PREEMINENCIA DE LOS <strong>DERE<strong>CH</strong>OS</strong> ‣ La Constitución establece que los actos contrarios a los derechos humanos son nulos y dan lugar a la responsabilidad de los agentes estatales que los ordenen o ejecuten, "sin que les sirvan de excusa órdenes superiores" (CRBV, artículo 25)
PRINCIPIO DE PROGRESIVIDAD E IRREVERSIBILIDAD ‣ Este principio se traduce en la prohibición general a los Estados de desmejorar los logros que en materia de derechos humanos, han sido producto de la evolución progresiva de los mismos. El Estado tiene la obligación de aplicar las normas más favorables a los derechos humanos, y de no retroceder desconociendo los progresos consagrados en las normas nacionales e internacionales (CRBV, artículo 23).
