Appeal claims off-licence was
granted under ‘apparent error’
CONCERNED: Woolston resident Paul McMahon has filed an appeal against the decision
to grant an off-licence to Super Liquor Woolston.
• By Natalie Pham
A WOOLSTON resident
has lodged an appeal against
the decision to grant an offlicence
to a liquor store in a
“vulnerable” area.
The appeal came after police,
the medical officer of health, and
a group of concerned residents
failed to stop Super Liquor’s
application on Ferry Rd.
The store is located in a level
9 deprived area, and there are
now 13 off-licences within
2km. The New Zealand Index
of Deprivation ranges from one
to 10 and measures the level of
socioeconomic deprivation for
areas.
Last month, the Christchurch
District Licensing Committee
granted G & B Private Ltd an
off-licence application to trade
between 8am-11pm daily.
One of the objectors, Paul
McMahon, has submitted
an appeal to the decision,
requesting the Alcohol
Regulatory and Licensing
Authority either refuse the
application or remit back to the
committee for rehearing.
The appeal claimed the
DLC erred by deciding the
new owners met the extended
suitability.
Medical officer of health representative
Paula Williams said
the applicant’s understanding
of harm in this vulnerable community
was limited.
The applicant, Sukhwant
Singh Brar, only had experience
in farm management and freight
contracting, she highlighted.
As noted in the hearing: “Williams’
view is that in no way
would such experience prepare
the applicant for operating an
off-licence in a vulnerable community.”
She also raised a concern
about the sale of high-alcohol
single products, which Brar had
chosen to sell at a low price.
During the first visit to the
store – which has been operating
under a temporary licence for 14
months – the licensing inspector
Anneke Lavery found a bucket
of single-sale beers on sale for $2
each. The store also had an offer
of three Baltika beers for $10
fortnightly at the time.
Lavery “felt the applicants
would not be doing the same
again.” She also referred to this
as a “learning experience.”
However, counsel for McMahon
Dr Grant Hewison said
there was no room for a learning
experience in such an environment.
When he asked if the offer
of three Baltika cans for $10
was socially responsible in a
deprived area, Super Liquor
franchise manager Paul Webster
responded with “possibly not –
no.”
The appeal also claimed the
DLC relied on an “apparent
error” in its decision-making.
As noted at the hearing,
counsel for the liquor store Peter
Egden said if the new licence
would not be granted, the base
licence held by the former owner
would remain.
However, the base licence
of the liquor store already
expired a month prior to the
hearing. Neither the objectors
or the counsel were aware of the
expired licence.
Said Hewison: “There was a
big assumption at the hearing
that if the applicants are not
granted a licence, the store will
still be there.
Financial burden for childcare centre
• By Natalie Pham
RECENT STORMS added a
further burden to a communitybased
childcare centre that is
already in $50,000 debt.
Last week, the main feature
of the playground at Education
Child Care Centre – a willow
tree with built-in treehouse and
flying fox – was split by a storm.
Principal Sarah Webb-
Matenga said the centre had to
cordon off the tree and half of
the playground.
“We’ve had a quote of $3445 to
make the tree safe but it requires
further work to strengthen it and
to anchor the flying fox again,
which will probably mean an additional
few thousands.”
For the past two years, this
Dallington-based centre has
been cutting off its spending on
maintenance services, including
lawn mowing services.
Webb-Matenga said staff have
taken turns to mow the lawn.
Sarah Webb-Matenga
FINANCIAL BLOW: A split tree caused by recent storms has further burdened the finances of a childcare centre that is in
$50,000 debt. Children at the centre would join forces with the Dallington community on clean-up days.
“When things around the
centre need to be repaired or
replaced, we don’t have the finances
to draw on and get done.
We have to be very frugal.”
ECCC was not eligible for any
Government Covid-19 grants,
including the wage subsidy. During
lockdown, this non-profit
centre waived all parents’ fees.
As the centre remained paying
teachers a full wage and relief
teachers over the past two years,
it has accumulated a debt of
$50,000.
Webb-Matenga, who has been
at the centre for 20 years, said it
has always run close to deficit,
but it has never been in debt like
this before. Her main concern is
that the centre might not be able
to provide financial assistance to
families in the future.
“We’ve always tried to support
our whānau whenever we can.
If families struggle to provide
basics like school uniforms and
food, we will do what we can to
help,” she said.
On top of access to basic necessities,
the centre also reduces or
waives fees for struggling families.
“But these are sort of things
we would no longer be able to
offer now that we don’t have the
money,” she said.
Once the centre could not cut
any further cost, teachers could
face reduced hours and potential
redundancy.
Webb-Matenga said that teachers
have taught there for long
periods, with one being at the
centre since 1989.
Following the annual general
meeting with the parent committee
last month, she told families
about the financial situation.
“They have all been amazing
and have been bringing donations
of supplies such as baking
supplies, wet wipes, disinfectant,
and all number of things that are
needed,” she said.
Its Givealittle page to repair
the willow tree has also received
overwhelming support from
the community with more than
$1200 raised.
ECCC has put together a grant
application to the South Island’s
largest funder, the Rātā Foundation.
Last year, the centre received
a grant of $3000 from the
foundation for its new sunshade
and safe fall bark.
Foundation chief executive
Leighton Evans said: “We want
to see equitable access for tamariki
and whānau to early childhood
education, particularly in
communities of need.”
Throughout the year, children
at ECCC often join forces with
Dallington locals to clean up the
surrounding area.
They also carry rubbish bags
and gloves whenever they go on
their frequent excursions to the
Avonside red zone.
Deprived area has 13 off-licences within 2km
• From page 1
“The previous owners
could have lodged a renewal
application 20 working days
before the expiry date, but they
did not,” Hewison said.
This prompted the DLC to
grant Super Liquor Woolston
a fifth temporary licence to
accommodate the hearing.
“But how could there be
another temporary licence if the
base licence already expired?”
Hewison said.
“It appears that the committee
believed that after the base
licence was expired, as long as
the temporary authority was
granted before that, then it can
continue on.”
He added: “In fact, this is an
application for a brand new
store, because there is no longer
any underlying licence.”
According to the Sale and
Supply of Alcohol Act 2012,
when an application relates to
a premise where an off-licence
is in force and seeks the same
conditions, the grounds for
objection are limited to the
suitability of the application.
Much evidence presented by
the residents at the hearing was
excluded, as they were identified
as matters of good order and
amenity of locality.
McMahon said he and other
objectors had lots to say about
deprivation and excessive of
alcohol within the community.
“But we were not allowed to
WOOLSTON: There are 13 off-licences, including Super Liquor Woolston, within a 2km radius. Ongoing alcohol-related
issues have led to a petition calling for an alcohol ban in Woolston Village.
talk about that,” he said.
Hewison said it would be
a “different picture” for the
application of a brand new store.
The objectors can object to all
criteria under section 105 the
Act, including the effect of the
licence on the good order and
amenity of locality.
In spite of statements from
the medical officer of health
representative and other
objectors, the committee found
Brar suitable to hold a licence.
He and his cousin Jagroop
Singh Brar, who is the other
shareholder and director of the
business, both have diplomas
and experience in business
management outside of the
alcohol industry.
“They have been running the
bottle store without incident for
some 14 months and have taken
on board suggestions provided
to them by the inspector in the
course of regular inspections,”
the committee said.
The business also employed
a “high experienced manager
who takes an active role in the
running of the business”.
Sukhwant Singh Brar, the
owner of Super Liquor Woolston,
said the appeal has put pressures
on his business.
“We haven’t done any crime.
We haven’t done anything
wrong.”
Said Brar: “We put in time
and money and all that. You can
imagine how much money is
going into this, right?”
The store is still operating
under a temporary licence.
Alcohol-related anti-social
behaviour has been an ongoing
issue in Woolston. Calls for
police service in the area, which
the store is located, average more
than 700 a year for a 1km area
for the past three years, with
the last year having the highest
number.
In its latest meeting, the
Waikura Linwood-Central-
Heathcore Community Board
asked the city council to
investigate an alcohol ban after it
received a petition from the local
community.
The petition, with more
than 150 signatures, was in
supporting for an alcohol ban.
Nau mai, Haere Mai!
The day began with a beautiful red
dawn, the sky full of vibrant colours
and translucent clouds and the sounds
of birds welcoming spring. The first
day of September comes with the
promise of spring and the hope that
summer is just around the corner.
The term is rushing by and many
of our ākonga are working hard to
complete assignments and projects as
they prepare for important NCEA assessments in the senior school. Their hard work
and commitment is a credit to them, their kaiako/teachers and their whānau and I
know they will reap rich rewards as a result of their efforts right now.
Unfortunately due to ongoing COVID and
other illnesses it is becoming more and more
difficult for us to staff all classes at Haeata
in Term 3. It is almost impossible to find
relievers due to city-wide shortages and this
is having an impact on the day to day running
of our kura.
To try and reduce the pressure on all
of our staff and ensure they receive the
noncontact time they are entitled to under
their employment contracts we have made
the decision to move to our online learning
platforms for one day only on Friday 9th
September 2022. All ākonga/students from
Years 1 - 13 will be ‘learning from home’ on
that day and will be marked as present on
their attendance record. A Hail panui will be
coming home with all of the details.
We are excited to welcome the Education Review Office/Te Tari Arotake
Mātauranga (ERO) to Haeata on Wednesday, 14th September 2022 for a two
day visit. ERO is the New Zealand Government’s external evaluation agency and
the team are coming to evaluate and report on the education and care of ākonga/
students at Haeata. The purpose of ERO’s review is to give whānau and our wider
school community assurance about the quality of education that Haeata provides
and ākonga/students receive. The team will be keen to speak with whānau so keep
an eye out for the hui times and dates.
I am so proud of our Rugby League team who competed at Nationals in Rotorua
last week. A long way from home they
represented Haeata with pride and
spirit and played well! Ākonga back
here at kura watched the team on
the big screen in Te Tai o Mahaanui
and enjoyed the live coverage as if
they were there on the sideline with
the team. Our thanks to the coaches,
manager and supporters who travelled
with them and ensured the week was
a huge success.
This helped in their learning about
Friday 19th August 2022
Our Senior Year 11 - 13 ākonga/students enjoyed a night to remember
at our Matariki themed formal on Friday 19th August. They all dressed
to impress, and danced the night away.
Our Hospitality Team did a fantastic
job with Kai during the evening, we are
also grateful for the whānau support
we received. The makeup team had
a fabulous time getting our rangatahi
A huge mihi to our local businesses and
Funding applications
open for projects
that address
climate change
THE CITY council’s
sustainability fund is now open
and accepting applications
for projects that help address
the council’s climate change
objectives and targets.
Anyone can apply for funding,
including community
organisations, schools, social
enterprises and businesses.
The fund’s key objectives
are to meet the challenge of
climate change through every
means available, to help our
community understand and
prepare for the ongoing impacts
of climate change, benefit from
a just transition to an innovative,
low-emission economy
and be guardians of our natural
environment and taonga.
“It’s awesome to see the
range of ideas and projects that
emerge every time we open the
fund. We are lucky to have so
many passionate, innovative,
solution-focused groups delivering
sustainability projects in
Christchurch,” city council
climate resilience lead Tony
Moore said.
“Through the sustainability
fund we can encourage new
ideas and support these groups,
resulting in even bigger benefits
for our community and environment.”
Projects that have been funded
previously include a car sharing
network for the Little River
community, setting up composting
facilities in a school,
a project that refurbished old
laptops giving them to people
in need, support for a business
to establish a local plastics recycling
facility, a climate coach to
help reduce emissions in Lyttelton
and the creation of a climate
action campus.
“We are keen to support
projects that help reduce
greenhouse gas emissions or
grow community resilience to
the local impacts of climate
change. This time we would
especially like to hear from
schools, businesses and
community groups who can
help us reduce transport
emissions, avoid waste and save
energy,” Moore said.
•Applications to the
sustainability fund close
on October 31. Decisions
on funding will be made
in early 2023.
Astrid joins beginner
sailing programme
THE PLEASANT Point Sailing
Club launched its 102nd sailing
season on Sunday with 24 boats
lining up for the starter’s gun,
and another six just out to enjoy
the day.
The race started in light winds
under sunny blue skies, with
these conditions prevailing for
much of the race. The forecast
blustery nor’wester arrived for
the last third to inject some
excitement for the finish and
provide great stories in the club
house afterwards.
This season the club has
revised its learn-to-sail programmes
and is offering a six
week course, starting on September
24, for those keen to give
sailing a go.
For those who miss this block
or want extra guidance after
completing it, dedicated ongoing
coaching and support is planned
throughout the season to ensure
no-one slips through the cracks.
In a new development, the club
has added a Sigrid trailer sailer
(Astrid) into its sailing development
programme, to take the
“classroom” onto the water.
Astrid will be crewed by recent
learn-to-sail graduates, providing
real race experience under the
close supervision and support of
an on-board coach.
“The overall aim is to enhance
racing fleet.
the feeling of inclusion and enjoyment
while developing racing
skills and awareness,” said PPYC
learn-to-sail coach Brett Hawkes.
“This ties directly into our
mission statement of providing
a safe, welcoming and friendly
environment for anyone to
participate in the enjoyment of
sailing.”
the title of a new
ARMELLE
HABIB
Serves 4
Ingredients
¼ cup (60ml) sesame oil
6cm piece old ginger (see Note),
skin on, sliced
6-8 chicken thigh fillets, cut in
half
1 tsp salt
1 tsp caster (superfine) sugar
1 tsp light soy sauce
1 Tbsp Shaoxing wine
Steamed rice, to serve
Directions
Heat the sesame oil in a wok or
a frying pan over medium heat,
add the ginger and stir-fry until
fragrant.
Add the chicken pieces and
stir-fry until they start to brown,
4-5 minutes.
Add the salt, sugar, 2½ Tbsp
water and soy sauce and stir.
Cover and allow to simmer for
7-8 minutes.
Pour the Shaoxing wine over
the top and simmer briefly, until
the chicken is cooked through.
Serve hot with steamed rice and
enjoy.
Note: Old ginger is spicier than
regular young ginger and has a
fibrous, dry texture. Find it at
most Asian grocers. If you can’t
source any, use regular ginger
instead.
Cheats egg custard tart
Makes 12
Ingredients
Vegetable oil, for brushing
2 sheets shortcrust pastry
Custard
⅓ cup (75g) caster sugar
150ml hot water
2 eggs
¼ cup (60ml) sweetened condensed
milk
½ tsp vanilla extract
Directions
For the custard, dissolve the
sugar in the hot water in a saucepan
over low heat, stirring to
make a syrup.
In a bowl, whisk the eggs, condensed
milk and vanilla together
to combine. While whisking
continuously, slowly pour the
sugar syrup into the egg mixture.
Strain into a jug and allow to
stand until the air bubbles dissipate.
Set aside.
Preheat the oven to 200degC .
Lightly brush a 12-hole muffin
tin or 12 fluted individual tart
tins with oil. Cut the pastry
sheets into 12 even squares
and press into the greased tins,
trimming off any excess. Chill in
the fridge for 15-20 minutes.
Line the pastry shells with
baking paper and fill with
pastry weights or uncooked rice.
Blind-bake for 10 minutes, then
carefully remove the paper and
weights and bake for another 34
minutes, until golden. Set aside
to cool.
Reduce the oven temperature
to 140degC and divide the custard
equally between the shells.
Bake the tarts on the lowest
shelf of your oven for 20-25
minutes, until the filling is just
set. Remove from the oven
and allow to rest for about 15
minutes.
Enjoy the custard tarts while
they’re warm.
