About The Firm
A Century of Excellence
Founded in 1924, Bulkley, Richardson and Gelinas, LLP is the largest law firm based in western Massachusetts
with offices located in downtown Springfield and Hadley, MA. The firm provides high-quality legal services to
local and national clients, addressing a broad range of sophisticated matters for clients in both the private and
public sectors.
With approximately 40 lawyers, our firm’s size allows us to provide the best attributes of both large and small
firms. While the quality of our services equals that of large national firms, our interest in long-term client
relationships and appreciation of each client’s desire for cost-effective representation reflect the best of small,
local law firms.
As we celebrate Bulkley Richardson’s centennial anniversary, the firm remains committed to a standard of
the development of long-term relationships with clients and an in-depth understanding of their legal needs;
the earned respect of both colleagues and courts; and the ability to apply valuable insight and pragmatic
problem-solving skills to achieve results for our clients.
supports more than 50 local events and organizations. We recognize the valuable work that has gone into
such as helping to feed the hungry and addressing food insecurity; supporting arts and culture; contributing
funds to lifesaving health care and research organizations; providing pro bono legal services to those in need;
and supporting a range of educational programs from childcare through collegiate level, among many others.
Members of the firm regularly contribute time, resources and finances to help worthy causes over the past
century and plan to continue that legacy.
Bulkley Richardson was founded on the premise that people define the heart and soul of a firm. Our
Independent Investigations
Colleges and universities seek to provide a learning environment for their students and a workplace for their
employees free of unlawful harassment, gender bias, discrimination and sexual or other misconduct. In
today’s environment, this goal has often become difficult to achieve. When allegations are made, the preferred
method should be to retain independent counsel to conduct a prompt investigation and, when appropriate,
make recommendations. This process allows colleges and universities to respond with prompt effective action.
The Independent Investigations Team at Bulkley Richardson has conducted investigations in schools and
universities, as well as public and private businesses. Our team is prepared to investigate claims of Title IX
violations, unlawful discrimination, unlawful harassment, and any other claims that may arise in both the
workplace and the educational setting.
In addition, businesses and schools periodically encounter issues relating to potential criminal violations such
as embezzlement, fraud, kickbacks and bribery. Our team has conducted numerous internal investigations of
such issues and worked with law enforcement, where appropriate, on such matters.
The firm has conducted a wide range of investigations, including allegations of:
• Misconduct involving students and employees of colleges, universities, private college prep schools and
public schools
• A gender and age employment discrimination claim against a public school
• A Title IX complaint involving allegations of rape/sexual assault at a university
• A student’s assault of an employee
• Internal investigation involving allegations against senior management
• A racial discrimination claim involving state employees
• Multiple HR investigations for publicly traded companies, including defending filed discrimination claims
• Harassment investigation for local municipality
Cybersecurity
Cybersecurity is a moving target. Technology evolves faster than the law and hackers compete to be the first
to exploit gaps in either. Bulkley Richardson works with clients to put contractual, procedural and educational
safeguards in place to allocate risks and minimize liability before a breach occurs.
Bulkley Richardson’s Cybersecurity Team also works to keep our clients abreast of, and in compliance with,
emerging regulations. This level of proactivity goes back to 2010 when Massachusetts pioneered data privacy
and protection standards with the issuance of 201 C.M.R. 17, and the firm helped clients draft Written
Information Security Programs (WISP). Bulkley Richardson’s Cybersecurity practice group continues to keep
our clients informed of the rapidly evolving personal information and data security laws and regulations of
the fifty states and international regions in which our clients have customers and employees, such as relevant
aspects of the European Union’s General Data Protection Regulations (GDPR), the California Consumer
Protection Act, and the New York SHIELD Act.
The Cybersecurity Team works to protect clients both before and after a data breach. This includes helping
companies prevent a breach by conducting risk assessments and helping clients design and implement
a cybersecurity program – or modify an existing program – to meet new conditions. We, along with select
technical partners, develop incident response plans to put our clients in the best position to respond if a
breach occurs. We also assist in reviewing cyber insurance policies to ensure that clients receive the best
coverage at the lowest cost.
Bulkley Richardson regularly assists clients in complying with a broad range of regulations. From HIPAA to
GDPR and from 201 CMR 17 to the safe harbor rule in Ohio, we have it – and our clients – covered.
The Cybersecurity Team also has experience advising companies on the data privacy and security implications
of mergers and acquisitions, outsourcing arrangements, cross-border data transfers and other transactions.
We perform contract reviews to ensure that vendors commit to protecting and maintaining the confidentiality,
integrity, and availability of data that our clients entrust to them. And we respond to inquiries from federal and
state regulators and, when necessary, litigate to protect our clients’ valuable information.
If a data breach occurs, Bulkley Richardson’s Cybersecurity Team provides rapid and comprehensive incident
response, including handling communications with cyber insurance carriers, assessing potential reporting
obligations and performing after-action analysis.
Intellectual Property and Technology
Bulkley Richardson offers full-service assistance for intellectual property (“IP”) matters, including those related to
acquisition, protection and enforcement of patents, trademarks and copyrights, as well as in unfair competition,
trade secrets and related matters.
Our IP attorneys offer strategic insights and solutions to individuals, entrepreneurs, small businesses at all
stages of development, non-profit organizations, academic institutions, and local, national and multi-national
corporations facing both simple and complex intellectual property issues as they develop and exploit new
technology. We work closely with our clients, as a team, to identify, develop, protect and monetize their IP. Value
is added by delving deep into our clients’ technology, identifying all forms of IP requiring protection and assisting
them in protecting and expanding upon their creative concepts and securing the integrity of their brands. We can
then draw from our firm’s other relevant practice groups to help turn ideas into revenue streams.
Should an IP-related dispute arise, we are there to protect our clients’ interests effectively and efficiently. Because
all actions we take in response to disputes are based on a thorough understanding of applicable laws and facts,
we formulate a proper resolution to any IP-related dispute early and thus strive to resolve disputed matters
before they get to court or other tribunal.
When necessary, we litigate zealously and effectively and have successfully asserted and defended our clients’ IP
rights in tribunals in the United States and around the world, including:
• U.S. Patent and Trademark Office
• State and federal trial and appellate courts
