go ahead,”
she said.
City council infrastructure,
planning and regulatory
services general manager Jane
Davis said staff had agreed to
reimburse Walker because of
her special situation.
Sumner landmark back on market
Fighting against the Government’s
Tony Simons spent 26
years with the New
Zealand Broadcasting
School and once that
career wound down
he found new voice,
articulating widespread
community concerns
about the Government’s
housing intensification
policies. Chris Barclay
reports
TONY SIMONS wanders down
memory lane on Harakeke
St, Riccarton, and pauses to
reminisce about how much has
changed – and not for the better,
in his estimation.
The majestic magnolia
dominating the front yard at
No.16 has been felled, the pre-
World War 2 era house it shaded
demolished to accommodate
what Simons’ cuttingly describes
as yet another a “sausage flat”
development. A productionline
of six duplex townhouses
running from front to back on
the section, all of which have
been sold.
Simons, who lives nearby on
the fringes of Riccarton Bush,
bristles at the term NIMBY
(Not in My Backyard), with
one exception: he is happy to
post on the NIMBY Nature in
my Backyard – Christchurch
Facebook page.
The charity organisation is
dedicated to creating a better
Christchurch by growing and
protecting trees and natural
spaces for a healthier and
more climate-ready urban
environment.
Until recently, social media was
his platform to express concern
at housing intensification in
the suburb he has called home
for more than 14 years since
relocating from Burnside, where
he still plays social grade tennis.
Last Thursday he posted
before and after images of the
treeless property on Harakeke
St, lamenting: “We have another
insight into what Christchurch
will look like in the future (except
they’ll be three storeys instead of
two).”
About 24 hours earlier he
emailed city councillors and
mayor Lianne Dalziel, urging
them to resist the Government’s
solution to the housing crisis
– legislation which effectively
allows the construction of three
townhouses of up to three storeys
on almost all residential sites in
the city.
Simons distributed the open
letter on behalf of 15 residents’
associations, though he and
the councillors are aware the
Government can push ahead
with a policy also backed by
National.
A 16th, the St Albans Residents’
Association, has subsequently
joined the campaign.
Simons, a former head of
the ARA-based New Zealand
Broadcasting School, has chaired
the Riccarton Bush-Kilmarnock
Residents’ Association for
five years, an organisation
established in 1996 to safeguard
the area from another form of
intensification.
Residents were concerned
commercial development could
expand north towards the bush
and its dense stand of kahikatea,
an enclave gifted to the city by
the Deans family in 1914.
“As it happens, it hasn’t really
done that because Westfield has
become the centre of commercial
development,” Simons said.
and under this policy buildings
can go 15 or 20 storeys high.
It’s pretty dramatic what’s been
proposed.”
Simons, who
ended his stint
with the NZBC
as part-time head
of professional
placements in
Tony
Simons
July, has been
focused on housing
intensification
since he studied
the implications
of a 2021 amendment to The
Resource Management Act and
the National Policy Statement on
Urban Development.
“The catalyst was in July when
we (residents’ associations)
realised the entire city was going
to be three storeys, that gelled us
into action,” he said, adding he
was still coming to grips with the
issue.
“I’m still learning, every time I
look at the council maps I think
I understand what’s happening,
and then I think ‘I don’t know if
I’ve got that right’.
“It’s very difficult for an
average person to understand.
They might know what zone
they’re in, but they don’t
necessarily know what that
means.
“When someone is within
walking distance of a town
centre, that means something. It
means you are in a zone which
can have six storey buildings
around you. Most people don’t
know that.”
Simons pointed out the
residents’ associations
attached to the open letter
don’t necessarily object to
intensification if, when and
where it was warranted but: “We
definitely object to the way it’s
being enforced on everybody.
“We suddenly realised it’s
going to happen next month
and we wanted councillors to be
aware they can say ‘no’ if they
want to.”
Councillors can decide to
effectively rubber stamp the
legislation at a council meeting
on September 8, although many
have expressed reservations.
The residents’ association urge
councillors and Dalziel to resist
on principle.
“This is a point of action rather
than words,” said Simons, who
admitted he had not had any
definitive support following
the email, just the occasional
acknowledgement.
Simons is obviously concerned
about what lies close to his
HOUSING: A recent development at 8 Peverel St, Riccarton.
backyard.
“Over the last 20 years there’s
already been intensification
around Riccarton Bush as
properties get broken up and
houses get built on the back,” he
said.
“Every time a tree gets cut
down that’s one less tree for
the birds to meet on. You’ve
got a bush that’s supposedly
sacrosanct, but we’re quite happy
to chop down every tree in the
suburbs around it.”
Yet, while intent on protecting
his own environment, Simons
also fears for the Garden City
outside the 8011 postcode.
“We’re trying to protect
liveability, amenity, privacy, trees
. . . we’re trying to protect our
‘Perversely, we argue against sprawl but by intensifying
the city we actually encourage it’ – Tony Simons
greenfields out in the suburbs as
well,” he said.
“We’ve got residents’
associations from all over
Christchurch. This is not a
Fendalton, Merivale thing. This
is Somerfield, this is Hornby, this
is Westmoreland . . . Dallington.
“They’ve all agreed the
Government has no place
imposing urban planning
rules on city councils, who are
supposed to be making these
decisions themselves.”
When asked, Simons said he
had no intention of selling his
property to a developer, though
he considered it a fair question.
“No, but it’s hard not to think
about,” he said.
“I don’t think there would be a
person in Christchurch who isn’t
thinking: ‘What would I do if
the place next door was suddenly
four or five or six storeys?’.
“Some people would say:
‘It wouldn’t worry me’. But if
people do decide to move, if we
force people to flee the suburbs
because of the intensification
going on around them, where are
they going to go?” Simons said,
before answering his own query.
“Where they’re going to go is
Lincoln or Prebbleton, or Ohoka.
That’s exactly what we don’t want
happening because we’re trying
to save that farm land, we’re
trying to preserve it.
“Perversely, we argue against
sprawl but by intensifying the
city we actually encourage it. A
lot more thought should have
gone into this before someone in
Wellington drafted this policy.”
24 Hour Swim
500KM:
City council
lifeguard
supervisor
Martin Martinez
D’Orso has
organised the
challenge, to
raise money for
St John.
A TEAM of lifeguards is
planning to raise funds for
St John by swimming 500
kilometres – slightly more
than the distance between
Christchurch and Queenstown –
in just 24 hours.
The 24-Hour Swim Challenge
is the initiative of city council
lifeguard supervisor Martin Martinez
D’Orso, who has organised
similar events in Queenstown.
City council lifeguards will
spearhead the challenge, which
will take place from midday
Saturday, September 3 until midday
Sunday, September 4 at the
Graham Condon Recreation and
Sport Centre, in Papanui.
A number of groups that regularly
use the pools have also been
invited to participate.
The pool will be open for
general public admission, but a
couple of lanes will be set aside
specifically for swimmers taking
part in the challenge.
“Anyone can participate in the
challenge and there’s no minimum
amount of laps that you
need to complete. Every lap that
is swam will get us a step closer
to our goal of swimming at least
20,000 laps of the pool – or about
500 kilometres – in 24 hours,’’
Martinez D’Orso said.
Overnight, it will be up to
Martinez D’Orso and the other
lifeguards to keep the challenge
on track by taking turns swimming
laps of the pool.
People can support the
24-Hour Swim Challenge by
donating money through the
Givealittle page that has been set
up or by coming along on the day
and making a cash donation.
“Our goal is to raise $5000 to
support Hato Hone St John South
Island because as lifeguards we
really value the life-saving work
they do. They are always there to
help,’’ Martinez D’Orso said.
Maddie’s claim settled
in 21 days – ACC
• By Tina Grumball
ACC SAYS it settled the
treatment injury claim for
Maddie Collins’ medical snafu
in just three weeks.
Last week, The Star reported
on the progress of Maddie’s
struggles with infected pieces
of plastic left inside of her, after
initial surgery to have her peritoneal
dialysis catheter removed
in August last year so she could
continue dialysis at home.
Maddie had to return to
Christchurch Hospital twice to
have the infected pieces surgically
taken out, with both infections
leaving her feeling anaemic
and “really unwell”.
Diagnosed with nephrotic
syndrome, kidney disease, in
2008, Maddie did not respond
to the typical treatment and so
her kidneys were removed so she
could receive new ones.
However, her body rejected a
first transplant from her father
in 2012, and a second “miracle”
transplant in 2018, leaving her,
currently, with no kidneys.
After the most recent surgery
to remove the second piece of
tubing, Maddie’s mother and
full-time carer, Sarah Manson
KIDNEY DISEASE: Maddie Collins has undergone countless
surgeries in her 18 years.
said their treatment injury claim
to ACC “took weeks and plenty
of emails from us”.
ACC deputy chief executive
service delivery Phil Riley said
the claim was lodged on April
14 and was accepted on May 5, a
total of 21 days.
“For claims lodged in 2017 to
2021, the average time to reach
a cover decision on these claims
has been 57 days,” he said.
“Assessing these claims can
be quite complex and clinical
experts need to assess medical
evidence from treatment
providers to identify the link
between the treatment and the
injury.”
A treatment injury is a “physical
injury caused as a result of
seeking or receiving medical
treatment from a registered
health professional”.
To fulfil the criteria, there
must be a clear casual link between
treatment and the person’s
injury and cannot be a necessary
part or ordinary consequence of
the treatment.
Last year, ACC received 17,953
treatment injury claims, and
have received 11,306 this year
to date.
DECISIONS ABOUT housing
developments don’t just affect
neighbours, but generations of
residents to come.
So there is a need for more
(affordable) housing, but it is
encumbent on this generation to
ensure they’re not future slums,
cells for the troubled, underprivileged
and under-stimulated.
What is proliferating now is
largely aesthetically unacceptable,
depressing in appearance,
and too small for families.
Let’s all ask for a major
slowdown of the same-same,
featureless, mulit-storeyed
white plaster boxes with token
brown or black board, and
WE LOOK back not to blame,
but to understand. These are the
words I used when speaking at
the book launch of A Decade of
Disaster Experiences in Ōtautahi
Christchurch.
This is an incredibly significant
book about our disaster
experience, because it engages a
range of critical disaster studies
perspectives.
From the opening chapter on
the critical studies imperative
through to the concluding reflections
– making social choices in
turbulent times – we are asked
to reflect on the events that occurred,
the order of priorities
that were chosen and how decisions
were made.
It is an important contribution
to the literature that will inform
best practice for the future. I
recall the despairing message
given by one of the speakers at
the International Speakers Series
– an important component of
the city council’s extraordinary
insist on a little beauty by way
of architectural detail, larger
room sizes, interesting claddings,
colours, retention of large trees
and curved paths and driveways,
to enhance pride and privacy in
our suburbs.
Make no bones about it; no
MPs (Labour, National or Green,
who voted to stifle the country
with sausage housing) nor the
developers and builders of same,
will ever have to live in, or beside
them. It’s up to us NIMBYs
(Not In My Back Yard) via our
residents’ associations, to speak
for future Christchurch.
Share an Idea campaign – that
importance of Share an Idea and
the imposition of the blueprint
that followed.
Learning lessons is an
important part of our shared
The Star article (August 11)
about Sam MacDonald choosing
to stay in local government over
other possibilities also mentions
one of his challengers to the Waimairi
List.
Although List identifies as
Independent, it mentions he has
worked for the Greens and The
People’s Choice. This leads one to
ask if anyone is truly independent?
All candidates will offer
a brighter, better future for
Christchurch, but what does that
mean? For one it could mean all
roads are turned into cycleways
and for another it could mean
responsibility post-disaster. But,
most importantly, we need to
ensure the lessons we learn from
our experience are embedded
into future practice so we don’t
make the same mistakes again
and again.
We often learn more from
the things we get wrong, as the
things we do well.
This is a timely book and
will be of considerable interest
to community members and
academics alike. A big congratulations
to the contributors and
editors, especially Bruce Glavovic,
who I met after the February
Housing choices need to consider future generations
something entirely different.
Therefore we need to find out
how they voted on issues that
concern us (CCC will give this
information on request) and for
new candidates, ask direct, practical
questions, and expect direct
answers.
Local council decisions have
an enormous effect on our life,
from roading, waste management,
housing intensification,
sporting facilities and more. I
think we all need to be more
engaged before we end up with a
city that serves the Government
and not the people that live here.
Student creates low-cost ‘green’ building product
A CHRISTCHURCH-based
international student has
come up with what could be a
two-pronged ‘green’ solution
to problems facing the New
Zealand building industry –
namely carbon emissions and a
critical shortage of Gib board.
Andy (Minhong) Park, 21,
arrived here from South Korea
to complete his Bachelor of
Product Design at Canterbury
University. While studying, he
recognised the significant impact
the building industry was having
on the environment – currently
contributing 20 per cent of the
country’s carbon emissions.
So, as part of his final-year
project, he experimented with a
low-cost plasterboard alternative,
which resulted in the development
of a biocomposite wall panel
that uses algae – or seaweed
– as a bio-filler.
As well as helping the building
industry reduce its footprint
through recyclable components,
in comparison to traditional
gypsum-board seaweed plasterboard
requires significantly less
energy to manufacture, further
reducing its environmental
impact.
Andy explains: “Seaweed is
fast growing at 0.5 metres per
day and is capable of sequestering
around 173 million metric
tons of carbon annually. It’s
easy to cultivate and can be
farmed offshore, not competing
for farmable land with other
bio-based materials, making it
an attractive, low-cost farming
commodity.
“Because seaweed can absorb
carbon underwater, large wallpanel
manufacturers could
employ seaweed farming as a
carbon offset by growing it,” he
adds.
An ability to control moisture
also means seaweed bio-filler
contributes to warmer, drier, safer
homes, and preliminary testing
indicates fire performance at
the level of commercially available
products.
“Seaweed has been proven to
reduce ignition risks, increase
flame retardancy, and promote
auto-extinguishing behaviour of
seaweed-based composite systems
because it contains boron,
a natural fire retardant,” Andy
says.
“Seaweed is also recognised
for its ability to absorb and
release moisture and is a greener
alternative to traditional passive
fire-protection materials due to
the absence of non-recyclable
elements. This also makes it
able to be recycled and used as a
fertiliser.”
The finished seaweed plasterboard
product has a glossy
marble surface, coloured green,
red or brown depending on the
type of seaweed used.
Andy’s eco alternative to
recognised in the UC innovation
jumpstart greatest commercial
potential award, winning him
Football silverware still on the line
• By Chris Barclay
CASHMERE Technical ended
Christchurch United’s quest to
complete the Southern League
undefeated, leaving the trophy
up for grabs this weekend
between the two dominant
teams.
United thrashed Cashmere
Technical 4-1 in their first meeting
back in May, but a 1-0 defeat
at Garrick Memorial Park means
they missed an opportunity to
claim the silverware last Saturday.
Instead, Cashmere Technical
seem to be in the box seat with
a positive goal difference of +6
over United, who host cellar
dwelling Mosgiel AFC, a clash
that gives Cashmere Technical
coach Dan Schwarz some cause
for concern.
“I don’t want to speak ill of
Mosgiel but they’ve had some
hidings this year,” said Schwarz,
who watched his side score 19 in
two outings against the Dunedin
side.
United beat Mosgiel 4-0 in
May, but Schwartz reckoned they
could more than double that
margin.
“I wouldn’t write them off
yet. They could definitely get
double figures against Mos,”
said Schwarz, whose squad faces
fourth-ranked
Dunedin City
Royals away, a
team they beat
4-2 in May.
Cashmere
Technical and
Christchurch
United nailed
National
Dan Schwarz
League spots
with ease, with
the rivals only losing a game
apiece so far.
“It’s not a bad run for both
teams and it makes it exciting
for the final game as well,” said
Schwarz.
Other than thwarting United’s
unbeaten campaign, Cashmere
Technical were also motivated to
retain the Hurley Shield.
Christchurch football’s equivalent
of the Ranfurly Shield goes
on the line when the holder hosts
games.
scoring in the Southern League’s top of the table clash
with Christchurch United.
PHOTO: JIM WATTS PHOTOGRAPHY
in the domestic competition was
another carrot for Cashmere
Technical if they keep United at
bay.
“I think we get more home
games when the National League
draw comes out so it’s not
just bragging rights at stake,”
Schwarz said.
He said beating United was
among the highlights of a season
which also saw Cashmere
Technical win the delayed 2021
Chatham Cup.
“United are a very, very good
team and it was quite a tense
spectacle,” he said.
Cashmere Technical ended
the contest with nine players
after Cory Vickers and Lachie
McIsaac were red carded in the
76th and 81st minutes respectively
for late tackles.
Vickers was still in credit with
the coach after heading in the
winning goal early in the second
half – the defensive midfielder
had entered the fray as a fourthminute
replacement for Fraser
Angus, who suffered a seasonending
knee injury.
“Cory came on and did a
reasonable job until he got sent
off. When we signed him (from
Auckland’s Eastern Suburbs) we
knew he’d bring a bit of feistiness.
It was a hell of a goal, so I
still call him the hero of the day.”
While Vickers received a
straight red, McIsaac departed
after his second yellow card,
both players warranting the
punishment.
“It was a definite red, they both
were. The referee was excellent,
he got all the big decisions right,”
said Schwarz.
At the other end of the table,
Selwyn United’s anxiety levels
eased after a 3-1 victory over
Ferrymead Bays lifted them two
points clear of Mosgiel ahead of
their trip to Nelson Suburbs.
With the game scheduled for
Sunday they will know if they
have avoided relegation – if Mosgiel
lose – or whether they need a
point to preserve their Southern
League status.
premier league treble in dramatic
circumstances, keeping
their nerve after Marist forced a
penalty shootout with a last gasp
equaliser.
Marist gave themselves a
chance of a maiden title at Nga
Puna Wai on Saturday when
Emily Baker hit the target with
the last play of regulation from
a well-worked penalty corner to
level the contest at 2-2.
However, Harewood’s
championship qualities
ultimately came to the fore as
they refocused and claimed the
shootout 4-2 to consign Marist
to runners-up status for a second
successive year.
Harewood head coach Matt
Ling praised a new-look squad
who emulated their predecessors
by winning when it mattered
most.
Bella Ambrosius, Breana
Catley, Charlotte Lee and
Georgie McKay Stewart scored
for Harewood, while goalkeeper
Sandy Mitchell – a key off-season
acquisition – saved one shot and
forced another Marist player to
shoot wide.
Ling said this title was the
most satisfying due to the personnel
changes from 2021.
“This one is a little bit sweeter.
It wasn’t as expected as previous
years. It took us a little bit longer
to get our processes in place in
pool play with a reasonably new
team,” Ling said.
“We lost six players at the start
of the season, some of them
were just outside or had made
the Black Sticks so they were key
players for us.
“We had to bring up a few
div one players, the only out-oftowner
we brought in was our
goalkeeper.”
Harewood were unbeaten last
season but were third at the end
of the regular season so they had
to beat HSOB/Burnside and top
qualifiers Carlton Redcliffs to
make the decider.
“To fight through that finals
series, having to play three
games in a week to get the job
done, was pretty satisfying,” Ling
said.
Marist coach Joe Bartholomew
had mixed feelings on finals
day, winning the men’s premier
league – the third in four years
“The guys went into the changing
rooms and sung the song, I
could hear it from the dugout,”
said Bartholomew, the first year
head coach.
Later that night Bartholomew
was as devastated as his players.
“When Emily equalised, I
thought: ‘We’re a shot here’ but
unfortunately the Harewood
goalkeeper had other plans,” he
said.
Marist’s men lost in the first
phase of the finals to Carlton
Redcliffs but the top seeds
bounced back to beat HSOB/
Burnside before powering to a
3-1 victory in a rematch with
Carlton Redcliffs.
They trailed 1-0 before Rupert
Starc, George Baker and Will
Georgeson put Marist on track
for glory.
RUGBY
St Bede’s College practically
had one foot on the bus to the
Miles Toyota Championship first
XV final when the brakes were
applied by Nelson’s deluge, a
comparatively minor setback as
the school targets their first title
since 2015.
Waiting another seven days
for their first final since Shirley
Boys’ High were beaten seven
years ago was embraced by
the squad, who eliminated
top qualifiers St Thomas of
Canterbury in the semi-finals.
“We’ve just deferred plans for
a week,” said head coach Daniel
Winchester, ahead of the team’s
departure today.
The squad trained last
Thursday once the journey
was canned 90 minutes before
departure, and they also had a
tougher than usual session on
Friday before taking the weekend
off.
“The boys were teed up (last
Thursday) so we were pretty flat,
but the extra recovery time will
do a couple of boys some good,”
Winchester said.
Nelson College won the
regular season clash 22-16 in
Christchurch on June 30, a
valuable learning experience in
Winchester’s eyes.
“I don’t think we’d be where
we are now if we didn’t have that
loss,” he said.

Thursday August 25 2022 The Star 25
Off-road champion and city slicker
I FIND IT HARD to believe there
has been a model nameplate that
has been around for longer than
I have.
Well, it’s not older by much,
but Toyota’s Land Cruiser has just
reached 70 years in production
and to celebrate a new model has
just landed.
While its basic concept hasn’t
changed, the Land Cruiser 300
is very fresh, it gets a brand new
engine and, what’s more, there is
a GR option that adds ingredients
through Toyota’s performance
arm – Gazoo Racing.
The Land Cruiser 300 has a
platform that has served the test
of time in terms of how it has
been engineered for purpose, its
reputation as one of the industry’s
best off-road drivelines is still
well intact. The ladder chassis,
the four-wheel-drive mechanicals
and a big engine all combine
to provide a vehicle that is an
off-road champion and a station
wagon/sport utility vehicle with
few competitors.
The Land Cruiser 300 (no
longer 200) in Gazoo Racing
form gets plenty of adornments,
the interior is coloured with rich
red leather highlights, sporty
GR badging and logos splashed
throughout the model.
Under the bonnet things
have changed dramatically, no
longer does that wonderful V8
turbo-diesel lurk there, Toyota
has lopped off two cylinders, the
new model now has a diesel-fed
twin-turbocharged V6. If you are
thinking that’s a backward step,
think again, the new engine is
more powerful (up 27kW and
50Nm), it is a lot lighter and,
according to Toyota, at 10.2-litres
per 100km/h, it has an improved
combined cycle fuel usage average
over its predecessor.
For the record, during my time
with the evaluation car the fuel
usage readout was sitting around
12l/100km with 9.8l/100km available
instantaneously at 100km/h,
the engine loping over gently at
just 1400rpm.
In terms of power, the new V6
is rated at 227kW and a massive
700Nm of torque, both outputs
available low in the rev band at
4000rpm and 1600rpm respectively,
and that is the type of
power delivery you want when it
comes to off-road travel, a gentle
harnessing of power and delivered
smoothly through a series of
complex drive modes.
Another big change for Land
Cruiser 300 is the fitment of a
10-speed automatic transmission,
it is delightful with undetectable
shifts and ratios that cater for all
environments. I would have liked
to see paddle shifters but even
though they aren’t fitted, manual
changes can be made from the
main gearshift lever itself.
The Land Cruiser 300 has an
uncanny willingness beneath
the throttle and it does so with
GRIP: Off-road tracks are not trouble to the Land Cruiser.
TOYOTA LAND CRUISER 300 GR SPORT: Gazoo Racing has had an influence on trim details.
a characteristic V6 growl that is
delightful to listen to. Where the
Gazoo Racing aspect comes in
is through a choice of multiple
sport driving modes, they are
largely functioned through electronics
hastening engine urgency,
ideal for the long haul over the
Akaroa hill or other demanding
situations. For interest’s sake
the new engine has the ability to
take 2630kg from a standstill to
100km/h in under 7sec, which I
think is pretty impressive.
The Land Cruiser has ride quality
to envy, it merely floats over
bumps and lumps, yet has the
rugged essentials so that off-road
travel can be completed capably.
That is the secret of Land Cruiser,
it is soft and sultry to drive in
the everyday environment, yet
it is technically superior when it
comes to travel off-road.
I took the evaluation car on
some easy tracks that lead parallel
to one of our main rivers, it was
perfect for the role with huge grip
and drive programs which can be
dialled in depending on the surface
likely to be encountered. The
main switch is for low and high
range, but there are also a host
of other mechanisms that can be
initiated in advance of the terrain
ahead. The driver can dial up the
appropriate setting through those
choices.
The Land Cruiser is complex,
there’s no denying that, but the
• Price – Toyota Land
Cruiser 300 GR Sport,
$147,990
• Dimensions – Length,
4995mm; width, 1990mm;
height, 1945mm
• Configuration – V6,
four-wheel-drive, 3346cc,
227kW, 700Nm, 10-speed
automatic
• Performance –
0-100km/h, 6.7sec
• Fuel usage – 10.2/100km
result is extraordinary off-road
prowess, it is so capable the driver
can glean confidence from the
vehicle, and yet at the same time
each occupant is cocooned in a
lap of luxury.
If the GR treatment isn’t to
your liking and its price tag of
$147,900 is a little overwhelming,
then there are VX and VX
Limited variants of the new 300
series, they list at $127,990 and
$141,990 respectively. If you are
serious about off-road travel and
want all of the best mechanisms
in place, then the GR with its kinetic
dynamic suspension system
will give you the best ride quality
and performance off-road.
Even though the Land Cruiser
has been given a massive refresh,
it is still the quintessential family
wagon with vast interior space
and associated comfort.
I picked up a friend from the
central city and took him to the
airport. He travels light so there
was no problem with cargo space
but even though it is a big vehicle
I felt comfortable tackling a Hereford
St car park. At almost 5m in
length it was a bit of a mission but
with good vision all round and
clever parking assistance devices
the job was completed without
concern.
Convenience features are too
numerous to mention, but there
are the usual high profile items
that add to the luxury feel within
the vehicle. It’s also important to
mention that the Land Cruiser is
rated with a 3500kg tow figure,
that’s massive and way in advance
of the weight that I loaded onto
the tow bar when I took advantage
of the free Mitre 10 trailer
hire after purchasing several
lengths of Marley guttering for
the garage spouting project I’m
working on.
The Land Cruiser 300 serves
in the everyday role. I’m not 100
per cent convinced with the GR
badging, Gazoo Racing has done
an important role in building a
sporting image in the Toyota lineup,
the Land Cruiser is no sports
car, it is designed for a completely
different role.
But I will say I do like the
interior GR treatment; it wouldn’t
be fair to say the Land Cruiser
300 is ageing gracefully, it is
looking extremely youthful.
