In addition to the EPBC Act, petroleum resource<br />

exploration and exploitation is also governed<br />

by the Commonwealth Offshore Petroleum and<br />

Greenhouse Gas Storage (OPGGS) Act 2006. This<br />

legislation and associated regulations provide a<br />

framework for the development and operation of<br />

environment plans for offshore petroleum activity.<br />

The OPGGS (Environment) Regulations 2009 aim to<br />

ensure that offshore petroleum activity is carried<br />

out in a manner consistent with the principles of<br />

ecologically sustainable development and that<br />

the development of an environment plan has<br />

appropriate environmental performance objectives<br />

and standards, measurement criteria to assess the<br />

plan’s performance, an implementation strategy<br />

and reporting arrangements.<br />

The environment plans required by the regulations<br />

must describe the existing environment that may<br />

be affected by the activity, as well as any relevant<br />

cultural, social and economic aspects of the<br />

environment that may be affected. This involves<br />

details of the particular relevant values and<br />

sensitivities of that environment, the environmental<br />

impacts and risks for the activity and an evaluation<br />

of all the impacts and risks.<br />

Plans are submitted to the appropriate regulatory<br />

body for approval. There is no formal system for<br />

public consultation on environment plans, although<br />

each plan must include details of any consultation<br />

undertaken. However, who is consulted and when<br />

they are consulted is at the discretion of the plan’s<br />

author. Only once a plan has been approved is a<br />

summary submitted for public disclosure, but not<br />

public comment.<br />
