Jacobs: Well, once—97 percent <strong>of</strong> <strong>the</strong> people who<br />

come <strong>in</strong>, once <strong>the</strong>y have <strong>the</strong>ir <strong>in</strong>terview, if <strong>the</strong>y’re found<br />

eligible, <strong>the</strong>y get <strong>the</strong>ir visa ei<strong>the</strong>r that same day or with<strong>in</strong><br />

48 hours after <strong>the</strong> <strong>in</strong>terview.<br />

There is a very small percentage <strong>of</strong> cases that have to<br />

be referred back to Wash<strong>in</strong>gton for fur<strong>the</strong>r [security] vett<strong>in</strong>g.<br />

Those were <strong>the</strong> cases, really, back <strong>in</strong> 2002, 2003, that<br />

were caus<strong>in</strong>g significant delays and that’s where we have<br />

really made very significant improvement. We’ve gone<br />

from 79 days down to 14 [to complete secondary clearances].<br />

So I th<strong>in</strong>k we have made significant progress <strong>the</strong>re.<br />

Neifach: DHS and <strong>State</strong> have been work<strong>in</strong>g very<br />

closely on fur<strong>the</strong>r improvements that can be made. How<br />

can we rapidly check those folks that we need to [and],<br />

not have to check those people when <strong>the</strong>re is already<br />

ano<strong>the</strong>r check happen<strong>in</strong>g.<br />

Johnson: Janice, can I ask you, on <strong>the</strong> reapplication,<br />

now that—you have to reapply, resubmit an entire<br />

application—<br />

Jacobs: Right.<br />

Johnson: Pay <strong>the</strong> fee aga<strong>in</strong>.<br />

Jacobs: Right.<br />

Johnson: I just paid a hundred dollars to <strong>the</strong> Russian<br />

Embassy for m<strong>in</strong>e—it’s a significant amount for a lot <strong>of</strong><br />

people.<br />

Is <strong>the</strong>re, though, an <strong>in</strong>ternal process by which someone<br />

could say, “Look, this guy’s not treat<strong>in</strong>g me right. I<br />

want someone else to look at my file,” and sort <strong>of</strong> reapply<br />

and fairly quickly have a second pair <strong>of</strong> eyes? Is that possible<br />

or not?<br />

Jacobs: Many posts have that—a procedure whereby,<br />

if you have been denied, say, a certa<strong>in</strong> number <strong>of</strong> times<br />

on [<strong>the</strong> visa] l<strong>in</strong>e, say, twice, and you reapply aga<strong>in</strong>—<strong>the</strong><br />

third time, <strong>the</strong> head <strong>of</strong> <strong>the</strong> section would look at <strong>the</strong><br />

case. It really varies from post to post, depend<strong>in</strong>g on <strong>the</strong><br />

volume and <strong>the</strong> size <strong>of</strong> <strong>the</strong> [consular] section.<br />

Question: <strong>You</strong> talked about a <strong>State</strong> <strong>Department</strong><br />

website.<br />

Jacobs: Right.<br />

Question: But you’ve also said that <strong>the</strong>re are differences<br />

from country to country. How will <strong>the</strong>y—how does<br />

one f<strong>in</strong>d out about [those differences]? Where’s <strong>the</strong> best<br />

place to go to?<br />

Jacobs: If you go to our website [http://<br />

www.travel.state.gov], you can l<strong>in</strong>k <strong>in</strong>to all <strong>of</strong> our embassies<br />

and consulates that process visas. And we’ve asked all<br />

<strong>of</strong> <strong>the</strong> posts to put on <strong>the</strong>ir <strong>in</strong>dividual websites <strong>the</strong> special<br />

procedures that <strong>the</strong>y have <strong>in</strong> place for people gett<strong>in</strong>g <strong>in</strong> on<br />

an urgent basis.<br />

Question: And <strong>the</strong>re are, through <strong>the</strong> Foreign Commercial<br />

Service or o<strong>the</strong>rwise…<strong>the</strong>re are arrangements for<br />

bus<strong>in</strong>ess applicants, specifically bus<strong>in</strong>ess applicants?<br />

Jacobs: There are. We have many, many different<br />

k<strong>in</strong>ds <strong>of</strong> programs. We have programs where people<br />

can—who are registered with AmCham—can get expedited<br />

appo<strong>in</strong>tments. At some <strong>of</strong> our posts, we have someone<br />

designated <strong>in</strong> <strong>the</strong> consular section who is <strong>the</strong> bus<strong>in</strong>ess representative.<br />

The companies can call that person to set up<br />

appo<strong>in</strong>tments. Every post handles it a little bit differently.<br />

I th<strong>in</strong>k <strong>the</strong>re is a misperception, after 9/11, that, <strong>in</strong><br />

fact, we are deny<strong>in</strong>g more visas under Section 214(b),<br />

which is <strong>the</strong> one that talks about be<strong>in</strong>g an <strong>in</strong>tend<strong>in</strong>g immigrant.<br />

The fact is that our worldwide refusal rate is a<br />

little bit lower today than it was before 9/11.<br />

We are f<strong>in</strong>d<strong>in</strong>g that <strong>the</strong> fact that we’re shar<strong>in</strong>g more<br />

<strong>in</strong>formation with o<strong>the</strong>r agencies, that we’re able to<br />

confirm for students, for example, that <strong>the</strong>y have been<br />

accepted at a school…all <strong>of</strong> <strong>the</strong>se th<strong>in</strong>gs are result<strong>in</strong>g <strong>in</strong> a<br />

higher rate <strong>of</strong> visa issuance after 9/11….<br />

The criteria has not changed for a visa. What has<br />

really changed is that we have taken steps to know more<br />

about applicants. We’re <strong>in</strong>terview<strong>in</strong>g more applicants and<br />

look<strong>in</strong>g more closely at documents and th<strong>in</strong>gs like that,<br />

but <strong>the</strong> criteria for qualify<strong>in</strong>g have not changed.<br />

Moderator: I th<strong>in</strong>k that’s a great place to stop. I want<br />

to thank all <strong>of</strong> you for be<strong>in</strong>g here today and for talk<strong>in</strong>g<br />

about <strong>the</strong>se critical issues. I th<strong>in</strong>k <strong>the</strong> bottom l<strong>in</strong>e is that<br />

America’s doors are open and that we welcome foreign<br />

visitors, whe<strong>the</strong>r <strong>the</strong>y’re com<strong>in</strong>g for bus<strong>in</strong>ess, to study, or<br />

for tourism.<br />

And I hope that we will quickly correct some <strong>of</strong> <strong>the</strong><br />

challenges that we’ve heard about today and I th<strong>in</strong>k that,<br />

you know, we’ve heard that some <strong>of</strong> <strong>the</strong> myths out <strong>the</strong>re<br />

are not actually true and are, <strong>in</strong> fact, myths and that <strong>the</strong>re<br />

are th<strong>in</strong>gs that <strong>the</strong> bus<strong>in</strong>ess community and <strong>the</strong> applicants<br />

can do to help smooth <strong>the</strong> whole process.<br />

So thank you aga<strong>in</strong> for com<strong>in</strong>g and we look forward<br />
