volgens John Stuart Mill tot vooruitgang<br />
– van kennis. Volgens hem kunnen<br />
ook onjuiste opvattingen daarbij<br />
een positieve rol spelen. Deze bijdrage<br />
onderzoekt de vraag in hoeverre<br />
de argumentatie van Mill ook ziet op<br />
onjuiste uitlatingen van feitelijke<br />
aard en in hoeverre zijn benadering<br />
is terug te vinden in het geldend<br />
recht van de VS, Duitsland en onder<br />

Het Hof van Justitie en de<br />
bescherming van de handelsagent:<br />
over voorrangsregels, dwingende<br />
bepalingen en openbare orde<br />
– In 2000 heeft het Hof van Justitie<br />
van de Europese Unie (HvJ) in het<br />
arrest Ingmar geoordeeld dat de artt.<br />
17-19 van de Handelsagentuurrichtlijn<br />
hebben te gelden als bepalingen<br />
van dwingend recht. Zelden is een<br />
arrest zo eenstemmig in de literatuur<br />
bekritiseerd; de kritiek was<br />
vooral gericht op de door het HvJ<br />
gehanteerde redenering. In het arrest<br />
Unamar werd het HvJ verzocht zich<br />
uit te laten over de toepassing van de<br />
op de Handelsagentuurrichtlijn gebaseerde<br />
bepalingen van nationaal<br />
recht als voorrangsregels in de zin<br />
van art. 7 EVO (thans art. 9 Rome I).<br />
Deze bijdrage grijpt de beslissing in<br />
Unamar aan om enkele onderwerpen<br />
op het terrein van voorrangsregels<br />
aan de orde te stellen. In de eerste<br />
plaats wordt bezien hoe de beslissing<br />
in Unamar zich verhoudt tot de<br />
beslissing in Ingmar en in hoeverre<br />
het HvJ van de gelegenheid heeft<br />
gebruikgemaakt Ingmar te verduidelijken.<br />
Daartoe worden Ingmar en<br />
Unamar uiteengezet en besproken.<br />

Towards the reform of the European<br />
Insolvency Regulatio: codification<br />
rather than modification<br />
– The European Insolvency Regulation<br />
has largely succeeded in providing<br />
a framework for cross-border<br />
insolvency. But after serving for more<br />
than a decade, the time is ripe to<br />
give it a ‘new facelift’, as suggested by<br />
mrs. Viviane Reding. This paper provides<br />
a critical overview of the Proposal<br />
amending the Regulation<br />
issued by the European Commission<br />
on 12 December 2012. While its<br />
inputs are backed up by a broad consensus<br />
as it mostly reflects developments<br />
in national insolvency laws<br />
and codifies the Court of Justice of<br />
the European Union’s case law, the<br />
Proposal is a missed opportunity to<br />
modify some rules which do not properly<br />
contribute in their current wording<br />
to achieving the insolvency proceedings’<br />
goals. This is particularly<br />
remarkable in view of the extension<br />
of the Regulation’s scope of application<br />
to include proceedings with reorganization,<br />
adjustment of debt or<br />
rescue purpose and hence, aiming to<br />
enhance their cross-border effects<br />

of whether there is a<br />
need to ‘update’ or revise<br />
the current immunity<br />

– Author presents a brief overview of<br />
the work of the International Law<br />
Commission (ILC) over a period of<br />
thirty years. In 1992, the ILC decided<br />
to discontinue its work on this topic:<br />
this paper outlines the main reasons<br />
given by the ILC for this decision,<br />
and draws some conclusions from<br />
the work of the ILC in this area.<br />

enjoy immunity under customary<br />
international law?<br />
– Author considers whether there is<br />
a ‘general practice accepted as law’<br />
establishing rules of customary international<br />
law on the immunity of<br />
international organizations from the<br />
jurisdiction of domestic courts. This<br />
article sketches the historical development<br />
of the immunity of international<br />
organizations since the nineteenth<br />
century, describes various<br />
approaches that have been suggested<br />
to this question, and sets out such<br />
practice as there is and academis<br />
consideration of that practice. It then<br />
considers whether practice has to<br />
date generated and rules of customary<br />
international law regarding immunities,<br />
and finally suggests some conclusions.<br />

In Should the 2004 UN State<br />
Immunity Convention serve as a<br />
model/starting point for a future<br />
UN Convention on the immunity of<br />
international organizations?<br />
– Author argues that the ‘2004 United<br />
Nations Convention on Jurisdictional<br />
Immunities of States and their<br />
Property’ should not serve as a<br />
model for a new convention with<br />
regard to international organizations.<br />
However, this paper contends that<br />
each of these reasons does not overcome<br />
the problems of principle, practice<br />
and precedent. The immunities<br />
afforded to State officials may have<br />
greater value as a model for the<br />
immunities of officials of international<br />
organizations.<br />
