Questions around access aren’t always
straightforward. For instance, you may have
used a path for years, but that doesn’t
automatically mean you have a legal right
to it - although in some circumstances, a right
may be established.
Disputes can arise in many ways. A
neighbour might block what you believe
is your only route to a garage or garden or
there may be disagreements over shared
driveways or footpaths. In other cases, a
landowner could obstruct a public right of
way or there may be uncertainty around
access needed for maintenance or utilities.

BOUNDARY DISPUTES
Boundary disputes may not always involve
large sums of money, but they can be
surprisingly difficult and stressful to resolve.
It’s common for both parties to feel strongly
that they are in the right, which can make
compromise challenging. These situations
can be upsetting and disruptive but our
skilled team is here to guide you through

One of the reasons these disputes arise, is
that Land Registry title plans are a guide
to where a boundary is, rather than a
precise measurement. The exact position
of a boundary is often determined by a
combination of title deeds, historical
conveyances and physical features on
the ground - something that can come as
a surprise. Resolving a boundary dispute
will often involve both a lawyer and a
specialist surveyor. We work closely
with surveyors on your behalf and can
also recommend a trusted professional
if required.
Before getting in touch, it can be helpful
to gather any relevant documents, such as
your title deeds, old photographs showing
the boundary and details of any previous
agreements with your neighbour.

Dilapidation
Repairs or maintenance that a tenant is
required to carry out under the terms of a
lease, usually at the end of the lease term.
Easement
A legal right to use someone else’s land for

drainage.
