Registered Designs<br />

Our firm successfully represent clients in registered design disputes.<br />

A registered design is a monopoly for a design (for example a tread<br />

pattern) when applied to an article (for example a tyre) and is<br />

granted under the laws of a country the registered design is filed in.<br />

A registered design protects the way a product looks.<br />

The registered design allows the owner of that design to grant access<br />

to, or exclude others from, making, selling, offering for sale or hire the<br />

design protected by the registered design. The exact monopoly the<br />

design covers is contained in the drawings in the registered design.


Trademarks and Copyrights<br />

Trademarks are letters, digits, words, images, symbols or a<br />

combination thereof, which are used by manufacturers or service<br />

providers in order to identify their goods and services to the<br />

consumers.<br />

The registration of the mark confers upon its owner the exclusive use<br />

of the mark in relation to the products or services for which it is<br />

registered; it also serves to protect the public against deception<br />

regarding the origin of the goods/services in question.


Applications are filed to the trademarks department where they<br />

await examination according to their filing dates (as of today the<br />

waiting period is 12-15 months of receiving the application).<br />

Trademark examiners check the legitimacy of the application with<br />

accordance to the Trade Marks Ordinance [New Version] 5732-1972;<br />

the Trademark Regulation 1940 as well as with official work<br />

guidelines.<br />

Trademarks and service-marks are initially registered for a 10 year<br />

period and must be renewed on or about the 10-year anniversary of<br />

the trademark registration.


The registration of a trademark in Israel only provides territorial<br />

protection, and is applicable only under Israeli jurisdiction.<br />

Today, due to the joining of Israel to the Madrid protocol, an Israeli<br />

applicant may submit a single trademark application, which can<br />

automatically apply in over 90 countries around the world. The filing<br />

is done under the "Madrid system", which is operated and managed<br />

by WIPO (World Intellectual Property Organization).<br />

The Madrid system facilitates the registration process, and also saves<br />

the costs of filing and further maintaining the mark. The international<br />

application is based on a national application or on a national<br />

registration.

consumer product trademarks, business names, trademark dilution,<br />

trademark counterfeiting, false advertising, etc.


Trade Secrets<br />

Broadly speaking, any confidential business information which<br />

provides an enterprise a competitive edge may be considered a<br />

trade secret. Trade secrets encompass manufacturing or industrial<br />

secrets and commercial secrets.<br />

The unauthorized use of such information by persons other than the<br />

holder is regarded as an unfair practice and a violation of the trade<br />

secret.


Depending on the legal system, the protection of trade secrets forms<br />

part of the general concept of protection against unfair competition<br />

or is based on specific provisions or case law on the protection of<br />

confidential information.<br />

The subject matter of trade secrets is usually defined in broad terms<br />

and includes sales methods, distribution methods, consumer profiles,<br />

advertising strategies, lists of suppliers and clients, and<br />

manufacturing processes.


While a final determination of what information constitutes a trade<br />

secret will depend on the circumstances of each individual case,<br />

clearly unfair practices in respect of secret information include<br />

industrial or commercial espionage, breach of contract and breach of<br />

confidence.<br />
