between <strong>the</strong> City of Malibu and<br />
<strong>the</strong> state agency that gives <strong>the</strong><br />
municipality authority to issue<br />
wastewater discharge permits.<br />
The board could have terminated<br />
<strong>the</strong> agreement on Thursday,<br />
but didn’t. Instead <strong>the</strong> panel<br />
agreed to leave <strong>the</strong> current MOU<br />
in place for one year, while <strong>the</strong><br />
two sides renegotiate its terms.<br />
Revisions could include <strong>the</strong><br />
state agency taking over all commercial<br />
discharge permits, which<br />

Little Wind Helps Make Short Work of Five-Acre County Line Blaze<br />

County firefighting resources<br />
were marshaled to <strong>the</strong> max in<br />
case a small brush fire in <strong>the</strong><br />
90265 zip code area of Ventura<br />
County tried to spread east into<br />
western Malibu.<br />
What was tentatively dubbed<br />
<strong>the</strong> Yellow Fire was reported at<br />
11:43 a.m. Friday in <strong>the</strong> 12800<br />
block of Yellow Hill Road, according<br />
to <strong>the</strong> Ventura County<br />
Fire Department incident log.<br />
Despite a relative lack of wind,<br />
by 12:14, <strong>the</strong> fire was over three<br />
acres in size. It burned about five<br />
acres before being brought under<br />
control by 3 p.m.<br />
Flames took hold near a large<br />
house under construction on<br />
Yellow Hill Road. Initial reports<br />
were that <strong>the</strong> fire started when<br />
sparks from an electric saw ignited<br />
brush behind <strong>the</strong> structure.<br />
Helicopters provided air support<br />
for ground crews. An Erickson<br />
Air-Crane was brought in,<br />
but not used. SuperScoopers<br />
were also available, if <strong>the</strong> fire<br />
<strong>the</strong> staff has recommended, and<br />
seeking a legally binding commitment<br />
from <strong>the</strong> city to build a<br />
centralized wastewater treatment<br />
plant for <strong>the</strong> Civic Center.<br />
Ano<strong>the</strong>r staff recommendation<br />
adopted by <strong>the</strong> board is to direct<br />
its staff to study <strong>the</strong> possibility of<br />
a septic tank ban in <strong>the</strong> city.<br />
However, executive officer<br />
Tracy Escogue made <strong>the</strong> staff’s<br />
intentions clear on <strong>the</strong> purpose of<br />
calling for a prohibition. “The<br />
prohibition is <strong>the</strong> stick,” she said,<br />
to prod city officials to accept <strong>the</strong><br />
terms of <strong>the</strong> RWQCB staff renegotiating<br />
a new MOU.<br />

would have to build a treatment<br />
plant, and a moratorium would<br />
be in place during <strong>the</strong> interim.<br />
The board questioned <strong>the</strong> staff<br />
about <strong>the</strong> boundaries of any sort<br />
of prohibition. The discussion<br />
centered on whe<strong>the</strong>r <strong>the</strong> Civic<br />
Center area would be <strong>the</strong> focus of<br />
any such action, as opposed to<br />
<strong>the</strong> entire municipality.<br />
RWQCB officials also talked<br />
about how <strong>the</strong>y took septic prohibition<br />
action in Ventura County.<br />
The board also heard from<br />
RWQCB staffers that <strong>the</strong> matter<br />
was before <strong>the</strong> board because of a<br />
dispute with <strong>the</strong> city over permitting<br />
for <strong>the</strong> Malibu Lumber Yard<br />
shopping center.<br />
Some board members appeared<br />
displeased <strong>the</strong> matter had to be<br />
addressed at <strong>the</strong> board level.<br />
They told staff <strong>the</strong>y wanted elements<br />
inserted into a new memo<br />
of understanding that would<br />
avoid a similar dispute rising to<br />
<strong>the</strong> level of board resolution.<br />
RWQCB staffers told board<br />
members that <strong>the</strong> city had decided<br />
to issue <strong>the</strong> discharge permit<br />
despite calls from RWQCB staff<br />
that such action should be overseen<br />
by <strong>the</strong> state agency. In <strong>the</strong><br />
RWCQB staff report, <strong>the</strong> state<br />
agency indicated it would consider<br />
<strong>the</strong> city as an illegal discharger<br />
if it continued to proceed with<br />
issuing a permit for its shopping<br />
center. The city has apparently<br />
relented and <strong>the</strong> matter has been<br />

Buying West End Land<br />
The Malibu City Council, on a<br />
4-1 vote with Councilmember<br />
Andy Stern dissenting,<br />
didn’t rule out acquiring a 9.8acre<br />
site currently for sale near<br />
<strong>the</strong> intersection of Pacific Coast<br />
Highway and Hea<strong>the</strong>rcliff Road.<br />
but didn’t indicate it wants to take<br />
action on a possible purchase.<br />
A majority of <strong>the</strong> council<br />
turned down a motion by Mayor<br />
Pamela Conley Ulich’s to move<br />
ahead with purchase of <strong>the</strong> Point<br />
Dume parcel on <strong>the</strong> market for<br />
$4.2 million.<br />
Stern said he is adamantly opposed<br />
to studying, or talking about<br />
acquiring <strong>the</strong> vacant acreage, let<br />
alone considering its purchase. “It<br />
is <strong>the</strong> wrong place. It is zoned residential.<br />
Uses would light up <strong>the</strong><br />
night sky. It would wreck it for<br />
Bonsall [Drive]. It would be a misplaced<br />
use of funds,” he said.<br />
Councilmember Sharon Barov-<br />
Authorities indicate <strong>the</strong>y have<br />
charged a former Westlake High<br />
School student with <strong>the</strong> seconddegree<br />
murder of Kaylin Marie<br />
Ma<strong>the</strong>ws, 20, whose body was<br />
found last July in Lobo Canyon.<br />
Weston Thomas McCahon, 19,<br />
who was living in South Lake<br />
Tahoe when he was arrested on<br />
Oct. 23, pled not guilty to <strong>the</strong><br />
murder charge at his Nov. 6<br />
arraignment, according to <strong>the</strong> Los<br />
Angeles County District Attorney’s<br />
office.<br />
McCahon is accused of giving<br />
drugs to Ma<strong>the</strong>ws and, when she<br />
overdosed, he allegedly dumped<br />
sky said she was unwilling to<br />
commit funds for <strong>the</strong> purchase<br />
unless <strong>the</strong> council could come up<br />
with a specific use for <strong>the</strong> land.<br />
“I hear open space, I hear about<br />
library, I hear people say <strong>the</strong>y<br />
don’t want anything built <strong>the</strong>re,”<br />
she said. “I can’t support it in<br />
<strong>the</strong>se economic times, especially<br />
if we don’t do anything about it.”<br />
The mayor and Councilmember<br />
Jefferson Wagner urged <strong>the</strong><br />
majority to think in terms of <strong>the</strong><br />
future, with <strong>the</strong> most important<br />
thing being acquiring <strong>the</strong> land at a<br />
fair market, affordable price, and<br />
deciding what to do later.<br />

After exactly one year, <strong>the</strong><br />
consequences of <strong>the</strong> Corral<br />
Fire that destroyed 53<br />
homes and burned 4650 acres of<br />
land are surfacing in a tangible<br />
manner. On Dec. 5, a preliminary<br />
hearing for Brian Anderson and<br />
William Coppock, two of <strong>the</strong> five<br />
men charged with causing <strong>the</strong><br />
tragic fire, is slated to take place<br />
at Van Nuys Superior Court.<br />
Defendant Brian Franks, originally<br />
included in <strong>the</strong> Anderson-<br />
Coppock action but who is now<br />
assisting <strong>the</strong> prosecution, will<br />
have a probation and sentencing<br />
hearing on Dec. 11, and defendants<br />
Eric Ullman and Dean Lavorante,<br />
being tried on <strong>the</strong> same<br />
charges separately, will face arraignment<br />
on that date as well.<br />
In an effort to assure that what<br />
<strong>the</strong>y consider to be justice will be<br />
served, a group of Corral Canyon<br />
residents who have been active in<br />
“Operation Recovery” are undertaking<br />
a letter-writing campaign<br />
to Judge Leslie Dunn that encourages<br />
that all five men be prosecuted<br />
to <strong>the</strong> full extent of <strong>the</strong> law.<br />

PBS & J, <strong>the</strong> company overseeing<br />
<strong>the</strong> Environmental Impact Report<br />
process at Malibu High School, to<br />
conduct an archeological survey<br />
of <strong>the</strong> project site for <strong>the</strong> City of<br />
Malibu Local Coastal Plan. The<br />
archeological survey is expected<br />
to cost $9166 and brings <strong>the</strong> total<br />
contract amount for PBS&J to<br />
$513,850.<br />
The initial EIR states that <strong>the</strong><br />
impact on archeological resources<br />
and <strong>the</strong> risk of “directly or indirectly<br />
destroying a unique paleontological<br />
resource” are estimated<br />
to be “less than significant with<br />
mitigation incorporation.” However,<br />
<strong>the</strong> risk of “substantial adverse<br />
change in <strong>the</strong> significance<br />
of a historical resource is listed as<br />
“potentially significant.”<br />

July of <strong>2008</strong> for <strong>the</strong> Santa Monica–Malibu<br />
Unified School District<br />
previously identified <strong>the</strong><br />
front facade of <strong>the</strong> high school,<br />
which is scheduled for demolition<br />
and reconstruction, as “potentially<br />
eligible for inclusion in <strong>the</strong><br />
California Register of Historic<br />
Places pursuant to <strong>the</strong> Register’s<br />
Criteria, (i.e., associated with<br />
events that have made a significant<br />
contribution to <strong>the</strong> broad<br />
patterns of local or regional history,<br />
or <strong>the</strong> cultural heritage of California<br />
or <strong>the</strong> United States) based<br />
on its association with both <strong>the</strong><br />
history of <strong>the</strong> school district and<br />
<strong>the</strong> history and development of<br />
<strong>the</strong> City of Malibu.<br />
The survey identified <strong>the</strong> front<br />
façade as “<strong>the</strong> primary characterdefining<br />
architectural feature that<br />
‘conveys <strong>the</strong> historical associations<br />
and significance of this individually<br />
eligible resource.’”<br />
The preliminary EIR states that<br />
“Currently <strong>the</strong> City of Malibu has<br />
not included <strong>the</strong> MHS site on its<br />
map of culturally sensitive places<br />
or on any list of locally historic<br />
properties.<br />
The board was also asked to<br />
approve an additional $25,144 to<br />
<strong>the</strong> firm of HMC Architects, to<br />
provide “architectural services for<br />
participation and support of <strong>the</strong><br />
Environmental Impact Review<br />
(EIR) work and associated public<br />
meetings, in conjunction with <strong>the</strong><br />
Measure “BB” construction program,<br />
in an amount not to exceed<br />
$25,144, for a total contract<br />

We are having trouble with <strong>the</strong> rebuilding process in <strong>the</strong><br />
aftermath of last year’s fire. We are going down <strong>the</strong> same<br />
roads traveled 30 years ago with less spunk and less junk.<br />
Although <strong>the</strong>re were many promises by government officials<br />
and agencies to “help” fire victims, not much assistance<br />
has been offered. Instead, <strong>the</strong> building and planning<br />
department is still demanding that we jump through all <strong>the</strong><br />
hoops we have already jumped through before, and many of<br />
<strong>the</strong>se hoops are higher and more expensive. And some are<br />
completely out of reach, and I might add are unnecessary.<br />
The average homebuilder doesn’t have a chance. Are<br />
o<strong>the</strong>rs experiencing <strong>the</strong> same miserable “service” as we?<br />

SIGNAL SIGNS<br />

While I can appreciate and respect Steve Woods’ opposing<br />
response to my support of <strong>the</strong> traffic signal being<br />
installed at Corral, I feel compelled to comment that after<br />
reading his arguments against <strong>the</strong> light, it only justifies<br />
installing <strong>the</strong> signal even more.<br />
His concern that <strong>the</strong>re will be an increase in noise from<br />
screeching tires, metal crashing and a longer commuter<br />
drive seems to indicate to me that that would be a result of<br />
drivers going over <strong>the</strong> posted speed limit, thus endangering<br />
o<strong>the</strong>rs in my neck of <strong>the</strong> woods, no pun intended.<br />
I have never noticed any of that at <strong>the</strong> signals of Zumirez,<br />
Hea<strong>the</strong>rcliff or Busch. The only exception is at Kanan<br />
where impatient drivers without <strong>the</strong> benefit of a no-turn-onred-arrow<br />
turn onto PCH from Kanan and cause accidents.<br />
For those who prefer to drive faster than <strong>the</strong> posted 50<br />
mph without <strong>the</strong> hinderence of traffic signals, I’d suggest<br />
<strong>the</strong>y take <strong>the</strong> 101. PCH is a highway, not a freeway.<br />

RECOVERY PROCESS<br />
Editor:<br />
It’s <strong>the</strong> one year anniversary of <strong>the</strong> Corral Fire. As we<br />
reflect on this terrible tragedy that affected our <strong>community</strong>,<br />
may we also reflect on <strong>the</strong> positives that this experience<br />
has brought to us? Although <strong>the</strong> year has been tough during<br />
<strong>the</strong> rebuilding process both of lives and homes, after<br />
one year and many man hours of time, we do see new<br />
growth in <strong>the</strong> neighborhoods affected by <strong>the</strong> October/November<br />
2007 firestorms.<br />
We see new houses, new lives, new opportunities, new<br />
tolerances, new knowledge and new relationships, new<br />
expectations and new goals. Many of us have bonded and<br />
become not just neighbors, but friends. We have met people<br />
that we hadn’t known albeit some of those lived right next<br />
door. We have developed new ways of doing things, perhaps,<br />
we have a family plan for handling emergencies, and<br />
some communities have fire safe councils, which are outcomes<br />
of this tragedy.<br />
Many are still dealing with <strong>the</strong> tragedy and <strong>the</strong>re is still<br />
grief, anger and fear. But, as we connected in <strong>the</strong> Operation<br />
Recovery 2007 group meetings, those connections and<br />
relationships have streng<strong>the</strong>ned most of us. It’s pretty<br />
amazing what’s happening in <strong>the</strong> wake of such losses.<br />
Take a moment and look how we have changed from this<br />
tragedy. Some of us have developed better problem-solving<br />
skills, patience has developed, and resiliency is a quality<br />
that will serve all of us over time. But even being resilient<br />
doesn’t make someone immune from <strong>the</strong> emotional highs<br />
and lows that have accompanied this tragedy. I believe a<br />
spirit has developed in each of us as we are all now survivors<br />
of <strong>the</strong> 2007 Malibu fires.<br />
How each of us has learned to adapt to tragedy is a<br />
valuable life lesson. During tragic times, we often have<br />
opportunities to discover things about ourselves that our<br />
strengths, abilities that we didn’t know we had within us.<br />

No one wishes more adversity to those who live in<br />
<strong>the</strong> recent wildfire areas where denuded hillsides are<br />
vulnerable to fur<strong>the</strong>r damage by heavy downpours,<br />
but <strong>the</strong> current rainfall is a cause for holiday thanks.<br />
Although it would take numerous, strong storms in<br />
rapid succession to make a dent in <strong>the</strong> state’s current<br />
drought conditions and reduce <strong>the</strong> areawide wildfire<br />
danger, that meteorological scenario might extract too<br />
high a price from areas that burned this year and last.<br />
As we sit down to express Thanksgiving gratitude<br />
with family and friends, <strong>the</strong> rain is a reminder that,<br />
despite our exponentially expanding technological<br />
capability and our myth of human dominance of <strong>the</strong><br />
universe, nature is <strong>the</strong> arbiter of all life. Members of<br />
our species appear reluctant to accept, despite one unsuccessful<br />
clash with <strong>the</strong> forces of nature after ano<strong>the</strong>r,<br />
that <strong>the</strong>y are not <strong>the</strong> ones who are in charge.<br />
The potential for ano<strong>the</strong>r year of drought is not just<br />
<strong>the</strong> concern of <strong>the</strong> farmer and <strong>the</strong> rancher. It affects<br />
everyone, as no part of California is immune to wildfire.<br />
Until <strong>the</strong> fire danger that is now a constant presence<br />
is reduced, thousands of lives will be upended<br />
with a frequency predicated on uncertainty. Humans<br />
have a responsibility to plan and prepare for <strong>the</strong> whatever<br />
happens, but nature always has <strong>the</strong> last word.<br />
Yet water is not just a natural phenomenon, it’s also<br />
a political one, as last week’s Regional Water Quality<br />
Control Board demonstrated. It’s a toss-up whe<strong>the</strong>r<br />
this approach is Machiavellian or Swiftian, but it is<br />
tempting to ask whe<strong>the</strong>r <strong>the</strong> City of Malibu isn’t making<br />
a major policy blunder by not letting <strong>the</strong> RWQCB<br />
take over <strong>the</strong> Civic Center wastewater issue.<br />

This strategy might temporarily slow some development,<br />
but a state-of-<strong>the</strong>-art system could support<br />
added density, as well as control its location. This<br />
might result in a superior wastewater solution to anything<br />
a city could afford, or should have to, as <strong>the</strong><br />
pollution is a regional problem that calls for a regional<br />
solution. Everyone could <strong>the</strong>n focus on whe<strong>the</strong>r<br />
<strong>the</strong> proposal accomplishes what we all want—<strong>the</strong><br />
cleanup of Malibu Lagoon and adjacent beaches.<br />

<strong>the</strong> impacts in regard to <strong>the</strong><br />
environment, lights, noise,<br />
septic, traffic and water and<br />
forwarded <strong>the</strong> spreadsheet<br />
to <strong>the</strong> council. The committee<br />
insisted <strong>the</strong> order of<br />
uses on <strong>the</strong> list did not reflect<br />
a committee recommendation.<br />
Some council members<br />
expressed impatience with<br />
<strong>the</strong> blue ribbon committee’s<br />
work. “I am<br />
disappointed it did not<br />
come back with information<br />
from <strong>the</strong> committee.<br />
I talked to committee<br />
members. I am glad<br />
<strong>the</strong> city manager talked to<br />
committee members,”<br />
added Barovsky. “Six of<br />
<strong>the</strong> 12 recommended not<br />
buying it. The o<strong>the</strong>rs<br />
wanted it as open space.”<br />
Sibert had <strong>the</strong> same criticism<br />
of <strong>the</strong> committee and<br />
said he thought months ago<br />
he would have been more<br />
amenable, but <strong>the</strong> current<br />
economic woes have<br />
changed his viewpoint<br />
tremendously. Sibert said<br />
he was interested in going<br />
forward with negotiations,<br />
but not for a purchase.<br />

to pay off building a new<br />
city hall.<br />
The staff report also<br />
indicated <strong>the</strong>re was additional<br />
funding that could<br />
be used for a library from<br />
money owed to <strong>the</strong> city<br />
from <strong>the</strong> county library<br />
system.<br />
The o<strong>the</strong>r options, such<br />
as a teen center, emergency<br />
operations center, or a<br />
sheriff’s sub-station are<br />
packaged with no money,<br />
no set-aside funds, or no<br />
form of monthly revenue<br />
stream, making those options<br />
seem much less<br />
feasible.<br />

School Campus Improvements Project (“Project”),<br />
which will be located on <strong>the</strong> existing Malibu Middle and<br />
High School campus at 30215 Morning View Drive in<br />
<strong>the</strong> City of Malibu. The middle and high school programs<br />
share core facilities. The Project consists of <strong>the</strong><br />

Environmental Review of <strong>the</strong> Project<br />
Notice of Preparation/Initial Study. As required by<br />
law, <strong>the</strong> District, as <strong>the</strong> lead agency, is responsible for<br />
<strong>the</strong> preparation and certification of an EIR for <strong>the</strong> Project.<br />
The EIR will disclose <strong>the</strong> District’s analysis of <strong>the</strong><br />
potential impacts to <strong>the</strong> environment as a result of <strong>the</strong><br />
Project. The first step in <strong>the</strong> EIR process was taken by<br />
filing of <strong>the</strong> Notice of Preparation/Initial Study<br />
(“NOP/IS”) on September 11, <strong>2008</strong> and holding a public<br />
scoping meeting on September 24, <strong>2008</strong>. An<br />
extended comment period on <strong>the</strong> NOP/IS was provided,<br />
which ended on October <strong>27</strong>, <strong>2008</strong>.<br />
Draft EIR. The next step in <strong>the</strong> EIR process is <strong>the</strong><br />
preparation and release of <strong>the</strong> Draft EIR for public comment.<br />
Areas studied will include air quality, aes<strong>the</strong>tics,<br />
biological resources, cultural resources, geology and<br />
soils, hazards, hazardous materials, hydrology, land<br />
use, light and glare, noise, parking, recreation, traffic,<br />
utilities, and water quality. The District is consulting<br />
with public agencies such as <strong>the</strong> City of Malibu and <strong>the</strong><br />
Los Angeles Regional Water Quality Control Board to<br />
ensure a comprehensive impact analysis. Moreover,<br />
<strong>the</strong> District is meeting with Malibu Middle and High<br />
School parents and o<strong>the</strong>r representative <strong>community</strong><br />
groups and members. Additional consultation with <strong>the</strong><br />
Malibu <strong>community</strong>, including residents in <strong>the</strong> vicinity of<br />
<strong>the</strong> campus, is being planned. Outreach meetings will<br />
be held on specific topics, as well as <strong>the</strong> overall Project.<br />
The attached list provides <strong>the</strong> current anticipated<br />
schedule of meeting topics, times, and locations.<br />
The District’s process is intended to provide <strong>the</strong> <strong>community</strong><br />
with opportunities to examine <strong>the</strong> Project in<br />
depth and to collaborate on mitigating any significant<br />
environmental impacts that might o<strong>the</strong>rwise occur.<br />
Once <strong>the</strong> District has conducted its consultation with<br />
<strong>the</strong> public agencies and <strong>the</strong> <strong>community</strong>, it will prepare<br />
and release <strong>the</strong> Draft EIR for additional public comment.<br />
During this comment period, <strong>the</strong> District will hold<br />

Final EIR. Once <strong>the</strong> comment period on <strong>the</strong> Draft EIR<br />
ends, <strong>the</strong> District will analyze <strong>the</strong> comments received<br />
and prepare responses to <strong>the</strong>m to include in <strong>the</strong> Final<br />
EIR. A public hearing will held on <strong>the</strong> Final EIR before<br />
<strong>the</strong> District’s Board of Education considers certification<br />
of <strong>the</strong> Final EIR and Project approval at a regularly<br />
scheduled Board of Education Meeting in <strong>the</strong> spring of<br />
2009. A notice of when this hearing/meeting is set will<br />
be made.<br />
Coastal Development Permit<br />
The Project site is located in <strong>the</strong> City of Malibu within<br />
<strong>the</strong> California Coastal Zone. Under <strong>the</strong> requirements of<br />
<strong>the</strong> California Coastal Act of 1976, <strong>the</strong> District will need<br />
to obtain a coastal development permit for <strong>the</strong> Project.<br />
The District is preparing its application for <strong>the</strong> permit<br />
and is working closely with <strong>the</strong> City of Malibu’s staff to<br />
ensure that <strong>the</strong> Project’s EIR conforms to <strong>the</strong> requirements<br />
of <strong>the</strong> Local Coastal Plan. The District’s intent is<br />
to integrate <strong>the</strong> public participation and review of <strong>the</strong><br />
EIR and coastal development permit processes as<br />
much as possible.<br />
Anticipated Construction Schedule<br />
The current construction plan is structured in two major<br />
parts:<br />
Installation of temporary classrooms, library, administrative<br />
offices, and on-site parking. If <strong>the</strong> EIR and coastal<br />
development permit approvals are obtained, construction<br />
is expected to begin in 2009 and last one year.<br />
Replacement of existing library, classrooms, and<br />
administrative offices with new structures, technology,<br />
site improvements and infrastructure. Install <strong>the</strong> athletic<br />
field improvements and remaining improvements.<br />
Construction is expected to begin in late 2010 and last<br />
up to three years.<br />

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF<br />
MALIBU ADOPTING REVISED LOCAL COASTAL PROGRAM<br />
AMENDMENT NO. 05-002, AMENDING THE SINGLE-FAMILY<br />
MEDIUM ZONING DISTRICT TO INCLUDE A 45 FOOT MINI-<br />
MUM LOT STANDARD FOR BEACHFRONT LOTS AND<br />
INCORPORATING THE COASTAL COMMISSION SUGGEST-<br />
ED MODIFICATIONS FOR A MALIBU BAY COMPANY OVER-<br />
LAY DISTRICT (30732 PACIFIC COAST HIGHWAY)<br />
THE CITY COUNCIL OF THE CITY OF MALIBU DOES ORDAIN<br />
AS FOLLOWS:<br />
Section 1. Recitals.<br />
A. On July 29, 2005, <strong>the</strong> Malibu Bay Company applied for a Coastal<br />
Development Permit (CDP No. 05-1<strong>36</strong>) with a Local Coastal Program<br />
Amendment request (LCPA No. 05-002) to subdivide into four lots a<br />
2.08 acre parcel located at 30732 Pacific Coast Highway.<br />
B. On January 22, 2007, <strong>the</strong> City Council held a duly noticed public<br />
hearing at which time it adopted Resolution No. 06-14, approving an<br />
amendment of <strong>the</strong> Malibu Local Coastal Program (LCP) Local Implementation<br />
Plan (LIP) and directing staff to submit Local Coastal Program<br />
Amendment (LCPA) No. 05-002 to <strong>the</strong> California Coastal Commission<br />
(CCC) for certification and introduced Ordinance No. 304<br />
approving an amendment to <strong>the</strong> LIP, which was subsequently adopted<br />
on February 12, 2007.<br />
C. On March 6, 2007, <strong>the</strong> LCPA was submitted to <strong>the</strong> CCC. On<br />
March 20, 2007, <strong>the</strong> submittal, identified by <strong>the</strong> CCC as LCPA 1-07,<br />
was reviewed by Commission staff and determined to be complete.<br />
D. At <strong>the</strong> June 14, 2007 CCC hearing, <strong>the</strong> Commission extended <strong>the</strong><br />
deadline to act on LCPA 1-07 for a period of one year.<br />
E. On June 11, <strong>2008</strong>, <strong>the</strong> CCC conditionally certified LCPA No. 05-<br />
002 subject to certain terms and modifications as set forth in <strong>the</strong> Resolution<br />
of Certification adopted by <strong>the</strong> CCC on June 11, <strong>2008</strong>.<br />
F. On August 19, <strong>2008</strong>, <strong>the</strong> City received said Resolution of Certification.<br />
G. On October 2, <strong>2008</strong>, a one-quarter page public hearing notice for<br />
a City Council meeting to be held on October <strong>27</strong>, <strong>2008</strong> was published<br />
in a newspaper of general circulation within <strong>the</strong> City. In addition, <strong>the</strong><br />
notice was mailed to interested parties, pertinent agencies, and to all<br />
property owners and occupants within a 500 foot radius of <strong>the</strong> subject<br />
property.<br />
H. On October <strong>27</strong>, <strong>2008</strong>, <strong>the</strong> City Council held a duly noticed public<br />
hearing.<br />
Section 2. Environmental Review and Mitigated Negative Declaration.<br />
In accordance with <strong>the</strong> California Environmental Quality Act, Section<br />
21080.9, approval by a local agency as necessary for <strong>the</strong> preparation<br />
and adoption of a Local Coastal Program is statutorily exempt from <strong>the</strong><br />
requirements of <strong>the</strong> California Environmental Quality Act Never<strong>the</strong>less,<br />
in <strong>the</strong> interest of fostering <strong>the</strong> most informed decision-making process<br />
practicable, and without waiving <strong>the</strong> applicable statutory exemption,<br />
staff prepared a Revised Mitigated Negative Declaration in connection<br />
with <strong>the</strong> project which includes an analysis of LCPA 05-002. The<br />
Revised Mitigated Negative Declaration was certified by this Council on<br />
January 22, 2007 upon adoption of Resolution No. 07-07. The<br />
Revised Mitigated Negative Declaration satisfies any obligation <strong>the</strong> City<br />
may have pursuant to CEQA Guideline section 15252.<br />
Section 3. Local Coastal Program Amendment No. 05-002 Findings.<br />
The City of Malibu Local Coastal Program Amendment No. 05-002<br />
involves changes to <strong>the</strong> Local Implementation Plan (LIP) of <strong>the</strong> certified<br />
Local Coastal Program. Amendments to <strong>the</strong> LIP are identified in Section<br />
4 of this ordinance. Pursuant to LIP Section 19.6, <strong>the</strong> City Council<br />
hereby finds as follows.<br />
A. The proposed amendments to <strong>the</strong> LIP meet <strong>the</strong> requirements<br />
of, and are in conformance with <strong>the</strong> policies and requirements of Chapter<br />
3 of <strong>the</strong> California Coastal Act. The proposed amendment does not<br />
change any land uses in <strong>the</strong> residentially zoned area; it primarily<br />
changes <strong>the</strong> lot width requirement so that <strong>the</strong> lot sizes are consistent<br />
with similarly zoned parcels.<br />
B. The amendments to <strong>the</strong> LIP meet <strong>the</strong> requirements of, and<br />
are in conformance with <strong>the</strong> goals, objectives and purposes of <strong>the</strong> LCP.<br />
C. The adoption of <strong>the</strong> LIP amendments would not impede <strong>the</strong><br />
implementation of goals or polices of <strong>the</strong> City of Malibu’s General Plan<br />
as <strong>the</strong> amendment conforms <strong>the</strong> subject parcel to <strong>the</strong> same standards<br />
to which neighboring parcels are already developed.<br />
Section 4. Local Coastal Program Local Implementation Plan<br />
Amendment No. 05-002.<br />
A. Section 3.3.B(3) (Single Family Zone Lot Development Criteria) of<br />
<strong>the</strong> LIP is hereby amended to read as follows:<br />
3. Lot Development Criteria<br />
All new lots created within <strong>the</strong> SF District shall comply with <strong>the</strong><br />
following criteria:<br />
a. Minimum Lot Area. All new parcels created within <strong>the</strong> SF District<br />
shall comply with <strong>the</strong> minimum corresponding SF designation<br />
indicated on <strong>the</strong> Zoning Map as follows:<br />
i. SF-L: 0.5 unit per acre<br />
ii. SF-M: 1 unit per 0.25 acre<br />
1. Beachfront: 1 unit per 0.25 acre<br />
b. Minimum Lot Width: 80 feet<br />
1. Beachfront Minimum Lot Width: 45 feet<br />
c. Minimum Lot Depth: 120 feet<br />
1. Beachfront Minimum Lot Depth: 120 feet<br />
B. Section 3.4.2 (Overlay Districts Specific to Future Developments)<br />
is hereby added to read as follows:<br />
H. Malibu Bay Company Overlay District (30732 Pacific Coast<br />
Highway/APN 4469-026-005)<br />
The Residential Property Development and Design Standards<br />
contained in Section 3.6 of <strong>the</strong> Malibu LIP, as well as all o<strong>the</strong>r<br />
applicable LCP provisions, shall apply, unless specifically modified<br />
by standards detailed in this Section (3.4.2.A). In addition, <strong>the</strong><br />
following special site-specific regulations shall apply to <strong>the</strong> subject<br />
property.<br />
1. Public View Corridors<br />
As a condition of approval of, and prior to issuance of a coastal<br />
development permit for, subdivision of <strong>the</strong> subject property, <strong>the</strong><br />
following restrictions shall be imposed, and <strong>the</strong> applicant shall be<br />
required to demonstrate that <strong>the</strong> land owner has executed and<br />
recorded a deed restriction that reflects <strong>the</strong> following restrictions:<br />
(a) No less than 20% of <strong>the</strong> lineal frontage of each created parcel<br />
of <strong>the</strong> subdivision shall be maintained as one contiguous public<br />
view corridor in <strong>the</strong> location shown on Exhibit A. The view corridor<br />
may not be split or reconfigured.<br />
(b) No portion of any structure shall extend into <strong>the</strong> view corridor<br />
above <strong>the</strong> elevation of Pacific Coast Highway.<br />
(c) Any fencing across <strong>the</strong> view corridor shall be visually<br />
permeable, and any landscaping within <strong>the</strong> view corridor shall<br />
include only low-growing species that will not block or obscure<br />
bluewater views.<br />
(d) Vegetation between Pacific Coast Highway and <strong>the</strong> on-site<br />
access road that is within <strong>the</strong> public view corridors shall include<br />
only low-growing species that will not block or obscure bluewater<br />
views.<br />
2. View Corridor<br />
As a condition of approval of, and prior to issuance of a coastal<br />
development permit for, subdivision of <strong>the</strong> subject property, <strong>the</strong><br />
applicant shall be required to remove all existing obstructions<br />
between Pacific Coast Highway and <strong>the</strong> on-site access road that<br />
are within <strong>the</strong> required public view corridors, including vegetation<br />
that is over two feet in height above <strong>the</strong> elevation of Pacific Coast<br />
Highway and any fencing or gates that are not visually permeable.<br />
3. Revised Dune Habitat Restoration Plan<br />
As a condition of approval of, and prior to issuance of a coastal<br />
development permit for, subdivision of <strong>the</strong> subject property, <strong>the</strong><br />
applicant shall be required to submit, for review and approval by<br />
<strong>the</strong> City Biologist, a revised “Restoration Plan for Coastal<br />
Foredunes, 30732 Pacific Coast Highway” (Read, 2005), that<br />
incorporates <strong>the</strong> following changes and additions:<br />
a. All restoration plants and seeds shall consist of local<br />
genotypes. Propagules shall be collected on <strong>the</strong> project site or<br />
from elsewhere along <strong>the</strong> coast of nor<strong>the</strong>rn Los Angeles<br />
County or sou<strong>the</strong>rn Ventura County, as close as feasible to<br />
<strong>the</strong> project site.<br />
b. The use of a temporary irrigation line system shall be omitted.<br />
Ra<strong>the</strong>r, restoration seeds/plants shall be planted during <strong>the</strong><br />
rainy season. If rainfall is not sufficient and additional irrigation<br />
is determined necessary for successful plant establishment,<br />
only hand watering may be conducted.<br />
c. The planting plan shall be revised to include all disturbed dune<br />
habitat areas as identified in <strong>the</strong> dune habitat delineation contained<br />
in <strong>the</strong> “Biological Resources Assessment,” by Hamilton<br />
et al., dated March 6, <strong>2008</strong>.<br />
d. A maximum of two (2), three-foot wide pathways through <strong>the</strong><br />
dunes may be established within <strong>the</strong> dune restoration area,<br />
and may only be sited in <strong>the</strong> area of <strong>the</strong> existing paths per Figure<br />
2 of <strong>the</strong> Restoration Plan.<br />
e. Symbolic fencing (post and rope) along <strong>the</strong> two allowed path<br />
ways within <strong>the</strong> restoration area shall be installed to clearly<br />
delineate pathways from restoration areas.<br />
f. The root barrier element of <strong>the</strong> Restoration Plan shall be omitted.<br />
g. Rear yard fencing shall be installed to delineate developed/<br />
setback areas from ESHA/restoration areas.<br />
4. Dune Habitat Restoration Plan Implementation<br />
As a condition of approval of <strong>the</strong> subdivision of <strong>the</strong> subject<br />
property, <strong>the</strong> applicant shall be required to implement <strong>the</strong><br />
Revised Dune Habitat Restoration Plan required pursuant to Part 3<br />
above. Restoration shall commence immediately after issuance of <strong>the</strong><br />
coastal development permit. If permit issuance does not correspond<br />
with <strong>the</strong> rainy season, restoration shall commence during <strong>the</strong> next<br />
rainy season following coastal development permit issuance.<br />
5. Rear Setback<br />
The following standard shall replace <strong>the</strong> rear setback standards for<br />
beachfront parcels in Malibu LIP Sections 3.6 (G3) and 3.6 (G4):<br />
Rear Setback<br />
New development, including dwellings, decks, patios, etc. shall<br />
provide a rear setback that is <strong>the</strong> most landward of ei<strong>the</strong>r: 1) <strong>the</strong><br />
appropriate structure or deck stringline; or 2) no less than 5 feet<br />
landward of <strong>the</strong> landwardmost limit of dune ESHA, which is shown<br />
on Exhibit B.<br />
Separate stringline standards apply to dwellings and decks, as follows:<br />
a. Dwellings. For a dwelling, new construction shall not extend<br />
seaward of a stringline drawn from a point on <strong>the</strong> closest<br />
upcoast and downcoast dwelling. The stringline point shall be<br />
located on <strong>the</strong> nearest adjacent corner of <strong>the</strong> upcoast and<br />
downcoast dwelling.<br />
b. Decks and patios. For a deck or patio, new construction<br />
shall not extend seaward of a stringline drawn from a point on<br />
<strong>the</strong> closest upcoast and downcoast deck or patio. The stringline<br />
point shall be located on <strong>the</strong> nearest adjacent corner of<br />
<strong>the</strong> upcoast and downcoast deck or patio.<br />
The variance provisions of Malibu LIP Section 13.26 shall not<br />
apply to <strong>the</strong> rear setback requirements of <strong>the</strong> Malibu Bay Company<br />
(30732 Pacific Coast Highway) Overlay.<br />
6. Open Space Conservation Easement<br />
No development, as defined in Section 2.1 of <strong>the</strong> Malibu LIP, shall<br />
occur within <strong>the</strong> area of <strong>the</strong> subject property located between <strong>the</strong><br />
landwardmost limit of ESHA and <strong>the</strong> ambulatory seawardmost<br />
limit of dune vegetation, which is generally shown on Exhibit B,<br />
except for dune habitat restoration, <strong>the</strong> use and maintenance of a<br />
maximum of two 3-feet wide pathways, and symbolic fencing to<br />
delineate <strong>the</strong> two pathways.<br />
As a condition of approval of, and prior to issuance of a coastal<br />
development permit for, subdivision of <strong>the</strong> subject property, <strong>the</strong><br />
applicant shall be required to demonstrate that <strong>the</strong> land owner has<br />
executed and recorded a document in a form and content acceptable<br />
to <strong>the</strong> Coastal Commission, irrevocably offering to dedicate<br />
(or grant an easement) to a public agency or private association<br />
approved by <strong>the</strong> Coastal Commission, an open space conservation<br />
easement over <strong>the</strong> area described in <strong>the</strong> prior paragraph<br />
(“open space conservation easement area”), for <strong>the</strong> purpose of<br />
habitat protection. The recorded easement document shall include<br />
a formal legal description of <strong>the</strong> entire property; and a metes and<br />
bounds legal description and graphic depiction, prepared by a<br />
licensed surveyor, of <strong>the</strong> open space conservation easement area,<br />
as generally shown on Exhibit B. The recorded document shall<br />
reflect that no development shall occur within <strong>the</strong> open space<br />
easement area except as o<strong>the</strong>rwise set forth in this permit condition.<br />
The offer shall be recorded free of prior liens and encum<br />
brances which <strong>the</strong> Coastal Commission determines may affect <strong>the</strong><br />
interest being conveyed.<br />
C. Section 6.5(E) (Ocean Views) of <strong>the</strong> LIP is hereby amended to read<br />
as follows:<br />
6. New subdivisions of beachfront residential parcels, where<br />
structures cannot be sited or designed below road grade,<br />
shall ensure that no less than 20% of <strong>the</strong> lineal frontage of<br />
each newly created parcel shall be maintained as one contiguous<br />
public view corridor (even if <strong>the</strong> resultant lots are 50 feet or<br />
less in width). The view corridors of <strong>the</strong> newly created parcels<br />
shall be contiguous to <strong>the</strong> maximum extent feasible in order to<br />
minimize impacts to public views of <strong>the</strong> ocean. This requirement<br />
shall be a condition of permit approval for subdivision of<br />
a beachfront property.<br />
D. The Exhibits in <strong>the</strong> LIP are hereby amended to include a map of<br />
Malibu Bay Company Overlay District (30732 Pacific Coast Highway/APN<br />
4469-026-005). The map is attached as Exhibit B.<br />
Section 5. Approval of Local Coastal Program Amendment No. 05-002<br />
A. Pursuant to <strong>the</strong> California Coastal Commission’s Administrative<br />
Regulations Section 13544.5, <strong>the</strong> LCP amendment certification<br />
shall not be deemed final and effective until all of <strong>the</strong> following occur: 1)<br />
<strong>the</strong> City Council: a) acknowledges receipt of <strong>the</strong> Commission’s resolution<br />
of certification, including any terms or modifications suggested for<br />
final certification; b) accepts and agrees to any such terms and modifications<br />
and takes whatever formal action is required to satisfy <strong>the</strong> terms<br />
and modifications; and c) agrees to issue coastal development permits<br />
for <strong>the</strong> total area included in <strong>the</strong> certified Local Coastal Program; 2) <strong>the</strong><br />
Executive Director determines in writing that <strong>the</strong> City’s action is legally<br />
adequate to satisfy any specific requirements set forth in <strong>the</strong> Commission’s<br />
certification order and <strong>the</strong> Director reports <strong>the</strong> determination to <strong>the</strong><br />
Commission at its next regularly scheduled meeting; 3) if <strong>the</strong> Director<br />
finds that <strong>the</strong> City’s action does not conform to <strong>the</strong> Commission’s order,<br />
<strong>the</strong> Commission shall review <strong>the</strong> City action as if it were a resubmittal;<br />
and 4) notice of <strong>the</strong> certification shall be filed with <strong>the</strong> Secretary of <strong>the</strong><br />
Resources Agency for posting and inspection.<br />

style and muckraking<br />
earned <strong>the</strong> respect of all<br />
political factions in Malibu,<br />
is starting a new career.<br />
“I am leaving journalism,”<br />
said Friedman, who<br />
also previously worked in<br />
radio. He announced that<br />
he is taking a job at PCR<br />
Services, Corporation.<br />
PCR, on its Web site, describes<br />
itself as “in <strong>the</strong><br />
business of environmental<br />
management and compliance,”<br />
with “diverse practices<br />
in environmental planning<br />
and documentation, biological<br />
services, air quality,<br />
environmental and architectural<br />
acoustics” in<br />
planning “from a single lot<br />
to an entire county.”<br />
Friedman, who was described<br />
as among <strong>the</strong> first to<br />
L-E-T-T-E-R-S<br />
transition <strong>the</strong> local weekly<br />
news cycle into more frequent<br />
segments with online<br />
reporting, may be <strong>the</strong> only<br />
journalist to have receive a<br />
commendation from <strong>the</strong><br />
seemingly media-averse<br />
Malibu City Council.<br />

reportage, including his<br />

promenade of pavers lined<br />
by palm trees and flanked<br />
by two large water fountains.<br />
The $26.6 million HSS<br />
Building was constructed in<br />
two phases—<strong>the</strong> north wing<br />
opened in fall 2006 and <strong>the</strong><br />
south wing in fall 2007. The<br />
53,000-square-foot complex,<br />
which faces onto <strong>the</strong><br />
Quad, is connected with<br />
pedestrian bridges and<br />

schedule for Malibu to work<br />

talked about Legacy Park. “I<br />
am really sad and disappointed<br />
about Legacy Park.<br />
That it has become a detention<br />
basin for stormwater.<br />
I would like to see <strong>the</strong><br />
[wastewater] treatment<br />
capacity reconsidered,” she<br />
added.<br />
Talking about <strong>the</strong> efficacy<br />
of septic systems in Malibu,<br />
Glickfeld noted, “There are<br />
so many commercial properties<br />
that don’t function<br />

The Week of November <strong>27</strong>-December 3, <strong>2008</strong> include <strong>the</strong> ongoing opposition to Saturn, but we are so used to<br />
Thanksgiving <strong>2008</strong> looks more<br />
like a mad tea party from Alice<br />
in Wonderland than a page from<br />
<strong>the</strong> Pilgrim Story. So don’t be surprised<br />
if your trip to Grandma’s house<br />
is interrupted by space aliens, visitors<br />
from Middle Earth, or a couple of<br />
Native American ghosts from Thanksgivings<br />
past. (It is, after all, a politically<br />
incorrect holiday). Also don’t be<br />
dismayed if <strong>the</strong> conversation around<br />
<strong>the</strong> tofutti turkey swings <strong>the</strong> grassy knoll to Obama’s birth certificate<br />
to bar codes as <strong>the</strong> “sign of <strong>the</strong> beast” to <strong>the</strong> Illuminati of<br />
<strong>the</strong> New World Order to Area 51 (I’m already exhausted, and I<br />
love <strong>the</strong>se stories). No matter how or what you slice, this<br />
Thanksgiving will be like no o<strong>the</strong>r. The source of eccentricity is<br />
Uranus, that mo<strong>the</strong>r of invention, who goes direct Thursday<br />
morning. Uranus represents sudden bolts from <strong>the</strong> blue, and<br />
whenever it alters its course, nervous systems quicken from <strong>the</strong><br />
shift in celestial perspective. The end of its retrograde phase does<br />

this tension, I’m not even going to talk about it. Instead, <strong>the</strong><br />
focus is on a Uranus sextile to <strong>the</strong> Venus/Jupiter conjunction in<br />
Capricorn. Positive Venus/Jupiter configurations signify <strong>the</strong><br />
principle of joyous love. And when you add Uranus to <strong>the</strong> mix,<br />
that joy is expressed without reservation. Saturn trines that<br />
Venus/Jupiter conjunction, stabilizing <strong>the</strong> “look at me, I’m free”<br />
exuberance just enough to keep most of us from volunteering to<br />
return to <strong>the</strong> Shire with Sam, Merry, and Pippin.<br />
(Okay…Lothlorien or Rivendell…maybe.) What’s more, Saturn’s<br />
sober presence could prevent a plethora of mashed potato<br />
mountains during dinner. (Devil’s Rock, anyone?) But that’s not<br />
all. A Sun/Mercury/Mars/Moon conjunction in Sagittarius also<br />
turns <strong>the</strong> entire day (actually <strong>the</strong> whole week) into a talkfest.<br />
Sagittarians are a loquacious lot who tend to be versed in any<br />
<strong>number</strong> of arcane subjects. Add Mercury, <strong>the</strong> symbol for language,<br />
as well as Mars, <strong>the</strong> principle of energy, and <strong>the</strong> entire<br />
bundle turns into a non-stop marathon discussion, capable of<br />
moving from discourse to debate to quick repartee in a matter of<br />
moments. Of course, <strong>the</strong> Moon adds an emotional touch, but no<br />
one is likely to mind, especially because everyone will be talking<br />

at once. Pluto sings a somber solo note, <strong>the</strong> night before Thanksgiving,<br />
as it moves into Capricorn (where it will stay for <strong>the</strong> next<br />
15 years) and doesn’t engage directly with any of its planetary<br />
cohorts until <strong>the</strong> Moon moves into Capricorn on Saturday, a<br />
conjunction some of us may feel more keenly than o<strong>the</strong>rs. It<br />
probably won’t be easy settling down long enough to say a<br />
prayer of gratitude, but that doesn’t mean it wouldn’t be wise to<br />
make an effort. Thanksgiving is a day set aside for feeling grateful.<br />
It may be hard this year for many of us to find a true place of<br />
thanks—so many lives have been disrupted by storms, physical<br />
and financial, and so much uncertainty about <strong>the</strong> future permeates<br />
<strong>the</strong> physical and psychic environment. So be sure to include<br />
those less fortunate in your heart.<br />
If you know your ascendant and/or your moon sign, read that too.<br />
Aries (March 21-April l9): Before you embark on that new venture,<br />
ga<strong>the</strong>r appropriate information. Read, research, and examine <strong>the</strong><br />
available data, and <strong>the</strong>n, focus on syn<strong>the</strong>sis and integration.<br />

OBITUARY<br />
Mille May<br />
July 10, 1929 - Nov. 18, <strong>2008</strong><br />
Mille May, a longtime Malibu resident, passed away in <strong>the</strong> early morning hours of Nov. 18,<br />
<strong>2008</strong>. She is survived by her husband of 58 years, Jim, and her daughters Sherry, Leslie and<br />
Holly.<br />
Mille and Jim built <strong>the</strong>ir house in Malibu and moved into it with <strong>the</strong>ir young family over<br />
51 years ago and <strong>the</strong>y truly appreciated <strong>the</strong>ir home and wonderful view.<br />
Mille was generous, intelligent, warm and gracious. She<br />
always made everyone feel welcome. If you were a plumber and<br />
were working on <strong>the</strong> sink, you would be sure to be served lunch.<br />
Mille was a spectacular gourmet cook who loved to entertain,<br />
and she was a gifted artist who painted large abstract canvases—several<br />
of which hung in Guido’s Restaurant for many years.<br />
She was <strong>the</strong> love of our lives and will be missed tremendously<br />
and we feel grateful that her passing was peaceful after a<br />
long and difficult illness.<br />
We are lucky to have known this remarkable woman.<br />
Mille was <strong>the</strong> daughter of Alfredo and Giovana Melaragno<br />
of Providence, RI.<br />

old.<br />
Frank Palmer<br />
was<br />
born Aug. 23,<br />
1913 in Aberdeen,<br />
South<br />
Dakota. His<br />
parents Arthur<br />
Cornell Palmer and Frances Leffingwell<br />
were from families of early English<br />
colonial settlers in New England from <strong>the</strong><br />
1600s. His fa<strong>the</strong>r worked for <strong>the</strong> railroad<br />
and as young boy moved with his family to<br />
Tacoma, Washington where Frank attended<br />
Stadium High School and worked for<br />
Gundersen Jewelers where he learned <strong>the</strong><br />
art of jewelry manufacturing from master<br />
jewelers.<br />
Frank moved to Los Angeles during <strong>the</strong><br />
depression and worked as a diamond setter<br />
and master jeweler creating masterpieces<br />
for many of <strong>the</strong> finest jewelry<br />
stores in Sou<strong>the</strong>rn California.<br />
In 1939 Frank married Grace Bishop in<br />
Los Angeles. He served in <strong>the</strong> U.S. Air<br />
Force during WW II in France. After<br />
returning home he started a family and<br />
Russell Philbrick, after a long battle<br />
with cancer, died peacefully at<br />
his home on Nov. 16, <strong>2008</strong>. Natalie<br />
(Tally), his wife of 64 years, was at<br />
his bedside.<br />
Russell was born on Oct. 9, 1922 in<br />
York, Maine. At 18 years of age, he<br />
joined <strong>the</strong> U.S. Navy “to see <strong>the</strong><br />
world,” but as it turned out, due to<br />
World War II, he spent six years in <strong>the</strong> Pacific area. First<br />
seeing action in <strong>the</strong> Aleutian Islands in <strong>the</strong> north, <strong>the</strong>n on<br />
to Hawaii and on to <strong>the</strong> South Pacific. During that time, he<br />
earned <strong>the</strong> rating of Chief Electricians Mate.<br />
In <strong>the</strong> early years in <strong>the</strong> navy, his best buddy invited him<br />
home with him for <strong>the</strong> weekend to Whittier, California,<br />
where he was introduced to Tally. Two years later <strong>the</strong>y<br />
were married on his 22nd birthday at his home in Maine.<br />
Just after <strong>the</strong> war ended, Tally was able to go to Hawaii to<br />
join Russ for his last year at Pearl Harbor Navy Base.<br />
Back in Whittier, Russ went to work at General Telephone,<br />
Co., eventually becoming transferred to Santa Monica.<br />
After 35 years with <strong>the</strong> company, Russ retired to become<br />
a true “Malibuite.” He was a very enthusiastic member of<br />
<strong>the</strong> Malibu Optimists Club, a docent at <strong>the</strong> Adamson House<br />
at Malibu Creek and an Arson Watch member. Also, with<br />
three young sons, he was very involved with <strong>the</strong> Cub Scouts<br />
and later, Sea Scouts.<br />
Retirement for Russ was filled with activities he loved:<br />
traveling, sailing, bicycle trips, skiing and golf—always with<br />
Tally or one or more of his sons, Bill, Mark or Scott.<br />
Russ also leaves two daughters-in-law, five grandchildren<br />
and four great grandchildren.<br />
He will be forever remembered and missed by all those<br />
who knew and loved him.<br />

Russell A. Philbrick<br />
worked as one of <strong>the</strong> most respected master<br />
jewelers in Los Angeles for over 50<br />
years before retiring. Frank worked in <strong>the</strong><br />
Metropolitan Building at 5th and Broadway.<br />
He first worked for Prentice Ball Diamond<br />
Setters and Ballard & Ballard<br />
before going into business for himself as<br />
Frank D. Palmer, Jeweler. In 1974 Frank<br />
partnered with Herman Widen at Widen<br />
Bro<strong>the</strong>rs Jewelers and later with Harry<br />
Wolf & Sons Diamonds before retiring.<br />
After <strong>the</strong> death of his wife, Grace, he<br />
purchased property in Malibu where<br />
Frank and his son, Jim, developed Malibu<br />
Vineyards in Decker Canyon, creating one<br />
of Malibu’s Gold Medal winning premium<br />
wine vineyards.<br />
Frank Palmer was respected by everyone<br />
who knew him. Always willing to help<br />
someone less fortunate, Frank and his<br />
wife Grace would invite neighbors with no<br />
family ties to <strong>the</strong>ir home for dinner to celebrate<br />
Thanksgiving and share with <strong>the</strong>ir<br />
neighbors.<br />
Frank always lived by <strong>the</strong> Golden Rule,<br />
“Do unto o<strong>the</strong>rs as you would have <strong>the</strong>m<br />
do unto you.”<br />
He would always tell his sons and grandson<br />
to learn something new every day.<br />
Frank Palmer lived a long and full life<br />
touching <strong>the</strong> lives of many who knew him.<br />
He is survived by his sons Jim Palmer of<br />
Malibu, John Palmer of Camarillo and<br />
Grandson, Jonny Palmer of Malibu.<br />
