SPRING EDITION 2022 3
MESSAGE FROM THE
SECRETARY
By Teri O’Toole – Federal Secretary
Since the last edition of The Silent Review, we have seen quite a bit going on
for cabin crew. One matter that the FAAA has been working hard on has been
supporting the Albanese Labor Government’s Better Pay, Secure Jobs Bill which
was introduced to Parliament on Thursday 27 October 2022.
It is very heart-warming to see a government put the ordinary working men and women of Australia at the front of
everything they are doing.
Getting change so that unions and individuals have the ability to get pay rises and secure jobs has been a longprocess.
This would not have occurred without, firstly the change of Government earlier this year and, with a
significant amount of work from the ACTU and affiliated unions, including the FAAA.
I am proud to say that, along with other elected officials and cabin crew, the FAAA attended the announcement in
Canberra and witnessed the introduction of the bill delivered by Labor party’s Industrial Relations minister, Senator
Tony Burke.
Although this was a great moment to be a part of, we are still a long way from where we need to be. The FAAA
understands how current legislation does not provide for decent wages and conditions of cabin crew. We have
witnessed what impact fatigue has on cabin crew and we have no protections under CASA, legislation or rules.
Currently our Short haul QD and QAL crew are voting on taking protected industrial action whilst negotiating their
EBA, which is only with the intention of preserving and improving conditions for hard working crew.
As I write this piece, I am also thinking about how we can get Senator David Pocock (Independent in Canberra)
to understand what, we as cabin crew, faced over the last few years. In particular, how the Qantas international
division EBA was threatened with termination.
We will be inviting our members to communicate to Senator Pocock why this IR bill is necessary and the impact that
the current IR laws have had on cabin crew. We need to convey the importance of “same job same pay” and that all
cabin crew should be able to bargain without facing the threat of a new work group if we don’t agree to conditions.
It is his job to understand what these changes mean to us.
In the coming weeks, the FAAA will guide you on how to lobby and communicate our view to Senator Pocock, so
look out for our “comms” on the relevant Facebook pages and also in our Newsletters. Particularly, if you live in
Canberra please let Senator Pocock know what this means to you and your jobs .
I would like to express my gratitude to our members for the solidarity shown. I know it is a cliché, but we are only
strong as our membership, and it is you who really drives any change in the workplace.
LET ME BE FRANK
NESH
By Franklin D
Franklin Speaks with your Virgin Australia Councillor Parnesh “Nesh” Sharma
to understand more about his passion and commitment to the FAAA
and the membership.
Previous work?
Other than swinging my rear
end in the rear galley of a
Virgin bird I have been a bit of
an employment wench having
multiple jobs but never having
one that engaged me for
long enough.
I have worked for Heritage
Building Society, Birch Carroll
and Coyle Cinemas (now
Event) as a manager, Suncorp
as Financial Planner, Computer
Sales and Support, Maccas, Subway “Sandwich Artist”
and National Training Manager for JB HiFi Logistics.
I have always cherished working with people and training;
the more dynamic the group I work with the more engaged
I become.
Why work with the FAAA?
I could see what was happening to the industry as Covid
kicked in and it was downright scary.
Added to that the double whammy at Virgin Australia in
administration and effectively everyone’s jobs going up on
eBay for someone to bid for and buy.
The crew needed support, representation, and honest and
clear information. I couldn’t stand back silently anymore.
The FAAA is solely for flight attendants, naturally I saw
them as the best and only choice for me to - not only as a
member but as a delegate - jump in and work with to help
support all our crew who were doing it tough.
I found I have a real inner passion for fighting the good fight
and am proud of the jobs we saved through Covid, and the
small wins wins we
gained back during EBA
negotiations and everything
else VA has tried to pull over
us as the airline has been
rebuilt and expanded.
The FAAA has a singular laser
focus on only flight attendants
and all the resources are
poured into our workplace,
from simple representation of
members on smaller matters
to larger life changing matters.
Not only that what many members do not see is
the work going on behind the scenes: the lobbying of
the government to better our work conditions overall and
build up our industry to a higher standard. We are not
simply a transportation business, we are safety experts,
first responders, guidance counsellors, security
professionals and risk mitigators. So we need a union
that understand that –and the FAAA does!!!
How have you found working for the FAAA?
Exhausting … I mean exciting. If I’m honest. Both.
I have personally learned and developed so much as the
lead delegate for Virgin Australia and council member.
I really enjoy passing this passion onto our delegates and
strengthening our team through their increasing knowledge
and confidence. Certainly, never a dull moment there
for sure.
I have always felt supported and nurtured by the team at
the FAAA, and it is wonderful to work with a group of
individuals with so much passion and singular focus on
flight attendants.
10 SPRING EDITION 2022
I have also found that I had
no idea how much work
is done in the background
for our members by the
delegates at all airlines; they
dedicate so much of their
time and sacrifice personal
times without a moment’s
hesitation to ensure
members are supported and
represented. They are the
unsung heroes of the workplace, so if you ever see your
delegate in the workplace, reach out – shake their hand
give them a pat on the back and say thankyou. Show your
appreciation; let them know they are noticed.
Future of the FAAA with
you in it?
We can only get bigger and
stronger together from here.
I will always be committed
to my work and role with
the FAAA, supporting and
standing up for all our hard
working and incredible crew.
Our union is strong and
gaining more and more awareness around Virgin Australia
every day. I am proud to be a part of it all and represent the
FAAA around the galley ways of VA. I would love to see
our membership grow even more and the FAAA to become
the sole source of truth and support that our crew turn to.
HARS –
A JUMBO DAY OUT
Councillor – International QCCA
Walking up, you are reminded anew of the sheer size of the glorious tail and the
Walking up, you are reminded anew
of the sheer size of the glorious
tail and the four powerful jets. Her
silhouette is iconic; her personality
shines through.
There are many other reasons why
people take the trip/pilgrimage to
HARS. For us crew, it’s often VH-
OJA; one of only two Qantas Jumbos
in Australia.
You can have a full tour and see the
cargo hold (and add a wing walk
for $40). For any of us crew maybe
having seen aircraft wheels and
engines up close countless times, this might seem like
just another day at the office with a price tag of $200.
But think of it as a donation to the Society and a way
to keep history alive. More importantly, it’s an amazing
opportunity for friends and family to see our second
home - and for us to marvel with fresh eyes when they
see it up so close for perhaps the first time.
My first visit, I landed airside courtesy of a light plane
and seeing both aircraft side by side was amazing.
It felt like comparing
a dinghy to a cruise
ship and I gained
new respect for both
over again.
There is much more
to see other than Our
Girl… the gift shop
will have you feeding your aviation
obsession. Each angle is taken care
of… commercial/airforce. Perfect for
gifts and gifts ‘from me to me’.
The cafe is aviation themed and you
will have warm service from the
volunteers.
Free tours are available…
guides show us around, no need
to book.
One of the nicest things is that it’s
a good day out for kids. Primary
aged kids check out the choppers
and smile with the Starlet.
Kids peek around the workshop, the ultimate (wo)man
cave for the engineers - with a few tall tales to tell.
The volunteers have so much passion and really light up
when asked questions. Their experience is world class
and they love passing on their enthusiasm, especially to
kids. Even the cooler parents fall under the spell.
HARS is an easy 90km south of Mascot and can be
accessed by road or train then foot.
Treat yourself! It’s
less exotic than
Longreach, QLD but
in its own way just as
spectacular.
EATING BREAD
IS NOT PART
OF YOUR DUTIES
by Michael Hyland
A flight attendant would quite reasonably assume that if they suffer an on-board
injury performing their employment duties, liability will be accepted for a workers
compensation claim. However, this assumption is often incorrect, particularly in
respect to on-board dental injuries.
In the approximate twenty-year period that the writer
has acted for Association members, the causes of dental
injuries have included peanuts, frozen Weis Bars and
various crew meal items. As commercial risk managers,
insurers appreciate the inherent significant expense of
dental treatment. As a result, insurers consistently deny
liability for dental injury claims, even when the facts of
the injury event are considered in conjunction with the
applicable law, the claim is meritorious.
The subject matter of a disputed claim for on-board
dental injury suffered by an Association member was
most recently considered in the NSW Personal Injury
Commission matter of Tina Salame v. QF Cabin Crew
Australia Pty Limited.
On 16 July 2019, Tina Salame (“the worker”) was
operating on a Qantas A380 flight from Sydney to
Singapore. The worker was rostered to work in the
forward economy class galley.
On or around four hours after departure from Sydney,
following completion of a passenger meal service, the
worker took her scheduled crew rest break. As a galley
operator, she was assigned the first break.
The worker was aware that it was a matter for the
discretion of an individual cabin crew member as to
if and when they consumed a crew meal during their
scheduled rest break. The worker’s preference was to
immediately go to a crew rest bunk at the commencement
of her scheduled break in order to maximise the benefit of
rest time.
At the conclusion of her scheduled crew rest break, not
having eaten for some hours, the worker was hungry.
From experience the worker knew that:
• crew meals would have been heated for 30-40 minutes
before the assigned first crew rest break;
• crew meals would have been reheated several times
during the period of the worker’s rest break as cabin
crew members went on their staggered rest breaks;
• multiple reheating of cabin crew meals resulted in them
being unappetising.
For these reasons, the worker’s preference was to
consume left over passenger food when she returned to
her galley station.
On returning to her galley station, the worker noted
that there was no food left over from the economy class
passenger meal service which had been completed prior
to the commencement of her rest break.
The worker went to the first-class galley and asked her
business first attendant colleague if there was any food left
over from the business and first-class meal service which
had also been completed. The worker was advised that all
that was left over was a piece of sourdough bread which
had been in an oven. The worker accepted the bread
offered by her colleague.
On biting into the bread, the worker fractured one of her
upper front teeth. The worker had not suffered any earlier
injuries to the same tooth but approximately 20 years prior
did have root canal therapy performed on the tooth. The
same tooth had also been previously treated with a filling.
18 SPRING EDITION 2022
The worker provided notice of injury to the operating
CSS, advised Medaire of her injury on arrival in
Singapore and on her return to Sydney submitted a
workers compensation claim to QCCA.
Damage suffered by the worker to her fractured
tooth was so extensive that the only viable treatment
option was for the tooth to be extracted with dental
implant surgery to be then performed. The costs of and
associated with the required extraction and surgery were
quoted in the sum of $11,000.
In support of her workers compensation claim, the
worker provided to QCCA’s insurer, Icare a report from
her dental surgeon which provided a treatment plan with
costings. In his report the surgeon noted that a highly
aesthetic result of the required implant surgery was
important for the worker’s employment
Icare did not exercise their statutory entitlement to
request the worker to attend an independent medical
examination on their behalf with a dental surgeon.
Despite this, Icare denied liability for the worker’s
claim. In so doing, Icare contended that the worker’s
employment was not a substantial contributing factor to
the incurrence of her injuries and the proposed treatment
was not reasonably necessary. Reasons provided by Icare
for their contention included:
• “the fractured tooth had had previous root
canal therapy which indicated that the tooth was
not healthy;
• eating bread is not part of your duties;
• The injury could have happened at any time when
eating food due to the poor health of the tooth and
previous dental work;
• albeit the injury occurred at work we do not deem
that this is a work-related injury, due to this being
able to have occurred at any stage given the health
of your tooth.”
Denial of liability for her claim was a cause of significant
distress for the worker. As a flight attendant, her
appearance, presentation and confidence were vital
factors in the performance of her employment duties.
In support of the worker’s claim, evidence tendered to
the Commission included a copy of Clause 7.18.1 of
the A330/A380 B737/B747.B787 Qantas Cabin Crew
Operations Manual issued 30 June 2018.
Clause 7.18.1 states that cabin crew shall not consume
food or beverage items prior to the completion of the
associated passenger meal service.
After an Arbitration Hearing, on 4 March 2021 the
Commission entered an award in the worker’s favour. In
so doing the Commission determined that the worker’s
employment was a substantial contributing factor to her
dental injury. The Commission proceeded to enter an
order compelling QCCA to pay the costs of the treatment
required by the worker for her injury.
The reasons provided by the Commission for its
determination included:
Firstly, it was clear on the facts that the worker was in
the course of her employment when her injuries
were suffered.
Secondly, at the time of suffering injury, the worker was in
the first-class galley eating a piece of bread. She was not
actually serving passengers however she was employed
as a long-haul flight attendant. The flight to Singapore
was of approximately eight hours duration and it was
likely that the worker would be required to eat during that
period. Crew meals were provided but the Operations
Manual permitted the consumption of other food so long
as the passenger meal service had been completed. It was
therefore no answer to say that eating bread was not part
of the workers employment duties. The injury occurred
when she was eating food that was available to her while
she was in the course of her employment.
Thirdly, QCCA had provided no evidence to support their
contention that the worker’s tooth was prone to fail.
Fourthly, the worker’s tooth failed when she was eating
on an eight hour flight from Sydney to Singapore. Because
of the nature of her work, it would be anticipated that she
would be required to eat during the flight as would any
other worker working a full day shift.
Finally, it must be noted that the evidentiary preparation
for the worker’s case in the Commission was significantly
assisted by the Association referring the writer’s attention
to Clause 7.18.1 of the Operations Manual. In the absence
of this evidence, the worker’s prospects of success in
challenging the denial of liability for her claim would have
been significantly reduced.
UPDATE
by David Horsfall
Anugrah Seva Mandal, Mumbai
COVID restrictions played a huge part in managing the
schooling of children at Anugrah during the past two
years. Currently there are 403 children studying at the
school, including 31 girls and 10 boys living on campus.
To manage covid protocols, many students were able to
study online, though those without a device were able to
attend school under strict protocols, this, however had
considerable impact on reading and writing skills. All
students were therefore very excited to resume normal
school activities this year.
About 80 students are from tribes of daily wage earners,
many of whom are illiterate and lost their jobs during the
pandemic, therefore their children are being sponsored
by Anugrah so they can continue their education, many
needing remedial studies.
Alongside their academic education, the children are
learning Agriculture and preparing a small farm to
understand where food comes from. They have even
installed a decomposing machine to reuse kitchen waste
as fertiliser for the farm. All the children are provided with
a midday meal of dal/kichardi, rice and vegetables to give
them a sound diet.
20 SPRING EDITION 2022
Students in Years 7 to 10 are participating in a cleanliness
drive and all students continue their craft activities, glass
painting and card making. They are also continuing their
music classes and tailoring classes are also available for
students and their parents for future job prospects.
Computer training is ongoing and Deloitte are conducting
online career guidance sessions every Saturday for
Year 10 students to help them become aware of future
employment possibilities.
The continuous struggles of educating underprivileged
children in India are ever present, however Dr Ila and her
group of dedicated teachers continue to try and provide
a well-rounded education for them against all odds. It is
indeed a privilege to be able to support them toward their
education and their ability to find gainful employment.
https://qcct.org.au/ourappeals/anugrah-home-forchildren/
We were also able to officially open our new classroom.
The location is the new office of the local community
leader who has kindly offered to let us use the space.
It’s close to the childrens’ homes however our team ensure
the kids are escorted to and from classes every day.
We are currently preparing to celebrate Christmas in
mid-December for 50 children who are past or present
students of the BSEP family.
https://berniesmithep.wixsite.com/berniesmithep/home
These wonderful children have progressed through our
kindergarten program with majority then able to enter the
public school system to continue their education.
Their parents work hard every day to provide the basics
for their children, however, we’re planning to give them a
little extra by way of a food hamper for the festive season.
Projects The Philippines
Recently our team of 12 Pilots and Cabin Crew carried out
eye testing working in partnership with The Fred Hollows
Foundation. We screened the children of the Bernie Smith
Educational Program (BSEP) family and of Ang Bahay
ParolaGrace home for boys.
Of the 50 children screened, 30 required eyewear or
procedures to rectify. This is a higher percentage than
anticipated. We wanted to send a huge thank you to
all involved in making this possible including all of the
optometrists, staff and volunteers from the Foundation,
our amazing team of crew who gave up their rest time in
Manila to assist with testing and, most importantly, our
outstanding donors who generously gave to ensure the
children were able to receive their glasses.
Last month 13 Pilots and Cabin Crew visited Mercy
Centre and the surrounding community. They
were able to visit the homes of some of the more
vulnerable in the local area and providing food
donations during their slip time. The team were
honoured to have Trish from operations travel with
them to be part of their trip. Sending a huge thank
you to Trish for all of your support!
Projects Australia
https://qcct.org.au/ourappeals/help-australian-farmers/
QCCT Projects Australia continued their great work in
helping more farmers from our beautiful country. Our
team of Qantas engineers and flight attendants flew into
Adelaide before embarking on a 6-hour drive Northwest
to the sheep station “Buckleboo”.
During Covid, it was a hard time for QCCT Projects,
during this time the Buckleboo station manager contacted
Projects Australia, and thanks to him we have been able
to continue helping farmers during the pandemic.
With our paying it forward “attitude” and now borders
are open, it’s time to return the favor.
And we sure did!
Despite the weather, we got the jobs done…
The job list was a challenge, but the team was up to
the task.
Projects South Africa
https://qcct.org.au/ourappeals/nkosis-haven-village/
We are currently planning our first visit to Johannesburg
since borders have reopened with a crew travelling
in early December. The crew will be visiting Nkosi’s
Haven to catch up with everyone after more than two
years. They’re planning a Christmas event as well as
looking at what more needs to be done in the new
year. We can’t wait to see everyone again!
Our clothing drive is on again!
If you have any clothing suitable for any age, male
or female, please message us via our Facebook page
https://www.facebook.com/QCCTManila and leave in
the baggage room at Joy. If you’re heading on a trip to
Manila, please leave it with the hotel Concierge.
Buckleboo is a
250,000-acre
property, this
sheep farm is also
leading the way
in sustainable
farming and land
conservation.
Renovations of the
meat house, with
painting and fly
