DIBAJIKatika mwaka wa 2006 kituo cha kutetea haki za uhamisho <strong>watu</strong> <strong>na</strong> makazi (COHRE), Kituocha <strong>Hakijamii</strong> <strong>na</strong> wizara <strong>ya</strong> ardhi waliandaa warsha mjini Naivasha kujadili maswala<strong>ya</strong> <strong>watu</strong> kufurushwa <strong>ya</strong>lioambata<strong>na</strong> <strong>na</strong> haki za bi<strong>na</strong>damu.Warsha hiyo ilihudhuriwa <strong>na</strong>wadau kutoka serikalini <strong>na</strong> taasisi zi<strong>na</strong>zoshughulikia <strong>na</strong> kusimamia maswala <strong>ya</strong> ardhi. Mafanikio<strong>ya</strong>liotoka<strong>na</strong> <strong>na</strong> warsha hiyo ni kubuniwa kwa jopo liloendeshwa <strong>na</strong> wizara <strong>ya</strong> ardhi. Jopo hilolilitakiwa kutoa mwongozo wa kushughulikia kesi za <strong>kuwahamisha</strong> au kuwafurusha <strong>watu</strong> wa<strong>na</strong>omilikiardhi kwa njia zisizo halali. Warsha hiyo iliandaliwa kutoka<strong>na</strong> <strong>na</strong> ripoti <strong>ya</strong> Ken<strong>ya</strong> <strong>ya</strong> kilamwaka kwa kamati <strong>ya</strong> haki za bi<strong>na</strong>damu <strong>ya</strong> umoja wa mataifa <strong>ya</strong> mwaka 2005 jijini New York,USA. Mazungumzo bai<strong>na</strong> <strong>ya</strong> umoja wa mataifa <strong>na</strong> ujumbe wa Ken<strong>ya</strong> ulioongozwa <strong>na</strong> aliyekuwamkuu wa sheria Amos Wako <strong>ya</strong>lisababisha mwongozo ufatao kuafikiwa:“Kwamba serikali itaunda sera <strong>na</strong> mwongozo wa kukabilia<strong>na</strong> <strong>na</strong> kesi za kuhamisha <strong>watu</strong>,kwamba<strong>watu</strong> hawatahamishwa hadi watakapoelezwa <strong>na</strong> hatua za kuwapa makaazi map<strong>ya</strong> zitekelezwe”.Baada <strong>ya</strong> jaribio la kwanza kutofanikiwa,hatimaye jopo hilo lilianza kutekeleza wajibu wakekikamilifu mwaka wa 2009,kufikia mwezi Machi 2012 rasimu <strong>ya</strong> mwongozo wa <strong>kuwahamisha</strong><strong>na</strong> kuwapa <strong>watu</strong> makaazi mbadala. Hatahivyo baada <strong>ya</strong> wadau kujadilia<strong>na</strong> zaidi,jopo hilo liliamuakuunda mswada utakao kuwa sheria.Kilichoko katika kitabu hiki ni rasimu <strong>ya</strong> mwongozoulioundwa pamoja <strong>na</strong> rasimu <strong>ya</strong> mswada.Hatua <strong>ya</strong> kuunda sheria <strong>na</strong> mwongozo huu,ni dhihirisho la jinsi wadau wa<strong>na</strong>vyoweza kushirikia<strong>na</strong><strong>na</strong> kufanikiwa kutoa sera <strong>na</strong> sheria mwafaka. Japo mswada huu bado haujapitishwa kuwasheria,kuambata<strong>na</strong> <strong>na</strong> utekelezwaji wa katiba mp<strong>ya</strong>, hatua hizi zitakamilishwa baada <strong>ya</strong> barazala mawaziri kuujadili <strong>na</strong> kuuwasilisha mswada bungeni. Mswada huu utakapopitishwa,itakuwahatua mwafaka katika kutetea haki za bi<strong>na</strong>damu nchini.Sheria hii itakuwa mbinu <strong>ya</strong> kulinda haki<strong>na</strong> hadhi <strong>ya</strong> <strong>watu</strong> hasa <strong>watu</strong> wasiojiweza wa<strong>na</strong>oathiriwa kila wakati kutoka<strong>na</strong> <strong>na</strong> kesi za kuhamishwakwa lazima kwenye ardhi.4 <strong>Rasimu</strong> <strong>ya</strong> <strong>kuwahamisha</strong> <strong>watu</strong> <strong>na</strong> makazi map<strong>ya</strong> - Mwongozo <strong>na</strong> rasimu <strong>ya</strong> mswada, 2012


Twapongeza jamii zilizojitolea,bila kufa moyo,kupigania mswada huu. Twashukuru maafisa katikawizara <strong>ya</strong> ardhi walioongoza juhudi za kuta<strong>ya</strong>risha mswada huu. Na kwa jopo lililojumuishawizara za serikali,mashirika <strong>ya</strong>sio <strong>ya</strong> serikali,<strong>na</strong> mashirika <strong>ya</strong> kijamii; twasema Hongera kwakazi nzuri.Twatoa shukrani kwa Ubalozi wa Sweden kupitia mradi wa mashirika <strong>ya</strong>sio <strong>ya</strong> kiserikali <strong>ya</strong> maendeleo<strong>ya</strong> miji (Civil Society Urban Development Programme -CSUDP) kwa kufanikisha juhudi hizi.Twatoa shukrani pia kwa taasisi <strong>ya</strong> kimataifa <strong>ya</strong> huduma za wa<strong>ya</strong>hudi Marekani <strong>na</strong> Kios (the AmericanWorld Jewish Services & Kios) kwa kuwezesha <strong>watu</strong> kuhamasishwa kuhusu mswada huu.Jukumu sasa limesalia katika mikono <strong>ya</strong> serikali,hasaa wizara <strong>ya</strong> ardhi,kuhakikisha mswada huuumepitishwa kuwa sheria ili kulinda haki za waKen<strong>ya</strong> katika kesi za kufurushwa kutoka makazi<strong>ya</strong>o. Mara kwa mara,serikali <strong>na</strong> wafanyibiashara wa kibi<strong>na</strong>fsi wa<strong>na</strong>odiakumiliki vipande v<strong>ya</strong> ardhi hutekleza visa v<strong>ya</strong> dhulma wa<strong>na</strong>pohamisha <strong>watu</strong>. Maafisa wa polisi,<strong>na</strong>tingatinga hutumiwa <strong>na</strong> kusababisha ghasia <strong>na</strong> hata vifo kati <strong>ya</strong> walioathiriwa. Visa hivi huathiripakubwa maisha <strong>ya</strong> familia <strong>na</strong> jamii zi<strong>na</strong>zofurushwa. Waathiriwa wengi huwa <strong>watu</strong> wasiojiwezawa<strong>na</strong>oishi katika mitaa <strong>ya</strong> mabanda. Hatahivyo ni kesi <strong>ya</strong> Novemba 2011 ambapo <strong>watu</strong> wa<strong>na</strong>ojiwezawaliobomolewa majumba makubwa Syokimau,ndio iliyoshinikiza bunge kumakinika<strong>na</strong> kuteua kamati maalum kutatua swala hili.Katika maeneo <strong>ya</strong> mashambani,wa<strong>na</strong>oathiriwa zaidi ni maskwota <strong>na</strong> wapangaji. Tatizo la maskotali<strong>na</strong>athiri <strong>watu</strong> wengi kote nchini <strong>na</strong> husababishwa <strong>na</strong> miradi <strong>ya</strong> maendeleo,vita,<strong>watu</strong> waliofurushwakutoka msituni <strong>na</strong> ufisadi katika usajli wa ardhi.Mwenendo wa kuwafurusha <strong>watu</strong> huhusishwa <strong>na</strong> kesi za <strong>watu</strong> kupata ardhi kwa njia zisizo halaliau udanganyifu. Kesi hizi zimerekodiwa katika ripoti <strong>ya</strong> jopo la ardhi <strong>ya</strong> umma,al-maarufu ripoti<strong>ya</strong> Ndung’u.Asilimia 80 <strong>ya</strong> ardhi <strong>ya</strong> Ken<strong>ya</strong> humilikiwa <strong>na</strong> jamii kumbata<strong>na</strong> <strong>na</strong> sheria za ardhi <strong>ya</strong> jamii katikakatiba mp<strong>ya</strong>. Licha <strong>ya</strong> kwamba ardhi hii i<strong>na</strong>paswa kulindwa <strong>na</strong> mabaraza <strong>ya</strong> miji,mabaraza ha<strong>ya</strong>hulaghai jamii. Mfano wa kesi ni ile <strong>ya</strong> jamii <strong>ya</strong> Endorois huko Baringo waliolagahiwa ardhi <strong>ya</strong>o<strong>na</strong> baraza pamoja <strong>na</strong> serikali.Mwaka wa 1974,serikali iliwahamisha kwa lazima jamii <strong>ya</strong> Endorois kutoka ardhi <strong>ya</strong>o iliyopaka<strong>na</strong><strong>na</strong> mto Bogoria <strong>na</strong> kukiuka sheria. Serikali ilidhamiria kutengeza mpaka mp<strong>ya</strong> <strong>ya</strong> mbuga <strong>ya</strong>wan<strong>ya</strong>ma <strong>ya</strong> mto Bogoria. Jamii <strong>ya</strong> Endorosi walikosa usaidizi wa kulinda ardhi <strong>ya</strong>o <strong>na</strong> kutafuta<strong>Rasimu</strong> <strong>ya</strong> <strong>kuwahamisha</strong> <strong>watu</strong> <strong>na</strong> makazi map<strong>ya</strong> - Mwongozo <strong>na</strong> rasimu <strong>ya</strong> mswada, 20127


haki kupitia tume <strong>ya</strong> Africa <strong>ya</strong> kutetea haki za bi<strong>na</strong>damu (Africa Comission on Human Rights andPeople’s rights) huko Banjul, Gambia. Mwaka 2009,mahakama ilitoa amri warudishiwe ardhihiyo. Kati <strong>ya</strong> mapendekezo <strong>ya</strong>liotolewa <strong>na</strong> tume hiyo <strong>ya</strong> Africa ni:(a) Serikali,Itambue haki <strong>ya</strong> jamii <strong>ya</strong> Endorois kumiliki ardhi <strong>ya</strong> mababu zao.(b) Ihakikishe jamii <strong>ya</strong> Endorois i<strong>na</strong> ruhusa kutumia ardhi hiyo katika mto wa Baringo kuendeshamatambiko <strong>ya</strong>o <strong>ya</strong> kidini <strong>na</strong> kitamaduni <strong>na</strong> pia kupata lishe <strong>ya</strong> mifugo <strong>ya</strong>o.(c) Jamii hiyo ilipwe fidia kwa dhulma waliopata <strong>na</strong> mali waliopoteza(d) Jamii <strong>ya</strong> Endorois wafaidi kimapato kutoka<strong>na</strong> <strong>na</strong> bishara zi<strong>na</strong>zoendeshwa <strong>na</strong> mbuga hiyo.Japo serikali iliahidi kutekeleza matakwa hayo,hadi leo haku<strong>na</strong> hatua waliochukua kutekelezaamri hiyo.Mwongozo wa kitaifa wa ardhi 2009 pamoja <strong>na</strong> katiba 2012 zi<strong>na</strong>tambua haja <strong>ya</strong> kuunda mwongozomaalum wa kuwafurusha <strong>watu</strong>. Ni kwa mkutadha huu ambapo mwongozo wa kwafurusha <strong>na</strong>kuwapa makaazi waathiriwa uliundwa. Ni hatua iliyojumuisha wizara <strong>ya</strong> ardhi <strong>na</strong> wizara zenginehusika pamoja <strong>na</strong> mashirika <strong>ya</strong>sio <strong>ya</strong> kiserikali.Hii ni <strong>na</strong>kala <strong>ya</strong> mwongozo huo.8 <strong>Rasimu</strong> <strong>ya</strong> <strong>kuwahamisha</strong> <strong>watu</strong> <strong>na</strong> makazi map<strong>ya</strong> - Mwongozo <strong>na</strong> rasimu <strong>ya</strong> mswada, 2012


Kuwahamisha <strong>watu</strong> kwa lazima,ni ukiukaji mkubwa wa haki za bi<strong>na</strong>damu2.0 MUKTADHA WA KIMATAIFASwala la mwenendo wa kuwafurusha <strong>watu</strong> limeshughulikiwa kikamilifu katika maazimio,mikataba<strong>na</strong> maagano <strong>ya</strong> kimataifa. Maazimio hayo <strong>ya</strong>kijumuishwa pamoja,ni lengo la kimataifa kulindahaki <strong>ya</strong> makazi. Stakabadhi zilizo muhimu zaidi ni mikataba <strong>na</strong> ahadi za kisheria. Maazimio <strong>na</strong>mapendekezo pia ni muhimu japo ha<strong>ya</strong><strong>na</strong> uzito kisheria.Nchi ambazo zimeridhia mikataba hii au sheria <strong>ya</strong> jumla kimataifa wa<strong>na</strong> wajibu wa kutimizamasharti hayo. Ken<strong>ya</strong> ni mwa<strong>na</strong>chama wa baadhi <strong>ya</strong> maazimio ha<strong>ya</strong> <strong>na</strong> wa<strong>na</strong> wajibu wa kutekelezamasharti <strong>ya</strong> sheria za kimataifa. Umuhimu wa za<strong>na</strong> za kimataifa umejadiliwa hapa chini.2.1 AZIMIO LA HAKI ZA BINADAMU (UDHR)UDHR ni chombo mwanzilishi wa za<strong>na</strong> za haki za bi<strong>na</strong>damu kilichowezesha kuundwa kwamaazimio yote <strong>ya</strong> kulinda haki za bi<strong>na</strong>damu. Ibara <strong>ya</strong> 25 <strong>ya</strong> UDHR iliyopitishwa katika kongamanotarehe 10 Desemba 1948, i<strong>na</strong>wahakikishia <strong>watu</strong> dhama<strong>na</strong> <strong>ya</strong> haki <strong>ya</strong> kila mtu makazi. 2.2 MKATABA WA KIMATAIFA WA HAKI ZA KIUCHUMI,KIJAMII NA KIUTAMADUNI(ICESCR)ICESCR ni mkataba ulioundwa Januari 3 January 1976 <strong>na</strong> ni sheria katika nchi 149. Ken<strong>ya</strong>ilikuwa mwa<strong>na</strong>chama kuanzia 1972. Sheria <strong>ya</strong> haki <strong>ya</strong> makazi i<strong>na</strong>patika<strong>na</strong> katika ibara <strong>ya</strong> 11(1).Hi ni sharia muhimu zaidi i<strong>na</strong>yotambuwa haki <strong>ya</strong> makaazi <strong>na</strong> kuchambuliwa <strong>na</strong> kutafsiriwa marakwa mara .Agano hili li<strong>na</strong>tambua haki <strong>ya</strong> makaazi kama sehemu kubwa <strong>ya</strong> haki mwafaka <strong>ya</strong>kustawisha maisha, chini <strong>ya</strong> sharia za kimataifa za haki za bi<strong>na</strong>damu. Kamati<strong>ya</strong> Umojawa Mataifa i<strong>na</strong>yokabilia<strong>na</strong> <strong>na</strong> ai<strong>na</strong> zote za ubaguzi hufuatlia utekelezwaji wa mkatabahuo. Mkataba huo umepiga marufuku ubaguzi katika sekta <strong>ya</strong> makazi. Hatahivyo Ken<strong>ya</strong> haijapitishamkataba huu humu nchini.Ibara <strong>ya</strong> 5(e) (iii) <strong>ya</strong> mkataba huo imepiga marufuku ai<strong>na</strong> yeyote <strong>ya</strong> ubaguzi i<strong>na</strong>yodhulumu haki<strong>ya</strong> makazi.2.5 MKATABA WA KUPIGA MARUFUKU AINA YEYOTE YA UBAGUZI DHIDI YAWANAWAKE (CEDAW)Mkataba wa CEDAW ulipitishwa tarehe 3 Septemba 1981 <strong>na</strong> kuhalalishwa katika nchi 163.Kamati <strong>ya</strong> Umoja wa Mataifa i<strong>na</strong>yoshughulikia kupiga marufuku ubaguzi dhidi <strong>ya</strong> wa<strong>na</strong>wakehufuatilia utekelezwaji wa mkataba huu katika mataifa wa<strong>na</strong>chama. Ken<strong>ya</strong> iliunga mkono mkatabahuo mwaka 1994. Ibara <strong>ya</strong> 14(2)(h) <strong>ya</strong> mkataba u<strong>na</strong>olinda haki za makazi <strong>ya</strong> wa<strong>na</strong>wakemashi<strong>na</strong>ni.2.6 MKATABWA WA KULINDA HAKI ZA WATOTO (CRC)Mkataba wa CRC ulipitishwa tarehe 2 Septemba 1990 <strong>na</strong> kuhalalishwa katika mataifa 191. Kamati<strong>ya</strong> kulinda haki za watoto hufuatilia utekelzwaji wa sheria hizo katika mataifa wa<strong>na</strong>chama.Ken<strong>ya</strong> iliunga mkono mkataba huo 1990. Ibara <strong>ya</strong> 27(3) i<strong>na</strong>linda haki <strong>ya</strong> makaazi kwa watoto.2.7 MKATABA WA AFRIKA WA HAKI ZA BINADAMU NA WATU.Mkataba huo ulipitishwa tarehe 21 Oktoba 1986 <strong>na</strong> kuhalalishwa katika mataifa 53 <strong>ya</strong> Afrika.Ken<strong>ya</strong> ilihalalisha mwaka 1992. Chini <strong>ya</strong> sera hii,serikali i<strong>na</strong>paswa kuweka mwongozo wa <strong>kuwahamisha</strong> <strong>watu</strong> <strong>na</strong> kuwapamakaazi map<strong>ya</strong> kuambata<strong>na</strong> <strong>na</strong> viwango v<strong>ya</strong> miongozo <strong>ya</strong> kimataifa.Sera hiyo i<strong>na</strong>toa misingi wazi <strong>ya</strong> miongozo <strong>ya</strong> <strong>kuwahamisha</strong> <strong>watu</strong> <strong>na</strong> kuwapa makaazi.3.1.2 SERA YA KITAIFA YA MAKAZILengo la maazimio <strong>ya</strong> kikao No. 3 mwaka 2004 kilichohusu sera za kujenga <strong>na</strong> kugawa nyumbani kuwezesha kutolewa huduma za kuboresha mazingira kwa bei <strong>na</strong>fuu kwa jamii zote <strong>na</strong> makundiyote <strong>ya</strong> <strong>watu</strong> nchini Ken<strong>ya</strong>. Mojawapo <strong>ya</strong> malengo <strong>ya</strong>ke ni kuwezesha usalama wa umiliki kwamakundi yote <strong>ya</strong> kijamii <strong>na</strong> kiuchumi. Pia i<strong>na</strong>tambua umuhimu wa maendeleo kwa ajili <strong>ya</strong> ustawiwa haki <strong>ya</strong> makazi. Hii ni pamoja <strong>na</strong> kutungwa kwa sheria <strong>ya</strong> <strong>kuwahamisha</strong> <strong>watu</strong> kwa nguvu.Sera <strong>ya</strong> Ardhi <strong>na</strong> Sera <strong>ya</strong> <strong>Makazi</strong> husisitiza haja <strong>ya</strong> kushughulikia utaratibu wa <strong>watu</strong> kuhamishwa<strong>na</strong> kupendekeza hatua mwafaka za kuzuia visa hivyo. Sura <strong>ya</strong> Nne <strong>ya</strong> Haki za Bi<strong>na</strong>damu <strong>na</strong>masharti mengine kadhaa <strong>ya</strong><strong>na</strong> athari <strong>ya</strong> moja kwa moja dhidi haki <strong>ya</strong> makazi kwa ujumla <strong>na</strong>hasa <strong>kuwahamisha</strong> <strong>watu</strong> kwa nguvu.Ibara <strong>ya</strong> 2 hutoa mkataba ilioridhiwa <strong>na</strong> Ken<strong>ya</strong> <strong>na</strong> kufanywa kuwa sehemu <strong>ya</strong> katiba. Idadi <strong>ya</strong>mikataba ambayo Ken<strong>ya</strong> ni mwa<strong>na</strong>chama imetambua haki <strong>ya</strong> nyumba za kutosha. Ibara <strong>ya</strong> 10 <strong>ya</strong>maadili <strong>ya</strong> kitaifa <strong>na</strong> misingi <strong>ya</strong> utawala i<strong>na</strong>jumuisha pia,ushiriki wa <strong>watu</strong>, ahadi <strong>ya</strong> kulinda hadhi<strong>ya</strong> bi<strong>na</strong>damu, haki za bi<strong>na</strong>damu, mashirika <strong>ya</strong>siyo <strong>ya</strong> ubaguzi <strong>na</strong> ulinzi wa jamii ndogondogoIbara <strong>ya</strong> 21 i<strong>na</strong>shinikiza Serikali iwajibike kupitisha sheria, kupitisha sera <strong>na</strong> kuchukua hatuanyingine, ikiwa ni pamoja <strong>na</strong> kuboresha viwango v<strong>ya</strong> maisha kwa kulinda haki chini <strong>ya</strong> Ibara <strong>ya</strong>43. Moja <strong>ya</strong> haki chini <strong>ya</strong> Ibara <strong>ya</strong> 43 ni haki <strong>ya</strong> makazi <strong>na</strong> kiwango cha kuridhisha cha usafi wamazingira.Haki <strong>ya</strong> makazi hujumuisha uhuru. Hii ni pamoja <strong>na</strong> uhuru wa ulinzi dhidi <strong>ya</strong> kufukuzwa kwanguvu <strong>na</strong> uharibifu holela wa nyumba au mali <strong>ya</strong> mtu. Sheria <strong>ya</strong> ki<strong>na</strong> kuhusu kufukuzwa hutoautaratibu maalum <strong>ya</strong> kulinda makazi <strong>ya</strong> <strong>watu</strong>. Mbinu kama hiyo ilipitishwa Afrika Kusini kupitiakutungwa sheria za Kuzuia <strong>watu</strong> kufukuzwa kwa njia liyio kinyume cha sheria <strong>ya</strong> Ardhi, 1998.Ibara <strong>ya</strong> 31 i<strong>na</strong>eleza kwamba kila mtu a<strong>na</strong> haki <strong>ya</strong> kuruhusu au kukataa mtu kuingia katikamakazi <strong>ya</strong>o; ambayo i<strong>na</strong>jumuisha haki <strong>ya</strong> kukataa mtu wao, nyumba au mali kupekuliwa <strong>na</strong>waliowakamata. Kufukuzwa kiholela daima huathiri faragha <strong>ya</strong> <strong>watu</strong>. Shirika la Umoja wa Mataifala Haki za Bi<strong>na</strong>damu i<strong>na</strong> tafsiri kifungu hiki chini <strong>ya</strong> ICCPR kumaanisha;ulinzi dhidi <strong>ya</strong> kufukuzwakwa nguvu ndiyo, msingi wa mapendekezo <strong>ya</strong>ke <strong>ya</strong> sheria hii nchini Ken<strong>ya</strong> mwaka 2005.Ibara <strong>ya</strong> 26 i<strong>na</strong>eleza kwamba kila mtu a<strong>na</strong> haki <strong>ya</strong> kuishi <strong>na</strong> ni hatia kutolewa uhai kwa kukusudia,ila kwa ruhusa <strong>ya</strong> mamlaka <strong>ya</strong> kisheria <strong>ya</strong> katiba au sheria nyingine zilizoandikwa. Baadhi<strong>ya</strong> utawala, kama vile India, wamejumuisha haki <strong>ya</strong> kuishi pamoja <strong>na</strong> haki <strong>ya</strong> kukidhi mahitaji <strong>na</strong>njia za kujikidhi.Ibara <strong>ya</strong> 27 i<strong>na</strong>nukuu usawa <strong>na</strong> uhuru kuepusha <strong>watu</strong> kutoka<strong>na</strong> <strong>na</strong> ubaguzi katika sheria.14 <strong>Rasimu</strong> <strong>ya</strong> <strong>kuwahamisha</strong> <strong>watu</strong> <strong>na</strong> makazi map<strong>ya</strong> - Mwongozo <strong>na</strong> rasimu <strong>ya</strong> mswada, 2012

Visa v<strong>ya</strong>kufurusha <strong>watu</strong> vi<strong>na</strong>vyofanywa kwa <strong>na</strong>m<strong>na</strong> i<strong>na</strong>dhalilisha mtu ni kinyume cha sheria hii.Ibara <strong>ya</strong> 40 i<strong>na</strong>toa haki <strong>ya</strong> ulinzi wa mali , kwamba haku<strong>na</strong> mtu a<strong>na</strong>yeweza kun<strong>ya</strong>ng’anywamali <strong>ya</strong> ai<strong>na</strong> yoyote au <strong>ya</strong> maslahi yoyote kiholela. Kifungu cha 4 imepiga marufuku mazoea<strong>ya</strong> awali kwa:Sheria hii i<strong>na</strong>wapa uwezo maelfu <strong>ya</strong> <strong>watu</strong> maskini ambao kwa sasa wa<strong>na</strong>kaa katika ardhi<strong>ya</strong> umma katika maeneo <strong>ya</strong> mijini <strong>na</strong> vijijini bila vyeti v<strong>ya</strong> ardhi, waweze kulipwe fidia.Ikiwa watadhihirisha imani nzuri <strong>ya</strong> maelewano.Ibara <strong>ya</strong> 47 i<strong>na</strong>yohusu utawala wa haki huelekeza kwamba kila mtu a<strong>na</strong> haki <strong>ya</strong> ufanis <strong>na</strong> kupatahuduma <strong>ya</strong> serikali <strong>ya</strong> utawala. Ibara hii i<strong>na</strong>hitaji kwamba matendo yote <strong>ya</strong> kiutawala <strong>ya</strong><strong>na</strong>yoathiriuhuru wa kimsingi <strong>na</strong> haki lazima <strong>ya</strong>ambatane <strong>na</strong> sababu zilizonukuliwa kuzuia dhulma.Ibara <strong>ya</strong> 33 i<strong>na</strong>elezea uhuru wa kujieleza, u<strong>na</strong>oandama<strong>na</strong> pamoja <strong>na</strong> uhuru wa kutafuta, kupokeaau kutoa habari au mawazo. Ibara hii lazima isomwe pamoja <strong>na</strong> ibara <strong>ya</strong> 35 <strong>ya</strong> uhuru wa habari.Ibara hii i<strong>na</strong>hakikisha wa<strong>na</strong>ohamishwa kwa nguvu wa<strong>na</strong>pashwa habari kabla kufurushwa <strong>na</strong>baada <strong>ya</strong> hatua hiyo kutekelezwa ili mradi waathiriwa wawe <strong>na</strong> taarifa kuhusu pendekezo hilo.Masharti hayo yote <strong>ya</strong>mewezesha kuundwa kwa mfumo wa kikatiba kwa ajili <strong>ya</strong> kupitishwa kwamiongozo <strong>ya</strong> kesi za <strong>watu</strong> kuhamishwa kwa nvugu.Masharti ha<strong>ya</strong> ta<strong>ya</strong>ri <strong>ya</strong>metafsiriwa <strong>na</strong> mahakama katika kesi mbalimbali. Katika kesi iliyomhusuSatrose Ayuma <strong>na</strong> wengine dhidi <strong>ya</strong> wadhamini waliosajiliwa wa hazi<strong>na</strong> <strong>ya</strong> <strong>watu</strong>mishi waliostaafuwa shirika la reli (Lalama <strong>ya</strong> 65 of 2010), Susan Waithera Kariuki dhidi <strong>ya</strong> katibuwa baraza la jiji la <strong>na</strong> wengine (Lalama No. 66 <strong>ya</strong> 2010) <strong>na</strong> Ibrahim Sangor <strong>na</strong> wengine dhidi<strong>ya</strong> waziri wa usalama wa nchii <strong>na</strong> utawala (Petition No.2 of 2011), Mahakama kuu ilikata kaulikwamba visa v<strong>ya</strong> <strong>watu</strong> kufurushwa vi<strong>na</strong>kikuka sheria <strong>ya</strong> katiba <strong>na</strong> kupendekeza kwamba serikaliibuni miongozo <strong>ya</strong> kisheria kukabilia<strong>na</strong> <strong>na</strong> visa v<strong>ya</strong> <strong>watu</strong> kufurushwa kiholela. 3.2.2.1 SHERIA YA ARDHI KIFUNGU 280Kifungu cha 8 cha sheria ki<strong>na</strong>mumrisha kamishan wa ardhi kupata idhini <strong>ya</strong> mahakama kablakuwafurusha <strong>watu</strong> wa<strong>na</strong>omiliki ardhi <strong>ya</strong> serikali kwa njia isiyo halali .Hatahivyo taratibu za sheria hii hukiukwa katika zoezi la <strong>kuwahamisha</strong> <strong>watu</strong>. Hivyo basi Sheriamadhubuti i<strong>na</strong>hitajika kuundwa.3.2.2.2 SHEIRA YA MIPANGO (KIFUNGU. 286)Sehemu <strong>ya</strong> 29 <strong>ya</strong> sheria hii i<strong>na</strong>ruhusu mabaraza <strong>ya</strong> miji kuzuia matumizi <strong>na</strong> ujenzi wa mijengokatika maeneo <strong>ya</strong> ardhi wa<strong>na</strong>yosimamia au kutoa ruhusu kwa maendeeo kufanywa.Ikiwa ruhusahaikutolewa,mabaraza <strong>ya</strong> miji wa<strong>na</strong> haki kubomoa mijengo hiyo. Hatahivyo sheria hiyo haijatoamwongozo wa jinsi <strong>ya</strong> kutekeleza ubomoaji wa mijengo.Hali hii imesababisha ugomvi <strong>na</strong> ghasiabai<strong>na</strong> <strong>ya</strong> maafisa wa baraza la mji <strong>na</strong> wa<strong>na</strong>omiliki eneo hilo kwa njia isiyo halali.3.2.2.3 SHERIA YA AFYA YA UMMA (KIFUNGU. 242)Sehemu <strong>ya</strong> 116 <strong>ya</strong> Sheria pia i<strong>na</strong>ruhusu mamlaka <strong>ya</strong> mabaraza <strong>ya</strong> miji kuchukua hatua halali <strong>na</strong>muhimu ili kudumisha wila<strong>ya</strong> zao wakati wote katika mazingira safi , <strong>na</strong> kwa ajili <strong>ya</strong> kuzuia tukiola, au kwa ajili <strong>ya</strong> kurekebisha kero au hali itakayosababisha dhuluma au hatari kwa af<strong>ya</strong>, <strong>na</strong>kufungua kesi dhidi <strong>ya</strong> mtu a<strong>na</strong>yesababisha au kuendeleza kero yoyote. Katika matukio mengi,taratibu za kisheria hukiukwa hata kabla hatua <strong>ya</strong> kuwafurusha <strong>watu</strong> kutekelzwa .3.2.2.4 SHERIA YA KUMILKI ARDHI (KIFUNGU. 295)Sehemu <strong>ya</strong> 3 <strong>ya</strong> Sheria i<strong>na</strong>toa utaratibu <strong>na</strong> kufuatwa <strong>na</strong> Waziri wakati serikali a<strong>na</strong>pochukuaardhi kwa lazima <strong>na</strong> kumpa taarifa “kila mtu ambaye a<strong>na</strong>oneka<strong>na</strong> kuwa nia <strong>ya</strong> kupata ardhi hiyo”. Hata hivyo ku<strong>na</strong> shaka kwamba wa<strong>na</strong>omiliki ardhi hiyo kwa njia zisizo halali hawapashiwihabari chini <strong>ya</strong> mpango huu. Hatahivyo sheria hii i<strong>na</strong>dhihirika kuwashughulikia tuu walio <strong>na</strong>vyeti halali kwa kuwapa taarifa hiyo.3.2.2.5 SHERIA YA HALMASHAURI YA VIWANJA VYA NDEGE (KIFUNGU. 395), HALMASHAURI YA BANDARI (KIFUNGU. 391) NA SHIRIKA LA RELI (KIFUNGU. 397)Sheria i<strong>na</strong>ruhusu Makampuni kubomoa majengo ambayo <strong>ya</strong><strong>na</strong>weza kusababisha hatari au kuwakizuizi kwa huduma zao. 3.2.2.6 MAMLAKA YA BARABARA (SURA YA 2) 2007Sehemu <strong>ya</strong> 23 i<strong>na</strong>ruhusu mamlaka <strong>ya</strong> barabara kufan<strong>ya</strong> mazungumzo <strong>na</strong> wamiliki bi<strong>na</strong>fsi wa ardhiwakati wa<strong>na</strong>hitaji ardhi. Kama ardhi ni <strong>ya</strong> umma, Waziri mwenye dhama<strong>na</strong> <strong>ya</strong> ardhi a<strong>na</strong>weza,kwa uamuzi wake kutoa ardhi hiyo kwa Mamlaka husika kwa matumizi <strong>ya</strong>o. Hatahivyo Maskwota,ambao wengi wao humiliki ardhi <strong>ya</strong> umma, hawajalindwa <strong>na</strong> sheria hizi <strong>na</strong> hivyo basi wa<strong>na</strong>wezakufurshwa bila kupewa notisi au taarifa <strong>ya</strong> ai<strong>na</strong> yoyote <strong>ya</strong> kuzingatia utaratibu maalum kwa ajili<strong>ya</strong> kudadisi malalamishi <strong>ya</strong>o.3.2.2.7 SHERIA YA WAMILIKI NYUMBA NA (MADUKA,HOTELI,NA MIKAHAWA )(KIFUNGU. 301)Chini <strong>ya</strong> kifungu cha 4 cha Sheria, ambapo ku<strong>na</strong> kandarasi <strong>ya</strong> upangaji iliyoandikwa (maa<strong>na</strong><strong>ya</strong>ke kandarasi <strong>ya</strong> upangaji ambayo haijandikWa au imeandikwa <strong>na</strong> isiyozidi miaka tano au i<strong>na</strong>kipengee cha kusimamisha kandarasi,kando <strong>na</strong> ukiukaji wa kandarasi hiyo katika miaka mitanotangu iandikwe) i<strong>na</strong>weza kusimamishwa tuu baada <strong>ya</strong> notisi kutolewa kwa mpangaji <strong>na</strong> yeyekupewa <strong>na</strong>fasi <strong>ya</strong> kujitetea.Hatahivyo swala la kuhamisha <strong>watu</strong> ni tatanishi chini <strong>ya</strong> sheria hii. Wenye nyumba wengi hutakamakubaliano <strong>ya</strong>siowahusu. Hatahivyo,kandarasi hizo huhusisha tuu mijengo <strong>ya</strong> wamiliki <strong>na</strong>i<strong>na</strong>waepusha kutoka kuwajibikia sheria hizo. Visa vingi v<strong>ya</strong> uhamisho huathiri <strong>watu</strong> zaidi katikamakazi duni.3.2.2.8 SHERIA YA MASHARTI YA KODI (KIFUNGU. 296)Sheria hii ndiyo <strong>ya</strong> ki<strong>na</strong> zaidi i<strong>na</strong>yoshughulikia uhusiano wa mpangaji <strong>na</strong> mwenye nyumbanchini. Sehemu <strong>ya</strong> 14 huutoa utaratibu wa ki<strong>na</strong> wa masharti <strong>ya</strong> kutimizwa kabla <strong>ya</strong> amri <strong>ya</strong> <strong>watu</strong>kufurishwa kutolewa.Ni sheria i<strong>na</strong>yomlinda mpanganji dhidi <strong>ya</strong> kufurushwa kiholela. Hatahivyo haijafaulu kutoa mwongozomadhubuti kulinda haki za wapangaji. Hali hii i<strong>na</strong>weza kuhusishwa <strong>na</strong> baadhi <strong>ya</strong> mamboambayo ni pamoja <strong>na</strong>:Asili <strong>ya</strong> kisheria <strong>ya</strong> makazi duni mara nyingi huzuia wapangaji wengi kujihusisha <strong>na</strong> mfumo(a)wa kisheria kutoka<strong>na</strong> <strong>na</strong> hali <strong>ya</strong>o ambapo ni maskini <strong>na</strong> wa<strong>na</strong>ishi katika makaazi kinyumecha sheria.Sheria hii haihusu Serikali au taasisi zake,hivyobasi wapangaji au <strong>watu</strong> wa<strong>na</strong>oishi katika(b)makazi katika hali isiyohalali hawawezi kulindwa <strong>na</strong> serikali. 3.2.2.9 SHERIA YA KUTOINGIA KWENYE MAKAZI YA WATU BILA RUHUSA (KIFUNGU. 294)Sehemu <strong>ya</strong> 3 <strong>ya</strong> sheria hii imenukuu hatua <strong>ya</strong> mtu kuingia katika makazi <strong>ya</strong> <strong>watu</strong> bila ruhusakuwa hatia. AIdha mwenye kuingia katika makaazi hayo atapaswa kujitetea kwa nini aliingiakatika makazi hayo wakati wa uchunguzI <strong>na</strong> kuweka wazi uwezekano wa kuwasababishia <strong>watu</strong>maskini dhiki <strong>ya</strong> kukamatwa <strong>na</strong> kufunguliwa mashitaka <strong>ya</strong> ji<strong>na</strong>i katika hali ambapo utatuzi u<strong>na</strong>wezakupatika<strong>na</strong> kati <strong>ya</strong> wenyewe kwa wenyewe.3.2.2.10 SHERIA YA KUDHIBITI (KIFUNGU. 22)Sehemu <strong>ya</strong> 7 hutoa msingi <strong>ya</strong> kisheria <strong>ya</strong> kawaida ambayo i<strong>na</strong>ruhusu mtu aliye <strong>na</strong> kitu, au <strong>watu</strong>ambao, walichukua kipande cha ardhi kwa muda wa miaka kumi <strong>na</strong> mbili au zaidi bila idhini <strong>ya</strong>mmiliki au mamlaka <strong>ya</strong> usajili au wamiliki wajisajili kama wamiliki kisheria. Sheria hii, hata hivyo,haitumiki kwa uvamizi wa ardhi <strong>ya</strong> umma. Lakini hata pale ambapo hali i<strong>na</strong>weza kuruhusu kwaajili <strong>ya</strong> matumizi <strong>ya</strong> utaratibu, ni vigumu kwa zaidi maskini kufan<strong>ya</strong> hivyo kutoka<strong>na</strong> <strong>na</strong> utata <strong>na</strong>gharama za matumizi <strong>ya</strong>ke.3.2.2.11 SHERIA YA USMAMIZI WA MAZINGIRA (KIFUNGU 8. 1999)Lengo kuu la sheria hii ni kutoa mwongozo wa kisheria utakaosimamia mazingira . Kipenge42 cha katiba ki<strong>na</strong>mpa/ki<strong>na</strong>linda haki <strong>ya</strong> kila mtu kupata mazingira safi. Aidha jukumu hilo nila katiba. Na kumaanisha kwamba ku<strong>na</strong> wakati ambapo <strong>watu</strong> wa<strong>na</strong>weza kuhamishwa kulindamazingira. Changamoto kuu, ni kuweka misingi <strong>ya</strong> kulinda haki <strong>ya</strong> mazingira safi pamoja <strong>na</strong> haki<strong>ya</strong> wakaazi katika makazi <strong>ya</strong>o.Chini <strong>ya</strong> sehemu <strong>ya</strong> kipengee cha (Sehemu 42-57) Mkurugenzi wa shirikal la mazingira (NEMA)<strong>na</strong> waziri wa mazingira kuchukua hatua <strong>na</strong> kutoa mwongozo utakaolinda usatwi wa mazingira.Maeneo <strong>ya</strong> mazingira <strong>ya</strong><strong>na</strong>yohitaji kulindwa maradufu ni,mito,ziwa,maeneo tepetepe,milima,misitu<strong>na</strong> mwambao wa pwani.Hatahivyo sheria hii imetaja tuu kitendo cha kujenga majumba katikamaeneo ha<strong>ya</strong> kuwa hatia . Haku<strong>na</strong> mwongozo maalum wa <strong>kuwahamisha</strong> <strong>watu</strong> kutoka maeneoha<strong>ya</strong> ,ilhali <strong>watu</strong> wamefurushwa mara kwa mara kutoka maeneo ha<strong>ya</strong>.3.2.2.12 SHERIA YA MISITU 2005Shria hii i<strong>na</strong>simamia uzinduzi,ustawi <strong>na</strong> maendeleo, pamoja <strong>na</strong> hifadhi <strong>na</strong> matumizi mwafaka <strong>ya</strong>misitu kwa lengo la kuboresha miundombinu <strong>ya</strong> kijamii <strong>na</strong> kiuchumi nchini. Sheria hii iliwezeshakuundwa kwa shirika la huduma za misitu wa<strong>na</strong>otakiwa kusimamia misitu yote. Majukumu <strong>ya</strong>o nipamoja kuzuia <strong>watu</strong> kuharibu misitu.Sheria hiyo i<strong>na</strong>ruhusu shirika la msitu kuwazuia <strong>watu</strong> kumilikimaeneo hayo lakini haijatoa mfumo wa <strong>kuwahamisha</strong> <strong>watu</strong> wa<strong>na</strong>oishi katika misitu bila ruhusa.Hali hii imetatiza shirika hilo wakati wa<strong>na</strong>potaka <strong>kuwahamisha</strong> <strong>watu</strong>,kwa kushindwa kutekelezaamri <strong>ya</strong> mahakama. Ikiwa <strong>watu</strong> watakiuka notisi hiyo sharia i<strong>na</strong>ruhusu tuu hukumu <strong>na</strong> faini isiyohusisha swlaa la kuwhamisha<strong>watu</strong>. Ni wamiliki bi<strong>na</strong>fsi tuu wa<strong>na</strong>opewa uwezo wa kuwafurusha <strong>watu</strong> chini <strong>ya</strong> sheriasehemu 58 wa<strong>na</strong>weza kutafuta amri <strong>ya</strong> Mahakam kusimamisha uhamisho huo. Hali hii i<strong>na</strong>wezakuwaweka mashakani <strong>watu</strong> wa<strong>na</strong>oishi misituni,kwani haku<strong>na</strong> sheria mwafaka zi<strong>na</strong>zowalinda.3.2.2.13 SHERIA YA MAJI NO. 8 2002Hi ni sheria i<strong>na</strong>yotoa mwongozo wa kusimamia, <strong>na</strong> kuhifadhi maji pamoja <strong>na</strong> kutoa kibali chamatumizi <strong>ya</strong>ke,kusimamia usambazaji wa maji,kuunda <strong>na</strong> kutekeleza sheria za kusambaza maji<strong>na</strong> huduma za maji taka. Sheria hii imeweka rasilamli zote za maji chini <strong>ya</strong> serikali <strong>na</strong> kuwezeshakuundwa kwa taasisi zi<strong>na</strong>zosimamia <strong>na</strong> kutoa mwongozo wa rasilami <strong>ya</strong> maji. Kati <strong>ya</strong> taasisihizi ni bodi <strong>ya</strong> kusimamia raslimali <strong>ya</strong> maji iliyo <strong>na</strong> jukumu la kulinda maeneo/ardhi yenye majimaji.Njia mojawapo <strong>ya</strong> kulinda maeneo ha<strong>ya</strong> ni kuhakikisha <strong>watu</strong> hawan<strong>ya</strong>kui ardhi <strong>ya</strong> maeneo<strong>ya</strong> rasilamli <strong>ya</strong> maji. Hatahivyo <strong>watu</strong> bado wa<strong>na</strong>endelea kujenga katika maeneo ha<strong>ya</strong>. Sheriahii i<strong>na</strong>ruhusu halmashauri,kupitia ruhusa <strong>ya</strong> waziri,kutangaza maeneo yenye maji kama eneolililolindwa <strong>na</strong> kuhamisha <strong>watu</strong> ikiwa: ta<strong>ya</strong>ri wanishi katika maeneo yenye raslimali <strong>ya</strong> maji, <strong>na</strong>kuwaarifu ikiwa watahitajika kuondolewa. Lakini sheria hiyo hailinidi haki za wakaazi <strong>na</strong> kuwachapengo li<strong>na</strong>lohitaji kujazwa <strong>na</strong> mapendekezo ha<strong>ya</strong> .3.2.3 JUHUDI ZA AWALI KUKABILIANA NA SWALA LA KUWAFURUSHA WATU.Juhudi zilifanywa hapo awali <strong>na</strong> serikali kuunda sheria za kukabilia<strong>na</strong> <strong>na</strong> swala la kuwafurusha<strong>watu</strong>.3.2.3.1 MSWADA WA MAREKEBISHO YA ARDHI YA UMMA 2001Mswada huu ulikuwa jaribio zuri la kuunda sheria kuhusu kufurushwa kwa <strong>watu</strong> lakini haukuwahikupitishwa. Kwa mara <strong>ya</strong> kwanza jaribio lilitolewa hasaa kwa ajili <strong>ya</strong> kuunda utaratibu wa kulindahaki za <strong>watu</strong> wanofurushwa. Mswada huo ulielezea kwa ki<strong>na</strong> maa<strong>na</strong> <strong>ya</strong> kufurushwa <strong>na</strong> kusistizahaja <strong>ya</strong> kutoa usalama wa kumiliki ardhi kwa <strong>watu</strong> wa<strong>na</strong>oishi katika makazi duni. Sheria hiyoilitoa utaratibu wa kufuatwa kabla <strong>ya</strong> <strong>watu</strong> kufurushwa. Viwango v<strong>ya</strong> mswada huu viliambata<strong>na</strong><strong>na</strong> mahitaji <strong>ya</strong> kimataifa,<strong>na</strong> ikiwa mswada huu ungepitishwa hapangekuwa haja <strong>ya</strong> kuboresha<strong>Rasimu</strong> <strong>ya</strong> sasa. Hata hivyo, rasimu hiyo kamwe haikuwasilishwa Bungeni.3.2.3.2 MSWADA WA WENYE NYUMBA NA WAPANGAJI 2007Mswada huu uilikuwa <strong>na</strong> lengo la kuimarisha mahusiano <strong>ya</strong> kabaila <strong>na</strong> mpangaji (Maduka, Hotlei<strong>na</strong> mikahawa <strong>ya</strong> upishi) (kifungu <strong>na</strong>mbari 301) <strong>na</strong> Sheria <strong>ya</strong> Kodi Masharti (kifungu. 296). Lengolingine lilikuwa kuanzisha mfumo wa kudhibiti wamiliki wa ardhi <strong>na</strong> wapangaji ili kuratibu sekta <strong>ya</strong>kukodisha; kulinda wapangaji kutoka<strong>na</strong> <strong>na</strong> ongezeko la kodi kinyume cha sheria <strong>na</strong> kuhamishwa<strong>Rasimu</strong> <strong>ya</strong> <strong>kuwahamisha</strong> <strong>watu</strong> <strong>na</strong> makazi map<strong>ya</strong> - Mwongozo <strong>na</strong> rasimu <strong>ya</strong> mswada, 201219


katika makazi <strong>ya</strong>siyo halali; kusawazisha majukumu <strong>ya</strong> wamiliki wa ardhi <strong>na</strong> wapangaji kwa ajili<strong>ya</strong> kuharakisha hukumu <strong>ya</strong> migogoro .Jambo muhimu la mabadiliko lililopendekezwa <strong>na</strong> mswada huu ilikuwa la kuongeza kodi kutokashilingi. 2,500 hadi shilingi. 15,000. Hatua hii ingeweza kuweka wamiliki zaidi chini <strong>ya</strong> mkono waserikali . Mswada pia ulimruhusu waziri kuanzisha jopo katika maeneo mengine. Mswada uliwezeshajopo kuamua kodi <strong>ya</strong> haki kwa ajili <strong>ya</strong> kudhibiti <strong>watu</strong> kufurushwa kutoka<strong>na</strong> <strong>na</strong> kutolipa kodi.Mswada huo pia ulitoa kauli kwamba mtu hawezi kufurushwa hadi mwenye nyumba apate amrikutoka kwa jopo la makazi Mahakama i<strong>na</strong> uwezo wa kukataa kutoa amri kama hiyo isipoku<strong>watu</strong>u wakiridhishwa, kwa kuzingatia hali zote, kuwa itakuwa ni haki kufan<strong>ya</strong> hivyo. Mwenye nyumbaambaye a<strong>na</strong>mfurusha mpangaji bila mamlaka <strong>ya</strong> Mahakama atakuwa <strong>na</strong> hatia <strong>na</strong> kutozwa fainiisiyozidi kodi <strong>ya</strong> miezi miwili ‘<strong>ya</strong> majengo au kifungo kwa muda usiozidi miezi sita, au vyote viwli.Ikiwa mswada huo ungepita ungelitoa mwongozo wa kuimarisha <strong>na</strong> kulinda haki za mpangaji ,hata hivyo, bado haungeliweza kushughulikia kikamilifu matukio mbalimbali <strong>ya</strong> <strong>watu</strong> kufurushwanchini. Kwanza, mswada huu ulishughulikia mahusiano <strong>ya</strong> mwenye nyumba / mpangaji wakatihakukuwepo <strong>na</strong> mahusiano hayo katika hali halisi. Pili, mswada huo haukushughulika sa<strong>na</strong> taratibukufuatwa kabla <strong>ya</strong> <strong>watu</strong> kufurushwa, jopo lilipewa uwezo wa kuamua.3.2.3.3 MSWADA WA NYUMBA 2011Muswada wa Sheria <strong>ya</strong> <strong>Makazi</strong> ulianza kuimarishwa mwaka 2004 <strong>na</strong> hadi sasa bado haujakamilika.Toleo la mwisho lilikuwa tarehe 2011. Mswada huo haujashughulikia maswali <strong>ya</strong> <strong>watu</strong> kufurushwa3.2.3.4 KANUNI ZA SHERIA YA MIPANGO NA UJENZIHaku<strong>na</strong> hata sera moja i<strong>na</strong>yoongoza mipango <strong>na</strong> sekta <strong>ya</strong> ujenzi. Ukosefu wa sera <strong>ya</strong> mpangilio<strong>ya</strong> ardhi <strong>ya</strong> kuongoza jinsi ambayo ardhi hiyo itatumika i<strong>na</strong>sababisha mvurugano katika matumizi<strong>ya</strong> ardhi. Kodi za mijengo katika sekta <strong>ya</strong> ujenzi nchini Ken<strong>ya</strong> haitoshelezi, udhibiti <strong>na</strong> kufanisilengo <strong>na</strong> njia za utekelezaji <strong>na</strong> kusababisha kero kubwa kwa utoaji wa makazi <strong>na</strong> ujenzi,<strong>na</strong>kuongezeka kwa makazi duni. Kupanga <strong>na</strong> kujenga kanuni ni chimbuko la makazi endelevu <strong>ya</strong>bi<strong>na</strong>damu. 3.2.4.1 KESI YA MSITU WA MAUSerikali ilipotangaza hatua <strong>ya</strong> kuchukua v<strong>ya</strong>nzo v<strong>ya</strong> maji <strong>ya</strong> Mau, walikumbwa <strong>na</strong> vikwazo kwani<strong>watu</strong> waliomiliki vipande v<strong>ya</strong> arhdi walidaiwa kulaghaiwa. Serikali iliunda jopo la kutafuta mwafakakudadisi madai <strong>ya</strong> wakaazi hao kuhusu jinsi walivyomiliki ardhi hiyo. Baada <strong>ya</strong> kukamilishakazi <strong>ya</strong>ke, kamati walitoa mapendekezo ambayo <strong>ya</strong>taratibiwa <strong>na</strong> baraza katika <strong>ya</strong> Ofisi <strong>ya</strong> WaziriMkuu ambayo lengo lake kuu ni kuratibu utekelezaji wa mapendekezo kuhusu ukarabati <strong>na</strong> uhifadhiwa Msitu wa Mau .Mazungumzo <strong>ya</strong>litambuliwa kama kipengele muhimu katika kuwezesha usafiri wa <strong>watu</strong> kutokamsituni. Hata hivyo, mchakato umekumbwa <strong>na</strong> ubishi wa kisiasa. Mbinu iliyopitishwa katikakushughulikia suala la kufukuzwa <strong>na</strong> zoezi la kuwarejesha li<strong>na</strong>zidi, ilikuwa ni mfano kwambai<strong>na</strong>wezeka<strong>na</strong> kushughulikia suala la kufahamisha <strong>watu</strong> kwa <strong>na</strong>m<strong>na</strong> ambayo itapunguza uwezekanowa ukiukaji wa haki za bi<strong>na</strong>damu. Ni matumaini <strong>ya</strong> Serikali kwamba, kutoka<strong>na</strong> <strong>na</strong> kuundwakwa Mamlaka <strong>ya</strong> Misitu Mau, suluhisho la kudumu litapatika<strong>na</strong> katika kushughulikia suala lakuvutia maelewano kati <strong>ya</strong> ulinzi wa maeneo <strong>ya</strong> v<strong>ya</strong>nzo v<strong>ya</strong> maji <strong>na</strong> haki za bi<strong>na</strong>damu kwa walewa<strong>na</strong>oishi katika maeneo hayo.3.2.4.2 MPANGO WA SHIRIKA LA RELI WA KUWAHAMISHA WATUMwaka 2006 shirika la reli lilihamisha shughuli zake kupitia mkataba kwa shirika la reli laRift Valley. Kwa kipindi kirefu <strong>watu</strong> walimiliki maeneo <strong>ya</strong> ardhi <strong>ya</strong> reli wakiwemo wafan<strong>ya</strong>biasharawadogo wadogo, taasisi kama vile shule <strong>na</strong> mijengo <strong>ya</strong> makazi hasa katika maeneo<strong>ya</strong> reli <strong>ya</strong> Kibera <strong>na</strong> Mukuru-Nairobi. Katika makubaliano <strong>ya</strong> mkataba ilikubaliwa kuwawaliochukua hifadhi <strong>ya</strong> maeneo hayo wahame ili kutoa <strong>na</strong>fasi kwa ajili <strong>ya</strong> upanuzi wareli <strong>na</strong> kupunguza matukio <strong>ya</strong> ajali. Benki <strong>ya</strong> Dunia ilikubali kufadhili mradi wa upanuzi.Kuwezesha kuondolewa kwa biashara au wale wa<strong>na</strong>oishi katika hifadhi <strong>ya</strong> reli, mpango wa <strong>kuwahamisha</strong>-ActionPlan (RAP) ulitengenezwa <strong>na</strong> kukamilika mwaka 2005 lakini haukutekelezwa.Mpango huo ulikuwa <strong>na</strong> lengo la kutoa njia mbadala <strong>ya</strong> <strong>kuwahamisha</strong> <strong>watu</strong> . Mpango mp<strong>ya</strong>wa RAP uliundwa <strong>na</strong> kukamilika mwaka 2010 <strong>na</strong> sasa ni mada <strong>ya</strong> majadiliano kati <strong>ya</strong> wakazi<strong>na</strong> mamlaka <strong>ya</strong> Reli. Mpango huo u<strong>na</strong>takiwa kuongozwa <strong>na</strong> Sera <strong>ya</strong> Benki <strong>ya</strong> Dunia 4.12, ambayohutoa mwongozo, kwamba kila mpango wa makazi map<strong>ya</strong> au mfumo wa sera lazima ujumuishehatua za kuhakikisha kuwa <strong>watu</strong> waliokosa makazi <strong>ya</strong>o wa<strong>na</strong>fahamishwa kuhusu mbinumbadala ,wa<strong>na</strong>pewa ushauri, <strong>na</strong> makao wa<strong>na</strong>yoweza kumudu kifedha. 3.2.4.3 MRADI WA KILIMO MWEA WA KUNYUNYUZIA MAJI (Mwea Irrigation Agriculturedevelopment-MIAD).Bodi <strong>ya</strong> Taifa <strong>ya</strong> Unyunyuziaji Maji (NIB) imebainisha maeneo <strong>ya</strong> upanuzi wa kuongeza uzalishajiwa mchele <strong>na</strong> kuongeza upatika<strong>na</strong>ji wa maji katika eneo Mutithi Mwea katika wila<strong>ya</strong> <strong>ya</strong> Kirin<strong>ya</strong>ga.mradi utahitaji ziada <strong>ya</strong> hekta 8,860 za ujenzi wa bwawa katika mto wa Thiba katika eneo laKabare, kata <strong>ya</strong> Gichugu. Itawalazimu kupata ardhi kwa ajili <strong>ya</strong> ujenzi wa bwawa <strong>na</strong> miundombinu <strong>ya</strong> usambazaji maji.Eeneo li<strong>na</strong>milikiwa <strong>na</strong> <strong>watu</strong> bi<strong>na</strong>fsi chini <strong>ya</strong> mifumo <strong>ya</strong> kukodi ardhi.Mpango wa <strong>Makazi</strong> Map<strong>ya</strong> (RAP) ulifanyika kuongoza mchakato kulinga<strong>na</strong> <strong>na</strong> mahitaji <strong>ya</strong> zamani<strong>ya</strong> Benki <strong>ya</strong> Japan <strong>ya</strong> Ushirikiano wa Kimataifa (JBIC), <strong>na</strong> Miongozo <strong>ya</strong> Benki <strong>ya</strong> DuniaSera <strong>ya</strong> <strong>Makazi</strong> Map<strong>ya</strong> - OP 4.12, Desemba 2001. Aidha, RAP ilikopa sa<strong>na</strong> mwongozo kutokataasisi <strong>ya</strong> fedha <strong>ya</strong> kimataifa <strong>ya</strong> Ufaransa (IFC) kwa ajili <strong>ya</strong> kuunda miongozo <strong>ya</strong> <strong>Makazi</strong>.Lengo la Mpango wa <strong>Makazi</strong> Map<strong>ya</strong> lilikuwa ni kufan<strong>ya</strong> utafiti wa sensa <strong>ya</strong> kijamii <strong>na</strong> kiuchumikutathmini <strong>watu</strong> walioathirika, kukusan<strong>ya</strong> hesabu <strong>ya</strong> mali iliyoharibiwa kwa lengo la kuweka miongozo<strong>ya</strong> fidia <strong>na</strong> kutoa bajeti kwa ajili <strong>ya</strong> utekelezaji. Utafiti RAP ulitoa miongozo NIB kuhusumahitaji <strong>ya</strong> ununuzi wa ardhi, <strong>watu</strong> ambao nchi zitachukuliwa <strong>na</strong> hivyo zi<strong>na</strong>hitaji kupelekwa <strong>na</strong>mali walioathirika <strong>na</strong> mradi huo. Pia hutoa kwa wadau katika kukabilia<strong>na</strong> <strong>na</strong> athari mba<strong>ya</strong> <strong>ya</strong> kijamii<strong>ya</strong> mradi huo. Mashauriano <strong>ya</strong> umma juu <strong>ya</strong> Tathmini <strong>ya</strong> Athari <strong>ya</strong> Mazingira (EIA) <strong>na</strong> Mpangowa Utekelezaji wa <strong>Makazi</strong> Map<strong>ya</strong> (RAP) <strong>ya</strong>ilifanyika ili kuwajulisha jamii kuhusu mradi <strong>na</strong> malengo<strong>ya</strong> EIA <strong>na</strong> RAP. Ili kuepuka madai <strong>ya</strong> uongo kwa ajili <strong>ya</strong> fidia au ukarabati baada <strong>ya</strong> kutoataarifa <strong>ya</strong> mipango <strong>ya</strong> mradi, tarehe wazi ilipangwa <strong>na</strong> kutangazwa katika maeneo <strong>ya</strong> Kabare<strong>na</strong> Mutithi, angalau siku saba kabla <strong>ya</strong> kuanza kwa uchunguzi wa sensa <strong>ya</strong> kijamii <strong>na</strong> kiuchumi.Utafiti RAP ulitilia maa<strong>na</strong>ni kwamba katika utamaduni wa Ken<strong>ya</strong> wa jadi, umiliki wa ardhi auriba katika nchi hautegemei milki <strong>ya</strong> hati miliki. Idadi kubwa <strong>ya</strong> <strong>watu</strong> huishi chini <strong>ya</strong> mfumowa umiliki wa ardhi, ambapo mmiliki wa ardhi a<strong>na</strong>weza kuwa <strong>na</strong> <strong>watu</strong> kadhaa wengine wa<strong>na</strong>oishi<strong>na</strong> kumiliki mali katika eneo hilo, lakini hawa<strong>na</strong> hati miliki halali. Ardhi nyingi zimegawanywaili watoto au ndugu wengine wamiliki ardhi. Ku<strong>na</strong> ardhi zengine ambazozimegawanywa rasmi, lakini mabadiliko ha<strong>ya</strong>jafanywa kwenye ofisi za ardhi kwa sababumbalimbali. Pia ku<strong>na</strong> baadhi <strong>ya</strong> ardhi zilizouzwa <strong>na</strong> kugawanywa kihalali <strong>na</strong> vyeti vimetolewa,lakini mabadiliko katika rekodi <strong>ya</strong> sasa kwenye ofisi za ardhi, au katika ramani <strong>ya</strong> sasa<strong>ya</strong> utafiti ha<strong>ya</strong>jafanywa. Watu walioathirika ni pamoja <strong>na</strong> ambao wa<strong>na</strong> nia <strong>ya</strong> kupata ardhikisheria, au wa<strong>na</strong>oishi katika eneo la walioathirika <strong>na</strong> vyeti. Mpango, huu utatekelezwa kwa hatuatatu kwa kushirikia<strong>na</strong> <strong>na</strong> wadau wengine wa maendeleo kama UN-Habitat, malengo <strong>ya</strong> kuboreshamaisha <strong>ya</strong> <strong>watu</strong> wa<strong>na</strong>oishi <strong>na</strong> kufan<strong>ya</strong> kazi katika makazi duni <strong>na</strong> makazi <strong>ya</strong>siyo rasmi katikamaeneo <strong>ya</strong> mijini <strong>ya</strong> Ken<strong>ya</strong>.Awamu <strong>ya</strong> kwanza i<strong>na</strong>shughulikia miji mikubwa nchini. Ili kuboresha makazi duni, ilibidiwahamishe <strong>watu</strong> kwa awamu hadi katika eneo la Lang’ata ili kuunda <strong>na</strong>fasi kwaajili <strong>ya</strong> kupata <strong>na</strong>fasi <strong>ya</strong> kujenga miundombinu. Kulinga<strong>na</strong> <strong>na</strong> mkakati <strong>ya</strong> KENSUP shughuli<strong>ya</strong> kuhamishwa <strong>watu</strong>, kutoka Soweto Mashariki ilifuata utaratibu wa kudumu.Hatua zi<strong>na</strong>zohusika:• Kutambua Watu watakaohamishwa, <strong>na</strong> kufan<strong>ya</strong> mikutano <strong>ya</strong> ushauriano <strong>na</strong> wadauhusika kwa ajili <strong>ya</strong> kuelewa uratibu.• Kuhamasisha <strong>watu</strong> waliolengwa ili kujenga imani <strong>na</strong> kumiliki mchakato, kutoa matangazo<strong>ya</strong> kuhama, mgao wa vitengo v<strong>ya</strong> makazi katika tovuti, kuondolewa kwamiundo <strong>na</strong> wamiliki, <strong>na</strong> kutia saini mkataba wa maelewano.• Kutia saini mikataba <strong>ya</strong> upangaji i<strong>na</strong>yonyesha nyumba walizotengewa.• Kodi i<strong>na</strong>yolipwa <strong>na</strong> hali <strong>ya</strong> kuhamishwa tangu <strong>watu</strong> wa<strong>na</strong>potarajiwa kuhamaSoweto Mashariki nyumba mp<strong>ya</strong> i<strong>na</strong>pokamilika.Wizara iliwezesha harakati <strong>ya</strong> kuhamisha familia <strong>na</strong> bidhaa za nyumbani kwa kutoa usafiri.wakazi walipewa notisi <strong>ya</strong> miezi miwili. Serikali ilikuwa <strong>na</strong> uwezo wa kuhamisha <strong>watu</strong> 3529kutoka Soweto Kibera Mashariki Eneo la A hadi katika eneo la Lang’ata bila kulazimishwa.Kanuni ambazo zilikuwa kigezo cha mradi zililinda haki za bi<strong>na</strong>damu. 3.2.4.5 MAKAZI DUNI YA ZIWA LA NG’OMBE – MOMBASAMradi huu ulihusisha ujenzi wa shule, ofisi za usimamizi <strong>na</strong> barabara. Hapa, mkakati <strong>ya</strong>KENSUP kuhamisha <strong>watu</strong> ilitumika. Shughuli <strong>ya</strong> kuwashirikisha <strong>watu</strong> kwa kutoa taarifa <strong>ya</strong> nia<strong>ya</strong> kuboresha eneo hilo ilifanywa kwa njia <strong>ya</strong> baraza, ingawa ombi la kuboresha shule lilikuwalimetoka kwa jamii. Kulikuwa <strong>na</strong> mkutano wa mashauriano <strong>na</strong> wadau wote ili kuhakikishawamelewa<strong>na</strong>, wamehamasishawa , <strong>na</strong> kuhusishwa kwa Halmashauri <strong>ya</strong> Manispaa <strong>ya</strong> Mombasaambayo idara <strong>ya</strong> utekelezaji <strong>ya</strong> KENSUP katika hatua zote, kutoka kwa mipango <strong>ya</strong> utekelezaji.Kamati <strong>ya</strong> Utendaji ilianzishwa kwa ajili <strong>ya</strong> kuhamasisha jamii <strong>na</strong> ushiriki. Hatimaye, wakaziwaliondoka kwa hiari <strong>na</strong> ardhi <strong>ya</strong> shule <strong>na</strong> utawala a kukabidhiwa kwa jamii. Ni jukumu la serikali <strong>kuwahamisha</strong> <strong>na</strong> kuwapa makaazi wamiliki wasiojiweza4.0 KUTAFUTA UTATUZI:MWONGOZO WA KUWAHAMISHA WATUPamoja <strong>na</strong> kwamba Serikali imefan<strong>ya</strong> juhudi mbalimbali ili kupata suluhisho madhubuti la kisheriala tatizo la <strong>watu</strong> kufurushwa kiholela, mbinu <strong>ya</strong> ki<strong>na</strong> i<strong>na</strong>hitajika, hasa katika mtazamo waKatiba mp<strong>ya</strong> ambayo ilianzisha wajibu mp<strong>ya</strong> .4.1 MATATIZO YA KUHAMISHWA KWA NGUVUKatika kuendeleza miongozo hii, masuala kadhaa lazima kushughulikiwa. Maswala hayo <strong>ya</strong>mejadiliwahapa chini.4.1.1 UMILIKI WA ARDHIKwa ujumla kumekuwa <strong>na</strong> mwelekeo wa kuzingatia utoaji wa vyeti v<strong>ya</strong> ardhi kwa <strong>watu</strong> bi<strong>na</strong>fsi.Kutafuta cheti cha ardhi kama mtu bi<strong>na</strong>fsi huambatan <strong>na</strong> gharama <strong>ya</strong> juu. Nchini Ken<strong>ya</strong>, tanguvyeti v<strong>ya</strong> ardhi vianze kutolewa kwa muda wa miaka 100, ni asilimia 15% tuu <strong>ya</strong> taifa imepata<strong>Rasimu</strong> <strong>ya</strong> <strong>kuwahamisha</strong> <strong>watu</strong> <strong>na</strong> makazi map<strong>ya</strong> - Mwongozo <strong>na</strong> rasimu <strong>ya</strong> mswada, 201225

Hii itaimarishausalama wa umiliki, hasa kwa maskini mijini <strong>na</strong> vijijini. Mifano <strong>ya</strong> ai<strong>na</strong> hii ni pamoja <strong>na</strong>haki za umiliki wa ardhi, mfano wa ai<strong>na</strong> za umiliki ni pamoja <strong>na</strong> haki za kukabilia<strong>na</strong> <strong>na</strong> kesi zakufurushwa, mmilki mba<strong>ya</strong>, upangaji <strong>na</strong> ukodishaji usiosajiliwa.4.1.2 USMAMIZI WA ARDHIMifumo hii ni muhimu kwani haiwezekani kusambaza haki za ardhi <strong>na</strong> usalama wa umiliki bilamfumo sahihi wa kiufundi <strong>na</strong> taasisi (utawala bora) ili kuimarisha haki hizo. Hizi ni pamoja <strong>na</strong>kumbukumbu za ardhi, taratibu za uendeshaji, <strong>na</strong> ugavi wa kazi. Mfumo wa usajili wa ardhihufanywa pahala pamoja,ni ghali, kuwategemea wataalamu wasiopatika<strong>na</strong>, <strong>na</strong> huwa katika mijimikubwa. Hali hii i<strong>na</strong>sababisha wale wa<strong>na</strong>oishi nje <strong>ya</strong> maeneo <strong>ya</strong> mijini, hasa maskini <strong>na</strong> hawajuikusoma <strong>na</strong> kuandika, si rahisi kutumia au kupata huduma <strong>ya</strong> kawaida.4.1.3 MPANGILIO WA MIKAKATIMifumo <strong>ya</strong> kusimamia <strong>na</strong> kupanga miradi haijabadilika kwa kiasi kikubwa tangu uhuru <strong>na</strong> haiambatani<strong>na</strong> ustawi wa miji nchini Ken<strong>ya</strong> <strong>na</strong> mwenendo wa makazi. Kupanga mikakati <strong>na</strong> mbinukuimarishwa ili kuhakikisha kwamba maendeleo <strong>ya</strong> udhibiti <strong>na</strong> usimamizi wa matumizi <strong>ya</strong> ardhini endelevu. Nchini kote,mbinu <strong>na</strong>fuu za kupanga viwango , ikiwa ni pamoja <strong>na</strong> haja <strong>ya</strong> kuwa <strong>na</strong>maendeleo <strong>ya</strong><strong>na</strong>hitajika kutekelezwa4.1.4 UGAVI WA MAMLAKA NA UBORESHAJI WA UWEZO WA UTAWALAKatika siku za nyuma, makundi <strong>ya</strong> wanyonge ha<strong>ya</strong>kuhusishwa <strong>na</strong> maafisa wa utawala katikautoaji wa maoni kikamilifu. Uwazi <strong>na</strong> ushiriki wa jamiikatika maamuzi <strong>ya</strong> maendeleo lazima kuzingatiwa.4.1.5 VIWANGO VYA MIPANGO NA HUDUMA ZA JAMIIWakaazi wengi katika miji/makazi bado wa<strong>na</strong>tegemea mipango <strong>na</strong> huduma za kijamii ambayoi<strong>na</strong> viwango visivyozingatia changamoto za maendeleo <strong>ya</strong> miji <strong>na</strong> mwenendo wa kisasa wamaendeleo. “Mtu a<strong>na</strong>yesimamia” maa<strong>na</strong> <strong>ya</strong>ke ni mtu ambaye a<strong>na</strong> au kwa wakati husika alikuwa <strong>na</strong> mamlaka<strong>ya</strong> kisheria <strong>ya</strong> kutoa ruhusa kwa mtu kuingia au kuishi juu <strong>ya</strong> ardhi katika swali;“Skwota mtaalamu” i<strong>na</strong>maanisha <strong>watu</strong> au vikundi v<strong>ya</strong> <strong>watu</strong> ambao huchukua ardhi kwa madhumuni<strong>ya</strong> kubahatisha bila <strong>ya</strong> kueleza au kupata ridhaa <strong>ya</strong> mwenye nyumba au mtu katikamalipo. I<strong>na</strong>husu pia <strong>watu</strong> ambao wamekuwa awali walituzwa nyumba au ardhi <strong>na</strong> Serikalilakini ambao waliuza, ikodisha au kuihamisha kinyume cha sheria katika sehemu moja aukatika eneo jingine. Maa<strong>na</strong> hii haitaambatanishwa <strong>na</strong> <strong>watu</strong> bi<strong>na</strong>fsi au vikundi v<strong>ya</strong> <strong>watu</strong> ambaohukodi ardhi <strong>na</strong> nyumba kutoka maskwota mtaalamu au sakata za maskowta.“Mali” ni pamoja <strong>na</strong> haki yoyote au nia kutoka<strong>na</strong> kumiliki <strong>na</strong>- ardhi, au Ratiba <strong>ya</strong> kudumukwenye, au maboresho <strong>ya</strong> ardhi; bidhaa au mali bi<strong>na</strong>fsi; fedha <strong>na</strong> vyombo vilivyojadiliwa;“Maslahi <strong>ya</strong> umma” ni pamoja <strong>na</strong> maslahi <strong>ya</strong> af<strong>ya</strong> <strong>na</strong> usalama wa wale wa<strong>na</strong>omiliki ardhi <strong>na</strong>umma kwa ujumla;“mtu a<strong>na</strong>yemiliki ardhi kinyume cha sheria” i<strong>na</strong> maa<strong>na</strong> <strong>ya</strong> mtu ambaye a<strong>na</strong> milki <strong>ya</strong>, au nchialichukua bila ridhaa <strong>ya</strong> mmiliki, au bila <strong>ya</strong> haki yoyote kwenye sheria <strong>ya</strong> kumilki , au kumilikiardhi hiyo..3— Misingi <strong>ya</strong> sheria(1) Misingi <strong>ya</strong> sheri ni <strong>ya</strong> ku—(a) kuhakikisha kwamba wato wa<strong>na</strong>omiliki ardhi kinyume cha sheria, ardhi <strong>ya</strong> umma,au ardhi bi<strong>na</strong>fsi hawatateseka kwa kufukuzwa kin<strong>ya</strong>ma au haki zao kukiukwa wakatiwowote wa mchakato wa kufukuzwa;(b) kulinda haki <strong>ya</strong> kumiliki mali <strong>ya</strong> wa<strong>na</strong>ofurushwa <strong>na</strong> wamiliki halali wa ardhi kinyume chasheria ;(c) kuhakikisha wa<strong>na</strong>pata msaada wa serikali kwa <strong>watu</strong> waliofurushwa katika makao <strong>ya</strong>o<strong>ya</strong> awali;(d) kuhakikisha adhabu sahihi kwa ajili <strong>ya</strong> <strong>watu</strong> waliohusika <strong>na</strong> kuwaondoa umma, jamii aumtu bi<strong>na</strong>fsi kwa ardhi kinyume cha sheria(2) Sheria hii haihusishi maskwota walio <strong>na</strong> mazoea <strong>ya</strong> kuchukua ardhi4— Haki <strong>ya</strong> makazi <strong>na</strong> ulinzi dhidi <strong>ya</strong> kufurushwaHaku<strong>na</strong> mtu atakayefurushwa kutoka kwa nymba <strong>ya</strong>ke,au kubomolewa nyumba au kuvunjiwamali <strong>ya</strong>o bila amri <strong>ya</strong> mahakama <strong>na</strong> amri hiyo izingatie maslahi <strong>ya</strong> wakaazi hao.<strong>Rasimu</strong> <strong>ya</strong> <strong>kuwahamisha</strong> <strong>watu</strong> <strong>na</strong> makazi map<strong>ya</strong> - Mwongozo <strong>na</strong> rasimu <strong>ya</strong> mswada, 201231


SEHEMU YA II—KANUNI ZA, NA TARATIBU ZA KUHAMISHA WATU,5— Kanuni za JumlaKanuni hizi zitafuatiliwa katika kufurusha <strong>watu</strong>—(a) Nafasi <strong>ya</strong> majadiliano;(b) Muda ufaao wa kutoa notisi;(c) Tathmini <strong>ya</strong> kimazingira, kiuchumi <strong>na</strong> kijamii kabla <strong>ya</strong> <strong>watu</strong> kufukuzwa <strong>na</strong> maandalizi <strong>ya</strong>mipango makazi map<strong>ya</strong> kuta<strong>ya</strong>rishwa; <strong>na</strong>fasi kwa ajili <strong>ya</strong> kurekebisha sheria; uwazi, <strong>na</strong>kufuata kanuni za kimataifa za haki za bi<strong>na</strong>damu katika mchakato yoyote kufukuzwa.(d) Nafasi <strong>ya</strong> kusikizwa <strong>na</strong> mamlaka <strong>ya</strong> kisheria(e) Uwazi <strong>na</strong> kufuata kanuni za kulinda haki za bi<strong>na</strong>damu katika kesi yeyote <strong>ya</strong> kufursha <strong>watu</strong>.6— Ilani <strong>ya</strong> kufurusha <strong>watu</strong>(1) Kabla hatua yeyote <strong>ya</strong> kufurusha <strong>watu</strong> kutekelezwa,notisi <strong>ya</strong> miezi isiyopungua tatu itolewekwa waathiriwa <strong>na</strong> mmiliki wa ardhi(2) Notisi hiyo ichapishwa katika lugha i<strong>na</strong>yozungumzwa <strong>na</strong> wakaazi hao katika eneo walimotrajiwakufurushwa,notisi hiyo iwasilishwe kwa —(a) Mikutano <strong>ya</strong> baraza(b) Vyombo v<strong>ya</strong> kutangaza habari nchini <strong>na</strong> mashi<strong>na</strong>ni.(3) Notisi hiyo itajumuisha taarifa <strong>ya</strong> sababu zi<strong>na</strong>zolazimu <strong>watu</strong> kufurushwa <strong>na</strong> dhamira <strong>ya</strong>matumizi <strong>ya</strong> ardhi hiyo.(4) Mikutano <strong>ya</strong> hadhara ifanywe kati <strong>ya</strong> waathiriwa <strong>na</strong> wamiliki <strong>ya</strong> kujadili njia mbadala auuwezekano wa kuepuka haja <strong>ya</strong> <strong>kuwahamisha</strong> <strong>watu</strong> hao .(5) Iwapo haku<strong>na</strong> njia mbadala <strong>ya</strong> kukwepa kuwafurusha,hatua mwafaka zichukuliwe kupunguzaatahri za kufursha <strong>watu</strong> .7— Utathmini wa athari za mazingira(1) Halmashauri au mtu a<strong>na</strong>yependekeza kuwafurusha <strong>watu</strong> lazima atathmini atahri zakimazingiria,uchumi <strong>na</strong> kijamii <strong>na</strong> ata<strong>ya</strong>rishe ratiba <strong>ya</strong> kuwatafutia makaazi mbadala(2) Tathmini <strong>ya</strong> athari uliyofanywa chini <strong>ya</strong> kifungu cha (1) zitakuwa ni pamoja <strong>na</strong>-(a) kuweka tarehe maalum kwa ajili <strong>ya</strong> mchakato wa kuhesabia;32 <strong>Rasimu</strong> <strong>ya</strong> <strong>kuwahamisha</strong> <strong>watu</strong> <strong>na</strong> makazi map<strong>ya</strong> - Mwongozo <strong>na</strong> rasimu <strong>ya</strong> mswada, 2012

9— Kufurushwa wamiliki wasio halali(1) Pamoja <strong>na</strong> hayo, <strong>na</strong> kwa kujali sheria, masharti <strong>ya</strong> ibara hii <strong>ya</strong><strong>na</strong>husu kesi <strong>ya</strong> mmiliki wa ardhikwa ajili <strong>ya</strong> kufurushwa kiholela kinyume cha sheria mtu a<strong>na</strong>yemiliki makazi kinyume cha sheria.(2) Angalau siku ishirini <strong>na</strong> <strong>na</strong>ne kabla <strong>ya</strong> kusikilizwa kwa kesi <strong>ya</strong> kudharau katika kifungu cha (1),mahakama wataandika taarifa <strong>ya</strong> kesi kwa mmiliki haramu(3) Kulinga<strong>na</strong> <strong>na</strong> masharti <strong>ya</strong> kifungu cha (2), utaratibu wa kutoa matangazo <strong>na</strong> jalada la magazetini kama ilivyoagizwa <strong>na</strong> sheria <strong>ya</strong> mahakama(4) Kulinga<strong>na</strong> <strong>na</strong> masharti <strong>ya</strong> kifungu cha (2), kama mahakama haikuridhika kwamba hudumahaiwezi kufanyika kwa njia zilizotolewa katika sheria <strong>ya</strong> mahakama, huduma itaathirika kwa<strong>na</strong>m<strong>na</strong> ilivyoongozwa <strong>na</strong> mahakama:Bora tuu mahakama itazingatia haki za mmiliki haramu <strong>ya</strong> kupokea ilani <strong>ya</strong> kutosha <strong>na</strong> kujitetea kesi.(5) Taarifa <strong>ya</strong> kesi katika kifungu cha (2) itatoa mwelekeo(a) kuwa iambatane <strong>na</strong> kifungu cha (1) kwa ajili <strong>ya</strong> utaratibu kwa ajiliwa<strong>na</strong>ofukuzwa kinyumecha sheria;(b) zionyeshe sasa <strong>na</strong> wakati mahakama kusikia kesi;(c) kuweka misingi <strong>ya</strong> penedekezo la kufurusha <strong>watu</strong>; <strong>na</strong>(d) mmiliki aliyemiliki ardhi kinyume cha sheria a<strong>na</strong> haki <strong>ya</strong> kusikizwa mbele <strong>ya</strong> mahakama<strong>na</strong> kutetea kesi <strong>na</strong>, i<strong>na</strong>pohitajika, a<strong>na</strong> haki <strong>ya</strong> kuomba msaada wa kisheria.(6) Kama mahakama imeridhika kwamba mahitaji yote <strong>ya</strong> sehemu hii <strong>ya</strong>metiliwa maa<strong>na</strong>ni, <strong>na</strong>mmiliki haramu hajatoa malalmishi yeyote, kama mahakama imeridhika kwamba matakwa <strong>ya</strong>kifungu hiki <strong>ya</strong>metekelzwa itatoa amri <strong>ya</strong> mahakama <strong>ya</strong> kuwafurusha wakaazi asio halali <strong>na</strong>kuamua -(a) Tarehe ambayo mmiliki asiye halali atahamishwa ;(b) Na tarehe <strong>ya</strong> kutekelezwa amri <strong>ya</strong> mahakama kumfurusha mkaazi ikiwa hatatii amri hiyokuondoka kwenye ardhi iliyotangazwa katika a<strong>ya</strong> <strong>ya</strong> (a).(7) Katika kuamua tarehe chini <strong>ya</strong> kifungu cha (6), mahakama itazingatia mambo yote muhimu,ikiwa ni pamoja <strong>na</strong> muda aliokaa mtu aliyemiliki kinyume cha sheria <strong>na</strong> familia <strong>ya</strong>ke.(8) Mahakama i<strong>na</strong>weza kutoa amri <strong>ya</strong> kubomoa <strong>na</strong> kuondolewa kwa majengo au miundo katikakesi <strong>ya</strong> ardhi hiyo.34 <strong>Rasimu</strong> <strong>ya</strong> <strong>kuwahamisha</strong> <strong>watu</strong> <strong>na</strong> makazi map<strong>ya</strong> - Mwongozo <strong>na</strong> rasimu <strong>ya</strong> mswada, 2012


(9) Amri yoyote kwa ajili <strong>ya</strong> kufukuzwa kwa mmiliki kinyume cha sheria au kwa ajili <strong>ya</strong> uharibifu aukuondolewa kwa majengo <strong>na</strong> miundo katika suala la sehemu hii itatekelezwa chini <strong>ya</strong> busara <strong>ya</strong>mahakama, <strong>na</strong> mahakama <strong>ya</strong>weza, ikiwa <strong>na</strong> sababu nzuri , kutofautia<strong>na</strong> kwa hali yoyote kuhusukufukuzwa kwa mmiliki huyo.10— Kesi <strong>ya</strong> dharura ili kumhamisha mmiliki asiye halali(1) Bila kujali masharti <strong>ya</strong> kifungu cha 8, mmiliki wa ardhi a<strong>na</strong>weza kuanzisha kesi haraka kwaajili <strong>ya</strong> kumfukuza a<strong>na</strong>yemiliki ardhi kinyume cha sheria <strong>ya</strong> nchi, kabla kukamilishwa kwa kesi,<strong>na</strong>mahakama i<strong>na</strong>weza kutoa amri kama hiyo kama i<strong>na</strong>dhihirika kwamba—(a) ku<strong>na</strong> hatari <strong>ya</strong> kweli <strong>na</strong> kubwa au uharibifu wa mtu au mali kama <strong>na</strong>yemiliki adhikinyume cha sheria hatafukuzwa mara moja;(b) Athari i<strong>na</strong>weza kuwa kubwa kwa mmiliki au familia kushinda athari kwa a<strong>na</strong>yemilikiardhi hiyo kwa njia isiyo halali. kwa ajili <strong>ya</strong> kufukuzwa kutoka <strong>na</strong>fasi hiyo.(c) Haku<strong>na</strong> mbinu mbadala <strong>ya</strong> utatuzi.(2) Kabla <strong>ya</strong> kusikilizwa kwa kesi mahak ama chini <strong>ya</strong> kifungu cha (1), itatoa taarifa <strong>ya</strong> maandishi<strong>ya</strong> nia <strong>ya</strong> mmiliki a<strong>na</strong>yetaka notisi <strong>ya</strong> kuhamisha mmiliki asiye halali.(3) Notisi <strong>ya</strong> kesi i<strong>na</strong>yotajwa katika kifungu cha sheria (2) ita—(a) Eleza kwamba kesi itaendeshwa kuambata<strong>na</strong> <strong>na</strong> mwongozo wa kifungo cha sheria (1) ilikuta<strong>ya</strong>risha amri <strong>ya</strong> mahakam <strong>ya</strong> mmiliki asiye halali ;(b) itaonyesha tarehe,wakati <strong>na</strong> lini mahakama itasikiza kesi;(c) <strong>na</strong> kuweka misingi <strong>ya</strong> kumarifu mtu a<strong>na</strong>yefukuzwa;(d) kumpa <strong>na</strong>fasi <strong>ya</strong> kusikizwa <strong>na</strong> mhakama kutetea kesi <strong>na</strong>, i<strong>na</strong>pohitajika, a<strong>na</strong> haki <strong>ya</strong> kuombamsaada wa kisheria.11— Uhamisho u<strong>na</strong>ofanywa <strong>na</strong> serikali(1) Kama taasisi <strong>ya</strong> serikali i<strong>na</strong> maoni kuwa mtu yoyote a<strong>na</strong>miliki ardhi <strong>ya</strong> umma bila ruhusa <strong>na</strong>kwamba wa<strong>na</strong>takiwa kufukuzwa, taasisi hiyo itatoa ilani, isiyopungua au isiyozidi siku thelathini<strong>na</strong> kwa maandishi, <strong>ya</strong><strong>na</strong>toa wito kwa <strong>watu</strong> wote wa<strong>na</strong>ohusika waoeleze kwa nini utaratibu wakufukuzwa haupaswi kufanywa.(2) Taasisi <strong>ya</strong> serikali i<strong>na</strong>weza kuanzisha kesi <strong>ya</strong> kufukuzwa kwa mtu/<strong>watu</strong> wa<strong>na</strong>omiliki ardhikinyume cha sheria <strong>ya</strong> ardhi <strong>ya</strong> umma au jamii.(3) Mahakama i<strong>na</strong>weza kutoa amri kama hiyo kama wa<strong>na</strong>fikiria ni <strong>ya</strong> haki <strong>na</strong> usawa, baada <strong>ya</strong>kuzingatia mazingira yote husika, <strong>na</strong> kama-<strong>Rasimu</strong> <strong>ya</strong> <strong>kuwahamisha</strong> <strong>watu</strong> <strong>na</strong> makazi map<strong>ya</strong> - Mwongozo <strong>na</strong> rasimu <strong>ya</strong> mswada, 201235


(a)(b)Ruhusa <strong>ya</strong> tasisi <strong>ya</strong> serikali i<strong>na</strong>hitajika kwa ajili <strong>ya</strong> kujenga mijengo au kutumia ardhi,<strong>na</strong> ni kinyume cha sheria kumiliki ardhi bila ruhusa hiyokuwa ni kwa maslahi <strong>ya</strong> umma <strong>ya</strong> kutoa amri kama hiyo.(4) Katika kuamua kama ni haki kuruhusu kufukuza <strong>watu</strong>, mahakama itazingatia-(a) Njia ambayo mkaazi huyo alimiliki ardhi hiyo kinyume cha sheria <strong>na</strong> kujenga mijengo;(b) Muda ambapo mtu aliyemiliki ardhi kwa njia zisizohalali,<strong>na</strong> familia <strong>ya</strong>ke wamekaakatika ardhi tetesi, <strong>na</strong>(c) Upatika<strong>na</strong>ji wa makaazi mbadala kwa a<strong>na</strong>yemiliki ardhi kinyume cha sheria(5) Taasisi <strong>ya</strong> serikali iliyotajwa katika kifungu cha (1) i<strong>na</strong>weza, kabla <strong>ya</strong> kuanzisha kesi kamahiyo, kutoa ilani si chini <strong>ya</strong> siku thelathini <strong>na</strong> taarifa kwa mmiliki wa ardhi kuanzisha kesi.12— Mwongozo wa kufuata wakati wa kuhamisha/kufukuza <strong>watu</strong>(1) Ambapo mahakama imetoa amri <strong>ya</strong> kufukuza <strong>watu</strong>, mchakato huo utafuata muongozoufuatao(a) Harakati <strong>ya</strong> kufukuza <strong>watu</strong> itafanyika mbele <strong>ya</strong> mwakilishi kutoka wizara <strong>ya</strong> ardhi <strong>na</strong>Huduma <strong>ya</strong> Polisi;(b) Watu wa<strong>na</strong>ohusika katika kufukuza <strong>watu</strong> watalazimika kuwa <strong>na</strong> vitambulisho <strong>na</strong>mmiliki ataweka rekodi <strong>ya</strong> vitambulisho v<strong>ya</strong> <strong>watu</strong> hao;(c) Mtu atakayetekeleza zoezi la kufukuza <strong>watu</strong> atawasilisha idhini rasmi akitakiwakufan<strong>ya</strong> hivyo wakati wa shughuli hiyo;(d) Kufurushwa au kuhamisha <strong>watu</strong> hakutatekelezwa wakati wa hali mba<strong>ya</strong> <strong>ya</strong> hewa,wakati wa usiku, wakati wa sikukuu au likizo <strong>ya</strong> dini, kabla <strong>ya</strong> uchaguzi, wakati waau tu kabla <strong>ya</strong> mitihani <strong>ya</strong> shule;(e) Hatua <strong>ya</strong> <strong>kuwahamisha</strong> <strong>watu</strong> itachukuliwa kwa <strong>na</strong>m<strong>na</strong> ambayo i<strong>na</strong>heshimu utu,haki <strong>ya</strong> maisha <strong>na</strong> usalama wa wale wa<strong>na</strong>oathirika; hatua maalum zitachukuliwakuhakikisha kwamba haki za bi<strong>na</strong>damu <strong>ya</strong> mazingira magumu, ikiwa ni pamoja <strong>na</strong>wa<strong>na</strong>wake <strong>na</strong> watoto i<strong>na</strong>waepusha <strong>na</strong> ai<strong>na</strong> yoyote <strong>ya</strong> ghasia;(f) Hatua maalum zitachukuliwa kulinda mali <strong>ya</strong> waliohamishwa dhidi <strong>ya</strong> uharibifu.(g) Mali iliyoachawa nyuma <strong>na</strong> <strong>watu</strong> wa<strong>na</strong>ohamishwa italindwa dhidi <strong>ya</strong> uharibifu, <strong>na</strong>kuambata<strong>na</strong> <strong>na</strong> sheria;(h) Kama ni lazima kutumia nguvu, matumizi <strong>ya</strong>ke <strong>ya</strong>taheshimu kanuni chini <strong>ya</strong> matakwa<strong>ya</strong> Katiba <strong>na</strong> viwango v<strong>ya</strong> kimataifa.(i) Wa<strong>na</strong>opaswa kuhama watapewa muda wa kutosha kuondoa mijengo au mali wa<strong>na</strong>yowezakutumia katika ardhi nyingine yoyote.36 <strong>Rasimu</strong> <strong>ya</strong> <strong>kuwahamisha</strong> <strong>watu</strong> <strong>na</strong> makazi map<strong>ya</strong> - Mwongozo <strong>na</strong> rasimu <strong>ya</strong> mswada, 2012


(2) Wakati tuu ambapo wa<strong>na</strong>ohamishwa wamekataa kutii amri <strong>ya</strong> mahakama <strong>ya</strong> kuhama aukuondoa mali <strong>ya</strong>o,basi sheria <strong>ya</strong> kuwafurusha itatumika13— Makaazi map<strong>ya</strong>(1) Kufuatia kuhamishwa, Katibu wa Baraza la Mawaziri itasimamia waliohamishwa kupata makaazimap<strong>ya</strong>.(2) Katibu wa Baraza la Mawaziri atachukua hatua <strong>ya</strong> kushirikisha wa<strong>na</strong>wake, <strong>watu</strong> wenye ulemavu<strong>na</strong> makundi mengine <strong>ya</strong>liyo katika michakato <strong>ya</strong> kupanga <strong>na</strong> kutekeleza <strong>na</strong> katika utoaji wahuduma muhimu wakati wa kushughulikia makazi map<strong>ya</strong>.(3) Hatua zitachukuliwa kuhakikisha kwamba —i. Familia hazitenganishwi;ii. Watu <strong>na</strong> mali zao zimelindwa;iii. Watu wa<strong>na</strong>weza kupata huduma za matibabu;iv. Huduma za ushauri zimetolewa;v. Tahadhari maalumu kwa <strong>watu</strong> wenye mahitaji maalum <strong>na</strong> <strong>watu</strong> wa<strong>na</strong>oishi katika mazingiramagumu;vi. Huduma <strong>ya</strong> matibabu <strong>ya</strong> muda mrefu kwa mtu a<strong>na</strong>yehamishwa haisambaratiki kutoka<strong>na</strong><strong>na</strong> matokeo <strong>ya</strong> kuhamishwa;vii. Kuhakikisha kuzuia kuenea kwa magonjwa <strong>na</strong> kuumbukiza <strong>watu</strong> katika maeneo walioyohamishwa;viii. Kuhakikisha chakula <strong>na</strong> maji <strong>ya</strong><strong>na</strong>tolewa, <strong>na</strong> usafi wa mazingira umedumishwaix. <strong>Makazi</strong> <strong>ya</strong> msingi <strong>na</strong> nyumba ni zi<strong>na</strong>zotolewa;x. Elimu kwa watoto i<strong>na</strong>tolewa vilviyo <strong>na</strong>xi. Mahitaji mengine <strong>ya</strong> rasilimali za maisha <strong>ya</strong><strong>na</strong>tolewa.(4) Katibu Baraza la Mawaziri atachukua hatua ili kuimarisha uwezo wa wale waliofurushwakuwa <strong>na</strong> uwezo wa kuzoea mazingira map<strong>ya</strong> <strong>na</strong> kutumia fursa zilizopo katika maeneo mp<strong>ya</strong>.(5) Katibu Baraza la Mawaziri atawajibika kulipa gharama yoyote, ikiwa ni pamoja <strong>na</strong> gharamaza makazi <strong>na</strong> atakuwa <strong>na</strong> wajibu wa kuhakikisha kwamba waliohamishwa kwenye makazimap<strong>ya</strong> wa<strong>na</strong> usalama wa umiliki ili kuepuka kufukuzwa siku zijazo.(6) Katibu wa Baraza la Mawaziri atachukua hatua kuhakikisha kuwa haku<strong>na</strong> mijengo mp<strong>ya</strong>i<strong>na</strong>yojengwa te<strong>na</strong> katika eneo ambalo <strong>watu</strong> wamefukuzwa.(7) Watu walioathirika watapewa <strong>na</strong>fasi <strong>ya</strong> kushiriki kikamilifu katika mipango <strong>na</strong> utekelezaji wampango wa makazi map<strong>ya</strong>.<strong>Rasimu</strong> <strong>ya</strong> <strong>kuwahamisha</strong> <strong>watu</strong> <strong>na</strong> makazi map<strong>ya</strong> - Mwongozo <strong>na</strong> rasimu <strong>ya</strong> mswada, 201237


(8) Mpango wa makazi map<strong>ya</strong> utakuwa <strong>na</strong> mpangilio maalum wa eneo au maeneo <strong>ya</strong>liolengwa<strong>kuwahamisha</strong> <strong>watu</strong>.(9) Pale Ambapo kufukuzwa kwa <strong>watu</strong> kumefanyika kwa kiwango kikubwa, Katibu wa Baraza laMawaziri atata<strong>ya</strong>risha mpango wa makazi map<strong>ya</strong>, ratiba <strong>na</strong> bajeti <strong>ya</strong> kuwapa makaazi map<strong>ya</strong>.(10) Pendekezo litakalofuatwa la kuchagua makazi map<strong>ya</strong> litaambata<strong>na</strong> <strong>na</strong> mazingira <strong>ya</strong> <strong>watu</strong>waliohamishwa hasa kwa <strong>watu</strong> kutoka mazingira <strong>ya</strong> kilimo au rasmi mijini.(11) Mpango wa makazi map<strong>ya</strong> utazingatia maslahi <strong>ya</strong> jamii husika <strong>na</strong> hasa, jinsi <strong>watu</strong> watakavyoingilia<strong>na</strong><strong>na</strong> wenyeji katika makazi map<strong>ya</strong> ili kusaidiwa kikamilifu kuwaunganisha kijamii<strong>na</strong> kiuchumi ili kupunguza madhara yoyote mba<strong>ya</strong> kwa jamii husika <strong>na</strong> wale waliohamishwakatika eneo hilo jip<strong>ya</strong>.14— Msaada wa kisheria kwa walifurushwa kwa njia zisizo halali(1) Bila kujali masharti <strong>ya</strong> sheria yoyote mtu yoyote aliyetishiwa au kufukuzwa a<strong>na</strong> haki <strong>ya</strong> kupatamsaada wa kisheria.(2) Mahakama i<strong>na</strong>weza kutoa amri hiyo ikiwa ni pamoja <strong>na</strong> tamko la haki za bi<strong>na</strong>damu, amri <strong>ya</strong>kutoa fidia, kulinga<strong>na</strong> kesi .15— Mamlaka <strong>ya</strong> mahakama <strong>ya</strong> Mazingira <strong>na</strong> Mahakama <strong>ya</strong> Ardhi(1) Bila kujali masharti <strong>ya</strong> sheria nyingine yoyote, mahakama i<strong>na</strong> mamlaka <strong>ya</strong> kutoa amri yoyoteau uongozi au kulazimisha adhabu yoyote chini <strong>ya</strong> mamlaka <strong>na</strong> masharti <strong>ya</strong> Sheria hii.(2) Rufaa kutoka mahakama <strong>ya</strong> hakimu itaelekezwa kwa mahakama <strong>ya</strong> Mazingira <strong>na</strong> Mahakama<strong>ya</strong> Ardhi.16— Makaazi <strong>na</strong> ukarabatiShughuli <strong>ya</strong> kuhamisha <strong>watu</strong> itatekelezwa kwa njia <strong>ya</strong> haki <strong>na</strong> usawa <strong>na</strong> kwa mujibu wa masharti<strong>ya</strong> Sheria hii, kanuni husika <strong>ya</strong> Katiba <strong>na</strong> viwango v<strong>ya</strong> kimataifa.17— Uchunguzi, tathmini <strong>na</strong> utekelezaji(1) Tume <strong>ya</strong> kitaifa <strong>ya</strong> kutetea haki za bi<strong>na</strong>damu <strong>na</strong> tume <strong>ya</strong> kitaifa <strong>ya</strong> ardhi , itafuatilia <strong>na</strong> ku-38 <strong>Rasimu</strong> <strong>ya</strong> <strong>kuwahamisha</strong> <strong>watu</strong> <strong>na</strong> makazi map<strong>ya</strong> - Mwongozo <strong>na</strong> rasimu <strong>ya</strong> mswada, 2012


chunguza visa v<strong>ya</strong> <strong>watu</strong> waliohamishwa kwa lazima <strong>na</strong> mwongozo wa serikali katika kutii <strong>na</strong>kutekeleza sheria za kimataifa za haki <strong>na</strong> kuandika ripoti kila mwaka itakayowasilishwa bungeniili kuelezea hali halisi,changamoto <strong>na</strong> kutoa mapendekezo <strong>ya</strong> kurekebisha swala hili.(2) Ripoti za kufuatilia hali halisia <strong>na</strong> matokeo <strong>ya</strong>ke <strong>ya</strong>tawekwa wazi kwa umma au vinginevyokutangazwa chini <strong>ya</strong> kifungu cha (1)18— Wajibu wa wadauWadau wote wa<strong>na</strong> wajibu wa kukuza, kulinda <strong>na</strong> kutimiza haki <strong>ya</strong> kumiliki nyumba <strong>na</strong> mali kabla,wakati <strong>na</strong> baada <strong>ya</strong> mtu kufukuzwa.19— Hatia <strong>ya</strong> kutoa ardhi kinyume cha sheria(1) Haku<strong>na</strong> mtu a<strong>na</strong>weza, iwe kupitia stakabadhi,ahadi au kupokea fedha kama malipo <strong>ya</strong> kuruhusumtu kumiliki ardhi bila ruhusa <strong>ya</strong> mmiliki mwenyewe.(2) Mtu yeyote a<strong>na</strong>yekiuka kifungu cha sheria (1) a<strong>na</strong> hatia <strong>na</strong> a<strong>na</strong>weza kuhukumiwa kifungokisichozidi mwaka mmoja au faini isiyozidi shillingi millioni moja(3) Mahakama ambayo imempata <strong>na</strong> hatia mtu yoyote a<strong>na</strong>yekiuka sehemu hii <strong>ya</strong> sheria, i<strong>na</strong>wezakuhakikisha fedha alizopokea zi<strong>na</strong>rejeshwa kwa <strong>watu</strong> ambao walidanganywa au iamuezisirejeshwe ikiwa <strong>watu</strong> hao hawapatikani.(4) Amri <strong>ya</strong> mahakama chini <strong>ya</strong> kifungu cha sheria (3) in athari <strong>ya</strong> <strong>na</strong> i<strong>na</strong>weza kutekelezwa dhidi<strong>ya</strong> mwenye hatia chini <strong>ya</strong> humuku <strong>ya</strong> raia kati <strong>ya</strong>ke <strong>na</strong> waliotoa fedha au kwa kuzingatia maamuzi<strong>ya</strong> serikali20— Hatia <strong>ya</strong> kumfukuza mtu kinyume <strong>na</strong> Sheria hii(1) Ni hatia kumfukuza mkaazi isipokuwa kupitia amri <strong>ya</strong> mahakama husika.(2) Haku<strong>na</strong> mtu a<strong>na</strong>yeruhusiwa makusudi au kuingilia kati <strong>na</strong> kumzuia afisa wa serikali au mpatanishikatika utendaji wa kazi <strong>ya</strong>ke katika suala la Sheria hii.(3) Mtu yeyote ambaye atakiuka sheria hii <strong>ya</strong> kifungu cha (1) au (2), atakuwa <strong>na</strong> hatia <strong>na</strong> kupigwafaini <strong>ya</strong> au si zaidi <strong>ya</strong> shilingi lefu mia tano, au kufungwa kifungu kisichozidi miaka miwili, auatozwe faini hiyo <strong>na</strong> kifungo.<strong>Rasimu</strong> <strong>ya</strong> <strong>kuwahamisha</strong> <strong>watu</strong> <strong>na</strong> makazi map<strong>ya</strong> - Mwongozo <strong>na</strong> rasimu <strong>ya</strong> mswada, 201239
