Interview with Mr. Hilmi Jashari, Acting Ombudsperson in <strong>Kosovo</strong><br />

JUDICIAL SYSTEM IN KOSOVO HAS BIG FAULTS...<br />

It states that the judicial system in <strong>Kosovo</strong> is quite a complicated one and it <<strong>strong</strong>>has</<strong>strong</strong>> big faults in law application, which guarantee and protect<br />

the essential human rights. Majority of the appeals filed at Ombudsperson a<strong>re</strong> <strong>re</strong>lated to property issues. People file appeals in the courts<br />

<strong>re</strong>garding the inefficiency of the state administration. It thinks that the organized crime, corruption, ir<strong>re</strong>sponsibility and inefficiency of the<br />

local and central institutions c<strong>re</strong>ated the p<strong>re</strong>conditions <strong>for</strong> lack of a satisfactory level in <strong>re</strong>specting the human rights in <strong>Kosovo</strong>, including the<br />

property right... stated to the “KPA Gazette”, Mr. Hilmi Jashari, Acting Ombudsperson in <strong>Kosovo</strong>.<br />

In its last <strong>re</strong>port, the Ombudsperson<br />

emp<<strong>strong</strong>>has</<strong>strong</strong>>izes the fact that: “due<br />

to the faults in gjeneral in <strong>re</strong>gard<br />

to the rule of law in <strong>Kosovo</strong>, the<br />

property owners a<strong>re</strong> protected<br />

only if they a<strong>re</strong> capable of protecting<br />

themselves”. Whe<strong>re</strong> does this<br />

conclusion come from?<br />

Hilmi JASHARI:<br />

This conclusion from our last published<br />

<strong>re</strong>port is substantiated on the<br />

general developments in <strong>Kosovo</strong>.<br />

This is also <strong>re</strong>lated to improper functioning<br />

of the principal of division of<br />

the th<strong>re</strong>e main authorities; legislation,<br />

judicial and executive. <<strong>strong</strong>>The</<strong>strong</strong>> biggest<br />

fault stands on the fact that the legal<br />

and judicial system as a whole is<br />

rather complicated. Let’s take the<br />

judicial system. This system <<strong>strong</strong>>has</<strong>strong</strong>> big<br />

problems, starting with the processes<br />

prolongation, incapacity <strong>for</strong> proper<br />

justice administration and ending with<br />

the failu<strong>re</strong> to properly and rapidly<br />

apply the applicable laws.<br />

As <strong>for</strong> the Executive, the<strong>re</strong> a<strong>re</strong> also<br />

problems and faults noticed the<strong>re</strong><br />

which a<strong>re</strong> quite evident, both in the<br />

local and central level. <<strong>strong</strong>>The</<strong>strong</strong>><strong>re</strong> is a<br />

chaotic situation, inefficiency of<br />

administration and in generally providing<br />

services to the people as well<br />

as incapacity to insu<strong>re</strong> that their rights<br />

a<strong>re</strong> guaranteed and protected. All this<br />

situation also c<strong>re</strong>ates legal uncertainty<br />

in <strong>Kosovo</strong>, which necessarily leads<br />

to the lost of confidence towards the<br />

institutions, and especially the legal<br />

system. Today, <strong>Kosovo</strong> <<strong>strong</strong>>has</<strong>strong</strong>> a unique<br />

legal system with 5 legal <strong>re</strong>courses,<br />

since we do not have yet a synchronization<br />

of laws from 1980 until<br />

now, including he<strong>re</strong> as well the laws<br />

adopted during the <strong>re</strong>cent years. Furthermo<strong>re</strong>,<br />

another problem in itself is<br />

<strong>re</strong>p<strong>re</strong>sented by the lack of awa<strong>re</strong>ness<br />

<strong>for</strong> good communication with people<br />

by the local and central institutions<br />

side in order to explain to them the<br />

rights and the f<strong>re</strong>edoms guaranteed<br />

by the law. <<strong>strong</strong>>The</<strong>strong</strong>><strong>re</strong><strong>for</strong>e, we <strong>re</strong>ached<br />

the conclusion that due to lack of<br />

legitimate national and institutional<br />

protection, then people a<strong>re</strong> <strong>for</strong>ced to<br />

seek <strong>for</strong> other alternative solutions,<br />

in most of the cases illegal ones, in<br />

order to claim and <strong>re</strong>alize their own<br />

rights, even in the issues <strong>re</strong>lated to the<br />

property disputes. In such cases, as<br />

possible “alternatives” a<strong>re</strong> specified;<br />

corruption, document <strong>for</strong>gery, etc.<br />

How much space is given to the<br />

issues <strong>re</strong>lated to property rights<br />

in the activities of Ombudsperson<br />

Institution?<br />

Hilmi JASHARI:<br />

Su<strong>re</strong>, the property right is a crucial<br />

human right. In the majority of the<br />

annual and periodical p<strong>re</strong>pa<strong>re</strong>d, we<br />

have given our assessment, as an Institution,<br />

<strong>re</strong>garding many problematic<br />

issues <strong>re</strong>lated to the property rights.<br />

<<strong>strong</strong>>The</<strong>strong</strong>><strong>re</strong><strong>for</strong>e, I can say that as part of the<br />

overall Ombudsperson activities, we<br />

pay a special attention and ca<strong>re</strong>fulness<br />

to these problems as well or the<br />

appeals which in one way or another<br />

a<strong>re</strong> <strong>re</strong>lated to the property issues.<br />

What do people complain mostly in<br />

<strong>re</strong>spect to the issues <strong>re</strong>lated to the<br />

property rights? And against whom<br />

they complain mostly?<br />

Hilmi JASHARI:<br />

Most of the appeals filed at Ombudsperson,<br />

apart from those <strong>re</strong>fer<strong>re</strong>d to<br />

the courts, a<strong>re</strong> <strong>re</strong>lated to the property<br />

issues. <<strong>strong</strong>>The</<strong>strong</strong>> appeals a<strong>re</strong> various ones,<br />

starting with administration inefficiencies<br />

and continuing with the lack<br />

of proper mechanisms to solve the<br />

problems raised. <<strong>strong</strong>>The</<strong>strong</strong>><strong>re</strong> a<strong>re</strong> appeals<br />

whe<strong>re</strong> the parties allege unfairness<br />

made to them when deciding, but<br />

the<strong>re</strong> a<strong>re</strong> many of them who complain<br />

about the implementation prolongation<br />

of the decisions issued by the<br />

local institutions. Most of the cases<br />

a<strong>re</strong> <strong>re</strong>lated to the property disputes. A<br />

problem in itself p<strong>re</strong>sents the failu<strong>re</strong><br />

to apply the applicable laws, which<br />

makes the issue of such problems<br />

even mo<strong>re</strong> opp<strong>re</strong>ssive, whe<strong>re</strong> people<br />

complaining to us. Citizens of<br />

<strong>Kosovo</strong>, belonging to all ethnicity,<br />

approach our office di<strong>re</strong>cting the<br />

focus of the appeals towards the local<br />

and central courts, prolongation of<br />

the decisions making, <strong>re</strong>spectively<br />

their implementation. <<strong>strong</strong>>The</<strong>strong</strong>><strong>re</strong> a<strong>re</strong><br />

cases when we also <strong>re</strong>ceive appeals<br />

against KPA decisions. Furthermo<strong>re</strong>,<br />

people complain about bu<strong>re</strong>aucracies<br />

and administrative ir<strong>re</strong>gularities at<br />

the Municipal Assembles, as well as<br />

about KTA, <strong>re</strong>spectively the privatization<br />

process, whe<strong>re</strong> the<strong>re</strong> a<strong>re</strong> allegations<br />

<strong>re</strong>garding property rights over<br />

certain properties.<br />

From what was stated till now,<br />

whe<strong>re</strong> do you think the biggest<br />

problems stand in <strong>re</strong>gard to<br />

<strong>re</strong>specting the property rights in<br />

<strong>Kosovo</strong>?<br />

Hilmi JASHARI:<br />

In our periodical <strong>re</strong>ports, we have<br />

alerted that the p<strong>re</strong>valence of negative<br />

phenomena, such as; organized<br />

crime, corruption, ir<strong>re</strong>sponsibility and<br />

inefficiency of the institutions have<br />

c<strong>re</strong>ated the p<strong>re</strong>conditions <strong>for</strong> lack of a<br />

satisfactory level in <strong>re</strong>specting the human<br />

rights in <strong>Kosovo</strong>, including the<br />

property right. I have always stated<br />

that, and I will <strong>re</strong>peat it once again<br />

now, even if we had the best laws in<br />

the world, but the<strong>re</strong> is no political and<br />

institutional will, it would be hard to<br />

achieve satisfactory <strong>re</strong>sults.<br />

What is your cooperation with<br />

<strong>Kosovo</strong> <strong>Property</strong> Agency and what<br />

do you think about the work of this<br />

Agency?<br />

Hilmi JASHARI:<br />

<<strong>strong</strong>>The</<strong>strong</strong>> cooperation between Ombudsperson<br />

in <strong>Kosovo</strong> and KPA is good<br />

and a <strong>re</strong>gular one. We a<strong>re</strong> satisfied,<br />

especially with the exchange of<br />

adequate in<strong>for</strong>mation, which we have<br />

a need <strong>for</strong> and would help us. This<br />

in<strong>for</strong>mation and contact exchange<br />

is quite efficient and professional. I<br />

have to mention the fact that we have<br />

signet a Memorandum of Understanding<br />

with KPA <strong>re</strong>garding the expeditious<br />

and full access in the documentation<br />

<strong>re</strong>lated to the decisions, whe<strong>re</strong><br />

the parties allege of being affected<br />

from. During the time when HPD<br />

existed we had given our <strong>re</strong>marks and<br />

exp<strong>re</strong>ssed our concerns in <strong>re</strong>lation to<br />

the Regulation which provided no opportunities<br />

to the parties in the dispute<br />

to appeal after Commission issued<br />

the decision. Now, with KPA, the<strong>re</strong> is<br />

opportunity provided <strong>for</strong> the parties<br />

to have the right to file an appeal at<br />

the Sup<strong>re</strong>me Court of <strong>Kosovo</strong> against<br />

the decision issued by the Commission<br />

and I think that this is a prog<strong>re</strong>ss<br />

in <strong>re</strong>gard to providing opportunities<br />

<strong>for</strong> people to <strong>re</strong>quest <strong>re</strong>spected and<br />

guaranteed human rights.
