Potential Amendment A1: ELV 

Issue 

‘The permit shall include emission limit values for pollutants, in particular, 

those listed in in Annex III, likely to be emitted from the installation 

concerned in significant quantities, having regard to their nature and 

their potential to transfer pollution from one medium to another (water, 

air and land). (…)’ [art 9(3)] 

‘The permit shall contain suitable release monitoring requirements, 

specifying measurement methodology and frequency, evaluation 

procedure and an obligation to supply the competent authority with 

data required for checking compliance with the permit. (…)’ [art 9(5)] 

Problem Definition 

• Difficult to compare ELVs in permits across Europe. 

• Currently ELVs often set in terms of e.g. mg/Nm3 – could it be better 

presented e.g. by g/tonne? 

• Improving information could lead to benefits of transparency, use in 

benchmarking, and encourage eco-efficiency.

Potential Amendment A2:

Issue 

‘Member States shall take the necessary measures to ensure that 

competent authorities periodically reconsider and, where necessary, 

update permit conditions.’ [art. 13(1)] 

Problem definition 

• Frequency of permit renewal is not defined – either as a method to 

determine appropriate time periods or as fixed timescales for renewal 

• Wide range of practices in different MS. 

• Some countries are concerned that others are unsuitably gaining by low 

permit review frequency – in terms of lower costs to business and later 

upgrade to latest BAT

‘Member States shall take the necessary measures to ensure that: 

(…) the operator regularly informs the competent authority of the results of 

the monitoring of releases and without delay of any incident or accident 

significantly affecting the environment (…)’ [art 14] 


• Monitoring report frequency is not defined 

• IPPC reporting is complicated by other reporting and links to initiatives 

to reduce reporting requirements 

• There are arguments that the current data reported is insufficient and 

that more data on actual emissions could usefully be required. 

• How to amend to ensure that it respects/implements Aarhus?

‘‘Member States shall take the necessary measures to ensure that: 

(…) operators of installations afford the representatives of the competent 

authority all necessary assistance to enable them to carry out any 

inspections within the installation, to take samples and to gather any 

information necessary for the performance of their duties for the 

purposes of this Directive.’ [art 14] 


• Inspections should be carried out regularly to assess whether 

installations conform with permit requirements 

• Early IMPEL led work raised the issue that the quality of inspections (inc. 

frequency) was very variable across Europe and led to the creation of 

the Minimum Criteria on Inspections. 

• IPPC sets out no precise inspection requirement (unlike Seveso), so 

some amendment may be appropriate.

Potential Amendment A5 

Requirement re discharges to water 

Issue 

Introduction of explicit requirements related to discharges to water from 

IPPC installations of priority substances and priority hazardous 

substances, as specified by Annex X of the Water Framework Directive 

2000/60/EC. 


• Clear link between IPPC Directive and WFD through the discharges to 

water from the installation. 

• To ensure that the link is optimal, a permit application could have more 

information on discharges and the permit could include conditions to 

ensure compliance.

BAT information exchange 

Cf. Art 16(2): ‘The Commission shall organise an exchange of information 

between Member States and the industries concerned on best 

available techniques, associated monitoring, and developments in 

them.’ 


• Provision of information for the BREFs, e.g. on emissions data, is 

variable 

• Data limitations affect ability to draw timely BAT conclusions

1.1. Combustion installations with a rated thermal input exceeding 50 MW 

(1) [Annex I] 


• Power plants in the range of 20MW to 50MW currently fall outside 

IPPC, but have been identified as significant emission sources in 

CAFE work and are under ET scheme 

• Should they be included in IPPC? 

• A better understanding of costs is needed– how many installations 

involved, what level costs at an average installation, overall etc.

Potential amendment C2: Intensive 

aquaculture 

Potential addition of intensive aquaculture to the Annex I list of covered 

activities, eg with a production capacity of 1,000 tonnes of fish or 

shellfish per year. 


Aquaculture can cause environmental degradation, e.g.: 

• Biological Pollution: Fish that escape from aquaculture facilities may harm 

wild fish populations; 

• Organic Pollution and Eutrophication: discharges of fish wastes and uneaten 

feed can bring local nutrient loading; 

• Chemical Pollution: use of antibiotics and pesticides may bring antibiotic 

resistance and harm to non-target species;

Beyond Regulatory Compliance? 

BRC = Companies that achieve higher environmental performance than requiered by their IPPC 

permits 

Examples are companies that are using 

– EMS (eg EMAS/ISO 14001 (Akzo Sassenheim NL)) or 

– product stewardship (VNCI, Chemical Industry Netherlands; U.S.) 

to perform beyond the basic requirements that are in their permit. 

Other tools or instruments are: 

– covenants, tax reliefs, differentiation in enforcement, name and fame publicity, etc.

Il quadro di riferimento tracciato dal D.lgs 

59/05 non è ancora definitivo poiché 

mancano i decreti attuativi che riguardano: 

- il rilascio dell’AIA ad impianti soggetti a 

più autorità competenti; 

- la definizione del tariffario; 

- l’adozione delle linee guida nazionali; 

- la possibilità di fissare “Requisiti 

generali” per talune categorie di impianti.

D.lgs 14 Aprile 2006 n. 152 “NORME IN MATERIA AMBIENTALE” 

Parte II^: : Procedure per la VAS, per la VIA e per l’IPPCl 

Art. 34: relazioni tra VIA e IPPC e abroga il comma 9 dell’art. 5 del D.Lgs. . 59/05, 

relativo alla Commissione Istruttoria IPPC 

Per le opere sottoposte a Via che rientrano nel campo di applicazione del Dlgs 

59/05 è facoltà del proponente ottenere che la procedura di Via sia integrata nel 

procedimento per il rilascio dell’AIA con le seguenti conseguenze: 

a) lo studio di impatto ambientale dovrà contenere anche le informazioni 

richieste nella procedura per l'AIA; 

b) le forme di informazione e partecipazione stabilite per la Via 

sostituiscono, ad ogni effetto, quelle del Dlgs 59/2005; 

c) il procedimento per l‘AIA l 

viene sospeso; 

d) l'istruttoria tecnica viene condotta dagli organi preposti all'istruttoria 

sulla domanda AIA; 

Una volta conclusa la procedura di valutazione ambientale, il giudizio verrà 

comunicato all'autorità competente per l‘AIA l 

che, tenendone conto, riprenderà 

il proprio procedimento. 

Il richiedente versa un unico corrispettivo per il giudizio di compatibilitc 

ompatibilità e per 

l’AIA

Delibera GR 29 Novembre 2004 n. 2411 “Approvazione delle guide e delle relative modulistiche per la 

redazione della domanda di AIA”; 

Delibera GR 6 Dicembre 2004 n. 2523 “Approvazione della sesta modifica calendario scadenza 

presentazione domande autorizzazione integrata ambientale. Abrogazione delibere 1240/02, 38/03, 

1859/03, 1658/04, 1946/04 (D.lgs 372/99, art. 4, comma 3)”;

Dal D.lgs 59/05: due novità su cui lavorare

c) scambio di informazione a livello 

nazionale di cui all'art. 14, comma 4; 

d) adempimenti in materia di 

comunicazione previsti dall'art. 12, comma 

3, dall'art. 14, commi 1 e 2 e dall'art. 15, 

commi 1 e 2; 

e) aggiornare il quadro dello stato di 

attuazione nazionale e comunitario della 

disciplina in materia di prevenzione e 

riduzione integrata dell'inquinamento 

anche al fine di renderlo accessibile al 

pubblico. 

Art. 14. - Scambio di informazioni 

3. Il Ministero dell'ambiente e della tutela del 

territorio, di intesa con il Ministero delle 

attività produttive, con il Ministero della 

salute e con la Conferenza permanente per 

i rapporti tra lo Stato, le regioni e le 

province autonome di Trento e di Bolzano, 

provvede ad assicurare la partecipazione 

dell'Italia allo scambio di informazioni 

organizzato dalla Commissione europea 

relativamente alle migliori tecniche 

disponibili e al loro sviluppo, nonché alle 

relative prescrizioni in materia di controllo, 

e a rendere accessibili i risultati di tale 

scambio di informazioni. Le modalità di tale 

partecipazione, in particolare, dovranno 

consentire il coinvolgimento delle autorità 

competenti in tutte le fasi ascendenti dello 

scambio di informazioni.

Regolamenti e norme tecniche 

integrative – Autorizzazione unica 

ambientale per le piccole imprese 

5. Con successivo decreto, 

adottato dal Ministro dell’ambiente e 

della tutela del territorio, di concerto 

con il Ministro dell’economia e delle 

finanze e con il Ministro delle attività 

produttive, si provvederà ad accorpare 

in un unico provvedimento le diverse 

autorizzazioni ambientali nel caso di 

impianti non rientranti nel campo di 

applicazione del decreto legislativo 18 

febbraio 2005, n. 59, ma sottoposti a più 

di una autorizzazione ambientale di 

settore.

Conclusione 

?La revisione della direttiva IPPC lascia immutata la scadenza 

di Ottobre 2007 per gli impianti esistenti e prefigura un 

rafforzamento dell’approccio integrato ed un ampliamento del 

suo campo di applicazione; 

?Il quadro normativo italiano presenta novità ma anche ritardi 

e difficoltà nel superamento dell’approccio settoriale e nel 

rinnovamento del sistema regolatore; 

?L’attuazione di IPPC in Italia richiede di costruire rapidamente 

un quadro conoscitivo aggiornato sul quale sviluppare i 

necessari confronti e riflessioni finalizzati a fare contare di 

più il nostro paese; 

?Dall’Emilia-Romagna e dai suoi oltre mille impianti IPPC può 

venire un contributo importante.
