without this be<strong>in</strong>g due to force majeure or oper<strong>at</strong>ional<br />
reasons, constitutes a very serious <strong>in</strong>fraction, pursuant to<br />
po<strong>in</strong>t g) <strong>of</strong> paragraph 1 <strong>of</strong> article 9 <strong>of</strong> Decree Law number<br />
109/2008 <strong>of</strong> June 26 th , as amended by Decree Law number<br />
98/2018 <strong>of</strong> November 26 th <strong>and</strong> by Decree Law number<br />
7/2020 <strong>of</strong> March 3 rd .<br />
The take-<strong>of</strong>f or l<strong>and</strong><strong>in</strong>g <strong>of</strong> an aircraft <strong>at</strong> coord<strong>in</strong><strong>at</strong>ed airports<br />
on <strong>the</strong> d<strong>at</strong>e for which <strong>the</strong> slot was alloc<strong>at</strong>ed, but <strong>in</strong> <strong>viol<strong>at</strong>ion</strong><br />
<strong>of</strong> <strong>the</strong> same slot, without this be<strong>in</strong>g due to force majeure<br />
or oper<strong>at</strong>ional reasons, constitutes a serious <strong>in</strong>fraction, pursuant<br />
to po<strong>in</strong>t c) <strong>of</strong> paragraph 2 <strong>of</strong> article 9 <strong>of</strong> Decree Law<br />
number 109/2008, <strong>of</strong> June 26 th , as amended by Decree law<br />
number 96/2018 <strong>of</strong> November 26 th <strong>and</strong> by Decree Law number<br />
7/2020 <strong>of</strong> March 3 rd .<br />
PORTUGAL - ANGOLA - BRAZIL - CABO VERDE - GUINEA BISSAU - MOZAMBIQUE
Article 3 <strong>of</strong> DL 109/2008 st<strong>at</strong>es on paragraph 1 th<strong>at</strong> “for <strong>the</strong> purposes<br />
<strong>of</strong> apply<strong>in</strong>g <strong>the</strong> provisions <strong>of</strong> Council Regul<strong>at</strong>ion (EEC) No. 95/93 <strong>of</strong> 18<br />
January, as amended by Regul<strong>at</strong>ion (EC) No. 793/2004 <strong>of</strong> <strong>the</strong> European<br />
Parliament <strong>and</strong> <strong>of</strong> <strong>the</strong> Council <strong>of</strong> 21 April, Lisbon, Porto <strong>and</strong> Madeira<br />
Airports are design<strong>at</strong>ed as coord<strong>in</strong><strong>at</strong>ed.”<br />
As for Faro Airport, it is design<strong>at</strong>ed as a coord<strong>in</strong><strong>at</strong>ed airport <strong>in</strong> <strong>the</strong><br />
summer IATA period <strong>and</strong> as an airport with facilit<strong>at</strong>ed schedules <strong>in</strong><br />
<strong>the</strong> w<strong>in</strong>ter IATA period.<br />
Ponta Delgada Airport is design<strong>at</strong>ed as an airport with facilit<strong>at</strong>ed<br />
schedules.<br />
This is relevant s<strong>in</strong>ce <strong>the</strong> access to a coord<strong>in</strong><strong>at</strong>ed airport shall only be<br />
possible through <strong>the</strong> alloc<strong>at</strong>ion <strong>of</strong> a slot to <strong>the</strong> air oper<strong>at</strong>or, <strong>in</strong> accordance<br />
with Council Regul<strong>at</strong>ion (EEC) No 95/93 <strong>of</strong> 18 January 1993, as<br />
amended, without prejudice to <strong>the</strong> exceptions provided for <strong>the</strong>re<strong>in</strong><br />
(Article 6 DL 109/2008).<br />
The problem with a slot <strong>viol<strong>at</strong>ion</strong> may become significant s<strong>in</strong>ce <strong>the</strong><br />
coord<strong>in</strong><strong>at</strong><strong>in</strong>g body may refuse to alloc<strong>at</strong>e a slot or series <strong>of</strong> slots <strong>and</strong><br />
require <strong>the</strong> return to <strong>the</strong> reserve <strong>of</strong> slots already alloc<strong>at</strong>ed, <strong>in</strong> situ<strong>at</strong>ions<br />
where <strong>the</strong> air oper<strong>at</strong>or concerned has repe<strong>at</strong>edly <strong>and</strong> <strong>in</strong>tentionally<br />
disregarded <strong>the</strong> rules on <strong>the</strong> alloc<strong>at</strong>ion <strong>and</strong> use <strong>of</strong> slots (paragraph 6<br />
<strong>of</strong> article 6 <strong>of</strong> DL 109/2008).<br />
Still, <strong>the</strong> conditions for <strong>the</strong> applic<strong>at</strong>ion <strong>of</strong> this precautionary measure<br />
must be proven by <strong>the</strong> existence <strong>of</strong> <strong>at</strong> least three f<strong>in</strong>al <strong>and</strong> unappealable<br />
convictions, <strong>in</strong> adm<strong>in</strong>istr<strong>at</strong>ive <strong>of</strong>fence proceed<strong>in</strong>gs, <strong>in</strong> <strong>the</strong> last five<br />
years, whose object is precisely <strong>the</strong> <strong>in</strong>tentional disregard for <strong>the</strong> rules<br />
referred to <strong>in</strong> <strong>the</strong> previous paragraph, without prejudice to <strong>the</strong> mechanisms<br />
<strong>of</strong> recidivism provided for by law (paragraph 7 <strong>of</strong> article 6 <strong>of</strong> DL<br />
109/2008).<br />
Article 9 <strong>of</strong> DL 109/2008 st<strong>at</strong>es on paragraph 6 wh<strong>at</strong>, for <strong>the</strong> purposes<br />
<strong>of</strong> paragraph 1(d) <strong>and</strong> paragraph 2(b) <strong>and</strong> (c), is considered to be cases<br />
<strong>of</strong> force majeure:<br />
(a) Aircraft <strong>in</strong> urgent situ<strong>at</strong>ions, tak<strong>in</strong>g <strong>in</strong>to account meteorological,<br />
technical failure or flight safety reasons;<br />
(b) An unforeseen time change caused by an abnormal disturbance<br />
<strong>in</strong> air traffic control;<br />
(c) Unforeseen time change caused by delays not <strong>at</strong>tributable<br />
to <strong>the</strong> airport manag<strong>in</strong>g body or <strong>the</strong> air oper<strong>at</strong>or;<br />
(d) Unforeseen time change caused by meteorological reasons.<br />

On paragraph 7 it st<strong>at</strong>es th<strong>at</strong> when <strong>the</strong> air oper<strong>at</strong>or fails to comply, for<br />
reasons not <strong>at</strong>tributable to it <strong>and</strong> which are subsumable to cases <strong>of</strong><br />
force majeure or oper<strong>at</strong>ional reasons, it shall, with<strong>in</strong> 72 hours, communic<strong>at</strong>e<br />
such facts to <strong>the</strong> coord<strong>in</strong><strong>at</strong><strong>in</strong>g body, prov<strong>in</strong>g <strong>and</strong> substanti<strong>at</strong><strong>in</strong>g<br />
<strong>the</strong> oper<strong>at</strong>ional reasons or cases <strong>of</strong> force majeure.<br />
Of course this will only be applicable if <strong>the</strong> air oper<strong>at</strong>or has <strong>the</strong> knowledge<br />
<strong>of</strong> <strong>the</strong> problem beforeh<strong>and</strong>.<br />
Paragraph 5 <strong>of</strong> <strong>the</strong> above-mentioned article 9 <strong>of</strong> Decree Law 109/2008<br />
st<strong>at</strong>es th<strong>at</strong> oper<strong>at</strong>ional reasons are those th<strong>at</strong> result from <strong>the</strong> air services<br />
<strong>in</strong>terruption, th<strong>at</strong> make practically <strong>and</strong> technically impossible for<br />
<strong>the</strong> aircrafts oper<strong>at</strong>or to oper<strong>at</strong>e.<br />
As for <strong>the</strong> <strong>viol<strong>at</strong>ion</strong> <strong>of</strong> <strong>the</strong> oper<strong>at</strong>ional <strong>restrictions</strong> <strong>imposed</strong> <strong>at</strong> <strong>night</strong>,<br />
it constitutes a serious <strong>in</strong>fraction pursuant to po<strong>in</strong>t f) <strong>of</strong> paragraph 2<br />
<strong>of</strong> article <strong>of</strong> Decree-Law number 9/2007, <strong>of</strong> January 17 th , as amended<br />
by Decree Law number 278/2008 <strong>of</strong> August 1st. This Decree Law approves<br />
<strong>the</strong> General Noise Regul<strong>at</strong>ion so it <strong>in</strong>tends to enforce rules on<br />
<strong>the</strong> noise pollution, <strong>in</strong> order to safeguard human health <strong>in</strong> <strong>the</strong> popul<strong>at</strong>ion<br />
th<strong>at</strong>, <strong>in</strong> this specific case, resides near <strong>the</strong> Portuguese airports.<br />
In accordance with article 2 (1) e) <strong>of</strong> DL 9/2007, this regul<strong>at</strong>ion is applicable<br />
to transport <strong>in</strong>frastructures <strong>and</strong>, accord<strong>in</strong>g to article 26 po<strong>in</strong>t b),<br />
<strong>the</strong> entity responsible for <strong>the</strong> licens<strong>in</strong>g or authoriz<strong>at</strong>ion <strong>of</strong> <strong>the</strong> activity<br />
is responsible for supervis<strong>in</strong>g <strong>the</strong> rules laid down by this regul<strong>at</strong>ion.<br />
Therefore, ANAC is <strong>the</strong> responsible entity for <strong>the</strong> supervision.<br />
Article 20 paragraph 1 st<strong>at</strong>es th<strong>at</strong> <strong>the</strong> l<strong>and</strong><strong>in</strong>g <strong>and</strong> take-<strong>of</strong>f <strong>of</strong> civil aircrafts<br />
between 0 <strong>and</strong> 6 o’clock are prohibited <strong>at</strong> airports <strong>and</strong> aerodromes<br />
not covered by <strong>the</strong> provisions <strong>of</strong> Decree Law 293/2003 <strong>of</strong> November<br />
11 th , except for reasons <strong>of</strong> force majeure.<br />
It’s also important to note th<strong>at</strong> <strong>the</strong> st<strong>and</strong>ard time <strong>in</strong> ma<strong>in</strong>l<strong>and</strong> <strong>Portugal</strong><br />
varies under <strong>the</strong> terms def<strong>in</strong>ed <strong>in</strong> Decree Law 17/96 <strong>of</strong> March 8 th .<br />
Therefore, <strong>the</strong> local time <strong>in</strong> ma<strong>in</strong>l<strong>and</strong> <strong>Portugal</strong> co<strong>in</strong>cides with Coord<strong>in</strong><strong>at</strong>ed<br />
Universal Time (UTC) <strong>in</strong> <strong>the</strong> period from 1 am UTC on <strong>the</strong> last<br />
Sunday <strong>in</strong> October to 1 am UTC on <strong>the</strong> last Sunday <strong>in</strong> <strong>the</strong> follow<strong>in</strong>g<br />
March (w<strong>in</strong>ter time) <strong>and</strong> it co<strong>in</strong>cides with <strong>the</strong> coord<strong>in</strong><strong>at</strong>ed universal<br />
time <strong>in</strong>creased by sixty m<strong>in</strong>utes <strong>in</strong> <strong>the</strong> period from 1 UTC on <strong>the</strong> last<br />
Sunday <strong>in</strong> March to 1 UTC on <strong>the</strong> last Sunday <strong>in</strong> October (daylight sav<strong>in</strong>g<br />
time).<br />
Never<strong>the</strong>less, Portuguese courts have been consider<strong>in</strong>g th<strong>at</strong> it’s not<br />

any quantum <strong>of</strong> delay th<strong>at</strong> m<strong>at</strong>ters to be considered punishable <strong>in</strong><br />
adm<strong>in</strong>istr<strong>at</strong>ive terms, acknowledg<strong>in</strong>g some tolerance <strong>of</strong> 15 m<strong>in</strong>utes.<br />
There are also exceptions, regard<strong>in</strong>g cases <strong>of</strong> force majeure or oper<strong>at</strong>ional<br />
reasons th<strong>at</strong> can exclude punishability, hav<strong>in</strong>g <strong>the</strong> aircraft oper<strong>at</strong>or<br />
to allege <strong>and</strong> prove <strong>the</strong>m.<br />
The ancillary sanction <strong>of</strong> publicity <strong>of</strong> <strong>the</strong> punishment may be applied<br />
if one’s convicted, under <strong>the</strong> terms provided for <strong>in</strong> article 38 <strong>of</strong> <strong>the</strong><br />
Framework Law on Environmental Offenses (enforceable by article 28,<br />
paragraph 4 <strong>of</strong> <strong>the</strong> General Noise Regul<strong>at</strong>ion).<br />
Th<strong>at</strong> said, it’s very commom for an aircraft oper<strong>at</strong>or to be notified <strong>of</strong><br />
misdemeanor’s proceed<strong>in</strong>gs regard<strong>in</strong>g slot <strong>viol<strong>at</strong>ion</strong>s <strong>and</strong>, consequently,<br />
<strong>viol<strong>at</strong>ion</strong> <strong>of</strong> <strong>the</strong> oper<strong>at</strong>ional <strong>restrictions</strong> <strong>imposed</strong> <strong>at</strong> <strong>night</strong>, <strong>in</strong><br />
those flights th<strong>at</strong> should depart until 00:00.<br />
Consider<strong>in</strong>g th<strong>at</strong> <strong>the</strong> f<strong>in</strong>es amounts may be elev<strong>at</strong>ed <strong>and</strong>, ma<strong>in</strong>ly,<br />
th<strong>at</strong> recurrent convictions may affect <strong>the</strong> slots alloc<strong>at</strong>ion, it is important<br />
for <strong>the</strong> aircraft oper<strong>at</strong>ors oper<strong>at</strong><strong>in</strong>g <strong>in</strong> <strong>Portugal</strong> to determ<strong>in</strong>e<br />
<strong>the</strong> relevance <strong>of</strong> present<strong>in</strong>g a defense to <strong>the</strong> misdemeanor’s<br />
proceed<strong>in</strong>gs, to m<strong>in</strong>imize or even ext<strong>in</strong>guish <strong>the</strong> penalty <strong>and</strong> / or<br />
responsibility.<br />
