WELCOME
CMI planners would like to welcome everyone to this
online community consultation.
This online article has been prepared in relation to the
retrospective mixed use development to include a
shed sub-divided with approx 2/3 use for farm storage
and 1/3 use for recycling of metal products.
Retrospective farm silage pits, weighbridge, yard, lane
& entrance at lands approx 200m south-west of 27
Lurgylea Road, Galbally, Dungannon.
An integral part of the planning application process is
public engagement . Therefore, we invite you to take
the time to view the work prepared to date to support
the preparation of a forthcoming planning application.
A statutory part of the pre-application is to engage
with the local community and invite your feedback.
All feedback received is welcome and all matters
raised will be taken into consideration prior to the
submission of a planning application to Mid Ulster
District Council.

COMMUNITY CONSULTATION
INTRODUCTION
This community information pack follows a Proposal of
Application Notice (PAN) submitted to Mid Ulster
Council on 30 th January 2023 in accordance with the
Planning (General Procedures) Order (Northern
Ireland) 2015.
The PAN notifies the council that a formal planning
application will be submitted after the required 12
week notice period expires.
The PAN was accepted by Mid Ulster District Council
on 1 st February 2023.
The statutory provisions which set out the
requirements for PACC are found in the 2011 Act, The
Planning (Development Management) Regulations (NI)
and The Planning (General Development Procedure)
Order (NI) 2015.
Engaging communities is an essential part of an
effective and inclusive planning system. Where
applicants engage in meaningful pre-application
consultation, local communities can be better
informed about development proposals and have an
opportunity to contribute their views before a formal
planning application is submitted.
PRE-APPLICATION COMMUNITY
CONSULTATION STRATEGY
The pre-application community consultation strategy
was developed to take into account the development.
The aims of the strategy are:
•To ensure the community consultation process is
open and inclusive
•To engage the community as effectively as possible
•To ensure the community has easy access to
information and are aware of the details of the
proposed development
•To ensure the community are confident and
comfortable to put forward their own ideas and feel
confident that their opinions will be taken into
consideration
•To ensure the community has an active role in
developing this proposal
•To ensure the opinions and comments received are
considered and the proposal where appropriate is
amended to respect this

PRE-APPLICATION NOTICE ( PAN )
PRE-APPLICATION NOTICE (PAN)
Section 27 of the 2011 Act requires that, prior to
submitting a major application the applicant must give
notice, known as a ‘proposal of application notice’
(PAN), to the appropriate council. There must be at
least 12 weeks between the applicant giving the notice
and submitting any such application.
A Pre-Application Notice (PAN) was submitted for this
development to Mid Ulster District Council on
30 th January 2023. In a letter dated 1 st February 2023
from Mid Ulster District Council, they confirmed
receipt of the PAN and noted that the application must
not be submitted any sooner than 12 weeks from the
date the pre-application was received.
The PAN 1 form submitted to Mid Ulster District
contained the adjacent information.

CONSULTATION METHODS
CONSULTATION METHOD 01 –
PUBLIC ADVERTISEMENT
A public advertisement was placed in the local
newspaper, the Mid Ulster Mail on 16 th February 2023
detailing the upcoming public meeting (see annex 03
for a copy of the advertisement wording).
As required by The Planning (Development
Management) Regulations (NI) 2015 the proposed
meeting was advertised at least 7 days before the
meeting. The advertisement was published on 16 th
February 2023 with the public event scheduled 8 days
later on 24 th February 2023.
The advertisement published in the Mid Ulster Mail
contained the following;
• a description of the development
• location of the development
• the date, time and place of how to provide comment
• details that further information concerning the
development can be obtained online by visiting CMI
Planners website with a link provided
• details as to how, and by when, persons wishing to
make comments to the applicant on the proposal may
do so
• advised that comments made to the applicant are
not representations to the council, and there will then
be an opportunity to make representations to the
council if an application is submitted.
CONSULTATION METHOD 02 –
PUBLIC ONLINE MAGAZINE
A public online consultation article has been provided
on the CMI Planners website ( available by clicking this

This online consultation was available for comments
from the public to be submitted via an online form
before end of day on 24 th March 2023.
The online consultation article was chosen as it easily
accessible to all audiences. Information of the
development has been displayed within this article
for viewing .

the article can be requested via telephone on

Any concerns submitted by the public via the form on
the CMI Planners website will be recorded by CMI
Planners.

EXISTING SITE & DEVELOPMENT

EXISTING SITE
The site, 1.48 hectares in total including the laneway
and visibility splays, comprises the unauthorized
erection of a shed, farm silage pits, weighbridge, yard,
lane & entrance approx 200m south west of 27
Lurgylea Road, Galbally, Dungannon.
Planning Approval, Ref: LA09/2019/0669/F, had been
previously obtained for a Proposed cattle shed &
retention of uncovered open front silage pits at this
location.
The site is bounded by existing planting along the
south-western and north-western boundaries. The
north-eastern and south-eastern boundaries are
bounded by concrete retaining walls. The topography
of the site falls sharply from the Lurgylea Road down
to the existing site. An access and laneway has been
provided directly onto the Lurgylea Road.
SURROUNDINGS
The immediate surrounding lands are rural land in
agricultural use.
To the north-east of the site are multiple dwellings
which span along the Lurgylea Road eastwards
towards a small built up area including St Josephs
Primary School and a housing development.
The local GAA club (Galbally Pearses) and multiple
housing developments are located approx 0.2 miles
north-west off the site.
DEVELOPMENT
The proposal seeks approval for retrospective mixed
use development to include a shed sub-divided with
approx 2/3 use for farm storage and 1/3 use for
recycling of metal products. Retrospective farm silage
pits, weighbridge, yard, lane & entrance.
The existing planting at the south-west and northwest
boundaries of the site will be retained and
augmented where appropriate.
Proposed native species trees shall be planted along
the north-eastern boundary of the site and native
species hedging shall be planted along the southeastern
boundary to sensitively screen the site from
public view and integrate the development within the
surrounding context.
A Drainage Assessment is currently being prepared for
the site and a detailed report will accompany the
planning application.

WHAT HAPPENS NEXT?

Following the end of the consultation period, your
feedback will be taken into consideration in finalising
the development.
A formal planning application will be submitted to Mid
Ulster District Council thereafter, following the end of
the 12 week notice period for public consultation.
The application will be accompanied by technical
reports and detailed application drawings for
consideration by the local council and its statutory
consultees.
Once submitted, the opportunity for public
engagement in the decision making process will occur
in the normal manner. Representations will be
submitted to the council following the application’s
advertisement and neighbour notification procedures.
