A team of Canterbury University<br />

students is developing a new<br />

artificial heart prototype to<br />

be showcased at a prestigious<br />

international competition.<br />

Six mechanical and biomedical<br />

engineering students will<br />

compete in the Heart Hackathon<br />

in Vienna in December.<br />

<strong>The</strong> artificial heart could<br />

one day help one of the 50,000<br />

patients worldwide currently<br />

Repeat sexual offender<br />

staying in prison<br />

Sexual predator Leo Darin Goodwin<br />

will remain behind bars after<br />

being suspected of approaching<br />

schoolgirls while on parole.<br />

53-year-old Goodwin is subject to<br />

a preventive detention order for<br />

recidivist sexual violence. He was<br />

recalled to prison on an interim<br />

order last month after police<br />

charged him with breaching his<br />

parole conditions by approaching<br />

teenagers under the age of 16<br />

earlier this year. He was granted<br />

parole in March 2<strong>02</strong>3 after being<br />

jailed in 2006 for a violent sexual<br />

attack on a teenager.<br />

​Harbour cruises limited<br />

to protect dolphins<br />

Tourism operators in Akaroa are<br />

being limited to 20 harbour trips a<br />

day between them in the summer<br />

to protect Hector’s dolphins.<br />

Research has shown vessel activity<br />

can disturb the dolphins' behaviour<br />

so the Department of Conservation<br />

has put in the new trip limits.<br />

Operators will be limited to 12<br />

tours a day in the colder months.<br />

Chimney safety<br />

checks encouraged<br />

<strong>The</strong> Natural Hazards Commission<br />

is urging people to check their<br />

chimneys before another large<br />

earthquake. <strong>The</strong> commission<br />

warned unreinforced masonry<br />

structures can pose a serious risk<br />

of injury or even death. More than<br />

15,000 chimneys toppled over in<br />

the February 22, 2011 earthquake.<br />

Public education manager Hamish<br />

Armstrong said houses built before<br />

1970 were most at risk, particularly<br />

if brick or concrete chimneys<br />

remained in place. “Pretty much<br />

every major earthquake over<br />

the past 170 years has shown<br />

that crumbling chimneys pose a<br />

significant risk to people’s safety<br />

and to our homes,” he said.<br />

New safety<br />

rules aim to<br />

bike injuries<br />

Mountain bike trail safety<br />

guidelines have been updated<br />

in a bid to reduce the<br />

hundreds of annual injuries<br />

in Canterbury and thousands<br />

nationwide.<br />

Until August, there were<br />

major inconsistencies across<br />

the country in how mountain<br />

biking trails were graded by<br />

degree of challenge.<br />

Key changes include<br />

consistent safety signage, new<br />

auditing guidelines, advice<br />

on trail maintenance, trail<br />

enhancers and safety in design,<br />

as well as refreshed diagrams<br />

and technical drawings for<br />

trails.<br />

Canterbury recorded the<br />

second-highest number of<br />

mountain biking injuries in<br />

2<strong>02</strong>4 with 699. So far this year,<br />

the region has the third-most<br />

with 386.<br />

ACC received 4238 mountain<br />

biking related injury claims in<br />

2<strong>02</strong>4, costing $22.2 million to<br />

help people recover.<br />

Up to September 4 this year,<br />

2659 claims have been lodged,<br />

costing $16.7m.<br />

Nationwide, the age groups<br />

which suffered the most<br />

mountain biking-related<br />

injuries in 2<strong>02</strong>4 were 10-14<br />

(617), 50-54 (471), 45-49 (422),<br />

and 55-59 years (400).<br />

Spike in business liquidations<br />

Christchurch businesses<br />

are feeling the pinch of the<br />

national economic downturn as<br />

liquidations remain high.<br />

Data from the Companies<br />

Office shows 141 companies in<br />

the city had entered liquidation<br />

since January.<br />

From June 30, 2<strong>02</strong>4, to June<br />

30, 2<strong>02</strong>5, 2<strong>02</strong> companies went<br />

into liquidation, while in the<br />

2<strong>02</strong>3/24 financial year, 200<br />

companies entered liquidation<br />

and in 22/23 there were 136.<br />

<strong>The</strong> number of liquidations<br />

has spiked significantly since<br />

2<strong>02</strong>0/2<strong>02</strong>1 when there were 105.<br />

If one or two of these<br />

challengers – Jones, Kearney,<br />

Zervos, Manji, Simons, Mora,<br />

or Yau – win, it could shift<br />

influence away from the leftleaning<br />

bloc.<br />

This assumes the left-leaning<br />

bloc does not gain additional<br />

city councillors and Mauger<br />

retains the mayoralty.<br />

Of these seven candidates,<br />

Manji and Yau have been the<br />

most in favour of exploring<br />

partial strategic asset sales.<br />

Jones, Zervos, Simons and<br />

Mora say they neither support<br />

or oppose sales with the general<br />

view being they would analyse<br />

options further with more<br />

information if elected.​<br />

Kearney had been noncommittal<br />

when previously<br />

asked by media about asset<br />

sales, but has come out against<br />

at least a sale of the port.<br />

<strong>The</strong>se key five ward elections<br />

will likely determine the<br />

political leanings of the city<br />

council, but three other ward<br />

races are also worth watching<br />

– Burwood, Papanui and Banks<br />

Peninsula.<br />

Nana’s secret to moving free<br />

For the last few years, Christine<br />

watched other grandparents chase<br />

their grandchildren around the<br />

playground while she sat on the<br />

same park bench.<br />

“I’d gotten quite good at making<br />

excuses,” the 64-year-old admits.<br />

“When my granddaughter would<br />

tug at my hand saying ‘Come<br />

on, Nana!’ I’d have to tell her<br />

Nana needed to rest. But really,<br />

I just didn’t have the confidence<br />

anymore.”<br />

<strong>The</strong> gradual changes in her<br />

knees had transformed Christine<br />

from an active grandmother into<br />

someone who measured life<br />

in careful steps. Every outing<br />

required planning. <strong>The</strong> local<br />

park, just 400 metres away, felt<br />

impossibly far.<br />

“<strong>The</strong> worst part wasn’t physical<br />

- it was watching life happen<br />

without me,” she explains. “I’d<br />

tried various products for joint<br />

support. Some upset my stomach.<br />

Others smelled awful and left<br />

marks on everything. Nothing<br />

gave me the confidence to get<br />

moving again.”<br />

Christine had settled into a<br />

cautious routine, always thinking<br />

about her knees. “I kept thinking<br />

about my mother’s health. I could<br />

see myself heading down the same<br />

path of limitations.”<br />

<strong>The</strong>n two months ago, while<br />

at the local pharmacy, Christine<br />

noticed a small display for Koru<br />

FX - a natural joint and muscle<br />

“I was sceptical - I’d tried so<br />

many things,” she says. “But I’d<br />

seen it talked about online and the<br />

<strong>The</strong> 400-metre walk that had<br />

seemed like miles suddenly<br />

wasn’t. Christine found herself not<br />

pushing her granddaughter on the<br />

swings, even managing a gentle<br />

game of chase.<br />

“She looked at me with these<br />

huge eyes and said, ‘Nana, you’re<br />

playing!’ That’s when I felt like<br />

crying,” Christine laughs, eyes<br />

misting at the memory. “Three<br />

years of watching from that bench,<br />

and finally I was part of her world<br />

again.”<br />

Now, Christine continues to<br />

reclaim pieces of her life. Daily<br />

walks to the shops. Standing and<br />

baking with her granddaughter.<br />

Even careful gardening, kneeling<br />

with support.<br />

“I’m still cautious, but I’m not<br />

afraid anymore,” she says. “<strong>The</strong><br />

cream gives my knees the support<br />

I need to be present in my own life<br />

again.”<br />

She’s careful not to overdo<br />

things but finds herself saying yes<br />

to activities more often.<br />

“People ask what changed, and I<br />

tell them ‘Koru FX’,” she grins.<br />

Campers and whitebaiters at Kairaki<br />

Beach, near Kaiapoi, have been accused of<br />

anti-social behaviour.<br />

A beachgoer, who did not want to be<br />

named, said he had “a culture shock”<br />

during a recent visit to the beach, where<br />

he witnessed what he described as “a<br />

ramshackle slum-like camp”.<br />

He said the behaviour of some campers<br />

and whitebaiters was concerning. <strong>The</strong><br />

whitebait season runs until <strong>October</strong> 30.<br />

Canterbury police rural area<br />

commander inspector Peter Cooper said<br />

police had been investigating reports of<br />

“anti-social and threatening behaviour” at<br />

Kaiapoi’s beaches over the last month.<br />

“We encourage everyone that uses the<br />

area for whitebaiting or other activities to<br />

respect one another,” he said.<br />

​A Waimakariri District Council<br />

spokesperson said staff were aware of the<br />

concerns and were monitoring the site<br />

alongside Environment Canterbury.<br />

Staff visited the beach several times<br />

and spoken to about a dozen people who<br />

were whitebaiting and camping.<br />

<strong>The</strong> spokesperson said camper and<br />

whitebaiter numbers were consistent with<br />

previous years.<br />

“<strong>The</strong>re have been instances of antisocial<br />

and threatening behaviour, which we<br />

have shared with police. <strong>The</strong>y are keen to<br />

see this defused.”<br />

<strong>The</strong> monitoring of whitebaiting is a joint<br />

agency approach with the Department<br />

of Conservation which is responsible for<br />

the enforcement of fishing gear and catch<br />

limits.<br />

<strong>The</strong> district council’s role is to monitor<br />

the Pegasus Bay area in line with the<br />

council’s Northern Pegasus Bay Bylaw.<br />

Under the bylaw, freedom and overnight<br />

camping on the beach and sand<br />

dunes is not permitted.<br />

<strong>The</strong> council prefers to educate beach<br />

users, rather than taking enforcement<br />

action, the spokesperson said.<br />

“This is to minimise any negative effects<br />

on Pegasus Bay, such as toileting, dogs,<br />

fires, litter and anti-social behaviour.”<br />

When Alicia Mabey started<br />

livestreaming workouts during<br />

As demand grew, so did Mabey’s realisation<br />

that she needed support.<br />

teacher.<br />

A man who lost his wife when the CTV<br />

building collapsed in the February 22,<br />

2011, earthquake says the Government's<br />

new rules are prioritising building<br />

owners over potential victims.<br />

Under the new earthquake safety criteria<br />

announced on Monday, 55% of the<br />

buildings that were previously considered<br />

earthquake prone will be marked<br />

as safe.<br />

<strong>The</strong> Government says the changes will<br />

save building owners more than $8.2 billion<br />

across New Zealand.<br />

Under the new rules a building like the<br />

CTV building – where 115 people died<br />

in 2011 - would not automatically be<br />

deemed earthquake prone.<br />

Professor Maan Alkaisi, whose wife<br />

died in that building, told Checkpoint<br />

the changes appeared to be about taking<br />

care of building owners, rather than the<br />

victims of any earthquakes.<br />

“We know we are in high risk areas<br />

like Christchurch or Wellington, so who<br />

will take care of victims when something<br />

happens?”<br />

He said his main concern was over<br />

who will decide which buildings are low<br />

risk.<br />

“Because from our experience, the CTV<br />

Building was green-stickered, so a lowrisk<br />

building. So what exactly what they<br />

will inspect and so forth, because the<br />

devil is in the details. We would like to<br />

know about the inspection procedures,<br />

who is going to do them, what exactly<br />

they are going to test and things like<br />

that.<br />

“We've been campaigning for over<br />

15 years for accountability, for justice<br />

and to improve building standards and<br />

practices, so we were campaigning for a<br />

system to improve public safety, and cost<br />

should not be the only factor.<br />

“Human safety and lives should be put<br />

first, or at least have a priority in these<br />

decisions.”<br />

Building and Construction Minister<br />

Chris Penk has argued that the new rules<br />

for earthquake safety will save lives in<br />

the long run.<br />

He told Checkpoint that the previous<br />

rules were too costly and led many<br />

buildings to be abandoned, rather than<br />

strengthened.<br />

Penk said that when it came to cases<br />

like the CTV Building, the government<br />

was retaining the “identify at any time”<br />

pathway.<br />

“Which is to say that buildings that are<br />

objectively able to be demonstrated as<br />

unsafe or continue to be captured by the<br />

regime, for example if they are structurally<br />

unsound or engineered in a faulty<br />

manner, as we know sadly was the case<br />

with the CTV building. So we’re retaining<br />

that mechanism while removing the<br />

blunt instrument approach that would<br />

capture a number of buildings that are<br />

currently safe.”<br />

But Alkaisi said he could not see how<br />

the new regulations will lower the risk,<br />

“it will definitely increase the risk to<br />

human lives.”<br />

He said the government needed to talk<br />

to the families of victims and learn what<br />

they have experienced so these factors<br />

could be considered.<br />

Alkaisi said he received an email from<br />

Penk today about the changes, and saying<br />

that the victims families will have an<br />

opportunity to raise any concerns about<br />

these changes, "which I appreciated, and<br />

I will take this opportunity".<br />

“Previous governments, whether<br />

National or Labour, have consulted me, at<br />

least to look into what the victims think<br />

about these changes, so I was hoping we<br />

would be more engaged with this.”<br />

a prominent feature of the<br />

city’s skyline for more than a<br />

two water gas plants releasing<br />

the gasworks’ supply<br />

was turned off (below) on<br />

September 30, 1982.<br />

<strong>The</strong> production of gas from<br />

coal had been a welcome<br />

19th century innovation.<br />

Christchurch streets were lit<br />

by a few kerosene lamps prior<br />

to the gasworks; by 1913,<br />

there were 1235 streetlamps<br />

powered by gas.<br />

It was also used for domestic<br />

heating and cooking. After<br />

1982 – THE GASWORKS<br />

demand for electric lighting<br />

and heating grew, the<br />

gasworks found its niche supplying<br />

gas for commercial<br />

heating.<br />

In 1967, the company<br />

decided to use oil instead of<br />

coal to produce gas. But over<br />

the next decade oil prices<br />

rose and the plant became<br />

increasingly unviable.<br />

On August 10, 1975, the huge<br />

No 6 tank collapsed, releasing<br />

1.3 million cubic feet of<br />

gas into the air. Fortunately<br />

there were no injuries, but<br />

emergency services remained<br />

onsite into the evening in case<br />

a fire broke out. Five years<br />

later, a spectacular fire in<br />

the tar plant, thought to be<br />

caused by a malfunction, was<br />

quickly quelled<br />

When the Government<br />

started to phase out subsidies<br />

to manufactured gas companies,<br />

the end was in sight.<br />

<strong>The</strong> three million bricks<br />

used onsite were expected to<br />

be sold during demolition.<br />

to keep the boys focused.<br />

“We put huge focus on our<br />

first game of the tournament,<br />

we've got to start the right<br />

way, we can't put ourselves in<br />

a hole. <strong>The</strong>n we've got to look<br />

at how the rest of the draw<br />

looks, so the next job is we<br />

want to top our pool, because<br />

if you've got top spot then you<br />

had a game off before quarterfinals,<br />

and that was quite<br />

critical to earn ourselves that<br />

rest, which is critical in a long<br />

tournament.” Shirley won their<br />

group before beating Nelson<br />

College 84-80 in the quarterfinals<br />

and Westlake Boys’ High<br />

School 90-88 in their semi-final.<br />

Costley said the win meant a<br />

lot, as he was a former Shirley<br />

student who also played in the<br />

basketball team.<br />

"<strong>The</strong>re's a lot of history,<br />

and I've had so many former<br />

players from my playing days<br />

and then throughout the last<br />

25 years that have all played<br />

there and are sharing a bit of<br />

it, and they're all reaching out.<br />

<strong>The</strong> support on that side of<br />

things has been amazing.<br />

we had this goal of, at the very<br />

least, qualifying for nationals<br />

and finishing with a national<br />

ranking. I don't know if we<br />

ever kind of thought deep<br />

down that we'd win it all, but<br />

Claims against estates under<br />

A de-facto partner of less than three<br />

years, a stepchild or a parent of the<br />

deceased can also make a claim in<br />

exceptional circumstances.<br />

<strong>The</strong> FPA provides that if adequate<br />

provision is not made from the<br />

deceased’s estate for the proper<br />

maintenance and support of the<br />

claimant the Court may order provision<br />

out of a deceased’s estate for the<br />

claimant. <strong>The</strong> Court will consider<br />

whether there has been a breach of a<br />

moral duty by the deceased to provide<br />

for the claimant. Factors such as the<br />

size of the estate, the health and income<br />

of the claimant and the relationship<br />

between the claimant and the deceased<br />

during the deceased’s lifetime are<br />

relevant.<br />

Adequate provision for “proper<br />

maintenance and support” does not<br />

equate with fairness. A deceased does<br />

not have to leave their estate equally to<br />

their children or all of their estate to a<br />

spouse or partner. When considering<br />

competing moral claims matters<br />

such as the financial position of each<br />

potential claimant is highly relevant.<br />

Claims must be brought within 12<br />

months of the date of the grant of<br />

probate or letters of administration<br />

with very few exceptions. From the<br />

claimant’s point of view it is preferable<br />

to make a claim within 6 months to<br />

avoid an early distribution of assets.<br />

Many claims are settled by way<br />

of informal negotiations between<br />

parties without the necessity for Court<br />

proceedings. In some cases claims<br />

do proceed to Court but most are<br />

resolved in mediation or a judicial<br />

settlement conference without the need<br />

for a full hearing. Claims are usually<br />

determined by the Courts based on<br />

affidavit evidence but in some cases<br />

oral evidence is required. This can be<br />

stressful for all the parties involved and<br />

should be a last resort.<br />

It is always important that advice is<br />

taken as soon as practicable should a<br />

person wish to challenge or contest a<br />

will in order to avoid unnecessary costs<br />

and disappointment. For those making<br />

and to make wills in a way which will<br />

avoid family disputes later on.<br />

Burnside lose key duo<br />

ahead of Metro season<br />

​Three-time Metro premiership two-day<br />

winners Burnside West University are<br />

victims of their own success this season<br />

after losing two key players to domestic<br />

contracts.<br />

Opening batter Scott Janett and allrounder<br />

Oscar Jackson played crucial<br />

roles in the side’s two-day and T20 titles,<br />

while they also finished runner-up in the<br />

one-dayers.<br />

But Janett’s involvement this season will<br />

be heavily limited after he earned a Canterbury<br />

contract while Jackson has left the<br />

club entirely after signing a first professional<br />

deal with Wellington.<br />

Head coach Carl Huyser said Old Boys<br />

Collegians all-rounder Matt Lewis had<br />

joined as an almost-direct replacement for<br />

Jackson.<br />

“A couple of his good childhood friends<br />

with the same core group defending their<br />

premier tennis interclub championship<br />

title – an honour they have claimed in 18<br />

of the past 25 seasons.<br />

Team stalwart Johnny McHarg said he<br />

was excited for another title run with<br />

his regular teammates, the Meredith<br />

brothers Matt, James and Tim, along<br />

with Harry Weeds, who joined Cashmere<br />

after moving to Christchurch nine years<br />

ago. Ashburton’s Tyler Leonard will also<br />

return after debuting for the side last year.<br />

McHarg said it was a privilege to be part<br />

of the Cashmere crew, which has made<br />

the final in 24 of the last 25 years.<br />

“It really is like playing with family. We<br />

get on so well on and off the court.”<br />

Cashmere has home-court advantage in<br />

Saturday’s first round, hosting Burnside<br />

mayoralty.<br />

Arps gained notoriety for<br />

sharing the livestream video of<br />

the March 2019 mosque attacks<br />

filmed by the terrorist Brenton<br />

Tarrant who murdered 51<br />

people at Al N or Mosque and<br />

Linw od Islamic Centre.<br />

He shared<br />

the video with<br />

30 people and<br />

asked a friend to<br />

modify the video<br />

by editing in<br />

cro s-hairs and<br />

a ‘ki l-count’.<br />

When<br />

interviewed<br />

by police he Philip Arps<br />

described the<br />

video as “awesome”.<br />

Arps was charged with<br />

distributing an objectionable<br />

publication. He pleaded guilty<br />

and was sentenced to 21<br />

months prison in June, 2019.<br />

At one of his court a pearances,<br />

Arps distributed<br />

holocaust denial material to<br />

journalists and the public.<br />

He was released on bail in<br />

January, 2<strong>02</strong>0 but sent back to<br />

prison for four months in April,<br />

2<strong>02</strong>3 due to a range of breaches<br />

to release conditions.<br />
