5. ABANDONED HOUSING PROJECTS
The Ministry of Housing and Local Government
(KPKT) has initiated the following to further reduce
and curb the occurrence of housing projects being
abandoned:
(i) Home Completion Insurance/Guarantee
Scheme; and
(ii) Amendment to the Payment Schedule under
Act 118 and other related Acts with the view
of issuing Land Titles and Vacant Possession
simultaneously.
6. COMPETITION POLICY
Malaysia Competition Commission (MyCC) will
undertake various advocacy programmes in
2012 to further enhance the understanding of the
Competition Act 2010.
Various guidelines will be published to assist
stakeholders in understanding the provisions and
terminologies in the Act. Public consultation was
held beginning December 2011 for views and
comments. Details of the public consultation of the
guidelines are available on MyCC’s website (www.
mycc.gov.my).
7. REGISTERING PROPERTY
National Land Code (NLC) Review
The review of the National Land Code (NLC) is to
reduce the number of fraudulent or forged land
transactions through the control of legislation and
enhancement of registration security. Proposed
revisions are:
(i) Introduction of the “Certificate of Correctness”
(CoC) to control the integrity of attestation in
land transactions;
(ii) Insertion of the definition of “fraud and forgery”
as a construed part of criminal offences;
(iii) Allowing land owners to apply for entry of
Registrar’s Caveat to safeguard against fraud
and forgery in land dealings;
(iv) Provision of assurance fund to compensate
the victims of fraudulent land transaction; and
(v) Streamlining all statutory forms in the NLC into
a simplified and user-friendly format.
