Richard Ryles has become a member of the firm now
known as Rosenthal, Levy, Simon & Ryles, P.A. uniting two
strong practices into one unstoppable team. Ryles, a third
generation West Palm Beach resident, brings to the firm his
vast experience in the area of negligent security. Negligent
security lawsuits are asserted by individuals who were attacked
or victimized, most often on business property. Ryles has
represented many local residents in personal injury and police
brutality cases, including the $2.1 Million settlement for the
survivors of the Rosewood Massacre.
After attending the University of Illinois and San Jose State University Richard went on to
earn his law degree from Howard University. He returned to West Palm Beach to start his

Jury Awards $400,000 to
Victim of Uninsured Motorist
Driving home from work four years ago, our client
Sam Green (not his real name) was injured
when a driver rear-ended his car and fled. He
chased the offending driver off I-95, where the
driver stopped and told Sam that he carried no
insurance and was leaving. Sam reported the
accident to the police and drove home. He began
experiencing headaches, neck pain, back
pain, and shoulder pain so severe his wife had
to take him to the emergency room.
Sam was devastated by this piece of bad
luck. He had been injured on the job just 14
months earlier. He was recovering from the first
neck and shoulder injury when the new blow
occurred. Not only did his neck and shoulder
grow worse, but he also developed a lower
back problem. His injuries made it impossible
for him to return to his position as an automobile
painter.
Sam knew he was in trouble. But when he reported
all this to Allstate, the company that had
insured him for nearly 30 years without a single
claim, he was astounded by the response. Sam
had coverage of $100,000 for Uninsured/Underinsured
motorist protection with Allstate for
just this sort of situation — to protect himself
and his family if they were ever injured by a driver
with insufficient insurance or one like the hitand-run
driver who was nowhere to be found.
But the one and only time that Sam needed the
benefits he had paid for year after year, Allstate
let him down. They denied. They delayed.
Despite his many attempts to get Allstate to do
the right thing and pay him his limited benefits,
they refused.

Levy, who filed suit and fought for his injured
client against Allstate for nearly two years.
Working closely with Sam’s doctors, Levy
documented the countless hours of testing,
treatment and physical therapy Sam had
already endured. In the three day trial, he also
presented the jury with the treatment needed
for Sam’s future medical care. Sam had
already suffered through four epidural injections
and faced a future of more injections,
more therapy, more medication and possible
surgery. Though he had always loved his
job, he was now 60 years old and had been
unable to work since the hit-and-run. His
work had given him purpose and satisfaction
in being able to provide for his family. Now he
was depressed and doubted anyone would
ever hire him.
The Palm Beach County jury came down
firmly on Sam’s side, awarding him every
dollar he owed his doctors, money for future
medical care, lost wages for the past and
future, as well as money for his pain and
suffering — an award totaling $400,000. All
this could have been avoided had Allstate
paid Sam the $100,000 policy limits, but
they don’t make money by paying legitimate
claims. Instead they chose to fight and they
lost; in fact, Allstate continues to fight this decision
and vows to appeal it. Sam is confident
his attorneys will achieve justice and collect
what the jury awarded, but he also realizes
that despite his foresight in buying insurance,
his insurance company is hardly the “good
hands people” he thought he could rely on.

Jurado adjudica $400,000 a
Víctima de Conductor sin Seguro
Hace cuatro años, cuando iba manejando del trabajo
a la casa, nuestro cliente Sam Green (no es
su nombre real) se lesionó cuando otro conductor
le chocó el carro por detrás y se dio a la fuga.
Sam persiguió al conductor que lo chocó por la
I-95, y éste se detuvo y le dijo que no tenía seguro
y que se iba a ir. Sam reportó el accidente a la
policía y se fue manejando a casa. Luego empezó
a sufrir dolores de cabeza, dolor en el cuello, en
la espalda y en los hombros tan fuertes que su
esposa tuvo que llevarlo a la sala de urgencias.
Sam quedó devastado con este golpe de mala
suerte. Él ya se había lesionado en el trabajo hacía
solo 14 meses. Se estaba recuperando de la
primera lesión en el cuello y en el hombro cuando
el nuevo golpe ocurrió. No solo el cuello y el hombro
se le empeoraron, sino que también desarrolló
un problema en el área lumbar. Sus lesiones
hicieron que fuera imposible volver a su trabajo de
pintor de automóviles.
Sam sabía que estaba en problemas. Pero
cuando él reportó esto a Allstate, la empresa con
la que había tenido el seguro por casi 30 años
sin haber hecho un solo reclamo, quedó atónito
con la respuesta que le dieron. Con Allstate Sam
tenía una cobertura de $100,000 para protección
contra conductor sin seguro o con seguro
insuficiente, solo para este tipo de situaciones -
para protegerse a él mismo y a su familia si alguna

Litigation and Social Media
- A Dangerous Combination
In today’s society you may find it is
easier to text or “tweet” friends than
it is to pick a phone and call them.
Social media, with its many options
such as Facebook, Instagram, Twitter,
MySpace, and YouTube, brings you
convenient ways to keep in contact
with friends and family. What better
way to share your thoughts and
opinions along with photos and videos
of your experiences with a group of
your friends and family at one time?
But did you know that the information
you post on your social media sites
may be quite harmful if you are
involved in litigation such as personal
injury, workers’ compensation, labor
and employment and many other legal
areas? As a Plaintiff or Claimant in
one of these matters, you should be
aware that the insurance companies,
their adjusters, investigators and
attorneys (the defense) are now
known to look at profiles, pictures,
videos, and comments posted on
social media sites to try to weaken,
disprove, or deny the claims of
plaintiffs or claimants like you. Even
if you did not give the defense team

your site, courts have held that the
information posted there is fully
discoverable; courts have allowed
the defense access to postings that
were meant to be personal in nature
and solely for friends and family. The
insurance company and their defense
teams have used the photos and
comments found on pages like yoursfor
instance in one personal injury case
where a young woman injured her
neck in an automobile accident and
claimed she was disabled, the defense
used her Facebook page where she
was “tagged” in a photo, participating
in a kick boxing class. That information
was used as ammunition to reduce the
validity and value of her claim. Do you
post photos of yourself surfing or water
skiing? How about playing tennis, golf
or baseball? Even photos of carrying
a child or dancing exuberantly at a
wedding can undermine your claim.
If you have a current lawsuit, my
initial inclination is to advise you to
close down a social media site like
Facebook until your case resolves. If
you continue to take the risk of leaving
the site open, here are some of my
recommendations: (a) Place your sites
on the highest of privacy settings. (b)
Limit people being able to tag you
in postings and pictures. Many sites
have settings to ask for your approval
prior to posting. (c) Be cautious in your
postings. Remember that regardless
of your privacy settings, what you post
on the internet can fall into the wrong
hands. Information can be subpoenaed

and not everyone is your “friend”. (d)
Be upfront and honest with your
attorney as to any questionable
postings. (e) Lastly, if you are involved
in a case, be careful about removing
postings from the internet. Trying to
hide or delete information can be
considered destroying evidence that
can cause you to face harsh penalties
by the courts. Furthermore, you
should know that deleting information
does not mean it is permanently
erased for the internet or your drive.
Experts have ways of finding these
things. If you have a question about
what to do, ask your lawyer.
Social networking has great benefits
for not only the user but society
as a whole. It is a great way of
communicating information. We at

surfing o esquí acuático? ¿O quizá jugando
tenis, golf o béisbol? Incluso fotos cargando
un niño o bailando exuberantemente en una
boda pueden socavar su reclamo.
Si usted tiene una demanda vigente,
mi inclinación inicial es aconsejarle que
cierre su página de medios sociales como
Facebook hasta que se resuelva su caso.
Si continúa corriendo el riesgo de dejar la
página abierta, estas son algunas de mis
recomendaciones: (a) Configure sus páginas
con las mayores exigencias de privacidad. (b)
Limite las personas que pueden etiquetarlo en

Food Bank Mobile Pantry

Treasure Coast Food Bank (TCFB)
and are happy to participate in the
launch of their newest program, the
Mobile Pantry Program. The TCFB
has acquired refrigerated trucks to
serve the Martin, Saint Lucie, Indian
River and Okeechobee counties. This
new program will address hunger in an
innovative and creative way, by serving
as a “Pantry on Wheels.”

Over $9,000 Raised for Fallen Soldier
Aaron Vaughn’s Family
Kara Russell, a local teen, organized a fundraising event for
Aaron Vaughn, a fallen Navy Seal from Martin County who
was killed in Afghanistan when his helicopter was shot down
in August.
The Aaron Vaughn Memorial Walk was held Saturday,
November 19, 2011 at Flagler Park in Downtown Stuart.
Walkers gathered starting at 8:00am on the misty morning.
Heath West of WAVE 92.7 emceed and Aaron Vaughn’s
mother and Stuart resident, Karen Vaughn, lead the walk
to support it. “This program gives those
in need access to a healthy and fresh
meal when most of the time they would
not otherwise eat at all,” says Hewling.
On Friday March 16, the TCFB Mobile
Pantry, carrying 11,000 pounds of
food, set up shop at the Rosenthal,
Levy, Simon & Ryles, P.A. office in Port
St. Lucie. The pantry provided 100
families with healthy food.

The event was held at Tabernacle Missionary
Baptist Church in West Palm

area youth to understand that reading
is cool and necessary to be competitive
in today’s global economy. In a well

La adolescente local, Kara Russell, organizó un evento de recaudación
de fondos para Aaron Vaughn, el soldado caído de la Navy
SEAL del Condado de Martin que fue asesinado en Afganistán
cuando derribaron su helicóptero en agosto.
La Caminata Conmemorativa en Honor a Aaron Vaughn se celebró
el sábado 19 de noviembre de 2011 en el Parque Flagler del centro
de Stuart. Los caminantes se reunieron desde las 8:00 am en la
nublosa mañana. El presentador fue Heath West de WAVE 92.7 y la
madre de Aaron Vaughn y residente de Stuart, Karen Vaughn, lider-
eron apoyarla. “Este programa brinda a los
