It’s that time again
Hundreds of thousands of
people have taken part in the
FreshChoice City2Surf over the
decades – from those aiming to
be first across the line to those
who simply want to be part of
Canterbury’s most iconic fun
run.
And now it is rolling into the
time of the year when the The
Star’s iconic and timeless event
is on the horizon.
Team and individual entries
for the FreshChoice City2Surf on
Sunday, March 15, are now open
at city2surf.co.nz
Allied Media regional
manager Steve McCaughan is
expecting the event to be even
bigger in 2026 than this year’s
run in March.
“It was a fantastic day, and
the weather played its part as
we see every year.” McCaughan
said.
Political
posturing
looms
large
Mayor Phil Mauger and his rightleaning
political allies have often
spoken of needing “one more
vote” or a “working majority” of
like-minded city councillors to get
key decisions over the line.
On pages 6 and 7 reporter Dylan
Smits breaks down the political
leanings of the current city
councillors, and candidates, on the
right, middle and left side of the
political spectrum with the local
body elections just nine days away.
The left-leaning voting bloc of
city councillors has got their way
most of the time this past three
years in what has been Mauger’s
first term as mayor.
But that could all change
after the local body elections
with centrist and centre-right
independent candidates mounting
major challenges of left-leaning
The People’s Choice incumbents in
three wards – Riccarton, Central
and Innes.
The balance of political power
could also shift away from the leftleaning
bloc if incumbent Celeste
Donovan loses in the Coastal Ward
or Sumner lawyer Ian Kearney
wins the Heathcote Ward, vacated
by city councillor Sara Templeton
who is standing for mayor only.
The possibility of partial
strategic asset sales, lowering
rates rises, and Christchurch’s
transport future will be front of
mind for voters as they cast their
votes.
Chimney safety
checks encouraged
The Natural Hazards Commission
is urging people to check their
chimneys before another large
earthquake. The commission
warned unreinforced masonry
structures can pose a serious risk
of injury or even death. More than
15,000 chimneys toppled over in
the February 22, 2011 earthquake.
Public education manager Hamish
Armstrong said houses built before
1970 were most at risk, particularly
if brick or concrete chimneys
remained in place. “Pretty much
every major earthquake over
the past 170 years has shown
that crumbling chimneys pose a
significant risk to people’s safety
and to our homes,” he said.
New safety
rules aim to
curb mountain
bike injuries
Mountain bike trail safety
guidelines have been updated
in a bid to reduce the
hundreds of annual injuries
in Canterbury and thousands
nationwide.
Until August, there were
major inconsistencies across
the country in how mountain
biking trails were graded by
degree of challenge.
Key changes include
consistent safety signage, new
auditing guidelines, advice
on trail maintenance, trail
enhancers and safety in design,
as well as refreshed diagrams
and technical drawings for
trails.
Canterbury recorded the
second-highest number of
mountain biking injuries in
2024 with 699. So far this year,
the region has the third-most
with 386.
ACC received 4238 mountain
biking related injury claims in
2024, costing $22.2 million to
help people recover.
Up to September 4 this year,
2659 claims have been lodged,
costing $16.7m.
Nationwide, the age groups
which suffered the most
mountain biking-related
injuries in 2024 were 10-14
(617), 50-54 (471), 45-49 (422),
and 55-59 years (400).
A four-bedroom, four-bathroom home on Dyers Pass Rd, Cashmere, sold last
section spread over three titles.
Marked-down
mansion sells
for $4.15m
A sprawling estate has found
a buyer after its price was
slashed by hundreds of
thousands of dollars.
The grand four-bedroom,
four-bathroom home on Dyers
Pass Rd, Cashmere, sold last
month for $4.15m – $650,000
below what the late owners
paid for it in 2013.
Harcourts Gold
agent Cameron Bailey,
who marketed the
home with colleague
Christeen Flynn, told
OneRoof the sale
price reflected current
market conditions in
Christchurch.
“There are a lot of
people at the moment
selling houses for less
than what they paid,” he
said, noting that sales activity
at the lower end of the market
was busier than the top end.
The home, considered to be
the suburb’s most expensive,
was initially listed for sale in
August last year for $4.5m.
The asking price was dropped
twice since the property hit
the market – first to $4.299m,
and then to $4.15m, OneRoof
reported.
The property attracted two
offers, with a Christchurch
family the successful buyers.
The sale price is the highest in
Cashmere in at least five years,
OneRoof-Valocity data shows.
The house was designed by
Trengrove and Blunt Architects
in 2006 and boasts
impressive views of the
city and the Southern
Alps and comes with a
summer house.
Bailey said families and
empty-nesters were the
main buyer types.
Properties over 1500sq
m were a rarity in
Cameron Christchurch, so to have
Bailey one at 4036sq m, spread
over three titles, made it
a standout in the market.
Bailey said the new owners
planned to retain all of the land.
He said the cost of building the
same house now would be huge.
“That’s the attraction in
this market – you can buy
properties below what you
can build them for,” he told
OneRoof.
Spike in business liquidations
BY DYLAN SMITS
Christchurch businesses
the city had entered liquidation
since January.
From June 30, 2024, to June
Key wards to determine balance
Mayor Phil Mauger has often
come up short of the votes
needed to achieve his priorities.
If re-elected, which candidates
will need to win for him to gain
a working majority on council?
Dylan Smits investigates
Left-leaning
Centrist
The political balance of power
is likely to be influenced by
elections in five key wards:
Central, Innes, Heathcote,
Coastal, and Riccarton.
Three of these wards are held
by left-leaning The People’s
Choice incumbents while leftleaning
Coastal Ward councillor
Celeste Donovan is an independent.
Heathcote is an open contest,
as left-leaning independent Sara
Templeton is standing for mayor
only.
This means there are five key
opportunities for candidates
who do not identify as leftleaning
to win, potentially
shifting influence away from
the left-leaning voting bloc
and assisting Mauger, who is
right-leaning, in a possible
second-term.
However, many challengers
to left-leaning incumbents
emphasise their independence
from Mauger and identify more
with political centrism than rightleaning
politics.
Mauger can usually only rely
on six city councillors to back
him during politically-charged
Celeste
Donovan
Melanie
Coker
Pauline
Cotter
Jake
McLellan
votes, but eight are needed for a
majority.
His priorities typically lean
right politically, with a stated
focus on fiscal discipline and
reducing rates increases.
In December 2022, he backed
a proposal for Christchurch City
Holdings Ltd (CCHL) to develop
business cases for potentially
selling strategic assets including
Lyttelton Port, the airport, Orion,
Enable, City Care, and EcoCentral.
Mauger and nine city
councillors supported the move,
Sara Templeton
but public backlash slowed
momentum. The council later
voted 8-7 against handing control
to CCHL.
Mauger has since ruled out
selling the port, airport and
Orion.
He and his allies often say
they need “one more vote” or a
“working majority”.
Lost battles have included
attempts to remove the Park
Tce temporary cycleway and cut
funding for a pedestrian-friendly
Gloucester St.
Tyla
Harrison-Hunt
Tyrone
Fields
Yani
Johanson
Templeton, Mauger’s main
rival for the mayoralty, would
require the left-leaning bloc
to hold or expand in order to
best progress her priorities
– investing more in water
infrastructure and blocking
asset sales.
However, unlike Parliament,
the council has no formal
government or opposition.
Voting blocs are informal,
many decisions are unanimous,
and city councillors sometimes
break from allies, and all city
Andrei
Moore
councillors are considered
equal partners in governance
and decision-making.
Currently, eight of the 16 city
councillors reliably vote with
the left-leaning bloc.
This includes all six People’s
Choice incumbents standing
for re-election: deputy mayor
Pauline Cotter (Innes),
Melanie Coker (Spreydon),
Jake McLellan (Central), Tyla
Harrison-Hunt (Riccarton),
Yani Johanson (Linwood),
and Tyrone Fields (Banks
Peninsula).
Independents Templeton
and Donovan (Coastal) almost
always vote with People’s
Choice on divisive political
issues.
The right-leaning voting bloc
is made up of Mauger, Sam
MacDonald (Waimairi), James
Gough (Fendalton), Victoria
Henstock (Papanui), Aaron
Centrist
Tim
Scandrett
Keown (Harewood), Mark Peters
(Hornby), and Kelly Barber
(Burwood).
Peters is the most likely of the
group to break ranks.
MacDonald and Gough
belong to the Independent
Citizens ticket, while Mauger
and his other allies stand as
independents.
Two city councillors – Andrei
Moore (Halswell) and Tim
Scandrett (Cashmere) – are more
centrist and often decide close
votes.
If the left bloc remains united,
they only need either Moore or
Scandrett, or a defection from
the right side to form a votewining
majority.
By contrast, the right bloc
must remain unanimous and
win both centrists’ support, or
peel away left votes, to succeed.
Looking at the less competitive
ward races, three right-leaning
Sam
MacDonald
Mark
Peters
James
Gough
city councillors – Keown, Peters,
and MacDonald – are running
unopposed.
David Cartwright is the likely
right-leaning replacement in
Fendalton, endorsed by outgoing
councillor Gough.
Coker and Johanson,
representing Spreydon and
Linwood, are likely to win due to
those wards’ left-leaning voting
history.
Scandrett and Moore also have
strong chances of re-election in
Cashmere and Halswell.
Right-leaning
Phil Mauger
With Templeton pursuing
the mayoralty, Heathcote is
the only one of the five highlycompetitive
wards without an
incumbent.
It is a two-way race between
People’s Choice candidate and
former Living Wage Movement
organiser Nathaniel Herz-
Jardine and Sumner lawyer Ian
Kearney.
It is a rematch in Innes Ward
between deputy mayor Cotter
and former city councillor Ali
Jones.
Victoria
Henstock
Kelly
Barber
Aaron
Keown
Cotter won the last election by
a razor-thin eight-vote margin.
In the Central Ward,
incumbent McLellan will
need to fend off high-profile
challenges from former city
councillor Raf Manji and
community advocate Hayley
Guglietta.
In Riccarton, incumbent
Harrison-Hunt will also have to
beat four other candidates.
They are Riccarton Bush-
Kilmarnock Residents
Association chair Tony Simons,
longtime community board
member Debbie Mora, 2022
Riccarton runner-up property
developer Sam Yau, and café
owner Mark Chirnside.
Right-leaning community
board member Jo Zervos
is challenging incumbent
Donovan in the Coastal Ward,
with left-leaning Taraia Brown
also in the race.
If one or two of these
challengers – Jones, Kearney,
Zervos, Manji, Simons, Mora,
or Yau – win, it could shift
influence away from the leftleaning
bloc.
This assumes the left-leaning
bloc does not gain additional
city councillors and Mauger
retains the mayoralty.
Of these seven candidates,
Manji and Yau have been the
most in favour of exploring
partial strategic asset sales.
Jones, Zervos, Simons and
Mora say they neither support
or oppose sales with the general
view being they would analyse
options further with more
information if elected.
Kearney had been noncommittal
when previously
asked by media about asset
sales, but has come out against
at least a sale of the port.
These key five ward elections
will likely determine the
political leanings of the city
council, but three other ward
races are also worth watching
– Burwood, Papanui and Banks
Peninsula.
Nana’s secret to moving free
For the last few years, Christine
watched other grandparents chase
their grandchildren around the
playground while she sat on the
same park bench.
“I’d gotten quite good at making
excuses,” the 64-year-old admits.
“When my granddaughter would
tug at my hand saying ‘Come
on, Nana!’ I’d have to tell her
Nana needed to rest. But really,
I just didn’t have the confidence
anymore.”
The gradual changes in her
knees had transformed Christine
from an active grandmother into
someone who measured life
in careful steps. Every outing
required planning. The local
park, just 400 metres away, felt
impossibly far.
“The worst part wasn’t physical
- it was watching life happen
without me,” she explains. “I’d
tried various products for joint
support. Some upset my stomach.
Others smelled awful and left
marks on everything. Nothing
gave me the confidence to get
moving again.”
Christine had settled into a
cautious routine, always thinking
about her knees. “I kept thinking
about my mother’s health. I could
see myself heading down the same
path of limitations.”
Then two months ago, while
at the local pharmacy, Christine
noticed a small display for Koru
FX - a natural joint and muscle
relief cream made in New
Zealand.
“I was sceptical - I’d tried so
many things,” she says. “But I’d
seen it talked about online and the
lady said it’s been selling really
well which made me think it was
worth trying.”
Christine began applying the
cream directly to both knees
each morning and night, gently
massaging it in. “It absorbed
beautifully, with a pleasant
peppermint scent. No sticky
residue on my clothes.”
“After a few weeks, I noticed
I was moving differently. More
confidently. My knees felt
supported,” she reflects. “If I
overdid it, the Koru FX was easy
to pop on quickly and I’d feel it
getting to work right away.”
The real test came when her
three-year-old granddaughter
arrived for a visit.
“She asked if we could go to the
park, and I almost said my usual
‘not today’. Then I realised - I felt
ready to try. Not reckless, just...
ready.”
The 400-metre walk that had
seemed like miles suddenly
wasn’t. Christine found herself not
just at the park, but participating -
pushing her granddaughter on the
swings, even managing a gentle
game of chase.
“She looked at me with these
huge eyes and said, ‘Nana, you’re
playing!’ That’s when I felt like
crying,” Christine laughs, eyes
misting at the memory. “Three
years of watching from that bench,
and finally I was part of her world
again.”
Now, Christine continues to
reclaim pieces of her life. Daily
walks to the shops. Standing and
baking with her granddaughter.
Even careful gardening, kneeling
with support.
“I’m still cautious, but I’m not
afraid anymore,” she says. “The
cream gives my knees the support
I need to be present in my own life
again.”
She’s careful not to overdo
things but finds herself saying yes
to activities more often.
“People ask what changed, and I
tell them ‘Koru FX’,” she grins.
Campers and whitebaiters at Kairaki
Beach, near Kaiapoi, have been accused of
anti-social behaviour.
A beachgoer, who did not want to be
named, said he had “a culture shock”
during a recent visit to the beach, where
he witnessed what he described as “a
ramshackle slum-like camp”.
He said the behaviour of some campers
and whitebaiters was concerning. The
whitebait season runs until October 30.
Canterbury police rural area
commander inspector Peter Cooper said
police had been investigating reports of
“anti-social and threatening behaviour” at
Kaiapoi’s beaches over the last month.
“We encourage everyone that uses the
area for whitebaiting or other activities to
respect one another,” he said.
A Waimakariri District Council
spokesperson said staff were aware of the
concerns and were monitoring the site
alongside Environment Canterbury.
Staff visited the beach several times
and spoken to about a dozen people who
were whitebaiting and camping.
The spokesperson said camper and
whitebaiter numbers were consistent with
previous years.
“There have been instances of antisocial
and threatening behaviour, which we
have shared with police. They are keen to
see this defused.”
The monitoring of whitebaiting is a joint
agency approach with the Department
of Conservation which is responsible for
the enforcement of fishing gear and catch
limits.
The district council’s role is to monitor
the Pegasus Bay area in line with the
council’s Northern Pegasus Bay Bylaw.
Under the bylaw, freedom and overnight
camping on the beach and sand
dunes is not permitted.
The council prefers to educate beach
users, rather than taking enforcement
action, the spokesperson said.
“This is to minimise any negative effects
on Pegasus Bay, such as toileting, dogs,
fires, litter and anti-social behaviour.”
When Alicia Mabey started
livestreaming workouts during
lockdown, she wasn’t thinking about
brand strategy or business plans.
With gyms closed and visits to her
terminally ill father halted, the Timaru
mum of five and wellness coach was
simply trying to cope.
“I was struggling – and if I was, others
must have been too,” she said.
“I just wanted to help people get out of
bed and move their bodies.”
That impulse led to Motivating-Me, an
online wellness platform offering fitness
programmes, coaching, and workshops.
As demand grew, so did Mabey’s realisation
that she needed support.
“I didn’t know the first thing about
running a business,” said the former
teacher.
She turned to Business Mentors NZ, a
service supported by ChristchurchNZ,
and was matched with mentor Amanda
Pavanetti. The impact was immediate.
Pavanetti guided Mabey through defining
her audience, building a strategy,
and navigating digital marketing – particularly
New rules prioritise
A man who lost his wife when the CTV
building collapsed in the February 22,
2011, earthquake says the Government's
new rules are prioritising building
owners over potential victims.
Under the new earthquake safety criteria
announced on Monday, 55% of the
buildings that were previously considered
earthquake prone will be marked
as safe.
The Government says the changes will
save building owners more than $8.2 billion
across New Zealand.
Under the new rules a building like the
CTV building – where 115 people died
in 2011 - would not automatically be
deemed earthquake prone.
Professor Maan Alkaisi, whose wife
died in that building, told Checkpoint
the changes appeared to be about taking
care of building owners, rather than the
victims of any earthquakes.
“We know we are in high risk areas
like Christchurch or Wellington, so who
will take care of victims when something
happens?”
He said his main concern was over
who will decide which buildings are low
risk.
“Because from our experience, the CTV
Building was green-stickered, so a lowrisk
building. So what exactly what they
will inspect and so forth, because the
devil is in the details. We would like to
know about the inspection procedures,
who is going to do them, what exactly
they are going to test and things like
that.
“We've been campaigning for over
15 years for accountability, for justice
and to improve building standards and
practices, so we were campaigning for a
system to improve public safety, and cost
should not be the only factor.
“Human safety and lives should be put
first, or at least have a priority in these
decisions.”
Building and Construction Minister
Chris Penk has argued that the new rules
for earthquake safety will save lives in
the long run.
He told Checkpoint that the previous
rules were too costly and led many
buildings to be abandoned, rather than
strengthened.
Penk said that when it came to cases
like the CTV Building, the government
was retaining the “identify at any time”
pathway.
“Which is to say that buildings that are
objectively able to be demonstrated as
unsafe or continue to be captured by the
regime, for example if they are structurally
unsound or engineered in a faulty
manner, as we know sadly was the case
with the CTV building. So we’re retaining
that mechanism while removing the
blunt instrument approach that would
capture a number of buildings that are
currently safe.”
But Alkaisi said he could not see how
the new regulations will lower the risk,
“it will definitely increase the risk to
human lives.”
He said the government needed to talk
to the families of victims and learn what
they have experienced so these factors
could be considered.
Alkaisi said he received an email from
Penk today about the changes, and saying
that the victims families will have an
opportunity to raise any concerns about
these changes, "which I appreciated, and
I will take this opportunity".
“Previous governments, whether
National or Labour, have consulted me, at
least to look into what the victims think
about these changes, so I was hoping we
would be more engaged with this.”
The Christchurch Gasworks,
on the corner of Moorhouse
Ave and Waltham Rd, was
a prominent feature of the
city’s skyline for more than a
century.
Residents might also
remember the smell – a whiff
of rotten eggs that came from
two water gas plants releasing
traces of sulphur, Geoff
Mein wrote in his ‘87 retrospective
for The Press.
Others may remember
the 1933 oil painting by Rita
Angus, who lived nearby.
After 118 years in operation,
the gasworks’ supply
was turned off (below) on
September 30, 1982.
The production of gas from
coal had been a welcome
19th century innovation.
Christchurch streets were lit
by a few kerosene lamps prior
to the gasworks; by 1913,
there were 1235 streetlamps
powered by gas.
It was also used for domestic
heating and cooking. After
1982 – THE GASWORKS
demand for electric lighting
and heating grew, the
gasworks found its niche supplying
gas for commercial
heating.
In 1967, the company
decided to use oil instead of
coal to produce gas. But over
the next decade oil prices
rose and the plant became
increasingly unviable.
On August 10, 1975, the huge
No 6 tank collapsed, releasing
1.3 million cubic feet of
gas into the air. Fortunately
there were no injuries, but
emergency services remained
onsite into the evening in case
a fire broke out. Five years
later, a spectacular fire in
the tar plant, thought to be
caused by a malfunction, was
quickly quelled
When the Government
started to phase out subsidies
to manufactured gas companies,
the end was in sight.
The three million bricks
used onsite were expected to
be sold during demolition.
After a five-year journey,
Shirley Boys’ High School
is celebrating its first-ever
national schools basketball
title.
The Spartans beat their city
rivals Christ’s
College, 94-81,
in the final at
Palmerston
North on
Saturday,
overturning
a 68-59 deficit
late in the third
quarter to roar Fraser Costley
to victory.
Head coach Fraser Costley
has been instrumental in the
team’s success, coaching eight
members of the 10-man squad
since they were in year 9 five
years ago, including his son
Kobe.
“They’ve grown together,
they’ve put in the work, and
it’s a special moment,” he said.
"To have that core group
of dudes for all those years,
I think it just goes beyond
basketball. It's such a good life
lesson in terms of the work
and then what you can get out
of it if you just put your mind
to it.”
Costley said he knew his
team had the quality to be one
of the best in the country after
winning the Canterbury and
South Island competitions this
year.
“You’ve got to go in with an
ultimate goal and then break it
down to little day-by-day goals
to keep the boys focused.
“We put huge focus on our
first game of the tournament,
we've got to start the right
way, we can't put ourselves in
a hole. Then we've got to look
at how the rest of the draw
looks, so the next job is we
want to top our pool, because
if you've got top spot then you
had a game off before quarterfinals,
and that was quite
critical to earn ourselves that
rest, which is critical in a long
tournament.” Shirley won their
group before beating Nelson
College 84-80 in the quarterfinals
and Westlake Boys’ High
School 90-88 in their semi-final.
Costley said the win meant a
lot, as he was a former Shirley
student who also played in the
basketball team.
"There's a lot of history,
and I've had so many former
players from my playing days
and then throughout the last
25 years that have all played
there and are sharing a bit of
it, and they're all reaching out.
The support on that side of
things has been amazing.
"(At the start of the season)
we had this goal of, at the very
least, qualifying for nationals
and finishing with a national
ranking. I don't know if we
ever kind of thought deep
down that we'd win it all, but
as the season wore on, we
started to see that it was a
possibility.
"It’s incredibly special for
these boys.”
Shirley captain Kobe Costley, son of head coach Fraser Costley, on the ball in the
national final.
Improve short-term memory and overall health
Creatine is one of the most widely studied
and effective dietary supplements for
improving athletic performance and has
a growing body of evidence supporting its
benefits for overall health. It is a naturally
occurring compound found in muscle
cells, and it helps the body produce
energy, particularly during short bursts of
intense activity.
Creatine helps your muscles produce
more adenosine triphosphate (ATP),
which is the primary source of energy
for muscle contractions. This allows you
to do more work, especially during highintensity,
short-duration activities like
weightlifting and sprinting, leading to
greater gains in strength, muscle size, and
power. Creatine supplementation with
resistance training can lead to significant
increases in lean body mass and muscle
size.
Research suggests that creatine
supplementation may improve shortterm
memory, attention, and information
processing speed, especially in older
adults, vegetarians, or those under stress
(e.g., lack of sleep). Research also indicates
creatine may support bone density and
heart health in older adults, as well as
help combat sarcopenia (the age-related
loss of muscle and strength).
Creatine is considered very safe. It is
one of the most thoroughly researched
compounds, and no adverse side
effects have been noted through
supplementation in healthy individuals.
Creatine monohydrate is considered
the gold standard among creatine
supplements. It is the most thoroughly
researched type, with strong scientific
evidence supporting its efficacy and
safety. However, studies overseas have
shown that not all creatine on the market
is pure or meets its label claim. We
recommend the NOW brand of creatine
as NOW is one of the only supplement
manufacturers to rigorously test every
batch of ingredients for identity, purity,
potency, heavy metals, pesticides and
other contaminants in their own state-ofthe-art
labs.
The generally recommended daily
intake of creatine monohydrate is 3 to
5 grams. It is best taken with food and
works best when taken consistently.
Short-Term Memory & Overall Health
Creatine monohydrate is best known for its benefits in increasing physical performance, but a growing
body of research is exploring its effects on the brain, particularly in relation to memory and other
cognitive functions. The connection lies in the brain’s high energy demand. The brain, despite making up
only a small percentage of body weight, is incredibly energy-intensive. It consumes around 20% of the
body’s total energy. This energy is primarily supplied by adenosine triphosphate (ATP), the same molecule
that fuels muscle contractions. Creatine supplementation cannot only help maintain a stable supply
of ATP in muscles but also in the brain. Several studies have shown positive results with memory and
enhanced mental performance.
- Improved memory, particularly in older adults,
vegetarians and those under stress
- Enhanced mental performance, including
reasoning and intelligence
- Reduced mental fatigue
- Recovery from Traumatic Brain Injury (TBI)
- Increased exercise capacity
- Increased strength and power
- Increased muscle mass, when combined with
resistance training
- Healthy aging - helps combat sarcopenia (agerelated
loss of muscle mass and strength)
Claims against estates under
the Family Protection Act
Family relationships are becoming
more complex. After a person has
passed away certain family members
are entitled to challenge the provisions
of a will under the Family Protection
Act 1955 (the FPA) if adequate provision
has not been made for them.
The FPA sets out who is eligible to
challenge a will. This includes a spouse,
de-facto partner, child or grandchild.
A de-facto partner of less than three
years, a stepchild or a parent of the
deceased can also make a claim in
exceptional circumstances.
The FPA provides that if adequate
provision is not made from the
deceased’s estate for the proper
maintenance and support of the
claimant the Court may order provision
out of a deceased’s estate for the
claimant. The Court will consider
whether there has been a breach of a
moral duty by the deceased to provide
for the claimant. Factors such as the
size of the estate, the health and income
of the claimant and the relationship
between the claimant and the deceased
during the deceased’s lifetime are
relevant.
Adequate provision for “proper
maintenance and support” does not
equate with fairness. A deceased does
not have to leave their estate equally to
their children or all of their estate to a
spouse or partner. When considering
competing moral claims matters
such as the financial position of each
potential claimant is highly relevant.
Claims must be brought within 12
months of the date of the grant of
probate or letters of administration
with very few exceptions. From the
claimant’s point of view it is preferable
to make a claim within 6 months to
avoid an early distribution of assets.
Many claims are settled by way
of informal negotiations between
parties without the necessity for Court
proceedings. In some cases claims
do proceed to Court but most are
resolved in mediation or a judicial
settlement conference without the need
for a full hearing. Claims are usually
determined by the Courts based on
affidavit evidence but in some cases
oral evidence is required. This can be
stressful for all the parties involved and
should be a last resort.
It is always important that advice is
taken as soon as practicable should a
person wish to challenge or contest a
will in order to avoid unnecessary costs
and disappointment. For those making
wills it is important to take legal advice
and to make wills in a way which will
avoid family disputes later on.
If you are seeking advice on the
Family Protection Act or the making
of a will please do feel free to contact
us at Harmans Lawyers to discuss.
Burnside lose key duo
ahead of Metro season
BY SAM COUGHLAN
Three-time Metro premiership two-day
winners Burnside West University are
victims of their own success this season
after losing two key players to domestic
contracts.
Opening batter Scott Janett and allrounder
Oscar Jackson played crucial
roles in the side’s two-day and T20 titles,
while they also finished runner-up in the
one-dayers.
But Janett’s involvement this season will
be heavily limited after he earned a Canterbury
contract while Jackson has left the
club entirely after signing a first professional
deal with Wellington.
Head coach Carl Huyser said Old Boys
Collegians all-rounder Matt Lewis had
joined as an almost-direct replacement for
Jackson.
“A couple of his good childhood friends
(Burnside players) Tim Seeto and Nick
Gibb, they were three Christ’s College boys
that did really well when they won the Gillette
Cup.
“I think there were a few conversations,
and then Matty started talking to me, so he
joined. He’s fitted in beautifully so far.”
South African-American twins Matthew
and Joshua Tromp have also made
the journey to Christchurch but will be
on rival teams, having joined Sydenham
and Old Boys respectively.
English wicketkeeper Ollie Pascall and
Irish batter John Glass have also signedon
for Old Boys
Riccarton have lost Shreyas Debur,
who has retired to become an umpire,
while Oliver Linton joins Pleasant Point
and Ethan O’Donoghue takes over the
captaincy from Jared Cookson.
Former Heathcote quick, Englishman
Batter Scott Janett is set to play a heavily reduced
role for Burnside West University this season after
earning his first Canterbury contract.
Finlay Testa, has also joined Riccarton
alongside Wellington batter Ben
Piesocki.
Heathcote have secured the services of
former Otago bowler Travis Muller and
Canterbury spinner Michael Rippon.
East Shirley have been boosted by the
return of all-rounder Brad Entwistle
from Australia while batter Ken McClure
is set to play a big role after missing out
on a Canterbury contract.
Core Cashmere crew
back for title defence
BY DIANE KEENAN
Cashmere will be back on court Saturday
with the same core group defending their
premier tennis interclub championship
title – an honour they have claimed in 18
of the past 25 seasons.
Team stalwart Johnny McHarg said he
was excited for another title run with
his regular teammates, the Meredith
brothers Matt, James and Tim, along
with Harry Weeds, who joined Cashmere
after moving to Christchurch nine years
ago. Ashburton’s Tyler Leonard will also
return after debuting for the side last year.
McHarg said it was a privilege to be part
of the Cashmere crew, which has made
the final in 24 of the last 25 years.
“It really is like playing with family. We
get on so well on and off the court.”
Cashmere has home-court advantage in
Saturday’s first round, hosting Burnside
Park/Sumner.
The visitors, coached by Remi Feneon,
boast some of the region’s most exciting
young players including Jack Hansen-
Ratter, Finn Emslie-Robson, Liam Adams,
Maddison Aubrey, Sakeri Pannell and
Jordan Edwards.
Mid-Canterbury returns to the premier
competition this year, after coach Jack
Tiller and his protégés Josh Gilbert and
Ryan Watt bolstered Elmwood in recent
seasons. They will host Te Kura Hagley at
Ashburton.
Te Kura Hagley’s Ben Smith, who played
much of his junior tennis in the country,
lines up alongside club coach Hugo
Cashmere’s Johnny McHarg, Harry Weeds, Tim
Meredith and James Meredith will be joined by
Matt Meredith and Tyler Leonard to defend their
interclub title.
Nurse-Strang, Ray Xu, Brandon Ng and
Franklin Barry.
The third tie also pits youth against
experience, with seasoned Elmwood
campaigners Elliot and Lawrence Darling,
Tom Batt, Jamie Poole, James Spence and
Benji McGillvray taking on Edgeware at
Edgeware.
Elmwood will also call on New Zealand
representative James Watt when available.
Edgeware coach Nick Jenkins has added
experienced Otago representative Paddy
Ou, supported by Connor Edmonds,
Matthew Campbell, Declan Barry and
Sean Howson.
Bishopdale has the bye this week.

Light Bears back on top with U85kg title
High School Old Boys have sealed
a second national U85kg rugby title
in three years after pipping Pōneke
Wanderers 24-19 in the final at
Eden Park on Saturday. The Light
Bears trailed 13-8 at half-time and
were still behind 19-18 with just
over 10 minutes to play, but two
late penalty goals from captain and
first-five Jarred Percival sealed
the win. Centre Ryan McNulty and
halfback Taine Cordell-Hull had
earlier crossed for a try apiece to
keep HSOB in the game. With time
up on the clock and the Light Bears
defending in their own 22, the team
pushed over the top of a ruck to win
a penalty, which Percival booted
into touch to spark wild celebrations
from the team and travelling fans.
It was the team’s third consecutive
final, after winning the competition in 2023 and losing at the final hurdle to Pakuranga Black
Panthers last year.
Bulls one win away from national final
All the Canterbury Bulls men’s team need is to beat Wellington Orcas this weekend to lock up
a spot in the final of the national premiership. The Bulls’ 30-20 win over Otago on Saturday
saw them remain at the top of the southern pool with one game to play, with the pool winner
advancing to next week’s grand final against the winners of the northern pool, currently
topped by Counties Manukau Stingrays with one round to play. A Bulls loss could see them
overtaken by either Wellington or Otago. Canterbury’s women’s team’s finals hopes were
dashed by a 44-14 loss to Counties Manukau, and they will meet Wellington in their final
game on Saturday looking for a win to secure third place.
Christchurch United’s new faces have inspired them to victory to start their National League
campaign in Auckland. Midfielder Noah Karunaratne, on debut, scored both goals in their
2-0 win over Auckland United on Saturday, while Bray Whitecliffe came off the bench with
12 minutes left to help defend the lead. Elsewhere Coastal Spirit slipped to a 2-1 loss to
Birkenhead United despite leading at halftime through a Liam Cotter goal. In the women’s
competition, Canterbury United Pride lost 8-0 to defending champions Auckland United.
Western Suburbs on Sunday. The Pride hosts Western Springs.
Make sure you have your say
in the 2025 local body election
This month’s local election is well
underway, with voting papers now
landing in the mailboxes of enrolled
voters.
Local elections are held by postal post,
with voters choosing their choice of:
• Mayor
• Ward councillor
• Community board members
A new initiative this election is the
publication of videos featuring the
candidates on the Christchurch City
Council website.
Of the 97 candidates standing, 92 took
up the offer to film a short video about
themselves.
Every candidate was asked:
• Tell us about yourself – your name
and where you are standing?
• What will you bring to the role?
• What would you like to achieve in
your term?
• What is the biggest challenge facing
the city or your community?
Election Officer Warwick Lampp
said personal videos were offered to
Christchurch candidates for the first
time this election.
“The intention of the videos is to
give voters as much information about
the candidates as possible, and we are
pleased so many candidates took up the
opportunity,” Lampp said.
“We know that lack of information
about candidates can be a reason why
people do not engage in the election
process.
“We encourage voters to watch the
videos and read their candidate profile
statements.”
VOTING
Voting for the election closes at noon,
Saturday, October 11.
Voters can post their completed voting
papers into any NZ Post or DX Mail
post box by October 7 or drop it into an
orange vote bin at council facilities and
locations in your community.
Electors who don’t receive their voting
documents can still vote by requesting
special voting documents between now
and election day from council customer
service hubs, email elections@ccc.govt.nz or
by phoning 03 941 8999.
