The Andalusian Team Championship 1st and 2nd

category will take place in December 2024, this time in

the city of Mijas. This event brings together the best

padel teams from all over Andalusia. The 1st category

features the most experienced teams, while the 2nd

category features the clubs that aspire to move up in

the competitive level of regional padel.

Championships

The 1st and 2nd category Andalusian Junior Team

Championships will be held from the 13th to the 15th of

December at the prestigious Nueva Alcántara Club in

Marbella. An important platform for young players

looking to excel in the world of competitive padel and

an excellent opportunity to follow closely the

development of the future talents of Andalusian padel.

Costa del Sol Charity Tournament

Every year, players and spectators come together at

this annual event to raise funds in support of various

charitable causes, attracting both local players and

visitors looking to contribute to a good cause while

enjoying their passion for padel. It also has a festive

atmosphere full of parallel activities such as concerts,

padel exhibitions and workshops for children.

U-18 Andalusian Championship

The U-18 Andalusian Championship is one of the most

exciting events for junior padel in the region. It takes

place in various clubs on the Costa del Sol and brings

together young talents looking to make a name for

themselves at a professional level. It is attended by

numerous coaches and scouts.

LAPI League 2025 (October 2024 - April 2025)

The LAPI League 2025 is a long term event that runs

from October 2024 to April 2025. One of the most

anticipated on the regional padel calendar. Teams of

between 9 and 15 players compete each weekend,

playing three matches per match. The league offers the

flexibility of choosing a host club, which facilitates

training and matches for the teams.

THE EARNEST

MONEY CONTRACT:

HOW TO PROTECT YOUR

INVESTMENT WHEN BUYING A

PROPERTY IN SPAIN.

The earnest money contract is an essential agreement

in the sale and purchase of property in Spain, as it acts

as a guarantee in the transaction and protects the

interests of both buyer and seller. By signing this

contract, a reservation on the property is established,

securing the intention to purchase by the payment of a

percentage of the total price, usually between 5% and

10%. This deposit serves as a guarantee while the buyer

carries out fundamental steps such as obtaining

financing and legal verifications of the property.

Types of deposit contract in Spain

In the context of Spanish law, there are three types of

earnest money contract, each with distinct legal

implications that affect the rights and obligations of the

parties in the event of non-performance. These are: arras

confirmatorias, arras penales and arras penitenciales.

1. Confirmatory Deposits: This type of contract

expresses a firm commitment between the parties to

carry out the sale. It does not allow the agreement to be

withdrawn without consequences. In the event that one

of the parties defaults, the other party may demand

performance of the contract or terminate the

agreement, requesting compensation for the damage

caused. This implies that the confirmatory deposit

ensures the seriousness of the transaction and the

intention of both parties to fulfil the contract.

2. Penalty Deposits: This type of deposit acts as a

penalty in the event of non-performance. In the event

that the seller decides not to go ahead with the

transaction, he must return to the buyer double the

amount paid as earnest money. On the other hand, if it

is the buyer who defaults, he will forfeit the amount

paid as a penalty. In this case, the earnest money

contract may also include a specific penalty clause,

detailing the amount to be paid as compensation if

either party defaults. This type of earnest money offers

additional protection and, to some extent, may

discourage non-performance.

3. Penitential Deposits: Penitential Deposits are

explicitly regulated in the Spanish Civil Code and allow

either party to withdraw from the transaction without

the need to justify the decision. However, this freedom

to withdraw entails a financial penalty: if the buyer

decides not to go ahead, he will lose the amount paid;

if the seller withdraws, he must return to the buyer

double the amount received. This type of deposit offers

more flexibility to both parties, especially when there

are doubts about the viability of the transaction.

Essential aspects in the drafting

of a deposit contract

For the earnest money contract to offer the expected

security, it is crucial that it is drafted with precision. It

must include key details such as the purchase price, the

amount of the deposit, the deadline for signing the

deed and the legal consequences in case of noncompliance.

These elements are fundamental to avoid

misunderstandings and to ensure that the obligations of

both parties are clearly established.

It is also advisable to check the legal status of the

property. This review involves verifying in the Land

Registry that the property is free of encumbrances, liens

or other encumbrances, and that the seller is indeed the

owner. This prior analysis helps to minimise legal risks

and avoids unpleasant surprises during the process.

Distribution of the expenses associated

with the purchase-sale

In Spain, there is a traditional distribution of the costs

associated with the sale. Usually, the buyer assumes the

notary and registry fees, while the seller covers the

municipal capital gains tax. It is important to mention

these agreements in the earnest money contract to avoid

future conflicts. In addition, the buyer should be informed

about other expenses and taxes arising from the

transaction, such as Transfer Tax (ITP) or VAT, as well as

other costs associated with the formalisation of the sale.

Additional clauses:

Withdrawal and suspensive conditions

In some cases, it may be convenient to include clauses

that allow withdrawal without penalty, especially if the

buyer is unable to obtain the necessary financing. For

example, a suspensive clause conditional on the

approval of a mortgage allows the buyer to withdraw

from the contract without forfeiting the amount paid if

the financing is not secured. These clauses should be

clearly stated in the contract to ensure that both parties

understand their rights and obligations.

Risks and recommendations for

effective protection

Although the earnest money contract provides security,

it also involves certain risks. The buyer may lose the

deposit if he decides not to proceed with the transaction

without a valid reason, and the seller may have to

compensate the buyer with double the amount received

if he decides to withdraw from the transaction.
