Gala Dinner 2023
After the excitement of the Christmas and New Year festivities,
going back to a regular routine is enough to lower anybody’s
spirits. Experts agree that a good way to alleviate this feeling
of post-holiday blues is to have something to look forward to. That’s
where the Institute of Vehicle Recovery’s AGM Gala Dinner comes
in, an opportunity to catch up with industry friends and colleagues
over a meal, to let your hair down, to enjoy the great entertainment
and to dance the night away. Spending time with others can be one
of the greatest mood boosters and you can rely on the IVR to take
the strain out of booking your weekend away.

Richard Goddard’s article in the issue of Professional
Recovery Magazine dated November 2022 (page 14) has
much to commend it, highlighting as it does the critical
role played by road recovery operators in keeping the nation’s
roads clear, and in protecting the safety of the travelling public.
The work these operators undertake is critical to the safe
functioning of the road network, and they clearly work in a highrisk
environment.
Unfortunately, there are some erroneous points and
implications in Mr Goddard’s article regarding TRL’s role, and I
would be grateful if you would publish this letter in full so your
readers can be fully informed.
1. Mr Goddard notes that a 2009 TRL report ‘raised the point’

2009 report, or in any other report. It was presented as a finding

person as a personal reflection on what the recovery industry
felt at the time, regarding the use of red lights by Traffic
Officers.
2. Mr Goddard notes that he wrote to TRL “…who we’re
(sic) despite being researchers and authors of the National
Highways report I’ve just referred to, have again been
commissioned by the DfT, to again research our request to use
Red Lights.” TRL cannot accept the implication here that it is
not qualified or possessed of the necessary independence to
undertake this work. As I explained to Mr Goddard when I met
him at Highways UK in November 2022, TRL is an independent
research organisation. It is completely separate from DfT (it
was privatised in 1996) and won the research contract for this
work in open competition as part of a formal procurement
process. TRL’s independence in this matter (and all research it
undertakes) is a central part of its mission and values.
3. Finally, Mr Goddard suggests that “…DfT continue to
waste public money commissioning worthless research…”.
A previous TRL review (mentioned in the letter from Grant
Shapps that Mr Goddard reproduces in his article) examined
evidence from published studies on the actual effectiveness
of red lamps on conspicuity in a range of on-road situations.
The current research has gathered evidence directly from
drivers (on a track, and in a high-fidelity simulator) on the
actual effectiveness of red lamps on a road recovery vehicle
in terms of being seen and understood by approaching
drivers. It has also examined other technologies that may
help with the conspicuity of road recovery operators
and produced guidance with inputs from road recovery
industry representatives. I cannot agree with Mr Goddard’s
statement that such research – designed explicitly to find
ways of improving the safety of road recover operatives – is
worthless. I hope that he will review the reports’ contents and
recommendations, when they are published, before making
further comments on the best way forward.
Mr Goddard is clearly passionate about the safety of those
working in the recovery industry, and by his own admission
has displayed some tone in communications around this
topic that echoes his anger and frustration. I do hope that
future communications can start from a shared desire to see
improvements in safety, with any passion and anger directed
firmly towards finding effective solutions.

It’s time to jump in that DeLorean and travel back in time, the story starts back in 2006
when the RHA recovery group petitioned government to review statutory fees. This
came about following sharp practices from a firm leaning on a recent court case that
went against a Midlands-based recovery operator, all will be revealed, read on...
The first statutory fee came into play back in the 1950s, I can
only imagine it was worked out on the back of a fag packet.
It was initially used as a fee to remove vehicles illegally
parked or causing an obstruction in London, or so I was led to
believe many years ago. This soon became part of the road traffic
regulations. Of course, once something is set into legislation
it takes decades to make any changes, especially if there’s no
provision for change. Back then the whole charge matrix was the
£105.00 recovery, £12.00 per day storage and £50 Disposal.
Five decades later and this fee was still set in stone and was
seriously holding back the recovery industry, with some major
issues around non-payment and over charging of the fees.
Without going into too much detail, as that may bring on some
nightmares, if an operator charged fair and reasonable charges
above the £105, then in general those charges would be paid.
Some insurance companies were challenging this quoting
the case of The Mansfield Group vs NYK Logistics. If you look it
up, the claim particulars state The Mansfield Group requested
an undisclosed amount but from memory I think it was in the
region of £10k. The case was won by NYK, and upheld against The
Mansfield Group. The judge ruling that NYK Logistics was right to
refuse the Mansfield bill above the £105.
Not to mention any names, but a certain individual (many know
who), was using the case in favour of other logistics companies,
with some financial arrangement, possibly ‘no win no fee’ and
getting any fees charged over the £105 rejected, all based on the
legal case of “Mansfield Group v NYK Logistics”.
It was that lobbying by the RHA I referred to in my opening
paragraph that set the wheels in motion, and it was then
announced by the Home Office, they were to carry out a review
of statutory charges, but as yet no date was set.
Fast forward that DeLorean to 2007. The Home Office issued
a consultation for the revision of statutory fees. This was a
watershed moment for the recovery industry, as statutory

charging had stayed £105 for a recovery and £12 per day storage,
£50 disposal, for as long as you could remember.
Without delay, and with the full backing the RHA, an RHA
RRG statutory fee working group was formed to deal solely
with the consultation. Hundreds of hours were spent building a
full working business model. No stone was left uncovered, the
detailed cost modules looked at everything, overheads, vehicle
cost, driver’s wages, you name it, we even catered for the cost of
the toilet roll.
All this data was used to produce an in-depth report passed
directly to the Home Office and supplied as evidence-based
data. I know the level of detail this report delivered as I was
part of the RHA working group along with John Coupland, Mark
McAllister, Robin Downy, Ray Coleman and some others, whose
name escapes me, sorry.
The process was taken very seriously by the Home Office as
they appointed PA consultants to deal with the process, several
meetings in Westminster Palace and at PA Consultants office.
The result we all know, published in 2008 was the new
scenario charging table, adopted 1st October 2008, The removal
storage and disposal of vehicles (prescribed sums and charges)
regulations 2008. Those new recovery descriptions, on road, off
road, laden and unladen, substantially damaged, all became new
industry vocabulary.

You’re probably asking what’s the point of going back to
2007, 2008. Well, I think it’s relevant to remind ourselves what
happened and when, what should’ve happened in terms of
annual reviews, but never happened.
Jump start that DeLorean, or just wind the clock forward to
2021, after a lot of requests to review the charges again, and
not just from the recovery Industry, as the Metropolitan Police
Service (MPS) and the National Police Chief’s Council (NPCC)
also did their own lobbying, an overdue consultation was
published. Whether you participated or not, or in some cases,
if you even knew about it, there was a fresh consultation,
carried out in 2021.
The consultation did drag out, because AVRO requested
an extension - I never did understand why that was, as there
was plenty of time to get involved and to have your say.
Anyway, that is the fact of the matter and now in the history
books, unfortunately we have seen the revolving door of No
10 and every excuse possible to drag this out, minister after
minister and far more important matters than the poor orphan
recovery operator.
What our magazine readers and the wider industry don’t
realise is how supportive the MPS and the NPCC have been,
realising how important this consultation and the financial
increase will be on the recovery industry. They have been
fighting the corner for the recovery industry to increase the
fees, working closely with the Home Office pushing on the door
until it has opened with this positive result.
Consultation
If you didn’t already know, the consultation results were
published on the 10th of January 2023, yes last week. Following
the Home Office reviewing the consultation results, there were
several options available to them. One was to do nothing and
continue to kick the problem deeper into the long grass, along
with the red-light debate! The second option was to select one
of the revised tables with an intention to pursue an increase
of the charges. They have decided to pursue the increase and
have selected “Inflationary Increase Option 2”, if you want
to see the other options that were available, you will need to
check out the link below.
This table of charges shows an average increase of some
28%. The Scenario quoting “Vehicle on road upright and not
substantially damaged or any two wheeled vehicle whatever its
condition and position on or off the road.”
Today this recovery job valued today at £150.00 increased to
£184.00 and the £250.00 job increased to £306.00.
The next steps from government will be to make statutory
provision to increase vehicle recovery charges within several
different regulations, there is far too many to list.
Further commitment from the Government, they will
then undertake the necessary policy development and
further engagement with industry stakeholders to gather the
appropriate evidence pertaining to EV and Hybrid vehicles. The
Home Office will work with the Department for Transport DfT,
police and recovery industry, to address these issues, (their
words not mine), with a fresh consultation set before 2025.
This is very good news for the recovery industry, especially
when you hear on the news about so many industries call for
8% to 10% increases, and other industry’s having to strike to
get their point across., I understand this is not a salary review,
this is a small part of your operating costs, and only if you’re a
Police or NHSS17/17B National Highways contracted operator.
This does however set a precedent to those other companies
who call on the independent operator to deliver roadside
rescue and recovery. The work around Police contracts is not
done, in fact its only just started.
I believe it’s very important to thank a few individuals, some
by name as they have truly gone out of their way to directly
support the independent recovery industry, without their
support this would not have been achieved. The amount of
work gone into this must have eroded into their personal time
and massively on their conscience.

What better than to print an email addressed to Terry Hunt,
Chair – NPCC Vehicle Recovery Group.
Dear Terry,
Thank you for announcing what I believe to be a fair and much
needed increase to the Statutory Fees for the removal of vehicles
under the removal storage and disposal of vehicles (prescribed
sums and charges) regulations 2008.
Many people within the recovery industry will say it has been
a long time coming, however my honest opinion is without the
hard work, determination and positive contributions made by
yourself, Mick, and Mat, I truly believe “Stat Fees” would still remain
unresolved, and possible stay that way for many years to come.
Could you also forward mine and my team within PROF that works
alongside me, our thanks to Tracey Cattlin for her willingness to
meet with me and PROF and without hesitation, openly discuss the
proposed increases to the fees.
I would also respectfully ask that mine and again my PROF
supporters, thanks and observations are passed onto your Chief
Constable!
I am not sure how easy it was to convince your hierarchy to
commit to a partnership agreement, with PROF, but I am sure your
commitment and input to the partnership agreement has now
paid positive dividends, not just with the success around Statutory
Charges, but going forward across the board in all matters Vehicle
Rescue and Recovery!
I strongly feel that between yourself Mick and Mat, our constant
and regular dialogue, and your willingness to open positive avenues
of communication between ourselves, and Tracy Cattlin, from the
Home Office made it so much easier to discuss the changes needed
and in fact come to a positive conclusion beneficial to all parties
involved! PROF sees the success around stat fees as only the
beginning.
The recovery industry itself, is now much more trusting and aware
that the NPCC are willing to work and collaborate constructively
with VROs, our relationship is helping to pave the way for future
dialogue regarding police contracts, safety, and the raising of
industry standards.
The NPCC, has now become a positive and personal entity now
known and respected within our industry, this will be a strong
currency in future collaborations!
This outcome may in some eyes, be seen as a victory of sorts,
by others, and I mean The Professional Recovery Operators
Federation (PROF), recognise and acknowledging this as a victory
for the partnership agreement, made possible by your trust in
working with us.

Finally, there’s always been the fear that any increase in statutory
fees would be eaten into by the managing agents, who would
simply dip their hands into the pockets of the recovery operator
and increase the agent’s fees.
Well National Highways have set the precedent against this
happening. As soon as this announcement was published the
following statement was made by National Highways, another
partnership agreement we should be proud of, without the
relationship we enjoy, I doubt this level of support would ever have
been achieved.

Home Office announcement on the statutory removal charges
The Home Office have announced today their intention to pursue
an increase to the statutory charges in relation to removal, storage
and disposal of vehicles.
National Highways have listened to the concerns raised by our
strategic recovery partners and have committed to passing on the
increase in the statutory charges to the vehicle recovery operator
(VRO) supply chain working on the National Highways’ Vehicle
Recovery contract. The increase will be applied when the change to
the statutory charges comes into law.
VROs under our contract are always paid for their work, but we
recognise we need to do more to support a sustainable roadside
rescue and recovery sector. We have therefore decided that it
is right that any increase in statutory charges goes directly to the
VROs who work under our contract.
So that’s National Highways and FMG in full support, now let’s hope
the other managing agents or in house schemes follow suit, and
pass the whole fee increase to the independent operator, and do
not find a way to add a stealth tax and take more from those who
deserve it, the independent recovery operator.
A united victory for a united industry. The real winners were
the strategic partners working together for the industry, with the
industry, as an industry.

Vehicle Charges Government Response
At a time when this country is in an economic crisis and
public sector workers are striking for 10-12% pay rises.
It’s a massive concession that has been given to us by the
Government of a 28% increase in the statutory fee. Not that
it isn’t well deserved and a long time coming, however, what’s
right isn’t always what’s right, and the Government have flown
in the face of public perception and given us the increase.
Another massive concession has been the negotiations
with ourselves and National Highways, and their negotiations
with FMG. Allowing us to keep the total increase is a
watershed in the recovery industry and will have a massive
impact financially. I thank FMG for that and National Highways
for the consultation over it. I only hope that the concession
offered will make other third party management think twice
before trying to take any percentage of statutory increases;
our first since 2008. I’m hopeful that these companies will
believe that the industry should receive all of the increase;
the Government has given the increase to the recovery
industry, not the management companies.
It’s a great start to the new year and hopeful that it’s
just the beginning. We continue to work with our strategic
partners who have been instrumental in this economic
watershed and the upturn in statutory fee charges. I hope
this will be carried on to the real problem which is police
contracts. I hope the positive dialogue, consultation and
attitude shown by the Home Office, Police and all of our
strategic partners will allow us to improve police contracts
which will be another positive step forward.

from the Home Office is very welcome
by our members and the wider industry,
but it is felt that Government’s proposal
falls far short of the fee increase that is
actually needed to meet the spiralling
costs that have crippled our members and
industry since 2008.

We are disappointed that the Home Office have rejected
calls for increases to be in line with vehicle running costs,
as AVRO called for, and have chosen a framework that
was initially rejected by nearly 70% of respondents. The current
situation has been made worse by predications that inflation will
rise by 10% this year alone, meaning the grim reality is that our
industry will continue to face huge economic uncertainty in 2023
and beyond.
We do however acknowledge that the Home Office have at least
recognised the financial pressures on our members and industry
and amended the proposed increase from 22% to 28% as well as
commitment to a further review in 2025. It is in this 2025 review
that the Home Office have indicated their intention to review
statutory fees in respect of alternatively fuelled vehicles (EV’s) – we
are disappointed about that despite AVRO making a case for these
vehicles to be included within this review we will however continue
to make a strong case that action must be taken in regards to such
vehicles and their impact on the roadside recovery industry.
We also feel that the Home Office’s findings as well as the wider
consultation represent a missed opportunity in regards to the
operation and management of Police contracts and the practice
of large amounts of the statutory fees being taken by middle
management organisations.
We are very encouraged by the work being undertaken by the
NPCC (National Police Chiefs Council) in particular the Vehicle
Recovery leads within the NPCC who have listened and identified
the need for a fairer arrangement for the roadside recovery
industry and are pleased that a meeting is to be held in February
2023 led by the NPCC Vehicle Recovery leads which will involve
each Police Force and their vehicle recovery and commercial leads.
AVRO will support the NPCC in their initiative and continue to work
closely with them.
On that note we would like to take the opportunity to thank both
Terry Hunt and Mick Burke of the NPCC Vehicle Recovery team for
their hard work, dedication, and support in achieving the review of
the statutory fees.
We would further note that National Highways have confirmed
that the increase in statutory fees will be passed on in its entirety to
the roadside recovery operator and not their management agent.
This is very welcome news, and we encourage all others to follow
suit.
A lot of hard work and dedication to this issue has been brought
to bear within AVRO to achieve this review, it may well not be a case
that we have achieved everything which we set out to achieve, far
from it – but we will continue to work with our colleagues, partners
and other stakeholders to continue to push for that fair and
transparent system of statutory fees which allows our members and
the wider industry to continue to provide the much needed and
crucial service that it does to all road users, organisations and public
bodies.

Eastern General Recovery
Eastern General Recovery continues with its fleet renewal
and expansion with the addition of two new recovery
vehicles.
“Even though we’re based in Essex, much of our work is
inside the London Ultra Low Emission Zone,” said General
Manager John Cox.
Working for clients that include motoring organisations
and insurance companies means that Easter General
Recovery’s green credentials need to be exemplary. For
this reason, their two new vehicles meet the stringent ULEZ
clean air requirements.
The new Peugeot 3.5tonne beaver-tail recovery vehicle
powered by a Euro-6 engine has an interesting new feature.
The vehicle built by Advanced KFS Special Vehicles includes a
central track that allows the recovery of motorcycles.
John Cox says, “the genius of this development is its
simplicity. It’s a wonder no one thought of this before. It
means one operator can recover a motorcycle without
incurring additional damage.”
Another new addition is an Iveco 70C 7-tonne tilt-andslide
recovery vehicle from Boniface Engineering. With
one-person operation capabilities and a crew cab that can
accommodate up to six passengers.

Now have a look at this nifty new wheel nut socket from
Laser Tools — one socket that actually fits four wheel-nut
sizes! It’s a half-inch-drive, double-ended wheel-nut socket
(part number 8458), that features a spring-loaded insert at each
end that enables it to accommodate four different sized wheel
nuts in total: 17, 19, 21 and 22mm. This innovative space saving

and is ideal where storage space is limited.
Each end includes an internal sliding socket insert that moves
out of the way when the larger size is required, provided two
socket sizes at each end. At 78mm long, the socket is suitable

77mm long 1/2 “ drive extension bar which makes this an ideal
combination for an emergency tool kit providing both space and
weight savings.
