The Employment Law Practice Group advises employers on all aspects of the employment relationship and<br />

offers practical solutions and advice to avoid and resolve workplace disputes. We provide legal advice on hiring,<br />

promoting, disciplining and discharging employees, wage and hour laws, employee classifications, leave and<br />

Independent Investigations<br />

<strong>College</strong>s and universities seek to provide a learning environment for their students and a workplace for their<br />

employees free of unlawful harassment, gender bias, discrimination and sexual or other misconduct. In<br />

today’s environment, this goal has often become difficult to achieve. When allegations are made, the preferred<br />

method should be to retain independent counsel to conduct a prompt investigation and, when appropriate,<br />

make recommendations. This process allows colleges and universities to respond with prompt effective action.<br />

The Independent Investigations Team at Bulkley Richardson has conducted investigations in schools and<br />

universities, as well as public and private businesses. Our team is prepared to investigate claims of Title IX<br />

violations, unlawful discrimination, unlawful harassment, and any other claims that may arise in both the<br />

workplace and the educational setting.<br />

In addition, businesses and schools periodically encounter issues relating to potential criminal violations such<br />

as embezzlement, fraud, kickbacks and bribery. Our team has conducted numerous internal investigations of<br />

such issues and worked with law enforcement, where appropriate, on such matters.<br />

Cybersecurity<br />

Cybersecurity is a moving target. Technology evolves faster than the law and hackers compete to be the first<br />

to exploit gaps in either. Bulkley Richardson works with clients to put contractual, procedural and educational<br />

safeguards in place to allocate risks and minimize liability before a breach occurs.<br />

Bulkley Richardson’s Cybersecurity Team also works to keep our clients abreast of, and in compliance with,<br />

emerging regulations. This level of proactivity goes back to 2010 when Massachusetts pioneered data privacy<br />

and protection standards with the issuance of 201 C.M.R. 17, and the firm helped clients draft Written<br />

Information Security Programs (WISP). Bulkley Richardson’s Cybersecurity practice group continues to keep<br />

our clients informed of the rapidly evolving personal information and data security laws and regulations of<br />

the fifty states and international regions in which our clients have customers and employees, such as relevant<br />

aspects of the European Union’s General Data Protection Regulations (GDPR), the California Consumer<br />

Protection Act, and the New York SHIELD Act.<br />

The Cybersecurity Team works to protect clients both before and after a data breach. This includes helping<br />

companies prevent a breach by conducting risk assessments and helping clients design and implement<br />

a cybersecurity program – or modify an existing program – to meet new conditions. We, along with select<br />

technical partners, develop incident response plans to put our clients in the best position to respond if a<br />

breach occurs. We also assist in reviewing cyber insurance policies to ensure that clients receive the best<br />

coverage at the lowest cost.


Bulkley Richardson regularly assists clients in complying with a broad range of regulations. From HIPAA to<br />

GDPR and from 201 CMR 17 to the safe harbor rule in Ohio, we have it – and our clients – covered.<br />

The Cybersecurity Team also has experience advising companies on the data privacy and security implications<br />

of mergers and acquisitions, outsourcing arrangements, cross-border data transfers and other transactions.<br />

We perform contract reviews to ensure that vendors commit to protecting and maintaining the confidentiality,<br />

integrity, and availability of data that our clients entrust to them. And we respond to inquiries from federal and<br />

state regulators and, when necessary, litigate to protect our clients’ valuable information.<br />

If a data breach occurs, Bulkley Richardson’s Cybersecurity Team provides rapid and comprehensive incident<br />

response, including handling communications with cyber insurance carriers, assessing potential reporting<br />

Intellectual Property and Technology<br />

Bulkley Richardson offers full-service assistance for intellectual property (“IP”) matters, including those related to<br />

Dan Finnegan focuses his practice in the areas of litigation, property tax, construction<br />

businesses, and governmental and individual clients at the trial and appellate court levels in both state and federal courts. Dan<br />

in state and federal courts. She has also successfully represented employers in state court on wage and hour claims. Mary Jo regularly<br />

advises employers on personnel and wage and hour issues, reviews and drafts personnel policies, and conducts seminars for clients on<br />

sexual harassment in the workplace, employment discrimination in the hiring process, reasonable accommodations, and remote work.<br />

Justice Rup, in over 25 years on the Massachusetts Superior Court, has presided over a<br />

wide variety of cases. In her years on the bench, she has earned a reputation for fairness<br />

and efficiency. After leaving the bench, she joined Bulkley Richardson as senior counsel,<br />

handling the firm’s Independent Investigations Alternative Dispute Resolution practices,<br />

along with Justice John Greaney.<br />

Justice Rup has always been a proponent of legal education at many levels. She has lectured in high schools, colleges and law<br />

schools. Over the last decade, she has traveled to Tomsk and Rostov as a participant in education exchange programs with Russian<br />

legal professionals and more recently to Latin America, Israel and Jordan.<br />
