it co-chairs the <strong>National</strong> Protection Working Group,<br />
under whose auspices the policy was developed.<br />
In Nepal, the <strong>National</strong> Human Rights Commission<br />
(NHRC) was established in 2000 as an independent<br />
and au<strong>to</strong>nomous constitutional body. 45 According <strong>to</strong><br />
the NHRC, “Since the Commission has significant responsibility<br />
<strong>to</strong> work for the guarantee of the rights of<br />
IDPs, the issues of the IDPs are taken with the highest<br />
priority.” 46 A specified person within the Protection and<br />
Moni<strong>to</strong>ring Division is the IDP focal point, whose “objective<br />
[is] <strong>to</strong> pay attention <strong>to</strong>wards the protection and<br />
promotion of human rights of IDPs.” 47<br />
The Comprehensive Peace Accord (CPA) mandates<br />
the NHRC <strong>to</strong> moni<strong>to</strong>r the government’s adherence<br />
<strong>to</strong> its human rights commitments under the accord. 48<br />
The commission investigates incidents of human rights<br />
violations, 49 moni<strong>to</strong>rs and reports on IDP conditions,<br />
coordinates with NGOs and INGOs, moni<strong>to</strong>rs the activity<br />
of government authorities working on IDP issues,<br />
reports on implementation of national laws and policies<br />
on IDP issues, and conducts public awareness campaigns.<br />
In 2008, NHRC published a pamphlet <strong>to</strong> educate<br />
the public on IDPs and the government’s response. 50 A<br />
national seminar on national IDP policy was organized<br />
by the NHRC in July 2008. 51<br />

The United Nations has recognized and contributed <strong>to</strong><br />
the important work of the NHRC. In 2004 the commission<br />
was the subject of two separate agreements on capacity<br />
development between the government of Nepal<br />
and United Nations Development Programme and the<br />
Office of the High Commissioner for Human Rights. 52<br />
The government of Nepal also has publicly recognized<br />
the UN’s support for strengthening the NHRC as well<br />
as the commission’s work in protecting and promoting<br />
human rights in Nepal. Speaking in 2005, Ramesh Nath<br />
Pandey, the Minister for Foreign Affairs and leader of<br />
the Nepalese delegation <strong>to</strong> the UN, addressed the sixtyfirst<br />
session of the UN Commission on Human Rights<br />
in Geneva, stating:<br />
Equally important is HMG’s [His Majesty’s<br />
Government’s] commitment <strong>to</strong> strengthen<br />
the independence of <strong>National</strong> Human Rights<br />
Commission, an independent statu<strong>to</strong>ry body, <strong>to</strong><br />
carry out its mandated tasks of promoting and<br />
protecting human rights, including investigations<br />
and moni<strong>to</strong>ring the cases of human rights<br />
violations. We are committed <strong>to</strong> ensuring its<br />
independence, impartiality and continuity. We<br />
firmly believe that the Commission plays a significant<br />
and constructive role in the protection<br />
and promotion of human rights of the people. 53<br />
The NHRC seems <strong>to</strong> have significant potential <strong>to</strong> carry<br />
out its IDP-related activities. The government allocates<br />
money and resources <strong>to</strong> the NHRC, but most funds and<br />
