INTRODUCTION<br />
A Background to the project<br />
1. This <str<strong>on</strong>g>C<strong>on</strong>sultati<strong>on</strong></str<strong>on</strong>g> <str<strong>on</strong>g>Paper</str<strong>on</strong>g> forms part of the Commissi<strong>on</strong>‟s Third<br />
Programme of <strong>Law</strong> <strong>Reform</strong> 2008-2014. 1<br />
2. The Commissi<strong>on</strong> has previously addressed the topic of advance care<br />
directives in the following:<br />

<str<strong>on</strong>g>C<strong>on</strong>sultati<strong>on</strong></str<strong>on</strong>g> <str<strong>on</strong>g>Paper</str<strong>on</strong>g> <strong>on</strong> <strong>Law</strong> and the Elderly (2003). 4<br />
In the <str<strong>on</strong>g>C<strong>on</strong>sultati<strong>on</strong></str<strong>on</strong>g> <str<strong>on</strong>g>Paper</str<strong>on</strong>g> <strong>on</strong> <strong>Law</strong> and the Elderly, the Commissi<strong>on</strong><br />
acknowledged that there has been no legislati<strong>on</strong> or case law in Ireland<br />
specifically addressing the efficacy of advance care directives. It suggested that<br />
“since it is possible to nominate another pers<strong>on</strong> to make pers<strong>on</strong>al and property<br />
decisi<strong>on</strong>s, it ought to be possible to make those decisi<strong>on</strong>s <strong>on</strong>eself and have<br />
them carried out by others if incapacity sets in. They could provide for practical<br />
decisi<strong>on</strong>s in relati<strong>on</strong> to pers<strong>on</strong>al care and property – broadly the same issues as<br />
may be dealt with under an EPA.” 5 However, the Commissi<strong>on</strong> was aware of the<br />
important and c<strong>on</strong>tentious moral, legal and ethical questi<strong>on</strong>s raised by advance<br />
care directives and that such questi<strong>on</strong>s would require detailed c<strong>on</strong>siderati<strong>on</strong>. 6<br />
