Executive Summary

Ontario Environmental & Safety Network Ltd. (herein referred to as OESN) was retained by the City of Niagara Falls

(herein referred to as the City) to assess construction materials, building mechanical systems, finished products,

equipment, appliances, and furnishings within the building located at 6121 Lundy’s Lane, Niagara Falls, Ontario. The

purpose of the assessment was to identify for the presence of designated substances and select hazardous

materials, as required in Section 30 of the Ontario Occupational Health and Safety Act and Regulations for

Construction Projects, which states before beginning a project, the owner shall determine whether any designated

substances are present at the project site and shall prepare a list of all designated substances present at the site.

Summarized below are the materials identified at the project site which were analytically determined to contain

designated substances:

The following designated substances were not identified within the building located at 6121 Lundy’s Lane, Niagara

Falls, Ontario:

� Acrylonitrile

� Arsenic

� Benzene

� Coke Oven Emissions

� Ethylene Oxide

� Isocyanates

� Vinyl Chloride

The Scope of Work, found in Appendix C, provides the City with guidance on the controlled removal and disposal of

the designated substances identified at 6121 Lundy’s Lane, Niagara Falls, Ontario.

Introduction

Prior to beginning a project, the owner is required to determine whether any designated substances are present at

the project site and shall prepare a list of all designated substances that are present at the site. This report, prepared

by OESN and provided to the City satisfies this requirement.

Scope of Work

To produce the information required to meet Section 30 of the Occupational Health and Safety Act, OESN developed

and implemented the following scope of work for the property located at 6121 Lundy’s Lane, Niagara Falls, Ontario:

1. Identify and locate materials suspected of containing designated substances or other potentially hazardous

substances throughout the interior and exterior of the building

2. Collect bulk samples of materials suspected to contain designated substances and submit for analysis

3. Document items suspected of containing designated substances and hazardous materials

4. Document the bulk sampling and inspection methodology, assessment findings, and results of analytical

work

Bulk Sampling and Analysis Methodology

General building assessment techniques and principles were applied for materials suspected of containing

designated substances and select hazardous materials. All accessible materials suspected of containing designated

substances were sampled and analyzed for the purpose of a Designated Substances and Select Hazardous

Materials Assessment.

The determination of materials to be sampled was based on the experience and knowledge of an OESN

representative regarding the historical use of designated substances and hazardous materials in building materials.

Trisha McPherson of OESN carried out the visual inspection and material bulk sampling at 6121 Lundy’s Lane,

Niagara Falls, Ontario.

Bulk Collection Methodology for Asbestos Samples

Asbestos bulk sampling was performed using the method stated in Section 3 of O. Reg. 278/05 as amended.

Sampling strategy for bulk sampling of asbestos included for the development of a homogeneous materials sampling

coding system. Homogeneous is defined as materials similar in composition, colour and texture.

The sampling plan for asbestos has the following coding system:

HF–01

HF – Homogeneous Floor Material (W - Wall, C - Ceiling, T - Thermal, M - Manufacturing)

01 – The first homogeneous floor material sampled

Analysis Methodology for Asbestos Samples

All bulk samples collected during the assessment were sent to CEI Labs for analysis. CEI Labs is accredited by the

National Voluntary Laboratory Accreditation Program (NVLAP). Samples were analyzed using Polarized Light

Microscopy (PLM). Sample preparation and analytical procedures are done in compliance with the procedures

described in U.S. EPA Method 600/R93/116 Method for the Determination of Asbestos in Bulk Building Materials

dated June 1993. Other procedures also utilized to supplement this method are described in Environmental

Laboratory Accreditation Program 198.1. (ELAP 198.1).

Bulk Collection Methodology for Lead, Mercury and Arsenic Samples

Sampling strategy for bulk sampling of lead, mercury and arsenic included for the development of a homogeneous

sampling coding system.

Analysis Methodology for Lead, Mercury and Arsenic Samples

All bulk paint samples collected were sent to Paracel Laboratories Ltd. Paracel Laboratories Ltd. is accredited by the

Canadian Association for Laboratory Accreditation (CALA).

Sample preparation and analytical procedures are done in compliance with the following analytical methods:

� Metals – EPA 6020 – Digestion, ICP-MS

� Mercury – EPA 7471A – CVAA, digestion

Analytical Findings

Analytical Findings for Asbestos-Containing Materials

Analytical testing determined the asbestos mineral Chrysotile is detected in samples collected within 6121 Lundy’s

Lane, Niagara Falls, Ontario in form of friable and non-friable materials. Friable material is defined as “material that

when dry, can be crumbled, pulverized or powdered by hand pressure, or is crumbled, pulverized or powdered” (O.

Reg. 278/05 as amended). Non-friable is hard in composition and cannot be pulverized under hand pressure.

Analytical testing determined asbestos is detected in the following materials listed in Table 1.

This report is intended for the exclusive use of the City of Niagara Falls. Any use that a third party makes of this

report, or any reliance on decisions to be made based on it, is the responsibility of such third parties.

The findings reported in this Designated Substances and Select Hazardous Materials Assessment have been

compiled using current industry best practices and techniques. The findings are relevant for the date of OESN’s site

visit and should not be relied upon to represent conditions at later dates. The findings in this assessment are limited

to the building materials observed in rooms or building spaces fully accessed during the time of inspection. All

materials were assessed at the discretion of the inspectors.

OESN reserves the right to modify any findings reported as a result of insufficient background and historical

information and inaccessibility issues from building condition, design and layout. It is possible that building materials

not identified in this report may become exposed during demolition. Any materials not identified in this report and are

suspected to contain designated substances should be treated as such until sampling and analysis is conducted.

Bulk Sampling Limitations

Bulk sampling of man-made vitreous fibre products, specifically, fibreglass pipe insulation, was not included in the

bulk sampling strategy subsequent to the review of present day MSDS sheets for the product which do not state the

inclusion of asbestos as an ingredient in their manufacture.

Paint coating samples were not submitted for further toxic characteristics leachate procedure (TCLP) analysis since

initial lead results of paint samples indicated a lead concentration of

Scope of Work for the Removal of Identified Designated Substances

INTRODUCTION

PROJECT BACKGROUND:

In July 2012, Ontario Environmental & Safety Network Ltd. (herein referred to as OESN) was retained by

the City of Niagara Falls (herein referred to as the City) to perform a designated substance assessment

within the property located at 6121 Lundy’s Lane, Niagara Falls, Ontario.

The purpose of assessment was to identify for the presence of designated substances as per Section 30

of the Ontario Occupational Health and Safety Act and Regulations for Construction Projects, which

states before beginning a project, the Owner shall determine whether any designated substances are

present at the project site.

Assessment concluded that asbestos, lead, mercury and silica are present at the project site and

represent a hazard for worker.

Based on future demolition plans, OESN was requested to provide the City with a scope of work for the

safe removal of the designated substances and hazardous materials identified during the assessment.

PROJECT OBJECTIVE:

The goal of this scope of work is to provide information necessary for the safe handling, removal and

disposal of the designated substances and hazardous materials identified during the assessment. The

scope of work is intended to direct the contractors executing the abatement work but does not supplant

existing provincial legislation, regulations, guidelines and policies.

Materials of concern are to be removed in a safe and controlled manner as per the requirements stated

in the following regulations and guidelines:

� Regulation respecting Asbestos on Construction Projects and in Buildings and Repair Operations

– O. Reg. 278/05 (as amended)

� Guideline - Silica on Construction Projects

PROJECT CLASSIFICATION OF WORK:

Classifications for abatement work have been segregated by hazard material type (e.g asbestos, silica,

etc.). If abatement of designated substances is conducted simultaneously, the measures and procedures

established for the Type 3 asbestos operation are adequate for abatement of other materials other than

asbestos.

ASBESTOS ABATEMENT:

Ontario Regulation 278/05 (as amended) requires that all work that may expose a worker to asbestos be

classified as a Type 1, Type 2, or Type 3 operation. The criteria for classification of work factors in the

type and nature of material (friable/material easily crumbles), nature of disturbance activity (cutting

material), quantity of material to be removed (< or > 1 m 2 ), duration of exposure to worker and risk to

bystanders (re-occupancy of work area(s) by building occupants).

The asbestos abatement work at the project site is classified as: Type 3 Operation

LEAD ABATEMENT:

The classification of typical lead-containing construction tasks is based on presumed airborne

concentrations obtained from the U.S. Occupational Safety and Health Administration (OSHA), the

Ontario Ministry of Labour, and published research studies. The classification of Type 1, Type 2, or Type

3 operations are grouped based on the concentrations of airborne lead that a worker may be exposed to

during typical construction operations that generate lead-containing dust.

The OSHA Lead Standard does not define lead paint based on the amount of lead present. That is, the

standard does not specify a minimum amount or concentration of lead that triggers a determination

that lead is present and the potential for occupational exposure exists. It is theoretically not possible to

exceed the OSHA permissible exposure limit of 50 µg/m 3 , eight-hour time-weighted average (TWA) if

lead content is ≤600 ppm.

SCOPE OF ABATEMENT WORK

In accordance with the Occupational Health & Safety Act (OSHA), the following is a list of designated

substances and hazardous materials affected during demolition:

� Asbestos:

o Friable Linoleum (approximately 137m 2 or 1477 ft 2 )

o Friable Stippled Texture Coat - Ceiling (approximately 30 m 2 or 320 ft 2 )

o Friable Paper Backing Behind Electrical Panel (approximately

CONTROLS FOR PROJECT

KEY HAZARD INFORMATION:

Once abatement begins, access to the inside of the building shall be restricted to workers involved in the

abatement operation. Given the operation will be carried on inside a building that is to be demolished,

clearance air sampling will not be conducted upon the completion of abatement. Following abatement

and final cleaning, the building shall not be re-entered by any person except the workers involved in the

building demolition. Following the cleaning phase of the project, if entry is required for any reason

including emergency purposes, proper PPE consistent with Type 3 asbestos operations shall be worn by

every person entering the building.

Given the operation will be carried on inside a building that is to be demolished, construction of interior

containment(s) is not required. The building perimeter walls will act as the enclosure. An internal or

remote decontamination facility for workers and tools is permitted.

Contractor is to supply construction grade lighting for execution of project.

Contractor shall supply temporary electrical power distribution systems (i.e. power distribution panel)

for tools and equipment needed for project. Power to the building will be supplied but internally the

building is to be de-energized and temporary electrical power is to be installed by a qualified electrical

contractor and shall include ground fault circuit interrupters.

The following statements in this section do not supplant or replace

the requirements stated in:

GENERAL MEASURES AND PROCEEDURES FOR PROJECT – ASBESTOS, MERCURY AND SILICA:

Prior to abatement commencement, warning signs restricting access to the building must be posted in

sufficient numbers in the work area(s) indicating the hazardous material of concern and personal

protective equipment to be worn inside the work area(s).

Doorways, windows, vents, floor drains and services holes in walls and grilles located within the work

area(s) must be sealed with polyethylene sheeting sealed with tape as appropriate.

Washing facilities for decontamination consisting of wash basin, water, soap and towels should be

provided to workers for all phases of the project.

Workers should not eat, drink, chew gum or smoke in the work area(s).

Drop sheets should be used below the abatement activities in work area(s) where dust, chips or debris

containing designated substances are produced or may be produced.

Dust and waste should be cleaned up regularly and removed by vacuuming with a HEPA filter equipped

vacuum.

Compressed air or dry sweeping should not be used to clean up any dust or waste from the work area(s)

or from clothing.

Gross waste and debris is to be cleaned up at the end of each abatement shift for prevention and

housekeeping measures.

Inspection of the work area(s) is to be conducted daily to ensure the work area(s) are clean and controls

for construction are maintained.

Waste containers used to dispose of designated substances shall be dust tight, suitable for the type of

waste, impervious to the waste intended for and clearly identified.

Waste containers shall be cleaned with a damp cloth or HEPA vacuumed immediately before being

removed from the work area(s) and removed from the work area(s) frequently and at regular intervals.

SPECIFIC MEASURES AND PROCEEDURES FOR PROJECT - ASBESTOS ABATEMENT:

Water with a wetting agent added shall be used to control the spread of dust and fibres during the

removal of the asbestos-containing materials.

Each side of each entrance or exit from the work area(s) must be fitted with curtains constructed of

polyethylene sheeting.

A decontamination facility, as described in O. Reg. 278/05 (as amended) shall be located as close as

practicable to the work area(s). The facility should consist of three rooms arranged in sequence and

constructed so as to prevent the spread of asbestos-containing dust. The rooms shall be separated with

curtains of polyethylene sheeting fitted to each side of the entrance or exit to each room. Each worker

shall enter the facility when leaving the work area(s) and decontaminate his or herself in the order as

outline in O. Reg. 278/05 (as amended).

PERSONAL PROTECTIVE EQUIPMENT AND RESPIRATORY PROTECTION - ASBESTOS ABATEMENT:

Protective clothing shall be provided by the employer and worn by every worker who enters the work

area(s). The protective clothing shall:

1. Be made of material that does not readily retain nor permit penetration of asbestos fibres

2. Consist of head covering and full body covering that fits snugly at the ankles, wrists and neck, in

order to prevent asbestos fibres from reaching the garments and skin under the protective

clothing

3. Include suitable footwear

4. Be repaired or replaced if torn

The employer shall provide every worker who will enter the work area(s) with a NIOSH approved

respirator in accordance with the general requirements for respirators outlined in Section 13 and Table

2 of O. Reg. 278/05 (as amended) and the worker shall wear and use the respirator.

SPECIFIC MEASURES AND PROCEEDURES FOR PROJECT - SILICA ABATEMENT:

The generation of silica-containing airborne dust should be controlled by thoroughly wetting the area

prior to and during the drilling or cutting operations and during the loading, scraping or moving.

PERSONAL PROTECTIVE EQUIPMENT AND RESPIRATORY PROTECTION - SILICA ABATEMENT:

A NIOSH approved respirator for Type 2 silica operations in accordance with respirator requirements as

outlined in Table 1: Respirator Requirement of Guideline – Silica on Construction Projects.

WASTE TRANSPORT AND DISPOSAL

Conform to requirements outlined in Ontario Regulation 347 – General – Waste Management (as

amended) for waste management, transporting and disposal of hazardous waste.

Ensure shipment of containers to dump is taken by waste hauler licensed to transport hazardous waste.

Retain receipt of disposal and submit to owner as proof of disposal.

PROJECT CLOSEOUT

Polyethylene sheeting, seals, tape, cleaning material, clothing, and other contaminated waste is to be

disposed of in waste containers suitable for the type of waste, impervious to the waste intended for and

clearly identified and included for hazardous waste.

The contractor is to conduct a final visual inspection of the work area(s) to ensure all types of dust or

debris is not visually evident.
