Prevention <strong>of</strong> Pollution<br />
18.5 AIR POLLUTION<br />
18.1 OBJECTIVE<br />
18.5.1 All engines with a power output <strong>of</strong> greater than 130kW, installed on a <strong>MASS</strong> <strong>of</strong> any size, or a <strong>MASS</strong> in commercial<br />
use for sport or pleasure over 24 metres length (as measured using EC Directive 2013/53/EU), constructed after<br />
1st January 2000, should be issued with an Engine International Air Pollution Prevention (EIAPP) Certificate <strong>and</strong><br />
a Technical File, according to schedule 2 <strong>of</strong> MSN 1819(M+F).<br />
The objective <strong>of</strong> this Chapter is to provide guidance on the considerations <strong>and</strong> requirements necessary<br />
for <strong>MASS</strong> to meet the provisions <strong>of</strong> the IMO MARPOL Instrument <strong>and</strong> Annexes.<br />
18.2 GENERAL<br />
18.5.2 A <strong>MASS</strong> less than 24 metres certified as a <strong>MASS</strong> in commercial use for sport or pleasure is not required to carry<br />
an EIAPP certificate if it is compliant with EC Directive 2013/53/EU. Further guidance on air emissions regulations<br />
can be found in MSN 1819 (M+F)85 <strong>and</strong> the Merchant Shipping (Prevention <strong>of</strong> Air Pollution from Ships). There<br />
are additional requirements for compliance with IMO MARPOL Annex VI Regulation 13 (NOx emissions) that<br />
require a vessel operating in an Emissions Control Area (ECA) to be fitted with engines compliant to IMO Tier III,<br />
certified by an Engine International Air Pollution Prevention (EIAPP) certificate.<br />
18.2.1 A <strong>MASS</strong> complying with the <strong>Code</strong> should meet international, national, regional <strong>and</strong> local requirements for the<br />
prevention <strong>of</strong> marine pollution which are applicable to the area in which the vessel is operating.<br />
18.2.2 Responsibility for the <strong>MASS</strong> to be properly equipped <strong>and</strong> maintained to meet the prevailing requirements rests<br />
with the Owner/Operator.<br />
18.6 BALLAST WATER<br />
18.6.1 <strong>MASS</strong> should comply with the International Convention for the Control <strong>and</strong> Management <strong>of</strong> Ships’ Ballast Water<br />
<strong>and</strong> Sediments (2004) as applicable.<br />
18.2.3 It is also the responsibility <strong>of</strong> the Owner/Operator to ensure that a charterer <strong>of</strong> a <strong>MASS</strong> receives up-to-date <strong>and</strong><br />
adequate information on prevention <strong>of</strong> pollution in the area in which the charterer intends to operate. The<br />
information may include the need to seek advice from local or harbour authorities, for which contact details should<br />
be given.<br />
18.2.4 The disposal <strong>of</strong> ship generated waste to port reception facilities is regulated in the <strong>UK</strong> through the Merchant<br />
Shipping <strong>and</strong> Fishing Vessels (Port Waste Reception Facilities) Regulations 2009 (SI 2009 No.1776), as<br />
amended. Further guidance on the applicability <strong>of</strong> these Regulations can be found in MGN 563 - Port Waste<br />
Reception Facilities Regulations 2003 <strong>and</strong> the “Port Waste Management Planning – A Guide to Good <strong>Practice</strong>”<br />
booklet available as an annex to MGN 563. <strong>MASS</strong> operators should ensure they manage their waste in a<br />
sustainable manner <strong>and</strong> fulfil the applicable requirements (if any) <strong>of</strong> these Regulations.<br />
18.2.5 All <strong>MASS</strong> should comply with the requirements <strong>of</strong> <strong>UK</strong> Regulations implementing MARPOL <strong>and</strong> environmental<br />
protection requirements as applicable to the size <strong>and</strong> operating area <strong>of</strong> the vessel.<br />
18.3 OIL POLLUTION<br />
18.7 USE OF ANTI-FOULING COATINGS AND PAINTS<br />
18.7.1 On the 5th October 2001, the IMO adopted the International Convention on the Control <strong>of</strong> Harmful Anti-Fouling<br />
Systems on Ships. This Convention prohibits the use <strong>of</strong> environmentally harmful organotins (for example, Tributyl<br />
Tin) in antifouling paints applied on vessels, including <strong>MASS</strong>, <strong>and</strong> prevents the possible use in the future <strong>of</strong> other<br />
harmful substances in anti-fouling systems. The Merchant Shipping (Anti-fouling Systems) Regulations 2009<br />
(SI 2009 No. 2796)83 apply to <strong>MASS</strong>.<br />
18.7.2 As a result <strong>of</strong> EC Regulation EC 782/2003 on the prohibition <strong>of</strong> organotin compounds on ships, it became<br />
compulsory for all ships in the EEA not to apply or re-apply organotin compounds which act as biocides in antifouling<br />
systems from 1st July 2003. For vessels less than 24 metres in length it is not necessary to provide for a<br />
specific survey or declaration.<br />

18.3.1 <strong>MASS</strong> should retain on board oil or oily mixtures for discharge to shore facilities.<br />
18.4 GARBAGE<br />
18.4.1 Being crewless, operation <strong>of</strong> the <strong>MASS</strong> should not generate substantial quantities <strong>of</strong> garbage or similar.<br />
However, any maintenance or cargo h<strong>and</strong>ling operations aboard which generate such arisings must comply with<br />
the provisions <strong>of</strong> the MARPOL annex as appropriate to the size <strong>of</strong> the vessel <strong>and</strong> material generated.<br />
