Entscheidungsformel
Aus diesen Gründen wird entschieden,
die der Großen Beschwerdekammer
vorgelegten Rechtsfragen
wie folgt zu beantworten:
1. Da Regel 140 EPÜ nicht zur Berichtigung
des Wortlauts eines Patents herangezogen
werden kann, ist ein Antrag des
Patentinhabers auf eine solche Berichtigung
zu jedem Zeitpunkt unzulässig,
also auch nach Einleitung des Einspruchsverfahrens.
2. In Anbetracht der Antwort auf die
erste Vorlagefrage erübrigt sich eine
Beantwortung der zweiten Vorlagefrage.
Order
For these reasons, it is decided to
answer the questions of law which
were referred to the Enlarged Board
of Appeal as follows:
1. Since Rule 140 EPC is not available
to correct the text of a patent, a patent
proprietor's request for such a correction
is inadmissible whenever made,
including after the initiation of opposition
proceedings.
2. In view of the answer to the first
referred question, the second referred
question requires no answer.
Dispositif
Par ces motifs, la Grande Chambre de
recours décide d'apporter les réponses
suivantes aux questions de droit
qui lui ont été soumises :
1. Etant donné que la règle 140 CBE
ne permet pas de rectifier le texte d'un
brevet, une requête formulée par le
titulaire d'un brevet aux fins d'une telle
rectification est irrecevable quel que
soit le moment où elle est présentée,
y compris après qu'une procédure
d'opposition a été introduite.
2. Compte tenu de la réponse à la
première question soumise, la deuxième
question soumise n'appelle aucune
réponse.
