curated to celebrate the <strong>350</strong>th anniversary of<br />

Sp<strong>in</strong>k. Every item here has been carefully selected<br />

by the heads of all the specialist departments at<br />

Sp<strong>in</strong>k to represent, <strong>in</strong> the broadest sense, the<br />

essence of what we do at Sp<strong>in</strong>k. We handle <strong>items</strong><br />

that speak of and reflect history, and all our<br />

specialists share a love of the objects they see on a<br />

daily basis.<br />

Sp<strong>in</strong>k was born <strong>in</strong> a tumultuous year <strong>in</strong> British<br />

history. Our founder, John Sp<strong>in</strong>k, as with so<br />

many others <strong>in</strong> the aftermath of the Great Fire of<br />

London <strong>in</strong> <strong>1<strong>66</strong>6</strong>, had to build his bus<strong>in</strong>ess from<br />

the ashes. We cont<strong>in</strong>ue that process of build<strong>in</strong>g<br />

today as we embrace new technologies and<br />

globalisation with fully fledged offices <strong>in</strong><br />

London, New York, Hong Kong, S<strong>in</strong>gapore and<br />

Switzerland. But, we never lose sight of our<br />

passion for history, the <strong>items</strong> we offer and you,<br />

our valued customers.<br />

1. An Exquisite Silver Gilt and Cloisonné Enamel Two Compartment Fabergé Stamp Box<br />

by the Famous Workmaster Fyodor Rückert, 1896-7, the h<strong>in</strong>ged lid at top beautifully<br />

enamelled with 5 and 7 Kopek stamps amid colourful scroll<strong>in</strong>g foliage, and open<strong>in</strong>g to a<br />

gilded and sloped <strong>in</strong>terior with central division, the ma<strong>in</strong> body of the box show<strong>in</strong>g a similar<br />

<strong>in</strong>tricate pattern with the different colours of the design separated by gilded rope effect bands;<br />

an extremely f<strong>in</strong>e and important stamp box made <strong>in</strong> the highest quality, which makes a great<br />

centre piece to any Stamp Box or F<strong>in</strong>e Russian Stamp collection. A great rarity.<br />

*Fyodor Rückert was a silver and goldsmith who worked with Carl Fabergé from 1887 <strong>in</strong> Moscow.<br />

restoration to England, 1<strong>66</strong>0, 70mm, by Pieter van Abeele, obverse shows Charles wear<strong>in</strong>g<br />

the George of the Order of the Garter, reverse fleet under sail, good very f<strong>in</strong>e, attractive and<br />

scarce.<br />

3. A Remarkable Entire, Believed to be the Earliest Recorded Penny Black on Cover<br />

show<strong>in</strong>g the full marg<strong>in</strong>al <strong>in</strong>scription, of which this is perhaps the prettiest <strong>in</strong> existence.<br />

GA, worn impression, with full sheet and marg<strong>in</strong> <strong>in</strong>scription “(In wett<strong>in</strong>g the) Back be careful<br />

not (to remove the cement)” and deckle edge at left, with good to large marg<strong>in</strong>s on the other<br />

three sides, affixed upside down (perhaps out of disrespect for the Queen) to entire letter,<br />

dated 13 May 1840. Addressed to Dubl<strong>in</strong>, tied by a red Maltese Cross cancellation, superb<br />

dated mark<strong>in</strong>gs and a bright green seal on reverse, f<strong>in</strong>e, fresh and uncreased.<br />

4. An Exact Surveigh of the Streets, Lanes, and Churches follow<strong>in</strong>g the Great Fire of<br />

London, 10 th December <strong>1<strong>66</strong>6</strong>, by Order of the Lord Mayor, John Leake, coloured <strong>in</strong> two<br />

parts, each 78 x 59cms, mounted on card, very clean and f<strong>in</strong>e, scarce; together with token co<strong>in</strong>s<br />

that can be placed on the map:<br />

a) William Adley, Bride Lane (Fleet Street), half penny, 1<strong>66</strong>3, very f<strong>in</strong>e.<br />

b) The Seven Stars, Cornhill, farth<strong>in</strong>g, 1648, very f<strong>in</strong>e.<br />

c) Will Hearne at Y Whit (the Bear), Bride Lane (Fleet Street), farth<strong>in</strong>g, f<strong>in</strong>e.<br />

d) Boars Head Tavern, Gt. Eastcheap, farth<strong>in</strong>g, f<strong>in</strong>e. Shakespeare, Burbage and Ben Jonson are all<br />

supposed to have frequented this tavern. It was totally destroyed <strong>in</strong> the Great Fire and subsequently<br />

rebuilt <strong>in</strong> 1<strong>66</strong>8.<br />

e) Edward Harris, Drury Lane, half penny, <strong>1<strong>66</strong>6</strong>, about very f<strong>in</strong>e.<br />

k) Jonathan Redock, Sharp’s Alley (Cow Cross), farth<strong>in</strong>g, 1<strong>66</strong>3, about very f<strong>in</strong>e.<br />

l) John Hall, New Exchange (Strand), farth<strong>in</strong>g, very f<strong>in</strong>e.<br />

m) Black Bell, Themes Street, farth<strong>in</strong>g, 1652, f<strong>in</strong>e.<br />

n) The Ship Without, Temple Bar, farth<strong>in</strong>g, 1649, f<strong>in</strong>e. The Ship Inn near Temple Bar goes back to the<br />

1570s and was <strong>in</strong> cont<strong>in</strong>uous use until reign of Queen Anne.<br />

o) The K<strong>in</strong>gs Tavern, Chancery Lane, farth<strong>in</strong>g, f<strong>in</strong>e. The K<strong>in</strong>g’s Head Tavern, its sign as on the token a<br />

bust of Henry VIII was the house of John Oldcastle, Baron Cobham (Shakespeare’s Sir John<br />

Falstaff). The Popish Plot was launched from here. The build<strong>in</strong>g was pulled down <strong>in</strong> 1799.<br />

*This beautiful survey is reduced<br />

and engraved by Vertue <strong>in</strong> 1723 for<br />

the Society of Antiquaries. It is a<br />

derivative of Leake’s 1<strong>66</strong>7 map of<br />

London after the Fire. The<br />

accompany<strong>in</strong>g tokens can be placed<br />

on the streets as they are<br />

contemporary. Tokens issued <strong>in</strong> the<br />

17 th century were struck to provide<br />

sufficient small denom<strong>in</strong>ation<br />

co<strong>in</strong>age as Parliament cont<strong>in</strong>ually<br />

failed to do so. Struck <strong>in</strong> copper or<br />

brass, often poorly and crudely they<br />

provide a wonderful social history of<br />

London at this time. They are<br />

becom<strong>in</strong>g <strong>in</strong>creas<strong>in</strong>gly rare.<br />

5. The Superb Russian Imperial Order of the White Eagle, bestowed upon Field Marshal the<br />

Lord Grenfell, K<strong>in</strong>g’s Royal Rifle Corps, Commander-<strong>in</strong>-Chief of the Egyptian Army, 1886-<br />

92; Aide-de-Camp to H.M. Queen Victoria; Governor of Malta, 1899-1903; Gold Stick to<br />

H.M. K<strong>in</strong>g Edward VII and H.M. K<strong>in</strong>g George V; and Commander of the Forces <strong>in</strong> Ireland,<br />

1904-08. Russia, Imperial, Order of the White Eagle, Civil Division, set of Insignia, by<br />

Keibel, St. Petersburg, sash Badge, 90mm <strong>in</strong>clud<strong>in</strong>g crown suspension x 60mm, gold (56<br />

zolotniki) and enamel, manufacturer’s mark, 1865-1896 assay office mark, and court stamp<br />

on eagle’s claws, manufacturer’s mark and court stamp on suspension loop; Star, 90mm,<br />

silver-gilt (84 zolotniki) and enamel, manufacturer’s name, 1865-96 assay office mark, and<br />

court stamp on reverse and on p<strong>in</strong>, blue enamel damage to crown tassels, otherwise extremely<br />

f<strong>in</strong>e, with short length of sash ribbon for display purposes (2).<br />

6. France, Unique use of French Stamps prior to the Official First Day of Issue (1 st<br />

January 1849), 1849-52, 20c. black, tied to entire by “AMIENS/31 DEC/1848” cachet a<br />

date and with arrival datestamp “OISEMONT/1 JANV/49” on reverse, f<strong>in</strong>e, exceptional and<br />

unique R. Calves (1996), Behr (2009) and Scheller (2009) certificates.<br />

7. Hong Kong and Shanghai Bank<strong>in</strong>g Corporation, Specimen $100, 1 st Jan. 1921,<br />

perforated, red SPECIMEN overpr<strong>in</strong>t, good extremely f<strong>in</strong>e, attractive and extremely rare.<br />

*The <strong>in</strong>spiration for the bank came from Thomas Sutherland, a Scot, who was work<strong>in</strong>g for the Pen<strong>in</strong>sula<br />

and Oriental Steam Navigation Company. He recognized the need for a commercial bank <strong>in</strong> Asia. The<br />

Hong Kong and Shanghai Bank<strong>in</strong>g Corporation Ltd opened <strong>in</strong> Hong Kong on 3 rd March 1865 and <strong>in</strong><br />

Shanghai one month later. It was the first locally owned and locally managed bank. Trade featured<br />

strongly <strong>in</strong> the bank’s operations; bullion, exchange, merchant bank<strong>in</strong>g and note issue. In 1874 the bank<br />

handled Ch<strong>in</strong>a’s first public loan and all the others thereafter.<br />

8. Real Compania de San Fernando de Sevilla, Certificate for One Share, 1748, no.2520,<br />

420 x 305mm, a classic design pr<strong>in</strong>ted <strong>in</strong> black on vellum, view of the Port and City of<br />

Seville, Neptune, sail<strong>in</strong>g ship and much more, <strong>in</strong>tricate paper seal, with some pieces miss<strong>in</strong>g at<br />

the upper right, quite good marg<strong>in</strong>s and a strong pr<strong>in</strong>t, very f<strong>in</strong>e.<br />

*Formed <strong>in</strong> 1747 to trade with all parts of South America, except Caracas and Havana. Company failed<br />

<strong>in</strong> the 1780s.<br />

9. K<strong>in</strong>gdom of Iraq Banknote, 100 D<strong>in</strong>ars of 1942, featur<strong>in</strong>g portrait of the child K<strong>in</strong>g Faisal<br />

II, very rare note <strong>in</strong> this condition.<br />

*K<strong>in</strong>g Faisal was the last monarch <strong>in</strong> Iraq, rul<strong>in</strong>g from 1939 to 1958, when he was deposed and<br />

assass<strong>in</strong>ated. He was used by Belgian comic writer, Hergé, as the model for Pr<strong>in</strong>ce Abdullah of Khemed<br />

<strong>in</strong> the Adventures of T<strong>in</strong>t<strong>in</strong>.<br />

10. Framed Portrait of Charles II, studio of Peter Lely (1618-1680). Oil on canvas; Head<br />

and Shoulders Portrait of Charles II dressed <strong>in</strong> Armour, pa<strong>in</strong>ted <strong>in</strong> a feigned oval, 75cms x<br />

60cms, conta<strong>in</strong>ed <strong>in</strong> a moulded ebonised frame (91cms x 79cms).<br />

*Lely was appo<strong>in</strong>ted as Charles II’s “Pr<strong>in</strong>cipal Pa<strong>in</strong>ter <strong>in</strong> Ord<strong>in</strong>ary” <strong>in</strong> 1<strong>66</strong>1, with a stipend of<br />

£200 per year. Demand was high and his studio was <strong>in</strong>creas<strong>in</strong>gly prolific; Lely pa<strong>in</strong>ted the sitter’s<br />

head and his pupils completed the portraits.<br />

11. Standard Oil Trust $100 Share, no.568, 1882, 300 x 195mm, signed by John D.<br />

Rockefeller as President and H.M. Flagler as Secretary, clean, good very f<strong>in</strong>e and scarce.<br />

*Standard Oil was the world’s first and largest mult<strong>in</strong>ational, which through its monopolistic approach at<br />

one po<strong>in</strong>t controlled 90% of all ref<strong>in</strong>ed oil <strong>in</strong> the U.S. as well as be<strong>in</strong>g the largest supplier of kerosene <strong>in</strong><br />

Ch<strong>in</strong>a. The Standard Oil Trust was controlled by a small group of families, giv<strong>in</strong>g evidence <strong>in</strong> 1910<br />

Rockefeller stated:<br />

“I th<strong>in</strong>k it is true that the Pratt family, the Payne-Whitney family, the Harkness-Flagler family and the<br />

Rockefeller family controlled the majority of the stock dur<strong>in</strong>g all the history of the company up to the present<br />

time.”<br />

The Trust was a mechanism much copied as it responded to State Laws which aimed to restrict the size<br />

of companies. By secret agreement the exist<strong>in</strong>g 37 shareholders conveyed their shares “<strong>in</strong> trust” to n<strong>in</strong>e<br />

trustees; John and William Rockefeller, Olivier Payne, Charles Pratt, Henry Flagler, John Archbold,<br />

William Warden, Jabez Bostwick and Benjam<strong>in</strong> Brewster. In 1911 the Trust was broken up under the<br />

Sherman Antitrust Act and split <strong>in</strong>to 34 companies; two are still very much with us today, Standard Oil<br />

of New Jersey (Exxon) and Standard Oil of New York (Mobil).<br />

lower-left corner of the sheet with Plate number “10” and <strong>in</strong>scription “Price 1d. Per. Label.<br />

1/- Per Row of 12. £1.~.~ Per Sheet. Place the Labels ABOVE the Addrefs and tow”, TA reentry,<br />

PA double letter A, RA-RF all “P” converted to “R”, good marg<strong>in</strong>s other sides,<br />

unused without gum, some creas<strong>in</strong>g, notably between the “Q” and “R” rows, fabulous<br />

colour. A stunn<strong>in</strong>g block.<br />

13. Great Fire of London Commemorative Medal, <strong>in</strong> 22ct gold (425gms), no.55 of 100<br />

struck, 19<strong>66</strong>, 75mm, reverse portrays the Great Seal of Charles II with London and old<br />

St. Paul’s before the Fire, the obverse symbolizes the re-birth of the city, uncirculated, sold<br />

with framed illustration of the Great Fire (2)<br />

*Start<strong>in</strong>g <strong>in</strong> a bakery <strong>in</strong> Pudd<strong>in</strong>g Lane the fire swept through the old medieval city <strong>in</strong>side the ancient<br />

Roman walls and fanned by high w<strong>in</strong>ds raged from Sunday 2 nd September to Wednesday 5 th September<br />

<strong>1<strong>66</strong>6</strong>. It destroyed some 13,000 houses, 87 churches and St. Paul’s Cathedral.<br />

14. Georgian Silver Broker’s Badge for London Stock Exchange, c. 1801-1830, 40mm,<br />

issued to John Norbury, extremely f<strong>in</strong>e and scarce.<br />

*John Norbury was Deputy Chairman of the Committee of the Stock Exchange. He was one of the<br />

promoters of <strong>in</strong>troduc<strong>in</strong>g a new Decimal Co<strong>in</strong>age <strong>in</strong> 1857.<br />

15. Richard III Groat, m<strong>in</strong>t mark Sun and Rose, dat<strong>in</strong>g this co<strong>in</strong> to the very end of Richard’s<br />

reign, be<strong>in</strong>g struck after 1484, 27mm, be<strong>in</strong>g the legend CIVITAS LONDON on the reverse<br />

of the co<strong>in</strong>, this example was struck <strong>in</strong> London, good very f<strong>in</strong>e.<br />

*Richard III was k<strong>in</strong>g for only two years and was the last k<strong>in</strong>g of the House of York and the Plantagenet<br />

dynasty. His defeat at the Battle of Bosworth Field marked the end of the Middle Ages <strong>in</strong> England.<br />

He was the last k<strong>in</strong>g of England to die on the battlefield. This co<strong>in</strong> was found at Bosworth Field<br />

Battlefield, 22 nd August 1485, and would have belonged to a soldier fight<strong>in</strong>g aga<strong>in</strong>st Henry Tudor, who<br />

won the day to found the Tudor Dynasty. This co<strong>in</strong> shows very little wear and would <strong>in</strong>dicate the co<strong>in</strong><br />

was struck perhaps to pay the troops head<strong>in</strong>g <strong>in</strong>to battle. Richard’s rema<strong>in</strong>s were found under a car park<br />

<strong>in</strong> 2013.<br />

Gate, about very f<strong>in</strong>e and an important historical piece.<br />

*17 th century tokens were issued by traders due to the failure of the Parliament to provide sufficient<br />

small denom<strong>in</strong>ation co<strong>in</strong>age. William Place offered a variety of services from lozenges, stationery and<br />

deliver<strong>in</strong>g letters. An advertisement placed <strong>in</strong> the Mercurius Publicus, no.24, June 15-22, 1<strong>66</strong>3:<br />

no.1642, 215 x 345mm, hand-signed by Guillaume Bolts and Charles de Proli, black<br />

pr<strong>in</strong>t<strong>in</strong>g with manuscript <strong>in</strong>sertions, receipts for four payments of 250 flor<strong>in</strong>s below, good<br />

very f<strong>in</strong>e.<br />

*This company was founded by Empress Maria Theresia as the last Austrian venture <strong>in</strong>to the East Indies<br />

trade. It was formed to take advantage of the Revolutionary Wars rag<strong>in</strong>g between France, Brita<strong>in</strong> and the<br />

Netherlands, and to monopolize their fallen trade. William Bolts, an adventurer and trader, <strong>in</strong>itiated the<br />

sett<strong>in</strong>g up of the company with Charles Proli, a banker. Initially bus<strong>in</strong>ess which focused on the tea trade<br />

with Ch<strong>in</strong>a was brisk, but on the sign<strong>in</strong>g of an Armistice <strong>in</strong> 1783 this trade reverted back to the English.<br />

Shortly after this the company went bankrupt; Proli’s bank collapsed and he committed suicide. Bolts<br />

went on to trade successfully on his own account.<br />

formed <strong>in</strong> 1825 to l<strong>in</strong>k Newcastle and Carlisle for transport<strong>in</strong>g m<strong>in</strong>erals. The first passengers were carried<br />

*The Key<strong>in</strong>g was the first Ch<strong>in</strong>ese Junk to visit<br />

England. She had been secretly purchased <strong>in</strong><br />

Hong Kong, break<strong>in</strong>g Ch<strong>in</strong>ese law, was<br />

manned by both British and Ch<strong>in</strong>ese crew and<br />

sailed from there to the U.S. and Brita<strong>in</strong><br />

between 1846 and 1848. Her arrival <strong>in</strong><br />

London caused quite a stir and visitors<br />

<strong>in</strong>clud<strong>in</strong>g Queen Victoria flocked to see her.<br />

pound locks and 20 horse hal<strong>in</strong>g<br />

bridges <strong>in</strong> 1758 at a cost of<br />

£14,070; over the next three years<br />

the navigation was opened <strong>in</strong><br />

sections. In August 1761 it was<br />

completed giv<strong>in</strong>g Northampton<br />

access to the sea. Thereafter the<br />

upkeep was to be paid for as this<br />

certificate testifies by tolls.<br />

33. Early Pr<strong>in</strong>ted British Passports (2),<br />

issued for Mr. St. Leger Glyn and the<br />

Honorable Mrs. Florence Glyn, 1864<br />

and 1871 respectively, 370 x 275mm,<br />

first bound <strong>in</strong> leather folder with<br />

various stamps, the second s<strong>in</strong>gle sheet.<br />

*The British Passport made its first written<br />

appearance as a “safe conduct” document dur<strong>in</strong>g<br />

the reign of Henry V. Henry VIII’s Privy Council<br />

issued a number of passports. S<strong>in</strong>ce 1794 all<br />

passports have been signed by the Secretary of State<br />

and records of each one issued exist from that date.<br />

Photographs were added <strong>in</strong> 1914 and the familiar<br />

blue document <strong>in</strong>troduced <strong>in</strong> 1921. This replaced<br />

by the ubiquitous standard design <strong>in</strong> 2003.<br />

34. Possibly Unique c. 1<strong>66</strong>0 English Messenger’s Post Bag, 170mm x 95mm x 135mm, <strong>in</strong><br />

leather with superb h<strong>in</strong>ges that are typical of the type used on furniture of the period.<br />

The rema<strong>in</strong>s of a wax seal appear on the top, further suggest<strong>in</strong>g that this was used as a<br />

leather carrier’s bag. Decorated with a scalloped edge, side h<strong>in</strong>ges/handles and brass<br />

supports to re-<strong>in</strong>force the sewn jo<strong>in</strong>ts. Included is a period letter, dated 1<strong>66</strong>0, sent from<br />

Great Yarmouth to a merchant <strong>in</strong> Norwich, which would have been carried <strong>in</strong> a pouch of<br />

this type, generally <strong>in</strong> good condition.<br />

*It is unlikely that a bag of this type would have been used as a money bag or as a place of safe keep<strong>in</strong>g<br />

for other valuables. The size would have been ideal for letters of the period that were suitably folded.<br />

The bag would probably have been attached to a belt and the post delivered privately. This is a rare<br />

survivor!<br />

35. Algeria Postal History, 1860, “Adieu” (declaration of love) written by Abd El Kader,<br />

Islamic Scholar, 180 x 130mm, clean, extremely f<strong>in</strong>e, important and rare.<br />

*Abd El Kader was a celebrated Islamic Scholar and revolutionary leader. Born <strong>in</strong>to religious aristocracy<br />

<strong>in</strong> Algiers, he was a Sharif by decent. In 1830 the French <strong>in</strong>vaded Algeria and he rose to unite and lead<br />

tribal opposition as Emir or Commander of the Faithful. His attacks on the French and general success<br />

us<strong>in</strong>g guerilla tactics forced a peace treaty <strong>in</strong> 1837 and left him and his followers with the prov<strong>in</strong>ce of<br />

Oran. This he used as a base to extend his <strong>in</strong>fluence and prov<strong>in</strong>ces, effectively creat<strong>in</strong>g a new State.<br />

Further clashes with the French were <strong>in</strong>evitable and after protracted fight<strong>in</strong>g he surrendered <strong>in</strong> 1847<br />

whereupon he was held <strong>in</strong> the Chateau of Amboise as a prisoner <strong>in</strong> appall<strong>in</strong>g conditions. Such was his<br />

fame and the <strong>in</strong>fluence of many high rank<strong>in</strong>g figures that Louis Napoleon Bonaparte on his tak<strong>in</strong>g power<br />

granted him a pardon, on the proviso that he didn’t <strong>in</strong>terfere <strong>in</strong> Algeria, and a generous pension of<br />

100,000 francs per annum. He retired to Damascus to devote his life to theology and philosophy (as<br />

well as writ<strong>in</strong>g various poems and a book on the Arabian Horse). In riots <strong>in</strong> Damascus aga<strong>in</strong>st the<br />

Christian m<strong>in</strong>ority he used his <strong>in</strong>fluence and offered protection to many Christians – sav<strong>in</strong>g many (some<br />

3,000 were killed). For this he received many decorations and plaudits from across Europe. Richard<br />

Burton, the famous explorer, who met him described him thus:<br />

“He dresses purely <strong>in</strong> white … enveloped <strong>in</strong> the usual snowy burnous … if you see him on horseback without<br />

know<strong>in</strong>g him to be Abd el Kadir, you would s<strong>in</strong>gle him out … he has the seat of a gentleman and a soldier.<br />

His m<strong>in</strong>d is as beautiful as his face; he is every <strong>in</strong>ch a Sultan”<br />

*British Treasury banknotes were overpr<strong>in</strong>ted for use by British troops <strong>in</strong> the Dardanelles. They were<br />

sent to Alexandria but never distributed as the Gallipoli Campaign as it came to be known was such a<br />

*Married by proxy <strong>in</strong> 1<strong>66</strong>2 Cather<strong>in</strong>e of Braganza brought tea dr<strong>in</strong>k<strong>in</strong>g to England from her native<br />

Portugal. She was a loyal and devoted wife <strong>in</strong> spite of endur<strong>in</strong>g a long procession of often public<br />

mistresses of Charles. Under the wedd<strong>in</strong>g contract England ga<strong>in</strong>ed Tangiers (which was to occupy<br />

Samuel Pepys) as well as luxuries and a huge chest of tea, which helped to pay off £300,000 of Charles’<br />

debts.<br />

and signed by him as Director, on thick paper, few tears at folds otherwise f<strong>in</strong>e and<br />

*Built to jo<strong>in</strong> the Grand Junction Canal to the River Thames at Limehouse, the canal was completed <strong>in</strong><br />

1820. John Nash the famous architect persuaded his friend the Pr<strong>in</strong>ce Regent (later George IV) to lend<br />

his name to the canal as he did for various other projects. John Nash was responsible for the look and<br />

layout of much of Regency London, design<strong>in</strong>g many build<strong>in</strong>gs that still survive today; from the<br />

magnificent Regents Street to the quirky Brighton Pavilion. As personal architect to the Pr<strong>in</strong>ce and K<strong>in</strong>g<br />

he remodelled Buck<strong>in</strong>gham Palace, Marble Arch and Regents Park. You can see two of his build<strong>in</strong>gs<br />

near Sp<strong>in</strong>k at 15-17 Bloomsbury Square and <strong>66</strong>-71 Great Russell Street.<br />

*Touch pieces were gold co<strong>in</strong>s used to cure disease or br<strong>in</strong>g good luck. Through touch they became<br />

amulets. British monarchs from Edward the Confessor to Queen Anne held ceremonies dur<strong>in</strong>g which<br />

through their “God given” powers of touch they healed the sick. Charles II m<strong>in</strong>ted special medalets for<br />

the ceremonies, which he took seriously. He didn’t, however, touch the diseased, but touched the<br />

medalets and then gave them to the sick. So he did touch this medalet.<br />

stunn<strong>in</strong>g portrait of the crowned head of Harold fac<strong>in</strong>g left hold<strong>in</strong>g a scepter, struck by the<br />

moneyer Aelfwold, extremely f<strong>in</strong>e and rare.<br />

*Harold, K<strong>in</strong>g of England 6 th January to 14 th October 10<strong>66</strong>. Harold was the last Saxon k<strong>in</strong>g of<br />

England, the son of Earl Godw<strong>in</strong>e of Wessex, who dom<strong>in</strong>ated the royal court and was brother-<strong>in</strong>-law to<br />

Edward the Confessor. Edward died on the 5 th January 10<strong>66</strong>, Harold was crowned quickly the follow<strong>in</strong>g<br />

day. Harold successfully defeated a Vik<strong>in</strong>g <strong>in</strong>vasion (mounted by Harald Hardrada of Norway) <strong>in</strong> the<br />

north of England, then had to march his exhausted army south to meet the Norman <strong>in</strong>vasion,<br />

culm<strong>in</strong>at<strong>in</strong>g <strong>in</strong> the Battle of Hast<strong>in</strong>gs, dur<strong>in</strong>g which he was killed. There are only around 600 surviv<strong>in</strong>g<br />

co<strong>in</strong>s of Harold II, many <strong>in</strong> museums and <strong>in</strong>stitutions, mak<strong>in</strong>g these one of the most desirable of English<br />

co<strong>in</strong>s. Only the penny denom<strong>in</strong>ation was struck dur<strong>in</strong>g his brief ten month reign.<br />

After an unfruitful search of the church<br />

look<strong>in</strong>g for contraband, Excisemen came to<br />

Eunson’s house, where he had gathered a<br />

group of mourners around a coff<strong>in</strong> covered <strong>in</strong><br />

a th<strong>in</strong> white sheet of fabric; beneath which<br />

was the illicit whisky.<br />

Magnus Eunson is credited as the founder of<br />

the Highland Park Distillery. Ironically, it was<br />

John Robertson, the officer who was<br />

responsible for Eunson’s eventual arrest and<br />

his fellow Exciseman, Robert Pr<strong>in</strong>gle, who<br />

purchased the High Park estate, where the<br />

Highland Park Distillery now stands, <strong>in</strong> April<br />

1813.<br />

Today, Highland Park is one of the very few<br />

left to <strong>in</strong>sist on malt<strong>in</strong>g its own barley.<br />

“shroffs” or money handlers based around purity of the silver and weight; subsequently broken down<br />

55. Silver Medal Commemorat<strong>in</strong>g the First Major U-Boat Action <strong>in</strong> the World, attractive<br />

medal with Capta<strong>in</strong> Otto Weddigen and s<strong>in</strong>k<strong>in</strong>g British ship portrayed, 1914, 35mm,<br />

attractive and scarce, sold with support<strong>in</strong>g books and contemporary illustration of the action.<br />

*Capta<strong>in</strong> Weddigen set off on the first ever submar<strong>in</strong>e patrol leav<strong>in</strong>g Heligoland <strong>in</strong> August 1914 with<br />

the express purpose of s<strong>in</strong>k<strong>in</strong>g British warships. On 22 nd September U-9, his boat, found and sank three<br />

British armoured cruisers <strong>in</strong> less than an hour with m<strong>in</strong>imal torpedoes. HMS Aboukir, Hogue and Cressy<br />

were sunk <strong>in</strong> quick succession with the loss of 1,459 British sailors. The action rema<strong>in</strong>s one of the most<br />

notable submar<strong>in</strong>e victories of all time.<br />

57. A Rare John Sp<strong>in</strong>k Farth<strong>in</strong>g Token, 1657, In Nicholas Lane (St. Nicholas Lane), f<strong>in</strong>e.<br />

*The surname Sp<strong>in</strong>k (Sp<strong>in</strong>ks or Sp<strong>in</strong>kes) was first recorded <strong>in</strong> the twelfth century and became quite<br />

commonplace by the later Middle Ages, when it is found especially <strong>in</strong> Yorkshire and East Anglia. The<br />

first records of a Sp<strong>in</strong>k be<strong>in</strong>g <strong>in</strong>volved with the bus<strong>in</strong>ess that would characterize the firm of Sp<strong>in</strong>k & Son<br />

occurs <strong>in</strong> the second half of the 17th century. An entry <strong>in</strong> the apprenticeship registers of the Worshipful<br />

Company of Goldsmiths shows that <strong>in</strong> 1658 John Sp<strong>in</strong>k was apprenticed to a London goldsmith named<br />

Alexander Venner. Why he came down from Yorkshire and how he became an apprentice is not known.<br />

We would assume that John Sp<strong>in</strong>k completed his apprenticeship 1<strong>66</strong>5/6 as they were normally for a<br />

period of seven years. If this were to be the case then the orig<strong>in</strong>s of the firm Sp<strong>in</strong>k & Son are <strong>in</strong>deed <strong>in</strong><br />

<strong>1<strong>66</strong>6</strong>. We do know from the records that a John Sp<strong>in</strong>k lived <strong>in</strong> St. Bride’s Prec<strong>in</strong>ct, Fleet Street, <strong>in</strong> a<br />

house with three hearths.<br />

The bus<strong>in</strong>ess of the goldsmiths who were ris<strong>in</strong>g <strong>in</strong> importance at this time was evolv<strong>in</strong>g <strong>in</strong>to one of<br />

money changers, lend<strong>in</strong>g money at <strong>in</strong>terest (bank<strong>in</strong>g) and lend<strong>in</strong>g money aga<strong>in</strong>st pledges of precious<br />

objects. Several other members of the Sp<strong>in</strong>k family were <strong>in</strong>volved <strong>in</strong> both activities dur<strong>in</strong>g the latter half<br />

of the 17th century.<br />

58. Ch<strong>in</strong>a, M<strong>in</strong>g Dynasty, Da M<strong>in</strong>g Bao Chao Banknote, 1 kuan, 1368-1399, black text on<br />

grey mulberry bark, red seal, attractive and rare <strong>in</strong> this condition.<br />

*Paper currency was <strong>in</strong>troduced <strong>in</strong>to Ch<strong>in</strong>a as early as 1,000AD, however, it was the M<strong>in</strong>g Dynasty<br />

(1385-1644) who were the first to try and replace co<strong>in</strong>s with paper money. But through the<br />

<strong>in</strong>troduction of too many notes by 1425 paper currency was suspended, be<strong>in</strong>g only worth one<br />

seventeenth of its orig<strong>in</strong>al value. A message on the note reads, “to counterfeit is death”.<br />

*Morris & Clayton were scriveners, merchant bankers and estate agents. They were one of the orig<strong>in</strong>al<br />

banks <strong>in</strong> the United K<strong>in</strong>gdom. Their unique contribution to bank<strong>in</strong>g history was to <strong>in</strong>tegrate the<br />

mortgage as a form of long-term security for loans. Sir Robert Clayton (1629-1707) was a banker (also<br />

one of first Directors of the Bank of England) and politician, who amassed a huge fortune through<br />

money lend<strong>in</strong>g <strong>in</strong> partnership with John Morris (1625-83). They lent money to landowners who were<br />

driven by the Civil War and Cromwellian period to seek credit <strong>in</strong> London. They dom<strong>in</strong>ated the market.<br />

Sir John Lewis was a senior London merchant, ironmonger, ship owner, knight and baronet who made<br />

his fortune <strong>in</strong> the East Indies and Persia (where he lived for ten years as a factor) with the East India<br />

Company. Pepys comments <strong>in</strong> his diary:<br />

“… down to the Lewes, Capta<strong>in</strong> Dek<strong>in</strong>s, his ship, a merchantman, where we met the owners Sir John Lewis<br />

and Alderman Lewes …”<br />

released by Gordon & MacPhail, an <strong>in</strong>dependent bottler<br />

This range was first launched <strong>in</strong> the 1960s, a period where<br />

most malts were used <strong>in</strong> blended whiskies, this was quite an<br />

unusual move to release a particular v<strong>in</strong>tage, but the range has<br />

proven to be a success for almost four decades.<br />

This bottle conta<strong>in</strong>s some rare sherried old sweet dram from<br />

the Millburn distillery <strong>in</strong> Inverness.<br />

Mombasa and adm<strong>in</strong>istered the coastal strip and Uganda. Generally it was <strong>in</strong>effective <strong>in</strong> adm<strong>in</strong>ister<strong>in</strong>g<br />

the territories assigned and was absorbed <strong>in</strong>to the Foreign Office <strong>in</strong> 1895. It did, however, survey the<br />

railway from Mombasa to Lake Victoria as well as the road. An <strong>in</strong>terest<strong>in</strong>g document from the British<br />

TERMS AND CONDITIONS FOR BUYERS (PRIVATE TREATY)<br />

These conditions set out the terms on which we (Sp<strong>in</strong>k and Son Limited of 69 Southampton Row, Bloomsbury London WC1B 4ET (company no. 04369748))<br />

contract with you (Buyer) either as agent on behalf of the Seller or as pr<strong>in</strong>cipal if we are the Seller. You should read these conditions carefully.<br />

1 DEFINITIONS<br />

The follow<strong>in</strong>g def<strong>in</strong>itions apply <strong>in</strong> these conditions:<br />

Dealers’ Marg<strong>in</strong> Scheme means a VAT marg<strong>in</strong> scheme as def<strong>in</strong>ed by HM Revenue & Customs;<br />

Certificate of Authenticity means a certificate issued by an Expert Committee confirm<strong>in</strong>g the authenticity of a Lot;<br />

Expert Committee means a committee of experts to whom a Lot may be sent for an extension <strong>in</strong> accordance with clause 3.4.3;<br />

Forgery<br />

means a Lot constitut<strong>in</strong>g an imitation orig<strong>in</strong>ally conceived and executed as a whole with a fraudulent <strong>in</strong>tention to deceive as to<br />

authorship, orig<strong>in</strong>, age, period, culture or source where the correct description as to such matters is not reflected by the description<br />

<strong>in</strong> the catalogue and which at the date of the auction had a value materially less than it would have had if it had been <strong>in</strong> accordance<br />

with the description <strong>in</strong> the catalogue. Accord<strong>in</strong>gly, no Lot shall be capable of be<strong>in</strong>g a Forgery by reason of any damage and/or<br />

restoration work of any k<strong>in</strong>d (<strong>in</strong>clud<strong>in</strong>g re-enamell<strong>in</strong>g);<br />

Hammer Price<br />

means the amount of the accepted offer by Sp<strong>in</strong>k <strong>in</strong> relation to a Lot;<br />

Lot<br />

means any item deposited with us for sale by private treaty or at auction and, <strong>in</strong> particular, the item or <strong>items</strong> described aga<strong>in</strong>st any<br />

Lot number <strong>in</strong> any catalogue;<br />

Reserve<br />

the amount below which we agree with the Seller that the Lot cannot be sold;<br />

Seller<br />

means the owner of the Lot be<strong>in</strong>g sold by us;<br />

Sp<strong>in</strong>k Group<br />

Sp<strong>in</strong>k and Son Limited, our subsidiaries and associated companies.<br />

VAT<br />

value added tax chargeable under VAT and any similar replacement or additional tax; and<br />

VAT Symbols means the symbols detail<strong>in</strong>g the VAT status of the Lot details of which are set out <strong>in</strong> par. 5.<br />

2 SPINK’S ROLE AS AGENT<br />

2.1 All sales undertaken by us either at auction or privately are<br />

undertaken either as agent on behalf of the Seller or from time to<br />

time, as pr<strong>in</strong>cipal if we are the owner of the Lot. Please note that even<br />

if we are act<strong>in</strong>g as agent on behalf of the Seller rather than as<br />

pr<strong>in</strong>cipal, we may have a f<strong>in</strong>ancial <strong>in</strong>terest <strong>in</strong> the Lot.<br />

2.2 The contract for the sale of the Lot will be between you and the<br />

Seller.<br />

3 BEFORE THE SALE<br />

3.1 Exam<strong>in</strong>ation of goods<br />

You are strongly advised to exam<strong>in</strong>e personally any goods <strong>in</strong> which<br />

you are <strong>in</strong>terested, before the auction takes place. Condition reports<br />

are usually available on request. We provide no guarantee to you<br />

other than <strong>in</strong> relation to Forgeries, as set out <strong>in</strong> clause 5.12 of these<br />

Terms and Conditions.<br />

3.2 Catalogue descriptions<br />

3.2.1 Statements by us <strong>in</strong> the catalogue or condition report, or made<br />

orally or <strong>in</strong> writ<strong>in</strong>g elsewhere, regard<strong>in</strong>g the authorship, orig<strong>in</strong>,<br />

date, age, size, medium, attribution, genu<strong>in</strong>eness, provenance,<br />

condition or estimated sell<strong>in</strong>g price of any Lot are merely<br />

statements of op<strong>in</strong>ion, and are not to be relied on as statements<br />

of def<strong>in</strong>itive fact. Catalogue and web illustrations are for guidance<br />

only, and should not be relied on either to determ<strong>in</strong>e the tone or<br />

colour of any item. No lot shall be rejected on the grounds of<br />

<strong>in</strong>accurate reproduction. No lot illustrated <strong>in</strong> the catalogue and<br />

onl<strong>in</strong>e shall be rejected on the grounds of cancellation, centr<strong>in</strong>g,<br />

marg<strong>in</strong>s, perforation or other characteristics apparent from the<br />

illustration. Estimates of the sell<strong>in</strong>g price should not be relied on<br />

as a statement that this price is either the price at which the Lot<br />

will sell or its value for any other purpose.<br />

3.2.2 Many <strong>items</strong> are of an age or nature which precludes their be<strong>in</strong>g<br />

<strong>in</strong> perfect condition and some descriptions <strong>in</strong> the catalogue or<br />

given by way of condition report make reference to damage<br />

and/or restoration. We provide this <strong>in</strong>formation for guidance<br />

only and the absence of such a reference does not imply that an<br />

item is free from defects or restoration nor does a reference to<br />

particular defects imply the absence of any others.<br />

3.2.3 Other than as set out <strong>in</strong> clause 5.12, and <strong>in</strong> the absence of<br />

fraud, neither the Seller nor we, nor any of our employees or<br />

agents, are responsible for the correctness of any statement as to<br />

the authorship, orig<strong>in</strong>, date, age, attribution, genu<strong>in</strong>eness or<br />

provenance of any Lot nor for any other errors of description or<br />

for any faults or defects <strong>in</strong> any Lot. Every person <strong>in</strong>terested<br />

should exercise and rely on his own judgment as to such matters.<br />

3.3 Your Responsibility<br />

You are responsible for satisfy<strong>in</strong>g yourself as to the condition of the<br />

goods and the matters referred to <strong>in</strong> the catalogue description.<br />

3.4 Extensions – Stamps only<br />

3.4.1 If you wish to obta<strong>in</strong> an expert op<strong>in</strong>ion or Certificate of<br />

Authenticity on any Lot (other than a mixed Lot or Lot<br />

conta<strong>in</strong><strong>in</strong>g undescribed stamps) you must notify us <strong>in</strong> writ<strong>in</strong>g at<br />

the time of plac<strong>in</strong>g your offer.<br />

If accepted by us, such request shall have the same effect as notice<br />

of an <strong>in</strong>tention to question the genu<strong>in</strong>eness or description of the<br />

Lot for the purposes of clause 5.12 (Refund <strong>in</strong> the case of<br />

Forgery) of these Terms and Conditions and the provisions of<br />

clause 5.12 (Refund <strong>in</strong> the case of Forgery) shall apply<br />

accord<strong>in</strong>gly.<br />

3.4.2 Notice of a request for an expert op<strong>in</strong>ion or Certificate of<br />

Authenticity must give the reason why such op<strong>in</strong>ion is required<br />

and specify the identity of your proposed expert which will be<br />

subject to agreement by us. We reserve the right, at our<br />

discretion, to refuse a request for an expert op<strong>in</strong>ion or Certificate<br />

of Authenticity <strong>in</strong>clud<strong>in</strong>g (without limitation) where the<br />

proposed expert is not known to us.<br />

3.4.3 If we accept a request for an expert op<strong>in</strong>ion or Certificate of<br />

Authenticity we will submit the Lot to the Expert Committee.<br />

You acknowledge and accept that the length of time taken by an<br />

Expert Committee to reach an op<strong>in</strong>ion will vary depend<strong>in</strong>g on<br />

the circumstances and <strong>in</strong> any event is beyond our control.<br />

3.4.4 We will not accept a request for an extension on account of<br />

condition. Any Lot described <strong>in</strong> the catalogue as hav<strong>in</strong>g faults or<br />

defects may not be returned even if an expert op<strong>in</strong>ion or<br />

Certificate of Authenticity cites other faults or defects not<br />

<strong>in</strong>cluded <strong>in</strong> the catalogue description, other than <strong>in</strong> the case of a<br />

Forgery.<br />

3.4.5 It should be noted that any stamp accompanied by a<br />

Certificate of Authenticity is sold on the basis of that Certificate<br />

only and not on the basis of any other description or warranty as<br />

to authenticity. No request for an extension will be accepted on<br />

such a stamp and the return of such a stamp will not be accepted.<br />

3.4.6 If you receive any correspondence from the Expert Committee<br />

<strong>in</strong> relation to the Lot, <strong>in</strong>clud<strong>in</strong>g but not limited to a Certificate<br />

of Authenticity, you must provide us with copies of such<br />

correspondence no later than 7 days after you receive such<br />

correspondence.<br />

4 AT THE SALE<br />

4.1 Refusal of participation<br />

We have the right, exercisable at our complete discretion, to refuse<br />

participation at the private treaty sale.<br />

4.2 Registration before plac<strong>in</strong>g offers<br />

You must complete and sign a registration form and provide<br />

identification before mak<strong>in</strong>g an offer. Please be aware that we usually<br />

require buyers to undergo a credit check.<br />

4.3 Plac<strong>in</strong>g offers as Pr<strong>in</strong>cipal<br />

When mak<strong>in</strong>g an offer (whether such offers are made <strong>in</strong> person or<br />

by way of written offer or email offer), you will be deemed to be<br />

act<strong>in</strong>g as pr<strong>in</strong>cipal and will be accept<strong>in</strong>g personal liability, unless it has<br />

been agreed <strong>in</strong> writ<strong>in</strong>g, at the time of registration, that you are act<strong>in</strong>g<br />

as agent on behalf of a third party buyer acceptable to us.<br />

4.4 Offers<br />

If you give us <strong>in</strong>structions to process your offer on your behalf, by<br />

us<strong>in</strong>g the form provided, we shall use reasonable endeavours to do so.<br />

If we receive offers on a particular Lot for identical amounts and these<br />

offers are the highest offers for the Lot and equal or higher than the<br />

acceptable price or the reserve, it will be sold to the person whose<br />

offer was received first. Process<strong>in</strong>g offers is undertaken subject to<br />

other commitments and we may be unable to process them as<br />

requested. S<strong>in</strong>ce this is undertaken as a free service to prospective<br />

buyers on the terms stated, we cannot accept liability for failure to<br />

process an offer.<br />

4.5 Offers by Sp<strong>in</strong>k<br />

4.5.1 We reserve the right to place offers on Lots on the Seller’s<br />

behalf up to the amount of the Reserve (if any), which will never<br />

be above the published price pr<strong>in</strong>ted on the price list.<br />

4.5.2 The Sp<strong>in</strong>k Group reserves the right to place offers on and<br />

purchase Lots as pr<strong>in</strong>cipal.<br />

4.6 Sp<strong>in</strong>k’s Discretion<br />

We have the right at our absolute discretion to refuse any if we decide<br />

to withdraw or divide any Lot, to comb<strong>in</strong>e any two or more Lots and,<br />

<strong>in</strong> the case of error or dispute, to put an item up for sale aga<strong>in</strong>.<br />

4.7 Successful Offer<br />

Subject to our discretion, the offer that equals or is higher than the<br />

price published on the price list, provided always that such offer is<br />

higher than the Reserve (where applicable), will be the hammer price<br />

and will mark the conclusion of a contract for sale between you and<br />

the Seller.<br />

4.8 Return of Lot<br />

4.8.1 Once your offer has been accepted for a Lot then you are liable<br />

to pay for that Lot <strong>in</strong> accordance with these Terms and<br />

Conditions. If there are any problems with a Lot then you must<br />

notify us with<strong>in</strong> 7 days of receipt of the Lot, specify<strong>in</strong>g the nature<br />

of the problem. We may then request that the Lot is returned to<br />

us for <strong>in</strong>spection. Save as set out <strong>in</strong> clause 5.12, the cancellation<br />

of the sale of any Lot and the refund of the correspond<strong>in</strong>g<br />

purchase price is entirely at our sole discretion. We will not<br />

normally exercise that discretion if the Lot is not received by us<br />

<strong>in</strong> the same condition that it was <strong>in</strong> at the time of purchase.<br />

4.8.2 No lot may be returned on account of condition if the<br />

condition was stated by a third party grad<strong>in</strong>g company<br />

(<strong>in</strong>clud<strong>in</strong>g, but not limited to PCGS, NGC, ANACS, ICG,<br />

PMG, WBG).<br />

5 AFTER THE SALE IS AGREED<br />

5.1 Hammer price, charges and Value Added Tax<br />

In addition to the Hammer Price, you must pay us a fee for pay<strong>in</strong>g<br />

by card and postal charge if Lot is shipped to you. For Lot marked as<br />

a Daggered (†) lot there is 20% VAT payable on the hammer price.<br />

5.2 VAT Refunds<br />

General<br />

5.2.1 As we rema<strong>in</strong> liable to account for VAT on all Lots unless they<br />

have been exported outside the EU with<strong>in</strong> 3 months of the date<br />

of sale, you will generally be asked to deposit all amounts of VAT<br />

<strong>in</strong>voiced. However, if a Sp<strong>in</strong>k nom<strong>in</strong>ated shipper is <strong>in</strong>structed,<br />

then any refundable VAT will not be collected. In all other cases<br />

credits will be made when proof of export is provided. If you<br />

export the Lot yourself you must obta<strong>in</strong> shipp<strong>in</strong>g documents<br />

from the Shipp<strong>in</strong>g Department for which a charge of £50 will be<br />

made.<br />

5.2.2 If you export the Lot you must return the valid proof of export<br />

certificate to us with<strong>in</strong> 3 months of the date of sale. If you fail to<br />

return the proof of export certificate to us with<strong>in</strong> such period and<br />

you have not already accounted to us for the VAT, you will be<br />

liable to us for the full amount of the VAT due on such Lot and<br />

we shall be entitled to <strong>in</strong>voice you for this sum.<br />

5.2.3 To apply for a refund of any VAT paid, the proof of export<br />

certificate must be sent to our Shipp<strong>in</strong>g Department clearly<br />

marked ‘VAT Refund’ with<strong>in</strong> 3 months of the date of sale. No<br />

payment will be made where the total amount of VAT refundable<br />

is less than £50 and Sp<strong>in</strong>k will charge £50 for each refund<br />

processed.<br />

VAT Refunds - Buyers from outside the EU<br />

5.2.4 Where the Lot is marked as a Daggered (†) Lot the VAT<br />

charged on the Hammer Price may be refunded where evidence<br />

of export from the EU is produced with<strong>in</strong> 3 months of the date<br />

of sale.<br />

5.3 Payment<br />

5.3.1 You must provide us with your full name and permanent<br />

address and, if so requested, details of the bank from which any<br />

payments to us will be made. You must pay the full amount due<br />

(compris<strong>in</strong>g the Hammer Price, card fee, postal charge and any<br />

applicable VAT) with<strong>in</strong> seven days after the date of the sale. This<br />

applies even if you wish to export the Lot and an export licence<br />

is (or may be) required.<br />

5.3.2 You will not acquire title to the Lot until all amounts due have<br />

been paid <strong>in</strong> full. This <strong>in</strong>cludes <strong>in</strong>stances where special<br />

arrangements were made for release of Lot prior to full<br />

settlement.<br />

5.3.3 Payment should be made <strong>in</strong> sterl<strong>in</strong>g by one of the follow<strong>in</strong>g<br />

methods:<br />

II(i) Direct bank transfer to our account details of which are set<br />

out on the <strong>in</strong>voice. All bank charges shall be met by you.<br />

Please ensure that your client number is noted on the<br />

transfer.<br />

i(ii) By cheque or bank draft made payable to Sp<strong>in</strong>k and Son<br />

Ltd and sent to Sp<strong>in</strong>k at 69 Southampton Row,<br />

Bloomsbury, London WC1B 4ET. Please note that the<br />

process<strong>in</strong>g charges for payments made by cheques or bank<br />

drafts drawn on a non-U.K bank shall be met by you.<br />

Please ensure that the remittance slip pr<strong>in</strong>ted at the bottom<br />

of the <strong>in</strong>voice is enclosed with your payment.<br />

(iii) By Visa, Mastercard or American Express. Payments made<br />

by American Express are subject to a 4% fee. All other<br />

credit cards and debit cards issued by overseas banks are<br />

subject to a fee of 2%. For all card payments there are limits<br />

to the amounts we will accept depend<strong>in</strong>g on the type of<br />

card be<strong>in</strong>g used and whether or not the cardholder is<br />

present.<br />

5.3.4 Payments should be made by the registered buyer and not by<br />

third parties, unless it has been agreed at the time of registration<br />

that you are act<strong>in</strong>g as an agent on behalf of a third party.<br />

5.4 Invoices<br />

Invoices may consist of one or more pages and will show: Zero rated<br />

Lots (o); no symbol Lots sold under the Dealers’ Marg<strong>in</strong> Scheme;<br />

Lots marked (g) special scheme Investment Gold; Daggered Lots (†),<br />

imported Lots marked (x) and (Ω), (e) Lots with Zero rated hammer<br />

for EU VAT registered buyers.<br />

5.5 Collection of Purchases<br />

5.5.1 We shall reta<strong>in</strong> lots purchased until 20 September 2016 and<br />

until all amounts due to us, or to the Sp<strong>in</strong>k Group, have been<br />

paid <strong>in</strong> full. Lots will not be released until cleared funds are<br />

received with regard to payments made by cheque.<br />

5.5.2 Unless we notify you to the contrary, <strong>items</strong> reta<strong>in</strong>ed by us will<br />

be covered <strong>in</strong> accordance with our policy which is available for<br />

<strong>in</strong>spection at our offices for a period of seven days after 20<br />

September 2016 or until the time of collection after 20<br />

September 2016, whichever is sooner. Lots purchased after 20<br />

September 2016 will be covered <strong>in</strong> accordance with our policy for<br />

seven days from the date of sale or until the time of collection,<br />

whichever is sooner.<br />

5.5.3 Our policy will not cover and we are unable to accept<br />

responsibility for damage caused by woodworm, changes <strong>in</strong><br />

atmospheric conditions or acts of terrorism.<br />

5.6 Notification<br />

We are not able to notify successful buyers by telephone. While<br />

Invoices are sent out by mail or email after the sale we do not accept<br />

responsibility for notify<strong>in</strong>g you of the result of your offer. You are<br />

requested to contact us by telephone or <strong>in</strong> person to obta<strong>in</strong> details of<br />

the outcome of your offers to avoid <strong>in</strong>curr<strong>in</strong>g charges for late<br />

payment.<br />

5.7 Pack<strong>in</strong>g and handl<strong>in</strong>g<br />

5.7.1 We shall use all reasonable endeavours to take care when<br />

handl<strong>in</strong>g and pack<strong>in</strong>g a purchased Lot but rem<strong>in</strong>d you that after<br />

seven days or from the time of collection, whichever is sooner,<br />

the Lot is entirely at your risk. Our postage charges are set out at<br />

the back of these terms.<br />

5.7.2 It is the responsibility of the Buyer to be aware of any Import<br />

Duties that may be <strong>in</strong>curred upon importation to the f<strong>in</strong>al<br />

dest<strong>in</strong>ation. Sp<strong>in</strong>k will not accept return of any package <strong>in</strong> order<br />

to avoid these duties. The onus is also on the Buyer to be aware<br />

of any Customs import restrictions that prohibit the importation<br />

of certa<strong>in</strong> collectibles. Sp<strong>in</strong>k will not accept return of the Lot(s)<br />

under these circumstances. Sp<strong>in</strong>k will not accept responsibility for<br />

Lot(s) seized or destroyed by Customs.<br />

5.7.3 If the Buyer requires delivery of the Lot to an address other<br />

than the <strong>in</strong>voice address this will be carried out at the discretion<br />

of Sp<strong>in</strong>k.<br />

5.8 Recommended packers and shippers<br />

If required our shipp<strong>in</strong>g department may arrange shipment as your<br />

agent. Although we may suggest carriers if specifically requested, our<br />

suggestions are made on the basis of our general experience of such<br />

parties <strong>in</strong> the past and we are not responsible to any person to whom<br />

we have made a recommendation for the acts or omissions of the<br />

third parties concerned.<br />

5.9 Remedies for non-payment or failure to collect purchases<br />

5.9.1 If you fail to make payment with<strong>in</strong> seven days of your<br />

stipulated payment date set out <strong>in</strong> your <strong>in</strong>voice, we shall be<br />

entitled to exercise one or more of the follow<strong>in</strong>g rights or<br />

remedies:<br />

5.9.1.1 to charge <strong>in</strong>terest at the rate of 2% per month compound<br />

<strong>in</strong>terest, calculated on a daily basis, from the date the full<br />

amount is due;<br />

5.9.1.2 to set off aga<strong>in</strong>st any amounts which the Sp<strong>in</strong>k Group<br />

may owe you <strong>in</strong> any other transaction the outstand<strong>in</strong>g amount<br />

rema<strong>in</strong><strong>in</strong>g unpaid by you;<br />

5.9.1.3 we may keep hold of all or some of your Lots or other<br />

property <strong>in</strong> the possession of the Sp<strong>in</strong>k Group until you have<br />

paid all the amounts you owe us or the Sp<strong>in</strong>k Group, even if<br />

the unpaid amounts do not relate to those Lots or other<br />

property. Follow<strong>in</strong>g fourteen days’ notice to you of the<br />

amount outstand<strong>in</strong>g and rema<strong>in</strong><strong>in</strong>g unpaid, the Sp<strong>in</strong>k Group<br />

shall have the right to arrange the sale of such Lots or other<br />

property. We shall apply the proceeds <strong>in</strong> discharge of the<br />

amount outstand<strong>in</strong>g to us or the Sp<strong>in</strong>k Group, and pay any<br />

balance to you;<br />

5.9.1.4 where several amounts are owed by you to the Sp<strong>in</strong>k<br />

Group <strong>in</strong> respect of different transactions, to apply any amount<br />

paid to discharge any amount owed <strong>in</strong> respect of any particular<br />

transaction, whether or not you so direct;<br />

5.9.1.5 to reject at any future auction any bids made by you or<br />

on your behalf or obta<strong>in</strong> a deposit from you before accept<strong>in</strong>g<br />

any bids.<br />

5.9.2 If you fail to make payment with<strong>in</strong> thirty-five days, we shall <strong>in</strong><br />

addition be entitled:<br />

5.9.2.1 to cancel the sale of the Lot or any other item sold to you<br />

at the same or any other sale;<br />

5.9.2.2 to arrange a resale of the Lot, publicly or privately, and,<br />

if this results <strong>in</strong> a lower price be<strong>in</strong>g obta<strong>in</strong>ed, claim the balance<br />

from you together with all reasonable costs <strong>in</strong>clud<strong>in</strong>g a 20%<br />

seller’s commission, expenses, damages, legal fees,<br />

commissions, premiums and fees of whatever k<strong>in</strong>d associated<br />

with both sales or otherwise, <strong>in</strong>curred <strong>in</strong> connection with your<br />

failure to make payment;<br />

5.9.2.3 when resell<strong>in</strong>g the Lot, place a notice <strong>in</strong> our catalogue<br />

stat<strong>in</strong>g that you successfully purchased the Lot but have<br />

subsequently failed to pay the Hammer Price of the Lot; or<br />

5.9.2.4 take any other appropriate action as we deem fit.<br />

5..9.3 Where purchases are not collected with<strong>in</strong> seven days after the<br />

sale, whether or not payment has been made, you will be<br />

required to pay a storage charge of £2 per item per day plus<br />

any additional handl<strong>in</strong>g cost that may apply. You will not be<br />

entitled to collect the Lot until all outstand<strong>in</strong>g charges are<br />

met, together with payment of all other amounts due to us.<br />

5.10 Uses of default <strong>in</strong>formation<br />

If you fail to make payment for a Lot <strong>in</strong> accordance with these Terms<br />

and Conditions:<br />

5.10.1 we reserve the right to refuse you the right to make bids or<br />

offers for any future auction or sale irrespective of whether<br />

previous defaults have been settled; and<br />

5.10.2 you consent to us disclos<strong>in</strong>g details of such default to other<br />

auctioneers and live bidd<strong>in</strong>g platforms, which will <strong>in</strong>clude your<br />

name, address, nature of the default and the date of the<br />

default.<br />

Auctioneers or live bidd<strong>in</strong>g platforms who receive details of<br />

the default may rely on such <strong>in</strong>formation when decid<strong>in</strong>g<br />

whether to enter <strong>in</strong>to a transaction with you <strong>in</strong> the future.<br />

5.11 Export Licence<br />

5.11.1 If required we can, at our discretion, advise you on the<br />

detailed provisions of the export licens<strong>in</strong>g regulations. Where we<br />

advise you <strong>in</strong> relation to export licens<strong>in</strong>g regulations the ultimate<br />

responsibility <strong>in</strong> respect of any export will lie with you and we will<br />

not be responsible for your failure to apply for any necessary<br />

licences.<br />

5.11.2 If the Lot is go<strong>in</strong>g to be hand carried by you, you may be<br />

required to produce a valid export licence to us or sign a waiver<br />

document stat<strong>in</strong>g that a licence will be applied for.<br />

5.11.3 You should always check whether an export licence is<br />

required before export<strong>in</strong>g. Export licences are usually obta<strong>in</strong>ed<br />

with<strong>in</strong> two or three weeks but delays can occur.<br />

5.11.4 Unless otherwise agreed by us <strong>in</strong> writ<strong>in</strong>g, the fact that you<br />

wish to apply for an export licence does not affect your obligation<br />

to make payment with<strong>in</strong> seven days nor our right to charge<br />

<strong>in</strong>terest on late payment.<br />

5.11.5 If you request that we apply for an export licence on your<br />

behalf, we shall be entitled to recover from you our<br />

disbursements and out of pocket expenses <strong>in</strong> relation to such<br />

application, together with any relevant VAT.<br />

5.11.6 We will not be obliged to resc<strong>in</strong>d a sale nor to refund any<br />

<strong>in</strong>terest or other expenses <strong>in</strong>curred by you where payment is<br />

made by you despite the fact that an export licence is required.<br />

5.12 Refund <strong>in</strong> the case of Forgery<br />

5.12.1 A sale will be cancelled, and the amount paid refunded to you<br />

if a Lot (other than a miscellaneous item not described <strong>in</strong> the<br />

catalogue) sold by us proves to have been a Forgery. We shall not<br />

however be obliged to refund any amounts if either (a) the<br />

catalogue description or saleroom notice at the auction date<br />

corresponded to the generally accepted op<strong>in</strong>ion of scholars or<br />

experts at that time, or fairly <strong>in</strong>dicated that there was a conflict of<br />

op<strong>in</strong>ions, or (b) it can be demonstrated that the Lot is a Forgery<br />

only by means of either a scientific process not generally accepted<br />

for use until after publication of the catalogue or a process which<br />

at the date of the auction was unreasonably expensive or<br />

impracticable or likely to have caused damage to the Lot.<br />

Furthermore, you should note that this refund can be obta<strong>in</strong>ed<br />

only if the follow<strong>in</strong>g conditions are met:<br />

5.12.1.1 you must notify us <strong>in</strong> writ<strong>in</strong>g, with<strong>in</strong> seven days of the<br />

receipt of the Lot(s), that <strong>in</strong> your view the Lot concerned is a<br />

Forgery;<br />

5.12.1.2 you must then return the item to us with<strong>in</strong> fourteen<br />

days from receipt of the Lot(s), <strong>in</strong> the same condition as at the<br />

auction date; and<br />

5.12.1.3 as soon as possible follow<strong>in</strong>g return of the Lot, you<br />

must produce evidence satisfactory to us that the Lot is a<br />

Forgery and that you are able to transfer good title to us, free<br />

from any third party claims.<br />

5.12.1.4 you must provide to us all evidence obta<strong>in</strong>ed by you<br />

that a Lot is a Forgery no later than 7 days after you receive<br />

such evidence.<br />

5.12.2 In no circumstances shall we be required to pay you any more<br />

than the amount paid by you for the Lot concerned and you shall<br />

have no claim for <strong>in</strong>terest.<br />

5.12.3 The benefit of this guarantee is not capable of be<strong>in</strong>g<br />

transferred, and is solely for the benefit of the person to whom<br />

the orig<strong>in</strong>al <strong>in</strong>voice was made out by us <strong>in</strong> respect of the Lot<br />

when sold and who, s<strong>in</strong>ce the sale, has rema<strong>in</strong>ed the owner of the<br />

Lot without dispos<strong>in</strong>g of any <strong>in</strong>terest <strong>in</strong> it to any third party.<br />

5.12.4 We shall be entitled to rely on any scientific or other process<br />

to establish that the Lot is not a Forgery, whether or not such<br />

process was used or <strong>in</strong> use at the date of the auction.<br />

6 LIABILITY<br />

Noth<strong>in</strong>g <strong>in</strong> these Terms and Conditions limits or excludes our liability for:<br />

6.1 death or personal <strong>in</strong>jury result<strong>in</strong>g from negligence; or<br />

6.2 any damage or liability <strong>in</strong>curred by you as a result of our fraud or<br />

fraudulent misrepresentation.<br />

7 USE OF YOUR PERSONAL INFORMATION<br />

7.1 We will use the personal <strong>in</strong>formation you provide to us to:<br />

7.1.1 process the offers or bids you make on Lots (whether<br />

successful or otherwise) and other auction related services we<br />

provide;<br />

7.1.2 process your payment relat<strong>in</strong>g to a successful purchase of a<br />

Lot;<br />

7.1.3 arrange for delivery of any Lot you purchase, which will<br />

<strong>in</strong>clude pass<strong>in</strong>g your details to shipp<strong>in</strong>g providers and, on<br />

overseas deliveries, to customs where they make enquiries<br />

regard<strong>in</strong>g the Lot;<br />

7.1.4 <strong>in</strong>form you about similar products or services that we provide,<br />

but you may stop receiv<strong>in</strong>g these at any time by contact<strong>in</strong>g us.<br />

7.2 In accordance with clause 4.2, you agree that we may pass your<br />

<strong>in</strong>formation to credit reference agencies and that they may keep a<br />

record of any search that they do.<br />

7.3 In accordance with clause 5.10, you agree that where you default on<br />

mak<strong>in</strong>g payment for a Lot <strong>in</strong> accordance with these terms and<br />

conditions we may disclose details of such default to other auctioneers<br />

and live bidd<strong>in</strong>g platforms.<br />

7.4 We are also work<strong>in</strong>g closely with third parties (<strong>in</strong>clud<strong>in</strong>g, for example,<br />

other auctioneers and live bidd<strong>in</strong>g platforms) and may receive<br />

<strong>in</strong>formation about you from them.<br />

8 COPYRIGHT<br />

8.1 We shall have the right (on a non-exclusive basis) to photograph,<br />

video or otherwise produce an image of the Lot. All rights <strong>in</strong> such an<br />

image will belong to us, and we shall have the right to use it <strong>in</strong><br />

whatever way we see fit.<br />

8.2 The copyright <strong>in</strong> all images, illustrations and written material relat<strong>in</strong>g<br />

to a Lot is and shall rema<strong>in</strong> at all times our property and we shall have<br />

the right to use it <strong>in</strong> whatever way we see fit. You shall not use or<br />

allow anyone else to use such images, illustrations or written material<br />

without our prior written consent.<br />

9 VAT<br />

You shall give us all relevant <strong>in</strong>formation about your VAT status. If we <strong>in</strong>cur<br />

any unforeseen cost or expense as a result of the <strong>in</strong>formation be<strong>in</strong>g<br />

<strong>in</strong>correct, you will reimburse to us on demand the full amount <strong>in</strong>curred.<br />

10 NOTICES<br />

All notices given under these Terms and Conditions may be served<br />

personally, sent by 1st class post, or faxed to the address given to the sender<br />

by the other party. Any notice sent by post will be deemed to have been<br />

received on the second work<strong>in</strong>g day after post<strong>in</strong>g or, if the addressee is<br />

overseas, on the fifth work<strong>in</strong>g day after post<strong>in</strong>g. Any notice sent by fax or<br />

served personally will be deemed to be delivered on the first work<strong>in</strong>g day<br />

follow<strong>in</strong>g despatch.<br />

11 ADDITIONAL PROVISIONS<br />

The follow<strong>in</strong>g provisions of this clause 11 shall apply only if you are act<strong>in</strong>g<br />

for the purposes of your bus<strong>in</strong>ess.<br />

11.1 Limitation of Liability<br />

Subject to clause 6, we shall not be liable, whether <strong>in</strong> tort (<strong>in</strong>clud<strong>in</strong>g<br />

for negligence) or breach of statutory duty, contract,<br />

misrepresentation or otherwise for any:<br />

11.1.1 loss of profits, loss of bus<strong>in</strong>ess, depletion of goodwill and/or<br />

similar losses, loss of anticipated sav<strong>in</strong>gs, loss of goods, loss of<br />

contract, loss of use, loss of corruption of data or <strong>in</strong>formation; or<br />

11.1.2 any special, <strong>in</strong>direct, consequential or pure economic loss,<br />

costs, damages, charges or expenses.<br />

11.2 Severability<br />

If any part of these Terms and Condition is found by any court to be<br />

<strong>in</strong>valid, illegal or unenforceable, that part may be discounted and the<br />

rest of the conditions shall cont<strong>in</strong>ue to be valid and enforceable to the<br />

fullest extent permitted by law.<br />

11.3 Force majeure<br />

We shall have no liability to you if we are prevented from, or delayed<br />

<strong>in</strong> perform<strong>in</strong>g, our obligations under these Terms and Conditions or<br />

from carry<strong>in</strong>g on our bus<strong>in</strong>ess by acts, events, omissions or accidents<br />

beyond our reasonable control, <strong>in</strong>clud<strong>in</strong>g (without limitation) strikes,<br />

lock-outs or other <strong>in</strong>dustrial disputes (whether <strong>in</strong>volv<strong>in</strong>g our<br />

workforce or the workforce of any other party), failure of a utility<br />

service or transport network, act of God, war, riot, civil commotion,<br />

malicious damage, compliance with any law or governmental order,<br />

rule, regulation or direction, accident, breakdown of plant or<br />

mach<strong>in</strong>ery, fire, flood, storm or default of suppliers or<br />

subcontractors.<br />

11.4 Waiver<br />

11.4.1 A waiver of any right under these Terms and Conditions is<br />

only effective if it is <strong>in</strong> writ<strong>in</strong>g and it applies only to the<br />

circumstances for which it is given. No failure or delay by a party<br />

<strong>in</strong> exercis<strong>in</strong>g any right or remedy under these Terms and<br />

Conditions or by law shall constitute a waiver of that (or any<br />

other) right or remedy, nor preclude or restrict its further<br />

exercise. No s<strong>in</strong>gle or partial exercise of such right or remedy shall<br />

preclude or restrict the further exercise of that (or any other)<br />

right or remedy.<br />

11.4.2 Unless specifically provided otherwise, rights aris<strong>in</strong>g under<br />

these Terms and Conditions are cumulative and do not exclude<br />

rights provided by law.<br />

11.5 Law and Jurisdiction<br />

11.5.1 These Terms and Conditions and any dispute or claim aris<strong>in</strong>g<br />

out of or <strong>in</strong> connection with them or their subject matter, shall<br />

be governed by, and construed <strong>in</strong> accordance with, the law of<br />

England and Wales.<br />

11.5.2 The parties irrevocably agree that the courts of England and<br />

Wales shall have exclusive jurisdiction to settle any dispute or<br />

claim that arises out of, or <strong>in</strong> connection with, Terms and<br />

Conditions or their subject matter.<br />
