Greetings from the Kenya Property Developers

Association!

Welcome to the Q2 issue of the KPDA Developers

Digest. This publication reflects our relentless commitment

to advocating for better policies and practices

in the built environment sector. Our theme for this

issue, “Legal Frameworks, Supporting Sustainable

Urban Development,” underscores the vital role of

robust legal and policy structures in shaping the

future of our cities and the importance of the legal

profession in real estate ventures.

KPDA has been at the forefront of championing

policy reforms and advocating for an enabling environment

for property developers in Kenya.

Our efforts are not merely about regulatory compliance but about driving sustainable urban

growth, economic vitality and social equity. As urban populations swell and climate change

impacts intensify, the need for innovative and sustainable development models has never

been more critical.

POLICY AND ADVOCACY ACTIVITIES

This quarter, we are proud to report on our advocacy initiatives;

1. Retention of the 15% Corporate Tax Incentives for Residential Real Estate

Developers: Initially proposed for removal, the 15% tax rebate for developers constructing 100

units annually has been retained. This incentive is crucial for fostering affordable housing

development, ensuring that developers can continue to contribute to reducing Kenya’s housing

deficit, which currently stands at over 2 million units. By maintaining this tax rebate, we are

supporting the creation of thousands of jobs and stimulating economic activity within the

construction sector.

2. Adjustment of E-TIMS Integration Requirements: The mandatory integration of

service providers into the electronic invoicing system, e-TIMS, has been adjusted for entrepreneurs

with an annual turnover of less than KES 1 million. This change alleviates the compliance

burden on smaller businesses, encouraging entrepreneurship and innovation. By simplifying

these requirements, we create a more inclusive environment that supports the growth of

SMEs, which are the backbone of our economy.

In our strategic engagements, KPDA has continued to forge strong partnerships with government

entities to address critical issues affecting the sector. Recently, we engaged in high-level

discussions with the leadership of Nairobi City County, led by Hon. Johnson Sakaja. This

dialogue focused on several key areas:

1. Streamlining Development Approvals: Addressing challenges with development approvals

following the migration from e-DAMS to the Nairobi Planning and Development Management

System (NPDMS). Simplifying these processes is essential for reducing project delays and

costs, thereby accelerating the delivery of essential infrastructure and housing projects.

2. Enhancing Public Participation: Promoting greater public participation with key stakeholders

and professionals on real estate matters, with KPDA as the umbrella body for property

developers. This inclusive approach ensures that the voices of all stakeholders are heard,

leading to more balanced and effective policy decisions.

3. Preserving Green Spaces: Emphasizing the need to protect green spaces, parks, and

playgrounds to preserve our natural habitat and enhance the quality of urban life. At KPDA,

we strongly believe that sustainable urban development must prioritize environmental stewardship

alongside economic growth.

We are also proud to announce the inclusion of two KPDA corporate members-Mr. Nickson

Otieno, CEO Niko Green Ltd and Stanley Maina, Managing Director Mlima Construction on

the Nairobi Planning and Development Systems Review Taskforce. This recognition underscores

our role as a leading advocate for the real estate sector, driving policy and regulatory

reforms that benefit the entire industry.

EVENTS AND KNOWLEDGE SHARING ENGAGEMENTS

Notable events in the 2nd quarter include the KPDA CEO Breakfast, where industry leaders

discussed the current property market outlook and strategic initiatives for the future. Our

Annual General Meeting provided a platform to review our progress and set ambitious goals

for the coming year. Additionally, our Mid-Year corporate networking Koroga event fostered

valuable connections and collaborations within the industry.

KPDA’s commitment to technological innovation and sustainability is evident in this publication.

We present a comprehensive policy framework for sustainable urban development,

addressing the multifaceted challenges modern cities face. Our goal is to create urban spaces

has been working in Ethiopia, Kenya,

Democratic republic of Congo, Cameroon,

completed around 200 million square feet of

1. Being in practice for more than two decades now, how does Parin Shah Architects function?

We understand the importance of designing to satisfy the client’s requirements and that every

job is unique in size, budget constraints and thus requires an individual approach. We maintain

We have evolved professionally and have built our expertise in unique design methodologies as

well as time saving construction techniques. We create impactful projects with aesthetic integrity

What current construction material and trend have you adapted to and why?

Aluminium formwork by Kumkang Kind is opening up infinite opportunities for builders and is

enabling them to create sustainable architectural wonders. The aluminium formwork technology

has great potential for application to provide affordable housing to its rising population. With the

ability to meet the needs of the future, we have hence considered this construction technology

for our futuristic projects, which makes the construction faster, better and more environmentally

sustainable as compared to any other conventional construction technology.

What value does aluminium formwork system bring to the construction industry?

Aluminium formwork system serves as a cost effective and efficient tool to solve the problems

of the mass housing project all over the world. It aims to maximize the use of modern construction

techniques and equipment. The total project cost and the duration of the project is lesser

than the conventional formwork system as it brings down the structural cost by 20 to 25 percent

and the structure duration will be reduced by 50 percent over the conventional method with

lesser labour inputs proving to be beneficial and viable in every way. It is the best suitable

system in terms of Safety, Quality, Cost and Duration over the conventional formwork system. It

is identified to be suitable for mass housing construction where quality and speed can be maintained

at a reasonably high level. It is adaptable for any design of a building and establishes a

kind of assembly line production benefiting the construction industry.

What does the Aluminium formwork technology have to offer?

• It is a precision engineered formwork fabricated in aluminium and is the most effective

mean available for mass housing reinforced concrete structures.

• It is flexible in design and can form any architectural or structural configuration, it reveals

a good quality fair face onto which a 4-5mm skin coat can be applied for a perfect finish and it

can be manually handled generating savings on heavy equipment and cranes.

How does Aluminium formwork system have an edge over the other constructions techniques?

All walls, columns, beams, slab, and staircases of aluminium formwork system are assembled

together and concrete is poured at one single shot. The whole structure is constructed with

cast-in-situ load bearing walls by using pre-engineered aluminium forms with form-finished

concrete and no plaster on any face. Construction period can be significantly reduced and the

quality of concrete surfaces is much better than using the conventional formwork system. Since

the system is monolithic the absence of numerous joints makes it stronger as compared to the

precast formwork.

What are the advantages of Aluminium formwork system?

• Aluminium sections are large enough to be effective, yet light enough in the weight to be

handled by a single worker.

• The formwork does not depend upon heavy lifting equipment and can be handled by

unskilled labours.

• Fast construction is assured and is particularly suitable for large magnitude construction

of respective nature at one project site.

• Construction carried out by this system has exceptionally good quality with accurate

dimensions for all openings to receive windows and doors, right angles at meeting points of wall

to wall, wall to floor, wall to ceiling, etc concrete surface finishes are good to receive painting

directly without plaster.

• System components are durable and can be used several times without sacrificing the

quality or correctness of dimensions and surface.

• Monolithic construction of load bearing walls and slabs in concrete produces structurally

superior quality with very few constructions joints compared to the conventional column and

beam slabs construction combined with filter brick work or block work subsequently covered by

plaster.

• In takes a 4 day cycle of casting the floor together with all slabs as against 14 to 20 day

cycle in the conventional method, resulting in a saving of 10 to 15 days per floor in the overall

completion period.

• As all the walls are cast monolithic and simultaneously with floor slabs requiring no

further plasters finish. Therefore, the time required is saved as compared to the conventional

method for construction of walls and plastering.

• Usage of aluminium formwork can result in an increase of 5% of usable area.

• Aluminium panels can last up to 100 - 200 repetitions before being recycled or sold at

scrap value.

What kind of hardware and software assembly is used in this formwork?

The hardware consists of high strength aluminium alloy components that are fitted together and

erected using pin and wedge system. These panels are lightweight with excellent stiffness to

weight ratio yielding minimum defection under concrete loading. They are often manufactured in

standard sizes. The panels precisely fit and require no bracing and the walls are held together

with high strength wall ties while decks are supported by beams and props. As of software is

concerned state of art and computer aided software is used to design the formwork by experienced

designers incorporating the optimum assembly procedures, most efficient construction

process, economical panel selection and ultimately minimising capital and operational costs.

10. Could you give details of a project which you have recently executed using Aluminium formwork.

Federal Housing Corporation (Government Housing Agency of Ethiopia) had appointed Us

(Parin Shah Architects) for the design of Gerji village project in Ethiopia. The project comprises

of 510 apartments (3 bed, 4bed and 5 bed duplex) with a club house. Total construction area of

the project was 120,000 Square meter. Our scope of work in this project was Architecture,

Structure, Mechanical, Electrical, plumbing, infrastructure, landscape and Co-ordination with

Kumkang Kind Aluminum formwork vendor. With our vast experience of using Aluminium formwork

technology, we were able to complete the entire project in 18 months. The Gerji Village

project was inaugurated by the Ethiopian high ranking officials. It is said that the project is first

in its kind and a unique housing development in Ethiopia.

As urbanization accelerates in Kenya and the impacts of climate change become more

pronounced, a critical question arises: can green buildings be the solution to our environmental

and developmental challenges? The recent climate change effects, particularly the April-May

2024 floods in Kenya led to massive loss of lives, destruction of property, and disruption of

businesses, and highlighted the need for sustainable building practices.

Can Green Buildings Be a Solution?

Green buildings are designed to reduce the overall impact of the built environment on human

health and the natural environment. This is achieved through efficient use of energy, water, and

resources, protecting occupant health, and reducing pollution, and environmental

degradation. The demand for green buildings is rising in Kenya, driven by increasing awareness

of environmental issues, government regulations, and market incentives. Currently, Kenya has a

proposed Climate Change Green and Resilient Buildings Regulations 2023 which seeks to

establish a green resilient building unit under the State Department for Public Works.

Why Green Buildings?

Environmental Impact: Green buildings significantly reduce energy consumption and

carbon emissions.

Economic Advantages: Although the initial cost of green buildings can be higher, they offer

long-term financial benefits. Studies have shown that green buildings can yield an average

return on investment of 19.2% over traditional buildings.

Market Demand and Value: Sustainable buildings are increasingly valued by tenants and

buyers.

In conclusion, adopting an ESG due diligence and compliance checklist is crucial for

developers aiming to mitigate the effects of climate change and achieve sustainability. By

integrating these practices into their projects, developers not only contribute to environmental

PRACTICES TO ACHIEVE SUSTAINABLE

Urbanization offers a chance to bring about socio-economic benefits. However, if not well

managed, it may create governance, infrastructure, housing, environment and resource challenges

which can hamper development. Thus, there is need to develop a policy framework that

willbalance urbanisation to meet the needs of the present without compromising the ability of

future generations to achieve their own needs. Such development may be achieved through

innovative design practices which aim at creating liveable, equitable and environmentally sustainable

cities that meet the needs of current and future generations.

This article focuses on the importance of innovative design practices while giving the legislative

bearing for sustainable urban development.

IMPORTANCE OF INNOVATIVE DESIGN PRACTICES

Innovative design practices refer to approaches, methods, and techniques that depart from

conventional or traditional norms to achieve novel and often ground breaking solutions. It

encompasses a wide range of practices and principles including the efficient use of resources,

the promotion of renewable energy sources, the reduction of pollution and waste, and the

creation of green spaces. It aims at addressing current and future challenges in unique ways.

For a city to be sustainable, it must be socially inclusive, environmentally safe and economically

productive. Technology and governance are some of the dimensions used to measure urban

sustainability. Smart technology plays a crucial role in the realization of sustainable urban

design

as it encompasses various digital and communication tools which include the Internet of Things

(IoT), artificial intelligence (AI), big data analytics and Intelligent Transportation Systems (ITS)

which offer innovative solutions to urban challenges.

Smart technology can be used to develop various innovations for sustainable urban development

such as;

• Smart Energy Systems which enable more efficient production, distribution and

consumption of energy, reducing the carbon footprint.

• Smart Transportation Systems which use data to optimize traffic flow, reduce

congestion and promote alternative modes of transportation such as electric vehicles and

public transit which as a result will contribute to lower emissions and improved air quality.

• Water Management Solution which use IoT to monitor and manage water use and

distribution by identifying leaks ensures sustainable water consumption and conservation.

• Waste Management Solution which involves developing smart waste systems to monitor

waste levels will help reduce fuel consumption and emissions associated with waste

management.

• Smart Buildings and adaptive lighting systems adjust energy use which significantly

reduce energy consumption.

Kenya has put in place a legal framework forming part of development law that guides these

innovative design practices for urbanization. Development Law provides the framework that

governs the planning, design, and implementation of urban development projects, aiming to

balance economic growth with environmental sustainability, community needs, and cultural

preservation. These laws aim to promote sustainable urban development, ensure environmental

protection, and enhance the quality of life. Some of these major laws are;

• The Constitution of Kenya (2010) which guarantees the right to a clean and healthy

environment and mandates the state to ensure sustainable exploitation, utilization,

management, and conservation of the environment and natural resources.

• The Physical and Land Use Planning Act (2019) which provides a framework for the

preparation and implementation of physical and land use development plans while

establishing guidelines for the development, management, and use of land, ensuring

orderly development and sustainable use of resources.

• The Environmental Management and Coordination Act (EMCA) (1999, amended

2015) which mandates regular environmental audits to ensure compliance with

environmental standards and regulations. It also establishes the National Environment

Management Authority (NEMA) as the regulatory authority for environmental

management. It sets standards and requirements that promote sustainable development,

protect natural resources, and involve the community in decision-making

processes.

• The Building Code (1968) and Revised Building Regulations which provides

standards for building design, construction, and maintenance while ensuring the buildings

are safe, healthy and habitable.

As a result of Article 2 (5) & (6) of the Constitution of Kenya, 2010 development law in Kenya

includes several international treaties as well which Kenya is a member of and are related to

sustainable urban development and environmental protection. Some of these treaties are;

• United Nations Framework Convention on Climate Change (UNFCCC) (1992)

whose objective is to stabilize greenhouse gas concentrations in the atmosphere at a

level

that would prevent dangerous anthropogenic interference with the climate system. It

also

encourages the development of sustainable cities that reduce greenhouse gas emissions

through energy-efficient buildings, renewable energy, and sustainable transportation.

• Kyoto Protocol (1997) aims at reducing greenhouse gas emissions based on the

premise

that global warming exists and human-made CO2 emissions have caused it while

promoting energy-efficient urban development practices and the use of low-carbon

technologies in urban infrastructure.

• United Nations Convention to Combat Desertification (UNCCD) (1994) which aims

at combating desertification and mitigating the effects of drought through national

action

programs.

While the application of smart technology for sustainable urban development has promising

prospects, there are various challenges that must be addressed to fully realize these innovations.

Such challenges include climate change, population growth, insufficient financial resources,

weak governance and cultural resistance to change. These challenges can however be remedied

by;

• Strengthening governance structures, updating regulatory frameworks, and ensuring

political commitment to sustainability.

• Mobilizing funding through public-private partnerships.

• Enhancing technical expertise and capacity through training programs, knowledge

sharing,

and international cooperation.

• Raising public awareness and encouraging community participation in urban planning

processes.

• Promoting research and innovation in sustainable design practices and technologies.

When these remedies are embraced and implemented, the innovations would offer a pathway

to transforming urban areas into sustainable, efficient and inclusive communities while presenting

a market opportunity for investments.

CONCLUSION
