remplissent intégralement les exigences <strong>de</strong> l'Ordonnance sur la publicité <strong>de</strong>s médicaments (RS 812.212.5).<br />

Art. 6 Publicité informative<br />
Toute publicité doit <strong>com</strong>porter au moins:<br />
a. le nom <strong>de</strong> la préparation (marque);<br />
b. les principes actifs avec leur abréviation (DCI/INN ou la désignation <strong>de</strong> la <strong>de</strong>rnière édition <strong>de</strong> la Pharmacopée; à défaut,<br />
d’autres abréviations généralement reconnues <strong>et</strong> approuvées par l’institut);<br />
c. le nom <strong>et</strong> l’adresse du titulaire <strong>de</strong> l’autorisation;<br />
d. au moins une indication ou une possibilité d’emploi ainsi que la posologie <strong>et</strong> le mo<strong>de</strong> d’administration;<br />

1 CHAMP D’APPLICATION<br />
Les conditions suivantes régissent les relations entre<br />
<strong>Galexis</strong> SA (ci-après <strong>Galexis</strong>) <strong>et</strong> ses fournisseurs concernant<br />
l’insertion d’<strong>instruments</strong> <strong>de</strong> <strong>promotion</strong> <strong>de</strong>s <strong>ventes</strong><br />
dans les médias imprimés <strong>et</strong> électroniques <strong>de</strong> <strong>Galexis</strong>. Par<br />
sa confirmation <strong>de</strong> <strong>com</strong>man<strong>de</strong> à <strong>Galexis</strong>, le fournisseur<br />
accepte expressément les conditions générales relatives<br />
aux <strong>instruments</strong> <strong>de</strong> <strong>promotion</strong> <strong>de</strong>s <strong>ventes</strong> qui font partie<br />
intégrante du contrat.<br />
2 DÉFINITION<br />
L’insertion d’<strong>instruments</strong> <strong>de</strong> <strong>promotion</strong> <strong>de</strong>s <strong>ventes</strong> dans<br />
les médias imprimés <strong>et</strong> électroniques <strong>de</strong> <strong>Galexis</strong> a pour<br />
objectif d’encourager la vente <strong>de</strong>s produits par l’intermédiaire<br />
<strong>de</strong>s clients <strong>de</strong> <strong>Galexis</strong> ainsi que d’ai<strong>de</strong>r les fournisseurs<br />
à m<strong>et</strong>tre en place leurs mesures <strong>de</strong> mark<strong>et</strong>ing <strong>et</strong> <strong>de</strong><br />
<strong>promotion</strong> <strong>de</strong>s <strong>ventes</strong>.<br />
3 ORDONNANCE SUR LA PUBLICITÉ DES<br />
MÉDICAMENTS (OPM)<br />
Par sa <strong>com</strong>man<strong>de</strong> à <strong>Galexis</strong>, le fournisseur confirme qu’en<br />
cas <strong>de</strong> publicité pour les médicaments, tous les éléments<br />
<strong>publicitaires</strong> remplissent intégralement les exigences <strong>de</strong><br />
l’Ordonnance sur la publicité <strong>de</strong>s médicaments (OMS, SR<br />
812.212.5).<br />
4 RESPONSABILITÉ<br />
<strong>Galexis</strong> est responsable<br />
_en cas <strong>de</strong> réclamation justifiée portant sur les <strong>instruments</strong><br />
<strong>de</strong> vente insérés, si le fournisseur l’a adressée à<br />
<strong>Galexis</strong> par écrit dans les 15 jours ouvrés suivant la parution<br />
dans les médias imprimés ou électroniques. Des divergences<br />
<strong>de</strong> couleur mineurs ne sont pas considérées<br />
<strong>com</strong>me <strong>de</strong>s défauts.<br />
_dans tous les cas, à hauteur <strong>de</strong> la valeur maximum <strong>de</strong> la<br />
<strong>com</strong>man<strong>de</strong> <strong>de</strong> chaque insertion. Toute autre prétention en<br />
responsabilité envers <strong>Galexis</strong> <strong>de</strong> la part du fournisseur est<br />
exclue.<br />
<strong>Galexis</strong> n’est pas responsable<br />
_en cas <strong>de</strong> réclamation portant sur les <strong>instruments</strong> <strong>de</strong> <strong>promotion</strong><br />
<strong>de</strong>s <strong>ventes</strong> insérés que le fournisseur a adressée à<br />
<strong>Galexis</strong> au-<strong>de</strong>là <strong>de</strong> 15 jours ouvrés suivant la parution dans<br />
les médias imprimés <strong>et</strong> électroniques.<br />
_<strong>de</strong> l’exactitu<strong>de</strong> ni du contenu <strong>de</strong>s pièces jointes <strong>et</strong> <strong>de</strong>s<br />
annonces venant <strong>de</strong> tiers ou <strong>de</strong>s textes <strong>com</strong>plémentaires<br />
venant <strong>de</strong> tiers dans ses médias imprimés <strong>et</strong> électroniques.<br />
Le fournisseur est l’unique responsable dans ces<br />
cas-là. Le fournisseur s’engage à donner <strong>de</strong>s informations<br />
conformes à la vérité.<br />

5 ANNULATION<br />
<strong>Galexis</strong> ou le fournisseur peuvent à tout moment annuler la<br />
<strong>com</strong>man<strong>de</strong> que le fournisseur a passée auprès <strong>de</strong> <strong>Galexis</strong><br />
avant que l’annonce ne paraisse. Si le fournisseur annule<br />
sa <strong>com</strong>man<strong>de</strong>, <strong>Galexis</strong> se réserve le droit <strong>de</strong> facturer 20 %<br />
du montant <strong>de</strong> l’insertion en cas d’annulation après la clôture<br />
du délai d’insertion, 50 % après la clôture du délai<br />
d’acceptation <strong>de</strong>s données <strong>et</strong> 100 % après l’impression.<br />
6 PUBLICATION DES DÉSIGNATIONS D’ARTICLES<br />
Les désignations d’articles publiées dans les <strong>instruments</strong><br />
<strong>de</strong> <strong>promotion</strong> <strong>de</strong>s <strong>ventes</strong> sont conformes au marché. Les<br />
désignations d’articles sont automatiquement reprises par<br />
le système <strong>de</strong> <strong>Galexis</strong> dans les différents <strong>instruments</strong> <strong>de</strong><br />
<strong>promotion</strong> <strong>de</strong>s <strong>ventes</strong> <strong>et</strong> sont i<strong>de</strong>ntiques aux désignations<br />
d’articles provenant <strong>de</strong> l’indice <strong>de</strong>s bases <strong>de</strong> données <strong>de</strong><br />
produits (autrefois la base <strong>de</strong> données Galdat) <strong>de</strong> la société<br />
e-mediat SA. En cas <strong>de</strong> modification <strong>de</strong>s désignations<br />
d’articles, le fournisseur doit s’adresser exclusivement<br />
à la société e-mediat SA. <strong>Galexis</strong> ne procè<strong>de</strong> à aucune<br />
modification <strong>de</strong>s désignations d’articles. Si le fournisseur<br />
<strong>de</strong>man<strong>de</strong> à e-mediat SA <strong>de</strong> modifier une désignation<br />
d’article, il peut s’écouler sept jours ouvrés avant que<br />
la modification soit effective dans le système <strong>de</strong> <strong>Galexis</strong>.<br />
Avant l’expiration <strong>de</strong> ce délai, <strong>Galexis</strong> n’octroie pas <strong>de</strong> garantie<br />
pour la reprise <strong>de</strong>s désignations d’articles éventuellement<br />
modifiées dans l’instrument <strong>de</strong> <strong>promotion</strong> <strong>de</strong>s<br />
<strong>ventes</strong> défini selon le contrat.
FICHE CONCERNANT<br />
LES MODIFICATIONS DES DÉSIGNATIONS D’ARTICLES POUR LES<br />
INSTRUMENTS DE PROMOTION DES VENTES (VFI)<br />
Pour les offres figurant dans les <strong>instruments</strong> <strong>de</strong> <strong>promotion</strong><br />
<strong>de</strong>s <strong>ventes</strong> (ci-après VFI), <strong>Galexis</strong> fait ca<strong>de</strong>au <strong>de</strong> la conception<br />
graphique à ses fournisseurs. <strong>Galexis</strong> veille à ce que<br />
toutes les offres fournisseurs paraissent <strong>de</strong> manière claire<br />
<strong>et</strong> uniforme pour les clients.<br />
La désignation <strong>de</strong>s articles <strong>de</strong>s produits fait également partie<br />
<strong>de</strong> c<strong>et</strong>te offre gratuite. <strong>Galexis</strong> s’appuie sur les désignations<br />
conformes au marché <strong>de</strong> e-mediat (Galdat/produits<br />
in<strong>de</strong>xés). Elles <strong>com</strong>portent 50 caractères <strong>et</strong> sont définies<br />
par e-mediat sur ordre <strong>de</strong>s fournisseurs, mais dans le respect<br />
<strong>de</strong>s critères scientifiques/logistiques <strong>et</strong> <strong>de</strong>s directives.<br />
Les différents groupes concernés utilisent ces désignations<br />
d’articles mises à jour <strong>de</strong> manière centralisée à tous les<br />
niveaux <strong>com</strong>merciaux du marché suisse <strong>de</strong> la santé, indépendamment<br />
<strong>de</strong>s supports médias.<br />
Pour les raisons évoquées ci-<strong>de</strong>ssus, <strong>Galexis</strong> ne peut accepter<br />
aucune <strong>de</strong>man<strong>de</strong> <strong>de</strong> corrections <strong>de</strong>s désignations d’articles<br />
dans ses publications imprimées.<br />
Concernant les textes <strong>de</strong>s désignations d’articles figurant<br />
dans les VFI, il convient <strong>de</strong> veiller aux <strong>de</strong>ux points suivants:<br />
_ Le public cible <strong>de</strong>s VFI <strong>de</strong> <strong>Galexis</strong> se concentre uniquement<br />
sur le <strong>com</strong>merce spécialisé, c’est-à-dire qu’il<br />

dans tous le processus simplifie le travail <strong>de</strong> vos clients.<br />
Ils peuvent ainsi r<strong>et</strong>rouver <strong>et</strong> reconnaître les articles qu’ils<br />
recherchent dans tous les médias spécialisés <strong>de</strong> manière<br />
efficace. <strong>Galexis</strong> garantit c<strong>et</strong>te sécurité au client en utilisant<br />
les mêmes désignations dans tous les points <strong>de</strong><br />
contact, <strong>de</strong> la publicité à la facturation.<br />
_ Les fournisseurs <strong>de</strong> <strong>Galexis</strong> ont le choix<br />
Les dispositions en vigueur dans les CG <strong>de</strong>s VFI (chiffre<br />
6) ne s’appliquent aux fournisseurs que si ceux-ci ont recours<br />
à la conception gratuite <strong>de</strong> <strong>Galexis</strong>. Les fournisseurs<br />
sont libres <strong>de</strong> publier leurs offres avec la présentation <strong>et</strong><br />
la terminologie qu’ils souhaitent sous forme d’annonces<br />
qu’ils conçoivent eux-mêmes ou dans <strong>de</strong>s suppléments<br />
paraissant dans nos publications imprimées. Ils trouveront<br />
les conditions cadres à ce suj<strong>et</strong> dans les CG VFI annexées.<br />
Modifications <strong>de</strong>s désignations d’articles dans les VFI<br />
<strong>de</strong> <strong>Galexis</strong><br />
Pour les nouveaux enregistrements ou les modifications <strong>de</strong><br />
produits, les fournisseurs doivent s’adresser exclusivement<br />
Explications <strong>de</strong> la procédure pour les fournisseurs<br />
à e-mediat ou à APF en suivant la procédure suivante. Ceci<br />
perm<strong>et</strong> <strong>de</strong> garantir que les corrections sont effectuées dans<br />
toutes les applications <strong>et</strong> dans tous les médias. Les fournisseurs<br />
peuvent vérifier les désignations d’articles en <strong>de</strong>mandant<br />
une liste <strong>com</strong>plète <strong>de</strong>s articles incluant la désignation<br />
<strong>de</strong>s marques par e-mail à e-mediat ou APF. Il convient <strong>de</strong> noter<br />
que le traitement <strong>de</strong>s modifications peut prendre jusqu’à<br />
sept jours avant d’apparaître dans les VFI <strong>de</strong> <strong>Galexis</strong>.<br />
Modifications <strong>de</strong>s désignations d’articles <strong>de</strong> la part<br />
d’e-mediat<br />
E-mediat confirme par écrit les nouveaux enregistrements<br />
d’articles <strong>de</strong>s fournisseurs. Sans autre information du fournisseur,<br />
l’article est définitivement enregistré. Plus tard, le<br />
fournisseur peut apporter les modifications suivantes aux<br />
articles enregistrés: <strong>com</strong>plément <strong>de</strong>s propriétés <strong>de</strong>s articles<br />
(par ex. «stérile», «vert»), mise à jour ou uniformisation<br />
<strong>de</strong>s désignations <strong>de</strong>s marques, ainsi que corrections <strong>de</strong>s<br />
fautes <strong>de</strong> frappe. Pour les modifications plus générales <strong>et</strong><br />
fondées d’un point <strong>de</strong> vue scientifique/logistique, e-mediat<br />
ouvre un nouveau pharmaco<strong>de</strong>. Celui-ci est relié à l’ancien<br />
pharmaco<strong>de</strong> afin <strong>de</strong> garantir au prestataire <strong>de</strong> services qu’il<br />
va le r<strong>et</strong>rouver.<br />
Le fournisseur envoie les <strong>de</strong>man<strong>de</strong>s <strong>de</strong> modification <strong>de</strong>s<br />
désignations d’articles directement à e-mediat (hotline@emediat.n<strong>et</strong>).<br />
C<strong>et</strong>te <strong>de</strong>rnière confirme par écrit les éventuelles<br />
corrections au fournisseur avec copie à l’équipe VFI<br />
<strong>de</strong> <strong>Galexis</strong>. <strong>Galexis</strong> garantit la modification effectuée par<br />
e-mediat pour l’insertion réservée jusqu’à 7 jours avant la<br />
date d’impression. Le fournisseur se renseigne auprès d’emediat<br />
s’il souhaite d’autres informations.<br />
Modifications <strong>de</strong>s désignations d’articles par APF<br />
Les données <strong>de</strong> base <strong>de</strong>s articles <strong>de</strong> cosmétique <strong>et</strong> <strong>de</strong> parfumerie<br />
sont gérés par APF dans le mon<strong>de</strong> entier. Le fournisseur<br />
envoie les nouveaux enregistrements ou les <strong>de</strong>man<strong>de</strong>s<br />
<strong>de</strong> modifications par e-mail à APF à ina.mueller@allperfumefacts.<strong>com</strong>.<br />
Une fois que la correction est effectuée, APF m<strong>et</strong><br />
les données à disposition via une interface. Ceci signifie que<br />
la base d’article d’APF valable dans toute la Suisse figure<br />
dans Galdat/les produits in<strong>de</strong>xés. Le fournisseur envoie les<br />
modifications qui doivent être rapi<strong>de</strong>ment effectuées dans<br />
un VFI <strong>de</strong> <strong>Galexis</strong> par copie à e-mediat (marina.kessler@emediat.n<strong>et</strong>)<br />
<strong>et</strong> à <strong>Galexis</strong> (vfi@galexis.<strong>com</strong>).<br />
Important: En cas <strong>de</strong> modification, il convient <strong>de</strong> <strong>de</strong>man<strong>de</strong>r<br />
une confirmation d’APF <strong>de</strong> manière explicite.<br />
