<strong>Application</strong> <strong>for</strong> <strong>compensation</strong> <strong>and</strong><br />

<strong>refunds</strong> <strong>after</strong> <strong>train</strong> <strong>delays</strong><br />

Dear customers,<br />

We regret any inconvenience caused by delay or cancellation of <strong>train</strong>s. We apologise <strong>for</strong> this <strong>and</strong> offer you <strong>compensation</strong> according to our<br />

fare regulations pursuant to the directive on Passengers’ Rights (Directive (EC) no. 1371/2007).<br />

• For a delay of 60 minutes onwards you will receive <strong>compensation</strong> to the amount of 25 %, <strong>and</strong> from 120 minutes onwards to the<br />

amount of 50 % of the ticket price paid <strong>for</strong> the single journey including reservations <strong>and</strong> surcharges, excluding any booking fees.<br />

You will not be entitled to receive <strong>compensation</strong> if only local <strong>train</strong>s were used (R, REX, suburban <strong>train</strong>s).<br />

• Holders of an ÖSTERREICHcard will receive a <strong>compensation</strong> lump sum to the amount of € 20 in Second Class <strong>and</strong> € 30 in First Class <strong>after</strong><br />

three <strong>delays</strong> from 60 minutes onwards, maximum ten percent of the sales price of the respective ÖSTERREICHcard.<br />

• Special provisions apply to annual tickets <strong>and</strong> international rail pass offers.<br />

• In the event that you missed the last connection by <strong>train</strong> of the day due to a <strong>train</strong> delay, we will refund the costs you incurred by using<br />

another public means of transport, possibly also taxi, to your destination as specified on the ticket or – if necessary – the accommodation<br />

expenses <strong>for</strong> a mid-range hotel.<br />

• Compensation amounts of less than € 4 will not be paid (neither by voucher nor by bank transfer).<br />

• We will compensate you in the <strong>for</strong>m of ÖBB vouchers (collectible at the ticket offices of ÖBB-Personenverkehr AG <strong>for</strong> all railway services),<br />

bank transfer, postal order or re-crediting to the credit card that was used to pay the ticket.<br />

• For detailed in<strong>for</strong>mation about your rights as a passenger go to www.oebb.at/fahrgastrechte. Please consider in particular the<br />

provisions regarding exclusion criteria <strong>and</strong> the maximum amounts of <strong>compensation</strong> in the event that you missed your last connecting<br />

<strong>train</strong>.<br />

Please fill in this <strong>for</strong>m completely be<strong>for</strong>e printing it. Please note that we can process only <strong>for</strong>ms that have been filled in completely <strong>and</strong><br />

signed.<br />

Send the <strong>for</strong>m with the originals or copies (certified copies on request) of tickets, reservations <strong>and</strong> other slips (confirmation of <strong>delays</strong>, taxicab<br />

or hotel bills, written confirmations <strong>for</strong> input tax deduction) to the following address (postage will be refunded in the event of justified<br />

<strong>compensation</strong> claims.):<br />

This address is exclusively in charge of applications <strong>for</strong> <strong>compensation</strong> <strong>after</strong> <strong>delays</strong> <strong>and</strong>/ or <strong>train</strong> cancellations. The fact that an application is<br />

accepted does not automatically mean you will receive <strong>compensation</strong>. It is obligatory <strong>for</strong> you to tell us whether you want to have original<br />

slips <strong>and</strong>/ or tickets returned to you.<br />

Please note that the railway undertaking that has issued a ticket is responsible <strong>for</strong> processing applications <strong>for</strong> <strong>compensation</strong>. If in your case<br />

this is not ÖBB-Personenverkehr AG, we will pass on the documents to the responsible railway undertaking.<br />
