Choosing the Right Lawyer is No Accident
complaint, the insurance company name is nowhere to be found. Here’s
why: When you bring a lawsuit for injuries, the insurance company is
not the party that caused the accident. They are stepping into the shoes
of their customer, the defendant. The law wants the jury to make their
decision not based on ability to pay, but on the law. The school of thought
is that a jury might award more money to an injured plaintiff if they knew
there was an insurance company that would cover the money damages.
Unfortunately, this sometimes has an opposite effect where jurors are
concerned that the defendant may have to pay the money judgment
personally, and it can influence verdicts. With that being said, if you see
a lawsuit against a person for personal injuries, it is safe to assume that
there is automobile insurance covering the defendant. If there were not,
most Florida attorneys would advise not bring the lawsuit because as
mentioned earlier, it is extremely difficult, often next to impossible, to
collect from people individually in this state.
One of the only ways you would see an insurance company named in a
personal injury case is if it is an Uninsured/Underinsured Motorist claim,
where the negligent defendant had no or very little bodily injury liability
coverage, as discussed earlier.
