maturity, the issue of undue influence, and the relevance<br />

of information and practical affairs. The standards<br />

compared and critically reflected upon. This book sets<br />

The World Health Organization and UNICEF have<br />

repeatedly sounded the alarm regarding unhealthy food<br />

marketing, childhood obesity and non-communicable<br />

diseases. Human rights bodies, like the Committee<br />

convincing, detailed account of states’ obligations<br />

and how states can restrict unhealthy food marketing<br />

without violating other treaties to which they are party.<br />

Furthermore, the book presents a blueprint for what<br />

a child rights approach to regulating unhealthy food<br />

of unhealthy food marketing in the European Union,<br />

spanning consumer protection, media law and data<br />

This book focuses on the protection of abducting<br />

mothers who have been subject to return proceedings<br />

under the 1980 Hague Abduction Convention and<br />

the Brussels IIa Regulation, in circumstances where<br />

the child abduction has been motivated by acts of<br />

domestic violence from the left-behind father. The<br />

utility of Regulation 606/2013 on mutual recognition<br />

of protection measures in civil matters and Directive<br />

2011/99/EU on the European Protection Order, and how<br />

protection measures can be used to protect abducting<br />

mothers, are examined within this context. Both<br />

instruments allow cross-border circulation of protection<br />

measures but, so far, have not attracted much attention<br />

in practice. This book aims to fill that gap.<br />

Domestic Violence and Parental Child Abduction is<br />

the culmination of the POAM (Protection of Abducting<br />

Mothers in Return Proceedings) project, a collaborative<br />

research project conducted between 2019 and 2021.<br />

It presents and analyses the findings of the project and<br />

brings together contributions by the project partners,<br />

as well as by other renowned experts. The book also<br />

presents a Best Practice Guide developed for the<br />

application of Regulation 606/2013 and Directive<br />

2011/99/EU in child abduction cases committed against<br />

the background of domestic violence.<br />

The book offers a unique perspective on the problem<br />

of international parental child abductions committed<br />

against the background of domestic violence. Given its<br />

practical focus, it will appeal not only to an academic<br />

audience but also to judges, legal practitioners and<br />

other professionals working in the area of parental child<br />

abduction.<br />

Over the years, no aspect of comparative law has drawn<br />

and kept the attention of comparatists more powerfully<br />

than the relationship between culture and law.<br />

What emerges from the pages of this volume cannot<br />

be summed up in a single or even a series of abstract<br />

propositions. Rather, each chapter confirms the<br />

specificity of the circumstances under which culture and<br />

law interact in myriad ways. What binds the contributions<br />

together is that each identifies in different perspectives<br />

the intertwinement of culture and law.<br />

Each author presents this intertwinement, both<br />

analytically and critically, in novel and stimulating<br />

explorations of the subject. The narratives are wideranging,<br />

but each records, in its own way, the results to<br />

which it led. What binds these narratives together is that<br />

each identifies the characteristics of this interaction.<br />

Excellence in comparative law scholarship may validly<br />

be measured by the extent to which the findings it<br />

reveals serve over time to test hypotheses to which<br />

This book explores the right of access to environmental<br />

information, considering both the environmental<br />

aspirations which underlie the right and how the right is<br />

used in practice.<br />

Basing its findings on qualitative research conducted in<br />

Scotland, the book identifies that individuals who seek<br />

environmental information under the right are often<br />

doing so for personal or professional reasons that do not<br />

further the right’s environmental purpose.<br />

The book uses Actor-Network Theory to discuss this<br />

divergence between theory and practice. It challenges<br />

the implicit assumptions which underpin the right and<br />

hinder the achievement of its environmental aims,<br />

identifying the overly-simplified conceptualisation of the<br />

parties who engage with the right as well as the failure<br />

to consider the impact that non-human actors have in<br />

the operation of the right.<br />

These findings provide a unique insight into the nature<br />

and operation of the right to environmental information<br />

and present the foundation for further inquiry into the<br />

right, its implementation and its relationship with wider<br />

freedom of information laws.<br />

Sean Whittaker is a lecturer in law at the university of<br />

dundee, where he specialises in public law, information<br />

law and comparative law.<br />

Colin T. Reid is professor of environmental law at the<br />

university of dundee, working on various environmental<br />

law and public law themes, especially biodiversity and<br />

devolution. He is a patron of the uk environmental law<br />

association.<br />

Jonathan Mendel is senior lecturer in human geography<br />

at the university of dundee. His research focusses on<br />

This book focuses on the development of marriage<br />

law in Ireland from 1937 to the present day, examining<br />

the relevant historical legal background to changes in<br />

the law in the 20th and early 21st centuries. It draws<br />

on legal sources and historical and empirical evidence<br />

about the reality of family life in Ireland, to raise<br />

broader questions about the appropriate role of law in<br />

establishing, preserving and developing inclusive social<br />

understandings of marriage. The impact of accurate<br />

empirical data about family life, external international<br />

influence and sustained activism as drivers in achieving<br />

meaningful social change is also evaluated.<br />

This original viewpoint highlights the initial ideological<br />

importance of marriage regulation in Ireland and its<br />

connection to national identity in a Catholic country.<br />

Historically, asymmetric social rules concerning marriage<br />

allowed those in power to favour particular religious<br />

groups; first the Protestant elite and then the Roman<br />

Catholic majority.<br />

Protecting a Catholic idea of marriage was an important<br />

consideration when drafting the founding documents<br />

of the Irish state. Article 41.3.1° of the 1937 Irish<br />

Constitution enshrines the institution of marriage as<br />

the only recognised basis for the family and pledges<br />

to protect marriage from ‘attack’. This protection has<br />

acted throughout the late 20th and early 21st centuries<br />

both as a basis for liberal judicial development of family<br />

law principles and an obstacle to meaningful statutory<br />

modernisation, fossilising a traditional understanding<br />

of marriage as the bedrock of Irish family law. Up<br />

until the end of the 20th century, the state’s ‘secular’<br />

understanding of marriage was generally inseparable<br />

from its acceptance of traditional Catholic norms.<br />

However, the adoption of same-sex marriage in Ireland<br />

in 2015 marked a substantial change in traditional<br />

attitudes to marriage and the social role of the family<br />

unit. This book critically highlights the role played by<br />

the ideal of constitutional protection of marriage and<br />

existing legislative structures in initiating and delaying<br />

family law reform.<br />

This book presents comparative perspectives on two<br />

main issues. The first is whether, and if so, how, family<br />

law recognises that a child can have multiple parents.<br />

The focus falls on stepfamilies; families where children<br />

are raised in more than one household; polygamous<br />

families; families where children have been adopted<br />

but maintain links with their biological families; families<br />

where children are cared for in terms of a kafala<br />

arrangement; families where a child was born as a result<br />

of donor-assisted reproductive technology; families<br />

where a child was born as a result of ‘three-parent’<br />

medical technology; and families where a child was born<br />

as a result of surrogacy. The second main issue is which<br />

family functions are recognised and favoured by the<br />

law, and whether the presence of children in the family<br />

makes a difference in this regard.<br />

Article 12 of the UN Convention on the Rights of<br />

Persons with Disabilities (UNCPD) recognises the equal<br />

right to exercise legal capacity without discrimination<br />

based on disability, and obliges state parties to ensure<br />

access to the support a person may require in exercising<br />

it. Since its adoption, there has been a growing body of<br />

work critically examining laws which restrict or remove<br />

the exercise of legal capacity based on disability.<br />

Traditionally, this work has focused on constitutional<br />

an all-encompassing enterprise, which requires deeper<br />

attention to be paid to its historical, social and legal<br />

foundations, as well as the wide array of institutions that<br />

Legal Capacity, Disability and Human Rights comprises<br />

chapters by key legal scholars and practitioners in the<br />

field of legal capacity, disability and human rights from<br />

the Americas, Europe, Asia, Oceania and Africa. The<br />

book aims to achieve three main goals to address the<br />

aforementioned issues. First, to explore the historical<br />

evolution, theoretical constructs and institutional<br />

features of legal capacity within comparative legal<br />

systems and determine the legal and social contours it is<br />

taking in current legal reforms. In doing so, the chapters<br />

help to reveal the multiple dimensions and institutional<br />

in cross-border family matters and succession in EU<br />

private international law. It analyses the choice of court<br />

and choice of law provisions that has been developed<br />

issues.<br />

Dr Jacqueline Gray obtained her PhD from Utrecht<br />

University in 2019. As a member of the Utrecht Centre<br />

for European Research into Family Law (UCERF), she<br />

also participated in the European Commission-funded<br />

project ‘Cross-Border Proceedings in Family Law Matters<br />

before National Courts and CJEU’. Prior to this, she<br />

worked as a trainee at the European Parliament within<br />

the Committee on Civil Liberties, Justice and Home<br />

Affairs (LIBE) and studied at Leiden University and the<br />

University of Glasgow.<br />

This book is the result of a long-term comparative<br />

research project on intellectual property, with topics<br />

ranging from patents to copyright, examined across 16<br />

jurisdictions. The country reports unearth the culturally,<br />

morally and historically imprinted thought patterns<br />

across Europe which underpin current discussions on the<br />

appropriation of information and which do not change<br />

quickly. The research results question the common<br />

narratives of the distinctiveness of private and public<br />

law, contracts and property, and morality and the law.<br />

The focus is on public interests which are pursued when<br />

assigning information as property. The 14 selected<br />

cases aim to identify how boundaries of information<br />

property emerge, the areas of law that are applied and<br />

the principles that are followed in order to balance<br />

conflicting interests. The book shows how some national<br />

discussions appear similar on the surface but subsequent<br />

domestic policy answers vary greatly. Inversely, in<br />

pursuing an identical policy, the research shows that<br />

countries install contrasting legal rules which aim to<br />

instigate exactly the same behavioural change.<br />

Since 1 May 2010, when Coordination Regulation<br />

883/2004 came into force, important cases have been<br />

decided by the Court of Justice. These judgments<br />

interpreted several provisions of the Regulation and<br />

clarified the impact that other instruments have had on<br />

coordination issues. In December 2016, the European<br />

Commission proposed a radical revision of several of the<br />

chapters of the Regulation. To date, this proposal has<br />

not been adopted and the prospects for its adoption<br />

are bleak. An up-to-date overview of the Regulation<br />

and the case law is both timely and essential. This book<br />

delivers on this objective and, in addition, discusses the<br />

proposed revisions carefully, as well as analyses their<br />

background and effects. The book also examines the<br />

main non-discrimination provisions relevant to social<br />

security and important social policy instruments, such as<br />

the Open Method of Coordination, the Social Pillar and<br />

the Charter of Fundamental Rights.<br />

Frans Pennings is Professor of Labour Law and Social<br />

Security Law at Utrecht University, the Netherlands.<br />

This book is a groundbreaking comparative law analysis<br />

of the world’s largest and most mature compensation<br />

funds, impacting nearly 22 million people in the four<br />

jurisdictions of Victoria (Australia), Québec and Manitoba<br />

(Canada), and New Zealand. These funds operate in a<br />

way that turns tort law on its head, are financially stable<br />

and sustainable, and are a true revolution in private<br />

law. The author analyses and provides solutions for<br />

the core unresolved problems in the field of no-fault<br />

compensation and identifies the operational and further<br />

development principles of the four largest no-fault<br />

compensation funds within these jurisdictions.<br />

The similarities and differences between thematically<br />

equivalent schemes in civil law countries are examined<br />

and the human rights intersections of large no-fault<br />

compensation funds are analysed, something which<br />

has never been undertaken before in both literature<br />

and practice. Based on qualitative surveys of the four<br />

funds, the author analyses the funding, quantum of<br />

compensation and dispute resolution issues. The book<br />

goes on to identify realistic development goals for the<br />

existing funds and focuses on the future by identifying<br />

new applications used by large no-fault compensation<br />

funds for artificial intelligence and emergency public<br />

health liability challenges. In particular, this book<br />

examines the no-fault compensation funds underpinning<br />

the World Health Organization’s COVAX scheme, which<br />

was established in early 2021.<br />
