NOTICE OF PUBLIC HEARING
CITY OF MALIBU
CITY COUNCIL
The Malibu City Council will hold a public hearing on WEDNESDAY, January 10, 2018, at 6:30 p.m. in the Council
Chambers, Malibu City Hall, 23825 Stuart Ranch Road, Malibu, CA, for the project identified below.
LOCAL COASTAL PROGRAM AMENDMENT NO. 17-001, GENERAL PLAN AMENDMENT NO. 17-001, AND
ZONING MAP AMENDMENT NO. 17-003 – The Malibu City Council will consider an ordinance to amend the City’s
Local Coastal Program Land Use Map, Malibu Municipal Code Title 17 Zoning Map, and General Plan Land Use Map and
the Planning Commission’s recommendations thereon to correct a land use and zoning designation from Public Open Space
(OS) to Commercial Visitor Serving-Two (CV-2) for the parcel identified as Assessor Parcel Map Number (APN)
452-005-029; and an amendment to the General Plan Land Use Map to correct the land use designation from Single-Family
Medium to CV-2 for the parcel identified as APN 4452-005-031
Applicant:
City of Malibu
Owner:
Mani MBI(DE), LLC
Location:
22878 Pacific Coast Highway (Malibu Beach Inn)
APNs: 4452-005-029 and 4452-005-031
Case Planner: Stephanie Hawner, Senior Planner
(310) 456-2489, extension 276
shawner@malibucity.org
The Local Coastal Program (LCP) amendment was assessed in accordance with the authority and criteria contained in the
California Environmental Quality Act (CEQA) and the environmental regulations of the City. Under Public Resources Code
Section 21080.9, CEQA does not apply to activities and approvals by the City as necessary for the preparation and adoption
of LCP amendments. This amendment to the LCP must be certified by the California Coastal Commission before it takes effect.
Local Implementation Plan Section 1.3.1 states that the provisions of the LCP take precedence over any conflict between
the LCP and City’s General Plan and Malibu Municipal Code Title 17 (Zoning). In order to prevent an inconsistency
between the LCP and the City’s General Plan and Malibu Municipal Code Title 17 (Zoning), if the LCP amendment is approved,
the City must also approve the corollary map amendment to the General Plan and Malibu Municipal Code Title 17
(Zoning). This amendment is necessary for the preparation and adoption of the proposed LCP amendment and because it is
entirely dependent on, related to, and duplicative of the exempt activity, it is subject to the same CEQA exemption.
A written staff report will be available at or before the hearing. All persons wishing to address the Council will be afforded
an opportunity in accordance with the Council’s procedures.
Copies of all related documents are available for review at City Hall during regular business hours. Written comments may
be presented to the City Council at any time prior to the beginning of the public hearing.
IF YOU CHALLENGE THE CITY’S ACTION IN COURT, YOU MAY BE LIMITED TO RAISING ONLY THOSE IS-
SUES YOU OR SOMEONE ELSE RAISED AT THE PUBLIC HEARING DESCRIBED IN THIS NOTICE, OR IN
WRITTEN CORRESPONDENCE DELIVERED TO THE CITY, AT OR PRIOR TO THE PUBLIC HEARING.
FORMULA RETAIL ORDINANCE
ZONING TEXT AMENDMENT NO. 17-003 – The Malibu City Council will consider an amendment and the Planning Commis -
sion’s recommendations thereon to institute new citywide regulations and limits on formula retail uses (commonly known as chain
stores), create a table summarizing permitted and conditionally permitted used allowed by the Zoning Code, and make other associ -
The California Environmental Quality Act (CEQA) applies only to projects which have the potential for causing a significant effect
on the environment. Pursuant to CEQA Guidelines Section 15061(b)(3), where it can be seen with certainty that there is no possibility
that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. After analyzing the
project, the Planning Department determined that there is no possibility the amendment will have a significant effect on the environment
and accordingly, the exemption set forth in Section 15061(b)(3) applies.
Without waiving its right to rely on the above-referenced exemption, when adopting its first formula retail ordinance (Ordinance No.
376) in 2014, the City nevertheless undertook an initial study (Initial Study No. 13-001) in the interest of providing meaningful information
to the City’s decision-making body and fostering the most informed decision-making process practicable. The original for -
mula retail ordinance did not authorize a use other than that already designated in the Local Coastal Program and Malibu Municipal
Code as a permitted or conditionally permitted use in the zone. The project description, initial study and negative declaration were
circulated for a 30-day public review period from March 13, 2013 to April 11, 2013. The City Council adopted Initial Study No.
13-001 and Negative Declaration No. 13-001 when it approved Ordinance No. 376, based on its determination that (i) there was no
substantial evidence that the request set forth in the ordinance would have a significant effect on the environment and (ii) the negative
declaration prepared for that request reflected the City’s independent judgment and analysis. While Ordinance No. 376 applied only
to the Civic Center area of the City whereas the proposed ordinance applies citywide, this difference is not significant given most
commercial activity occurs in the Civic Center and the proposed ordinance again does not change the uses allowed or their intensity or
density. While the City could conduct another initial study out of caution, it is not necessary due to the exemption. Planning Department
staff has also conducted an initial review of the categories that would be examined in an initial study and cannot identify any potential
impacts that would need to be studied. A written staff report will be available at or before the hearing. All persons wishing to
address the Council will be afforded an opportunity in accordance with the Council’s procedures. Copies of all related documents are
available for review at City Hall during regular business hours. Written comments may be presented to the City Council at any time
prior to the beginning of the public hearing.
IF YOU CHALLENGE THE CITY’S ACTION IN COURT, YOU MAY BE LIMITED TO RAISING ONLY THOSE ISSUES YOU
OR SOMEONE ELSE RAISED AT THE PUBLIC HEARING DESCRIBED IN THIS NOTICE, OR IN WRITTEN CORRESPON-
DENCE DELIVERED TO THE CITY, AT OR PRIOR TO THE PUBLIC HEARING.
If there are any questions regarding this notice, please contact Bonnie Blue, Planning Director, at (310) 456-2489, extension 258.
