Jail suicide crisis leads to stubborn change

VISALIA – Lt. Buddy Hirayama
sagged into his desk
chair after a busy morning on
his first day leading a county
jail system running along the
eastern edge of California’s San
Joaquin Valley.
A call crackled across his
radio:
“Man down. Unresponsive.”
Hirayama and almost two
dozen deputies raced to a cell
where a man appeared to have
overdosed on something. Deputies
pounded on his chest, administering
CPR. Emergency
medical crews arrived.
“Ultimately,” Hirayama
said, “they were unable to
bring him back.”
The June 5, 2023, fentanyl
overdose death
of Ignacio Garcia,
32, was the
second in Tulare
County jails last
year, and the first
on Hirayama’s
watch. Those
deaths followed
the deadliest
year in the jail’s
history when
eight inmates
died in 2022, four of them by
suicide.
Similar scenes have been
playing out all over California.
The year 2022 was the deadliest
on record for California’s jail
system, when 215 people died
in county-run lockups from
natural causes, suicide, overdoses
and homicides. Death
rates in jails remained high
statewide in 2023, as they have

been every year since 2019.

But the state
doesn’t manage
California’s
county jails, the
lockups where
people await trials
or serve relatively
shorter
sentences. Locally
elected sheriffs
run them.
Changes, if they happen,
will have to take place at the local
level, in places like this Central
Valley jail, and they’ll have
to come from Hirayama and
other commanders like him.
He didn’t expect to face an
in-custody death so quickly.
He had to ask himself whether
anything he could do would
make a difference.
“I was honestly completely

the seminary’s sexual standards
that was obtained by The Associated
Press.

Budget woes: Cal State must ‘do less with less’

Half a billion dollars. That’s how much
more California State University’s budget
gap will grow in two years under Gov.
Gavin Newsom’s proposed spending plan
for next year, a fiscal chasm that may
prompt hiring freezes, raid precious reserves
and bring larger class sizes and fewer
courses.
“We have to do less with less,” said
Cal State trustee member Christopher J.
Steinhauser. “We are going to have fewer
programs, fewer positions. And anyone
listening to this meeting, if they think that
we can do this without doing that, they’re
really kidding themselves.”
Senior finance officers from Cal State’s
chancellor’s office debuted the sobering figures
at last week’s board of trustees meeting.
The forecasted deficit could change
— legislators and Newsom have until late
June to finalize a state budget that could include
more money for the university.
Protecting Cal State, community college
and University of California ongoing
funding from cuts “wherever possible” is a
priority, said David Alvarez, a Democratic
assemblymember from Chula Vista and
University faces extra $500 million budget gap
chair of Assembly’s budget subcommittee
on education, last week.
“We got to stick with the commitments
we’re making to the students of California
in the budget,” added Greg Wallis, a Republican
assemblymember from Rancho
Mirage, at the same hearing.
But if Newsom’s May budget update
becomes law, Cal State would face a threeyear
operating deficit of $831 million
through 2025-26 — more than $500 million
greater than what was estimated last
September, said Ryan Storm, an assistant
vice chancellor at Cal State overseeing the
system’s finances, at a trustees meeting last
week.
Budget math
The yawning gap is the result of two
forces: Newsom heavily scaling back his
promises of growing financial support for
Cal State due to the state’s multibillion-dollar
deficit and ever-increasing labor costs
fueled by recent 5% pay hikes to much
of the system’s roughly 60,000 unionized
workers.
Other expenses include nearly $80 million
in higher health care premiums to provide
insurance to its employees in 2024-25.
Newsom’s May spending plans for Cal
State, the UC and other state agencies are
complex, prompting the Legislative Analyst’s
Office to call them “opaque and unnecessarily
complicated.”
After a mix of cuts in 2024-25 and far
less new spending in 2025-26 than initially
promised, Cal State would see new state
revenues that are $470 million less than
they anticipated last fall, according to summary
tables Storm showed the trustees. A
promise to backfill faculty raises to end a
strike earlier this year added roughly $30
million to the system’s budget gap.
Cal State was already projecting a
three-year budget gap of more than $300
million last September.
That was even with the assumption
of nearly $500 million more in state support
through 2026 and roughly $200 million
more in new tuition revenue after the
board approved tuition hikes of 34% across
five years starting this fall.
Half a billion dollars is equivalent to
the entire operating budget of San Diego
State University, among the system’s largest
campuses.

to human sexuality, according
to retired professor John Hawthorne,
an expert on Christian
colleges.
Such a decision would carry
Fuller into uncharted territory,
Hawthorne said. “It’s a bold
step for a school that fought off
lawsuits on this very issue a few
years ago.”
At the same time, several
current and former students
and faculty believe this move
would preserve Fuller’s existing
status as a “third space” where
Christians with diverse views
on sexuality are welcome — a
space that has been shrinking
nationally amid increasing political
polarization on the issue.
Fuller issued a statement
Thursday saying the deliberations
on this topic are ongoing
and drafts of possible revisions
have been created solely for
discussion and reflection. It
says no proposals have been
submitted to trustees for a
vote and it is unclear when the
board might even consider the
matter.
Hawthorne, whose upcoming
book argues that Christian
colleges should put students
front and center instead of
worrying about critics, anticipates
“significant blowback”
from conservative Christians
should Fuller move forward
with the revisions. “I hope they
have a plan on how to manage
the aftermath, the storm, when
it comes,” he said.
Fuller’s president, David
Goatley, who came to the
nondenominational seminary
in 2022 from Duke Divinity
School, appointed a task force
of administrators and faculty
to look into the school’s sexual
standards. That move came
about a month after Ruth
Schmidt was fired from her
position as a senior administrator
in January for refusing
to sign the seminary’s sexual
standards.
In 2019 and 2020, two former
students sued Fuller, alleging
they were being expelled
for being in same-sex marriages.
In October 2020, courts
upheld Fuller’s right to enforce
its sexual standards policy. Its
standards prohibit “homosexual
forms of explicit sexual conduct”
and hold that sexual intimacy
is reserved for a marriage
between a man and a woman.
The draft containing the
revisions, dated April 3, states
“that there are thoughtful
Christians and churches that
have different interpretations.
Therefore, we expect all members
of this global, evangelical,
and ecumenical seminary student
and learner community to
live with integrity consistent to
the Christian communities to
which they belong.”
The document is less clear,
however, when it comes to
standards for trustees, administrators,
faculty and staff, requiring
them “to abide by the
sexual standard regarding sexual
intimacy within the boundaries
of the traditional understanding
of marriage.” It also
states that those from Christian
communities that differ
from Fuller’s stance supporting
traditional marriage would
still be expected to support the
seminary’s position. It does not
specify whether faculty, staff
and administrators would be
penalized for being in a samesex
marriage.

Hirayama knew he couldn’t
control everything in the jail.
A substantial number of its inmates
come from rival gangs,
and keeping them apart is critical
to limiting violence. Tulare
County, like many local governments,
hires outside contractors
to provide health care
and mental health treatment to
inmates. They don’t report to
Hirayama.
He focused on something
he could control: creating
a less-predictable system of
checks meant to keep inmates
guessing about when deputies
would pass by them.
Hirayama made other
changes, too, as he stepped into
his new role leading the jails.
He hoped they would improve
deputy morale and yield more
cooperative inmates.
But mostly, he had to stop
people from dying.
Mental health crises in
California jails
New inmates are welcomed
with a “fish kit,” the toothbrush,
soap and other basic hygiene
supplies they’ll save or trade
while they’re incarcerated. But
just as important is the mental
health check they’re given by an
intake nurse or medical assistant
when they’re first processed,
said Dr. Abdolreza Saadabadi,
the jail’s psychiatrist employed
by the private company Precision
Psychiatric Services.
Jails have become this
country’s mental health wards,
Saadabadi said. Mental illness
that goes untreated on the outside
becomes mental illness
that must be addressed inside,
he said. Worse, he said, is when
inmates who have been treated
before for mental illness may
not like the drugs they were
given, or feel ashamed to admit
their diagnosis, so they don’t
disclose it.
“When they don’t share, it’s
difficult to project what they
might or might not do,” Saadabadi
said.
Curtis Peck was facing a
long prison sentence when
he killed himself in his Tulare
County jail cell on Sept. 27,
2022. He was 45.
His father, a retired prison
guard of more than 26 years
at California State Prison,
Corcoran, doesn’t believe the
sheriff ’s office could have done
anything to stop him.
“I had to accept that he took
his own life rather than go back
to prison,” Roger Peck said.
“He wasn’t convicted yet but he
had been most of his adult life
in and out of prison.”
Roger Peck’s three eldest
sons spent time in prison, but
Peck said Curtis’ latest charges
would send him away for a
long time. Peck has family and
friends in the Tulare County
Sheriff ’s Office, and asked one
of them to investigate his son’s
death.
“I asked my sister’s neighbor
to look into it,” Peck said.
“It was a single cell, no one in
there with him. Everything
proves that he took his own life.
“He knew what he was
looking at in prison.”
Other families are not as resigned
to the outcome.
Kelsi Fahrni was 29 when
she hung herself in her jail cell
on Aug. 12, 2022. In previous
stays in jail, Fahrni had swallowed
razor blades, jumped off
a second-story railing and tried
to hang herself.
After she was booked and
admitted to using fentanyl daily,
she was put in a cell, alone.
“Fahrni deteriorated and
began self-harming behaviors,”
alleges a lawsuit her family filed
last year in federal court against
the Tulare County Sheriff ’s Office
and Precision Psychiatric
Services.
Deputies didn’t check on
Fahrni for more than two
hours, the lawsuit alleges, despite
California laws mandating
at least hourly checks on
inmates.
UC student workers strike
expands to three campuses

Nearly a third of the academic and graduate student workers
of the University of California are on strike, after the union of
48,000 employees escalated its labor standoff by walking off the
job at UCLA and UC Davis this morning.
With as many as 2,000 UC Santa Cruz graduate students and
academic workers picketing since last Monday, today’s job action
brings 12,000 more out of classrooms and laboratories, potentially
crippling the university’s mission of educating the roughly 80,000
undergraduates at the three campuses just two weeks before students
begin to take their end-of-quarter finals.
Workers, including teaching assistants, academic researchers
and graders, are striking not over pay and benefits but instead
over the UC’s response to pro-Palestinian protesters who were arrested
by police or suspended from their campuses. Some union
members were arrested or suspended for their role in the protests.
Core to the union’s demands is that the UC offer “amnesty for
those who experienced arrest or are facing University discipline,”
the union’s public writings state.
Some 60 academic workers began picketing at Royce Quad at
UCLA by 9 a.m., where just weeks ago students at a large pro-Palestinian
encampment were attacked by counter-protesters.
Origins of strike
UC’s Office of the President calls the strike illegal, saying that
its contract with the union — itself the result of a six-week long
strike in late 2022 — includes a no-strike provision. The union,
UAW 4811, vehemently disagrees with that analysis, citing legal
precedent that a union can strike over unfair labor practices that
fall outside the scope of a union contract. It’s a view shared by at
least one UCLA law professor.
Both sides have leaned heavily on the state’s Public Employment
Relations Board to adjudicate their disputes.
Two days after police swept the encampments at UCLA and
arrested scores of protesters, the union filed an unfair labor practice
violation with the labor relations board. The union then filed
similar violations after police cleared encampments at UC San
Diego and UC Irvine that also led to arrests of protesters — and
another alleging that the UC changed its disciplinary rules unilaterally
to punish academic workers. • UC Strike, see page 12

Adult day services provide respite for full-time caregivers

PLATTSBURGH, N.Y. —
Sally White helps her husband
of 46 years get dressed, fed and
on the bus for the short ride
from their home to Third Age
Adult Day Center four mornings
a week.
Preparing 74-year-old Rodger
White to leave the house
for the day can be a chore since
he’s been in declining health for
more than a decade and has severe
memory loss.
“It’s like having a small
child,” said Sally White, 78.
“This long goodbye is hell. I’m
exhausted. When he’s at Third
Age, I clean the house and try
to get errands done.”
For thousands of older
Americans like the Whites,
Third Age Adult Day Center
and similar adult day services
provide safe, stimulating places
for those who have physical or
cognitive disabilities and give
respite to their caregivers.
William Zagorski, chairman
of the National Adult Day
Services Association, estimates
there are about 8,000 adult day
service centers across the U.S.
catering to people with varying
needs who want to remain
in their own homes. More
than half of these centers serve
homebound seniors who need
supervision and opportunities
to socialize.
After raising four children
and retiring from their teaching
jobs, the Whites each began
studying for the ministry.
During their studies, Rodger
White suffered a brain bleed
in 2013 and memory problems
he’d been having for several
years began to escalate. Sally
White said his memory loss has
stolen from her the intellectually
sharp, active man she knew
and the life they had planned as
they grew old together.
To keep her husband in a
safe environment while she
handles household tasks and
gets a break from being a full-
time caretaker, White enrolled
him at Third Age Adult Day
Center in January 2022.
“I can’t put a price on what
it’s done for us,” she said. “Rodger
has a routine and a community
there and I keep my
sanity by getting the bills paid
and keeping the house in good
condition and tidy so it’s safe
for him here.”
Cost and location
Adult day services are
prevalent in areas across the
country, particularly California,
New England and southern
states, such as Tennessee,
which experienced a 20% increase
in these programs in the
past 13 months, Zagorski said.
Meanwhile, middle America
and rural areas struggle to
either staff or fill the centers
with clients.
Adult day programs cost
under $100 a day nationally,
which is less expensive than a
nursing home. It’s one of the
reasons Zagorski and organizations
like the National Council
on Aging are advocating for
more support of senior day
programs.
“Unfortunately, Medicare
is not an option and that has
been a barrier to its growth,”
Zagorski said.
Medicaid covers about half
the revenue collected for these
services across the U.S., and
Veterans Affairs is increasingly
supporting it, but about 15% of
users still have to pay out-ofpocket.
That may account for only
about 237,400 older Americans
participating in structured day
programs, according to the
Centers for Disease Control,
even though adults 65 and
older make up 18% of the U.S.
population.
Sally White said she struggles
to afford the roughly
$2,200 a month for her husband
to attend the program
since the couple doesn’t qualify
for Medicaid. Because of his
health decline, she’s been solely
responsible for handling all the
bills and the stress they bring.
Since 1987, 13 adult day
centers have opened and closed
in the two counties, which Kyle
attributed to a lack of mass
public transportation, cost and
non-flexible hours.
“Many families want services
in their home, want to
take care of family members on
their own or still equate it to a
child-care setting,” she said.
The stigma of aging may
also play a role in adult day
programs being underused,
said Georgia Goodman, director
of Medicaid at LeadingAge,
which represents more than
5,400 aging services.
“A lot of (older) people
don’t seek services until they’re
in a crisis,” she said, adding that
earlier access could offer more
preventative care.
Marilyn Vargo, 79, of Milton,
Pennsylvania, has been
attending VNA Caring Center
in Shamokin since February.
Vargo, who for years worked
as an administrative assistant
to several Bucknell University
presidents, suffered a traumatic
brain injury in a fall about five
years ago and now has shortterm
memory loss and is unable
to care for herself.
“It’s very difficult,” said her
husband, Joe Vargo, 81.
More than dancing and dominoes
VNA Caring Center is the
only adult day services program
for cognitively impaired
seniors in the Susquehanna
Valley. Full-day attendance,
from 8:30 a.m. to 3:30 p.m.
weekdays, costs $44, including
meals. Although the center has
the capacity for 19 clients, only
five clients are enrolled, director
Angela Loeper said.
Another major hurdle to
expanding access to adult day
services, Zagorski said, is the
lack of public awareness and
research about the benefits of
the service, which he said helps
reduce depression, loneliness
and isolation.
There’s been a nationwide
effort to rebrand the program
as adult day services, instead
of day care, and distinguish it
from child care or senior centers.
“We’re a lot more than
dancing and dominoes,” Zagorski
said. “We do have fun
and social activity is promoted,
but we have cognitive-based
activities, and physical games
and range-of-motion exercises.
Food insecurity is a massive
problem for seniors and we offer
nutrition. We help reduce
falls and decrease medication
errors because people are right
there. We’re the best-kept secret
in long-term care. We offer
a holistic level of care that allows
people to remain healthy
and with friends.”

It’s the clean version of those gooey
rice krispies treats. I used to love those
as a kid.
But now I avoid marshmallows because
I’m not really sure what’s in them.
So, I haven’t had a rice crispy treat in
forever.
Until now! These revamped treats
are made of all natural, healthy ingredients
and are like rice krispie’s cousin.
They are a little different, but so delicious.
Some may argue they’re even
better.
Instead of marshmallows, these
bars are made with protein-rich peanut
butter and maple syrup. And instead of
butter, coconut oil takes its place. So it
checks off more healthy boxes than the
old version.
The result is heavenly. It doesn’t just
taste good, it’s so much more satisfying.
The big plus is that kids love them, too.

of rice krispie treats and feel good
knowing exactly what goes in them.
Peanut Butter Rice Krispie Treats
Servings: 16 bars
Ingredients
For the treats:
* 3/4 cup natural creamy peanut butter (nothing added)
* 1/3 cup pure maple syrup
* 2 tablespoons virgin coconut oil
* 1 teaspoon vanilla extract
* pinch of salt (if your peanut butter isn’t already salted)
* 2 1/2-3 cups crispy brown rice cereal (or rice krispies)

Snack Remix: Next-Level Krispies
For the chocolate topping:
* 3.5 oz 85% dark chocolate bar,
broken up into pieces
Directions:
1. Line an 8x8 inch pan with parchment
paper. Set aside.
2. Place a medium pot over low heat
and add in peanut butter, coconut oil,
maple syrup and vanilla extract. Mix
until smooth and well combined, about
1 minute.
3. Next, add in the crispy brown rice
cereal; stir until combined and cereal is
completely coated. Pour into the prepared
pan, and use a spatula to flatten
the top so it is even.
4. Next make the chocolate topping
by adding chocolate to a microwave
safe bowl. Microwave on high in 30 second
intervals, stirring in-between, until
chocolate is completely melted. You can
also melt the chocolate in a small saucepan
over very low heat if you prefer.
5. Pour melted chocolate over the
bars and spread out the chocolate evenly.
6. Place pan in the refrigerator for
30 minutes or until the bars are completely
cool and the chocolate is hardened.Then cut into 16 bars.

UC STUDENT WORKERS STRIKE from Page 3
“By summoning the
police to forcibly arrest
and/or issuing interim
suspensions to these
employees, the University
has violated their
employee rights,“ the
union wrote in one of
its submissions to the labor
relations board. The
union says its workers
were not only rallying
against the war in Gaza
but also seeking ways
to remove academic research
funding sources
tied to the U.S. military.
Workers also oppose
“the discrimination and
hostile work environment
directed towards
Palestinian, Muslim,
and pro-Palestine Jewish
employees and students.”
Unlike a systemwide
strike, this “stand
up” strike will pursue
labor stoppages at certain
campuses, a strategy
employed by Detroit
autoworkers in their
successful campaign for
higher compensation
last year. The approach
is meant to apply gradual
pressure to management.
Union leaders
have maintained that if
UC management wants
to stop the spread of the
strike, it should come to
the table with the union
to remedy the unfair labor
practice charges.
While the strike
is technically distinct
from the larger protest
movement against the
war, the two movements
are related. Last Thursday,
several hundred
UCLA members of the
UAW 4811 held a rally
in support of their
impending strike. Moments
later, they joined
a student-led protest
demanding that the UC
call for a ceasefire and
divest from weapons
manufacturers and the
Israeli economy. That
same day, protesters
erected a short-lived
encampment and temporarily
took over a
campus building before
being pushed out by police.
Legality of strike debated
Almost 20,000 of
the union’s 48,000 represented
workers voted
on whether to strike two
weeks ago, and nearly
80% of those who did
vote approved the strike
authorization. Only
union members can
vote.
The UC sought an
injunction to legally
halt the strike, but the
labor relations board
wrote last week that UC
hadn’t established that
an injunction is “just
and proper.” The union
hailed the ruling. However,
the board wrote
that it’s leaving UC’s request
open in the event
the university provides
better evidence.
In a partial victory
for the university, the
board issued a complaint
that the union
“failed to provide adequate
advance notice of
its work stoppage, and
failed and refused to
meet and confer in good
faith.”
The UC press office,
in announcing the
board’s response, wrote
that the labor board
“found enough evidence
to suggest that a violation
may have occurred,
and further examination
is warranted.”
The union argues
in its latest unfair labor
practice violation
that the UC unilaterally
implemented a disciplinary
policy that affects
UAW 4811 workers.
The union seeks an
order telling the UC to
“cease and desist from
unilaterally changing
the terms and conditions
of employment related
to discipline.”
A spokesperson for
the UC Office of the
President disputes that
characterization, writing
that these policies
aren’t new and reaffirm
existing rules. The
spokesperson, Heather
Hansen, sought to invalidate
the central thrust
of the union’s demands,
writing to CalMatters
last week: “By requesting
amnesty, UAW is
asking the University
not to follow its processes
but rather to make an
exception for its members
so that they are
not subject to the same
accountability measures
applicable to all other
members of the UC
community.”
