GENERAL TERMS AND CONDITIONS OF SALE
OFFERS
Offers have a 30 days validity from their issue date. When this period of time expires without having received the relative order, Spath Italy has the right to consider the quotation as annulled.
ORDERS
Orders are binding and irrevocable after 7 days from the order’s reception. If the customer declines the supply after this time frame, he is required to either pay 30% of the supply amount
or pick up the goods.
DELIVERIES
Delivery times are approximate and they have to be considered in working days. Spath Italy shall not be held accountable for any delay due to causes that are beyond its control.
Deliveries are considered to be carried out with the notification that goods have been picked up by the courier to be transported to their destination. From this moment on, the buyer shall
bear all risks and relative expenses.
SHIPPING
Goods are supplied ex – works, therefore warehousing and transportation costs are on the buyer. Goods sent to Spath Italy must be free of charge, otherwise they will not be accepted.
Claims for any kind of damage that could be occurred during transportation have to be presented to the courier. If goods are delivered to a buyer’s representative, the buyer shall bear all risks.
PRICES
Spath Italy has the right to adjust already decided prices any time in the event of particular occurrences that are beyond Spath Italy’ control. Prices are quoted ex- works, unless otherwise
agreed. Prices for special wheels, which are not part of Spath Italy’ standard products, will be set from time to time. Prices of such wheels are not related to those of standard wheels, even
if they have similar features and sizes.
PAYMENT
Payments will be considered effective only if made according to Spath Italy’ decided guidelines. Different guidelines have to be agreed upon every time. Delays in payment will be ground for
immediate loss of the possible agreed discount or start of bank interest entitlement with an additional cost of 3%. No power of attorney is granted to Agents, Commissioners, and Middlemen.
Anything arranged by them has to be considered as unilaterally binding, absolving Spath Italy from any responsibility.
WARRANTY
Under the assumption that payment terms and conditions are respected, Spath Italy provides the customer with a 24 month warranty from the date of shipment. The warranty covers manufacturing
mistakes and faulty material. This warranty does not apply if the product has been altered, mounted differently from how instructed, used for purposes which it has not been designed for,
or repaired without Spath Italy’ approval. Should the wheel be defective, claims must be submitted within 8 days from when the flaw first appeared. Defective wheels have to be shipped to Spath
Italy’ factory, carriage paid and free of any equipment. After being inspected, wheels which turn out to be defective will be fixed or replaced. Wheels that have been replaced will become Spath
Italy’ property. Products repaired under warranty will be returned to the customer for free. Shipping costs for wheels which are not under warranty, and possible expenses related to mounting
and dismantling the wheel on the car will not be paid by Spath Italy. Defective products sent to Spath Italy without its approval will be returned to the customer.
DISPUTES
Any controversy, including those connected to any other lawsuit placed under others Judicial Authorities, will be exclusive jurisdiction of the Court of Justice of Bergamo.
IMPORTANT NOTICE:
Before mounting the tyre on the wheel, carefully check whether the wheel perfectly fits and properly turns on the car hub.
