In line with the recent initiative launched by His Highness<br />
Sheikh Mohammed Bin Rashid Al Maktoum, Vice-P<strong>res</strong>ident<br />
and Prime Minister of the UAE and Ruler of Dubai, “The<br />

Abu Dhabi Ports announced the<br />
introduction of a new stream of<br />
digital services in the field of import<br />
and export operations for RORO and<br />
General Cargo. This is a substantial<br />
offering that will provide customers<br />
and stakeholders the accessibility to<br />
new benefits they can now reap from<br />
the automation of operational processes<br />
and services through its Maqta Port<br />
Community System (PCS).<br />
Captain Mohamed Al Shamisi, CEO<br />
of Abu Dhabi Ports, stated that “This<br />
achievement is a major milestone that<br />
highlights Abu Dhabi Ports’ continued<br />
commitment to offer innovative and<br />
competitive solutions to our customers<br />

System is the first of its kind in the<br />

Dubai set to invest $336m to develop<br />
Somali port<br />
P&O Ports, owned by the<br />
Government of Dubai, has won a 30-<br />
year concession for the management<br />
and development of a multi-purpose<br />
port project at Bosasso in the Puntland<br />
state of Somalia. Investment in the<br />
facilities is expected to be about $336<br />
million divided into two phases. Work<br />
Dubai-based oil company ENOC<br />
Group signed an agreement with<br />
Rotary Engineering Fujairah for<br />
storage tanks as part of the $1bn<br />
expansion of its Jebel Ali refinery.<br />
Rotary Engineering Fujairah will<br />
construct 12 new storage tanks for the<br />
on the project will involve building a<br />
450m quay and a 5 hectare back up<br />
area, dredging to a depth of 12m with<br />
reclamation work using dredge spoil.<br />
There will also be major investment in<br />
an IT and terminal operating system,<br />
mobile harbour cranes and container<br />
handling equipment.<br />
Dubai’s ENOC awards contract for<br />
Jebel Ali refinery expansion<br />
refinery. The new tanks are designed<br />
to store jet fuel, naphtha along with<br />
gasoline blend stocks.<br />
They will be equipped with their<br />
own safety featu<strong>res</strong>, with dedicated<br />
firefighting systems integrated into<br />
the existing systems, a statement said.<br />
Sailor killed, four<br />
injured as ship<br />
catches fire in<br />
Sharjah port<br />
The fire broke out on a Panamaflagged<br />
ship carrying diesel fuel and<br />
was reported to civil defense. A sailor<br />
was killed and four others injured in<br />
a fire the gutted a vessel docked in<br />
Sharjah’s Al Hamriya port. Firefighters<br />
from Al Hamriya, with the help of the<br />
UAE Coastguard, contained the fire<br />
within 40 minutes, said Lt Col Sami<br />
Al Naqbi, Director of Sharjah Civil<br />
Defence. The vessel was handed over to<br />
the Sharjah Police who is investigating<br />
the incident and a fire expert visited the<br />
site to establish the cause of the fire.<br />

"موانئ أبوظبي" تبدأ التشغيل التجريبي لبوابة المقطع اإللكترونية<br />
اأعلنت موانئ اأبوظبي عن بدء التشغيل التجريبي<br />
لنظام جمتمع املوانئ املتطور الذي اأطلقت عليه اسم "بوابة<br />
املقطع الإلكرتونية" عقب استكمال مرحلة الإعداد واجتياز<br />
الختبارات الأولية وتدريب الكوادر. تعتبر بوابة املقطع<br />
الإلكرتونية اأول نظام اإلكرتوين يف دولة الإمارات العربية<br />
املتحدة يهدف اإىل خدمة جمتمع املوانئ من مستخدمني<br />
ومتعاملني ومن اجلهات والهيئات احلكومية ذات الصلة،<br />
حيث يتيح النظام سهولة وصول الأطراف املعنية اإىل<br />
البيانات واحلصول على املعلومات فيما يتعلق بعمليات<br />
السترياد والتصدير وحركة الشحنات.<br />
ويوضح الكابتن حممد جمعة الشامسي، الرئيس<br />
التنفيذي ملوانئ اأبوظبي اجلوانب املتعددة لأهمية بوابة<br />
املقطع ف يقول: "التزامنا باأهداف الروؤية القتصادية لإمارة<br />
اأبوظبي يدفعنا لالستمرار يف الإبتكار وتوظيف طاقاتنا من<br />
اأجل املساهمة يف حتقيقها يف ظل اهتمام القيادة الرشيدة<br />
باملشروع واملتابعة احلثيثة والتوجيهات التي حتتم علينا<br />
الإجناز يف اإطار مسوؤولياتنا الوطنية". كما بنيّ الشامسي<br />
اأن موانئ اأبوظبي وبالتعاون مع شركائها قد استفادت اأيضاً<br />
من اإعالن 2015 "عام البتكار الإماراتي" حيث خرج هذا<br />
النظام كنموذج متميز لالبتكار يف جمال اخلدمات املينائية<br />
خالل وقت قياسي مل يتجاوز العام، واأكد الشامسي اأيضاً:<br />
"اإن دور بوابة املقطع الإلكرتونية يندرج ضمن اأولوياتنا يف<br />
اإيجاد املحفزات التشغيلية لدعم حتقيق التنويع القتصادي<br />
من منظور شامل، ثم تسهيل اإجراءات التعامل مع موانئ<br />
اأبوظبي وتبسيط اخلطوات، وتسريع الإجناز، وتوظيف<br />
التكنولوجيا احلديثة خللق جتربة فريدة جتذب الستثمارات<br />
نحو اإمارة اأبوظبي".<br />
"موانئ بي آند أو" تستثمر 336 مليون دوالر<br />
لتطوير ميناء الصومال<br />
وقعت شركة "موانئ بي اآند اأو" اتفاقية لإدارة وتطوير<br />
ميناء بوساسو املتعدد الوظائف يف ولية بونت لند "اأرض<br />
النبط" الصومالية ملدة 30 عاماً، بقيمة 336 مليون<br />
دولر ما يعادل 1.235 مليار درهم؛ حيث سيكون الستثمار<br />
مقسماً على مرحلتان. ووفق التفاقية، فاإن اأعمال التطوير<br />
يف املشروع ستتضمن بناء رصيف بطول 450 مرتاً ومساحة<br />
"إينوك" نحو إنشاء خزانات نفط في جبل علي<br />
وقعت شركة برتول الإمارات الوطنية "اإينوك" مع شركة<br />
"روتاري الهندسية" اتفاقية لإنشاء اثني عشر خزاناً جديداً يف<br />
اإطار مشروع توسعة مصفاة جبل علي ورفع قدرتها الإنتاجية<br />
بنسبة 50%، وياأتي ذلك يف اأعقاب الإعالن عن منح عقد<br />
دعم تبلغ 5 هكتارات واإجراء اإصالحات واإزالة رواسب اإىل<br />
عمق يصل اإىل 12 مرتاً، كما سيتم تطوير اأنظمة تقنية<br />
املعلومات اخلاصة بتشغيل امليناء )TOS( وحتسني عمل<br />
الروافع املتحركة ومعدات مناولة احلاويات وغريها من<br />
الأعمال التطويرية للميناء.<br />
الأعمال الهندسية واملشرتيات والإنشاء لتصميم واإنشاء<br />
وحدات معاجلة جديدة وثانوية يف سبتمر املاضي. يشمل<br />
املشروع ثالث حزم توسعة منفصلة بتكلفة تقديرية تبلغ مليار<br />
دولر، ومن املتوقع بدء التشغيل التجاري وعمليات الإنتاج خالل<br />
الربع الرابع من العام 2019.<br />
وفاة شخص وإصابة<br />
أربعة آخرين إثر<br />
حريق سفينة في<br />
ميناء الحمرية<br />
اشتعلت النريان يف باخرة حتمل علم بنما، وهي حمملة<br />
باملشتقات النفطية، ترسوعلى ميناء احلمرية يف اإمارة<br />
الشارقة الإماراتية؛ ما اأدى اإىل وفاة عامل واإصابة 4 اآخرين،<br />
ومت اإبالغ الدفاع املدين فوراً.<br />
هرعت على الفور فرق الإنقاذ والإسعاف من مراكز<br />
الختصاص ومراكز الدعم بالدفاع املدين اإىل مكان احلادث،<br />
وسيطرت على احلريق يف غضون 40 دقيقة بحسب ما قاله<br />
العقيد سامي النقبي، مدير اإدارة الدفاع املدين بالشارقة.<br />
واأكد اأنه مت التعامل مع احلادث واأن فرق الإنقاذ متكنت<br />
من مكافحة النريان املشتعلة، ومتت السيطرة على احلريق<br />
وضمان عدم انتقاله للخزانات والسفن الأخرى بجوار<br />
الباخرة املحرتقة، واأضاف: "ساعدت فرق مكافحة احلريق<br />
من عجمان واأم القيوين على اإخماد احلريق ؛ وجاري الآن<br />
التحقيقات للكشف عن مالبسات احلادث".<br />

Imdaad signs AED4m contract with Dubai Maritime City<br />
Imdaad has been awarded a threeyear<br />
contract worth approximately AED<br />
4 million by Dubai Maritime City, a<br />
specialized maritime cluster for the<br />
UAE and GCC and the world's first<br />
maritime centre.<br />
Under the terms of their agreement,<br />
Imdaad will deliver integrated<br />
FM services in the <strong>22</strong>7-hectare Dubai<br />
Maritime City MBC Building. The<br />
new partnership illustrates the multiawarded<br />
FM company’s proven capability<br />
to roll out quality-driven integrated<br />
FM solutions designed to lessen costs,<br />
improve facility functions and asset<br />
management, and achieve streamlined<br />
operations and standardized approach.<br />
Jamal Abdullah Lootah, CEO<br />
of Imdaad, said: “We are excited by<br />
this latest strategic cooperation with<br />
Dubai Maritime City. Gaining the trust<br />

DMCA launches ‘Maritime Signage<br />
Design and Guidelines’<br />
In keeping with its long-standing<br />
efforts to develop, regulate, and<br />
enhance the maritime sector, the<br />
Dubai Maritime City Authority<br />
(DMCA) recently launched the<br />
‘Maritime Signage Design and<br />
Guidelines’ available in both Arabic<br />
and English. The guidelines serve<br />
as an integrated framework for<br />

collided with the harbour wall,<br />
striking the leg of a quay crane and<br />
causing it to fall at Terminal 1 of<br />
Jebel Ali Port. A second crane was<br />
also shifted off its rails during the<br />

implementation of uniform standards<br />
in designing and placing of signage,<br />
safety boards, and guiding arrows<br />
off Dubai waters, including coasts<br />
and waterways, according to best<br />

the guidelines, the DMCA aims<br />
to ensure maritime safety in local<br />
maritime community.<br />
DP World witnessed a crane accident<br />
reported. DP World said in a statement<br />
“Our first priority is the safety and<br />
wellbeing of our employees and all<br />
visitors to the port. DP World’s<br />
terminal safety teams <strong>res</strong>ponded<br />
immediately to the incident and head<br />
office global safety teams joined them<br />
on site within five minutes.”<br />
Aramco, ADNOC<br />
to jointly assess<br />
upstream<br />
technologies<br />
The two companies plan to collaborate<br />
on identifying technologies that<br />
could deliver improved operational<br />
performance and efficiency across<br />
the oil and gas value chain. Dr. Sultan<br />
Ahmed Al Jaber, the UAE Minister<br />
of State and ADNOC Group<br />
CEO, said: “We share many strategic<br />
objectives and increased cooperation<br />
between ADNOC and Saudi Aramco<br />
will further ensure our long-term economic<br />
and energy <strong>res</strong>ilience.<br />
Amin H. Nasser, p<strong>res</strong>ident and CEO<br />
of Saudi Aramco, said the MOU would<br />
“further strengthen and advance our<br />
joint goals for <strong>res</strong>earch and development<br />
in sustainable energy supply,<br />

"إمداد" توقع اتفاقية إلدارة المرافق مع مدينة دبي المالحية<br />
وقعت اإمداد موؤخراً اتفاقية ملدة ثالث سنوات مع<br />
مدينة دبي املالحية، اأول مركز بحري يف العامل لأغراض<br />
التجارة والأعمال البحرية لدولة الإمارات ودول جملس التعاون<br />
اخلليجي. ومبوجب شروط هذه التفاقية، التي تبلغ قيمتها<br />
حوايل 4 ماليني درهم، ستقوم اإمداد بتوفري خدمات اإدارة<br />
املرافق املتكاملة يف مركز الأعمال البحري البالغة مساحته<br />
<strong>22</strong>7 هكتار واخلاص بالشحن البحري وصناعة النفط<br />
والغاز. وتوؤكد هذه التفاقية اجلديدة على قدرة شركة اإدارة<br />
املرافق احلائزة على عدة جوائز، يف تقدمي حلول اإدارة املرافق<br />
املتكاملة واملصممة لتخفيض التكاليف وحتسني وظائف<br />
املرفق واإدارة الأصول وتبسيط العمليات والوصول اإىل<br />
منهجية اإدارة موحدة.<br />
وقال جمال عبد اهلل لوتاه، الرئيس التنفيذي لشركة<br />

سلطة دبي المالحية تطلق "دليل تصميم<br />
اللوحات اإلرشادية البحرية"<br />
اأطلقت سلطة مدينة دبي املالحية اأخرياً "دليل تصميم<br />

Nakilat LNG carrier comes under in-house management<br />
Doha-based Nakilat assumed full<br />
ship management and operations of<br />
the Q-Flex LNG carrier, Mesaimeer,<br />
from STASCo (Shell Trading and<br />
Shipping Company Ltd.) as part of<br />
the planned and phased transition<br />
announced in October last year. The<br />
216,000 cu m capacity Mesaimeer,<br />
delivered by Hyundai Heavy Industries<br />
in 2009, is wholly-owned by Nakilat<br />
and chartered by Qatargas. It is the<br />
sixth wholly-owned LNG vessel<br />
that has been brought under the<br />
management of Nakilat Shipping<br />
Qatar Ltd. (NSQL).<br />

اأعلنت شركة قطر لنقل الغاز املحدودة " ناقالت"<br />
اأنها تولت، اإدارة وعمليات التشغيل الفنية الكاملة لناقلة<br />
الغاز الطبيعي املسال "مسيمري" من نوع كيو – فليكس، من<br />
ستاسكو "شركة شل للتجارة والشحن املحدودة". واأشارت<br />
الشركة اإىل اأن الناقلة "مسيمري" وهي ذات قدرة استيعابية<br />
تصل اإىل 216 األفاً و312 مرتاً مكعباً، مملوكة بالكامل<br />
من قبل "ناقالت" ومستاأجرة من قبل شركة "قطرغاز"،<br />
ومت بناوؤها يف كوريا اجلنوبية من قبل شركة" هيونداي"<br />
للصناعات الثقيلة ومت تسليمها يف مارس 2009 وهي يف<br />

،)TPM( يف اإطار سعيها جلعل امليناء ذي كفاءة تامة وخال<br />

As a subsidiary of the Kuwait<br />
Petroleum Corporation (KPC),<br />
the Kuwait Oil Tanker Company<br />
(KOTC) is committed to providing<br />
safe and efficient transportation for<br />
Kuwait’s leading export (petroleum),<br />
which is in line with KPC’s strategic<br />
vision. Recently KOTC completed a<br />
nine-vessel new building programme,<br />
where they worked with different<br />
suppliers to implement new systems<br />
to operate a cleaner, safer, and more<br />
fuel-efficient fleet.<br />

الكويتية. وجهزت الشركة موؤخراً برناجماً جديداً لبناء<br />
تسع سفن من خالل العمل مع موردين خمتلفني لتنفيذ<br />
اأنظمة جديدة لتشغيل اأسطول اأنظف واأكثر اأماناً<br />

واأوضح نائب الرئيس التنفيذي لعمليات الأسطول<br />

A Lebanese registered ship hijacked<br />
off the cast of war-torn Somalia has<br />
been freed, says a shipping expert. The<br />
pirates who boarded the ship Saturday<br />
abandoned it Sunday before naval<br />
forces <strong>res</strong>cued the ship, Mohamed<br />
Abdirahman, former director of<br />
Puntland's marine forces, told The<br />
Associated P<strong>res</strong>s. The pirates were<br />
unable to take the crew hostage because<br />
they locked themselves in a safe room<br />
said Abdirahman. No pirates were<br />
ar<strong>res</strong>ted and international naval forces<br />
are now escorting the ship, he said.<br />
The ship hijacked off the coast of<br />
war-torn Yemen is a cargo vessel owned<br />
by a Lebanon-registered company, a<br />
United Nations agency confirmed<br />
Sunday. The hijacking was the latest in<br />
a <strong>res</strong>urgence of piracy in the waters off<br />
Somalia and Yemen, one of the world's<br />
crucial sea trade routes. The pirates<br />
managed to board the ship Saturday<br />
evening near Yemen's Socotra Island<br />
despite <strong>res</strong>istance from the crew, said<br />
Somali pirate, Bile Hussein.<br />
Egypt receives first oil product shipments from Saudi Aramco<br />
Egypt has received two oil product<br />
shipments from Saudi Arabian state oil<br />
company Aramco, Egyptian Petroleum<br />
Minister Tarek el-Molla announced in<br />
a phone interview with local television<br />
channel CBC.<br />
Aramco will send two more oil<br />
shipments by end of this March, the<br />
minister added, saying that the value<br />
of the Saudi shipments would range<br />
between $320 million and $340 million<br />
per month.<br />
There will be a five-year grace period<br />
before the Egyptian government would<br />
start paying for Aramco shipments,<br />
el-Molla stated, saying his country had<br />

قال خبري مالحي اأنه مت اطالق سراح السفينة التي<br />
متلكها شركة لبنانية والتي اختطفت من قبل قراصنة<br />
صوماليني. وقال حممد عبد الرحمن املدير السابق لقوات<br />
بونتالند البحرية لوكالة انباء اسوشييتد برس اأن القراصنة<br />
الذين استقلوا السفينة غادروها قبل اأن تنقذ القوات البحرية<br />
السفينة. واأضاف، مل يتمكن القراصنة من اأخذ اأي من اأفراد<br />
الطاقم رهائن لأنهم اأقفلوا على اأنفسهم يف غرفة اآمنة. وقال<br />
اأنه مل يتم اإلقاء القبض على القراصنة واأن القوات البحرية<br />
الدولية رافقت السفينة.<br />
كما اأكدت وكالة الأمم املتحدة يف لبنان اأن السفينة<br />
التي اختطفت قبالة ساحل اليمن هي سفينة شحن مملوكة<br />
لشركة مسجلة يف لبنان. وكانت عملية الختطاف هذه<br />
الأخرية بعد عودة القرصنة اإىل املياه قبالة الصومال واليمن<br />
والتي تعتر اإحدى اأهم طرق التجارة البحرية فى العامل. وقال<br />
اأحد القراصنة الصوماليون بيل حسني : "متكن القراصنة<br />
من الصعود اإىل السفينة بالقرب من جزيرة سقطرى<br />
اليمنية رغم مقاومة الطاقم".<br />

موؤسسة موانئ خليج عدن اليمنية. وساهمت حمطّ ة عدن<br />
للحاويات يف عامي - 2015 2016 يف استقبال كل احلاويات<br />
التي تعذّ ر وصولها اإىل املوانئ اليمنية بسبب احلرب، ومت<br />
جتهيز مساحات خزن اإضافية فيها لستقبال مزيد من<br />
احلاويات ولديها القدرة الكاملة يف تغطية نشاط اليمن يف<br />
شكل فاعل كونها املحطّ ة املتخصّ صة الوحيدة يف عموم<br />

مصر تستلم أول شحنة نفط من السعودية<br />
بعد توقف دام عدة أشهر<br />
اأعلنت احلكومة املصرية استالمها اأول شحنة منتجات<br />
نفطية من السعودية بعد توقف دام عدة اأشهر. واأوضح<br />
وزير البرتول املصري، طارق املال، اأن بلده استلم شحنتنيْ<br />
من وقود الديزل من شركة اأرامكو السعودية، لفتاً اإىل اأن<br />
هناك شحنتني اأخريني وصلتا نهاية شهر مارس املاضي.<br />
واأشار املال اأن قيمة شحنات النفط السعودي ترتاوح<br />
شهرياً بني 320 و340 مليون دولر، مع فرتة سماح 5<br />
سنوات قبل بدء سداد قيمة النفط. واأضاف اأن بالده<br />

building the largest container ship<br />
surpassing 20,000 TEU. Mitsui<br />
O.S.K. Lines' (MOL) Triumph is 400<br />
met<strong>res</strong> in length, has a width of 58.8<br />
met<strong>res</strong>, and a depth of 32.8 met<strong>res</strong>,<br />
classing it as a Ultra Large Container<br />
Ship (ULCS) as it can transport<br />
20,150 containers. MOL currently<br />
ranks 12 for TEU on Alphaliner's<br />
global carrier line list. SHI held a<br />
Rolls-Royce has announced plans to<br />
open a global <strong>res</strong>earch and development<br />
center for the advancement of remote<br />
controlled and autonomous shipping<br />
technology in Turku, Finland. The<br />
center is expected to be opened this<br />
naming ceremony for the first of four<br />
20,150 TEU container ships, ordered<br />
year. Rolls-Royce is at the forefront of<br />
the development of remote controlled<br />
and autonomous ships, with a stated<br />
goal of seeing a remote controlled<br />
ship in commercial use by the end of<br />

to ensure customer satisfaction. This has<br />
been our primary focus from day one and<br />
has opened up several opportunities for<br />
us, because our customers know that we<br />
can deliver and exceed their expectations.<br />
We also periodically review our existing<br />
business model and strategy in order to<br />
measure different markets and sectors. We<br />
have been able to sustain our primary clients<br />
including NMDC, Valentines Marine,<br />

Ali & Sons has a strategic location with<br />
access to both onshore and offshore fields<br />
in UAE. How does this location serve the<br />
prog<strong>res</strong>s of the company?<br />
We have 545m of waterfront facility that<br />
can serve all offshore and overseas works,<br />
which provides us with the flexibility to<br />
build oversized, non-land transportable<br />
packages. We have diversified business<br />
units and work directly with the major<br />
EPC contractors like Petrofac, for the UZ<br />
750 project, Tozzi in the ADCO Mender<br />
project, with QCon in ADGAS Island<br />
Project and Schneider for ZADCO Island<br />
Airport upgrade. Our organisation also<br />
works alongside many others to build<br />
skids, modules, E-houses, and oil and<br />

Safety and security are critical issues<br />
worldwide. How does your company<br />
ensure that safety standards are<br />
implemented?<br />
At Ali & Sons, we have always<br />
prioritised high safety & security standards<br />
for ourselves, our people, our facilities<br />
and our clients. We are ISO certified<br />
and regularly being reviewed by the<br />
relevant authorities for safety and security<br />
compliance. Our activities demand the<br />
active implementation of comprehensive<br />
HSE policies to protect our employees,<br />
clients, and assets and minimise the impact<br />
of our ecological footprint, and we take<br />
our <strong>res</strong>ponsibilities in these areas seriously.<br />
Our proactive approach to safety has led to<br />
the development of rigorous programmes<br />
and contributed to our excellent safety<br />
record as we have completed 1.5 million<br />
man-hours in 2016 without a single Lost<br />
Time Injury (LTI) and we are aiming to<br />

We are planning to expand and grow<br />
our business across other GCC countries<br />
such as Kuwait and Saudi Arabia, in<br />
addition to providing technical support<br />
for major countries across the Middle<br />
East and Africa. At the same time, we<br />
are currently upgrading our facilities to<br />
meet all customer requirements. One of<br />
the initiatives that I’m working on is to<br />
enhance our activities to further support<br />
local businesses, in line with the vision<br />
of our UAE leaders.<br />

خاللها تعزيز قوة الشركة ومنوها؟<br />
لطاملا اآمنت اأن املستقبل بيد الأشخاص الطموحني الذين<br />
باإمكانهم اكتشاف واستغالل الفرص التي تنشاأ من خالل<br />
التغيري حيث اأن التكيف مع ظروف السوق املتغرية والتفكري<br />
املُبتكر هما العوامل الرئيسية للنجاح. وحتتاج كل موؤسسة<br />

قطاع النفط والغاز، ونحمد اهلل اأننا على الدوام نلعب دوراً<br />
هاماً يف تعزيز اقتصاد دولة الإمارات.<br />
كم عدد السفن والرافعات واحلفارات التي متتلكها<br />
شركتكم؟<br />
نحرص دائماً على تنويع الأصول والتجهيزات التي منتلكها<br />
يف الشركة لتحقيق مبداأ "حمطة التوقف الشاملة للخدمات<br />
البحرية"، من اأجل ذلك متتلك شركتنا حالياً 5 سفن و3 راف عات<br />
وحفارة واحدة يف مصنعنا ونعمل حالياً على مشاريع عديدة.<br />
ما هي االسرتاتيجية التي تتبعها شركتكم للحفاظ<br />
على عمالئكم ووالئهم للخدمات التي تقدمونها؟<br />
اأفضل طريقة للمحافظة على النجاح يف سوق مليئة<br />
بالتنافس هي ضمان جودة اخلدمات ورضا العمالء، فكان<br />
ذلك هدفنا الأساس منذ البداية. وبذلك ضمنا ولء عمالئنا<br />
من خالل اإميانهم باأننا قادرون على الإنتاج والتميز. كما نقوم<br />
مبراجعة دورية لنموذج عملنا واسرتاتيجيتنا حتى تتناسب مع<br />
خمتلف االقطاعات والأسواق.<br />
لقد متكنا من املحافظة على عمالئنا مثل شركة اجلرافات<br />
البحرية الوطنية "NMDC" وفالنتينزمارين و ELA واإسناد<br />
وزاخر مارين بالإضافة اإىل عدد من الشركات الأخرى العاملة<br />
يف قطاع النفط والغاز.<br />
كيف تطبق علي واأوالده حلوالً اأكرث فاعلية من حيث<br />
التكلفة؟<br />
يف شركة علي واأولده، يتم تطبيق اإدارة النفقات وفق منهجية<br />
تعتمد اأفضل املمارسات يف اإدارة املوازنة والتعامل مع شبكة<br />
املوردين واملشرتيات، نستطيع عرها حتقيق وفورات عديدة<br />
وتقليل التكلفة على العمالء دون الإضرار بجودة اخلدمات،<br />
وبذلك نحافظ على نقاط التميز والتنافسية يف خدماتنا، وهو<br />
ما ساعدنا على التعامل مع الأزمات التي مرت يف السوق من<br />

يتذبذب السوق البحري يف االإمارات بسبب تغري<br />
اأسعار النفط والغاز بشكل متقلب، ما هي اأبرز<br />
التحديات التي تواجهها الشركة حالياً وكيف<br />
تَتخطونها؟<br />
حالياً تواجه الشركة حتديان اإثنان، وهما: انخفاض اأسعار<br />
النفط واملنافسة القوية يف السوق. وللتغلب على هذان التحديان<br />
نعتمد منهجية التميز من خالل تنويع اأعمالنا التجارية والبحث<br />
عن فرص عمل يف السوق مل يسبقنا اإليها اأحد.<br />

متنقلة ضخمة. وقمنا بتنويع اأعمالنا عر التعامل مباشرةً<br />

يمثل عنوان "صنع في اإلمارات" للبعض أكثر من مجرد نشاط تجاري يحقق الكسب واألرباح، إذ يتعداها ليصبح طموحًا ورسالة في<br />

اأبوظبي للعمليات البرتولية الرية املحدودة ،"ADCO" و<br />
شركة قطر للهندسة والإنشاءات "OCon" يف مشروع جزيرة<br />
اأدجاز ،"ADGAS" وشنايدر يف مشروع زادكو لتوسعة جزيرة<br />
املطار. كما تعمل شركتنا مع العديد من اجلهات على بناء<br />
وحدات وقطع بحرية وبيوت كهربائية، اإضافة اإىل اأعمال اأخرى<br />
عديدة تتعلق بالنفط والغاز.<br />

والتقليل من خطر اآلثار البيئية الناجمة عن<br />

مستوى السالمة التي نفخر اأننا حققنا فيها مستوى قياسياً،<br />
حيث اأكملنا 1.5 مليون ساعة عمل من دون اأية اإصابات<br />
يف فريق العمل، ونهدف اإىل التقليل من نسبة احلوادث يف<br />
املصنع لتصل اإىل صفر بحلول العام 2020.<br />

املستقبلية؟<br />
اإن خططنا ومشروعاتنا هي صدى خلطط وروؤية قيادتنا<br />

that is active and consists of marine<br />
services primarily dealing with ship<br />
lifts, ship repair plots, warehouses,<br />

and showrooms. A 1270 m stretch of<br />
wet berthing has been available in this<br />
precinct alongside with 42 dry berths<br />
of various covered and open sizes. This<br />
area also contains 19 ship repair plots<br />
and three ship lifts with the capacity<br />
of 700, 3000 and 6000 tons each in<br />
addition to more than 200 workshops<br />
and warehouses. DMC has also<br />
succeeded to maintain 323 companies<br />
with 13 % business expansion in 2016<br />
compared to 2015.<br />

جمتمع مالحي عاملي فريد من نوعه؛ حيث تستطيع املدينة<br />
من خالل شركائها دعم عمالئها يف احلصول على رخص<br />
ملكية بنسبة 100%.<br />
متكنت مدينة دبي املالحية اأيضاً من تطوير منطقة<br />
صناعية فعَ الة باإمكانها اأن توؤمن جميع اخلدمات املالحية<br />
مبا فيها مرافق روافع وبناء واصالح السفن واليخوت،<br />
املستودعات، وورش العمل بالإضافة اإىل دعم املحالت<br />
التجارية وصالت العرض. كما تضم هذه املنطقة اأرصفة<br />
مائية متتد على 1270 مرتاً، اإضافة اإىل 42 من الأرصفة<br />
اجلافة املغطاة واملكشوفة مبختلف الأحجام. وحتتوي هذه<br />
املنطقة اأيضاً على 19 اأرض خمصصة لإصالح السفن<br />
وثالث رافعات سفن بسعة 3000 700، و6000 طناً<br />
بالإضافة اإىل ما يزيد عن 200 ورشة عمل ومستودع. كما<br />
استطاعت مدينة دبي املالحية تسجيل حوايل 323 شركة؛<br />
حمُ ققة بذلك زيادة يف معدلت النمو التي وصلت اإىل % 13<br />
خالل العام 2016 مقارنة بالعام 2015.<br />

Damen celebrates nine decades<br />
of operations in the shipbuilding industry<br />
Damen is celebrating nine decades of operations in<br />
the shipbuilding industry. From small beginnings in<br />
the 1920s, the company has grown into a renowned<br />
maritime service provider that employs 9,000 people.<br />
With Dutch roots, Damen’s expansion has been<br />
global. This growth can be viewed in terms of its<br />
yards, service hubs and other subsidiary companies as well as<br />
a globally-operating client base. For 90 years, Damen’s vessel<br />
designs have successfully served customers operating on all over<br />
the world.<br />
Damen was originally established by two brothers, Jan and<br />
Rien Damen, in 1927. From facilities located on the banks of the<br />
River Merwede in Hardinxveld, the Netherlands, they managed<br />
the growing firm into a well-<strong>res</strong>pected business.<br />
Production prog<strong>res</strong>s<br />
When Kommer Damen took over in 1969, he introduced<br />
numerous changes to the ship fabrication process. Advances<br />
such as modular construction techniques and series production of<br />
standard designs <strong>res</strong>ulted in considerable increases in efficiency.<br />
Damen’s clients could benefit from shortened delivery times and<br />
flexible vessel configurations.<br />
The subsequent growth since the late 1960s has been as swift<br />
as it was broad. The company’s worldwide coverage developed<br />
with the acquisition of foreign yards and the establishment of<br />
dedicated service cent<strong>res</strong>. The vessel portfolio has grown too<br />
– today the company’s vessels serve an ever-evolving range of<br />
maritime sectors.<br />
A team performance<br />
Looking back at Damen’s success over the years, Chairman<br />
Kommer Damen highlights the contribution made by the<br />
company’s personnel: “I am honoured to celebrate 90 years of<br />
Damen. What started as a small team, has grown into a global<br />
company. And yet – we have achieved this while still retaining<br />
our family values.<br />
“Damen owes its success to the commitment and dedication<br />
that has been invested by our past and p<strong>res</strong>ent employees. It has<br />
always been important that our personnel enjoy their work and it<br />
is their passion that has made the company into what it is today.”<br />
Looking forward<br />
With a view to forthcoming decades, it is essential to note that<br />
Damen is still very much a family-orientated business. Kommer<br />
Damen’s four children all play significant roles in operations:<br />
Arnout Damen is Chief Commercial Officer, Rose Damen is<br />
Commercial Director at Amels, Annelies Damen manages the<br />
corporate properties portfolio, and Bear Damen recently directed<br />
the company’s corporate film.<br />
Never a company to <strong>res</strong>t on its laurels, Damen has always been<br />
defined by its constant forward-thinking strategies. It is this<br />

IMO CONVENTION RATIFICATION,<br />
US TYPE APPROVALS PUT BALLAST WATER REGULATIONS ON THE HOME STRETCH<br />

After an extended period<br />
during which regulations and<br />
technology related to ballast<br />
water management suffered<br />
from misalignment, shipowners now<br />
have greater certainty on international<br />
and regional requirements.<br />
Despite last year’s ratification of<br />
the IMO Ballast Water Management<br />
Convention, the industry continues<br />
to work on twin compliance tracks<br />
to meet IMO and US Coast Guard<br />
rules.<br />
Because an agreement could not<br />
be reached at last October’s IMO<br />
MEPC 70 meeting on implementation<br />
dates for the Convention, this will<br />
be on the agenda for the upcoming<br />
meeting of the MEPC in July 2017.<br />
Member states will consider whether<br />
the effective compliance date should<br />
remain as originally proposed – the<br />
first renewal of the IOPP certificate<br />
after September 2017 – or the first<br />
renewal after September 2019.<br />
Once the entry into force dates for<br />
the IMO BWM Convention have been<br />
agreed, shipowners will have a clear<br />
deadline by which they will need to<br />
install a BWMS. To ease this process,<br />
the IMO has taken several steps to<br />
enable smooth implementation of<br />
the convention.<br />
The revision of the IMO’s G8 Guidelines<br />
The revision of the IMO’s G8<br />
Guidelines was made to add<strong>res</strong>s<br />
concerns with the robustness of the<br />
original standard. These amendments<br />
are intended to provide greater<br />
transparency, a more robust approval<br />
process for BWMS and to add<strong>res</strong>s<br />
weaknesses in the approval process.<br />
The expectation is that owners will<br />
have more confidence that what they<br />
are buying will perform as expected.<br />
Other BWM issues for further discussion<br />
ahead of MEPC 71 include<br />
the concept of an ‘experience building’<br />
phase or action to be taken by authorities<br />
in the period of time immediately<br />
fol<strong>low</strong>ing implementation for vessels<br />
found to be in non-compliance.<br />
The United States does not intend to<br />
ratify the Convention and has adopted<br />
its own ballast water management<br />
regulations. The USCG’s ‘BW<br />
Discharge Standard <strong>Final</strong> Rule’ is<br />
in force and applicable to all vessels<br />
discharging ballast water in US ports<br />
or territorial seas. Ships must be in<br />
compliance with USCG regulations<br />
and also with the requirements of<br />
the US Environmental Protection<br />
Agency. They must additionally<br />
be in compliance with the local<br />
regulations in 16 individual US states<br />
if discharging there.<br />
The principal difference between<br />

the IMO and USCG regimes is that<br />
vessels, ir<strong>res</strong>pective of flag, discharging<br />
ballast in US waters must have a<br />
BWM treatment system which has<br />
been Type Approved by a USCGaccredited<br />
independent laboratory.<br />
Largely due to the lack of US type<br />
approvals - for BWMS, the USCG has<br />
issued more than 10,000 extensions<br />
in <strong>res</strong>ponse to specific applications by<br />
shipowners. These extension letters<br />
must be carried aboard the vessel and<br />
the crew is <strong>res</strong>ponsible for ensuring<br />
that the terms of the extension are<br />
specifically fol<strong>low</strong>ed.<br />
The USCG’s Policy Letter states<br />
that in order to prevent delays to<br />
vessel schedules, the master, owner,<br />
operator, agent, or person in charge<br />
of a vessel is reminded to keep BWM<br />
records onboard the vessel and<br />
immediately available for review by<br />
Coast Guard officials.<br />

Service<br />
When looking for the right BWMS<br />
technology for their unique fleet<br />
profiles, owners and operators must<br />
weigh the technical merits, costs and<br />
benefits of each available alternative.<br />

BWMS technologies.<br />

Evaluation Service, owners and<br />
operators can save time and gain a<br />

by the vendor, all BWMS<br />
that have successfully met the requirements<br />
of the ABS Guide for Ballast<br />
Water Treatment are issued a Product<br />
Design Assessment or Type Approval<br />
Certificate as appropriate.<br />
ABS has seen an increase in the<br />
number of shipowners and operators<br />
seeking advice regarding the<br />
suitability of systems and compliance<br />
strategies. In addition, there has been<br />
an increase in the number of system<br />
manufacturers seeking recognition<br />
from ABS for their technology as<br />
well as a cor<strong>res</strong>ponding increase<br />
in the number of systems seeking<br />
compliance with the ABS Ballast<br />
Water Treatment Guide.<br />

الأمريكية. حيث مت تذكري مشغلي السفن اأنه عند القيام<br />
بتصريف مياه الصابورة يف اأية مياه داخل الوليات املتحدة<br />
الأمريكية، يجب اأن تتم العملية وفقاً لقوانينها.<br />
كما اأصدر خفر السواحل الأمريكية اأكثر من 10 اآلف<br />
متديداً استجابة لتطبيقات حمددة من قبل مالك السفن<br />
وذلك بسبب عدم مصادقة الوليات املتحدة الأمريكية على<br />
قوانني اإدارة مياه الصابورة. ويجب اأن حتُ مل هذه الرسائل<br />
الرشادية على من السفينة ويجب اأن يوؤكد الطاقم املسوؤول<br />
على اتباع شروط التمديد املحددة.<br />
ومت حديثاً تشديد السياسة املتعلقة بتطبيقات الرشاد<br />
بدرجة كبرية بسبب اإصدار خفر السواحل الأمريكي شهادات<br />
اعتماد لثالثة من مالك السفن. وتنص سياسة خفر<br />
سواحل الوليات املتحدة على اأنه يجب تذكري رئيس اأومالك<br />
اأومشغل اأو وكيل اأوالشخص املسوؤول عن السفينة بالإبقاء<br />

دون حدوث تاأخريات يف اجلداول الزمنية للسفينة.<br />

كما يجب على مالك ومشغلي السفن تقدير املزايا<br />
التقنية والتكاليف والفوائد لكل بديل متاح عند البحث<br />

مصادقة اتفاقية المنظمة البحرية الدولية<br />
على قوانين أنظمة مياه الصابورة التابعة للواليات المتحدة األمريكية<br />

اأيقن اأصحاب السفن اأهمية املتطلبات الدولية والإقليمية<br />
بعد عدم التوافق بني قوانني وتكنولوجيا اإدارة مياه الصابورة<br />
والتي استمرت لفرتة طويلة. اإل اأنه وبالرغم من اتفاقية العام<br />
املاضي لإدارة مياه الصابورة التابعة للمنظمة البحرية الدولية،<br />
يستمر القطاع البحري بالعمل على تلبية قواعد املنظمة<br />
البحرية الدولية وقواعد خفر السواحل الأمريكية.<br />
ونظراً لعدم التوصل اإىل اتفاق يف الجتماع السبعني<br />
الذي عقدته املنظمة البحرية الدولية للجنة حماية البيئة<br />
البحرية )MEPC( يف اأكتوبراملاضي بشاأن مواعيد تنفيذ<br />
التفاقية، سيكون هذا على جدول اأعمال الجتماع املقبل<br />
للجنة يف يوليو 2017. وستنظر الدول الأعضاء فيما اإذا<br />
كان ينبغي اأن يظل تاريخ المتثال الفعلي كما اقرتح سابقاً -<br />
وهواأول جتديد للشهادة الدولية ملنع التلوث النفطي وذلك بعد<br />
سبتمر2017 - اأو اأول جتديد بعد سبتمر 2019.<br />
ومبجرد التفاق على موعد بدء تنفيذ اتفاقية اإدارة<br />
مياە الصابورة الصادرة عن املنظمة البحرية الدولية،<br />
سيكون لدى مالك السفن موعد نهائي لتثبيت النظام.<br />
ولتسهيل هذه العملية، اتخذت املنظمة البحرية الدولية<br />
عدة خطوات لتمكني التنفيذ السلس لالتفاقية. ومت تنقيح<br />
القواعد الرشادية ملجموعة G8التابعة للمنظمة البحرية<br />
الدولية والتي عاجلت صالبة القوانني الأصلية حيث<br />
استهدفت التعديالت زيادة الشفافية ومتكني اإدارة مياه<br />
الصابورة من اتخاذ القرارات بالإضافة ملعاجلة نقاط<br />
الضعف يف احلصول على املوافقة مما سيزيد ثقة املشرتين<br />
باأن ما يشرتونه سيوؤدي الوظيفة املطلوبة.<br />
وسيتم مناقشة قضايا اأخرى تتعلق باإدارة مياه الصابورة<br />
يف الجتماع الواحد والسبعون للجنة حماية البيئة البحرية<br />

UAE projects?<br />
We recently supported the Health<br />
Authority in Abu Dhabi (HAAD)<br />
in developing a new certification and<br />
audit methodology for all their listed<br />
hospitals and clinics, called JAWDA Data<br />
Certification ( JDC). Since January 2017<br />
we have successfully executed over 200<br />
JDC audits for HAAD, and we plan<br />
to complete 700 by the end of 2017.<br />
Our organisation has also conducted<br />
numerous workshops in hospitals and<br />
clinics to raise awareness about the<br />
importance of JDC. Furthermore, we have<br />
successfully provided the ISO 9001:2015<br />
quality management system certificate<br />
to Abu Dhabi Autonomous Systems<br />
Investments (ADASI) - one of the first<br />
in the world for the specific sectors of<br />
unmanned systems. Our group is also<br />
carrying out strategic advisory services<br />
for public sector entities.<br />
Can you please tell us more about the<br />
“Healthcare Leadership” Program?<br />
We were chosen to partner with the<br />
International Hospital Federation (IHF)<br />
to offer the Healthcare Leadership<br />
and Management Program to the<br />
Middle East. The new program aims<br />
to raise the confidence of healthcare<br />
professionals, improving the performance<br />
of their organisations by increasing<br />
their competence as leaders. Upon<br />
completion, the candidates will be certified<br />
“Healthcare Leaders” by the International<br />
Hospital Federation, a NGO based in<br />
Geneva, Switzerland.<br />
Do you have an example of new practices<br />
that you have been able to introduce to<br />
the market that deal with local needs?<br />
Our current project with (HAAD) is<br />
an excellent example. Our audits across<br />
Abu Dhabi hospitals and clinics help to<br />
improve the quality of the healthcare sector.<br />
This is in line with our company’s mission<br />
and makes an essential contribution to<br />
the UAE Vision 2021, which aims<br />
to achieve a world-class healthcare<br />
system. Through our R&D team, we are<br />

contributing towards the development<br />
of UAE legislative standards, and have<br />

This “Think Big” approach seems to be so<br />
ambitious. How can this grand vision be<br />
achieved when you are still new to this<br />
business compared with your competitors?<br />
I believe that a company’s most valuable<br />
asset is its employees. Although we are<br />
relatively new to the market, our staff<br />
consist of a professional calibre of people<br />
who are wholly committed to providing<br />
exceptional services to all our clients. We<br />
combine all of our collective experiences<br />
to successfully tackle any challenge that<br />
we may face.<br />
What have been your main challenges and<br />
how were you able to encounter them?<br />
Our main challenges in the certification<br />
business stem from a highly competitive<br />
marketplace and the considerable number<br />
of certification bodies already operating<br />
in the UAE. However, many of these<br />
certification bodies do not fol<strong>low</strong> the<br />
rules of the accreditation body. Not only<br />
do they neglect to count man-days as<br />
stipulated, but their audits are also very<br />
lenient. Unfortunately, it has become a<br />
business to sell certificates.<br />
A key challenge is to explain to clients<br />
that our audits need more man-days than<br />
our competitors due to their strict nature.<br />
However, clients have started to recognise<br />
the value of thorough audits, and how<br />
our recommendations benefit and enhance<br />
their businesses.<br />
What are your expansion plans and<br />
how do you think you can achieve more<br />
profitability?<br />
The best way to achieve greater<br />
profitability is to expand into markets<br />
and services which are currently<br />
underdeveloped. We are focusing our efforts<br />
and <strong>res</strong>ources on R&D projects that will<br />
provide improved outcomes in the future.<br />
<strong>Final</strong>ly, what is your opinion about<br />
empowering Emirati leaders in the<br />
maritime industry and to what extent<br />
could this benefit your business?<br />
We are striving to empower Emirati<br />
leaders not only in the maritime industry,<br />
but also across all other industry sectors<br />
we are involved in. Our organisation<br />
makes significant contributions towards<br />
developing the next generation of Emirati<br />
leaders, through our various training<br />
programs that develop the competency<br />
and skill sets of young Emiratis.<br />

مت تاأسيس "تصنيف لضمان الأعمال" والتي تتخصص<br />
يف توفري خدمات تطبيق معايري اجلودة واإصدار الشهادات<br />
لكل من شركات القطاع العام واخلاص، بشكل يضمن<br />
اأعلى مستويات الأداء لأعمالهم ومنتجاتهم وكوادرهم<br />
البشرية. ومن خالل شراكتنا مع هيئة التصنيف الإيطالية<br />
)رينا(، نعمل كذلك على تقدمي خدمات استشارية وتدريبية<br />
للموؤسسات احلكومية والهيئات التشريعية، وفق اأفضل<br />

Recent hijacks<br />
The latest statistics shows that attempted<br />
piracy was reported across 77 countries<br />
in the 1998¬–2017 period. However, the<br />
intensity of this issue varies significantly<br />
along with the number of pirate hotspots.<br />
Marine piracy hotspots include: a) Malacca<br />
Straits,; b) South China Sea; c) Gulf of<br />

Aden; d) Gulf of Guinea; e) Indonesia;<br />
f ) Gulf of Oman; g) Somalia and Indian<br />
Ocean - an unavoidable marine navigation<br />
routes that highlight the nature of the<br />
problem far more starkly.<br />
During the course of March and April<br />
2017, a considerable number of pirate<br />
attacks and hijackings took place.<br />
Risks arising from Somali piracy won’t<br />
cease unless essential measu<strong>res</strong> will be<br />
taken. The root cause of Somali piracy lies<br />
within economic and political problems of<br />
the region. Somalia lacks effective central<br />
government and is suffering from high<br />
unemployment, drought and famine.<br />
This on-going instability has contributed<br />
towards a surge in piracy. An effective<br />
mechanism of combined anti-piracy<br />
measu<strong>res</strong> should be implemented,<br />
underpinned by the cooperation of the<br />
international community. That would<br />
include naval vessels patrolling, <strong>res</strong>toration<br />
of political security and stability in the<br />
region, humanitarian aid.<br />
A prominent role should be given to ship<br />
owners and operators trading in waters<br />
affected by pirates to adhere to the relevant<br />
measu<strong>res</strong> as RRA (route risk assessment)<br />
planning, compliance with BMP4 (Best<br />
Management Practices for Protection<br />
against Somalia Based Piracy) and use<br />
of armed security personnel on board.<br />
Solutions to reduce piracy<br />
“Implementing the latest anti-piracy<br />
measu<strong>res</strong> and sticking close to the rules<br />
of use of force able to diminish the threat at<br />
sea. By fol<strong>low</strong>ing the BPM4, we can reduce<br />
the frequency of piracy attacks against<br />
our clients’ assets.” Ms.Yakunchenkova<br />
further advised that shipping companies<br />
need to prioritize all the security related<br />
issues in addition to sufficient hardening<br />
facilities installations on ships, training<br />
ship staff on anti-piracy drills, and the use<br />
of appropriately trained and competent<br />
Private Contracted Armed Security<br />
Personnel (PCASP).<br />
In this sense, piracy has opened a window<br />
of opportunity to re-organise maritime<br />
Recent hijacks:<br />
1. On 13th March – Oil Tanker hijacked. MT Aris 13, a Comoros-flagged oil tanker<br />
hijacked en route to Mogadishu from Djibouti. The vessel was released with crew<br />
unharmed.<br />
2. On 31st March, - Dhow hijacked. The dhow Al Kausar and its cargo of rice and<br />
wheat were hijacked en route from Dubai to Yemen, two crewmembers were saved<br />
and nine are missing. The vessel was released after.<br />
3. On 1st April - Cargo vessel hijacked. MV Salama 1 was hijacked by Somali pirates.<br />
4. On 8th April - Cargo vessel, attempted boarding. MV OS-35, had an attempted<br />
boarding by pirates. The vessel was heading from Port Kelang to Aden, Yemen<br />
when it was attacked. The hijack attempt was foiled.<br />
5. 14th April – Pirate attack, attempted boarding. A small boat attempted to board a<br />
vessel off the south-east coast of Yemen. The attack failed, the vessel and the crew<br />
are safe.<br />
6. 15th April – Pirate attack tanker off Bosaso. A product vessel was approached by<br />
a skiff with seven armed men on board, the pirates shot at the tanker and private<br />
maritime security returned fire, causing the skiff to move away, the ship and the<br />
crew reported safe.<br />
7. 16th April – Container ship reported several approaches in Bab Al Mandeb Straight.<br />
Several skiffs approaches occurred in Bab Al Mandeb Straight prompting the<br />
Master to raise the alarm. After the armed security team was sighted on board the<br />
skiffs fled.<br />
8. 18th April – Philippines, coast guards foiled an attack off Zamboanga del Norte. The<br />
Philippines Coast Guard foiled the attack against the cargo vessel.<br />
9. 19th April – South East Asia, Indonesia, robbers board a bulk carrier. When the<br />
robbers boarded, the crew sighted the assailants and raised the alarm. The vessel<br />
and crew are safe.<br />
10. <strong>22</strong>nd April – Somalia, a tanker attacked off Hobyo. MT Costina was attacked by<br />
pirates just six nm off the coast of Somalia's Mudug region. Fol<strong>low</strong>ing a dist<strong>res</strong>s<br />
call, the Spanish flagship ESPS Galicia launched a SH-3D Sea King helicopter and<br />
sailed at full speed towards MT Costina. Pirates broke off their attack and fled.<br />
security governance. It is vital that the<br />
maritime community learns from piracy,<br />
that countries <strong>res</strong>tructure their maritime<br />
sector and sufficient <strong>res</strong>ources be made<br />
available for implementing programmes<br />
that tackle maritime insecurity.<br />
Several recent hijackings and successful<br />
piracy approaches in the Gulf of Aden and<br />
Bab Al Mandeb straight from commercial<br />
vessels rep<strong>res</strong>ent the first notable escalation<br />
of piracy activity since 2012. There are<br />
many other previous incidents that were<br />
not reported, which has created a false<br />
perception that piracy may have been<br />
eradicated. The industry has a <strong>res</strong>ponsibility<br />
to increase ship owners’ awareness of piracy<br />
acts and to help strengthen the security<br />
of commercial shipping.<br />

املخاطر والتهديدات؛ ما جعل "السفينة لالأمن البحري"<br />
شريكاأً موثوقاً يُعتمد عليه يف توفري اخلدمات الأمنية.<br />
عمليات القرصنة االأخرية<br />
وبحسب اخلبراء يف شركة السفينة لالأمن البحري اأظهرت<br />
الإحصائيات اأنه مت الإبالغ عن حماولت قرصنة يف 77<br />
دولة يف الفرتة ما بني 2017-1998. واختلفت اأسباب ومدى<br />
خطورة حوادث القرصنة بحسب النقاط التي يتجمع فيها<br />
القراصنة، حيث يتمركز القراصنة يف مضيق ملقا وبحر<br />
الصني اجلنوبي وخليج عدن وخليج غينيا واإندونيسيا وخليج<br />
عُ مان والصومال واملحيط الهندي، وهي طرق مالحية عالية<br />
اخلطورة ولكن ل ميكن جتنبها.<br />
وليس من املحتمل اأن يتوقف خطر القرصنة القادم<br />
من الصومال اإل اإذا مت اتخاذ تدابري اأساسية حتول<br />
دون القرصنة، اإذ يعود السبب اجلذري وراء القرصنة يف<br />
الصومال اإىل الوضع السياسي والقتصادي يف املنطقة<br />
التي تعاين الصومال من عدم تواجد حكومة مركزية فاعلة،<br />
فضالً عن البطالة والفقر واملجاعة.<br />
وتعتقد ياكونشينكوفا اأن عدم الستقرار املستمر يف<br />
املنطقة سيوؤدي حتماً اإىل زيادة عمليات القرصنة، لذا لبد<br />
من تطبيق اآلية فعالة ملكافحة القرصنة مَ دعومة من قبل<br />
املجتمع الدويل، وهذا يتضمن اإنزال دوريات بحرية تتواجد<br />
يف املناطق الساخنة، لسيما تلك التي ينشط بها القراصنة<br />
الصوماليون، اإضافة اإىل اإعادة الأمن السياسي والستقرار<br />
القتصادي يف املنطقة، وتوفري املساعدات الإنسانية.<br />
وتضيف ياكونشينكوفا اأنه بناء على كل ما سبق، ينبغي<br />
على اأصحاب ومشغلي السفن الذين ميارسون نشاطاً<br />
جتارياً يف املناطق املليئة بالقرصنة اتخاذ التدابريالالزمة<br />
للحماية من القراصنة؛ ومنها على سبيل املثال خمططات<br />
تقييم خماطر الطريق "RRA" واتخاذ اأفضل املمارسات<br />
الإدارية للحماية من القرصنة يف الصومال "BMP4"<br />
وكذلك استخدام عناصر الأمن املسلح على متن السفينة<br />
يف احلالت الضرورية.<br />
حلول للحد من القرصنة<br />
وحول الأساليب التي ميكن استخدامها للحد من القرصنة،<br />
قالت ياكونشينكوفا: "على شركات الشحن اإعطاء الأولوية<br />
جلميع املسائل املتعلقة بالأمن والسالمة، ويجب عليها<br />
تركيب اأجهزة كافية حلماية السفينة، وتدريب طاقمها على<br />
تدابري مكافحة القرصنة، بالإضافة اإىل التعاقد مع شركات<br />
خاصة )PCASP( لتوفري اأفراد اأمن مسلحني يرافقون<br />
الطواقم املالحية يف احلالت اخلاصة.<br />
وتعتبر ياكونشينكوفا اأن حوادث القرصنة، واإن كان لها<br />
جانب سلبي على التجارة وسالمة الطواقم املالحية، اإل اأنها<br />
هيئت فرصة لإعادة تنظيم اإدارة الأمن البحري، ويتوجب<br />
على خمتصي املالحة التعلم من تلك حوادث لتعزيز<br />
اأمن السفن، كما يجب على الدول اإعادة هيكلة قطاعها<br />
البحري، وتوفري املوارد الكافية لتطبيق برامج تعالج حوادث<br />
الأمن البحري.<br />
احلوادث الأخرية للقرصنة يف خليج عدن ومضيق<br />
باب املندب توكد بداية تصعيد جديد غري مسبوق من<br />
القراصنة منذ عام 2012، لسيما واأن هنالك العديد من<br />
احلوادث التي مل يتم الإبالغ عنها، الأمر الذي تسبب يف<br />
الرتاخي واأعطى للبعض انطباعاً خاطئاً باأنه مت القضاء<br />
على القرصنة، وبالتايل ولتفادي وقوع اأية تهديدات يف اأهم<br />
املضائق التي متر منها حركة املالحة البحرية يف العامل،<br />
يجب تكريس املزيد من التوعية لأصحاب السفن حول<br />
حوادث القرصنة، واملساهمة يف دعم جهود توفري اأمن<br />
وسالمة السفن التجارية.<br />

WHY OIL MARKET<br />
ISN’T RECOVERING<br />
FASTER?<br />

As one of the most sensitive<br />
commodities to global change,<br />
the current state of black gold<br />
remains a mystery to scholars.<br />
A gradual build-up of factors including<br />
monopolies, natural disasters, supply and<br />
demand, credit bubbles, market cycles,<br />
global warming and last but not least<br />
geopolitics have all come to bear on oil<br />
prices. These combined dynamics are<br />
far more complex than they in previous<br />
recessions.<br />
The 1973 recession for example was<br />
caused by the by the OPEC members<br />
embargo on the United States, 1979 was<br />
caused by oil <strong>low</strong> output <strong>res</strong>ulting from<br />
the Iranian Revolution and 1990 the Gulf<br />
War. It is clear that previous recessions<br />
were primarily of a geopolitical nature,<br />
but the long list of factors today are more<br />
reminiscent of 2008 and 2015’s recipes<br />
for disaster.<br />
The great recession of 2008 was caused<br />
by a global market collapse with varying<br />
effects from one country to the next,<br />
causing the suspension of many projects.<br />
For oil demand there was a steep drop<br />
from $150/bbl to $32/bbl. A major factor<br />
that many of us have given a blind eye to<br />
which contributed towards the 2008 and<br />
2015 recessions happened to be what I like<br />
to call a man-made natural disaster - the<br />
banking industry. We cannot ignore the<br />
major contribution of bankers and their<br />
notorious behaviour which triggered the<br />
recession with the sub-prime mortgage<br />
crisis.<br />
Whilst the market was still licking its<br />
wounds from 2008, another clunking great<br />
hit came along. A new challenge arose<br />
in the form of shale oil, which affected<br />
market share. This caused significant<br />
impact in 2016 that <strong>res</strong>ulted in job cuts,<br />
tight cash f<strong>low</strong>s, banking panics, and dying<br />
businesses which led to monopolisation.<br />
OPEC’s decision to <strong>res</strong>cue the economy<br />
by cutting its share didn’t have much of an<br />
influence on the market, its contribution<br />
will not have many further affects either<br />
unless the recipe is broken down and at<br />
least one or two ingredients are tossed<br />
away. Bottom line supply and demand and<br />
geopolitics would be the only reasons for<br />
oil price fluctuation and recession in an<br />
ideal business world, but we should all<br />
agree that wars and decreasing demand<br />
are causing shifts that are far too baffling<br />
for anybody to make reliable forecasts.<br />

يعتبر الذهب الأسود لغزاً حمرياً للعلماء مبا اأنه اأحد<br />
اأهم السلع التي تتاأثر بسرعة للتغريات التي حتدث يف العامل<br />
حيث مت مراعاة العديد من العوامل عند النظر يف تقلبات<br />
اأسعار النفط ومنها: سياسة الحتكار والعوامل الطبيعية<br />
والعرض والطلب والقروض الضخمة وتقلبات السوق<br />
والحتباس احلراري واأخرياً وليس اآخراً اجلغرافيا السياسية.<br />
ولكن يبدو اأن الأسباب اليوم اأصبحت اأكثر تعقيداً مما<br />
كانت عليه يف فرتات الركود السابقة.<br />
على سبيل املثال، الركود الذي حدث يف عام 1973 كان<br />
بسبب احلظر الذي فرضه اأعضاء منظمة الدول املصدرة<br />
للبرتول "اأوبك" على الوليات املتحدة الأمريكية. اأما ركود عام<br />
1979 فكان بسبب الثورة اليرانية والتي اأدت اإىل انخفاض<br />
اإنتاج النفط. اأما ركود عام 1990 فرتجع اأسبابه اإىل حرب<br />
اخلليج وتوابعها. ميكننا الستنتاج اأن حالت الركود السابقة<br />
كانت لأسباب جيوسياسية، ولكن عوامل اليوم املذكورة تلعب<br />
دوراً رئيسياً وتعتر موؤشراً حلدوث كارثة.<br />
يعود سبب الركود العاملي يف عام 2008 اإىل انهيار<br />
السوق العاملية التي تفاوتت نتائجها من بلد اإىل اآخر مما<br />
اأدى اإىل توقف املشاريع وانخفاض الطلب على النفط<br />
وبالتايل اأدى اإىل انخفاض حاد يف سعر الرميل من 150<br />
دولراً للرميل اإىل 32 دولراً للرميل الواحد. كما تعتبر<br />
البنوك وسلوكها السيء يف عمليات القروض والتحصيل<br />
اأحد اأهم العوامل الرئيسية التي ساهمت بشكل كبري يف<br />
الركود يف عامي 2008 و2015.<br />
واستطاع السوق اأن يظل متماسكاً يف عام 2008، ولكن<br />
وبسبب الصراعات املستمرة على النفط الصخري واحلصة<br />
يف السوق العاملي يف عام 2016 بالإضافة اإىل خفض فرص<br />
العمل وقلة تدفق العمالت النقدية وذعر البنوك والأعمال<br />
التجارية اأدى ذلك اإىل حدوث ضربة اأخرى اأدت اإىل الحتكار.<br />
وعلى الرغم من اأن "اأوبك" قررت خفض حصتها مل يكن<br />
لذلك تاأثري كبري على السوق حيث اأن مساهمة "اأوبك" لن<br />
يكون لها تاأثري كبري اإل اإذا مت تقسيم املسوؤولية والتخلص<br />
من واحد اأو اثنني على الأقل من الأسباب الرئيسية والتي<br />
سببت انخفاض اأسعار النفط.<br />
لن يكون العرض والطلب واجلغرافيا السياسية سوى<br />
اأسباباً رئيسية اأخرى لتذبذب النفط والركود يف عامل<br />
الأعمال املثايل، وعلينا اأن ناأمل جميعاً اأنه لن يكون هناك<br />
حروب اأخرى ولن ينخفض الطلب الذي يعتر حمركاً رئيسياً<br />
لنخفاض اأسعار النفط.<br />

Originally, the cheapest<br />
available materials were<br />
used on land and at sea, viz.<br />
asbestos to make fire retardant<br />
clothes, insulation and packing<br />
materials, PCBs, TBT, TBTO,<br />
TET in paints and CFC gases<br />
in refrigeration systems, without<br />
assessing the harm they caused to<br />
humans or to the environment.<br />

Many equipment, even today,<br />
still contain heavy metals<br />
such as Mercury, Lead,<br />
Cadmium, Chromium and<br />
Radioactive materials.<br />
Over the years, regulatory p<strong>res</strong>sure (IMO<br />
Resolution MEPC. 269(68) and the Hong<br />
Kong recycling convention) compelled the<br />
marine industry to minimize the use of<br />
potentially hazardous materials in the<br />
construction or operation of a ship and to<br />
maintain an accurate inventory of materials<br />
potentially hazardous to human health and<br />
the environment, so that when ships are<br />
demolished (recycled), these harmful toxins<br />
do not find their way into the local land<br />
based environment.<br />
For new constructions, a document<br />
called “Green Passport” is produced by<br />
the shipyard and contains an inventory of<br />
all materials used in the construction of<br />
each ship, that are considered potentially<br />
hazardous to human health or the<br />
environment. This document is handed<br />
over to the buyer. The subsequent buyers<br />
have to maintain a record of all changes<br />
in materials and equipment and finally<br />
the Green Passport is handed over to the<br />
recycling yard along with the vessel, during<br />
delivery for demolition.<br />
For existing ships, HazMat experts have<br />
to attend and identify each hazardous<br />
material and make an inventory for<br />
each ship.<br />
The “‘Green Passport” has three parts:<br />
(1) Inventory of potentially hazardous<br />
materials used in construction, paint,<br />
plastics; (2) Operationally Generated<br />
Wastes, Oil <strong>res</strong>idues, gases, chemicals;<br />
(3) Sto<strong>res</strong>.<br />
But there is more to Green Shipping<br />
than the Green Passport.<br />
The maritime industry, IMO and local<br />
legislations have continuously contributed<br />
to improve the shipping industry’s carbon<br />
footprint by:<br />
a) Introducing regulations for Ballast<br />
Water Management and Zero Ballast<br />
Systems and No Ballast design of<br />
ships prevent transportation of<br />
sediments and micro-organisms.<br />
b) EECA areas for Low Sulfur fuels<br />
and Scrubber systems to add<strong>res</strong>s<br />
Sulphur emissions with LNG fuel<br />
being promoted as a solution for NOx<br />
and SOx.<br />
c) EEDI for Better hull and propeller<br />
designs, optimum trim, planned<br />
waste heat recovery for better energy<br />
efficiency.<br />
d) Silicon hull paint to reduce water friction<br />
<strong>res</strong>ulting in reduced fuel consumption<br />
and improvement in speed.<br />

شجعت اجلهات التنظيمية مثل :)قرار املنظمة البحرية<br />
الدولية 1(68) MEPC.269 واتفاقية اإعادة تدوير<br />
هونغ كونغ( موؤسسات الصناعات البحرية على التقليل<br />
من استخدام املواد اخلطرة يف بناء اأو تشغيل السفن<br />
واإبقاء املواد اخلطرة على صحة الإنسان والبيئة يف خمازن<br />
متخصصة بحيث لن جتد هذه املواد الضارة طريقها اإىل<br />
البيئة عندما يتم هدم السفن اأو اإعادة تدويرها.<br />
وبالنسبة اإىل املنشاآت اجلديدة، سيتم اإنتاج مستند<br />
ي سم ى "جواز السفر الأخضر" من قبل حوض بناء السفن<br />
حيث يحتوي هذا املستند على جرد جلميع املواد اخلطرة<br />
على صحة الإنسان والبيئة واملستخدمة يف بناء كل سفينة.<br />
وسيتم تسليم هذه الوثيقة اإىل املشرتي ويتعني على املشرتين<br />
الالحقني الحتفاظ بسجل يحتوي على جميع املتغريات<br />
يف املواد واملعدات من ثم تسليم جواز السفر الأخضر مع<br />
السفينة اإىل ساحة اإعادة التدوير.<br />
اأما بالنسبة للسفن احلالية، يتعني على اخلبراء<br />
املتخصصني يف جمال املواد اخلطرة حتديد املواد الضارة<br />
املستخدمة يف صناعة السفن واإنشاء قائمة جلردها.<br />
وسيكون ل" جواز السفر الأخضر" ثالثة اأجزاء:<br />

Taking women on board<br />
as non-executive members<br />
Legal implications can have a serious impact on company balance sheets. You<br />
need to plan ahead, becoming aware of regulations, new laws, international<br />
conventions and the impact these might have on your business<br />

Knowledge is power and this is certainly<br />
true in the maritime industry. I see a great<br />
appetite for legal knowledge with most<br />
CEOs and managers I work with, and it<br />
is increasingly the case that business deals<br />
are considered not just from a financial<br />
perspective but also from the legal side.<br />
Although much has been said about<br />
the Ballast Water Treatment and Sulphur<br />
Conventions there is still much uncertainty<br />
surrounding these regulations, with a<br />
lot more information that needs to be<br />
circulated and shared. I would put my<br />
money on an extension being granted for<br />
the Ballast Water Convention just before<br />
summer, lets watch this space!<br />
I feel that in recent seminars and<br />
publications a lot has already been<br />
said about topics including flag issues,<br />
infrastructure improvements, conventions,<br />
changes to the current UAE Maritime<br />
Law and case law on C/P disputes. I<br />
therefore decided to omit a legal topic<br />
on this occasion and to instead focus on<br />
something else, which I have observed<br />
during my day to day job and which has<br />
troubled me for some time.<br />
The home-grown maritime industry in the<br />
Middle East<br />
The home-grown maritime industry<br />
in the Middle East primarily consists of<br />
family-run businesses and entrepreneurs<br />
who have gained a strong foothold in the<br />
market over the years. Listed companies are<br />
hard to find amongst these usual suspects.<br />
These CEOs, Chairmen and Managing<br />
Directors are often very knowledgeable,<br />
having to take business decisions in the<br />
blink of an eye and often not trusting of<br />
anybody else. Company structu<strong>res</strong> tend<br />
to be hierarchical, with the top not used<br />
to listening to anybody, especially not<br />
an outsider. People who have been at an<br />
organisation for a long time may be trusted<br />
with the belief that no consultant could<br />
add any value. Key decision makers at these<br />
companies are often used to doing things<br />
all themselves and believe that things are<br />
only done properly if they are doing them<br />
themselves, however major or minor the<br />
task may be.<br />
But here is the rub: shipping is on the<br />
cusp of a momentous change, with the<br />
local business community becoming evermore<br />
corporate in recent years. The current<br />
buzzword is ‘disruption’ - this means that<br />
the shipping industry has not changed its<br />
ways over the past 40 years, and it may<br />
be wiped out if the industry as a whole<br />
is not considered in a new way. In order<br />
to look at the big picture an Advisory<br />
Board might help, and adding in Non-<br />
Executive Board members (NEB) would<br />
certainly force any current strategies to<br />
be challenged.<br />
Integrated proposal for the industry<br />
Who would be better to take on such a<br />
task than somebody who is not working<br />
for the company, who can look at your<br />
business from a wholly new perspective and<br />

who might be able to assist the decisionmaking<br />
process? As they are not on the<br />
company payroll they are able to question<br />
a key decision maker in a wholly different<br />
way to an employee.<br />
Whilst you are digesting this proposal,<br />
here is a further one to consider: adding<br />
women as Non-Executive Board members.<br />
You should do so not because the law is<br />
forcing you to, or because it looks like a<br />
good CSR initiative, but because a woman<br />
might be able to look at your business<br />
from a completely different angle. Do you<br />
come from a background that believes that<br />
the women in your life should stay out of<br />
business? Then bring non-family members<br />
in who know what they are talking about<br />
- give this a try, it won’t hurt you!<br />
How to find the right Non-Executive<br />
Board is an altogether different story<br />
however, I would certainly advise to take<br />
your time and spread your net wide and<br />
far. But here is something you should<br />
take into account: in WISTA UAE<br />
(Women’s International Shipping and<br />
Trading Association) we have more<br />
than 60 members drawn from a number<br />
of different shipping and trade related<br />
industries only in the UAE, with a global<br />
membership of more than 3000 members.<br />
Why don’t you give it a go? Think about<br />
what you are looking for and send across<br />
your requirements.<br />

Show me the money:<br />
the new Bankruptcy Law and debt collection in the UAE<br />

At the end of 2016, the UAE finally<br />
adopted the long awaited Bankruptcy<br />
Law (Law No. 9 of 2016). After several<br />
years in the making the new law rep<strong>res</strong>ents<br />
a significant improvement over the old<br />
regime which has previously existed<br />
under the Commercial Code and which<br />
has now been repealed. In this article, we<br />
will consider the impact of the new law on<br />
debt collection in the UAE, which remains<br />
a topical issue in the current commercial<br />
environment.<br />
In the maritime industry, there are two<br />
main ways available to the creditors to<br />
put p<strong>res</strong>sure on the debtor to encourage<br />
prompt(er) payment of a debt: the maritime<br />
ar<strong>res</strong>t of a vessel and a civil attachment<br />
over other types of assets. Both of these<br />
methods are powerful means of extracting<br />
payment (and obtaining security over assets<br />
at the same time), but each one of them has<br />
its own limitations. To ar<strong>res</strong>t a vessel, one<br />
must demonstrate existence of a maritime<br />
debt and to attach assets a creditor must<br />
demonstrate risk of dissipation.<br />
The new Bankruptcy Law adds another<br />
weapon to the arsenal of a debt collector,<br />
that is the ability of a creditor who is owed<br />
a debt of at least AED100,000 that has<br />
become due to serve a demand on the<br />
debtor and to eventually file for the debtor’s<br />
insolvency. The creditor’s right to file for<br />
debtor’s bankruptcy existed under the old<br />
regime, but it had been rarely <strong>res</strong>orted to<br />
due to hazy and complicated insolvency<br />
procedu<strong>res</strong> that put off many creditors<br />
from taking this route.<br />
Advantages of the new bankruptcy law<br />
The new law lays down clear requirements<br />
for creditors’ insolvency applications and<br />
creates what looks like a straightforward<br />
framework for the insolvency proceedings.<br />
To start the insolvency proceedings,<br />
a creditor that satisfies the criterion<br />

mentioned in the previous paragraph must<br />
first serve the debtor with a written demand<br />
issued in accordance with Article 69 of<br />
the Bankruptcy Law demanding payment<br />
of the due debt. The debtor then has 30<br />
working days to pay the debt and if he<br />
fails to do so, then the creditor can file a<br />
bankruptcy application at the Court of First<br />
Instance in the Emirate where the debtor<br />
is located, attaching a copy of the served<br />
demand together with other documents<br />
evidencing the debt.<br />
Therefore, serving a “statutory demand”<br />
can put additional p<strong>res</strong>sure on the debtor<br />
to pay the debt within 30 days. Before<br />
serving the demand the creditor must<br />
consider whether he is in fact prepared<br />
to start the insolvency proceedings against<br />
the debtor so as to avoid making empty<br />
threats, which can only undermine the<br />
recovery efforts. The creditor must weigh<br />
up the advantages and disadvantages of<br />
starting insolvency proceedings (which<br />
will include both legal and commercial<br />
considerations) before serving the demand.<br />
The creditors must also avoid using this<br />
process for claims which are not genuine<br />
matured and undisputed debts.<br />
Another inte<strong>res</strong>ting featu<strong>res</strong><br />
Another inte<strong>res</strong>ting feature of the new<br />
Bankruptcy Law that is relevant to debt<br />
collection relates to claims arising from<br />
bounced cheques. It is well known that<br />
a bounced cheque can <strong>res</strong>ult in criminal<br />
liability for the issuer in the UAE. The<br />
new law enables the debtor to apply for<br />
suspension of the criminal proceedings if<br />
protective composition or <strong>res</strong>tructuring<br />
proceedings are underway and eventual<br />
cancellation of criminal proceedings once<br />
these proceedings are completed. From<br />
the debt collection perspective, this<br />
is a positive development as it should<br />
encourage the debtors to take steps to<br />
<strong>res</strong>tructure their business affairs instead<br />
of facing jail or fleeing the country, both<br />
of which outcomes severely diminish the<br />
likelihood of the debt being ever paid.<br />
Of course it remains as important as<br />
ever before starting the debt collection<br />
process to check whether the debtor has<br />
any assets available for recovery to avoid<br />
throwing good money after bad.<br />
The new Bankruptcy Law applies to<br />
companies established under the UAE<br />
Commercial Companies Law and to free<br />
zone companies except those incorporated<br />
in the DIFC and ADGM free zones which<br />
have their own insolvency regimes. It also<br />
applies to individual traders but it does<br />
not apply to private bankruptcies.<br />
It is too early to comment on the<br />
practical application of the law in the<br />
UAE courts, but the door has now been<br />
opened for the business community to<br />
use the new procedu<strong>res</strong>.<br />

In maritime industry legal falls in the<br />
very important part of it. Discussing many<br />

courts to the UAE Court’s approach to<br />
LNG’s claims over OWB’s receivables and<br />
the Role of the new Emirates Maritime<br />
Arbitration Centre and how UAE and/or<br />
Fujairah bunkering and offsho<strong>res</strong> industries<br />
can use EMAC. Jasmin Fichte, Managing<br />
Partner, Fichte & Co and P<strong>res</strong>ident of<br />
WISTA, UAE clarified that in UAE there<br />
is no certain approach when it comes to<br />
LNG’s claims over OW bunker there is<br />
only the application of law and the decision<br />
of the Supreme Court. Fichte highlighted<br />
“At the moment there is not much to say,<br />
we had one Supreme Court decision and<br />
we are expecting two more coming in the<br />
next few months if they are not postponed<br />
and we are expecting a clash between the<br />
decision makers and the law.”<br />
Fichte also pointed out that the bunker<br />
industry for 2017 will be inte<strong>res</strong>ting.<br />
According to the live poll that took place<br />
in the conference, 40% of attendees voted<br />
there will be changes but till now they aren’t<br />
fully witnessed. “As ships need bunker so<br />
they have to deal with the current situation.<br />
Ships owners were looking at the price but<br />
now they are looking at the consequences,”<br />
added Fichte.<br />

Main challenges faced by ship owners<br />
Suha Obaid, Strategic planning Director,<br />
Folk shipping LLC shared her concerns<br />
about having the risk of being ar<strong>res</strong>ted<br />
for a bunker of a maximum value of 200<br />
thousand dollars because the contractual<br />
and the physical supplier are having issues<br />
between them. She also highlighted<br />
that, the OW bunker case has opened<br />
shipyowners’ eyes to such incidents that<br />
might occur to them or anybody else and<br />
“I need to make sure that I am protected<br />
as a ship owner.”<br />
Obaid also emphasized on the necessity<br />
of taking an action by Emirates Maritime<br />
Arbitration Centre “EMAC”, governments<br />
and courts to prevent the risk of an ar<strong>res</strong>t<br />
that might occur on the vessel, as the ship<br />
owner has nothing to do with the physical<br />
supplier if there is no direct contract<br />
between them.<br />
Environmental regulations and compliance<br />
The decision to implement a global<br />
sulphur limit of 0.50% in 2020 was<br />
taken by the International Maritime<br />
Organization (IMO), the regulatory<br />
authority for international shipping,<br />
during its Marine Environment Protection<br />
Committee (MEPC), meeting for its<br />
FUJCON has raised Fujairah’s<br />
profile as an internationally recognized<br />
service anchorage, being the world's<br />
second largest bunkering hub for both<br />
oil storage and oil product supply<br />
70th session in London. It rep<strong>res</strong>ents a<br />
significant cut from the 3.5% global limit<br />
currently in place and demonstrates a clear<br />
commitment by IMO to ensuring shipping<br />
meets its environmental obligations.<br />

that there are mixed feelings about the<br />
new sulphur cap requirements as some<br />
people are very comfortable with it and<br />
some might not feel the change as it is<br />
hard for them to handle all the current<br />
regulations and adding something new on<br />
the ground will bring more complexity.<br />
The views are also <strong>res</strong>onated where over<br />
30% of the <strong>res</strong>pondents who participated<br />
in a live poll said there would be some<br />
degree of non-compliance with the<br />
related emission control area (ECA) cap<br />
by 2020. Although, they were specifically<br />
<strong>res</strong>ponding to compliance in ECA, this<br />
might be indicative of how things might<br />
look like in non ECAs, if one were to<br />
extend the sampling group. “Of course,<br />
we have to take care of the environment<br />
and the next generation but we must be<br />
reasonable o the industry,” added Gamal<br />
Fekry, the CEO of Red Sea Marine<br />
Management DMCC.<br />

لدفع غرامات من املمكن اأن تصل اإىل 200 األف دولر بسبب<br />
نزاع بني املتعاقد وموردي النفط. كما اأشارت اإىل اأن استطاع<br />
قطاع تزويد السفن بالوقود والنفط اأن يلفت نظار مالكي<br />
السفن ملثل هذه احلوادث التي قد حتدث لهم اأو لأي شخص<br />
اآخر. واأضافت "اأنا بحاجة للتاأكد من اأنني حممية كمالك<br />
للسفينة".<br />
اأكدت عبيد اأيضاً على اأنه من الضروري اأن يتخذ كل من مركز<br />
الإمارات للتحكيم البحري "EMAC" واحلكومات واملحاكم<br />

املتحدة، يستمر ملتقى الفجرية الدويل للتزود بالوقود والنفط<br />
"فوجكون 2017" لعامه العاشر على التوايل. حيث ناقش<br />
امللتقى حتديات قوانني املنظمة البحرية الدولية التي يجب اأن<br />
تُطبق بحلول العام 2020.<br />
كما شارك يف امللتقى الذي تنظمه منطقة الفجرية للصناعة<br />
البرتولية "فوز" حتت شعار "قيادة التحول عر موردي تزويد<br />
السفن بالوقود" ما يقارب 400 مندوب من اأكر من 50 دولة<br />
من دول العامل اإىل جانب ممثلني عن منظمات وشركات معنية<br />
بسوق النفط. كما اأسهم هذا احلضور الباهر يف دعم صورة<br />
الفجرية كثاين اأكر مركز لتزويد الوقود يف العامل واإمداد<br />
النفط الالزم ملختلف الصناعات. حيث تبادل اخلراء مع<br />
احلضور وجهات نظرهم وحتليالتهم حول تطورات الأسواق<br />
العاملية لتجارة تزويد السفن بالوقود واأحدث الجتاهات<br />
والتحديات التي تواجه هذه الصناعة، اإضافة اإىل مناقشة روّاد<br />
صناعة القرار واخلراء تاأثري واإعداد متطلبات اتفاقية املاربول<br />
لتوفري الوقود منخفض الكريت التي سوف تطبق يف 2020.<br />
اآراء اخلرباء من الناحية القانونية<br />
تعتر القوانني والتشريعات اأهم العناصر يف قطاع الصناعة<br />
البحرية حيث ناقشت جاسمني فيشت وهي الشريك اإداري يف<br />
شركة فيشت وشركاه العديد من املواضيع املختلفة ابتداءاً من<br />
حماكم قطاع تزويد السفن بالوقود اإىل نهج حمكمة الإمارات<br />
العربية املتحدة حول مطالبات سفن الغاز الطبيعي املسال<br />
لعائدات قطاع تزويد السفن بالوقود واأيضاً دور مركز الإمارات<br />
للتحكيم البحري اجلديد وكيف ميكن لقطاع التموين يف<br />
الإمارات والفجرية والصناعات البحرية الستفادة منه. وقالت<br />
"ل يوجد نهج معني يف دولة الإمارات العربية املتحدة يتعلق<br />
مبطالبات سفن الغاز الطبيعي لعائدات قطاع تزويد السفن<br />
بالوقود بل يوجد التطبيق العملي للقانون وقرار املحكمة<br />
العليا". كما اأضافت فيشت: "ل منلك الكثري من املعلومات<br />
حالياً، حصلنا على قرار واحد من املحكمة العليا ونحن<br />
بانتظار قرارين اآخرين سيصدران يف الشهور املقبلة يف حال<br />
مل يتم تاأجيلهما ونتوقع حدوث خالف بني القانون وصانعي<br />
القرار". ويف سياق اجللسة احلوارية، توقَ ع 40% من احلاضرين<br />
حدوث بعض من التغريات ولكن اإىل الآن مل يشهد القطاع اأياً<br />
منها حيث حتتاج الناقالت للتزويد بالوقود ولذلك يجب على<br />
مالك السفن التعامل مع الوضع احلايل.<br />

our highest priority on the reality of the<br />
turbulent path to an oil market recovery.”<br />
The discussions on the oil and gas<br />
industry outlook assumed increased<br />
significance amid improved sentiments and<br />
optimism fol<strong>low</strong>ing demand growth to 1.5<br />
million b/p and strong refining margins.<br />
Oil recently edged be<strong>low</strong> $52 a barrel as<br />
rising crude output and drilling in the<br />
US countered OPEC-led production cuts<br />
aimed at clearing a supply glut. Experts<br />
at the MPGC conference said US output<br />
gains are limiting the impact of efforts led<br />
by the OPEC to cut output by almost 1.8<br />
million barrels per day for six months until<br />
June to banish a persistent glut.<br />
OPEC may need to keep a lid on its<br />
production<br />
Dr.Fereidun Fesharaki, Chairman of<br />
consultants at FGE emphasized “While<br />
a six-month deal was initially envisaged,<br />
OPEC may need to keep a lid on its<br />
production until well into 2018. The cuts<br />
will have to be extended even beyond this<br />
year to the middle or even the end of<br />
next year.”<br />
Saif Humaid Al Falasi, Group CEO<br />
of ENOC and Co-Chairman of MPGC<br />
2017, said: “Oil remains the key contributor<br />
to the direction of GCC markets for the<br />

second consecutive year, after the oil output<br />
cut agreement was sealed. With oil prices<br />
surging to an 18-month high by year-end<br />
2016, the priority for GCC economies<br />
will be to sustain a balanced budget for<br />

the impact of volatile price environment<br />
and strict sustainability targets on the<br />
energy industry, National Oil Companies<br />
are looking at alternative models of doing<br />
business.”<br />
Global and Middle East Geopolitics and<br />
Economics<br />
Ongoing political and social un<strong>res</strong>t in<br />
the Middle East, ever-increasing domestic<br />
oil production, and unpredictability in<br />
P<strong>res</strong>ident Donald Trump’s administration<br />
are all shaping a fluid geopolitical<br />
environment that will certainly impact<br />
the global energy market.<br />
The OPEC deal has affected the market<br />
by keeping prices from further failure.<br />
Edward Bell, Director of Commodities<br />
<strong>res</strong>earch in Emirates NBD said “Compared<br />
with 2016 volatility, the market has almost<br />
vanished as OPEC and shale set the<br />
bottom and top of the market <strong>res</strong>pectively,”<br />
Bell also added that OPEC strategy from<br />
Oil remains the key contributor to the direction<br />
of GCC markets for the second consecutive year,<br />
after the oil output cut agreement was sealed"<br />
2014 till 2016, as promoted by major GCC<br />
members, was to target market share at the<br />
expense of price. However, Middle East’s<br />
sha<strong>res</strong> of global oil trade has fallen more<br />
than 10% in the past 20 years to take up<br />
34% in 2015 compared with 44% in 1995.<br />
Risk management for crude oil trading<br />
Crude oil is vital for human being and<br />
the fluctuations in prices are causing a lot of<br />
challenges. Recently, oil prices have settled<br />
a bit higher, but still registered a weekly<br />
and monthly loss. This remains a sign of<br />
further gains in the U.S. crude output and<br />
will raise doubts over OPEC’s extension<br />
of output cuts. Mr.Owain Johnson, the<br />
Managing Director of DME/CME group<br />
pointed out that if OPEC and others cut<br />
output, the market will rebalance. Middle<br />
East share is falling that’s why sellers are<br />
seeking to maximize the value.<br />
Commenting on the growth of LNG<br />
markets, Fesharaki said “The LNG market<br />
is growing very fast as the supply is growing<br />
faster than demand. In the oil market,<br />
supply and demand is growing similarly<br />
but in the LNG market, market players<br />
will have 5 or 6 years of problems before<br />
they adjust.”<br />
OPEC and participating non-OPEC<br />
countries are expected to meet on May 25<br />
to discuss whether to extend the output<br />
reduction. Given that inventories remain<br />
high and prices are half their mid-2014<br />
level, OPEC members, including top<br />
exporter Saudi Arabia, support prolonging<br />
the curbs. The International Energy<br />
Agency said in its latest monthly market<br />
report that oil stocks in industrialized<br />
countries were about 336 million barrels<br />
above the five-year average.<br />

على موازنات دول اخلليج العربي بشكل خاص، قال سعادة<br />
سيف حميد الفالسي، الرئيس التنفيذي ملجموعة "اينوك":<br />
"اعتبر النفط دوماً مساهم رئيس لتوجهات اأسواق<br />
منطقة دول جملس التعاون اخلليجي للعام الثاين على<br />
التوايل، وبعد بدء تنفيذ اتفاقية خفض اإنتاج النفط، ناأمل<br />
اأن تتمكن اقتصادات اخلليج من املحافظة على ميزانيات<br />
متوازنة بحلول العام 2020. ويف ضوء التقلبات التي عانى<br />
منها السوق، فمن املتوقع اأن نشهد عجزاً يف امليزانيات خالل<br />
العامني املقبلني، ويجب اأن تسعى شركات النفط الوطنية اإىل<br />
مناذج بديلة لأداء الأعمال".<br />
االقتصاد واجليوسياسة يف الشرق االأوسط والعامل<br />
ل ميكن اأن يتم تناول الضطرابات يف اأسعار النفط من<br />
دون النظر اإىل الضطرابات السياسية والجتماعية املستمرة<br />
يف الشرق الأوسط والتي تشكل عامالً رئيساً يوؤثر على<br />
اإنتاج النفط، اإضافة اإىل عدم القدرة على تنبوؤ سياسة اإدارة<br />
الرئيس دونالد ترامب، كل ذلك يخلق بيئة جيوسياسية هشة<br />
توؤثر وبشكل كبري على سوق الطاقة العاملية.<br />
وقد ساهمت اتفاقية اأوبك باحلفاظ على اأسعار النفط<br />
من النخفاض بشكل اأكبر. وقال اإدوارد بيل، املحلل يف بنك<br />
الإمارات دبي الوطني: "شهدت السوق انحداراً كبرياً يف<br />
الأسعار باملقارنة مع الأسعار يف عام ". 2016 واأضاف: "اإن<br />
حافظ النفط على مكانته كمساهم رئيسي لتوجهات<br />
أسواق منطقة دول مجلس التعاون الخليجي للعام الثاني على<br />
التوالي بعد بدء تنفيذ اتفاقية خفض إنتاج النفط"<br />
اسرتاتيجية اأوبك منذ عام 2014 حتى عام 2016 ركزت<br />
على حصتها يف السوق على حساب السعر بحسب ما صدر<br />
عن دول جملس التعاون اخلليجي. ومع ذلك، انخفضت<br />
حصة الشرق الأوسط يف سوق النفط العاملية اإىل اأكر من 10<br />
باملئة يف السنوات ال 20 املاضية لتصل اإىل 34 باملئة يف عام<br />
2015 مقارنة مع 44 باملئة يف عام 1995".<br />
جتارة النفط اخلام مقابل الغاز الطبيعي<br />
من جهته علق السيد فيشاراكي على منو قطاع الغاز<br />
الطبيعي املسال قائالً: "يواجه سوق الغاز الطبيعي منواً<br />
سريعاً بسبب تزايد نسبة العرض على الطلب. يف حني اأن<br />
العرض والطلب يتماثالن يف سوق النفط. وسيحتاج قطاع<br />
الغاز الطبيعي اإىل وقت اأطول لستعادة توازنة مقارنة<br />
باأسواق النفط".<br />
ومن املتوقع اأن تلتقي دول اأوبك الأعضاء والدول غري<br />
الأعضاء بتاريخ 25 مايو ملناقشة اإمكانية الستمرارية يف<br />
التقليل من الإنتاج. لسيما واأن املخزونات ما زالت مرتفعة<br />
يف حني اأن الأسعار لزالت تراوح عند نصف مستواها مقارنة<br />
بعام 2014، فاإن اأعضاء منظمة اأوبك، مبا يف ذلك اململكة<br />
العربية السعودية، جميعهم يدعمون الستمرار يف تخفيض<br />
الإنتاج. وقالت الوكالة الدولية للطاقة يف التقارير الشهرية<br />
الأخرية، بلغت خمزونات النفط يف البلدان املصنعة حوايل<br />
336 مليون برميل وهو اأعلى معدلت لها خالل 5 سنوات، ما<br />
يجعل من خفض الإنتاج خياراً اسرتاتيجياً يف املرحلة املقبلة<br />
مهما تزايد الإنتاج من قبل دول اأخرى يف العامل.<br />

وحول تشخيص الوضع احلايل واآثاره العميقة على دول<br />
املنطقة، قال سمو الشيخ اأحمد بن سعيد اآل مكتوم، رئيس<br />
هيئة دبي للطريان املدين، رئيس مطارات دبي، الرئيس الأعلى<br />
ملجموعة طريان الإمارات، رئيس املجلس الأعلى للطاقة<br />
يف دبي: "شهدت املنطقة بال شك منواً هائالً يف العقدين<br />
املاضيني يف ظل عائدات قطاع الطاقة، ولكننا ندخل الآن<br />
حقبة جديدة وينبغي علينا فيها اإعادة النظر بحكمة يف<br />
القطاع. علينا اأن نسلط الضوء على السبب الرئيس وراء<br />
املسار املضطرب لتعايف اأسواق النفط".<br />
وعلى الرغم من اأن النقاشات حول مستقبل قطاع النفط<br />
والغاز افرتضت اأنه سيكون هناك زيادة واضحة يف اأسعار<br />
النفط، وسط مشاعر من التفاوؤل بعد الرتفاع امللحوظ على<br />
الطلب بنسبة 1.5 مليون برميل وهوامش التكرير، اإل اأنها<br />
انخفضت موؤخراً اإىل اأقل من 52 دولراً للرميل حيث اإن<br />
ارتفاع اإنتاج النفط اخلام والتنقيب عنه يف الوليات املتحدة<br />
الأمريكية تعارض مع سياسة اأوبك لتخفيض الإنتاج بهدف<br />
التقليل من العرض. وقال اخلراء يف موؤمتر الشرق الأوسط<br />
للنفط والغاز اأن مكاسب اأمريكا حتد من تاأثري جهود اأوبك<br />
للتقليل من الإنتاج بنسبة 1.8 مليون برميل يف اليوم الواحد<br />
وملدة 6 اأشهر حتى يونيو للتقليل من زيادة الإنتاج.<br />
اأوبك حتتاج اإىل التمسك بسقف لالإنتاج<br />
حول حتديد سقف ثابت لإنتاج النفط يف اأوبك، قال<br />
السيد فريدون فيشاراكي رئيس جملس اإدارة اإف.جي.اإي<br />
لالستشارات: "يف ظل اأنه من املمكن توقع اإبرام اتفاق ملدة<br />
ستة اأشهر من قبل اأعضاء منظمة اأوبك، على هذه الدول<br />
املحافظة على سقف اإنتاجها حتى عام 2018. حيث يجب<br />
الستمرار بالتقليل من الإنتاج اإىل نهاية هذا العام ورمبا اإىل<br />
منتصف العام املقبل اأو اإىل نهايته".<br />

ADVANCES IN SATCOM<br />
ON-THE-MOVE TESTING<br />

The Satcom On-The-Move (SOTM) market has<br />
experienced a rapid growth in recent years. In situations<br />
where no ter<strong>res</strong>trial communication infrastructure exists<br />
(e.g. disaster scenarios), SOTM systems rep<strong>res</strong>ent one<br />
of the best solution. SOTM is a strong candidate in<br />
many other applications such as <strong>news</strong> gathering, mobile TV,<br />
public security, <strong>res</strong>cue, maritime, aeronautical and military<br />
applications. However, the maritime market sector has proven<br />
to be the biggest and the most experienced through a vast<br />
number of applications amongst which are offshore oil and<br />
gas industry, <strong>res</strong>cue and entertainment.<br />
In a SOTM application, the terminal is mounted on a moving<br />
platform and has to keep connected to a desired satellite albeit<br />
being on-the-move. This imposes the biggest challenge not<br />
only to SOTM system manufacturers who need to equip their<br />
terminals with a decent tracking unit but also to the satellite<br />
operators who need to insure that their satellite networks are<br />
not harmed by adjacent satellite interferences caused by suboptimal<br />
terminals which do not belong to their legitimate clients.<br />
SOTM testing application<br />
SOTM Testing is currently performed either in a free field<br />
or in a laboratory. In the free field, the terminal is tested on a<br />
vehicle moving along a certain track. At least two operational<br />
satellites need to be involved. One satellite acts as the target<br />
satellite and the other acts as the adjacent one. Based on the<br />
a-priori knowledge of the antenna pattern, the antenna depointing<br />
estimation is possible. Although the free field enables<br />
testing the complete terminal as it will be used by the customer,<br />
it does not guarantee a repeatable or a cost efficient way of<br />
testing since operational satellites need to be hired. On the<br />
other hand, testing the SOTM terminal in a laboratory offers<br />
the opportunity for a cost efficient test in repeatable conditions.<br />
FORTE enables the emulation of the full reality around the<br />
SOTM terminal through the usage of satellite payload emulators,<br />
a 3-axis motion emulator, channel emulators and a GPS emulator.<br />
At FORTE, a two dimensional sensor array mounted on the<br />
antenna tower enables the estimation of antenna de-pointing<br />
with a very high degree of precision. A block diagram with<br />

the full structure of FORTE is shown in Figure 2.<br />
One of the main advantages of FORTE is that SOTM tests<br />
are performed on standard motion profiles for the maritime and<br />
the land mobile environments. The standard motion profiles<br />
define a clear reference for testing and offer a fair basis of<br />
comparison between different SOTM terminals. Before the<br />
definition of the standard motion profiles, a terminal with a<br />
sophisticated tracking unit can fail to be approved if it was tested<br />
on an extremely tough terrain. On the other hand, a terminal<br />
with a poor-performing tracking unit can pass the same type<br />
approval if it was tested on a paved terrain. Fraunhofer IIS<br />
aims in the future at extending the motion profile manifold<br />
by developing standard motion profiles for the aeronautical<br />
and the high speed train environments.<br />

EPAK GmbH and its DSi6 SOTM antenna<br />
EPAK GmbH has developed the DSi6 SOTM antenna to<br />
be used for maritime applications. The antenna has a 60 cm<br />
dish and is operating in Ku-band. It is equipped with a 3-axis<br />
tracking unit, to be able to track in azimuth, elevation and skew.<br />
The antenna has been tested at FORTE where its performance<br />
and abilities have been demonstrated. Figure 3 shows the DSi6<br />
antenna mounted on the motion emulator at FORTE.<br />
The tests were performed according to the GVF<br />
recommendations (GVF-105) and the type approval<br />
specifications of EUTELSAT (EESS-502 and ESOG-120).<br />
The DSi6 antenna was able to demonstrate its compliance<br />
to the pointing requirements for EUTELSAT. The antenna<br />
de-pointing does not exceed 0.4° on the maritime standard<br />
motion profiles. Figure 4 depicts the de-pointing estimation<br />
<strong>res</strong>ults along azimuth and elevation when the antenna was<br />
tested on the maritime class A motion profile. The class A<br />
motion profile has a maximum angular rate of 27 °/s and a<br />
maximum angular acceleration of 154 °/s2.<br />
