Los programas de mediación escolar
en marcha ponen el acento en la
mediación entre pares. Consideramos
que la mediación escolar no se
agota en “enseñar” un procedimiento,
implica mucho más, un fuerte
contenido en valores estrechamente
relacionado con los fines de la educación
actual y requiere el apoyo y
el ejemplo de los adultos del sistema,
este es el sentido del Plan de
Mediación Escolar establecido por
ley en la Provincia del Chaco.

Scholastic mediation program that
are running put the accent in peer
mediation. We consider that
scholastic mediation is not exhausted
in teaching a procedure, implies
much more, a fort contained in values
closely related to the aims of
the present education and requires
the support and the example of the
adults of the system, this is the
sense of the Plan of Scholastic
Mediation established by law in the
Province of the Chaco.

The Picture of the World of Divorce
in Divorce Mediation -
The Relationship Between
Theory and Practice."
This workshop will explore the
basic questions that a divorce
mediator and a divorce lawyer
must, of necessity, ask and answer.
It will argue that the answers that
each of them gives to those questions
are grounded in certain
assumptions - what I refer to as
"Pictures" - which they are not generally
aware of. This workshop will
make explicit what those very different
assumptions are, explore
their implications for the practice of
mediation, and indicate how a
proper understanding of those
assumptions would cause a mediator
to redefine his role in relationship
both to the process and to the
couple whom he is trying to help,
as well as to substitute a different
yardstick by which to judge the
object and success of a mediation.

Power imbalances
Mediators are generally advised (a)
that power imbalances are inherent
in the discussions between the parties
and (b) that it is a mediator’s
obligation to step in and correct
those imbalances. I would like to
see someone take that position and
I would very much like to have the
opportunity to answer it. The very
fact that no one would take issue
with either of these propositions is
evidence enough that the assumptions
implicit in those propositions
should be questioned. As is so often
the case today in the field of divorce
mediation, those propositions
unwittingly incorporate a great
many questionable adversarial assumptions.

English law on referral to family
mediation – experience in
practice
The Family Law Act 1996 in England
gives an important role to
mediation. Applicants for legal aid
in family proceedings must be referred
to State-registered family mediators
to consider mediation before
legal aid can be granted for
Court proceedings. Individuals can
also seek mediation at any stage.
Research findings and mediators’
experience of this system will be
drawn on in discussing the process
of engaging parties in mediation,
without coercing them.

Since 1989 REFS has worked intensively
with families experiencing
varying degrees of conflict.

improving communication and coexistence
and problem solving
skills. Specifically, the utilisation of
trained young people as peer mediators
has been shown to greatly

un proyecto piloto en la materia,
donde la región en que funciona el
centro de mediación CREA, es privilegiada
al haber sido piloto en la
implementación del nuevo sistema
procesal penal.

de presos políticos y comunes, se

un año trabajamos, en el Ministerio

pregunta era: que pasara cuando la
ley pierda vigencia? Es esta la norma
que buscamos para el futuro. El
norte del proyecto original de la
gestión fue buscar un futuro con un
sistema voluntario, judicial (no prejudicial)
y multipuertas.

La mediación ha tenido un desarrollo
legislativo espectacular en América
Latina y Caribe. Decimos espectacular
porque estos procedimientos
son de difícil implantación
si tenemos en cuenta la situación
social y económica de estos países.
Este desarrollo se explica entonces
por la influencia que ha tenido en
esta implementación el Banco Interamericano
de Desarrollo (BID), a
través de subvenciones que con el
objetivo de modernizar estos Países
ha dado a lo largo de los últimos
años. En esta comunicación hacemos
una reflexión sobre el cumplimiento
de los objetivos propuestos
por el BID con estos programas.

a healthy coexistence through

The experience of training in prevention,
contention and resolution
of conflicts in education, through
the training of negotiators and

institutions is producing a healthy
and peaceful coexistence in
scholastic environments. Our proposal,
Pedagogy for Peace, implemented
from 1999 on in different
countries and provinces confirms
that the school by its multiplying
effect and because it’s the only educational,
and public environment, it
represents a step in the formation
of a culture of peace.

The workshop will be an opportunity
to share the success of the San
Diego Mediation Center with
Parent/Teen mediation. Ms.
Maxwell will review adaptations
and other “secrets.” She will present
anecdotal and other information
to illustrate how it assists families
in crisis. A comparison of
English and Spanish speaking
clients’ use of Parent/Teen mediation,
outreach to obtain these types
of cases, as well as follow-up procedures
will be addressed.

a cross-cultural view of this
type of mediation.

an international Muslim community,

its own dispute resolution system.
Rooted in the Qur'an, the traditions
and the essential ethical and
intellectual values of Islam, the system
is also grounded in the laws of
the many countries where it operates,

context, through professional

situaciones conflictivas en las cuales
uno de sus componentes es la
violencia. En la restricción obviamente
se encuentran los conflictos
familiares violentos. No obstante la
tendencia enunciada, se ha reflexionado
sobre la revisión de esa
afirmación, concluyendo que resulta
posible la aplicación de la técnica
a ese tipo de disputas. Esa aseveración
se realiza a partir de una
comprobación empírica de un universo
de casos en los cuales se
aplicó la técnica con resultados satisfactorios.

In this roundtable workshop, Lillian
Holt, herself an Indigenous
Australian, will explore the perceptions
of a number of Indigenous
people she has interviewed and
how they see humour as a shield
from conflict and a tool for resolution
– overtly and covertly.
