Things to know about Missouri Probate<br />

and how to avoid Probate Court!<br />

In Missouri, probate is the legal process that oversees the distribution of a deceased person’s estate.<br />

This process can be time-consuming and costly, so many landowners seek ways to avoid probate to<br />

streamline the transfer of property to heirs. Fortunately, Missouri provides several legal mechanisms<br />

to help property owners achieve this goal.<br />

**Beneficiary Deeds (Transfer on Death Deeds)**<br />

Missouri allows property owners to use beneficiary deeds, also known as Transfer on Death (TOD)<br />

deeds, to transfer real estate to a beneficiary without the need for probate. This deed lets the owner<br />

name one or more beneficiaries to inherit the property automatically upon the owner’s death.<br />

Importantly, the owner retains full control of the property during their lifetime, allowing them to sell,<br />

mortgage, or revoke the deed if they choose.<br />

**Joint Ownership with Right of Survivorship**<br />

Property held in joint tenancy with right of survivorship automatically passes to the surviving coowner(s)<br />

upon the death of one owner. For instance, married couples often hold property as joint<br />

tenants, ensuring that the surviving spouse inherits without going through probate. However, joint<br />

tenancy should be considered carefully, as all parties hold equal ownership and decisions generally<br />

**Holding Property in a Trust**<br />

Another effective way to avoid probate in Missouri is by transferring property into a living trust.<br />

When a property owner sets up a trust, they can transfer ownership of their real estate into the trust,<br />

with themselves as the trustee and a designated beneficiary. Upon the owner’s death, the successor<br />

trustee can transfer the property to the beneficiary without probate. This approach not only avoids<br />

probate but also allows greater control over how and when the property is distributed. A trust also<br />

provides privacy, as it keeps details of the estate from becoming public record, which can happen in<br />

probate proceedings.<br />

By utilizing these options, Missouri landowners can simplify the transfer of property to heirs, save on<br />

costs, and ensure privacy. Consulting with an estate planning attorney can help determine the best<br />
