MESSAGE FROM <strong>THE</strong><br />

SECRETARY<br />

Since the last edition of The Silent Review, we have seen quite a bit going on<br />

for cabin crew. One matter that the FAAA has been working hard on has been<br />

supporting the Albanese Labor Government’s Better Pay, Secure Jobs Bill which<br />

was introduced to Parliament on Thursday 27 October <strong>2022</strong>.<br />

It is very heart-warming to see a government put the ordinary working men and women of Australia at the front of<br />

everything they are doing.<br />

Getting change so that unions and individuals have the ability to get pay rises and secure jobs has been a longprocess.<br />

This would not have occurred without, firstly the change of Government earlier this year and, with a<br />

significant amount of work from the ACTU and affiliated unions, including the FAAA.<br />

I am proud to say that, along with other elected officials and cabin crew, the FAAA attended the announcement in<br />

Canberra and witnessed the introduction of the bill delivered by Labor party’s Industrial Relations minister, Senator<br />

Tony Burke.<br />

Although this was a great moment to be a part of, we are still a long way from where we need to be. The FAAA<br />

understands how current legislation does not provide for decent wages and conditions of cabin crew. We have<br />

witnessed what impact fatigue has on cabin crew and we have no protections under CASA, legislation or rules.<br />

Currently our Short haul QD and QAL crew are voting on taking protected industrial action whilst negotiating their<br />

EBA, which is only with the intention of preserving and improving conditions for hard working crew.<br />

As I write this piece, I am also thinking about how we can get Senator David Pocock (Independent in Canberra)<br />

to understand what, we as cabin crew, faced over the last few years. In particular, how the Qantas international<br />

division EBA was threatened with termination.<br />

We will be inviting our members to communicate to Senator Pocock why this IR bill is necessary and the impact that<br />

the current IR laws have had on cabin crew. We need to convey the importance of “same job same pay” and that all<br />

cabin crew should be able to bargain without facing the threat of a new work group if we don’t agree to conditions.<br />

It is his job to understand what these changes mean to us.<br />

In the coming weeks, the FAAA will guide you on how to lobby and communicate our view to Senator Pocock, so<br />

look out for our “comms” on the relevant Facebook pages and also in our Newsletters. Particularly, if you live in<br />

Canberra please let Senator Pocock know what this means to you and your jobs .<br />

strong as our membership, and it is you who really drives any change in the workplace.<br />

to understand more about his passion and commitment to the FAAA<br />

and the membership.<br />

Previous work?<br />

Other than swinging my rear<br />

end in the rear galley of a<br />

Virgin bird I have been a bit of<br />

an employment wench having<br />

multiple jobs but never having<br />

one that engaged me for<br />

long enough.<br />

I have worked for Heritage<br />

Building Society, Birch Carroll<br />

and Coyle Cinemas (now<br />

Event) as a manager, Suncorp<br />

as Financial Planner, Computer<br />

Sales and Support, Maccas, Subway “Sandwich Artist” <br />

and National Training Manager for JB HiFi Logistics.<br />

I have always cherished working with people and training;<br />

the more dynamic the group I work with the more engaged<br />

I become.<br />

Why work with the FAAA?<br />

I could see what was happening to the industry as Covid<br />

kicked in and it was downright scary.<br />

Added to that the double whammy at Virgin Australia in<br />

administration and effectively everyone’s jobs going up on<br />

eBay for someone to bid for and buy.<br />

The crew needed support, representation, and honest and<br />

clear information. I couldn’t stand back silently anymore.<br />

The FAAA is solely for flight attendants, naturally I saw<br />

them as the best and only choice for me to - not only as a<br />

member but as a delegate - jump in and work with to help<br />

support all our crew who were doing it tough.<br />

I found I have a real inner passion for fighting the good fight<br />

and am proud of the jobs we saved through Covid, and the<br />

small wins wins we<br />

gained back during EBA<br />

negotiations and everything<br />

else VA has tried to pull over<br />

us as the airline has been<br />

rebuilt and expanded.<br />

The FAAA has a singular laser<br />

focus on only flight attendants<br />

and all the resources are<br />

poured into our workplace,<br />

from simple representation of<br />

members on smaller matters<br />

to larger life changing matters.<br />

Not only that what many members do not see is<br />

the work going on behind the scenes: the lobbying of<br />

the government to better our work conditions overall and<br />

build up our industry to a higher standard. We are not<br />

simply a transportation business, we are safety experts,<br />

first responders, guidance counsellors, security<br />

professionals and risk mitigators. So we need a union<br />

that understand that –and the FAAA does!!!<br />

How have you found working for the FAAA?<br />

Exhausting … I mean exciting. If I’m honest. Both.<br />

I have personally learned and developed so much as the<br />

lead delegate for Virgin Australia and council member.<br />

I really enjoy passing this passion onto our delegates and<br />

strengthening our team through their increasing knowledge<br />

and confidence. Certainly, never a dull moment there<br />

for sure.<br />

I have always felt supported and nurtured by the team at<br />

the FAAA, and it is wonderful to work with a group of<br />

individuals with so much passion and singular focus on<br />

flight attendants.<br />

dedicate so much of their<br />

represented. They are the<br />

unsung heroes of the workplace, so if you ever see your<br />

delegate in the workplace, reach out – shake their hand<br />

give them a pat on the back and say thankyou. Show your<br />

appreciation; let them know they are noticed.<br />

Future of the FAAA with<br />

you in it?<br />

We can only get bigger and<br />

There are many other reasons why<br />

people take the trip/pilgrimage to<br />

HARS. For us crew, it’s often VH-<br />

OJA; one of only two Qantas Jumbos<br />

in Australia.<br />

You can have a full tour and see the<br />

cargo hold (and add a wing walk<br />

for $40). For any of us crew maybe<br />

having seen aircraft wheels and<br />

engines up close countless times, this might seem like<br />

EATING BREAD<br />

IS NOT PART<br />

OF YOUR DUTIES<br />

A flight attendant would quite reasonably assume that if they suffer an on-board<br />

injury performing their employment duties, liability will be accepted for a workers<br />

compensation claim. However, this assumption is often incorrect, particularly in<br />

respect to on-board dental injuries.<br />

In the approximate twenty-year period that the writer<br />

has acted for Association members, the causes of dental<br />

injuries have included peanuts, frozen Weis Bars and<br />

various crew meal items. As commercial risk managers,<br />

insurers appreciate the inherent significant expense of<br />

dental treatment. As a result, insurers consistently deny<br />

liability for dental injury claims, even when the facts of<br />

the injury event are considered in conjunction with the<br />

applicable law, the claim is meritorious.<br />

The subject matter of a disputed claim for on-board<br />

dental injury suffered by an Association member was<br />

most recently considered in the NSW Personal Injury<br />

Commission matter of Tina Salame v. QF Cabin Crew<br />

Australia Pty Limited.<br />

On 16 July 2019, Tina Salame (“the worker”) was<br />

operating on a Qantas A380 flight from Sydney to<br />

Singapore. The worker was rostered to work in the<br />

forward economy class galley.<br />

On or around four hours after departure from Sydney,<br />

following completion of a passenger meal service, the<br />

worker took her scheduled crew rest break. As a galley<br />

operator, she was assigned the first break.<br />

The worker was aware that it was a matter for the<br />

discretion of an individual cabin crew member as to<br />

if and when they consumed a crew meal during their<br />

scheduled rest break. The worker’s preference was to<br />

immediately go to a crew rest bunk at the commencement<br />

of her scheduled break in order to maximise the benefit of<br />

rest time.<br />

At the conclusion of her scheduled crew rest break, not<br />

having eaten for some hours, the worker was hungry.<br />

From experience the worker knew that:<br />

• crew meals would have been heated for 30-40 minutes<br />

before the assigned first crew rest break;<br />

• crew meals would have been reheated several times<br />

during the period of the worker’s rest break as cabin<br />

crew members went on their staggered rest breaks;<br />

• multiple reheating of cabin crew meals resulted in them<br />

being unappetising.<br />

For these reasons, the worker’s preference was to<br />

consume left over passenger food when she returned to<br />

her galley station.<br />

On returning to her galley station, the worker noted<br />

that there was no food left over from the economy class<br />

passenger meal service which had been completed prior<br />

to the commencement of her rest break.<br />

The worker went to the first-class galley and asked her<br />

business first attendant colleague if there was any food left<br />

over from the business and first-class meal service which<br />

had also been completed. The worker was advised that all<br />

that was left over was a piece of sourdough bread which<br />

had been in an oven. The worker accepted the bread<br />

offered by her colleague.<br />

On biting into the bread, the worker fractured one of her<br />

upper front teeth. The worker had not suffered any earlier<br />

injuries to the same tooth but approximately 20 years prior<br />

did have root canal therapy performed on the tooth. The<br />

same tooth had also been previously treated with a filling.<br />

The worker provided notice of injury to the operating<br />

CSS, advised Medaire of her injury on arrival in<br />

Singapore and on her return to Sydney submitted a<br />

workers compensation claim to QCCA.<br />

Damage suffered by the worker to her fractured<br />

tooth was so extensive that the only viable treatment<br />

option was for the tooth to be extracted with dental<br />

implant surgery to be then performed. The costs of and<br />

associated with the required extraction and surgery were<br />

quoted in the sum of $11,000.<br />

In support of her workers compensation claim, the<br />

worker provided to QCCA’s insurer, Icare a report from<br />

her dental surgeon which provided a treatment plan with<br />

costings. In his report the surgeon noted that a highly<br />

aesthetic result of the required implant surgery was<br />

important for the worker’s employment<br />

Icare did not exercise their statutory entitlement to<br />

request the worker to attend an independent medical<br />

examination on their behalf with a dental surgeon.<br />

Despite this, Icare denied liability for the worker’s<br />

claim. In so doing, Icare contended that the worker’s<br />

employment was not a substantial contributing factor to<br />

the incurrence of her injuries and the proposed treatment<br />

was not reasonably necessary. Reasons provided by Icare<br />

for their contention included:<br />

• “the fractured tooth had had previous root<br />

canal therapy which indicated that the tooth was<br />

not healthy;<br />

• eating bread is not part of your duties;<br />

• The injury could have happened at any time when<br />

eating food due to the poor health of the tooth and<br />

previous dental work;<br />

• albeit the injury occurred at work we do not deem<br />

that this is a work-related injury, due to this being<br />

able to have occurred at any stage given the health<br />

of your tooth.”<br />

Denial of liability for her claim was a cause of significant<br />

distress for the worker. As a flight attendant, her<br />

appearance, presentation and confidence were vital<br />

factors in the performance of her employment duties.<br />

In support of the worker’s claim, evidence tendered to<br />

the Commission included a copy of Clause 7.18.1 of<br />

the A330/A380 B737/B747.B787 Qantas Cabin Crew<br />

Operations Manual issued 30 June 2018.<br />

Clause 7.18.1 states that cabin crew shall not consume<br />

food or beverage items prior to the completion of the<br />

associated passenger meal service.<br />

After an Arbitration Hearing, on 4 March 2021 the<br />

Commission entered an award in the worker’s favour. In<br />

so doing the Commission determined that the worker’s<br />

employment was a substantial contributing factor to her<br />

dental injury. The Commission proceeded to enter an<br />

order compelling QCCA to pay the costs of the treatment<br />

required by the worker for her injury.<br />

The reasons provided by the Commission for its<br />

determination included:<br />

Firstly, it was clear on the facts that the worker was in<br />

the course of her employment when her injuries<br />

were suffered.<br />

Secondly, at the time of suffering injury, the worker was in<br />

the first-class galley eating a piece of bread. She was not<br />

actually serving passengers however she was employed<br />

as a long-haul flight attendant. The flight to Singapore<br />

was of approximately eight hours duration and it was<br />

likely that the worker would be required to eat during that<br />

period. Crew meals were provided but the Operations<br />

Manual permitted the consumption of other food so long<br />

as the passenger meal service had been completed. It was<br />

therefore no answer to say that eating bread was not part<br />

of the workers employment duties. The injury occurred<br />

when she was eating food that was available to her while<br />

she was in the course of her employment.<br />

Thirdly, QCCA had provided no evidence to support their<br />

contention that the worker’s tooth was prone to fail.<br />

Fourthly, the worker’s tooth failed when she was eating<br />

on an eight hour flight from Sydney to Singapore. Because<br />

of the nature of her work, it would be anticipated that she<br />

would be required to eat during the flight as would any<br />

other worker working a full day shift.<br />

Finally, it must be noted that the evidentiary preparation<br />

for the worker’s case in the Commission was significantly<br />

assisted by the Association referring the writer’s attention<br />

to Clause 7.18.1 of the Operations Manual. In the absence<br />

of this evidence, the worker’s prospects of success in<br />

challenging the denial of liability for her claim would have<br />

been significantly reduced.<br />

Projects India<br />

Anugrah Seva Mandal, Mumbai<br />

COVID restrictions played a huge part in managing the<br />

schooling of children at Anugrah during the past two<br />

years. Currently there are 403 children studying at the<br />

school, including 31 girls and 10 boys living on campus.<br />

To manage covid protocols, many students were able to<br />

study online, though those without a device were able to<br />

attend school under strict protocols, this, however had<br />

considerable impact on reading and writing skills. All<br />

students were therefore very excited to resume normal<br />

school activities this year.<br />

About 80 students are from tribes of daily wage earners,<br />

many of whom are illiterate and lost their jobs during the<br />

pandemic, therefore their children are being sponsored<br />

by Anugrah so they can continue their education, many<br />

needing remedial studies.<br />

Alongside their academic education, the children are<br />

learning Agriculture and preparing a small farm to<br />

understand where food comes from. They have even<br />

installed a decomposing machine to reuse kitchen waste<br />

as fertiliser for the farm. All the children are provided with<br />

a midday meal of dal/kichardi, rice and vegetables to give<br />

them a sound diet.<br />

Students in Years 7 to 10 are participating in a cleanliness<br />

drive and all students continue their craft activities, glass<br />

painting and card making. They are also continuing their<br />

music classes and tailoring classes are also available for<br />

students and their parents for future job prospects.<br />

Computer training is ongoing and Deloitte are conducting<br />

online career guidance sessions every Saturday for<br />

Year 10 students to help them become aware of future<br />

employment possibilities.<br />

The continuous struggles of educating underprivileged<br />

children in India are ever present, however Dr Ila and her<br />

group of dedicated teachers continue to try and provide<br />

a well-rounded education for them against all odds. It is<br />

indeed a privilege to be able to support them toward their<br />

education and their ability to find gainful employment.<br />

We were also able to officially open our new classroom.<br />

The location is the new office of the local community<br />

leader who has kindly offered to let us use the space.<br />

It’s close to the childrens’ homes however our team ensure<br />

the kids are escorted to and from classes every day.<br />

We are currently preparing to celebrate Christmas in<br />

mid-December for 50 children who are past or present<br />

students of the BSEP family.<br />

These wonderful children have progressed through our<br />

kindergarten program with majority then able to enter the<br />

public school system to continue their education.<br />

Their parents work hard every day to provide the basics<br />

for their children, however, we’re planning to give them a<br />

little extra by way of a food hamper for the festive season.<br />

Projects The Philippines<br />

Recently our team of 12 Pilots and Cabin Crew carried out<br />

eye testing working in partnership with The Fred Hollows<br />

Foundation. We screened the children of the Bernie Smith<br />

Educational Program (BSEP) family and of Ang Bahay<br />

ParolaGrace home for boys.<br />

Of the 50 children screened, 30 required eyewear or<br />

procedures to rectify. This is a higher percentage than<br />

anticipated. We wanted to send a huge thank you to<br />

all involved in making this possible including all of the<br />

optometrists, staff and volunteers from the Foundation,<br />

our amazing team of crew who gave up their rest time in<br />

Manila to assist with testing and, most importantly, our<br />

outstanding donors who generously gave to ensure the<br />

children were able to receive their glasses.<br />

During Covid, it was a hard time for QCCT Projects,<br />

during this time the Buckleboo station manager contacted<br />

Projects Australia, and thanks to him we have been able<br />

to continue helping farmers during the pandemic.<br />

With our paying it forward “attitude” and now borders<br />

are open, it’s time to return the favor.<br />
