C<br />
omo um bom brasileiro, vez por outra sucumbo à tentação de<br />
também achar que Deus é brasileiro. Ainda mais quan<strong>do</strong> tenho<br />
oportunidades de viajar por este imenso país e descobrir suas belezas<br />
naturais, muitas delas ocultas por enormes distâncias. Mas quan<strong>do</strong><br />
penso na Suíça e em to<strong>do</strong>s os seus recantos que conheci em minhas<br />
várias visitas àquele país, confesso minha impressão de que aquele<br />
é o país que Ele escolheu para seu dia de descanso – e também<br />
para seus fins de semana e feriadões...<br />
Muito já se disse e se escreveu sobre as características da natureza<br />
naquele país, certamente um <strong>do</strong>s maiores campeões de suspiros de<br />
admiração por metro quadra<strong>do</strong> no planeta. Um país que ostenta<br />
belezas ímpares geradas pelas combinações singulares da majestade<br />
<strong>do</strong>s Alpes, <strong>do</strong>s muitos lagos de águas límpidas e convidativas, <strong>do</strong><br />
histórico Rhein.<br />
Mas o prazer de desfrutar as espetaculares visões da natureza no país<br />
é ainda mais realça<strong>do</strong> ao se observar os resulta<strong>do</strong>s <strong>do</strong>s esforços que<br />
os habitantes <strong>do</strong> país têm feito para possibilitar o acesso a tantas<br />
maravilhas e o desfrute deste paraíso. Pois estamos sempre cerca<strong>do</strong>s<br />
de feitos e realizações de uma população quase que obcecada pela<br />
precisão, perfeição até nos ínfimos detalhes, qualidade e harmonia.<br />
Assim é a Suíça, no coração da Europa. Sempre com bandeiras de seus<br />
Cantões ornamentan<strong>do</strong> praças, ruas e fachadas. Tantas são elas que é<br />
comum se perceber um ar de celebração, de festas em to<strong>do</strong>s os dias da<br />
semana e em todas as cidades e povoa<strong>do</strong>s. Seus nativos cultivaram<br />
através <strong>do</strong>s tempos as habilidades para transformar as irregularidades<br />
de seu solo em verdadeiros paraísos, com miríades de opções de<br />
lazer, esportes, aventuras que conseguem agradar e satisfazer as<br />
mais diversas expectativas.<br />
Além <strong>do</strong> fácil acesso para o brasileiro através de vôos diários para Zurique,<br />
a rede de transportes no país é formada por uma complexa e admirável<br />
combinação de trens, ônibus, bondes, barcos, teleféricos e eleva<strong>do</strong>res<br />
de fácil uso. Esta malha torna o acesso às localidades e aos inúmeros<br />
centros de turismo e lazer uma fonte de prazer. O transporte ferroviário<br />
suíço desenvolveu-se por mais de 150 anos para criar uma densa<br />
rede, que oferece transporte e viagens de alta qualidade. Aliás, não<br />
há outro país da Europa com um uso tão freqüente e intenso de trens<br />
como na Suíça. Os transportes urbanos e as inúmeras linhas de<br />
ônibus e de barcos regionais complementam a oferta de transporte<br />
e atingem quase to<strong>do</strong>s os pontos <strong>do</strong> país.<br />

ike any good Brazilian, sometimes I succumb to the temptation to<br />
think that God is a Brazilian. This is particularly so when I have<br />
the chance to travel through this immense country and discover its<br />
natural beauties, many of which are separated by enormous distances.<br />
However, when I think of Switzerland and all the areas I have come to<br />
know during my visits there I confess that it is the country which God<br />
chose for his day of rest, as well as for his weekends and holidays...<br />
Much has been said and written about Switzerland`s natural beauty,<br />
which must bring more gasps of admiration per square meter than<br />
anywhere else in the world. Its incomparable beauties are the result<br />
of the singular combination of the majesty of the Alps, the large<br />
number of lakes with clean, inviting waters and the historic Rhine.<br />
However, the pleasures of benefiting from the spectacular views of<br />
nature are intensified by observing the efforts which the Swiss have put<br />
into making so many of the marvels of this Paradise accessible. Everywhere<br />
we go we see the works of these people who are obsessed<br />
by precision, perfection to the smallest detail, quality and harmony.<br />
That is Switzerland, right in the heart of Europe, with the flags of its<br />
cantons flying everywhere – in squares, streets and facades. There are<br />
so many that they give an air of celebration, as though holidays were<br />
held every day and in every town and village. Over the ages, the Swiss<br />
have skillfully transformed the craggy features of their land into veritable<br />
paradises, with thousands of options for leisure, sports, adventures<br />
which add value to and attract the most varied expectations.<br />
Beside easy access for Brazilians, through daily flights to Zurich, the<br />
transport network is a complex, admirable combination of trains, buses,<br />
trams, boats, cable cars and lifts. This network makes it easy to get to<br />
the large number of tourist and leisure centers which are a source of<br />
pleasure. The Swiss railway system has developed over 150 years<br />
to create a dense network, providing high quality transport and trips.<br />
No other country in Europe uses trains as frequently and intensively as<br />
Switzerland. City transport and the large number of bus and regional<br />
boat routes complement the transport options and reach virtually<br />
part of the country.<br />

No ano passa<strong>do</strong>, a taxa de crescimento na Europa caiu 1%. O panorama não<br />
é melhor para 2003 e o mal-estar econômico na Alemanha aumentou o<br />

m 2002, a Europa realizou marcos importantes<br />
no rumo da integração política e<br />
econômica: a introdução <strong>do</strong> euro foi harmoniosa,<br />
e no final <strong>do</strong> ano, os líderes políticos<br />
<strong>do</strong>s 15 países membros da União Européia<br />
(UE) decidiram admitir 10 novos países em<br />
maio de 2004.<br />

comunistas da Europa Oriental. Quatorze anos<br />

Graças a uma aceleração esperada durante o<br />

o sucesso político e a realidade econômica.<br />

Europa caiu 1%. A visão não é muito clara para<br />
este ano, embora esperemos uma recuperação<br />
com início no segun<strong>do</strong> semestre de<br />
2003. A valorização <strong>do</strong> euro teve um impacto<br />
negativo nas exportações. O mal-estar econômico<br />
na Alemanha, a maior economia européia,<br />
incrementou a fragilidade. O desenvolvimento<br />
<strong>do</strong> capital <strong>do</strong>s merca<strong>do</strong>s europeus<br />
espelhou o frustrante desempenho econômico.<br />
Para compreender o eleva<strong>do</strong> potencial europeu,<br />
é necessária a reforma <strong>do</strong> merca<strong>do</strong> de trabalho<br />
que intensifica a competição. Diferentemente<br />
<strong>do</strong>s Esta<strong>do</strong>s Uni<strong>do</strong>s, a Europa não<br />
tem a praga de grandes desequilíbrios macroeconômicos.<br />
Sucesso Político<br />
Alenta e eficiente introdução física <strong>do</strong> euro no<br />
início de 2002 marca um sucesso ulterior para<br />
o merca<strong>do</strong> comum econômico europeu. Já<br />
existe sinais de que o euro está reduzin<strong>do</strong> as<br />
diferenças de preço de produtos e serviços das<br />
nações, assim como a diferença da rentabilidade<br />
nos ativos financeiros. Empresários e<br />
turistas podem por fim usar a mesma moeda<br />
em to<strong>do</strong>s os 12 países membros, o que<br />
também reduz seus custos (Reino Uni<strong>do</strong>,<br />
Dinamarca e Suécia são membros da UE, mas<br />
ainda permanecem com sua própria moeda).<br />

aumento <strong>do</strong> desemprego (atualmente 8,3% <strong>do</strong><br />
total da força de trabalho) causou a estagnação<br />
da demanda <strong>do</strong>méstica. O gasto de<br />
capital continuou a cair. As exportações ainda<br />
contribuíram muito para o escasso desempenho<br />
econômico, porém foram fortemente<br />
atingidas pela valorização <strong>do</strong> euro. Durante o<br />
último ano, a moeda comum européia valorizou<br />
8% em bases comerciais. Em comparação<br />
ao dólar, ganhou até 18%.<br />

a inflação pressionan<strong>do</strong> em torno de 1%, a<br />
política monetária é mais forte para as maiores<br />
economias da Eurolândia. A elevação <strong>do</strong>s<br />
impostos e política fiscal restritiva contribuem<br />
para o mal-estar.<br />
Enfraquecimento <strong>do</strong> Capital <strong>do</strong>s<br />
Merca<strong>do</strong>s<br />
Em 2002, as bolsas européias caíram pelo<br />
terceiro ano. Visto seu pico em março de 2000<br />
e medi<strong>do</strong> pelo Índice Europeu de Capital<br />
MSCI, a ação média perdeu 55% de seu<br />
valor no final de março de 2003. Algumas<br />
bolsas nacionais, sobretu<strong>do</strong> a alemã, com<br />

n 2002, Europe realized significant milestones<br />
on the way to political and economic<br />
integration: the introduction of Euro<br />
notes and bills went smoothly and at the end of<br />
the year, the political leaders of the 15<br />
European Union (EU) member states decided<br />
to admit 10 new countries in May 2004.<br />
Unfortunately there was a sharp contrast<br />
between the political success and the economic<br />
reality. Last year, the growth rate in<br />

half of 2003. The strengthening of the Euro<br />
had a negative impact on exports. The economic<br />
malaise in Germany, Europe’s largest<br />
economy, added to the weakness. The development<br />
of the European equity markets<br />
mirrored the disappointing economic<br />
performance.<br />
In order to realize Europe’s huge potential,<br />
labour market reforms that intensify competition<br />
are needed badly. Contrary to the US, Europe<br />
is not plagued with large macroeconomic<br />
imbalances.<br />
Political Success<br />
The smooth and efficient physical introduction<br />
of the Euro at the start of 2002 marks a<br />
further success for the common European<br />
economic market. There are already signs<br />
that the Euro is reducing national price<br />
differences of products and services as well<br />
as the difference of returns on financial<br />
assets. Business people and tourists alike<br />
are finally able to use the same currency in<br />
all 12 Euro member states, which reduces<br />
their costs as well (The UK, Denmark and<br />
Sweden are members of the EU, but still<br />
have their own currencies).<br />
The EU is likely to be enlarged by 10 new<br />
members in May 2004. With the exception<br />
of Cyprus and Malta, the candidates are all<br />

Economic Setback<br />
2002 has been a successful year for politics but<br />
a very difficult one for the economy. Although<br />
the world was much more focused on the<br />
limping American economic fortunes, Europe<br />
did even worse, growing only about half as<br />
much than the US.<br />
In Europe, the economic cycle peaked in<br />
2000, when GDP growth advanced by<br />
nearly 4%. Thereafter, the economy went<br />
from bad to worse: in 2001, growth decelerated<br />
to 1.6% and, in 2002 to 1.0%. During<br />
the last six months, the main European<br />
national economies nearly came to a standstill.<br />
Thanks to an expected acceleration<br />
during the second half of this year, growth<br />
could reach slightly over one percent in 2003.<br />

a operação de ganhos da maioria<br />
das corporações européias se mantiveram bem.<br />
Graças a várias restruturações e medidas de<br />
corte de custos, os lucros puderam aumentar<br />
bastante uma vez que se inicie a recuperação<br />
econômica.<br />
Necessário: Reformas Estruturais<br />
Nos anos futuros, o Velho Continente talvez se<br />
beneficie da recuperação econômica global<br />
liderada pelos Esta<strong>do</strong>s Uni<strong>do</strong>s. A longo prazo,<br />

geopolíticas atuais, a visão <strong>do</strong><br />
capital é construtiva<br />
entretanto, a perspectiva de uma economia<br />
européia quase totalmente dependente de<br />
eventos globais, isto é, sobretu<strong>do</strong> americanos,<br />
é muito desestimulante. Mas se a Europa<br />
deseja alcançar o poder econômico que<br />
merece devi<strong>do</strong> a seu grande tamanho e<br />
atuar um dia como uma máquina econômica<br />
mundial, reformas estruturais são necessárias<br />
urgentemente. Essas reformas não virão<br />
de graça e talvez serão muito <strong>do</strong>lorosas. No<br />
ponto central dessas etapas estão reformas<br />
trabalhistas e de merca<strong>do</strong> de produto a fim<br />
de intensificar a competição. Mais competição<br />
estimulará a produtividade, que retardará os<br />
Esta<strong>do</strong>s Uni<strong>do</strong>s. Ironicamente, o alto valor<br />
atual <strong>do</strong> euro pode ajudar a atingir esses<br />
objetivos: isto força as corporações européias<br />
a redefinir sua produção, tornan<strong>do</strong>-a mais<br />
enxuta e mais produtiva a fim de compensar<br />
o eleva<strong>do</strong> valor de sua moeda.<br />
Os pré-requisitos da Europa para atingir esses<br />
objetivos ambiciosos são bons: diferentemente<br />
<strong>do</strong>s Esta<strong>do</strong>s Uni<strong>do</strong>s, o Velho Continente<br />
não está sofren<strong>do</strong> desequilíbrios macroecônomicos,<br />
como eleva<strong>do</strong> déficit em conta-corrente<br />
<strong>do</strong> governo federal.<br />

Recessionary tendencies in large parts of the<br />
world, increasing geopolitical uncertainties as<br />
well as numerous accounting scandals, mainly<br />
in the US, have led to a loss of confidence<br />

by European consumers and businesses.<br />
Rising unemployment (currently 8.3% of the<br />
total workforce) caused <strong>do</strong>mestic demand to<br />
stagnate. Capital spending continued to fall.<br />
Exports still contributed the most to the meagre<br />
economic performance, but were badly hit<br />
by the strengthening of the Euro. During the<br />
last year, the European common currency<br />
has appreciated by 8% on a trade-weighted<br />
basis. Against the USD, it even gained 18%.<br />
Germany, the sick man of Europe<br />
The weak economic development in Germany<br />
affected the rest of Europe as well. With a<br />
population of 80 million people and a GDP of<br />
2 trillion Euros, this country accounts for<br />
almost a third of Euroland`s economy. Once<br />
a shining example of an economic fortress,<br />
Germany is now suffering under significant<br />
structural constraints, above all in its highly<br />
regulated labour market. This includes powerful<br />
unions that are responsible for rigid central<br />
wage agreements and restrictive labour<br />
practices. As a consequence, investment,<br />
innovation and growth are delayed. Germany`s<br />
labour costs are the highest in the world and it<br />
is fast losing competitiveness with its European<br />
neighbours. No wonder GDP growth is likely to<br />
remain well below the EU average (+0.4% for<br />
2003). Furthermore, with inflation hovering<br />
around 1%, monetary policy is much too tight<br />
for Euroland`s biggest economy. Rising taxes<br />
and a restrictive fiscal policy contribute to the<br />
malaise.<br />
Weakening Equity Markets<br />
In 2002, European stock markets declined for<br />
the third straight year. Since its peak in March<br />
2000, and measured by the MSCI Equity Index<br />
Europe, the average share lost 55% of its value<br />
by the end of March 2003. Some national<br />
stock markets, most notably that of Germany<br />
with a decline of nearly 70%, fared even worse.<br />
On the other hand, fixed income markets rose<br />
sharply, due to declining long-term interest<br />
rates. Yields of government bonds currently<br />
stand near record low levels.<br />
Looking beyond the current geopolitical<br />
uncertainties, the outlook for equities is<br />
constructive. Valuations are not expensive<br />
and in many cases, dividends yield of stocks<br />
exceed interest rates of government bonds.<br />
During the period of macroeconomic weakness,<br />
operating earnings of most European<br />
corporations held up quite well. Thanks to<br />
various restructuring and cost cutting measures,<br />
profits could rise sharply once an economic<br />
recovery sets in.<br />
Needed: Structural Reforms<br />
Over the coming years, the Old Continent is<br />
likely to benefit from a US-led global economic<br />
recovery. In the longer term, however,<br />

the prospect of a European economy almost<br />
entirely dependent on global, that is mainly<br />
US events, is very uninspiring. But if Europe<br />
wants to achieve the economic power it<br />
deserves, due to its large size, and act one<br />
day as a world economic engine, structural<br />
reforms are needed urgently. These reforms<br />
won’t come for free and are likely to be very<br />
painful. Central to such steps are labour and<br />
product market reforms in order to intensify<br />
competition. More competition will spur productivity,<br />
which badly lags the US. Ironically<br />
enough, the current high value of the Euro<br />
might help to reach these goals. It forces<br />
European corporations to streamline their<br />
production, become leaner and more<br />
productive in order to compensate for the<br />
increased value of their currency.<br />
The prerequisites for Europe to reach these<br />
ambitious targets are good. Unlike the US, the<br />
Old Continent is not suffering under macroeconomic<br />
imbalances such as huge current<br />
account and federal government deficits.<br />

Sejam carros, suco de laranja ou minério de ferro -<br />
o Brasil tem muito a oferecer para o gigante chinês<br />
Volkswagen <strong>do</strong> Brasil calcula que<br />
exportará, ainda este ano, mais <strong>do</strong><br />
que 30.000 veículos da marca Gol para a<br />
China. O gigante <strong>do</strong> minério de ferro, Companhia<br />
Vale <strong>do</strong> Rio Doce, quase não consegue<br />
atender as encomendas chinesas. Os produtores<br />
brasileiros de suco de laranja concentra<strong>do</strong><br />
já estão <strong>do</strong>minan<strong>do</strong> o merca<strong>do</strong><br />
chinês. Em outras palavras, o Brasil está<br />
fazen<strong>do</strong> uma carreira fulminante na China.<br />
As exportações para a China cresceram 75%,<br />
em 2001. No ano passa<strong>do</strong> subiram um terço,<br />
US$ 2,5 bilhões, isso representa a maior<br />
taxa de crescimento entre os destinos de<br />

no sistema jurídico. Além <strong>do</strong> mais, a<br />
China exige a sua fatia no negócio da importação.<br />

m meus muitos anos de convívio com<br />

Começo pela região de Jungfrau. A partir <strong>do</strong><br />
glamur e luxo que se respira na cosmopolita<br />
Zurique, são apenas três horas de trem até<br />
Lauterbrunnen, meu destino predileto na região.<br />
Trata-se de um diminuto vilarejo próximo de<br />
Interlaken, a base de referência para os passeios<br />
nas mais altas montanhas <strong>do</strong> país. Longe<br />
<strong>do</strong> burburinho da cidade, Lauterbrunnen é<br />
como um recanto que ornamenta o caminho<br />
para o Schilthorn. Quem não se lembra desta<br />
bela montanha com aquele restaurante giratório<br />
que aju<strong>do</strong>u James Bond a tornar-se<br />
famoso?<br />
Lauterbrunnen é um povoa<strong>do</strong> eternamente<br />
borrifa<strong>do</strong> pelas nuvens de água de cachoeiras<br />
oriundas <strong>do</strong> degelo das montanhas. Estas<br />
quedas d’água se desfazem antes de atingir<br />
o solo devi<strong>do</strong> à altura de onde se projetam,<br />
geran<strong>do</strong> um cenário especial. Lá se encontram<br />
as pequenas e típicas residências suíças de<br />

n my many years experience of this<br />
country, I can think of some regions<br />
which identify it strongly but I can never<br />
forget the great efforts which the Swiss<br />
have put into developing it and making it<br />
even better.<br />
Let us start with the Jungfrau region. From<br />
the glamour and luxury of cosmopolitan<br />
Zurich, it is only a three-hour train ride to<br />
Lauterbrunnen, my favorite spot in the region.<br />
Lauterbrunnen is a small village near Interlaken,<br />
the base for walks in some of the highest<br />
mountains in Switzerland. Far from the bustle<br />
of the city, Lauterbrunnen is like a retreat<br />
leading the way to the Schilthorn. Who <strong>do</strong>es<br />
not remember this beautiful mountain, with<br />
the revolving restaurant, which James Bond<br />
helped make famous?<br />
Lauterbrunnen is a place which is constantly<br />
sprayed by the clouds of water from the<br />
waterfalls created by the melting of ice in<br />
the mountains. These falls crash <strong>do</strong>wn to<br />
the earth from a great height, creating a<br />
spectacular sight. In this area one finds the<br />
small, typical Swiss houses with dark wood<br />
and white win<strong>do</strong>w ledges covered in flowers,<br />
bringing happiness to the visitors who are<br />
already ecstasy thanks to the magnificent<br />

desde Sankt Moritz, no vale <strong>do</strong> Engadin, até<br />

the surrounding region, with its chalets and<br />
sporting activities.<br />
Finally, one cannot forget famous Luzerne.<br />
This town was founded as a fishing village in<br />
the year 700 and has become one of the most<br />
important tourist centers in Switzerland. It is<br />
located on Lake Luzerne, called the Lake of<br />
the Four Cantons in German, and is famous<br />
for the large number of excursions which start<br />
from the town. There are also many monuments,<br />
mansions, wells, squares and historic<br />
buildings with paintings and frescoes. It includes<br />
the priceless, the oldest wooden bridge<br />
in the world, built in 1333.<br />

Assembléia Geral<br />
No dia 25 de março de 2003 realizou-se, no<br />
moderno auditório da Nestlé, gentilmente<br />
ofereci<strong>do</strong>, a Assembléia Geral Ordinária da<br />
SWISSCAM, que contou com a presença de<br />
Simon Franco, presidente da TMP-Worldwide,<br />
que proferiu a palestra: "Crian<strong>do</strong> o próprio<br />
futuro". Além de aprovar tanto o balanço para<br />
2002 como o orçamento 2003, os associa<strong>do</strong>s<br />
elegeram os senhores Urs Gujan e Felix Colas<br />
como novos conselheiros e ouviram <strong>do</strong> presidente,<br />
Dr. Ernesto Moeri, o relatório sobre<br />
as atividades da SWISSCAM em 2002 e os<br />
objetivos para 2003 que visam, em geral, menos<br />
dependência das anuidades, mais atividades<br />
comerciais e a ampliação <strong>do</strong>s serviços<br />
ofereci<strong>do</strong>s aos associa<strong>do</strong>s, como, por exemplo,<br />
a formação de novos comitês.<br />

The ordinary general meeting of SWISSCAM,<br />
held on March 25 in the Nestlé auditorium, had<br />
as guest speaker Simon Franco, the president<br />
of TMP-Worldwide. Mr Franco spoke on<br />
"Creating one`s own future". Members approved<br />
the financial statements for 2002<br />
and the 2003 budget and elected two new<br />
advisers, Urs Gujan and Felix Colas. The<br />
Chamber president, Ernesto Moeri, gave his<br />
report on SWISSCAM`s activities in 2002.<br />
For 2003, he said the Chamber`s aims were<br />
to depend less on membership fees and more<br />
on commercial activities and the expansion<br />
of services provided for members, such as<br />
the creation of new committees.<br />

Eugênio Staub, presidente da Gradiente e um<br />
<strong>do</strong>s primeiros empreende<strong>do</strong>res brasileiros que<br />
apoiou publicamente Lula nas eleições no ano<br />
passa<strong>do</strong>, apresentou a sua visão <strong>do</strong> Brasil sob<br />
o novo governo. Demonstrou fatos relevantes<br />
que destacam o desenvolvimento eleva<strong>do</strong><br />
<strong>do</strong> Brasil:<br />
- No Brasil, 22% da população <strong>do</strong> Brasil é<br />
constituída de camponeses (China 76%,<br />
Índia 72%).<br />
- O Brasil representa 42% <strong>do</strong> PIB da<br />
América Latina, incluin<strong>do</strong> o México e o<br />
PIB <strong>do</strong> interior <strong>do</strong> Esta<strong>do</strong> de São Paulo é<br />
equivalente ao PIB da Argentina.<br />
- O Brasil consome 8,02 trilhões de litros de<br />
refrigerantes. É o 3º maior merca<strong>do</strong><br />
mundial, 343% maior que o merca<strong>do</strong> <strong>do</strong><br />
Canadá.<br />
- No ano passa<strong>do</strong>, o Brasil consumiu US$<br />
1,3 bilhão em alimentos "diet" e "light",<br />
compara<strong>do</strong>s a somente US$ 100 milhões<br />
em 1990. A estimativa para 2010 é de<br />
US$ 6 bilhões somente para esses<br />
produtos.<br />
- O Brasil tem 11 milhões de usuários de<br />
Internet: 40% <strong>do</strong> total de usuários da<br />
América Latina e o <strong>do</strong>bro de usuários <strong>do</strong><br />
México.<br />
- O merca<strong>do</strong> de telefonia celular no Brasil<br />
está entre os 5 primeiros <strong>do</strong> mun<strong>do</strong>, com<br />
aproximadamente 750 mil novas linhas<br />
telefônicas vendidas a cada mês.É o único<br />
país <strong>do</strong> Hemisfério Sul a participar <strong>do</strong><br />
Projeto Genoma.<br />
- Qualidade é uma preocupação constante<br />
no Brasil e 6.890 empresas possuem o<br />
certifica<strong>do</strong> de qualidade ISO 9000. Este é<br />
o maior número de certificações entre os<br />
países em desenvolvimento (México 300,<br />
Argentina 265).<br />
Analisan<strong>do</strong> o histórico de crescimento e o<br />
potencial brasileiro em geral, Eugênio<br />
Staub concluiu que o Brasil pode alcançar<br />
uma taxa de crescimento de 4 a 5% por<br />
ano, inician<strong>do</strong> em 2004 ou 2005. Realçou<br />
também a importância da reforma da<br />
previdência e da reforma tributária e<br />
trabalhista.<br />

Eugênio Staub adresses SWISSCAM<br />
Eugênio Staub, the president of Gradiente and one<br />
of the first Brazilian businessmen to publicly<br />
support the left-wing PT candidate, Luiz Inacio<br />
Lula da Silva, in last year’s election campaign,<br />
gave his view of Brazil under the new government.<br />
He presented many facts, highlighting<br />
Brazil’ s high level of development:<br />
- In Brazil, 22% of the population consists of<br />
peasant farmers (China 76%, India 72%)<br />
- Brazil represents 42% of the GDP of Latin<br />
America, including Mexico and the GDP of<br />
the interior of the State of São Paulo is<br />
equivalent to the GDP of Argentina.<br />
- Brazil consumes 8.08 trillion liters of soft<br />
drinks. It is the 3rd market in the world and<br />
is 343% larger than Canada.<br />
- Last year, Brazil consumed US$ 1.3 billion<br />

Having analyzed Brazil’s growth, history and<br />
potential, Staub came to the conclusion that<br />
Brazil could reach a CAGR (compound annual<br />
growth rate) of 4% to 5% per year from 2004<br />
or 2005. He also highlighted the importance of<br />
reforming the pension and tax systems, as<br />
well as the labor legislation.<br />
Staub closed his lecture with a very positive<br />
statement: "I would say that the outlook<br />
for Brazil’s future is now the best in the<br />

Round-table para associa<strong>do</strong>s ouro e<br />
almoço-palestra com Dra. Hebe Teixeira,<br />
Coordena<strong>do</strong>ra Geral de Imigração<br />
Como mais uma iniciativa da SWISSCAM, reuniram-se<br />
os associa<strong>do</strong>s ouro da SWISSCAM<br />
ABB, Ciba, Clariant, Holcim, Nestlé, Novartis,<br />
Roche e Zurich num round-table que abriu<br />
espaço para um contato direto e muito valioso<br />
com a Coordena<strong>do</strong>ra Geral de Imigração<br />
Interina, Dra. Hebe Teixeira.<br />
As grandes empresas suíças estão contratan<strong>do</strong>,<br />
há anos, executivos e técnicos estrangeiros de<br />
diferentes áreas e níveis hierárquicos. Nos<br />
últimos anos tiveram certas dificuldades na<br />
contratação destes profissionais e queriam<br />
conhecer a "filosofia" da nova coordena<strong>do</strong>ra<br />
de imigração. Ela, por sua vez, já conhece<br />
bem as empresas suíças, através de suas<br />
experiências como conselheira <strong>do</strong> CADE,<br />
que lhe permite um profun<strong>do</strong> conhecimento<br />
<strong>do</strong>s perfis destas empresas.<br />
Os representantes das empresas ouro ficaram<br />
bastante satisfeitos com as anima<strong>do</strong>ras respostas<br />
da Dra. Hebe, de formação jurídica, que<br />
vê a "importação" de know-how estrangeiro<br />
como uma chance de agregar valor ao Brasil<br />
e defende a visão que deve haver uma parceria<br />
entre empresas e governo, um facilitan<strong>do</strong><br />
assim o sucesso <strong>do</strong> outro. Claro que<br />
nenhum estrangeiro deve "roubar" uma vaga<br />
que possa ser perfeitamente preenchida por<br />
um profissional brasileiro. Mas a Dra. Hebe<br />
deixou claro que não pretende estabelecer<br />
nenhum tipo de teto salarial e que está convicta<br />
de que a prática deve ser o menos discricionária<br />
possível e mais próxima daquilo que a<br />
lei estabelece.<br />
Os tópicos principais que as empresas<br />
queriam debater com a Dra. Hebe foram:<br />
- Remuneração de expatria<strong>do</strong>s<br />
- Visto temporário com contrato de trabalho<br />
- Resolução Normativa nº 34 (assistência<br />
técnica)<br />
- Resolução Normativa nº 53<br />
E as respectivas respostas foram bem claras:<br />
Remuneração de expatria<strong>do</strong>s<br />
"Não existe expatria<strong>do</strong> que ganha menos no<br />
exterior, portanto, o salário dele deve ser<br />
igual ou mais alto <strong>do</strong> que o último salário<br />
recebi<strong>do</strong> no país de origem", argumentou a<br />
Dra. Hebe referente à questão salarial.<br />
Ainda, seguin<strong>do</strong> a linha de diminuição <strong>do</strong> uso<br />
da discricionariedade, os benefícios admiti<strong>do</strong>s<br />
pela CLT (benefícios como o auxílio-moradia,<br />
por exemplo) como parte da remuneração<br />
total poderão ser considera<strong>do</strong>s na análise<br />
de pedi<strong>do</strong>s de autorização de trabalho. Ela<br />
mencionou também o fato de que é simples<br />
comparar os da<strong>do</strong>s que as empresas fornecem<br />
com aquelas registradas no sistema <strong>do</strong><br />
FGTS. O cruzamento destes da<strong>do</strong>s é uma<br />
ótima base para tomar decisões justas.<br />
Visto temporário com contrato de<br />
trabalho<br />
A admissão <strong>do</strong> funcionário estrangeiro deve<br />
ser feita na data de chegada no Brasil com<br />
o visto temporário. A concessão de prazo<br />
para a realização de tal registro, ten<strong>do</strong> em<br />
vista que muitas são as providências que<br />
antecedem a admissão, apenas pode ser<br />
feita por meio de alteração na regulamentação.<br />
Resolução Normativa nº 34<br />
(assistência técnica)<br />
"Há um certo abuso na interpretação <strong>do</strong> contrato<br />
de assistência técnica. E nunca será<br />
emiti<strong>do</strong> um visto para um profissional, por<br />
exemplo, um analista de processo, quan<strong>do</strong> a<br />
vaga possa ser preenchida com um brasileiro."<br />
Esta Resolução Normativa está sen<strong>do</strong><br />
revista e aberta para propostas de alteração.<br />
Resolução Normativa nº 53<br />
"Não há necessidade de ampliar o visto<br />
temporário para os familiares, porque estes<br />
podem ficar no país com o visto de turista<br />
por 90 dias."<br />
Dra. Hebe Teixeira sugeriu que a SWISSCAM<br />
enviasse, em nome das empresas associadas,<br />
uma carta ao Conselho Nacional de<br />
Imigração, bem como aos seus membros<br />
integrantes, especialmente aos Ministérios de<br />
Trabalho e Emprego, das Relações Exteriores<br />
e da Justiça, pedin<strong>do</strong> soluções para os assuntos<br />
ainda não satisfatoriamente resolvi<strong>do</strong>s.<br />
Desta maneira, as empresas reunidas poderiam<br />
usar o seu peso político para contribuir<br />
para soluções justas que respeitem os<br />
interesses de ambos os la<strong>do</strong>s e para fechar<br />
lacunas na legislação.<br />

Também ressaltou que cada caso é um caso<br />
e que a emissão de vistos depende muito<br />
da justificativa convincente que a empresa<br />
dá para a contratação <strong>do</strong> estrangeiro. Em<br />
princípio ela defende a posição que a contratação<br />
de estrangeiros somente faz senti<strong>do</strong><br />
quan<strong>do</strong> agrega valor para o merca<strong>do</strong> brasileiro<br />
e, obviamente, ela defende uma visão<br />
de proteção <strong>do</strong> trabalha<strong>do</strong>r brasileiro.<br />
As empresas ouro participan<strong>do</strong> deste roundtable<br />
ficaram muito satisfeitas com a oportunidade<br />
de esclarecer dúvidas diretamente<br />
com uma das principais autoridades brasileiras<br />
responsáveis pela questão <strong>do</strong> estrangeiro<br />
no Brasil. No almoço-palestra que foi<br />
realiza<strong>do</strong> em seguida e foi aberto para to<strong>do</strong>s<br />
os associa<strong>do</strong>s, a Dra. Hebe resumiu os seus<br />
objetivos e a sua visão e estava à disposição<br />
para perguntas <strong>do</strong>s ouvintes. Contamos<br />
com mais de 60 participantes no almoçopalestra,<br />
sinal óbvio de que a SWISSCAM<br />
está no caminho certo na seleção de palestrantes<br />
relevantes tanto para associa<strong>do</strong>s<br />

In another SWISSCAM initiative, gold company<br />
members from ABB, Ciba, Clariant, Holcim,<br />
Nestlé, Novartis, Roche and Zurich took part<br />
in a round-table discussion which gave them<br />
the opportunity to make a direct contact with<br />
Hebe Teixeira, Temporary Coordinator-<br />
General for Immigration.<br />
For many years, the big Swiss companies have<br />
been hiring foreign executives and technicians<br />
for different areas and levels. In recent<br />
be filled by a Brazilian professional. However,<br />
she did not intend establishing any salary limit<br />
and said she was convinced that the practice<br />
should discriminate as little as possible and<br />

be made on the date of arrival in Brazil, with<br />
the temporary visa. Granting a period for this<br />
registration to be carried out, bearing in mind<br />
that many concessions anticipate the admission,<br />
could only be <strong>do</strong>ne if the regulation was altered.<br />
Resolution nº 34 (technical assistance)<br />
"There is a certain abuse in the interpretation<br />
of the technical assistance contract. A visa<br />
will never be issued for a professional, such<br />
as a process analyst, when the vacancy can<br />
be filled by a Brazilian." This resolution is<br />
being revised and is open to suggestions on<br />
how it could be altered.<br />
Resolution nº 53<br />
"There is no need to increase the length of<br />
the temporary visa for relatives, since they<br />
can stay in the country with a tourist visa for<br />
90 days."<br />

Ms. Teixeira suggested that SWISSCAM should<br />
send a letter, on behalf of its member companies,<br />
to the National Immigration Council,<br />
and to its members, particularly the Ministries<br />
of Labor and Employment, Foreign Relations<br />
and Justice, requesting solutions for those<br />
matters which have still not been resolved<br />
satisfactorily. By <strong>do</strong>ing so, the companies<br />
could use their political weight to find just<br />
solutions which respected the interests of<br />
both sides and closed loopholes in the law.<br />

"There is no such thing as an expatriate<br />
who earns less abroad. Therefore, the<br />
salary should be the same or higher than<br />
the last salary he received in the country<br />
of origin."<br />
Also, in line with reducing discriminatory<br />
practices, the benefits arising from the CLT<br />
labor law (such as home help) as a part of<br />
the total remuneration could be considered in<br />
checking work permit applications. She also<br />
She also stressed the importance of individual<br />
cases and said that the issue of visas<br />
depended on a convincing justification by the<br />
company for hiring a foreigner. She defended<br />
the principle that, in order to protect the Brazilian<br />
worker, hiring foreigners only made sense<br />
when it added value to the Brazilian market.<br />
The gold member companies were extremely<br />
satisfied with the opportunity provided by the<br />
round table to clear up <strong>do</strong>ubts directly with one<br />
of the main Brazilian authorities responsible<br />
for the foreigners in Brazil. In the ensuing<br />
lunchtime speech, Ms. Teixeira summed up her<br />
aims and vision and answered questions from<br />
the audience. More than 60 people took part<br />
in the lunchtime speech, an obvious sign that<br />
SWISSCAM is on the right track in choosing<br />
important speakers for its members and nonmembers<br />

Se olharmos para o Brasil, sob qualquer perspectiva,<br />
temos muito a reclamar. Embora o<br />
nosso país seja historicamente apenas oito<br />
anos mais novo <strong>do</strong> que os Esta<strong>do</strong>s Uni<strong>do</strong>s,<br />
claramente, <strong>do</strong> ponto de vista geral ficamos<br />
para trás. Os contrastes sociais que tanto<br />
nos ferem to<strong>do</strong>s os dias mostram isso de<br />
forma dramática. Sempre temos encontra<strong>do</strong><br />
explicações, dizen<strong>do</strong> que a nossa colonização<br />
foi diferente; aí assumimos uma postura<br />
de absoluta inferioridade racial que parece<br />
nos deixar mais conforma<strong>do</strong>s.<br />
No entanto, deveríamos insistir na idéia de que<br />
o desenvolvimento das nações não depende<br />
da idade <strong>do</strong>s países, da região geográfica<br />
onde se situa, <strong>do</strong>s seus recursos naturais,<br />
<strong>do</strong> seu clima, da raça <strong>do</strong>s seus povos, nem<br />
da habilidade negocial ou empresarial <strong>do</strong>s<br />
empreende<strong>do</strong>res. Os exemplos são muitos<br />
que corroboram tal colocação. Os Esta<strong>do</strong>s<br />
Uni<strong>do</strong>s, Canadá, países da Europa, Japão,<br />
Austrália, Nova Zelândia e, mais recentemente,<br />
Coréia e China. Povos diferentes,<br />
regiões diferentes, raças diferentes, to<strong>do</strong>s<br />
encontraram de algum mo<strong>do</strong> o caminho <strong>do</strong><br />
progresso.<br />
Então, quais seriam realmente os propulsores<br />
<strong>do</strong> progresso e <strong>do</strong> desenvolvimento<br />
das sociedades humanas?<br />
Quero crer que seria a atitude (Dicionário<br />
Aurélio: "mo<strong>do</strong> de proceder ou agir; comportamento,<br />
procedimento") <strong>do</strong>s povos moldada<br />

If we look at Brazil, from any perspective,<br />
we have lots to complain about. Although, in<br />
historical terms, our country is only eight<br />
years younger than the United States, from<br />
the general point of view we are obviously<br />
behind. The social contrasts which upset us<br />
every day show this in a dramatic way. We<br />
always find some explanations, saying that<br />
our colonization was different; then we assume<br />
a position of complete racial inferiority which<br />
seems to leave us more acquiescent.<br />
However, we should insist on the idea that the<br />
development of nations <strong>do</strong>es not depend on<br />
the age of the country, its geographical<br />
location, its natural resources, its climate,<br />
the race of its people nor the commercial or<br />
entrepreneurial skills of its businessmen.<br />
There are many examples to support this<br />
stance, such as the United States, Canada,<br />
the countries of Europe, Japan, Australia,<br />
New Zealand and, more recently, Korea and<br />
China. These places have different people,<br />
are in different regions, have different races<br />
but have all come together in a certain way<br />
on the road to progress.<br />
What then would really be the factors which<br />
boost the development of human societies?<br />
I believe that the stem from the attitude of<br />
people formed by the educational and cultural<br />
systems of societies, based on principles such as:<br />
- The fundamental importance of ethics<br />
- Permanent integrity<br />
- Assuming responsibility for every action<br />
- Respect for the law and the cultural<br />
habits of society<br />
- Respect for citizens` rights<br />
- Pride in constructive work<br />
- Making efforts to save money and<br />
invest<br />
- Will to win and dedication to finding<br />
solutions<br />
- Punctuality<br />
- Efficiency and productivity<br />
Every citizen should affect be driven by these<br />
obligations. Above all, it is important that the<br />
government commits itself to them since, for<br />
years, it has seemed that the government<br />
felt it was exempt from these obligations.<br />
Nature, through its stability, understands and<br />
practices this every day, allowing human<br />
beings on Earth to make long-term plans for<br />
their lives.<br />
We made many mistakes in the past and the<br />
price paid has been brutal for most of our<br />
population. The driving idea should be: we<br />
will change, and quickly in order to survive<br />
decently as a nation and a people. The new<br />
is knocking loudly at our <strong>do</strong>ors. Our children<br />
and grandchildren will not forgive us if we<br />
continue to take the same steps in the years<br />
to come which we took in the past.<br />

The first meeting of the Secretaries Committee was held in April.<br />
It had an extremely enthusiastic response and proved to be highly<br />
productive. No less than 26 secretaries took part and expressed<br />
their satisfaction in this SWISSCAM initiative. The meetings will<br />
allow them to exchange experiences and take part in speeches<br />
and workshops, tailor-made to their specific professional needs.<br />

Suíça: Um pequeno grande país<br />
Switzerland: A little big country<br />

Ao perguntar às pessoas qual a primeira coisa<br />
que lhes vêm à mente quan<strong>do</strong> o assunto é Suíça,<br />
inevitavelmente elas respondem: chocolates,<br />
queijos, relógios, bancos e Alpes. Muito provavelmente<br />
estes clichês jamais desaparecerão<br />
completamente, mas é claro que a Suíça<br />
tem muito mais a oferecer. Afinal, ela tem um<br />
pouco de tu<strong>do</strong> da Europa. Quem viaja pelo país,<br />
devi<strong>do</strong> às fortes influências alemã, francesa<br />
e italiana, está quase sempre ultrapassan<strong>do</strong><br />
fronteiras sem perceber. Um exemplo: entre as<br />
cidades de Sierre e Leuk, no Cantão <strong>do</strong> Valais,<br />
o trajeto de trem dura uns cinco minutos. Mas<br />
o mesmo condutor que anunciou a aproximação<br />
de Sierre em francês, anuncia agora<br />
a chegada a Leuk no idioma de Goethe.<br />
Apesar de ser um país com dimensões territoriais<br />
bem reduzidas (cabe dentro <strong>do</strong> esta<strong>do</strong><br />
de Sergipe), estes são só alguns <strong>do</strong>s motivos<br />
que levam as pessoas que vão à Suíça a<br />
realizar sonhos.<br />
Nestes últimos quatro anos, pelo tipo de atividade<br />
que exerço, tive a oportunidade de<br />
conhecer diversos cantos da Suíça. Porém,<br />
mesmo após vários carimbos suíços em meu<br />
passaporte, continuo descobrin<strong>do</strong> novidades<br />
e pontos turísticos inimagináveis.<br />
Imagine uma sucessão cinematográfica de<br />
cartões postais que revele a nossa pequenez<br />
diante da natureza. Esse cenário existe e<br />
convive, sem arranhões, com a mutável<br />
eficiência tecnológica neste pequeno grande<br />
país. Minha dica fica entre os cantões de<br />
Berna e Valais, onde existem várias opções<br />
para desfrutar a tranqüilidade de um vilarejo<br />
com paisagens de tirar o fôlego, como em<br />
Bettmeralp, ou combinar esta tranqüilidade<br />
usufruin<strong>do</strong> um spa de alto padrão como em<br />
Leukerbad, ou até mesmo fazer ecoturismo<br />
(tipo de viagem que está na moda) em<br />
Zermatt ou na região <strong>do</strong> Jungfrau-Aletsch-<br />
Bietschhorn, um conjunto de três cadeias<br />
de montanhas que desde dezembro de 2001<br />
é considera<strong>do</strong> Patrimônio Natural Mundial<br />
pela Unesco.<br />
Esses são poucos exemplos de como a Suíça<br />
"verde" é mostrada em grande estilo. Um <strong>do</strong>s<br />
destaques fica por conta <strong>do</strong> Glaciar Aletsch,<br />
com 24 km de extensão, alcança<strong>do</strong> de teleférico<br />
de Bettmeralp, a 190 km de Genebra<br />
e no cantão <strong>do</strong> Valais. Para desvendar esse<br />
cenário no verão, pode-se fazer quatro caminhadas<br />
diferentes guiadas por vários pontos<br />
<strong>do</strong> glaciar Aletsch ou atravessá-lo to<strong>do</strong> ou em<br />
parte de bicicleta. Uma das paradas é na<br />
graciosa cidadezinha de Bettmeralp, onde os<br />
carros elétricos não poluentes são o único<br />
meio motoriza<strong>do</strong> de transporte.<br />

When I ask people what the first thing is that<br />
comes into their minds when they think of<br />
Switzerland, they inevitably answer: chocolates,<br />
cheese, watches, banks and the Alps. These<br />
cliches will probably never disappear completely,<br />
but it is obvious that Switzerland has much<br />
more to offer. In fact, Switzerland contains a<br />
little of all of Europe. Due to the strong German,<br />
French and Italian influences, the traveler is<br />
almost always crossing borders without<br />
noticing. For example, the train ride between<br />
the towns of Sierre and Leuk, in canton Valais,<br />
takes only five minutes yet the same conductor<br />
who announced the approach to Sierre in<br />
French now announces the arrival in Leuk<br />
in the language of Goethe.<br />

Although Switzerland is a small country (the<br />
size of the Brazilian state of Sergipe) these are<br />
only some of the reasons which lead people<br />
to Switzerland to realize dreams.<br />
Over the last four years, thanks to my job, I<br />
have had the chance to get to know various<br />
corners of Switzerland. However, even after<br />
a number of Swiss stamps in my passport, I<br />
continue to discover new and unimaginable<br />
tourist spots.<br />
Imagine a cinematic unreeling of postcards<br />
which shows how small we are in the face<br />
of Nature. This scenery exists and thrives<br />
unscathed, thanks to the technological<br />
efficiency of this small big country. My tip is to<br />
travel between the cantons of Bern and Valais,<br />
where there are many ways of unwinding,<br />
and enjoy the tranquillity of a place like<br />
Bettmeralp. Alternatively, one can combine<br />
this peace and quiet with the benefits of an<br />
up-market spa like Leukerbad or even enjoy<br />
fashionable eco-tourism in Zermatt or the<br />
Jungfrau-Aletsch-Bietschhorn region. This<br />
latter is a grouping of three mountain chains<br />
which UNESCO designated a World Natural<br />
Heritage in December 2001.<br />
These are just a few examples of how one<br />
can see ¨green¨ Switzerland in great style.<br />
One of the highlights is the Aletsch glacier,<br />
which is 24 km long and reached by cablecar<br />
from Bettmeralp, in canton Valais, 190 km from<br />
Geneva. To see this scenery in summer one<br />
can take four different routes along various<br />
points of the glacier or cross it completely,<br />
by bicycle in some parts. One of the stops<br />
is in the pretty village of Bettmeralp where<br />
non-polluting electrically powered cars are<br />
the only motorized transport.<br />

sobre serviços de<br />
qualquer natureza (ISS)<br />

Com a edição da Emenda Constitucional<br />
nº 37, de junho de 2002, que fixou como<br />
alíquota mínima <strong>do</strong> ISS o percentual de<br />
2% e máxima 5%, procurou o Governo<br />
Federal tentar acabar ou minorar a<br />
chamada guerra fiscal travada pelos<br />
municípios<br />
A<br />
líquota mínima de 2%: Fim da guerra<br />
fiscal?<br />
To<strong>do</strong>s se recordam das baixíssimas alíquotas<br />
praticadas por municípios vizinhos a São<br />
Paulo, por exemplo, Barueri, Santana <strong>do</strong><br />
Parnaíba e outros, que por este mecanismo<br />
procuravam atrair para a sua região geográfica<br />
as empresas presta<strong>do</strong>ras de serviços.<br />
Não raro São Paulo possuía alíquota de 5%,<br />
enquanto o mesmo serviço era tributa<strong>do</strong> por<br />
outros municípios por percentuais inferiores a 1%.<br />
Em que pese a diferença de até 3% ainda ser<br />
significativa, o que talvez ainda justifique a<br />
opção por estes municípios com alíquotas de<br />
ISS reduzida, possivelmente poderá ajudar<br />
a inibir as falsas situações. Não chega a ser<br />

municípios concentrarem o seu faturamento<br />
no estabelecimento localiza<strong>do</strong> no "paraíso<br />
fiscal municipal", de forma a beneficiarem-se<br />
da alíquota menor. Muitas são as autuações<br />
da Prefeitura de São Paulo contra empresas,<br />
quan<strong>do</strong> estas não conseguem comprovar de<br />
maneira satisfatória a efetiva prestação <strong>do</strong>s<br />
serviços pelo estabelecimento localiza<strong>do</strong> fora<br />
de seu município.<br />
Onde Pagar o ISS? No município onde está<br />
localiza<strong>do</strong> o estabelecimento presta<strong>do</strong>r <strong>do</strong><br />
Empresas concentrarem o seu<br />
faturamento no estabelecimento<br />
localiza<strong>do</strong> no "paraíso fiscal<br />
municipal", benefician<strong>do</strong>-se da<br />
alíquota menor<br />
serviço, ou no município onde o serviço é<br />
efetua<strong>do</strong>?<br />
Além da questão da minoração da diferença<br />
impositiva entre os municípios, reacendeu-se<br />
a discussão acerca da interpretação de que o<br />
ISS é devi<strong>do</strong> no local da prestação <strong>do</strong> serviço,<br />
e não no local onde se localiza o estabelecimento<br />
que o executa, o que vem geran<strong>do</strong><br />
contingência fiscal no caso das empresas que se<br />
instalam fora <strong>do</strong>s centros econômicos apesar<br />
de neles prestarem a maioria de seus serviços.<br />
Retenção e obrigações acessórias:<br />
conforto para os municípios - custos<br />
para as empresas<br />
Basea<strong>do</strong>s inclusive nesta interpretação acerca<br />
<strong>do</strong> local onde o imposto é devi<strong>do</strong>, algumas<br />
municipalidades com o objetivo de arrecadarem<br />
o ISS incidente sobre to<strong>do</strong>s os serviços<br />
realiza<strong>do</strong>s em seu território, independentemente<br />
da localização <strong>do</strong> estabelecimento<br />
presta<strong>do</strong>r, passaram a dispor sobre a obrigatoriedade<br />
de retenção pelo toma<strong>do</strong>r <strong>do</strong> serviço<br />
<strong>do</strong> imposto que seria devi<strong>do</strong> pelo presta<strong>do</strong>r.<br />
O mecanismo de recolhimento<br />
favorece a arrecadação<br />
tributária porque passa a<br />
reduzir significativamente o<br />
número de contribuintes<br />
Nesta linha, o Município de São Paulo, com a<br />
edição da Lei nº 13.476, publicada em 31 de<br />
dezembro de 2002, passou a regulamentar,<br />
ainda que timidamente, a obrigatoriedade de<br />
retenção <strong>do</strong> imposto por alguns toma<strong>do</strong>res<br />
de serviços, como opera<strong>do</strong>ras de turismo,<br />
instituições financeiras, sociedades segura<strong>do</strong>ras,<br />
agências de publicidade e propaganda,<br />
dentre outras (art. 5º), preven<strong>do</strong> ainda a necessidade<br />
de atendimento a diversas obrigações<br />
acessórias, tais como: a apresentação<br />
de declaração eletrônica de serviços pelo<br />
toma<strong>do</strong>r, a manutenção <strong>do</strong>s registros de<br />
serviços sujeitos à retenção em separa<strong>do</strong> etc.<br />
Com esta nova regulamentação, as citadas<br />
empresas toma<strong>do</strong>ras de serviços passaram<br />
a se ver obrigadas a realizar a retenção e o<br />
recolhimento <strong>do</strong> imposto, sob pena de, não<br />

agin<strong>do</strong> desta forma, serem responsabilizadas<br />
pelo pagamento da totalidade <strong>do</strong> ISS.<br />
Este mecanismo de recolhimento, apesar de<br />
se contrapor aos interesses das empresas,<br />
favorece a arrecadação tributária. Isto porque<br />
passa a reduzir significativamente o número de<br />
contribuintes, e ainda impõe a obrigatoriedade<br />
de recolhimento à pessoa que não arca<br />
com o ônus <strong>do</strong> imposto, o que minora a sonegação<br />
fiscal e facilita a atividade fiscaliza<strong>do</strong>ra.<br />
Em decorrência, tal mecanismo demonstra-se<br />
como tendência futura de recolhimento<br />
tributário, conforme tem se observa<strong>do</strong> em<br />
relação a outros tributos, como ICMS,<br />
COFINS e PIS.<br />

It is a well-known fact that certain municipalities<br />
adjacent to São Paulo, such as Barueri,<br />
Santana <strong>do</strong> Parnaíba and others, used to<br />

charge very low rates of tax, with a view to<br />
attracting service companies to their geographical<br />
region. It was very common, for<br />
example, for the city of São Paulo to charge<br />
a rate of 5% for a particular type of service<br />
that was taxed by other municipalities at<br />
rates lower than 1%.<br />
Although the difference of up to three percentage<br />
points is still significant, and perhaps<br />
even now justifies opting for one of these<br />
municipalities with a reduced rate of ISS,<br />
Companies concentrate their<br />
revenues in "municipal tax<br />
paradises" and benefit from<br />
the lower rates of tax<br />
the amendment may possibly help to curb<br />
artificial situations. For example, service<br />
companies with establishments both in São<br />
Paulo and in one of these "municipal tax<br />
havens" commonly issue all their invoices<br />
from the office situated in the latter, in order<br />
to take advantage of the lower tax rate. As a<br />
result, the Municipality of São Paulo brings<br />
numerous claims for ISS against companies<br />
that are unable to produce satisfactory evidence<br />
to show that the services were effectively<br />
performed by an establishment of theirs<br />
located in a neighbouring municipality.<br />
Where to pay ISS? In the municipality where<br />
the company performing the service is established,<br />
or where the service is actually<br />
performed?<br />
The reduction of the tax rate differential<br />
between the municipalities has rekindled the<br />
discussion regarding the interpretation that ISS<br />
is payable in the place where the services<br />
are performed, rather than in the place where<br />
the service company is established. Over the<br />
years this has given rise to a tax contingency<br />
for those companies that set up offices outside<br />
the main urban centres, although the majority<br />
of the services are performed within such<br />
centres.<br />
Withholding at source and accessory<br />
obligations: convenient for the municipalities<br />
- onerous for the companies<br />
Based on this interpretation regarding the place<br />
where the tax is due, certain municipalities,<br />
with the object of collecting the ISS due on all<br />
services carried out in their territory, irrespective<br />
of the location of the establishment in question,<br />
have passed legislation making it obligatory for<br />
companies for which services are performed<br />
to withhold at source the ISS for which the<br />
company providing such services is liable.<br />
In accordance with this tendency, the Municipality<br />
of São Paulo, with the enactment of<br />
Law no. 13.476, published on December 31,<br />
2002, introduced, albeit in a somewhat timid<br />
fashion, the obligation for certain firms for<br />
which services are performed, such as tour<br />
operators, financial institutions, insurance<br />
companies, publicity and advertising agencies,<br />
amongst others (art. 5), to withhold ISS at<br />
source and also to comply with a number of<br />
accessory obligations, such as: the production<br />
of an electronic declaration of services by<br />
the firm for which they are performed, the<br />
maintenance of separate books for services<br />
subject to the withholding tax etc.<br />
Under these new regulations, the firms for<br />
which the services are performed are now<br />
The collecting mechanism favors<br />
the tax collecting body since it<br />
leads to a significant reduction<br />
in the number of contributors<br />
obliged to withhold at source and account to the<br />
municipal revenue authorities for the ISS<br />
due. Failure to <strong>do</strong> so makes them liable to<br />
payment of the ISS in full.<br />
This system of payment, although not in the<br />
interests of the companies concerned, is<br />
clearly beneficial as far as tax revenues are<br />
concerned. This is because it significantly<br />
reduces the number of taxpayers and imposes<br />
the obligation to pay on the party which is<br />
not liable for the tax, which diminishes tax<br />
evasion and facilitates fiscal control. As a<br />
result, this system is already proving to be<br />
a tendency as regards the payment of taxes<br />
in the future, as has already been shown in<br />
relation to other taxes, such as ICMS, COFINS<br />
and PIS.<br />

A história de Jürg Müller, cosmopolita de 53<br />
anos, com três passaportes (brasileiro, suíço e<br />
americano), é um exemplo de um apaixona<strong>do</strong><br />
pelo Brasil que consegue realizar não somente<br />
um, mas, ao longo <strong>do</strong>s 27 anos que vive aqui,<br />
vários negócios bem-sucedi<strong>do</strong>s fora da sua<br />
terra natal.<br />

Foi em 1976 que Müller se radicou no Brasil.<br />
Antes disto havia passa<strong>do</strong> a infância nos EUA<br />
e a a<strong>do</strong>lescência na Suíça, forman<strong>do</strong>-se em<br />
Comércio Exterior. Com 26 anos de idade<br />
assumiu a tarefa de comercializar soja para<br />
uma grande empresa multinacional suíça no<br />
Brasil. Quan<strong>do</strong> esta empresa, em 1988, o<br />
enviou por <strong>do</strong>is anos para os EUA para<br />
assumir a filial lá, sentiu tanta saudade <strong>do</strong><br />
Brasil que decidiu abrir mão <strong>do</strong> emprego para<br />
poder voltar.<br />
Já de volta e trabalhan<strong>do</strong> para uma outra<br />
empresa de comércio de grãos, surgiu então<br />
o desejo de abrir o seu próprio negócio. A<br />

Jürg Müller is a 53-year-old cosmopolitan<br />
with three passports (Brazilian, Swiss and<br />
American). He has a passion for Brazil, where<br />
he has lived for 27 years, and during this time<br />
away from his homeland he has carried out<br />
not just one but a number of successful<br />
business operations.<br />
Müller moved to Brazil in 1976. He spent his<br />
childhood in the US and his teenage years in<br />
Switzerland where he studied Foreign Trade.<br />
At the age of 26 he began selling soybeans<br />
for a big Swiss multinational in Brazil. When<br />
this comopany sent him abroad for two years<br />
in 1988 to run its subsidiary in the US, he<br />
felt such a longing for Brazil that he quit his<br />
job in order to return.<br />
Once he returned and was working for another<br />
grain company he had the idea of opening his<br />
own business. He decided that the franchise<br />
for an American company specializing in fast<br />
printing services was the best way of making<br />
the change from employee to employer.<br />
Within three years, he managed to transform<br />
his shop into the largest of the network in<br />
the world.<br />
He then had the idea of making a radical change<br />
and started Imagix, his own brand. Over the<br />
years Imagix has changed its basic concept of<br />
offering fast printing services to the concept of<br />
"printing expressions" Imagix is based on an<br />
intensive collaborative relationship between<br />
the client and the supplier, with one valuing<br />
the other, thereby allowing both to grow. As<br />
Müller said: "I changed the concept of 'use<br />
and be used' to one of mutual respect among<br />

"P<br />
apai, o que é uma fusão?"<br />
Luca acabou de comer o seu<br />
<strong>do</strong>ce mil-folhas, sugan<strong>do</strong> agora o<br />
canu<strong>do</strong> de seu refrigerante vazio.<br />
Raufler está len<strong>do</strong> o caderno de<br />
economia <strong>do</strong> jornal.<br />
"Sim", ele responde.<br />
Luca já está acostuma<strong>do</strong> a este<br />
tipo de resposta <strong>do</strong> pai. Às vezes,<br />
ele até especula com isso, por<br />
exemplo, quan<strong>do</strong> quer ver um<br />
filme à noite ou provar um gole de<br />
vinho ou uma tragada de cigarro<br />
ou qualquer outra coisa ilegal para<br />
crianças de 10 anos. Mas hoje,<br />
ele queria uma resposta verdadeira<br />
porque sente um tédio<br />
monumental.<br />

uma câmara frigorífica, um furgão<br />
e assim por diante.<br />
Mas, quan<strong>do</strong> elas se fundem,<br />
elas podem produzir mil-folhas<br />
e canudinhos de coco por<br />
menos dinheiro, lucran<strong>do</strong> mais,<br />
porque economizam uma<br />
máquina para fazer a massa,<br />
uma máquina para fazer o<br />
creme, uma câmara frigorífica,<br />
um furgão e também<br />
economizam as pessoas que<br />
as operam. Isto se chama<br />
sinergia."<br />

Eles estão de férias de inverno numa estação<br />
de esqui sem neve nenhuma. E como sua<br />
mãe quis se livrar deles por duas horas, ele<br />
foi obriga<strong>do</strong> a acompanhar o pai num desses<br />
passeios chatérrimos <strong>do</strong> apartamento passan<strong>do</strong><br />
pela banca de jornais da estação de trem até<br />
o tea-room Montana e de volta pelo mesmo<br />
caminho.<br />
"O que significa?"<br />
"O quê?"<br />
"Fusão."<br />
Raufler espia o filho por cima <strong>do</strong> jornal. Meio<br />
irrita<strong>do</strong>, porque o menino não sabe o que é<br />
fusão, meio encanta<strong>do</strong> por ele querer saber.<br />
Raufler coloca o jornal ao la<strong>do</strong> da xícara de<br />
café. "Uma fusão é quan<strong>do</strong> duas empresas<br />
se fundem e formam uma só."<br />
"Elas fundem?", pergunta Luca, olhan<strong>do</strong> para<br />
a paisagem encharcada, marrom-esverdeada,<br />
diante da janela com friso, decorada com<br />
plantas, <strong>do</strong> Montana.<br />
Raufler explica mais precisamente: "Elas se<br />
unem, elas se juntam."<br />
"Por quê?"<br />
"Por causa das sinergias." Raufler não espera<br />
que a expressão seja familiar a Luca e a<br />
esclarece sem ser solicita<strong>do</strong>. "Isto é, quan<strong>do</strong><br />
diversas forças agem em conjunto, de tal<br />
maneira que elas produzem mais resulta<strong>do</strong>s<br />
<strong>do</strong> que simplesmente uma somada à outra."<br />
Um trenó a cavalos, cujos patins foram substituí<strong>do</strong>s<br />
por rodas, passa lá fora, tinin<strong>do</strong>. Os<br />
passageiros estão senta<strong>do</strong>s embaixo de<br />
guarda-chuvas. "Isto é, um cavalo sozinho<br />
pode puxar um trenó de uma tonelada, mas<br />
<strong>do</strong>is cavalos em conjunto conseguem puxar<br />
um trenó de três toneladas." Raufler está<br />
bastante orgulhoso com esta comparação.<br />
Mas ela não ajuda Luca em nada na sua luta<br />
contra o tédio. "Posso beber uma cerveja?",<br />
indaga, para agitar um pouco a conversa.<br />
Raufler ignora a pergunta e permanece no tema<br />
Luca reflete por um longo tempo. De repente<br />
sua face fica sombria: "E se eles fizessem<br />
uma fusão na sua empresa?"<br />
"Como assim?"<br />
"Aí, espero que você não se torne uma<br />
sinergia."<br />
